When death approaches any of you, (take) witnesses among yourselves when making bequests, - two just men of your own (brotherhood) or others from outside if ye are journeying through the earth, and the chance of death befalls you (thus). If ye doubt (their truth), detain them both after prayer, and let them both swear by Allah: "We wish not in this for any worldly gain, even though the (beneficiary) be our near relation: we shall hide not the evidence before Allah: if we do, then behold! the sin be upon us!"
Surat AlTaubah Ayah 74Surat AlTaubah-0.18113يَحْلِفُونَ بِاللَّهِ مَا قَالُوا وَلَقَدْ قَالُوا كَلِمَةَ الْكُفْرِ وَكَفَرُوا بَعْدَ إِسْلَامِهِمْ وَهَمُّوا بِمَا لَمْ يَنَالُوا وَمَا نَقَمُوا إِلَّا أَنْ أَغْنَاهُمُ اللَّهُ وَرَسُولُهُ مِنْ فَضْلِهِ فَإِنْ يَتُوبُوا يَكُ خَيْرًا لَهُمْ وَإِنْ يَتَوَلَّوْا يُعَذِّبْهُمُ اللَّهُ عَذَابًا أَلِيمًا فِي الدُّنْيَا وَالْآخِرَةِ وَمَا لَهُمْ فِي الْأَرْضِ مِنْ وَلِيٍّ وَلَا نَصِيرٍThey swear by Allah that they said nothing (evil), but indeed they uttered blasphemy, and they did it after accepting Islam; and they meditated a plot which they were unable to carry out: this revenge of theirs was (their) only return for the bounty with which Allah and His Messenger had enriched them! If they repent, it will be best for them; but if they turn back (to their evil ways), Allah will punish them with a grievous penalty in this life and in the Hereafter: They shall have none on earth to protect or help them.

They parted and later on Muhaiyisa came upon Abdullah Bin Sah! and found him murdered agitating in his blood. He buried him and returned to Medina. Abdulrahman Bin Sahl; Muhaiyisa and Huwaiuisa; the sons of Masud came to the Prophet ﷺ and Abdulrahman intended to talk; but the Prophet ﷺ said to him ; Let the eldest of you speak. as Abdulrahman was the youngest:. Abdulrahman kept silent and the other two spoke. The Prophet ﷺ said; If you swear as to who has committed the murder; you will have the right to take your right from the murderer. They said; How should we swear if we did not witness the murder or see the murderer? The Prophet ﷺ said; Then the Jews can clear themselves from the charge by taking Alaska an oath taken by men that it was not they who committed the murder. The!y said; How should we believe in the oaths of infidels? So; the Prophet ﷺ himself paid the blood money of Abdullah. SahihMuslim-017-001-17526Ayub said: We were sitting in the company of Abu Mousa that he called for food and it consisted of flesh of fowl. It was then that a person from Banu Tamim visited him. His complexion was red having the resemblance of a slave. He said to him: Come and join me in food. He showed reluctance. He Abu Masa said: Come on; for I saw Allah Messenger ﷺ eating it fowl meat ; whereupon that person said: I saw it eating something of filth and rubbish and I found it repugnant and took an oath that I would never eat that. He Abu Muds said: Come; so that I would narrate to you about that the incident pertaining to vow. And he narrated thus : I came to Allah Messenger ﷺ along with a group of people belonging to the tribe of Ashari; asking him to provide us with riding camels. He the Holy Prophet said: By Allah; I cannot provide you with riding animals. And there is nothing with me with which I can provide you a mount. We stayed for some time there as Allah willed; and there was brought to Allah Messenger ﷺ booty of camels. He called us and commanded that we should be given five white humped camels. As we were about to go back; some of us said to the other: As we made Allah Messenger ﷺ forget oath; there would be no blessing for us in his gift. We went back to him and said: Allah Messenger; we came to you to provide us with riding animals and you took an oath that you would never equip us with mounts and then you have provided us with the riding beasts Allah Messenger; have you forgotten? Thereupon he said: I swear by Allah that if Allah so wills; I shall not swear an oath; and then consider something else to be better than it without making atonement for my oath and doing the thing that is better. He said to his followers: One who has married a woman and wants to consummate to his marriage but has not yet done so; another who has built a house but has not yet erected its roof; and another who has bought goats and pregnantshe-camels and is waiting for their offspring-will not accommpany me. So he marched on and approached a village at or about the time of the Asr prayers. He said to the sun: Thou art subserviant to Allah and so am I. O Allah; stop it for me a little. It was stopped for him until Allah granted him victory. The people gathered the spoils of war at one place. A fire approached the spoils to devour them; but it did not devour them. He the Holy Prophet said: Some of