May I admit them? Umar said; Yes. So he admitted them Then he came again and said; May I admit Ali and Abbas? He said; Yes. Abbas said; O; chief of the believers! Judge between me and this man Ali. Umar said; I beseech you by Allah by Whose permission both the heaven and the earth exist; do you know that Allah Messenger ﷺ said; Our the Apostles property will not be inherited; and whatever we leave after our death is to be spent in charity? And by that Allah Messenger ﷺ meant himself. The group said; No doubt ; he said so. Umar then faced Ali and Abbas and said; Do you both know that Allah Messenger ﷺ said that? They replied; No doubt ; he said so. Umar said; So let me talk to you about this matter. Allah favored His Apostle with something of this Fai i.e. booty won by the Muslims at war without fighting which He did not give to anybody else; Allah said:- And what Allah gave to His Apostle Fai Booty.........to do all things.... 59.6 And so that property was only for Allah Messenger ﷺ. Yet; by Allah; he neither gathered that property for himself nor withheld it from you; but he gave its income to you; and distributed it among you till there remained the present property out of which the Prophet ﷺ used to spend the yearly maintenance for his family; and whatever used to remain; he used to spend it where Allah property is spent i.e. in charity etc.. Allah Messenger ﷺ followed that throughout his life. Now I beseech you by Allah; do you know all that? They said; Yes. Umar then said to Ali and Abbas; I beseech you by Allah; do you know that? Both of them said; Yes. Umar added; And when the Prophet ﷺ died; Abu Bakr said; I am the successor of Allah Messenger ﷺ ; and took charge of that property and managed it in the same way as Allah Messenger ﷺ did. Then I took charge of this property for two years during which I managed it as Allah Messenger ﷺ and Abu Bakr did. Then you both Ali and Abbas came to talk to me; bearing the same claim and presenting the same case. O Abbas! You came to me asking for your share from the property of your nephew; and this man Ali came to me; asking for the share of h is wife from the property of her father. I said; If you both wish; I will give that to you on that condition i.e. that you would follow the way of the Prophet ﷺ and Abu Bakr and as I Umar have done in man aging it. Now both of you seek of me a verdict other than that? Lo! By Allah; by Whose permission both the heaven and the earth exist; I will not give any verdict other than that till the Hour is established. I betook myself to Ibn Abd Yalil Bin Abd Kulal with the purpose of inviting him to Islam; but he did not respond to me as I desired. So I departed with signs of deep distress on my face. I did not recover until I reached Qarn AlThaalib. Where I raised my head; lo! near me was a cloud which had cast its shadow on me. I looked and lo! there was in it the angel Jibril who called out to me and said: God; the Honoured and Glorious; has heard what thy people have said to thee; and how they have reacted to thy call. And He has sent to thee the angel in charge of the mountains so that thou mayest order him what thou wishest him to do with regard to them. The angel in charge of the mountains then called out to me; greeted me and said: Muhammad; God has listened to what thy people have said to thee. I am the angel in charge of the mountains; and thy Lord has sent me to thee so that thou mayest order me what thou wishest. If thou wishest that I should bring together the two mountains that stand opposite to each other at the extremities of Mecca to crush them in between; I would do that. SahihMuslim-017-001-19386 | AIsha reported: When I came under discussion what the people had to say about me; Allah Messenger ﷺ stood up for delivering an address and he recited tashahhud I bear witness to the fact that iheie is no god but Allah and praised Allah; lauded Him what He rightly deserves and then said: Coming to the point. Give me an advice about them who have brought false charge about my family. By Allah; I know no evil in the members of my family and the person in connection with whom the false charge is being levelled; I know no evil in him too. And he never entered my house but in my presence and when I was away on a journey; he remained with me even in that. The rest of the hadith is the same but with this change that Allah Messenger ﷺ came to my house and asked my maidservant and she said: By Allah; I know no fault in her but this that she sleeps; and goat comes and eats the kneaded flour. Some of the Companions of the Holy Prophet scolded her and said: State the fact before Allah Messenger ﷺ and they even made a pointed reference to this incident. She said: gallowed be Allah. By Allah; I know about her as does the jeweller know about the pure piece of gold. And when this news reached the person in connection with whom the allegation was made he said: Hallowed be Allah. By Allah; I have never unveiled any woman. Aisha said: He fell as a martyr in the cause of Allah; and there is this addition in this hadith that the people who had brought false allegation amongst them were Mistah and Hamna and Hassan. And so far as the hypocrite Abdullah Bin Ubay is concerned; he was one who tried his best to gather the false news and then gave them the wind. So Salman went to them and said: I am only a man from among you; a Persian; and you see that the Arabs obey me. If you become Muslims then you will have the likes of what we have; and from you will be required that which is required from us. The version of Ibn Jawas has: I say them in the supplication of the witr. They were: O Allah; guide me among those Thou hast guided; grant me security among those Thou hast granted security; take me into Thy charge among those Thou hast taken into Thy charge; bless me in what Thou hast given; guard me from the evil of