SahihAlBukhari-017-001-1302 | Narrated AlMiswar Bin Makhrama: The group of people whom Umar had selected as candidates for the Caliphate gathered and consulted each other. Abdulrahman said to them; I am not going to compete with you in this matter; but if you wish; I would select for you a caliph from among you. So all of them agreed to let Abdulrahman decide the case. So when the candidates placed the case in the hands of Abdulrahman the people went towards him and nobody followed the rest of the group nor obeyed any after him. So the people followed Abdulrahman and consulted him all those nights till there came the night we gave the oath of allegiance to Uthman. AlMiswar bin Makhrama added: Abdulrahman called on me after a portion of the night had passed and knocked on my door till I got up; and he said to me; I see you have been sleeping! By Allah; during the last three nights I have not slept enough. Go and call AlZubair and Sad. So I called them for him and he consulted them and then called me saying; Call Ali for me. I called Ali and he held a private talk with him till very late at night; and then Al; got up to leave having had much hope to be chosen as a Caliph but Abdulrahman was afraid of something concerning Ali. Abdulrahman then said to me; Call Uthman for me. I called him and he kept on speaking to him privately till the Muadh-dhin put an end to their talk by announcing the Adhan for the Fajr prayer. When the people finished their morning prayer and that six men group gathered near the pulpit; Abdulrahman sent for all the Muhajirin emigrants and the Ansar present there and sent for the army chief who had performed the Hajj with Umar that year. When all of them had gathered; Abdulrahman said; None has the right to be worshipped but Allah; and added; Now then; O Ali; I have looked at the people tendencies and noticed that they do not consider anybody equal to Uthman; so you should not incur blame by disagreeing. Then Abdulrahman said to Uthman ; I gave the oath of allegiance to you on condition that you will follow Allah Laws and the traditions of Allah Apostle and the traditions of the two Caliphs after him. SahihAlBukhari-017-001-1592 | Narrated Ibn Abbas: I used to teach the Quran to some people of the Muhajirln emigrants ; among whom there was Abdulrahman Bin Auf. While I was in his house at Mina; and he was with Umar Bin AlKhattab during Umar last Hajj; Abdulrahman came to me and said; Would that you had seen the man who came today to the Chief of the Believers Umar ; saying; O Chief of the Believers! What do you think about so-and-so who says; If Umar should die; I will give the pledge of allegiance to such-andsuch person; as by Allah; the pledge of allegiance to Abu Bakr was nothing but a prompt sudden action which got established afterwards. Umar became angry and then said; Allah willing; I will stand before the people tonight and warn them against those people who want to deprive the others of their rights the question of rulership. Abdulrahman said; I said; O Chief of the believers! Do not do that; for the season of Hajj gathers the riff-raff and the rubble; and it will be they who will gather around you when you stand to address the people. And I am afraid that you will get up and say something; and some people will spread your statement and may not say what you have actually said and may not understand its meaning; and may interpret it incorrectly; so you should wait till you reach Medina; as it is the place of emigration and the place of Prophet Traditions; and there you can come in touch with the learned and noble people; and tell them your ideas with confidence; and the learned people will understand your statement and put it in its proper place. On that; Umar said; By Allah! Allah willing; I will do this in the first speech I will deliver before the people in Medina. Ibn Abbas added: We reached Medina by the end of the month of Dhu AlHijja; and when it was Friday; we went quickly to the Masjid as soon as the sun had declined; and I saw Saeed Bin Zaid Bin Amr Bin Nufail sitting at the corner of the pulpit; and I too sat close to him so that my knee was touching his knee; and after a short while Umar Bin AlKhattab came out; and when I saw him coming towards us; I said to Saeed Bin Zaid Bin Amr Bin Nufail Today Umar will say such a thing as he has never said since he was chosen as Caliph. Saeed denied my statement with astonishment and said; What thing do you expect Umar to say the like of which he has never said before? In the meantime; Umar sat on the pulpit and when the callmakers for the prayer had finished their call; Umar stood up; and having glorified and praised Allah as He deserved; he said; Now then; I am going to tell you something which Allah has written for me to say. I do not know; perhaps it portends my death; so whoever understands and remembers it; must narrate it to the others wherever his mount takes him; but if somebody is afraid that he does not understand it; then it is unlawful for him to tell lies about me. Allah sent Muhammad with the Truth and revealed the Holy Book to him; and among what Allah revealed; was the Verse of the Rajam the stoning of married person male & female who commits illegal sexual intercourse; and we did recite