If Allah had so willed, succeeding generations would not have fought among each other, after clear (Signs) had come to them, but they (chose) to wrangle, some believing and others rejecting. If Allah had so willed, they would not have fought each other; but Allah Fulfilleth His plan. |

Abdullah Bin Sahl was murdered. Then Abdulrahman Bin Sahl; Huwaiyisa and Muhaiyisa; the two sons of Masud; came to the Prophet ﷺ and spoke about the case of their murdered friend. Abdulrahman who was the youngest of them all; started talking. The Prophet ﷺ said; Let the older among you speak first. So they spoke about the case of their murdered friend. The Prophet ﷺ said; Will fifty of you take an oath whereby you will have the right to receive the blood money of your murdered man; or said;..your companion. They said; O Allah Messenger ﷺ ! SahihAlBukhari-017-001-3351 | Narrated Aisha: the wife of the Prophet Allah Messenger ﷺ died while Abu Bakr was at a place called AlSunah AlAliya Umar stood up and said; By Allah! Allah Messenger ﷺ is not dead! Umar later on said; By Allah! Nothing occurred to my mind except that. He said; Verily! Allah will resurrect him and he will cut the hands and legs of some men. Then Abu Bakr came and uncovered the face of Allah Messenger ﷺ ; kissed him and said; Let my mother and father be sacrificed for you; O Allah Messenger ﷺ ; you are good in life and in death. By Allah in Whose Hands my life is; Allah will never make you taste death twice. Then he went out and said; O oath-taker! Dont be hasty. When Abu Bakr spoke; Umar sat down. Abu Bakr praised and glorified Allah and said; No doubt! Whoever worshipped Muhammad; then Muhammad is dead; but whoever worshipped Allah; then Allah is Alive and shall never die. SahihMuslim-017-001-17302 | Abu Laila Abdullah Bin Abdulrahman Bin Sahl reported that the elderly persons of the tribe had informed Sahl Bin Abu Hathma that Abdullah Bin Sahl and Muhayisa went out to Khaibar under some distress which had afflicted them. Muhayisa came and informed that Abdutlah Bin Sahl had been killed; and his dead body had been thrown in a well or in a ditch. He came to the Jews and said: By Allah; it is you who have killed him. They said: By Allah; we have not killed him. He then came to his people; and made mention of that to them. Then came he and his brother Huwayisa; and he was older than he; and Abdulrahman Bin Sahl. Then Muhayisa went to speak; and it was he who had accompanied Abdullah to Khaibar; whereupon Allah Messenger ﷺ said to Muhayisa: Observe greatness of the great he meant the seniority of age. Then Huwayisa spoke and then Muhayisa also spoke. Thereupon Allah Messenger ﷺ said: They should either pay blood-wit for your companion; or be prepared for war. Allah Messenger ﷺ wrote about it to them to the Jews. They wrote: Verily; by Allah; we have not killed him. Thereupon Allah Messenger ﷺ said to Huwayisa and Muhayisa and Abdulrahman Are you prepared to take oath in order to entitle yourselves for the blood-wit of your companion? SahihMuslim-017-001-18085 | It has been narrated on the authority of Anas that when the news of the advance of Abu Sufyan at the head of a force reached him. the Messenger of Allah ﷺ held consultations with his Companions. The narrator said: Abu Bakr spoke expressing his own views ; but he the Holy Prophet did not pay heed to him. Then spoke Umar expressing his views ; but he the Holy Prophet did not pay heed to him too. Then Saad Bin Ubada stood up and said: Messenger of Allah; you want us to speak. By God in Whose control is my life; if you order us to plunge our horses into the sea; we would do so. If you order us to goad our horses to the most distant place like Bark AlGhimad; we would do so. The narrator said: Now the Messenger of Allah ﷺ called upon the people for the encounter. So they set out and encamped at Badr. Soon the water-carriers of the Quraish arrived. Among them was a black slave belonging to Banu AlHajjaj. The Companions of the Messenger of Allah ﷺ caught him and interrogated him about Abu Sufyan and his companions. He said: I know nothing about Abu Sufyan; but Abu Jahl; Utba; Shaiba and Umaya Bin Khalaf are there. When he said this; they beat him. Then he said: All right; I will tell you about Abu Sufyan. They would stop beating him and then ask him again about Abu Sufyan. He would again say; I know nothing about Abu Sufyan; but Abu Jahl. Utba; Shaiba and Umaya Bin Khalaf are there. When he said this; they beat him likewise. The Messenger of Allah ﷺ was standing in prayer. When he saw this he finished his prayer and said: By Allah in Whose control is my life; you beat him when he is telling you the truth; and you let him go when he tells you a lie. SahihMuslim-017-001-20719 | Ali Bin Husain reported that Miswar Bin Makhramah informed him that Ali Bin Abi Talib sent the proposal of marriage to the daughter of Abu Jahl as he had Fatima; the daughter of Allah Messenger ﷺ ; as his wife. When