SahihAlBukhari-017-001-1220Narrated Jabir Bin Abdullah: We were in the company of Allah Messenger ﷺ and we assumed the state of Ihram of Hajj and arrived at Mecca on the fourth of Dhu AlHijja. The Prophet ﷺ ordered us to perform the Tawaf around the Kaba and Sai between AlSafa and AlMarwa and use our lhram just for Umra; and finish the state of Ihram unless we had our Hadi with us. None of us had the Hadi with him except the Prophet ﷺ and Talha. Ali came from Yemen and brought the Hadi with him. Ali said; I had assumed the state of Ihram with the same intention as that with which Allah Messenger ﷺ had assumed it. The people said; How can we proceed to Mina and our male organs are dribbling? Allah Messenger ﷺ said; If I had formerly known what I came to know latterly; I would not have brought the Hadi; and had there been no Hadi with me; I would have finished my Ihram. Suraqa bin Malik met the Prophet ﷺ while he was throwing pebbles at the Jamrat AlAqaba; and asked; O Allah Messenger ﷺ ! Is this permitted for us only? The Prophet ﷺ replied. No; it is forever Aisha had arrived at Mecca while she was menstruating; therefore the Prophet ﷺ ordered her to perform all the ceremonies of Hajj except the Tawaf around the Kaba; and not to perform her prayers unless and until she became clean. When they encamped at AlBatha; Aisha said; O Allah Messenger ﷺ ! You are proceeding after performing both Hajj and Umra while I am proceeding with Hajj only? So the Prophet ﷺ ordered Abdulrahman Bin Abu Bakr AlSiddiq to go with her to AlTanim; and so she performed the Umra in Dhu AlHijja after the days of the Hajj. The Chapter on Menustration In Alhajj in HodHood Indexing, Chapter on If I had formerly known what I came to know recently in Sahih AlBukhari
SahihAlBukhari-017-001-1496Narrated Ata: I heard Jabir Bin Abdullah in a gathering saying; We; the companions of Allah Messenger ﷺ assumed the state of Ihram to perform only Hajj without Umra. Jabir added; The Prophet ﷺ arrived at Mecca on the fourth of Dhu AlHijja. And when we arrived in Mecca the Prophet ﷺ ordered us to finish the state of Ihram; saying; Finish your lhram and go to your wives for sexual relation. Jabir added; The Prophet did not oblige us to go to our wives but he only made that legal for us. Then he heard that we were saying; When there remains only five days between us and the Day of Arafat he orders us to finish our Ihram by sleeping with our wives in which case we will proceed to Arafat with our male organs dribbling with semen? Jabir pointed out with his hand illustrating what he was saying. Allah Messenger ﷺ stood up and said; You People know that I am the most Allah-fearing; the most truthful and the best doer of good deeds pious from among you. If I had not brought the Hadi with me; I would have finished my Ihram as you will do; so finish your Ihram. If I had formerly known what I came to know lately; I would not have brought the Hadi with me. So we finished our Ihram and listened to the Prophet ﷺ and obeyed him. Masruq added; I heard the clapping of her hands behind the curtain. She said; I used to twist the garlands for the Hadi of Allah Messenger ﷺ and he used to send his Hadi to Kaba but he never used to regard as unlawful what was lawful for men to do with their wives till the people returned from the Hajj. The Chapter on Almadinah And Alhajj in HodHood Indexing, Chapter on If someone sends his Hadi to be slaughtered in Sahih AlBukhari

So i dismounted the horse and picked it whip up and mounted again and caught the wild ass after chasing it. It was behind a hillock and I attacked it with my spear and killed it. Then I brought it to my companions. Some of them said: Eat it; while others said: Do not eat it. The Apostle of Allah ﷺ was in front of us. His Companions entered upon the state of Ihram whereas he did not; for it was conveyed to the Messenger of Allah ﷺ that the enemy was hiding at Ghaiqa. The Messenger of Allah ﷺ went forward. But we were afraid lest we should be separated from the Messenger of Allah. So I proceeded on with a view to seeking the Messenger of Allah ﷺ. Some- times Idashed my horse and sometimes I made it run at a leisurely pace keeping pace with others. In the meanwhile I met a person from Banfu Ghifar in the middle of the night. I said to him: Where did you meet the messenger of Allah ﷺ ? He said: I left him at Tabin and he intended to halt at Suqya to spend the afternoon. I met him and said: Messenger of Allah. your Companions convey salutations and