SahihAlBukhari-017-001-1139 | Narrated Abu Said: The Prophet ﷺ mentioned a man from the people of the past or those who preceded you. The Prophet ﷺ said a sentence meaning: Allah had given him wealth and children. When his death approached; he said to his sons; What kind of father have I been to you? They replied; You have been a good father. He told them that he had not presented any good deed before Allah; and if Allah should get hold of him He would punish him. So look! he added; When I die; burn me; and when I turn into coal; crush me; and when there comes a windy day; scatter my ashes in the wind. The Prophet ﷺ added; Then by Allah; he took a firm promise from his children to do so; and they did so. They burnt him after his death and threw his ashes on a windy day. Then Allah commanded to his ashes. Be; and behold! He became a man standing! Allah said; O My slave! What made you do what you did? He replied; For fear of You. SahihAlBukhari-017-001-1174 | Narrated Ibn Umar: A Jew and Jewess were brought to the Prophet ﷺ on a charge of committing an illegal sexual intercourse. The Prophet ﷺ asked the Jews; What do you usually do with them? They said; We blacken their faces and disgrace them. He said; Bring here the Torah and recite it; if you are truthful. They fetched it and came and asked a one-eyed man to recite. He went on reciting till he reached a portion on which he put his hand. The Prophet ﷺ said; Lift up your hand! He lifted his hand up and behold; there appeared the verse of AlRajm stoning of the adulterers to death. Then he said; O Muhammad! They should be stoned to death but we conceal this Divine Law among ourselves. Then the Prophet ﷺ ordered that the two sinners be stoned to death and; and they were stoned to death; and I saw the man protecting the woman from the stones. SahihAlBukhari-017-001-1208 | Narrated Abu Huraira: While we were with Allah Messenger ﷺ a bedouin got up and said; O Allah Messenger ﷺ ! Settle my case according to Allah Book Laws. Then his opponent got up and said; O Allah Messenger ﷺ ! He has said the truth! Settle his case according to Allah Book Laws. and allow me to speak; He said; My son was a laborer for this man and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death but I ransomed him with one-hundred sheep and a slave girl. Then I asked the religious learned people and they told me that his wife should be stoned to death and my son should receive one-hundred lashes and be sentenced to one year of exile. The Prophet ﷺ said; By Him in Whose Hands my life is; I will judge between you according to Allah Book Laws : As for the slave girl and the sheep; they are to be returned; and as for your son; he shall receive onehundred lashes and will be exiled for one year. You; O Unais! addressing a man from Bani Aslam; Go tomorrow morning to the wife of this man and if she confesses; then stone her to death. While I was in his house at Mina; and he was with Umar Bin AlKhattab during Umar last Hajj; Abdulrahman came to me and said; Would that you had seen the man who came today to the Chief of the Believers Umar ; saying; O Chief of the Believers! What do you think about so-and-so who says; If Umar should die; I will give the pledge of allegiance to such-andsuch person; as by Allah; the pledge of allegiance to Abu Bakr was nothing but a prompt sudden action which got established afterwards. Umar became angry and then said; Allah willing; I will stand before the people tonight and warn them against those people who want to deprive the others of their rights the question of rulership. Abdulrahman said; I said; O Chief of the believers! Do not do that; for the season of Hajj gathers the riff-raff and the rubble; and it will be they who will gather around you when you stand to address the people. And I am afraid that you will get up and say something; and some people will spread your statement and may not say what you have actually said and may not understand its meaning; and may interpret it incorrectly; so you should wait till you reach Medina; as it is the place of emigration and the place of Prophet Traditions; and there you can come in touch with the learned and noble people; and tell them your ideas with confidence; and the learned people will understand your statement and put it in its proper place. On that; Umar said; By Allah! Allah willing; I will do this in the first speech I will deliver before the people in Medina. Ibn Abbas added: We reached Medina by the end of the month of Dhu AlHijja; and when it was Friday; we went quickly to the Masjid as soon as the sun had declined; and I saw Saeed Bin Zaid Bin Amr Bin Nufail sitting at the corner of the pulpit; and I too sat close to him so that my knee was touching his knee; and after a short while Umar Bin AlKhattab came out; and when I saw him coming towards us; I said to Saeed Bin Zaid Bin Amr