what Thou hast decreed; for Thou dost decree; and nothing is decreed for Thee. SunanAbuDawoud-017-001-28966 | Narrated Yahya Bin Said: Abd AlHamid Bin Abdullah Bin Abdullah Bin Umar Bin AlKhattab copied to me a document about the religious endowment waqf made by Umar Bin AlKhattab : In the name of Allah; the Compassionate; the Merciful. This is what Allah servant Umar has written about Thamgh. He narrated the tradition like the one transmitted by Nafi. He added: provided he is not storing up goods for himself. The surplus fruit will be devoted to the beggar and the deprived. He then went on with the tradition; saying: If the man in charge of Thamgh wishes to buy a slave for his work for its fruits by selling them ; he may do so. Muiqib penned it and Abdullah Bin AlArqam witnessed it : In the name of Allah; the Compassionate; the Merciful. This is what Allah servant Umar ; Commander of Faithful; directed; in case of some incident happens to him i.e. he dies ; that Thamg; Sirmah Bin AlAkwa; the servant who is there; the hundred shares in the land of Khaibr; the servant who is there and the hundred sahres which Muhammad ﷺ had donated to me in the valley nearly will remain in the custody of Hafsah during her life; then the men of opinion from her family will be in charge of these endowments ; that these will neither be sold not purchased; spending its produce where they think necessary on the beggar; deprived and relatives. The amir ruler who is over the people is a shepherd and is responsible for his flock; a man is a shepherd in charge of the inhabitants of his household and he is responsible for his flock; a woman is a shepherdess in charge of her husband house and children and she is responsible for them; and a man slave is a shepherd in charge of his master property and he is responsible for it. MuwataMalik-017-001-35567 | Yahya related to me from Malik from Yahya Ibn Said that Zurayq Ibn Hayan; who was in charge of Egypt in the time of AlWalid; Sulayman; and Umar Ibn Abd AlAziz; mentioned that Umar Ibn Abd AlAziz had written to him saying; Assess the muslims that you come across and take from what is apparent of their wealth and whatever merchandise is in their charge; one dinar for every forty dinars; and the same proportion from what is less than that down to twenty dinars; and if the amount falls short of that by one third of a dinar then leave it and do not take anything from it. As for the people of the Book that you come across; take from the merchandise in their charge one dinar for every twenty dinars; and the same proportion from what is less than that down to ten dinars; and if the amount falls short by one third of a dinar leave it and do not take anything from it. Give them a receipt for what you have taken f rom them until the same time next year. Malik said; The position among us in Madina concerning goods which are being managed for trading purposes is that if a man pays zakat on his wealth; and then buys goods with it; whether cloth; slaves or something similar; and then sells them before a year has elapsed over them; he does not pay zakat on that wealth until a year elapses over it from the day he paid zakat on it. He does not have to pay zakat on any of the goods if he does not sell them for some years; and even if he keeps them for a very long time he still only has to pay zakat on them once when he sells them. Malik said; The position among us concerning a man who uses gold or silver to buy wheat; dates; or whatever; for trading purposes and keeps it until a year has elapsed over it and then sells it; is that he only has to pay zakat on it if and when he sells it; if the price reaches a zakatable amount. This is therefore not the same as the harvest crops that a man reaps from his land; or the dates that he harvests from his palms. Malik said; A man who has wealth which he invests in trade; but which does not realise a zakatable profit for him; fixes a month in the year when he takes stock of what goods he has for trading; and counts the gold and silver that he has in ready money; and if all of it comes to a zakatable amount he pays zakat on it. Malik said; The position is the same for muslims who trade and muslims who do not. MuwataMalik-017-001-35577 | Yahya related to me from Zayd Ibn Aslam from Ata Ibn Yasar that the Messenger of Allah; may Allah bless him and grant him peace; said; Zakat is not permissible for someone who is not in need except for five: someone fighting in the way of Allah; someone who collects zakat; someone who has suffered financial loss at the hands of debtors ; someone who buys it with his own money; and some one who has a poor neighbour who receives some zakat and gives some as a present to the one who is not in need. Malik said; The position with us concerning the dividing up of zakat is that it is up to the individual judgement of the man in charge wali. Whichever categories of people are in most need and are most numerous are given preference; according to how the man in charge sees fit. It is possible that that may change after one year; or two; or more; but it is always those who are in need and are most numerous that are given preference; whatever category they may belong to. This is what I have seen done by people of knowledge with which I am satisifed. MuwataMalik-017-001-35612 | Yahya related to me from Malik that he had heard people of knowledge say; When a woman dies and there are no women with her to wash her and no man who has the right by blood ties to take charge of that for her and no husband to take charge of it for her; she should be purified by tayammum ;that is; by wiping her face and hands with earth. Malik said; When a man dies and there are only women with him; they also should purify him with earth. Malik said; There is no particular way with us for washing the dead nor any recognised way to do it.