benedictions of Allah to you and they fear that they may not be separated from you and the enemy may do harm to you ; so wait for them; and he the Holy Prophet waited for them. When we came to Makkah four days of Dhu AlHijja had already passed. We the circumambulated the Kabah and ran between AlSafa and AlMarwah. The Apostle of Allaah ﷺ then commanded us to put off ihram. He said if I had not brought the sacrificial animals; I would have taken off Ihram. Suraqah Bin Malik then stood up and said Apostle of Allaah ; what do you think; have you provided this facility to us for this year alone or forever? He said I raised my voice in talbiyah for which the Apostle of Allaah ﷺ raised his voice. The Prophet ﷺ commanded his companions to change it into Umrah and clip their hair after running between AlSafa and AlMarwah ; and then take off their ihram except those who brought the sacrificial animals with them. They remarked should we go to Mina with our penises dripping with prostatic fluid? These remarks reached the Apostle of Allaah ﷺ. The people too raised their voices in talbiyah for both of them. When we came to Makkah ; he ordered the people to take off their ihram and they did so. When the eight of Dhu AlHijja came; they again raised their voices in talbiyah for Hajj i.e.; wore ihram for Hajj. When Ali returned from the Yemen to the Messenger of Allah ﷺ he said: I found that Fatimah had put on coloured clothes and the smell of the perfume she had used was pervading the house. He expressed his amazement at the use of coloured clothes and perfume. She said: What is wrong with you? The Messenger of Allah ﷺ has ordered his companions to put off their ihram and they did so. Ali said: I said to her: I raised my voice in talbiyah for which the Prophet ﷺ raised his voice i.e. I wore ihram for qiran. Then I came to the Prophet ﷺ. He asked me : How did you do? I replied: I raised my voice in talbiyah; for which the Prophet ﷺ raised his voice. He said: I have brought the sacrificial animals with me and combined umrah and hajj. In Muwata Malik

Hadith PageArabic TextEnglish TranslationBook and Chapter
MuwataMalik-017-001-35535Yahya said that he heard Malik say; Someone who eats or drinks out of neglect or forgetfulness during a voluntary fast does not have to repeat his fast; but he should continue fasting for the rest of the day in which he eats or drinks while voluntarily fasting; and not stop fasting. Someone to whom something unexpected happens which causes him to break his fast while he is fasting voluntarily does not have to repeat his fast if he has broken it for a reason; and not simply because he decided to break his fast. Just as I do not think that someone has to repeat a voluntary prayer if he has had to stop it because of some discharge which he could prevent and which meant that he had to repeat his Ablution. Malik said; Once a man has begun doing any of the right actions Alamal AlSaliha such as the prayer; the fast and the hajj; or similar right actions of a voluntary nature; he should not stop until he has completed it according to what the sunna for that action is. If he says the takbir he should not stop until he has prayed two rakas. If he is fasting he should not break his fast until he has completed that day fast. If he goes into ihram he should not return until he has completed his hajj; and if he begins doing tawaf he should not stop doing so until he has gone around the Kaba seven times. He should not stop doing any of these actions once he has started them until he has completed them; except if something happens such as illness or some other matter by which a man is excused. This is because Allah; the Blessed and Exalted; says in His Book; And eat and drink until the white thread becomes clear to you from the black thread of dawn; and then complete the fast until night-time; Surat 2 ayat 187 ; and so he must complete his fast as Allah has said. Allah; the Exalted; also says; And complete the hajj and the umra for Allah; and so if a man were to go into ihram for a voluntary hajj having done his one obligatory hajj on a previous occasion ; he could not then stop doing his hajj having once begun it and leave ihram while in the middle of his hajj. Anyone that begins a voluntary act must complete it once he has begun doing it; just as an obligatory act must be completed. This is the best of what I have heard. The Chapter on Mischief Fasting Alhajj Bowing And Prostration in HodHood Indexing, The Book of Divorce in Muwata Malik