Fatima heard about it; she came to Allah Apostle ﷺ and said: The people say that you never feel angry on account of your daughters and now Ali is going to marry the daughter of Abu Jahl. Makhramah said: Thereupon Allah Messenger ﷺ rose up and I heard him reciting Tashahhud and say: Now to the point. I gave a daughter of mine Zainab to Ab AlAs Bin Rabi; and he spoke to me and spoke the truth. Someone came to Muhaysah and he told him that Abdullah Bin Sahl had been Killed and thrown into a pit; or a well. He came to the Jews and said: By Allah; you killed him. They said: By Allah; we did not kill him.Then he went back to the Messenger of Allah and told him about that. Then he and Huwaysah - his brother who was older than him - and Abdulrahman Bin Sahl; came to the Prophet. Muhaysah; who was the one who had been at Khaibar; began to speak; but the messenger of Allah said: Let the elder speak first; So Huwaysah elder speaks first. So Huwaysah spoke; then Muhaysah spoke. The Messenger of Allah said: Either the Jews will pay the Diyah for your comanion; or war will be declared on them. The Messenger of Allah sent a letter to that effect to the Jews and they wrote back saying: By Allah; we did not kill him. The Messenger of Allah said to Huwaysah. Muhaysah and Abdulrahman Will you swear an oath establishing your claim to the blood money of your companion? They said: No. He said: Should the jews swear an oath for you? They told the Messenger of Allah about the killing of Abdullah Bin Sahl; and he said to them: Will you swear fifty oaths; then you will receive compensation; or be entitled to retaliate? They said: How can we swear an oath when we did not witness what happened? he said: Then can the Jews swear fifty oaths declaring their innocence? They said: How can we accept the oath of a disbelieving people? Abd AlRahan spoke about his brother case; but he was the youngest of them; so the Messenger of Allah said: Let the elders speak first. So they spoke about their companions; and the Messenger of Allah said: Let fifty of your swear an oath. The said: O Messenger of Allah; it is something that we did not witness: how can we swear an oath? He said: Then let the Jews swear fifty oaths to their innocence. SunanAbuDawoud-017-001-25095 | Ibn Abbas said Hilal Bin Umayah was one of the three persons whose repentance was accepted by Allaah. One night he returned from his land and found a man along with his wife. He witnessed with his eyes and heard with his ears. He did not threaten him till the morning. Next day he went to the Apostle of Allaah ﷺ in the morning and said Apostle of Allaah ﷺ I came to my wife in the night and found a man along with her. I saw with my own eyes and heard with my own ears. The Apostle of Allaah ﷺ disliked what he described and he took it seriously. There upon the following Quranic verse came down And those who make charges against their spouses but have no witnesses except themselves; let the testimony of one of them.... When the Apostle of Allaah ﷺ came to himself after the revelation ended he said Glad tidings to you Hilal; Allaah the exalted has made ease and a way out for you. Hilal said I expected that from my Lord. The Apostle of Allaah ﷺ said Send for her. She then came. The Apostle of Allaah ﷺ recited the verses to them and he reminded them and told them that the punishment in the next world was more severe than that in n this world. Hilal said I swear by Allah I spoke the truth against her. She said He told a lie. The Apostle of Allaah ﷺ said Apply the method of invoking curses on one another. Hilal was told Bear witness. So he bore witness before Allaah four times that he spoke the truth. When he was about to utter the fifth time he was told Hilal fear Allah; for the punishment in this world is easier than that in the next world and this is the deciding one; that will surely cause punishment to you. He said I swear by Allaah. Allah will not punish me for this act ; as He did not cause me to be flogged for this act. So he bore witness a fifth time invoking the curse of Allah on him if he was of those who tell a lie. Then the people said to her; Testify. So she gave testimony before Allaah that he was a liar. When she was going to testify the fifth time she was told Fear Allah; for the punishment in this world is easier than that in the next world. This is the deciding one that will surely cause punishment to you. She hesitated for a moment. And then said By Allah; I will not disgrace my people. So she testified a fifth time invoking the curse of Allah on her if he spoke the truth. Apostle of Allaah ﷺ separated them from each other and decided that the child will not be attributed to its father. Neither she nor her child will be accused of adultery. He who accuses her or her child will be liable to punishment. He also decided that there will be no dwelling and maintenance for her from the husband as they were separated without divorce and death. He then