this Verse and understood and memorized it. Allah Messenger ﷺ did carry out the punishment of stoning and so did we after him. I am afraid that after a long time has passed; somebody will say; By Allah; we do not find the Verse of the Rajam in Allah Book; and thus they will go astray by leaving an obligation which Allah has revealed. And the punishment of the Rajam is to be inflicted to any married person male & female ; who commits illegal sexual intercourse; if the required evidence is available or there is conception or confession. And then we used to recite among the Verses in Allah Book: O people! Do not claim to be the offspring of other than your fathers; as it is disbelief unthankfulness on your part that you claim to be the offspring of other than your real father. Then Allah Messenger ﷺ said; Do not praise me excessively as Jesus; son of Marry was praised; but call me Allah Slave and His Apostles. O people! I have been informed that a speaker amongst you says; By Allah; if Umar should die; I will give the pledge of allegiance to such-and-such person. One should not deceive oneself by saying that the pledge of allegiance given to Abu Bakr was given suddenly and it was successful. No doubt; it was like that; but Allah saved the people from its evil; and there is none among you who has the qualities of Abu Bakr. Remember that whoever gives the pledge of allegiance to anybody among you without consulting the other Muslims; neither that person; nor the person to whom the pledge of allegiance was given; are to be supported; lest they both should be killed. And no doubt after the death of the Prophet ﷺ we were informed that the Ansar disagreed with us and gathered in the shed of Bani Sada. Ali and AlZubair and whoever was with them; opposed us; while the emigrants gathered with Abu Bakr. I said to Abu Bakr; Let go to these Ansari brothers of ours. So we set out seeking them; and when we approached them; two pious men of theirs met us and informed us of the final decision of the Ansar; and said; O group of Muhajirin emigrants ! Where are you going? We replied; We are going to these Ansari brothers of ours. They said to us; You shouldnt go near them. Carry out whatever we have already decided. I said; By Allah; we will go to them. And so we proceeded until we reached them at the shed of Bani Sada. Behold! There was a man sitting amongst them and wrapped in something. I asked; Who is that man? They said; He is Saad Bin Ubada. I asked; What is wrong with him? They said; He is sick. After we sat for a while; the Ansar speaker said; None has the right to be worshipped but Allah; and praising Allah as He deserved; he added; To proceed; we are Allah Ansar helpers and the majority of the Muslim army; while you; the emigrants; are a small group and some people among you came with the intention of preventing us from practicing this matter of caliphate and depriving us of it. When the speaker had finished; I intended to speak as I had prepared a speech which I liked and which I wanted to deliver in the presence of Abu Bakr; and I used to avoid provoking him. So; when I wanted to speak; Abu Bakr said; Wait a while. I disliked to make him angry. So Abu Bakr himself gave a speech; and he was wiser and more patient than I. By Allah; he never missed a sentence that I liked in my own prepared speech; but he said the like of it or better than it spontaneously. After a pause he said; O Ansar! You deserve all the qualities that you have attributed to yourselves; but this question of Caliphate is only for the Quraish as they are the best of the Arabs as regards descent and home; and I am pleased to suggest that you choose either of these two men; so take the oath of allegiance to either of them as you wish. And then Abu Bakr held my hand and Abu Ubaida Bin AlJarrah hand who was sitting amongst us. I hated nothing of what he had said except that proposal; for by Allah; I would rather have my neck chopped off as expiator for a sin than become the ruler of a nation; one of whose members is Abu Bakr; unless at the time of my death my own-self suggests something I dont feel at present. And then one of the Ansar said; I am the pillar on which the camel with a skin disease eczema rubs itself to satisfy the itching i.e.; I am a noble ; and I am as a high class palm tree! O Quraish. There should be one ruler from us and one from you. Then there was a hue and cry among the gathering and their voices rose so that I was afraid there might be great disagreement; so I said; O Abu Bakr! Hold your hand out. He held his hand out and I pledged allegiance to him; and then all the emigrants gave the Pledge of allegiance and so did the Ansar afterwards. And so we became victorious over Saad Bin Ubada whom AlAnsar wanted to make a ruler. One of the Ansar said; You have killed Saad Bin Ubada. I replied; Allah has killed Saad Bin Ubada. Umar added; By Allah; apart from the great tragedy that had happened to us i.e. the death of the Prophet ; there was no greater problem than the allegiance pledged to Abu Bakr because we were afraid that if we left the people; they might give the Pledge of allegiance after us to one of their men; in which case we would have given them our consent for something against our real wish; or would have opposed them and caused great trouble. So when Allah had prevented that with the Truth He had given you; he was choked by that; and that caused him to behave in such an impolite manner which you had noticed. So Allah Messenger ﷺ excused him. It was the custom of Allah Messenger ﷺ and his companions to excuse the pagans and the people of the scripture Christians and Jews as Allah ordered them; and they used to be patient when annoyed by them. Allah said: You shall certainly hear much that will grieve you from those who received the Scripture before you.....and from the pagans 3.186 He also said: Many of the people of the scripture wish that if they could turn you away as disbelievers after you have believed..... 