MuwataMalik-017-001-35735Yahya related to me from Malik from Zayd Ibn Aslam from Ibrahim Ibn Abdullah Ibn Hunayn from his father Abdullah Ibn Hunayn that Abdullah Ibn Abbas and AlMiswar Ibn Makhrama once had a disagreement at AlAbwa. Abdullah said that some one in ihram could wash his head; and AlMiswar Ibn Makhrama maintained that some one in ihram could not wash his head. Abdullah Ibn Hunayn continued; Abdullah Ibn Abbas sent me to Abu Ayoub AlAnsari; and I found him doing ghusl between the posts of a well; screened by a garment. I greeted him and hesaid; Who is that? I replied; I am Abdullah Ibn Hunayn. Abdullah Ibn Abbas sent me to you to ask how the Messenger of Allah; may Allah bless him and grant him peace; used to wash his head when he was in ihram. He continued; Abu Ayoub put his hand on the garment and pulled it down until I could see his head. He said to the man who was pouring out the water for him; Pour; and he poured some over his head. Then he passed his hands over his head from the front to the back and then to the front again; and then said; I saw the Messenger of Allah; may Allah bless him and grant him peace; doing it like this. The Chapter on Personal Hygiene And Ihram in HodHood Indexing, The Book of Hajj in Muwata Malik
MuwataMalik-017-001-35738Yahya related to me from Malik from Nafi that Abdullah Ibn Umar would never wash his head while he was in ihram except if he had to do ghusl because of a wet dream. Malik said; I have heard the people of knowledge say that there is no harm in someone who is in ihram rubbing his head with certain kinds of plants after he has stoned the Jamrat AlAqaba but before he has shaved his head; because once he has finished stoning the Jamrat AlAqaba it is halal for him to kill lice; to shave his head; to clean himself of body hair; and to wear normal clothes. The Chapter on Ablution Hand Head Foot And Forearm in HodHood Indexing, The Book of Hajj in Muwata Malik

In that case you can wear leather socks; but cut them off below the ankles. Do not wear any clothes that have been touched by saffron or yellow dye. Yahya said that Malik was asked about the hadith attributed to the Prophet; may Allah bless him and grant him peace; Whoever cannot find a waist wrapper should wear trousers; and he said; I have never heard this; and I do not think that some one who is in ihram can wear trousers; because among the things which the Prophet; may Allah bless him and grant him peace; forbade some one in ihram to wear were trousers; and he did not make any exception for them although he did make an exception for leather socks. 20.4 Wearing Clothes when in IhramThe Chapter on Dress And Forbidden Cloths in HodHood Indexing, The Book of Hajj in Muwata Malik

Salim forbade him to do so; but Kharija Ibn Zayd Ibn Thabit said that he could. Malik said; There is no harm in a man oiling himself with an oil which does not have any perfume in it; either before he enters ihram; or before he leaves Mina for the tawaf Alifada; if he has stoned the jamra. Yahya said that Malik was asked whether someone in ihram could eat food with saffron in it; and he said; There is no harm in some one in ihram eating it if it has been cooked. MuwataMalik-017-001-35768Yahya related to me from Malik; from Ab AlAswad Muhammad Ibn Abdulrahman fromUrwa Ibn AlZubayr; that Aisha; the wife of the Prophet; may Allah bless him and grant him peace; said; We set out with the Messenger of Allah; may Allah bless him and grant him peace; in the year of the farewell hajj; and some of us went into ihram to do umra; some of us went into ihram to do hajj and umra; and some of us went into ihram to do hajj on its own. The Messenger of Allah; may Allah bless him and grant him peace; went into ihram to do hajj on its own. Those who had gone into ihram to do umra came out of ihram after doing umra. AlMiqdad said; Ali Ibn Abi Talib went off with bits of meal and leaves on his forearms - and I shall never forget the sight of the meal and the leaves on his arms - and went to see Uthman Ibn Affan and asked him; Are you saying then that people cannot do hajj and umra together? Uthman replied; That is my opinion. Whereupon AIi got angry and went out saying; I am at your service; O Allah; I am at your service for a hajj and an umra together. Malik said; Our position here in Madina is that someone who does hajj and umra together should not remove any of his hair; nor should he come out of ihram in any way until he has sacrificed an animal; if he has one. He should come out of ihram at Mina; on the day of the sacrifice. The Chapter on Mina In Alhajj in HodHood Indexing, The Book of Hajj in Muwata Malik

