He replied; If she commits illegal sexual intercourse; then flog her fifty stripes ; and if she commits illegal sexual intercourse after that for the second time ; then flog her fifty stripes ; and if she commits illegal sexual intercourse for the third time ; then flog her fifty stripes and sell her for even a hair rope. SahihMuslim-017-001-20731 | Anas reported that the son of Abu Talba who was born of Umm Sulaim died. She Umm Sulaim said to the members of her family: Do not narrate to Abu Talha about his son until I narrate it to him. Abu Talha came home ; she presented to him the supper. He took it and drank water. She then embellished herself which she did not do before. He Abu Talha had a sexual intercourse with her and when she saw that he was satisfied after sexual intercourse with her; she said: Abu Talha ; if some people borrow something from another family and then the members of the family ask for its return; would they resist its return? He said: No. She said: I inform you about the death of your son. He was annoyed; and said: You did not inform me until I had a sexual intercourse with you and you later on gave me information about my son. He went to Allah Messenger ﷺ and informed him what had happened. Thereupon Allah Messenger ﷺ said: May Allah bless both of you in the night spent by you! He the narrator said: She became pregnant. Allah Messenger may peace he upon him was in the course of a journey and she was along with him and when Allah Messenger ﷺ came back to Medina from the journey he did not enter his house during the night. When the people came near Medina; she felt the pangs of delivery. He Abu Talha remained with her and Allah Messenger ﷺ proceeded on. Abu Talha said: O Lord; you know that I love to go along with Allah Messenger when he goes out and enter along with him when he enters and I have been detained as Thou seest. Umm Sulaim said: Abu Talha ; I do not feel so much pain as I was feeling formerly; so better proceed on. So we proceeded on and she felt the pangs of delivery as they reached Medina and a child was born and my mother said to me: Anas; none should suckle him until you go to Allah Messenger ﷺ tomorrow morning. And when it was morning I carried him the child and went along with him to Allah Messenger may peace beupon him. He said: I saw that he had in his hand the instrument for the cauterisation of the camels. When he saw me. he said: This is; perhaps; what Umm Sulaim has given birth to. I said: Yes. He laid down that instrument on the ground. I brought that child to him and placed it in his lap and Allah Messenger ﷺ asked Ajwa dates of Medina to be brought and softened them in his month. When these had become palatable he placed them in the mouth of that child. The child began to taste them. Then Allah Messenger ﷺ said: See what love the Ansar have for dates. SahihMuslim-017-001-21481 | Ibn Umar Allah be pleased with them reported that he divorced his wife during the period of menses. Umar Allah be; pleased with him asked Allah Apostle ﷺ ; and he commanded him Abdullah Bin Umar to have her back and then allow her respite until she enters the period of the second menses; and then allow her respite until she is purified; then divorce her finally before touching her having a sexual intercourse with her ; for that is the prescribed period which Allah commanded to be kept in view for divorcing the women. When Ibn Umar Allah be pleased with them was asked about the person who divorces his wife in the state of menses; he said: If you pronounced one divorce or two; Allah Messenger ﷺ had commanded him to take her back; and then allow her respite until she enters the period of the second menses; and then allow her respite until she is purified; and then divorce her finally before touching her having a sexual intercourse with her ; and if you have pronounced three divorces at one and the same time you have in fact disobeyed your Lord with regard to what He commanded you about divorcing your wife. SahihMuslim-017-001-22658 | Abu Mousa reported: There cropped up a difference of opinion between a group of Muhajirs Emigrants and a group of Ansar Helpers and the point of dispute was that the Ansar said: The bath because of sexual intercourse becomes obligatory only-when the semen spurts out or ejaculates. But the Muhajirs said: When a man has sexual intercourse with the woman ; a bath becomes obligatory no matter whether or not there is seminal emission or ejaculation. Abu Mousa said: Well; I satisfy you on this issue. SahihMuslim-017-001-22860 | Atareported: I; along with some people; heard Jabir Bin Abdullah saying: We the Companions of Muhammad ﷺ put on Ihram for Hajj only. Ata further said that Jabir stated: Allah Apostle ﷺ came on the 4th of Dhu AlHijja and he commanded us to put off Ihram. Atasaid that he Allah Apostle commanded them to put off Ihram and to go to their wives for intercourse. Ata said: It was not obligatory for them; but intercourse with them had become permissible. We said: When only five days had been left to reach Arafa; he the Holy Prophet commanded us to have intercourse with our wives. And we reached Arafa in a state as if we had just had intercourse with them. He Ata said: Jabir pointed with his hand and I perceive as if I am seeing his hand as it moved. In the meantime the Messenger of Allah ﷺ stood amongst us and said: You are well aware that I am the most God-fearing; most truthful and most pious amongst you. And if there were not sacrificial animals with me; I would also have put off Ihram as you have put off. And if I were to know this matter of mine what I have come to know later on; I would not have brought sacrificial animals with me. He said: For the purpose for which the Messenger of Allah ﷺ had entered. The Prophet had entered as a Qiran; i.e. Ihram covering both Umra and Hajj simultaneously. Thereupon Allah Messenger ﷺ said: Offer a sacrifice of animal; and retain Ihram. And Ali brought a sacrificial animal for him for the Holy Prophet. SunanAlTermithi-017-001-9854 | Narrated Anas: When the women among the Jews menstruated; they would not eat with