SunanAlNasai-017-001-14850 | It was narrated that Qubaisah Bin Mukhariq said: I undertook a financial responsibility; then I came to the Prophet and asked him for help concerning that. He said: Hold on; o Qubaisah! When we get some charity we will give you some. Then the Messenger of Allah said: O Qubaisah; charity is not permissible except for one of three: A man who undertakes a financial responsibility; so it is permissible for him to be given charity until he finds means to make him independent and to suffice him; a man who was stricken by calamity and his wealth was destroyed; so it is permissible for him to ask for help until he has enough to keep him going; them he should refrain from asking; and a man who is stricken with poverty and three wise men from among his own people testily that so-and-so is in desperate need; then it is permissible for him to ask for help until he finds means to make him independent and to suffice him. SunanAlNasai-017-001-14902 | Sahl Bin Saad AlSaidi narrated that Uwaimir AlAjlani came to Aasi m Bin Adiy and said: What do you think; O Aasi m! If a man finds another man with his wife; should he kill him; and be killed in retaliation; or what should he do? O Aasi m! Ask the Messenger of Allah about that for me. So Aasi m asked the Messenger of Allah about that; and the Messenger of Allah disapproved of the question; and criticized the asking of too many questions until Aasi m felt upset. When Aasi m went back to his people; Uwaimir came to him and said: O Aasi m; what did the Messenger of Allah say to you? Aasi m said: You have not brought me any good. The Messenger of Allah disapproved of the question you asked. Uwaimir said: By Allah; I will go and ask the Messenger of Allah. So he went to the Messenger of Allah and found him in the midst of the people. He said: O Messenger of Allah; what do you think if a man finds another man with his wife -should he kill him; and be killed in retaliation or what should he do? The Messenger of Allah said: Something has been revealed concerning you and your wife; so go and bring her here. Sahl said: So they engaged in the procedure of Lian; and I was among the people in the presence of the Messenger of Allah. When Uwaimir finished he said: I would have been telling lies about her; O Messenger of Allah; if I keep her. SunanAbuDawoud-017-001-25092 | Abdullah bin Masud said We were in the Masjid on the night of a Friday; suddenly a man from the Ansar entered the Masjid. And said If a man finds a man along with wife and declares about her adultery you will flog him. Or if he kills you; you will kill him or if keeps silence he will keep silence in anger. I swear by Allaah; I shall ask the Apostle of Allaah ﷺ about it. MuwataMalik-017-001-35121 | Malik related to me from Yahya Ibn Said from Abu Bakr Ibn Muhammad Ibn Amr Ibn Hazm from Umar Ibn Abdal-Aziz from Abu Bakr Ibn Abdulrahman Ibn AlHarith Ibn Hisham from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; If anyone goes bankrupt; and a man finds his own property intact with him; he is more entitled to it than anyone else. Malik spoke about a man who sold a man wares; and the buyer went bankrupt. He said; The seller takes whatever of his goods he finds. If the buyer has sold some of them and distributed them; the seller of the wares is more entitled to them than the creditors. What the buyer has distributed does not prevent the seller from taking whatever of it he finds. It is the seller right if he has received any of the price from the buyer and he wants to return it to take what he finds of his wares; and in what he does not find; he is like the creditors. Malik spoke about some one who bought spun wool or a plot of land; and then did some work on it; like building a house on the plot of land or weaving the spun wool into cloth. Then he went bankrupt after he had bought it; and the original owner of the plot said; I will take the plot and whatever structure is on it. Malik said; That structure is not his. However; the plot and what is in it that the buyer has improved is appraised. Then one sees what the price of the plot is and how much of that value is the price of the structure. They are partners in that. The owner of the plot has as much as his portion; and the creditors have the amount of the portion of the structure. Malik said; The explanation of that is that the value of it all is fifteen hundred dirhams. The value of the plot is five hundred dirhams; and the value of the building is one thousand dirhams. The owner of the plot has a third; and the creditors have two-thirds. Malik said; It is like that with spinning and other things of the same nature in these circumstances and the buyer has a debt which he cannot pay. This is the behaviour in such cases. Malik said; As for goods which have been sold and which the buyer does not improve; but those goods sell well and have gone up in price; so their owner wants them and the creditors also want to seize them; then the creditors choose between giving the owner of the goods the price for which he sold them and not giving him any loss and surrendering his goods to him. If the price of the goods has gone down; the one who sold them has a choice. If he likes; he can take his goods and he has no claim to any of his debtor property; and that is his right. If he likes; he can be one of the creditors and take a portion of his due and not take his goods. That is up to him. Malik said about someone who bought a slave-girl or animal and she gave birth in his possession and the buyer went bankrupt; The slave-girl or the animal and the offspring belong to the seller unless the creditors desire it. I will not stop until I ask him about it! Uwaymir stood up and went to the Messenger of Allah; may Allah bless him and grant him peace; in the middle of the people and said; Messenger of Allah! What do you think a man who finds another man with his wife should do? Should he kill him and then be killed himself; or what should he do? The Messenger of Allah; may Allah bless him and grant him peace; said; Something has been sent down about you and your wife; so go and bring her. Sahl continued; They mutually cursed one another in the presence of the Messenger; may Allah bless him and grant him peace; and I was present with the people. When they finished cursing each other; Uwaymir said; I shall have lied about her; Messenger of Allah; if I keep her; and pronounced the divorce three times before the Messenger of Allah; may Allah bless him and grant him peace; ordered him to do it. MuwataMalik-017-001-35574 | Yahya said that Malik said; The position with us concerning a man who has zakat to pay on one hundred camels but then the zakat collector does not come to him until zakat is due for a second timeand by that time all his camels have died except five; is that the zakat collector assesses from the five camels the two amounts of zakat that are due from the owner of the animals; which in this case is only two sheep; one for each year. This is because the only zakat which an owner of livestock has to pay is what is due from him on the day that the zakat is actually assessed. His livestock may have died or it may have increased; and the zakat collector only assesses the zakat on what he actually finds on the day he makes the assessment.