Bin Nufail Today Umar will say such a thing as he has never said since he was chosen as Caliph. Saeed denied my statement with astonishment and said; What thing do you expect Umar to say the like of which he has never said before? In the meantime; Umar sat on the pulpit and when the callmakers for the prayer had finished their call; Umar stood up; and having glorified and praised Allah as He deserved; he said; Now then; I am going to tell you something which Allah has written for me to say. I do not know; perhaps it portends my death; so whoever understands and remembers it; must narrate it to the others wherever his mount takes him; but if somebody is afraid that he does not understand it; then it is unlawful for him to tell lies about me. Allah sent Muhammad with the Truth and revealed the Holy Book to him; and among what Allah revealed; was the Verse of the Rajam the stoning of married person male & female who commits illegal sexual intercourse; and we did recite this Verse and understood and memorized it. Allah Messenger ﷺ did carry out the punishment of stoning and so did we after him. I am afraid that after a long time has passed; somebody will say; By Allah; we do not find the Verse of the Rajam in Allah Book; and thus they will go astray by leaving an obligation which Allah has revealed. And the punishment of the Rajam is to be inflicted to any married person male & female ; who commits illegal sexual intercourse; if the required evidence is available or there is conception or confession. And then we used to recite among the Verses in Allah Book: O people! Do not claim to be the offspring of other than your fathers; as it is disbelief unthankfulness on your part that you claim to be the offspring of other than your real father. Then Allah Messenger ﷺ said; Do not praise me excessively as Jesus; son of Marry was praised; but call me Allah Slave and His Apostles. O people! I have been informed that a speaker amongst you says; By Allah; if Umar should die; I will give the pledge of allegiance to such-and-such person. One should not deceive oneself by saying that the pledge of allegiance given to Abu Bakr was given suddenly and it was successful. No doubt; it was like that; but Allah saved the people from its evil; and there is none among you who has the qualities of Abu Bakr. Remember that whoever gives the pledge of allegiance to anybody among you without consulting the other Muslims; neither that person; nor the person to whom the pledge of allegiance was given; are to be supported; lest they both should be killed. And no doubt after the death of the Prophet ﷺ we were informed that the Ansar disagreed with us and gathered in the shed of Bani Sada. Ali and AlZubair and whoever was with them; opposed us; while the emigrants gathered with Abu Bakr. I said to Abu Bakr; Let go to these Ansari brothers of ours. So we set out seeking them; and when we approached them; two pious men of theirs met us and informed us of the final decision of the Ansar; and said; O group of Muhajirin emigrants ! Where are you going? We replied; We are going to these Ansari brothers of ours. They said to us; You shouldnt go near them. Carry out whatever we have already decided. I said; By Allah; we will go to them. And so we proceeded until we reached them at the shed of Bani Sada. Behold! There was a man sitting amongst them and wrapped in something. I asked; Who is that man? They said; He is Saad Bin Ubada. I asked; What is wrong with him? They said; He is sick. After we sat for a while; the Ansar speaker said; None has the right to be worshipped but Allah; and praising Allah as He deserved; he added; To proceed; we are Allah Ansar helpers and the majority of the Muslim army; while you; the emigrants; are a small group and some people among you came with the intention of preventing us from practicing this matter of caliphate and depriving us of it. When the speaker had finished; I intended to speak as I had prepared a speech which I liked and which I wanted to deliver in the presence of Abu Bakr; and I used to avoid provoking him. So; when I wanted to speak; Abu Bakr said; Wait a while. I disliked to make him angry. So Abu Bakr himself gave a speech; and he was wiser and more patient than I. By Allah; he never missed a sentence that I liked in my own prepared speech; but he said the like of it or better than it spontaneously. After a pause he said; O Ansar! You deserve all the qualities that you have attributed to yourselves; but this question of Caliphate is only for the Quraish as they are the best of the Arabs as regards descent and home; and I am pleased to suggest that you choose either of these two men; so take the oath of allegiance to either of them as you wish. And then Abu Bakr held my hand and Abu Ubaida Bin AlJarrah hand who was sitting amongst us. I hated nothing of what he had said except