said If she gives birth to a child with reddish hair; light buttocks; wide belly and light shins he will be the child of Hilal. If she bears a dusky child with curly hair; fat limbs; fat shins and fat buttocks he will be the child of the one who was accused of adultery. She gave birth to a child with curly hair; fat limbs; fat shins and fat buttocks. SunanAbuDawoud-017-001-25550 | Abu AlTufail said I said to Ibn Abbas Your people think that the Apostle of Allaah ﷺ walked proudly with swift strides while going round the Kabah and that it is sunnah practice of the Prophet. He said They spoke the truth in part and told a lie in part. I asked What truth did they speak and what lie did they tell? He said They spoke the truth that the Apostle of Allaah ﷺ walked proudly while going round the Kabah but they told a lie; this is no sunnah. The Quraish asserted during the days of AlHudaibiyah Forsake Muhammad and his Companions till they die the death of a Camel which dies of bacteria in its nose. When they concluded a treaty with him agreeing upon the fact that they the Prophet and his Companions would come to Makkah next year and stay at Makkah three days; the Apostle of Allaah ﷺ said to the Companions Walk proudly moving shoulders while going round the Kabah in first three circuits. SunanAbuDawoud-017-001-25720 | Narrated Ziyad Ibn Saad Ibn Dumayrah AlSulami: On the authority of his father Sad and his grandfather Dumayrah according to Mousa version who were present in the battle of Hunayn with the Messenger of Allah ﷺ : After the advent of Islam; Muhallam Ibn Jaththamah AlLaythi killed a man of Ashja. That was the first blood-money decided by the Messenger of Allah ﷺ for payment. Uyaynah spoke about the killing of AlAshjai; for he belonged to Ghatafan; and AlAqra Ibn Habis spoke on behalf of Muhallam; for he belonged to Khunduf. The voices rose high; and the dispute and noise grew. So the Messenger of Allah ﷺ said: Do you not accept blood-money; Uyaynah? Uyaynah then said: No; I swear by Allah; until I cause his women to suffer the same fighting and grief as he caused my women to suffer. Again the voices rose high; and the dispute and noise grew. The Messenger of Allah ﷺ said: Do you not accept the blood-money Uyaynah? Uyaynah gave the same reply as before; and a man of Banu Layth called Mukaytil stood up. He had a weapon and a skin shield in his hand. He said: I do not find in the beginning of Islam any illustration for what he has done except the one that some sheep came on; and those in the front were shot; hence those in the rear ran away. The other example is that make a law today and change it. The Messenger of Allah ﷺ said: Fifty camels here immediately and fifty when we return to Medina. This happened during some of his journeys. Muhallam was a tall man of dark complexion. He was with the people. They continued to make effort for him until he was released. He sat before the Messenger of Allah ﷺ ; with his eyes flowing. He said: Messenger of Allah! I have done the act of which you have been informed. I repent to Allah; the Exalted; so ask Allah forgiveness for me. Messenger of Allah! The Messenger of Allah ﷺ then said: Did you kill him with your weapon at the beginning of Islam. O Allah! do not forgive Muhallam. He said these words loudly. Abu Salamah added: He Muhallam then got up while he was wiping his tears with the end of his garment. SunanAbuDawoud-017-001-25737 | Narrated Sahl Bin Abi Hathmah and Rafi Bin Khadeej: Muhayasah Bin Masud and Abdullah Bin Sahl came to Khaibar and parted from each other among palm trees. Abdullah Bin Sahl was killed. The Jews were blamed for the murder. Abdulrahman Bin Sahl and Huwayasah and Muhayasah; the sons of his uncle Masud came to the Prophet ﷺ. Abdulrahman who was the youngest; spoke about his brother; but the Messenger of Allah ﷺ said to him: Respect the elder; respect the elder or he said: Let the eldest begin. They then spoke about their friend and the Messenger of Allah ﷺ said: Fifty of you should take oaths regarding a man from them the Jews and he should be entrusted to him with his rope in his neck. They said: It is a matter which we did not see. How can we take oaths ? He said: The Jews exonerate themselves by the oaths of fifty of them. They said: Messenger of Allah! they are a people who are infidels. So the Messenger of Allah ﷺ paid them bloodwit himself. Sahl said: Once I entered the resting place of their camels; and the camel struck me with her lef. Hammad said this or something similar to it.Abu Dawud said: Another version transmitted by Yahya Bin Saeed has: Would you swear fifty oaths and make you claim regarding your friend or your slain man ? Bishr; the transmitter; did mention blood. Abdah transmitted it from Yahya as transmitted by Hammad. Ibn Uyainah has also transmitted it from Yahya; and began with his words: The Jew will exonerate themselves by fifty oaths which they will swear. SunanAbuDawoud-017-001-25738 | Sahl