This is what Abdullah Ibn Umar did when he said; If I am blocked from the House we shall do what we did when we were with the Messenger of Allah; may Allah bless him and grant him peace. He then turned to his companions and said; It is the same either way. I call you to witness that I have decided in favour of hajj and umra together. Malik said; The companions of the Messenger of Allah; may Allah bless him and grant him peace; went into ihram to do umra in the year of the farewell hajj; and the Messenger of Allah; may Allah bless him and grant him peace; said to them; Anyone that has a sacrificial animal with him should go into ihram to do hajj and umra together; and he should not come out of ihram until he has finished both. The Chapter on Perfumes Intercourse And Ihram in HodHood Indexing, The Book of Hajj in Muwata Malik
MuwataMalik-017-001-35783Yahya related to me from Malik; from Hisham Ibn Urwa; that Abdullah Ibn AlZubair stayed in Makka for nine years. He would go into ihram for hajj at the beginning of Dhu AlHijja; and Urwa Ibn AlZubayr; who was with him; would do likewise. Yahya said that Malik said; The people of Makka and whoever else is living there besides them should go into ihram for hajj if they are in Makka; and anyone that is living in the centre of Makka and is not one of the people of Makka should not leave the Haram. Yahya said that Malik said; Someone who goes into ihram for hajj in Makka should delay tawaf of the House and the say between Safa and Marwa until he has come back from Mina; which is what Abdullah Ibn Umar used to do. Malik was asked what the people of Madina; or anybody else; should do about tawaf if they went into ihram in Makka at the beginning of Dhu AlHijja; and he said; They should delay the obligatory tawaf; which is the one they combine with the say between Safa and Marwa; but they can do whatever other tawaf they want to; and they should pray two rakas every time they complete seven tawafs; which is what the companions of the Messenger of Allah; may Allah bless him and grant him peace; did when they had gone into ihram to do hajj. They delayed the tawaf of the House and the say between Safa and Marwa until they had come back from Mina. Abdullah Ibn Umar also did this; going into ihram for hajj in Makka at the beginning of Dhu AlHijja; and then delaying tawaf of theHouse and the say between Safa and Marwa until he had come back from Mina. Malik was asked whether one of the people of Makka could go into ihram to do umra in the centre of Makka; and he said; No. He should go outside the Haram and go into ihram there. The Chapter on Makkah And Alhajj in HodHood Indexing, The Book of Hajj in Muwata Malik
MuwataMalik-017-001-35786Yahya related to me from Malik; from Yahya Ibn Said; from Muhammad Ibn Ibrahim Ibn AlHarith AlTaymi; that Rabia Ibn Abdullah Ibn AlHudayr once saw a man in a state of ihram in Iraq. So he asked people about him and they said; He has given directions for his sacrificial animal to be garlanded; and it is for that reason that he has put on ihram. Rabia said; I then met Abdullah Ibn AlZubair and so I mentioned this to him and he said; By the Lord of the Kaba; an innovation. Malik was asked about some one who set out with his own sacrificial animal and marked it and garlanded it at Dh AlHulayfa; but did not go into ihram until he had reached AlJuhfa;and hesaid; I do not like that; and whoever does so has not acted properly. He should only garland his sacrificial animal; or mark it; when he goes into ihram; unless it is someone who does not intend to do hajj; in which case he sends it off and stays with his family. Malik was asked if somone who was not in ihram could set out with a sacrificial animal; and he said; Yes. There is no harm in that. He was also asked to comment on the different views people had about what became haram for some one who garlanded a sacrificial animal but did not intend to do either hajj or umra; and he said; What we go by as far as this is concerned is what Aisha; umm Almuminin said; The Messenger of Allah; may Allah bless him and grant him peace; sent his sacrificial animal off and did not go there himself; and there was nothing that Allah had made halal for him that was haram for him until the animal had been sacrificed. The Chapter on Almadinah And Alhajj in HodHood Indexing, The Book of Hajj in Muwata Malik
