If they do come to thee, either judge between them, or decline to interfere. If thou decline, they cannot hurt thee in the least. If thou judge, judge in equity between them. For Allah loveth those who judge in equity. | |

Those who after receiving direction from their Lord, desist, shall be pardoned for the past; their case is for Allah (to judge); but those who repeat (The offence) are companions of the Fire: They will abide therein (for ever). | |

It is not lawful for you, (Men), to take back any of your gifts (from your wives), except when both parties fear that they would be unable to keep the limits ordained by Allah. If ye (judges) do indeed fear that they would be unable to keep the limits ordained by Allah, there is no blame on either of them if she give something for her freedom. These are the limits ordained by Allah; so do not transgress them if any do transgress the limits ordained by Allah, such persons wrong (Themselves as well as others). | |

Walakal-hamd; Laka mulkus-samawati Alard wa man fihinna. Walakal-hamd; anta nurus-samawati Alard. Wa lakal-hamd; anta Alhaq wa waduka-lhaq; wa liqauka Haq; wa qauluka Haq; Aljannatu Han wan-naru Haq wannabiyuna Haq. Wa Muhammadun; sallal-lahualaihi wasallam; Haq; was-saatu Haq. Allahumma aslamtu Laka wabika amantu; wa Alaika tawakkaltu; wa ilaika anabtu wa bika khasamtu; wa ilaika hakamtu faghfir li ma qaddamtu wama akh-khartu wama as-rartu wamaa lantu; anta Almuqaddim wa anta Almu akh-khir; la ilaha illa anta or la ilaha ghairuka. O Allah! All the praises are for you; You are the Holder of the Heavens and the Earth; And whatever is in them. All the praises are for You; You have the possession of the Heavens and the Earth And whatever is in them. All the praises are for You; You are the Light of the Heavens and the Earth And all the praises are for You; You are the King of the Heavens and the Earth; And all the praises are for You; You are the Truth and Your Promise is the truth; And to meet You is true; Your Word is the truth And Paradise is true And Hell is true And all the Prophets Peace be upon them are true; And Muhammad is true; And the Day of Resurrection is true. SahihAlBukhari-017-001-1269 | Narrated Abu Qatada: Allah Messenger ﷺ said on the Day of the battle of Hunain; Whoever has killed an infidel and has a proof or a witness for it; then the salb arms and belongings of that deceased will be for him. I stood up to seek a witness to testify that I had killed an infidel but I could not find any witness and then sat down. Then I thought that I should mention the case to Allah Messenger ﷺ I and when I did so a man from those who were sitting with him said; The arms of the killed person he has mentioned; are with me; so please satisfy him on my behalf. Abu Bakr said; No; he will not give the arms to a bird of Quraish and deprive one of Allah lions of it who fights for the cause of Allah and His Apostle. Allah Messenger ﷺ I stood up and gave it to me; and I bought a garden with its price; and that was my first property which I owned through the war booty. The people of Hijaz said; A judge should not pass a judgment according to his knowledge; whether he was a witness at the time he was the judge or before that And if a litigant gives a confession in favor of his opponent in the court; in the opinion of some scholars; the judge should not pass a judgment against him till the latter calls two witnesses to witness his confession. And some people of Iraq said; A judge can pass a judgement according to what he hears or witnesses the litigant confession in the court itself; but if the confession takes place outside the court; he should not pass the judgment unless two witnesses witness the confession. Some of them said; A judge can pass a judgement depending on his knowledge of the case as he is trust-worthy; and that a witness is Required just to reveal the truth. The judge knowledge is more than the witness. Some said; A judge can judge according to his knowledge only in cases involving property; but in other cases he cannot. Allah is Able to do all things. 