Bin Abi Hathmah and some senior men of the tribe told that Abdullah Bin Abi Sahl and Muhayasah came to Khaibar on account of the calamity i.e. famine that befall them. Muhayasah came and told the Abdullah Bin Sahl had been killed and thrown in a well or stream. He hen came to the Jews and said: I swear by Allah; you have killed him. They said: We swear by Allah; we have not killed him. He then proceeded and came to his tribe and mentioned this to them. Then he; his brother Huwayasah; who was older to him; and Abdulrahman Bin Sahl came forward to the Prophet. Muhayasah began to speak. It was he who was at Khaibar. The Messenger of Allah ﷺ then said to him: Let the eldest speak ; let the eldest speak ; meaning age. So Huwayasah spoke; and after him Muhayasah spoke. The Messenger of Allah ﷺ then said: They should either pay the bloodwit for you friend or they should be prepared for war. So the Messenger of Allah ﷺ wrote to them about it. They wrote in reply : We swear by Allah; we have not killed him. The Messenger of Allah ﷺ then said to Huwayasah; Muhayasah and Abdulrahman Will you take an oath and thus have the claim to the blood of your friend ? Muhayisa returned and said that Abdullah Ibn Sahl had been killed and thrown in a shallow well or spring. The jews came and he said; By Allah! You have killed him. They said; By Allah! We have not killed him! Then he made for his people and mentioned that to them. Then he; his brother Huwayisa; who was older than him; and Abdulrahman set out. Muhayisa began to speak; as he had been at Khaybar. The Messenger of Allah; may Allah bless him and grant him peace; said to him; The greater first; the greater first; meaning in age. So Huwayisa spoke and then Muhayisa spoke. The Messenger of Allah; may Allah bless him and grant him peace; said; Either they pay your companion blood-money or we will declare war against them. The Messenger of Allah; may Allah bless him and grant him peace; wrote that to them and they wrote; By Allah; we did not kill him! MuwataMalik-017-001-35002 | Yahya said that Malik spoke about an investor who made a qirad loan and stipulated to the agent that only certain goods should be bought with his money or he forbade certain goods which he named to be bought. He said; There is no harm in an investor making a condition on an agent in qirad not to buy a certain kind of animal or goods which he specifies. It is disapproved of for an investor to make as a condition on an agent in qirad that he only buy certain goods unless the goods which he orders him to buy are in plentiful supply and do not fail either in winter or summer. There is no harm in that case. Malik spoke about an investor who loaned qirad money and stipulated that something of the profit should be his alone without the agent sharing in it. He said; That is not good; even if it is only one dirham unless he stipulates that half the profit is his and half the profit is the agent or a third or a fourth or whatever. When he names a percentage; whether great or small; everything specified by that is halal. This is the qirad of the muslims. He said; It is also not good if the investor stipulates that one dirham or more of the profit is purely his; with out the agent sharing it and then what remains of the profit is to be divided in half between them. MuwataMalik-017-001-35006 | Yahya said that Malik spoke about an investor who made a qirad loan to a man; who used it and made a profit. Then the man bought with all the profit a slave-girl and he had intercourse with her and she became pregnant by him; and so the capital decreased. Malik said; If he has money; the price of the slave-girl is taken from his property; and the capital is restored by it. If there is something left over after the money is paid; it is divided between them according to the first qirad. If he cannot pay it; the slave-girl is sold so that the capital is restored from her price. Malik spoke about an investor who made a qirad loan to a man; and the agent spent more than the amount of the qirad loan when buying goods with it and paid the increase from his own money. Malik said; The investor has a choice if the goods are sold for a profit or loss or if they are not sold. If he wishes to take the goods; he takes them and pays the agent back what he put in for them. If the agent refuses; the investor is a partner for his share of the price in increase and decrease according to what the agent paid extra for them from himself. Malik spoke about an agent who took qirad money from a man and then gave it to another man to use as a qirad without the consent of the investor. He said; The agent is responsible for the property. If it is decreased; he is responsible for the loss. If there is profit; the investor has his stipulation of the profit; and then the agent has his stipulation of what remains of the money. Malik spoke about an agent who exceeded and borrowed some of what he had of qirad in money and he