2.109 So Allah Messenger ﷺ used to apply what Allah had ordered him by excusing them till he was allowed to fight against them. When Allah Messenger ﷺ had fought the battle of Badr and Allah killed whomever He killed among the chiefs of the infidels and the nobles of Quraish; and Allah Messenger ﷺ and his companions had returned with victory and booty; bringing with them some of the chiefs of the infidels and the nobles of the Quraish as captives. I was a poor man keeping the company of Allah Messenger ﷺ and was satisfied with what filled my stomach. So; I used to be present while they i.e. the emigrants and the Ansar were absent; and I used to remember while they forgot the Hadith. One day the Prophet ﷺ said; Whoever spreads his sheet till I finish this statement of mine and then gathers it on his chest; will never forget anything of my statement. So; I spread my covering sheet which was the only garment I had; till the Prophet ﷺ finished his statement and then I gathered it over my chest. By Him Who had sent him i.e. Allah Apostle with the truth; since then I did not forget even a single word of that statement of his; until this day of mine. But the menstruating women should keep away from the Mousalla praying place. I asked her; The menstruating women? Excuse and forgive him; for by Him Who revealed the Book to you; Allah brought the Truth which was sent to you at the time when the people of this town i.e. Medina had decided unanimously to crown him and tie a turban on his head electing him as chief. But when Allah opposed that decision through the Truth which Allah gave to you; he i.e. Abdullah Bin Ubai was grieved with jealously. and that caused him to do what you have seen. So Allah Messenger ﷺ excused him; for the Prophet ﷺ and his companions used to forgive the pagans and the people of Scripture as Allah had ordered them; and they used to put up with their mischief with patience. Allah said: And you shall certainly hear much that will grieve you from those who received the Scripture before you and from the pagans........ 3.186 And Allah also said:-Many of the people of the Scripture wish if they could turn you away as disbelievers after you have believed; from selfish envy.. 2.109 So the Prophet ﷺ used to stick to the principle of forgiveness for them as long as Allah ordered him to do so till Allah permitted fighting them. So when Allah Messenger ﷺ fought the battle of Badr and Allah killed the nobles of Quraish infidels through him; Ibn Ubai Bin Salul and the pagans and idolaters who were with him; said; This matter i.e. Islam has appeared i.e. became victorious. SahihMuslim-017-001-17759 | It has been narrated on the authority of Abdulrahman Bin Abd Rabb AlKaba who said: I entered the Masjid when Abdullah Bin Amr Bin AlAs was sitting in the shade of the Kaba and the people had gathered around him. I betook myself to them and sat near him. Now Abdullah said: I accompanied the Messenger of Allah ﷺ on a journey. We halted at a place. Some of us began to set right their tents; others began to compete with one another in shooting; and others began to graze their beasts; when an announcer of the Messenger of Allah ﷺ announced that the people should gather together for prayer; so we gathered around the Messenger of Allah ﷺ. He said: It was the duty of every Prophet that has gone before me to guide his followers to what he knew was good for them and warn them against what he knew was bad for them; but this Umma of yours has its days of peace and security in the beginning of its career; and in the last phase of its existence it will be afflicted with trials and with things disagreeable to you. In this phase of the Umma ; there will be tremendous trials one after the other; each making the previous one dwindle into insignificance. When they would be afflicted with a trial; the believer would say: This is going to bring about my destruction. When at the trial is over; they would be afflicted with another trial; and the believer would say: This surely is going to be my end. Whoever wishes to be delivered from the fire and enter the garden should die with faith in Allah and the Last Day and should treat the people as he wishes to be treated by them. He who swears allegiance to a Caliph should give him the piedge of his hand and the sincerity of his heart i. e. submit to him both outwardly as well as inwardly. He should obey him to the best of his capacity. It another man comes forward as a claimant to Caliphate ; disputing his authority; they the Muslims should