59.6 So this property was especially granted to Allah Messenger ﷺ. But by Allah he neither withheld it from you; nor did he keep it for himself and deprive you of it; but he gave it all to you and distributed it among you till only this remained out of it. And out of this property Allah Messenger ﷺ used to provide his family with their yearly needs; and whatever remained; he would spend where Allah Property the revenues of Zakat used to be spent. Allah Messenger ﷺ kept on acting like this throughout his lifetime. Now I beseech you by Allah; do you know that? They said; Yes. Umar added; When Allah had taken His Apostle unto Him; Abu Bakr said; I am the successor of Allah Messenger ﷺ. Then Umar turned towards Ali and Abbas and said; You both claim that Abu Bakr was so-and-so! But Allah knows that he was honest; sincere; pious and right in that matter. Then Allah caused Abu Bakr to die; and I said; I am the successor of Allah Messenger ﷺ and Abu Bakr. So I kept this property in my possession for the first two years of my rule; and I used to do the same with it as Allah Messenger ﷺ and Abu Bakr used to do. Later both of you Ali and Abbas came to me with the same claim and the same problem. O Abbas! You came to me demanding your share from the inheritance of the son of your brother; and he Ali came to me demanding his wives share from the inheritance of her father. So I said to you; If you wish I will hand over this property to you; on condition that you both promise me before Allah that you will manage it in the same way as Allah Messenger ﷺ and Abu Bakr did; and as I have done since the beginning of my rule; otherwise you should not speak to me about it. So you both said; Hand over this property to us on this condition. And on this condition I handed it over to you. I beseech you by Allah; did I hand it over to them on that condition? The group said; Yes. Umar then faced Ali and Abbas and said; I beseech you both by Allah; did I hand it over to you both on that condition? They both said; Yes. Umar added; Do you want me now to give a decision other than that? SahihMuslim-017-001-17393 | AlBara Bin Azib reported: There happened to pass by Allah Apostle ﷺ a Jew blackened and lashed. Allah Apostle ﷺ called them the Jews and said: Is this the punishment that you find in your Book Torah as a prescribed punishment for adultery? They said: Yes. He the Holy Prophet called one of the scholars amongst them and said: I ask you in the name of Allah Who sent down the Torah on Moses if that is the prescribed punishment for adultery that you find in your Book. He said: No. Had you not asked me in the name of Allah; I would not have given you this information. We find stoning to death as punishment prescribed in the Torah. But this crime became quite common amongst our aristocratic class. So when we caught hold of any rich person indulging in this offence we spared him; but when we caught hold of a helpless person we imposed the prescribed punishment upon him. We then said: Let us argree on a punishment which we can inflict both upon the rich and the poor. So We decided to blacken the face with coal and flog as a substitute punishment for stoning. Thereupon Allah Messenger ﷺ said: O Allah; I am the first to revive Thy command when they had made it dead. He then commanded and he the offender was stoned to death. Allah; the Majestic and Glorious; sent down this verse : O Messenger; the behaviour of those who vie with one another in denying the truth should not grieve you... up to is vouchsafed unto you; accept it v. 41 2176 It was said by the Jews : Go to Muhammad; it he commands you to blacken the face and award flogging as punishment for adultery ; then accept it; but it he gives verdict for stoning; then avoid it. So his disputant said - and he was more eloquent that him: I agree of O Messenger of Allah! Judge between us by the Book of Allah; and allow me to speak. My son was a servant for this man and he committed adultery with his wife. So they told me that my son was to be stoned. I paid him one hundred female sheep and a female slave. Then I met some people from the people of knowledge and they said that my son was to be lashed one hundred times; and to be banished for a year and that stoning is only for this man wife. So the Prophet ﷺ said: By the One in Whose Hand is my soul! I will judge between you two by the Book of Allah. The one hundred female sheep and the female slave should be returned to you. For your son is one hundred lashes and banishment for a year. O Unais! Go to this Man wife; and if she confesses then stone her. Do you not see the people are becoming engrossed in story-telling? He said: They have been consumed with it? I said: Yes. He said: As for me; I heard the Messenger of Allah ﷺ saying: Indeed there comes a Fitnah So I said: What is the way out from it O Messenger of Allah? He said: Allah book. In it is news for what happened before you; and information about what comes after you; and judgement for what happens between you. It is the Criterion between right and wrong without jest. Whoever among the oppressive abandons it; Allah crushes him; and whoever seeks guidance from other than it; then Allah leaves him to stray. It is the firm rope of Allah; it is the wise remembrance; it is the straight path; and it is the one that the desires can not distort; nor can the tongues twist it; nor can the scholars ever have enough of it; and it shall not become dull from reciting it much; and the amazement of it does not diminish. When