bought goods for himself with it. There are certain jobs which an agent or his like are not responsible for; amongst them are collecting debts; transporting the goods; loading up and so forth. He can hire from the capital someone to do that for him. The agent should not spend from the capital nor clothe himself from it while he resides with his family. It is only permitted for him to have expenses when he travels for the investment. The expenses are taken from the capital. If he is only trading with the property in the city in which he resides; he has no expenses from the capital and no clothing. His creditors sought and found him while he was in a city away from the investor; and he had profitable merchandise whose good quality was clear. They wanted him to sell the merchandise for them so that they could take his share of the profit. Malik said; None of the profit of the qirad is taken until the investor is present. He takes his principal and then the profit is divided mutually between them. Malik spoke about an investor who put qirad money with an agent and he used it and had a profit. The agent said that he did not see any way to sell at that time and they quarrelled about it. He said; One does not look at the statement of either of them. The people of experience and insight concerning such goods are asked about these goods. If they can see anyway of selling them they are sold for them. If they think it is time to wait; they should wait. Malik spoke about a man who took qirad money from an investor and used it and when the investor asked him for his money; he said that he had it in full. When he held him to his settlement he admitted that Such-and-such of it was lost with me; and he named an amount of money. I told you that so that you would leave it with me. Malik said; He does not benefit by denying it after he had confirmed that he had it all. He is answerable by his confession against himself unless he produces evidence about the loss of that property which confirms his statement. If he does not produce an acceptable reason he is answerable by his confession; and his denial does not avail him. Malik said; Similarly; had he said; I have had such-and-such a profit from the capital; and then the owner of the capital asked him to pay him the principal and his profit; and he said that he had not had any profit in it and had said that only so it might be left in his possession; it does not benefit him. He is taken to account for what he affirmed unless he brings acceptable proof of his word; so that the first statement is not binding on him. The owner of the capital says; I gave you a qirad provided that you had a third. Malik said; The word is the word of the agent; and he must take an oath on that if what he says resembles the known practice of qirad or is close to it. If he brings a matter which is unacceptable and people do not make qirads like that; he is not believed; and it is judged to be according to how a qirad like it would normally be. Malik spoke about a man who gave a man one hundred dinars as a qirad. He bought goods with it and then went to pay the one hundred dinars to the owner of the goods and found that they had been stolen. The investor says; Sell the goods. If there is anything over; it is mine. If there is a loss; it is against you because you lost it. The agent says; Rather you must fulfil what the seller is owed. I bought them with your capital which you gave me. Malik said; The agent is obliged to pay the price to the seller and the investor is told; If you wish; pay the hundred dinars to the agent and the goods are between you. The qirad is according to what the first hundred was based on. If you wish; you are free of the goods. If the hundred dinars are paid to the agent; it is a qirad according to the conditions of the first qirad. If he refuses; the goods belong to the agent and he must pay their price. Malik spoke about two people in a qirad who settled up and the agent still had some of the goods which he used - threadbare cloth or a waterskin or the like of that. Malik said; Any of that which is insignificant is of no importance and belongs to the agent. I have not heard anyone give a decision calling for the return of that. Anything which has a price is returned. Malik spoke about a man who had drapery goods sent to him; and salesmen came to him and he read to them his list of contents and said; In each bag is such-and-such a wrap from Basra and such-and-such a light wrap from Sabir. Their size is such-and-such; and he named to them types of drapery goods by their sort; and he said; Buy them from me according to this description. They bought the bags according to what he described to them; and then they bought them and found them too expensive and regretted it. Malik said; The sale is binding on them; if the goods agree with the list of contents on which he sold them. Malik said; This is the way of doing things which people still use today.