that proposal; for by Allah; I would rather have my neck chopped off as expiator for a sin than become the ruler of a nation; one of whose members is Abu Bakr; unless at the time of my death my own-self suggests something I dont feel at present. And then one of the Ansar said; I am the pillar on which the camel with a skin disease eczema rubs itself to satisfy the itching i.e.; I am a noble ; and I am as a high class palm tree! O Quraish. There should be one ruler from us and one from you. Then there was a hue and cry among the gathering and their voices rose so that I was afraid there might be great disagreement; so I said; O Abu Bakr! Hold your hand out. He held his hand out and I pledged allegiance to him; and then all the emigrants gave the Pledge of allegiance and so did the Ansar afterwards. And so we became victorious over Saad Bin Ubada whom AlAnsar wanted to make a ruler. One of the Ansar said; You have killed Saad Bin Ubada. I replied; Allah has killed Saad Bin Ubada. Umar added; By Allah; apart from the great tragedy that had happened to us i.e. the death of the Prophet ; there was no greater problem than the allegiance pledged to Abu Bakr because we were afraid that if we left the people; they might give the Pledge of allegiance after us to one of their men; in which case we would have given them our consent for something against our real wish; or would have opposed them and caused great trouble. The man husband was of yellow complexion; thin; and of lank hair; while the man whom he had accused of having been with his wife; was reddish brown with fat thick legs and fat body. The Prophet ﷺ said; O Allah! Reveal the truth. Later on the lady delivered a child resembling the man whom the husband had accused of having been with her. So the Prophet ﷺ made them take the oath of Lian. A man said to Ibn Abbas in the gathering; Was that the same lady about whom the Prophet ﷺ said; If I were to stone any lady for committing illegal sexual intercourse to death without witnesses; I would have stoned that lade to death? He the narrator said that he went back not far; then came and said: Allah Messenger; purify me. whereupon Allah Messenger ﷺ said: Woe be upon you; go back and ask forgiveness of Allah and turn to Him in repentance. He the narrator said that he went back not far; when he came and said: Allah Messenger; purify me. Allah Apostle ﷺ said as he had said before. When it was the fourth time; Allah Messenger may; ﷺ said: From what am I to purify you? He said: From adultery; Allah Messenger ﷺ asked if he had been mad. He was informed that he was not mad. He said: Has he drunk wine? A person stood up and smelt his breath but noticed no smell of wine. Thereupon Allah Messenger ﷺ said: Have you committed adultery? He said: Yes. He made pronouncement about him and he was stoned to death. The people had been divided into two groups about him Maiz. One of them said: He has been undone for his sins had encompassed him; whereas another said: There is no repentance more excellent than the repentance of Maiz; for he came to Allah Apostle ﷺ and placing his hand in his in the Holy Prophets hand said: Kill me with stones. This controversy about Maiz remained for two or three days. Then came Allah Messenger ﷺ to them his Companions as they were sitting. He greeted them with salutation and then sat down and said: Ask forgiveness for Maiz Bin Malik. They said: May Allah forgive Maiz Bin Malik. Thereupon Allah Messenger ﷺ said: He Maiz has made such a repentance that if that were to be divided among a people; it would have been enough for all of them. He the narrator said: Then a woman of Ghamid; a branch of Azd; came to him and said: Messenger of of Allah; purify me; whereupon he said: Woe be upon you; go back and beg forgiveness from Allah and turn to Him in repentance. She said: I find that you intend to send me back as you sent back Maiz. Bin Malik. He the Holy; Prophet said: What has happened to you? She said that she had become pregnant as a result of fornication. He the Holy Prophet said: Is it you who has done that ? She said: Yes. He the Holy Prophet said to her: You will not be punished until you deliver what is there in your womb. One of the Ansar became responsible for her until she was delivered of the child. He that Ansari came to Allah Apostle ﷺ and said the woman of Ghamid has given birth to a child. He the Holy Prophet said: In that case we shall not stone her and so leave her infant with none to suckle him. One of the Ansar got up and said: Allah Apostle; let the responsibility of his suckling be upon me. SahihMuslim-017-001-18031 | Abu Qatada reported: We accompanied the Messenger of Allah my ﷺ on an expedition in the year of the Battle of Hunain. When we encountered the enemy; some of the Muslims turned back in fear. I saw that a man from the polytheists overpowered one of the