them; nor drink with them; nor mingle with them in their homes. She said: By Allah; I did not call you to bear witness; rather I called you to have intercourse with me; or to drink a cup of this wine; or to kill this boy. He said: Pour me a cup of this wine. So she poured him a cup. He said: Give me more. And soon he had intercourse with her and killed the boy. SunanAbuDawoud-017-001-25052 | Narrated Salamah Ibn Sakhr AlBayadi: I was a man who was more given than others to sexual intercourse with women. When the month of Ramadan came; I feared lest I should have intercourse with my wife; and this evil should remain with me till the morning. So I made my wife like my mother back to me till the end of Ramadan. But one night when she was waiting upon me; something of her was revealed. Suddenly I jumped upon her. I said: By Him Who sent you with truth; I do not possess a neck other than this: and I struck the surface of my neck. He said: Then fast two consecutive months. I said: Whatever I suffered is due to fasting. He said: Feed sixty poor people with a wasq of dates. I said: By Him Who sent you with truth; we passed the night hungry; there was no food in our house. He said: Then go to the collector of sadaqah of Banu Zurayq; he must give it to you. Then feed sixty poor people with a wasq of dates; and you and your family eat the remaining dates. Then I came back to my people; and said to them : I found with you poverty and bad opinion; and I found with the Prophet ﷺ prosperity and good opinion. He has commanded me to give alms to you. SunanAbuDawoud-017-001-25111 | Aisha wife of the Prophet ﷺ said Marriage in pre Islamic times was of four kinds. One of them was the marriage contracted by the people today. A man asked another man to marry his relative sister or daughter to him. He fixed the dower and married her to him. Another kind of marriage was that a man asked his wife when she became pure from menstruation to send fro so and so and have sexual intercourse with him. Her husband kept himself aloof and did not have intercourse with her till It became apparent that she was pregnant from the man who had intercourse with her. When it was manifest that she was pregnant; her husband approached her if he liked. This marriage was called istibda to utilize man for intercourse for a noble birth. A third kind of marriage was that a group of people less than ten in number entered upon a woman and had intercourse with her. When she conceived gave birth to a child and a number of days passed after her delivery; she sent for them. No one of them could refuse to attend and they gathered before her. She said to them You have realized your affair. I have now given birth to a child. And this is your son. O so and so. She called the name of anyone of them she liked and the child was attributed to him. A fourth kind of marriage was that many people gathered together and entered upon a woman who did not prevent anyone who came to her. They were prostitutes. They hoisted flags at their doors which served as a sign for the one who intended to enter upon them. When she became pregnant and delivered the child ; they got together before her and called for the experts of tracing relationship from physical features. MuwataMalik-017-001-35205 | Yahya related to me from Malik that he had heard that Marwan Ibn AlHakam decided about a man who had made a vow to abstain from intercourse with his wife; that when four months had passed; it was a divorce and he could return to her as long as she was in her idda. Malik added; That was also the opinion of Ibn Shihab. Malik said that if a man made a vow to abstain from intercourse with his wife and at the end of four months he declared his intent to continue to abstain; he was divorced. He could go back to his wife; but if he did not have intercourse with her before the end of her idda; he had no access to her and he could not go back to her unless he had an excuse - illness; imprisonment; or a similar excuse. His return to her maintained her as his wife. If her idda passed and then he married her after that and did not have intercourse with her until four months had passed and he declared his intent to continue to abstain; divorce was applied to him by the first vow. If four months passed; and he had not returned to her; he had no idda against her nor access because he had married her and then divorced her before touching her. Malik said that a man who made a vow to abstain from intercourse with his wife and continued to abstain after four months and so divorced her; but then returned and did not touch her and four months were completed before her idda was completed; did not have to declare his intent and divorce did not befall him. If he had intercourse with her before the end of her idda; he was entitled to her. If her idda passed before he had intercourse with her; he had no access to her. This is what Malik preferred of what he had heard on the subject. Malik said that if a man made a vow to abstain from intercourse with his wife and then divorced her; and the four months of the vow were completed before completion of the idda of the divorce; it counted as two pronouncements of divorce. If he declared his intention to continue to abstain and the idda of the divorce finished before the four months the vow of abstention was not a divorce. That was because the four months had passed and she was not his on that day. Malik said; If someone makes a vow not to have intercourse with his wife for a day or a month and then waits until more than four months have passed; it is not ila. Ila only applies to someone who vows more than four months. As for the one who vows not to have intercourse with his wife for four months or less than that; I do not think that it is ila because when the term enters into it at which it stops; he comes out of his oath and he does not have to declare his intention. Malik said; If someone vows to his wife not to have intercourse with her until her child has been weaned; that is not ila. MuwataMalik-017-001-35209 | Yahya related to me from Malik from Hisham Ibn Urwa that his father said