behead the latter. The narrator says: I came close to him Abdullah Bin Amr Bin AlAs and said to him: Can you say on oath that you heard it from the Messenger of Allah ﷺ ? He pointed with his hands to his ears and his heart and said: My ears heard it and my mind retained it. I said to him: This cousin of yours; Muawiya; orders us to unjustly consume our wealth among ourselves and to kill one another; while Allah says: O ye who believe; do not consume your wealth among yourselves unjustly; unless it be trade based on mutual agreement; and do not kill yourselves. Verily; God is Merciful to you iv. 29. Then the caller of the Prophet called out: AlPrayeru Jamiah prayer is about to begin. So we gathered; and the Messenger of Allah stood up and addressed us. He said: There has a never been a prophet before me who was not obliged to tell his nation of what he knew was good for them; and to warn against that he knew was bad for them. With regard to Ummah of yours; soundness of religious commitment has been placed in its earlier generations; and the last of them will be afflicted with calamities and things that you dislike. Then there will come tribulations which will make the earlier ones pale into significances; and the believer will say: This will be then end of me; then relief will come. SunanAbuDawoud-017-001-25111 | Aisha wife of the Prophet ﷺ said Marriage in pre Islamic times was of four kinds. One of them was the marriage contracted by the people today. A man asked another man to marry his relative sister or daughter to him. He fixed the dower and married her to him. Another kind of marriage was that a man asked his wife when she became pure from menstruation to send fro so and so and have sexual intercourse with him. Her husband kept himself aloof and did not have intercourse with her till It became apparent that she was pregnant from the man who had intercourse with her. When it was manifest that she was pregnant; her husband approached her if he liked. This marriage was called istibda to utilize man for intercourse for a noble birth. A third kind of marriage was that a group of people less than ten in number entered upon a woman and had intercourse with her. When she conceived gave birth to a child and a number of days passed after her delivery; she sent for them. No one of them could refuse to attend and they gathered before her. She said to them You have realized your affair. I have now given birth to a child. And this is your son. O so and so. She called the name of anyone of them she liked and the child was attributed to him. A fourth kind of marriage was that many people gathered together and entered upon a woman who did not prevent anyone who came to her. They were prostitutes. They hoisted flags at their doors which served as a sign for the one who intended to enter upon them. When she became pregnant and delivered the child ; they got together before her and called for the experts of tracing relationship from physical features. They attributed the child to whom they considered and it was given to him. The child was called his son and he could not deny. SunanAbuDawoud-017-001-25237 | Narrated Anas Ibn Malik: A man of the Ansar came to the Prophet ﷺ and begged from him. He the Prophet asked: Have you nothing in your house? He replied: Yes; a piece of cloth; a part of which we wear and a part of which we spread on the ground ; and a wooden bowl from which we drink water. He said: Bring them to me. He then brought these articles to him and he the Prophet took them in his hands and asked: Who will buy these? A man said: I shall buy them for one dirham. He said twice or thrice: Who will offer more than one dirham? A man said: I shall buy them for two dirhams. He gave these to him and took the two dirhams and; giving them to the Ansari; he said: Buy food with one of them and hand it to your family; and buy an axe and bring it to me. The man went away and gathered firewood and sold it. When he had earned ten dirhams; he came to him and bought a garment with some of them and food with the others. SunanAbuDawoud-017-001-26613 | Narrated Ubadah Ibn AlSamit: The tradition mentioned above No. 4401 has also been transmitted by Ubadah Ibn AlSamit through a different chain of narrators. This version has: The people said to Saad Ibn Ubadah: Abu Thabit; the prescribed punishments have been revealed: if you find a man with your wife; what will you do? He said: I shall strike them with a sword so much that they become silent i.e. die. Should I go and gather four witnesses? Until that time the need would be fulfilled. So they went away and gathered with the Messenger of Allah ﷺ and said: Messenger of Allah! did you not see Abu Thabit. He said so-and-so. The Messenger of Allah ﷺ said: The sword is a sufficient witness. The chief of Khaybar was a defiant and abominable man. He came to the Prophet ﷺ and said: Is it proper for you; Muhammad; that you slaughter our donkeys; eat our fruit; and beat our women? The Prophet ﷺ became angry and said: Ibn Awuf ; ride your horse; and call loudly: Beware; Paradise is lawful only for a believer; and that they the people should gather for prayer. They gathered and the Prophet ﷺ led them in prayer; stood up and said: Does any of you; while reclining