a man of Qurayzah killed a man of AlNadir; he would be killed. But if a man of AlNadir killed a man of Qurayzah; a hundred wasq of dates would be paid as blood-money. When Prophethood was bestowed upon the Prophet ﷺ ; a man of AlNadir killed a man of Qurayzah. They said: Give him to us; we shall kill him. They replied: We have the Prophet ﷺ between you and us. So they came to him. Thereupon the following verse was revealed: If thou judge; judge in equity between them. In equity means life for a life. SunanAbuDawoud-017-001-26644 | Narrated AlBara Ibn Azib: The people passed by the Messenger of Allah ﷺ with a Jew who was blackened with charcoal and who was being flogged. He called them and said: Is this the prescribed punishment for a fornicator? They said: Yes. He then called on a learned man among them and asked him: I adjure you by Allah Who revealed the Torah to Moses; do you find this prescribed punishment for a fornicator in your divine Book? He said: By Allah; no. If you had not adjured me about this; I should not have informed you. We find stoning to be prescribed punishment for a fornicator in our Divine Book. But it fornication became frequent in our people of rank; so when we seized a person of rank; we left him alone; and when we seized a weak person; we inflicted the prescribed punishment on him. So we said: Come; let us agree on something which may be enforced equally on people of higher and lower rank. So we agreed to blacken the face of a criminal with charcoal; and flog him; and we abandoned stoning. The Messenger of Allah ﷺ then said: O Allah; I am the first to give life to Thy command which they have killed. So he commanded regarding him the Jew and he was stoned to death. Allah Most High then sent down: O Apostle; let not those who race one another into unbelief; make thee grieve... up to They say: If you are given this; take it; but if not; beware!.... up to And if any do fail to judge by the light of what Allah hath revealed; they are no better than unbelievers; about Jews; up to And if any do fail to judge by the right of what Allah hath revealed; they are no better than wrong-doers about Jews: and revealed the verses up to And if any do fail to judge by the light of what Allah hath revealed; they are no better than those who rebel. MuwataMalik-017-001-34772 | Malik related to me from Ibn Shihab from Ubaydullah Ibn Abdullah Ibn Utba Ibn Masud that Abu Huraira and Zayd Ibn Khalid AlJuhani informed him that two men brought a dispute to the Messenger of Allah; may Allah bless him and grant him peace. One of them said; Messenger of Allah! Judge between us by the Book of Allah! The other said; and he was the wiser of the two; Yes; Messenger of Allah. Judge between us by the Book of Allah and give me permission to speak. He said; Speak. He said; My son was hired by this person and he committed fornication with his wife. He told me that my son deserved stoning; and I ransomed him for one hundred sheep and a slave-girl. Then I asked the people of knowledge and they told me that my son deserved to be flogged with one hundred lashes and exiled for a year; and they informed me that the woman deserved to be stoned. The Messenger of Allah; may Allah bless him and grant him peace; said; By him in whose Hand myself is; I will judge between you by the Book of Allah. As for your sheep and slave girl; they should be returned to you. Your son should have one hundred lashes and be exiled for a year. Umar saw that the right belonged to the jew and decided in his favour. The jew said to him; By Allah! You have judged correctly. So Umar Ibn AlKhattab struck him with a whip and said; How can you be sure. The jew said to him; We find that there is no judge who judges correctly but that there is an angel on his right side and an angel on his left side who guide him and give him success in the truth as long as he is with the truth. MuwataMalik-017-001-35902 | Yahya related to me from Malik that he had heard that Abdullah Ibn Abbas used to say; The least difficult thing acceptable as a sacrificial animal is a sheep. Malik said; That is what I like most out of what I have heard about the matter; because Allah; the Blessed and Exalted; says in His Book; O you who trust; do not kill game while you are in ihram. Whoever of you kills it intentionally; there shall be repayment the like of what he has slain; from livestock; as shall be judged by two men of justice among you; a sacrificial animal which will reach the Kaba; or food for poor people; or the equivalent of that in fasting; Surat 5 ayat 95 and a sheep is one of the animals which is judged to be acceptable as a sacrifice. Allah has called it a sacrificial animal; and there is no dispute among us about the matter. How; indeed; could anyone be in doubt about the matter?
