Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs. If it is a man that dies, leaving a sister but no child, she shall have half the inheritance: If (such a deceased was) a woman, who left no child, Her brother takes her inheritance: If there are two sisters, they shall have two-thirds of the inheritance (between them): if there are brothers and sisters, (they share), the male having twice the share of the female. Thus doth Allah make clear to you (His law), lest ye err. And Allah hath knowledge of all things.

But who doth more wrong than one who invents a lie against Allah, to lead astray men without knowledge? For Allah guideth not people who do wrong.

For parents, a sixth share of the inheritance to each, if the deceased left children; if no children, and the parents are the (only) heirs, the mother has a third; if the deceased Left brothers (or sisters) the mother has a sixth. (The distribution in all cases ('s) after the payment of legacies and debts. Ye know not whether your parents or your children are nearest to you in benefit. These are settled portions ordained by Allah; and Allah is All-knowing, Al-wise.

And no female conceives, or lays down (her load), but with His knowledge. Nor is a man long-lived granted length of days, nor is a part cut off from his life, but is in a Decree (ordained). All this is easy to Allah.

SahihAlBukhari-017-001-3153Narrated Ibn Abbas: The pagans were of two kinds as regards their relationship to the Prophet and the Believers. Some of them were those with whom the Prophet was at war and used to fight against; and they used to fight him; the others were those with whom the Prophet ﷺ made a treaty; and neither did the Prophet ﷺ fight them; nor did they fight him. If a lady from the first group of pagans emigrated towards the Muslims; her hand would not be asked in marriage unless she got the menses and then became clean. When she became clean; it would be lawful for her to get married; and if her husband emigrated too before she got married; then she would be returned to him. If any slave or female slave emigrated from them to the Muslims; then they would be considered free persons not slaves and they would have the same rights as given to other emigrants. The narrator then mentioned about the pagans involved with the Muslims in a treaty; the same as occurs in Mujahid narration. SahihAlBukhari-017-001-3530Narrated Urwa Bin AlZubair: that he asked Aisha; saying to her; O Mother! In what connection was this Verse revealed : If you fear that you shall not be able to deal justly with orphan girls to the end of the verse that your right hands possess? 4.3 Aisha said; O my nephew! It was about the female orphan under the protection of her guardian who was interested in her beauty and wealth and wanted to marry her with a little or reduced Mahr. SahihAlBukhari-017-001-6817Narrated Ibn Abbas: The law of Qisas i.e. equality in punishment was prescribed for the children of Israel; but the Diya i.e. blood money was not ordained for them. So Allah said to this Nation i.e. Muslims : O you who believe! The law of AlQisas i.e. equality in punishment is prescribed for you in cases of murder: The free for the free; the slave for the slave; and the female for the female. But if the relatives or one of them of the killed person forgive their brother i.e. the killers something of Qisas i.e. not to kill the killer by accepting blood money in the case of intentional murder --then the relatives of the killed person should demand blood-money in a reasonable manner and the killer must pay with handsome gratitude. Besides this; I grazed the camel; made arrangements for providing it with water and patched up the leather bucket and kneaded the flour. But I was not proficient in baking the bread; so my female neighbours used to bake bread for me and they were sincere women. She further said: I was carrying on my head the stones of the dates from the land of AlZubair which Allah Messenger ﷺ had endowed him and it was at a distance of two miles from Medina. She add: As I was one day carrying the atones of dates upon my head I happened to meet Allah Messenger ﷺ along with a group of his Companions. He called me and said to the camel to sit down so that he should make cite ride behind hirn. I told my husband: I felt shy and remembered your jealousy; whereupon he said: By Allah. the carrying of the stone dates upon your bead is more severe a burden than riding with him. SahihMuslim-017-001-20221Asma reported: I performed the household duties of AlZubair and he had a horse; I used to look after it. Nothing was more burdensome for me than looking after the horse I used to bring grass for it and looked after it; then I got a servant as Allah Apustle ﷺ had some prisoners of war in his possession. He gave me a female servant. She the female servant then began to look after the horse and thus relieved me of this burden. A person came and he said: Mother of Abdullah; I am a destitute person and I intend that I should start business under the shadow of your house. I Asma said: If I grant you permission; AlZubair may not agree to that; so you come and make a demand of it when AlZubair is also present there. He came accordingly find said: Mother of Abdullah. I am a destitute person. I intend to start t mall business in the shadow of your house. I said: Is there not in Medina any place for starting the business except my house? AlZubair said: Why is it that you prohibit the destitute man to start business here? So he started business and he earned so much that we sold our slave-girl to him There came AlZubair to me while the money was in my lap. He said: Give this to me. He the Jew said. What would