Muslims. I turned round and attacked him from behind giving a blow between his neck and shoulder. He turned towards me and grappled with me in such a way that I began to see death staring me in the face. Then death overtook him and left me alone. I joined Umar Bin AlKhattab who was saying: What has happened to the people that they are retreating ? I said: It is the Decree of Allah. Then the people returned. The battle ended in a victory for the Muslims and the Messenger of Allah ﷺ sat down to distribute the spoils of war. He said: One who has killed an enemy and can bring evidence to prove it will get his belongings. So I stood up and said: Who will give evidence for me? Then I sat down. Then he the Holy Prophet said like this. I stood up again and said: Who will bear witness for me? He the Holy Prophet made the same observation the third time; and I stood up once again. Now the Messenger of Allah ﷺ said: What has happened to you; O Abu Qatada? Then I related the whole story; to him. At this; one of the people said: He has told the truth. Messenger of Allah 1 The belongings of the enemy killed by him are with me. Persuade him to forgo his right in my favour. Objecting to this proposal Abu Bakr said: BY Allah; this will not happen. The Messenger of Allah ﷺ will not like to deprive one of the lions from among the lions of Allah who fight in the cause of Allah and His Messenger and give thee his share of the booty. So the Messenger of Allah may peace he upon him said: He Abu Bakr has told the truth; and so give the belongings to him Abu Qatada. So he gave them to me. I sold the armour which was a part of my share of the booty and bought with the sale proceeds a garden in the street of Banu Salama. This was the first property I acquired after embracing Islam. SahihMuslim-017-001-18043 | It is narrated on the authority of Urwa Bin AlZubair who narrated from Aisha that she informed him that Fatima; daughter of the Messenger of Allah ﷺ ; sent someone to Abu Bakr to demand from him her share of the legacy left by the Messenger of Allah ﷺ from what Allah had bestowed upon him at Medina and Fadak and what was left from one-filth of the income annually received from Khaibar. Abu Bakr said: The Messenger of Allah ﷺ said: We prophets do not have any heirs; what we leave behind is to be given in charity. The household of the Messenger of Allah ﷺ will live on the income from these properties; but; by Allah; I will not change the charity of the Messenger of Allah ﷺ from the condition in which it was in his own time. I will do the same with it as the Messenger of Allah may peace be upun him himself used to do. So Abu Bakr refused to hand over anything from it to Fatima who got angry with Abu Bakr for this reason. She forsook him and did not talk to him until the end of her life. She lived for six months after the death of the Messenger of Allah ﷺ. When she died; her husband. Ali Bin Abu Talib; buried her at night. He did not inform Abu Bakr about her death and offered the funeral prayer over her himself. During the lifetime of Fatima; All received special regard from the people. After she had died; he felt estrangement in the faces of the people towards him. So he sought to make peace with Abu Bakr and offer his allegiance to him. He had not yet owed allegiance to him as Caliph during these months. He sent a person to Abu Bakr requesting him to visit him unaccompanied by anyone disapproving the presence of Umar. Umar said to Abu Bakr: BY Allah; you will not visit them alone. Abu Bakr said: What will they do to me? By Allah; I will visit them. And he did pay them a visit alone. All recited Tashahhud as it is done in the beginning of a religious sermon ; then said: We recognise your moral excellence and what Allah has bestowed upon you. We do not envy the favour i. e. the Catiphate which Allah nas conferred upon you; but you have done it assumed the position of Caliph alone without consulting us ; and we thought we had a right to be consulted on account of our kinship with the Messenger of Allah ﷺ. He continued to talk to Abu Bakr in this vein until the latter eyes welled up with tears. Then Abd Bakr spoke and said: By Allah; in Whose Hand is my life; the kinship of the Messenger of Allah ﷺ is dearer to me than the kinship of my own people. As regards the dispute that has arisen between you and me about these properties; I have not deviated from the right course and I have not given up doing about them what the Messenger of Allah ﷺ used to do. So Ali said to Abu Bakr: This aftetnoon is fixed for swearing allegiance to you. So when Abu Bakr had finished his Zuhr prayer; he ascended the pulpit and recited Tashahhud; and described the status of Ali; his delay in swearing allegiance and the excuse which lie had offered to him for this delay. After this he asked for God forgiveness. Then Ali Bin Abu Talib