on his couch; imagine that Allah has prohibited only that which is to be found in this Quran? By Allah; I have preached; commanded and prohibited various matters as numerous as that which is found in the Quran; or more numerous. MuwataMalik-017-001-35570 | Yahya related to me from Malik that he had read what Umar Ibn AlKhattab had written about zakat; and in it he found: In the name of Allah; the Merciful; the ompassionate. The Book of Zakat. On twenty-four camels or less zakat is paid with sheep; one ewe for every five camels. On anything above that; up to thirty-five camels; a camel in its second year; and; if there is no she camel in its second year; a male camel in its third year. On anything above that; up to forty-five camels; a camel in its third year. On anything above that; up to sixty camels; a she camel in its fourth year that is ready to be sired. On anything above that; up to seventy-five camels; a camel in its fifth year. On anything above that; up to ninety camels; two camels in their third year. On anything above that; up to one hundred and twenty camels; two camels in their fourth year that are ready to be sired. On any number of camels above that; for every forty camels; a camel in its third year; and for every fifty; a camel in its fourth year. On grazing sheep and goats; if they come to forty or more; up to one hundred and twenty head; one ewe. On anything above that; up to two hundred head; two ewes. On anything above that; up to three hundred; three ewes. On anything above that; for every hundred; one ewe. A ram should not be taken for zakat. nor an old or an injured ewe; except as the zakat-collector thinks fit. Those separated should not be gathered together nor should those gathered together be separated in order to avoid paying zakat. MuwataMalik-017-001-35572 | Yahya said that Malik said; concerning two associates; If they share one herdsman; one male animal; one pasture and one watering place then the two men are associates; as long as each one of them knows his own property from that of his companion If someone cannot tell his property apart from that of his fellow; he is not an associate; but rather; a co-owner Malik said; It is not obligatory for both associates to pay zakat unless both of them have a zakatable amount of livestock. If; for instance; one of the associates has forty or more sheep and goats and the other has less than forty sheep and goats; then the one who has forty has to pay zakat and the one who has less does not. If both of them have a zakatable amount of livestock then both of them are assessed together i.e the flock is assessed as one and both of them have to pay zakat. If one of them has a thousand sheep; or less; that he has to pay zakat on; and the other has forty; or more; then they are associates; and each one pays his contribution according to the number of animals he has - so much from the one with a thousand; and so much from the one with forty. Malik said; Two associates in camels are the same as two associates in sheep and goats; and; for the purposes of zakat; are assessed together if each one of them has a zakatable amount of camels. That is because the Messenger of Allah; may Allah bless him and grant him peace; said; There is no zakat on less than five head of camels; and Umar Ibn AlKhattab said; On grazing sheep and goats; if they come to forty or more - one ewe. Yahya said that Malik said; This is what I like most out of what I have heard about the matter. Malik said that when Umar Ibn AlKhattab said; Those separated should not be gathered together nor should those gathered together be separated in order to avoid paying zakat; what he meant was the owners of livestock. Malik said; What he meant when he said; Those separated should not be gathered together is; for instance; that there is a group of three men; each of whom has forty sheep and goats; and each of whom thus has to pay zakat. Then; when the zakat collector is on his way ;they gather their flocks together so that they only owe one ewe between them. This they are forbidden to do. What he meant when he said; nor should those gathered together be separated; is; for instance; that there are two associates; each one of whom has a hundred and one sheep and goats; and each of whom must therefore pay three ewes. Then; when the zakat collector is on his way; they split up their flocks so that they only have to pay one ewe each. This they are forbidden to do. And so it is said; Those separated should not be gathered together nor should those gathered together be separated in order to avoid paying zakat. MuwataMalik-017-001-35703 | Malik related to me from Ibn Shihab from Urwa Ibn AlZubair that Abdulrahman Ibn Abd AlQari said; I went out with Umar Ibn alKhattab in Ramadan to the Masjid and the people there were spread out in groups. Some men were praying by themselves; whilst others were praying in small groups. Umar said; By Allah! It would be better in my opinion if these people gathered behind one reciter. So he gathered them behind Ubay Ibn Kaab Then I went out with him another night and the people were praying behind their Quran reciter. Umar said; How excellent this new way is; but what you miss while you are asleep is better than what you watch in prayer.
