SahihAlBukhari-017-001-1683 | Narrated Malik Bin Aus: I went and entered upon Umar; his doorman; Yarfa came saying Uthman; Abdulrahman AlZubair and Saad are asking your permission to see you. May I admit them? Umar said; Yes. So he admitted them Then he came again and said; May I admit Ali and Abbas? He said; Yes. Abbas said; O; chief of the believers! Judge between me and this man Ali. Umar said; I beseech you by Allah by Whose permission both the heaven and the earth exist; do you know that Allah Messenger ﷺ said; Our the Apostles property will not be inherited; and whatever we leave after our death is to be spent in charity? And by that Allah Messenger ﷺ meant himself. The group said; No doubt ; he said so. Umar then faced Ali and Abbas and said; Do you both know that Allah Messenger ﷺ said that? They replied; No doubt ; he said so. Umar said; So let me talk to you about this matter. Allah favored His Apostle with something of this Fai i.e. booty won by the Muslims at war without fighting which He did not give to anybody else; Allah said:- And what Allah gave to His Apostle Fai Booty.........to do all things.... 59.6 And so that property was only for Allah Messenger ﷺ. Yet; by Allah; he neither gathered that property for himself nor withheld it from you; but he gave its income to you; and distributed it among you till there remained the present property out of which the Prophet ﷺ used to spend the yearly maintenance for his family; and whatever used to remain; he used to spend it where Allah property is spent i.e. in charity etc.. Allah Messenger ﷺ followed that throughout his life. Now I beseech you by Allah; do you know all that? They said; Yes. Umar then said to Ali and Abbas; I beseech you by Allah; do you know that? Both of them said; Yes. Umar added; And when the Prophet ﷺ died; Abu Bakr said; I am the successor of Allah Messenger ﷺ ; and took charge of that property and managed it in the same way as Allah Messenger ﷺ did. Then I took charge of this property for two years during which I managed it as Allah Messenger ﷺ and Abu Bakr did. Then you both Ali and Abbas came to talk to me; bearing the same claim and presenting the same case. O Abbas! You came to me asking for your share from the property of your nephew; and this man Ali came to me; asking for the share of h is wife from the property of her father. I said; If you both wish; I will give that to you on that condition i.e. that you would follow the way of the Prophet ﷺ and Abu Bakr and as I Umar have done in man aging it. Now both of you seek of me a verdict other than that? Lo! By Allah; by Whose permission both the heaven and the earth exist; I will not give any verdict other than that till the Hour is established. He said; Shall I not tell you a thing; by doing which; you will catch up with those who are ahead of you and supersede those who will come after you; and nobody will be able to do such a good deed as you do except the one who does the same deed as you do. I replied; Labbaik wa Sadaik; O Allah Messenger ﷺ ! He said: Then half a Dinar? I said: They will not be able. He said: Then how much? I said A barely corn. He said: You made it too little. He said: So the Ayah was revealed: Are you afraid of spending in charity before your private consultation? SunanAlTermithi-017-001-9864 | Narrated Abu Malik: from AlBara regarding : And do not aim at that which is bad to spend from it 2:267 - he said: It was revealed about us; the people of the Ansar who were date-palm owners. A man would bring the amount of dates that he would from his date-palms; either a lot or a little. A man would bring a cluster or two and hang it in the Masjid. The people of AlSuffah did not have food; so one of them would go up to the cluster and hit it with his stick; and unripe and ripe dates would fall; and he would eat. Some people did not hope for good; so a man would bring a cluster with pitless and hard dates; and a cluster with damaged dates; and hang it. So Allah; Blessed and Most High; revealed: O you who believe! Spend of the good things which you have earned; and of that which We have produced from the earth for you; and do not aim at that which is bad to spend from it 2:267. They said: If one of you were given similar to what he gave; he would take it except bashfully with your eyes closed. So after that; one of us would bring the best that we had. | The Chapter on Food And Trees in HodHood Indexing, The Book of Chapters on Tafsir in Sunan AlTermithi |

SunanAlNasai-017-001-14427 | Narrated Ubaidullah Bin Abdullah Bin Utbah: It was narrated from Ubaidullah Bin Abdullah Bin Utbah that during the reign of Marwan; Abdullah Bin Amr Bin Uthman; who was a young man; issued a final divorce to the daughter of Saeed Bin Zaid; whose mother was Bint Qais. Her maternal aunt; Fatimah bint Qais; sent word to her telling her to move from the house of Abdullah Bin Amr. Marwan heard of that and he sent word to the daughter of Saeed; telling her to go back to her home; and asking her why she had moved from her home before her Iddah was over? She sent word to him telling him that her maternal aunt had told her to do that. Fatimah bint Qais said that she had been married to Abu Amr Bin Hafs; and when the Messenger of Allah appointed Ali Bin Abi Talib as governor of Yemen; he went out with him and sent word to her that she was divorced with the third Talaq. He told AlHarith Bin Hisham and Ayash Bin Abi Raiah to spend on her. She sent word to AlHarith and Ayash asking them what her husband had told them to spend on her; and they said: By Allah; she has no right to any maintenance from us; unless she is pregnant; and she cannot come into our home without our permission. She said that she came to the Messenger of Allah and told him about that; and he stated that they were correct. Fatimah said: Where should I move to; O Messenger of Allah? He said: Move to the home of Ibn Umm Maktum; the blind man whom Allah; the Mighty and Sublime; named in His Book. Fatimah said: So I observed my Iddah there. He was a man who has lost his sight; so I used to take off my garments in his house; until the Messenger of Allah married me to Usamah Bin Zaid. MuwataMalik-017-001-34885 | Malik related to me from Nafi from Abdullah Ibn Umar that the Messenger of Allah; may Allah bless him and grant him peace; said; It is the duty of a muslim man who has something to be given as a bequest not to spend two nights without writing a will about it. Malik said; The generally agreed-on way of doing things in our community is that when the testator writes something in health or illness as a bequest; and it has freeing slaves or things other than that in it; he can alter it in any way he chooses; until he is on his deathbed. If he prefers to abandon a bequest or change it; he can do so unless he has made a slave mudabbar to be freed after his death. If he has made him mudabbar; there is no way to change what he has made mudabbar. He is allowed to change his testament because the Messenger of Allah; may Allah bless him and grant him peace; said; It is the duty of a muslim man who has something to be given as a bequest not to spend two nights without writing a will about it. Malik explained; Had the testator not been able to change his will nor what was mentioned in it about freeing slaves; each testator might withhold making bequests from his property; whether in freeing slaves or other than it. A man gives a bequest in his health and in his travelling. i.e. he does not wait till his death bed. Malik summed up; The way of doing things in our community about which there is no dispute is that he can change whatever he likes of that except for the mudabbar. | The Chapter on Selling Of Slaves in HodHood Indexing, The Book of Hair in Muwata Malik | |

She continued; When I was free to remarry; I mentioned to him that Muawiya Ibn Abi Sufyan and Abu Jahm Ibn Hisham had asked for me in marriage.