recited the Tashahhud. extolled the merits of Abu Bakr and said that his action was nott prompted by any jealousy of Abu Bakr on his part or his refusal to accept the high position which Allah had conferred upon him; adding: But we were of the opinion that we should have a share in the government; but the matter had been decided without taking us into confidence; and this displeased us. Hence the delay in offering allegiance. The Muslims were pleased with this explanation and they said: You have done the right thing. Abu Bakr refused to give her this; and said: I am not going to give up doing anything which the Messenger of Allah ﷺ used to do. I am afraid that it I go against his instructions in any matter I shall deviate from the right course. So far as the charitable endowments at Medina were concerned; Umar handed them over to Ali and Abbas; but Ali got the better of him and kept the property under his exclusive possession. And as far as Khaibar and Fadak were concerned Umar kept them with him; and said: These are the endowments of the Messenger of Allah ﷺ to the Umma. Their income was spent on the discharge of the responsibilities that devolved upon him on the emergencies he had to meet. And their management was to be in the hands of one who managed the affairs of the Islamic State. SahihMuslim-017-001-18066 | It has been narrated on the authority of Anas Bin Malik who said: When the Muhajirs migrated from Mecca to Medina; they came in a state that they had not anything i. e. money in theirhands; while the Ansar possessed lands and date palms. They divided their properties with the Muhajirs. The Ansar divided and gave them on the condition that they would give half the fruit from the orchards every year; and the Muhajirs would recompense them by working with them and putting in labour. The mother of Anas Bin Malik was called Umm Sulaim and she was also the mother of Abdullah Bin Talha who was a brother of Anas from his mother side. The mother of Anas had given the Messenger of Allah ﷺ her date-palms. He bestowed them upon Umm Aiman; the slave-girl who had been freed by him and was the mother of Usama Bin Zaid. When the Messenger of Allah ﷺ had finished the war with the people of Khaibar and returned to Medina; the Muhajirs returned to the Ansar all the gifts which they had given them out of the fruits. Anas Bin Malik said: The Messenger of. Allah ﷺ returned to my mother her date-palms and gave to Umm Aiman instead of them date-palms from his orchard. Ibn Shihab says that Umm Aiman was the mother of Usama Bin Zaid who was the slave-girl of Abdullah Bin Abd AlMuttalib and hailed from Abyssinia. When Amina gave birth to the Messenger of Allah ﷺ after the death of his father; Umm Aiman used to nurse him until he grew up. He later on freed her and married her to Zaid Bin Haritha. SahihMuslim-017-001-18133 | It has been reported on the authority of Salama Bin Akwa who said: On the day of the Battle of Khaibar my brother fought a fierce fight by the side of the Messenger of Allah ﷺ. His sword rebounded and killed him. The Companions of the Messenger of Allah may peace be upon hill talked about his death and doubted whether it was martyrdom. They said : He is a man killed by his own weapon; and expressed doubt about his affair. Salama said: When the Messenger of Allah ﷺ returned from Khaibar; I said: Messenger of Allah; permit me that I may recite to you some rajaz verses. The Messenger of Allah ﷺ permitted him. Umar Bin AlKhattab said: I know what you will recite. I recited: By God; if God had guided us not; We would hive neither been guided aright nor practised charity; Nor offered prayers. I said: By God; some people are reluctant to invoke God mercy on him because they say he is a man who died by his own sword. Hearing this the Messenger of Allah ﷺ said: He died as God devotee and warrior. Ibn Shihab has said: I asked one of the sons of Salama Bin Akwa about the death of Amir. He related to me a similar tradition except that he said: When I said some people were reluctant invoke God blessings on him; the Messenger of Allah may peace be; upon him said: They lied. Amir died as God devotee and warrior in the cause of Allah. And there was a person his name was Quzman and he was one of the hypocrites among the Companions of the Messenger of Allah ﷺ who did not spare a detached fighter of the enemy but pursued and killed him with the sword. They the Companions of the Holy Prophet said: None served us better today than this man Upon this the Messenger of Allah ﷺ remarked: Verily he is one of the denizens of Fire. One of the people Muslims said: I will constantly shadow him. Then this man went out along with him. He halted whenever he halted; and ran along with him whenever he ran. He the narrator said: The man was seriously injured. He could not stand the pain and hastened his own death. He