be their food alter this? He the Holy Prophet said: A bullockwhich was fed in the different quarters of Paradise would be slaughtered for them. He the Jew said: What would be their drink? He the Holy Prophet said: They would be given drink from the fountain which is named Salsabil. He the Jew said: I have come to ask you about a thing which no one amongst the people on the earth knows except an apostle or one or two men besides him. He the Holy Prophet said: Would it benefit you if I tell you that? He the Jew said: I would lend ears to that. He then said: I have come to ask you about the child. He the Holy Prophet said: The reproductive substance of man is white and that of woman i. e. ovum central portion yellow; and when they have sexual intercourse and the male substance chromosomes and genes prevails upon the female substance chromosomes and genes ; it is the male child that is created by Allah Decree; and when the substance of the female prevails upon the substance contributed by the male; a female child is formed by the Decree of Allah. She further said: The people hastened on from Arafat; whereas Hums hastened from Muzdalifa; and said: Wedo not hasten but from Haram. So one of them stood before him and said: I ask you by Allah; O Messenger of Allah! Only that you would judge between us by the book of Allah. She said O my nephew; this means the female orphan who is under the protection of her guardian and she holds a share in his property and her property and beauty attracts him; so her guardian intends to marry her without doing justice to her in respect of her dower and he gives her the same amount of dower as others give her. They i.e.; the guardians were prohibited to marry them except that they do justice to them and pay them their maximum customary dower and they were asked to marry women other than them i.e.; the orphans who seem good to them. Urwah reported that Aisha said The people then consulted the Apostle of Allaah ﷺ about women after revelation of this verse. Thereupon Allaah the Exalted sent down the verse They consult thee concerning women. Say Allaah giveth you decree concerning them and the scripture which hath been recited unto you giveth decree concerning female orphans unto whom you give not that which is ordained for them though you desire to marry them. She said The mention made by Allaah about the Scripture recited to them refers to the former verse in which Allaah has said And if ye fear that ye will not deal fairly by the orphans; marry of the women; who seem good to you. Aisha said The pronouncement of Allaah ; the Exalted in the latter verse though you desire to marry them means the disinterest of one of you in marrying a female orphan who was under his protection; but she said little property and beauty. So they were prohibited to marry them for their interest in the property and beauty of the female orphans due to their disinterest in themselves except that they do justice to them. MuwataMalik-017-001-35135Yahya related to me from Malik; The generally agreed upon way of doing things among us and what I have seen the people of knowledge doing in our city about the fixed shares of inheritance of children from the mother or father when one or other of them dies is that if they leave male and female children; the male takes the portion of two females. If there are only females; and there are more than two; they get two thirds of what is left between them. If there is only one; she gets a half. If someone shares with the children; who has a fixed share and there are males among them; the reckoner begins with the ones with fixed shares. What remains after that is divided among the children according to their inheritance. When there are no children; grandchildren through sons have the same position as children; so that grandsons are like sons and grand-daughters are like daughters. They inherit as they inherit and they overshadow as they overshadow. If there are both children and grandchildren through sons; and there is a male among the children; then the grandchildren through sons do not share in the inheritance with him. If there is no surviving male among the children; and there are two or more daughters; the granddaughters through a son do not share in the inheritance with them unless there is a male who is in the same position as them in relation to the deceased; or further than them. His presence gives access to whatever is left over; if any; to whoever is in his position and whoever is above him of the granddaughters through sons. If something is left over; they divide it among them; and the male takes the portion of two females. If nothing is left over; they have nothing. If the only descendant is a daughter; she takes half; and if there are one or more grand-daughters through a son who are in the same position to the deceased; they share a sixth. If there is a male in the same position as the granddaughters through a son in relation to the deceased; they have no share and no sixth. If there is a surplus after the allotting of shares to the people with fixed shares; the surplus goes to the male and whoever is in his position and whoever is above him of the female descendants through sons. The male has the share of two females. The one who is more distant in relationship than grandchildren through sons has nothing. If there is no surplus; they have nothing. That is because Allah; the Blessed; the Exalted; said in His Book; Allah charges you about your children that the male has the like of the portion of two females. If there are more than two women they have two thirds of what is left. If there is one; she has a half. They divide it between themselves according