that a man who pronounced a dhihar from his four wives in one statement; had only to do one kaffara. Yahya related the same as that to me from Malik from Rabia Ibn Abi Abdulrahman Malik said; That is what is done among us. Allah; the Exalted said about the kaffara for pronouncing dhihar; It is to free a slave before they touch one another. If he does not find the means to do that; then fasting for two consecutive months before they touch one another. If he cannot do that; it is to feed sixty poor people. Surat 58 ayats 4;5. Malik said that a man who pronounced dhihar from his wife on various occasions had only to do one kaffara. If he pronounced dhihar; and then did kaffara; and then pronounced dhihar after he had done the kaffara; he had to do kaffara again. Malik said; Some one who pronounces dhihar from his wife and then has intercourse with her before he has done kaffara; only has to do one kaffara. He must abstain from her until he does kaffara and ask forgiveness of Allah. That is the best of what I have heard. Malik said; It is the same with dhihar using any prohibited relations of fosterage and ancestry. Malik said; Women have no dhihar. Malik said that he had heard that the commentary on the word of Allah; the Blessed; the Exalted; Those of you who pronounce the dhihar about their wives; and then retract what they have said; Surat 56 ayat 3 ; was that a man pronounced dhihar on his wife and then decided to keep her and have intercourse with her. If he decided on that; he must do kaffara. If he divorced her and did not decide to retract his dhihar of her and to keep her and have intercourse with her; there would be no kaffara incumbent on him. Maliksaid; If he marries her after that; he does not touch her until he has completed the kaffara of pronouncing dhihar. Malik said that if a man who pronounced dhihar from his slave-girl wanted to have intercourse with her; he had to do the kaffara of the dhihar before he could sleep with her. Malik said; All of the people of knowledge I have seen said that a slave-girl makes a free man muhsan when he marries her and consummates the marriage. Malik said; A slave makes a free woman muhsana when he consummates a marriage with her and a free woman only makes a slave muhsan when he is freed and he is her husband and has had sexual relations with her after he has been set free. If he parts from her before he is free; he is not a muhsan unless he marries her after having been set free and he consummates the marriage. Malik said; When a slave-girl is married to a free man and then he separates from her before she is set free; his marriage to her does not make her muhsana. She is not muhsana until she has married after she has been set free and she has had intercourse with her husband. That gives her ihsan. If she is the wife of a freeman and then she is set free while she is his wife before he separates from her; the man makes her muhsana if he has intercourse with her after she has been set free. Malik said; Umra is a sunna; and we do not know of any muslim who has ever said that it is permissible not to do it. Malik said; I do not think that anyone can do more than one umra in any one year. Malik said that someone doing umra who had sexual intercourse with his wife had to sacrifice an animal and do a second umra; which he had to begin when he had finished the one that he had spoiled. He should go into ihram at the same place where he went into ihram for the umra which he had spoiled; except if he had entered into ihram at a place further away than his miqat. This was because he only had to go into ihram from his miqat. Malik said; Someone who entered Makka to do umra; and does tawaf of the House and say between Safa and Marwa while he is junub; or not in Ablution; and afterwards has intercourse with his wife; and then remembers; should do ghusl; or Ablution; and then go back and do tawaf around the House and say between Safa and Marwa and do another umra and sacrifice an animal. Said said; There is a man who has had intercourse with his wife while in ihram who has sent a message to Madina asking about it. Some of them said; They should be kept apart until a future year; and Said Ibn AlMusayab said; They should carry on and complete the hajj which they have spoiled; and then return home when they have finished. If another hajj comes upon them; they must do hajj and sacrifice an animal. They should go into ihram at the same place where they went into ihram for the hajj that they spoiled; and they should keep apart until they have finished their hajj. Malik said; They should both sacrifice an animal. Malik said; about a man who had intercourse with his wife during hajj after he had come down from Arafa but before he had stoned the Jamra; He must sacrifice an animal and do hajj again in another year. If; however; he had intercourse with his wife after he stoned the Jamra; he only has to do an umra and sacrifice an animal and he does not have to do another hajj. Malik said; What spoils a hajj or an umra and makes sacrificing an animal and repeating the hajj necessary is the meeting of the two circumcised parts; even if there is no emission. It is also made necessary by an emission if it is the result of bodily contact. I do not think that a man who remembers something and has an emission owes anything; and if a man were to kiss his wife and no emission were to occur from that; he would only have to sacrifice an animal. A woman in ihram who has intercourse with her husband several times during hajj or umra out of obedience to him only has to do another hajj and sacrifice an animal. That is if her husband has intercourse with her while she is doing hajj. Yahya said that Malik said; The position with us is that when a woman who bleeds as if menstruating starts to do the prayer again; her husband can have sexual intercourse with her. Similarly; if a woman who has given birth sees blood after she has reached the fullest extent that bleeding normally restrains women; her husband can have sexual intercourse with her and she is in the same position as a woman who bleeds as if menstruating.