placed the blade of the sword on the ground with the tip between his chest and then pressed himself against the sword and killed himself. Then the man following him went to the Messenger of Allah ﷺ and said: I bear testimony that verily thou art the Messenger of Allah; He the Holy Prophet said: What is the matter? He replied: The person about whom you just mentioned that he was one among the denizens of Fire and the people were surprised at this and I said to them that I would bring the news about him and consequently I went out in search of him till I found him to be very seriously injured. He hastened his death. He placed the blade of the sword upon the ground and its tip between his chest and then pressed himself against that and killed himself. Thereupon the Messenger of Allah ﷺ remarked: A person performs the deeds which to the people appear to be the deeds befitting the dweller of Paradise; but he is in fact one of the denizens of Hell. SahihMuslim-017-001-19151 | Yusair Bin Jabir reported: Once there blew a red storm in Kufah that there came a person who had nothing to say but these words : Abdullah Bin Masud; the Last Hour has come. He Abdullah Bin Masud was sitting reclining against something; and he said: The Last Hour would not come until shares of inheritance are not distributed and there is no rejoicing over spoils of war. Then he said pointing towards Syria; with the gesture of his hand like this: The enemy shall muster strength against Muslims and the Muslims will muster strength against them Syrians. I said: You mean Rome? And he said: Yes; and there would be a terrible fight and the Muslims would prepare a detachment for fighting unto death which would not return but victorious. They will fight until night will intervene them; both the sides will return without being victorious and both will be wiped out. The Muslims will again prepare a detachment for fighting unto death so that they may not return but victorious. When it would be the fourth day; a new detachment out of the remnant of the Muslims would be prepared and Allah will decree that the enemy should be routed. And they would fight such a fight the like of which would not be seen; so much so that even if a bird were to pass their flanks; it would fall down dead before reaching the end of them. There would be such a large scale massacre that when counting would be done; only one out of a hundred men related to one another would be found alive. So what can be the joy at the spoils of such war and what inheritance would be divided! They would be in this very state that they would hear of a calamity more horrible than this. And a cry would reach them: The Dajjal has taken your place among your offspring. They will; therefore; throw away what would be in their hands and go forward sending ten horsemen; as a scouting party. SahihMuslim-017-001-19373 | Abu Saeed AlKhudri reported Allah Messenger ﷺ as saying: There was a person before you who had killed ninety-nine persons and then made an inquiry about the learned persons of the world who could show him the way to salvation. He was directed to a monk. He came to him and told him that he had killed ninety-nine persons and asked him whether there was any scope for his repentance to be accepted. He said: No. He killed him also and thus completed one hundred. He then asked about the learned persons of the earth and he was directed to a scholar; and he told him that he had killed one hundred persons and asked him whether there was any scope for his repentance to be accepted. He said: Yes; what stands between you and the repentance? You better go to such and such land; there are people devoted to prayer and worship and you also worship along with them and do not come to the land of yours since it was an evil land for you. So he went away and he had hardly covered half the distance when death came to him and there was a dispute between the angels of mercy and the angels of punishment. The angels of mercy said: This man has come as a penitant and remorseful to Allah and the angels of punishment said: He has done no good at all. Then there came another angel in the form of a human being in order to decide between them. He said: You measure the land to which he has drawn near. They measured it and found him nearer to the land where he intended to go the land of piety ; and so the angels of mercy took possession of it. They went to AlSham for their business; and they were approached by a freed slave of Banu Sahm; who was called Budail Bin Abi Maryam; with some trade. He had a bowl they wanted made of silver; but he wanted a great deal for it. Then he became ill; and willed it to them; and he commissioned them to deliver what was left to his family. Tamim said: When he died; we took that bowl and we sold it for one-thousand Dirham. Then Adi Bin Badda and I divided it. When we went