to the Book of Allah; whether they are male or female. The male has a portion of two females. If there is nothing left over; they have nothing. If the deceased does not leave a father or a paternal grandfather or children or male or female grandchildren through a son; a single full sister gets a half. If there are two or more full sisters; they get two thirds. If there is a brother with them; sisters; whether one or more; do not have a fixed share. One begins with whoever shares in the fixed shares. They are given their shares. Whatever remains after that goes to the full siblings. The male has the portion of two females except in one case; in which the full siblings have nothing. They share in this case the third of the half-siblings by the mother. That case is when a woman dies and leaves a husband; a mother; half- siblings by her mother; and full siblings. The husband has a half. The mother has one sixth. The half-siblings by the mother have a third. Nothing is left after that; so the full siblings share in this case with the half-siblings by the mother in their third. The male has the portion of two females in as much as all of them are siblings of the deceased by the mother. They inherit by the mother. That is because Allah; the Blessed; the Exalted; said in His Book; If a man or a woman has no direct heir and he has a brother or a sister; each one of the two gets a sixth. If there is one or more females in the full siblings and there is no male with them; the one full sister gets a half; and the half sister by the father gets a sixth; completing the two-thirds. If there is a male with the half-sisters by the father; they have no share. The people of fixed shares are given their shares and if there is something left after that it is divided between the half-siblings by the father. The male has the portion of two females. If there is nothing left over; they get nothing. If the full siblings consist of two or more females; they get two-thirds; and the half-sisters by the father get nothing with them unless there is a half-brother by the father with them. If there is a half-brother by the father with them; the people of fixed shares are given their shares and if there is something left over after that; it is divided between the half- siblings by the father. The male gets the portion of two females. If there is nothing left over; they get nothing. MuwataMalik-017-001-35143Yahya related to me from Malik that he had heard that Sulayman Ibn Yasar said; Umar Ibn AlKhattab; Uthman Ibn Affan; andZayd Ibn Thabit gave the grandfather a third with full siblings. Malik said; The generally agreed on way of doing things among us and what I have seen the people of knowledge in our city doing is that the paternal grandfather does not inherit anything at all with the father. He is given a sixth as a fixed share with the son and the grandson through a son. Other than that; when the deceased does not leave a mother or a paternal aunt; one begins with whoever has a fixed share; and they are given their shares. If there is a sixth of the property left over; the grandfather is given a sixth as a fixed share. Malik said; When someone shares with the grandfather and the full siblings in a specified share; one begins with whoever shares with them of the people of fixed shares. They are given their shares. What is left over after that belongs to the grandfather and the full siblings. Then one sees which is the more favourable of two alternatives for the portion of the grandfather. Either a third is allotted to him and the siblings to divide between them; and he gets a share as if he were one of the siblings; or else he takes a sixth from all the capital. Whichever is the best portion for the grandfather is given to him. What is left after that; goes to the full siblings. The male gets the portion of two females except in one particular case. The division in this case is different from the preceding one. This case is when a woman dies and leaves a husband; mother; full sister and grandfather. The husband gets a half; the mother gets a third; the grandfather gets a sixth; and the full sister gets a half. The sixth of the grandfather and the half of the sister are joined and divided into thirds. The male gets the share of two females. Therefore; the grandfather has two thirds; and the sister has one third. Malik said; The inheritance of the half-siblings by the father with the grandfather when there are no full siblings with them; is like the inheritance of the full siblings in the same situation. The males are the same as their males and the females are the same as their females. When there are both full siblings and half-siblings by the father; the full siblings include in their number the number of half-siblings by the father; to limit the inheritance of the grandfather; i.e.; if there was only one full sibling with the grandfather. If there were also two half-siblings by the father; their number is added to the division of the sum; which would then be divided four ways. If there is one full sister; she includes the grandfather with the half-siblings by her father in the division; however many. Malik said; What we do about the aqiqa is that if someone makes an aqiqa for his children; he gives a sheep for both male and female. The aqiqa is not obligatory but it is desirable to do it; and people continue to come to us about it. If someone makes an aqiqa for his children; the same rules apply as with all sacrificial animals - one-eyed; emaciated; injured; or sick animals must not be used; and neither the meat or the skin is to be sold. The bones are broken and the family eat the meat and give some of it away as sadaqa.