to his family to give them what was with us; they searched for the bowl and asked about it. We said: He did not leave behind other than this; nor did he give us other than this. Tamim said: When I accepted Islam; after the Messenger of Allah ﷺ had arrived in AlMadinah; I felt guilty about that; so I went to his family; and informed them about what had happened. I gave them fifty-thousand Dirham and told them my companion had the same. They took him to the Messenger of Allah ﷺ but he asked them for their proof; which they did not have; so he ordered them; to have him to take an oath in accordance with whatever the people of his religion revered; so he took the oath. Then Allah revealed: O you who believe! When death approaches any of you then take the testimony... up to His saying: Or else they would fear that oaths will be admitted after their oaths 5:106. He said: My son was a laborer serving this man; and he committed Zina with his wife. They told me that my son was to be stoned to death; but I ransomed him with one hundred sheep and a slave girl of mine. Then I asked the people of knowledge; who told me that my son was to be given one hundred lashes and exiled for a year; and that his the mans wife was to be stoned to death. His opponent; who was wiser than him; stood up and said: He is right; pass judgment between us according to the Book of Allah. He said: Speak. He said: My son was a laborer serving this man; and he committed Zina with his wife. I ransomed him with one hundred sheep and a servant. It is as if he was told that his son was to be stoned to death but he ransomed him from that. Then I asked some knowledgeable men and they told me that my son was to be given one hundred lashes and exiled for a year. The Messenger of Allah SAWSYMOBOL said to him: By the One in Whose hand is my soul; I will pass judgment between you according to the Book of Allah; the Mighty and Sublime. MuwataMalik-017-001-34813 | Malik said; The generally agreed-on way of doing things among us in the case of slave whose master makes a bequest to free part of him - a third; a fourth; a half; or any share after his death; is that only the portion of him is freed that his master has named. This is because the freeing of that portion is only obliged to take place after the death of the master because the master has the option to withdraw the bequest as long as he lives. When the slave is freed from his master; the master is a testator and the testator only has access to free what he can take from his property; being the third of the property he is allowed to bequeath; and the rest of the slave is not free because the man property has gone out of his hands. How can the rest of the slave which belongs to other people be free when they did not initiate the setting free and did not confirm it and they do not have the wala established for them? Only the deceased could do that. He was the one who freed him and the one for whom the wala was confirmed. That is not to be borne by another property unless he bequeaths within the third of his property what remains of a lave to be freed. That is a request against his partners and inheritors and the partners must not refuse the slave that when it is within the third of the dead man property because there is no harm in that to the inheritors. Malik said; If a man frees a third of his slave while he is critically ill; he must complete the emancipation so all of him is free from him; if it is within the third of his property that he has access to; because he is not treated in the same way as a man who frees a third of a slave after his death; because had the one who freed a third of his slave after his death lived; he could have cancelled it and the slave being set free would be of no effect. The master who made the freeing of the third of the slave irrevocable in his illness; would still have to free all of him if he lived. If he died; the slave would be set free within the third of the bequest. MuwataMalik-017-001-34880 | Yahya related to me from Malik from Umar Ibn Husayn; the mawla of Aisha bint Qudama; that Abd AlMalik Ibn Marwan imposed retaliation against a man who killed a mawla with a stick and so the mawla patron killed the man with a stick. Malik said; The generally agreed on way of doing things in our community about which there is no dispute is that when a man strikes another man with a stick or hits him with a rock or intentionally strikes him causing his death; that is an intentional injury and there is retaliation for it. Malik said; Intentional murder with us is that a man intentionally goes to a man and strikes him until his life goes. Part of intentional injury also is that a man strikes a man in a quarrel between them. He leaves him while he is alive; and he bleeds to death and so dies. There is retaliation for that. MuwataMalik-017-001-34885 | Malik related to me from Nafi from Abdullah Ibn Umar that the Messenger of Allah; may Allah bless him and grant him peace; said; It is the duty of a muslim man who has something to be given as a bequest not to spend two nights without writing a will about it. Malik said; The generally agreed-on way of doing things in our community is that when the testator writes something in health or illness as a bequest; and it has freeing slaves or things other than that in it; he can alter it in any way he chooses; until he is on his deathbed. If he prefers to abandon a bequest or change it; he can do so unless he has made a slave mudabbar to be freed after his death. If he has made him mudabbar; there is no way to change what he has made mudabbar. He is allowed to change his testament because the Messenger of Allah; may Allah bless him and grant him peace; said; It is the duty of a muslim man who has something to be given as a bequest not to spend two nights without writing a will about it. Malik explained; Had the testator not been able to change his will nor what was mentioned in it about freeing slaves; each testator might withhold making bequests from his property; whether in freeing slaves or other than it. A man gives a bequest in his health and in his travelling. i.e. he does not wait till his death bed. MuwataMalik-017-001-35279 | Yahya related to me from Malik from Yahya Ibn Said from Sulayman Ibn Yasar that Abdullah Ibn Abbas and Abu Salama Ibn Abdulrahman Ibn Awuf differed on the question of a wornan who gave birth a few nights after the death of her husband. Abu Salama said; When she gives birth to the child she is carrying; she is free to marry. Ibn Abbas said; At the end of two periods. Abu Huraira came and said; I am with my nephew; meaning Abu Salama. They sent Kurayb; a mawla of Abdullah Ibn Abbas to Umm Salamah; the wife of the Prophet; may Allah bless him and grant him peace; to ask her about it. He came back and told them that she had said that Subaya AlAslamiya had given birth a few nights after the death of her husband; and she had brought the matter to the Messenger of Allah; may Allah bless him and grant him peace; and he had said; You are free to marry; so marry whomever you wish. MuwataMalik-017-001-35427 | Yahya related to me from Malik from Yahya Ibn Said from Amr Ibn Kathir Ibn Aflah from Abu Muhammad; the mawla of Abu Qatada that Abu Qatada Ibn Ribi said; We went out with the Messenger of Allah; may Allah bless him and grant him peace; in the year of Hunayn. When the armies met; the Muslims were put in disarray. I saw a man from the idol worshippers who had got the better of one of the Muslims; so I circled round and came up behind him; and struck him with a sword on his shoulder-blade. He turned to me and grabbed me so hard that I felt the smell of death in it. Then death overcame him; and he let go of me. He continued; I met Umar Ibn AlKhattab and said to him; What going on with the people? He replied; The Command of Allah. Then the people took hold of the battle and the Messenger of Allah; may Allah bless him and grant him peace; said; Whoever has killed one of the dead and can prove it; can strip him of his personal effects. I stood up and said; Who will testify for me? and then I sat down. The Messenger of Allah repeated; Whoever has killed one of the dead and can prove it; can strip him of his personal effects. I stood up and said; Who will testify for me? then I sat down. MuwataMalik-017-001-35524 | Yahya related to me from Malik that he had heard that Said Ibn AlMusayab was asked whether a man who had vowed to fast a month could fast voluntarily; and Said said; He should fulfil his vow before he does any voluntary fasting. Malik said; I have heard the same thing from Sulayman Ibn Yasar. Malik said; If someone dies with an unfulfilled vow to free a slave or to fast or to give sadaqa or to give away a camel; and makes a bequest that his vow should be fulfilled from his estate; then the sadaqa or the gift of the camel are taken from one third of his estate. Preference is given to it over other bequests; except things of a similar nature; because by his vow it has become incumbent on him; and this is not the case with something he donates voluntarily. They vows and voluntary donations are settled from a limited one-third of his estate; and not from the whole of it; since if the dying man were free to dispose of all of his estate; he might delay settling what had become incumbent on him i.e. his vows ; so that when death came and the estate passed into the hands of his heirs; he would have bequeathed such things i.e. his vows that were not claimed by anyone like debts. If that i.e. to dispose freely of his property were allowed him; he would delay these things i.e. his vows until when he was near death; he would designate them and they might take up all of his estate.