you have been guilty of misappropriation. So one man from each tribe should swear fealty to me. The did so putting their hands into his. The hand of one man stuck to his hand and the Prophet ﷺ said: Your tribe is guilty of misappropriation. Let all the members of your tribe swear fealty to me one by one. They did so; when the hands of two or three persons got stuck with his hand. He said: You have misappropriated. So they took out gold equal in volume to the head of a cow. They-placed it among the spoils on the earth. Then the fire approached the spoils and devoured them. SahihMuslim-017-001-18043It is narrated on the authority of Urwa Bin AlZubair who narrated from Aisha that she informed him that Fatima; daughter of the Messenger of Allah ﷺ ; sent someone to Abu Bakr to demand from him her share of the legacy left by the Messenger of Allah ﷺ from what Allah had bestowed upon him at Medina and Fadak and what was left from one-filth of the income annually received from Khaibar. Abu Bakr said: The Messenger of Allah ﷺ said: We prophets do not have any heirs; what we leave behind is to be given in charity. The household of the Messenger of Allah ﷺ will live on the income from these properties; but; by Allah; I will not change the charity of the Messenger of Allah ﷺ from the condition in which it was in his own time. I will do the same with it as the Messenger of Allah may peace be upun him himself used to do. So Abu Bakr refused to hand over anything from it to Fatima who got angry with Abu Bakr for this reason. She forsook him and did not talk to him until the end of her life. She lived for six months after the death of the Messenger of Allah ﷺ. When she died; her husband. Ali Bin Abu Talib; buried her at night. He did not inform Abu Bakr about her death and offered the funeral prayer over her himself. During the lifetime of Fatima; All received special regard from the people. After she had died; he felt estrangement in the faces of the people towards him. So he sought to make peace with Abu Bakr and offer his allegiance to him. He had not yet owed allegiance to him as Caliph during these months. He sent a person to Abu Bakr requesting him to visit him unaccompanied by anyone disapproving the presence of Umar. Umar said to Abu Bakr: BY Allah; you will not visit them alone. Abu Bakr said: What will they do to me? By Allah; I will visit them. And he did pay them a visit alone. All recited Tashahhud as it is done in the beginning of a religious sermon ; then said: We recognise your moral excellence and what Allah has bestowed upon you. We do not envy the favour i. e. the Catiphate which Allah nas conferred upon you; but you have done it assumed the position of Caliph alone without consulting us ; and we thought we had a right to be consulted on account of our kinship with the Messenger of Allah ﷺ. He continued to talk to Abu Bakr in this vein until the latter eyes welled up with tears. Then Abd Bakr spoke and said: By Allah; in Whose Hand is my life; the kinship of the Messenger of Allah ﷺ is dearer to me than the kinship of my own people. As regards the dispute that has arisen between you and me about these properties; I have not deviated from the right course and I have not given up doing about them what the Messenger of Allah ﷺ used to do. So Ali said to Abu Bakr: This aftetnoon is fixed for swearing allegiance to you. So when Abu Bakr had finished his Zuhr prayer; he ascended the pulpit and recited Tashahhud; and described the status of Ali; his delay in swearing allegiance and the excuse which lie had offered to him for this delay. After this he asked for God forgiveness. Then Ali Bin Abu Talib recited the Tashahhud. extolled the merits of Abu Bakr and said that his action was nott prompted by any jealousy of Abu Bakr on his part or his refusal to accept the high position which Allah had conferred upon him; adding: But we were of the opinion that we should have a share in the government; but the matter had been decided without taking us into confidence; and this displeased us. Hence the delay in offering allegiance. The Muslims were pleased with this explanation and they said: You have done the right thing. They said: By Allah; we did not kill him.Then he went back to the Messenger of Allah and told him about that. Then he and Huwaysah - his brother who was older than him - and Abdulrahman Bin Sahl; came to the Prophet. Muhaysah; who was the one who had been at Khaibar; began to speak; but the messenger of Allah said: Let the elder speak first; So Huwaysah elder speaks first. So Huwaysah spoke; then Muhaysah spoke. The Messenger of Allah said: Either the Jews will pay the Diyah for your comanion; or war will be declared on them. The Messenger of Allah sent a letter to that effect to the Jews and they wrote back saying: By Allah; we did not kill him. The Messenger of Allah said to Huwaysah. Abdulrahman who was the youngest; spoke about his brother; but the Messenger of Allah ﷺ said to him: Respect the elder; respect the elder or he said: Let the eldest begin. They then spoke about their friend and the Messenger of Allah ﷺ said: Fifty of you should take oaths regarding a man from them the Jews and he should be entrusted to him with his rope in his neck. They said: It is a matter which we did not see. How can we take oaths ? He said: The Jews exonerate themselves by the oaths of fifty of them. They said: Messenger of Allah! they are a people who are infidels. So the Messenger of Allah ﷺ paid them bloodwit himself. Sahl said: Once I entered the resting place of their camels; and the camel struck me with her lef. Bishr; the transmitter; did mention blood. Abdah transmitted it from Yahya as transmitted by Hammad. SunanAbuDawoud-017-001-25985Salamah Bin Kuhail said: Zaid Bin Wahb AlJuhani told us that he was in the army which proceeded to fight with the Khawarij in the company of Ali. Ali then said: O people! I heard the Messenger of Allah ﷺ say: there will appear from among my community people who recite the Quran; and your recitation has no comparison with their recitation; and your prayer has no comparison with their prayer; and your fasts have no comparison with their fasts. They will recite the Quran thinking that it is beneficial for them; while it is harmful for them. Their prayer will not pass their collar-bones. They will swerve from Islam as an arrow goes through the animal shot at. If the army that is approaching them knows what reward has been decided for them at the tongue of their Prophet ﷺ ; they would leave other good activities. The sign of that is that among them there will be a man who has an upper arm; but not hand; on his upper arm there will be something like the nipple of a female breast; having white hair thereon. Will you go to Muawiyah and the people of Syria; and leave them behind among your children and property? I swear by Allah; I hope these are the same people; for they shed the blood unlawfully; and attacked the cattle of the people so go on in the name of Allah. Salamah Bin Kuhail said: Zaid Bin Wahb then informed me of all the halting places one by one; saying : Until we passed a bridge. When we fought with each other; Abdullah Bin Wahb AlRasibi; who was the leader of the Khawarij; said to them: Throw away the lances and pull out the swords from their sheaths; for I am afraid they will adjure you as they had adjured on the day of Harura. So they threw away their lances and pulled out their swords; and the people pierced them with their lances. They were killed lying one on the other. On that day only two persons of the partisans of Ali were afflicted. Ali said: Search for the man with the crippled hand. But they could not find him. Then Ali got up himself and went to the people who had been killed and were lying on one another. He said: Take them out. They found him just near the ground. So he shouted: Allah is Most Great! Muhayisa returned and said that Abdullah Ibn Sahl had been killed and thrown in a shallow well or spring. The jews came and he said; By Allah! You have killed him. They said; By Allah! We have not killed him! Then he made for his people and mentioned that to them. Then he; his brother Huwayisa; who was older than him; and Abdulrahman set out. Muhayisa began to speak; as he had been at Khaybar. The Messenger of Allah; may Allah bless him and grant him peace; said to him; The greater first; the greater first; meaning in age. So Huwayisa spoke and then Muhayisa spoke. The Messenger of Allah; may Allah bless him and grant him peace; said; Either they pay your companion blood-money or we will declare war against them. The Messenger of Allah; may Allah bless him and grant him peace; wrote that to them and they wrote; By Allah; we did not kill him! The Messenger of Allah; may Allah bless him and grant him peace; said to Huwayisa; Muhayisa; and Abdulrahman Do you swear and claim the blood of your companion? They said; No. He said; Shall the jews swear to you? They said; But they are not muslims. MuwataMalik-017-001-34742Yahya said from Malik from Yahya Ibn Said that Bushayr Ibn Yasar informed him that Abdullah Ibn Sahl AlAnsari and Muhayisa Ibn Masud went out to Khaybar; and they separated on their various businesses and Abdullah Ibn Sahl was killed. Muhayisa; and his brother Huwayisa and Abdulrahman Ibn Sahl went to the Prophet; may Allah bless him and grant him peace; and Abdulrahman began to speak before his brother. The Messenger of Allah; may Allah bless him and grant him peace; said; The older first; the older first. Therefore Huwayisa and then Muhayisa spoke and mentioned the affair of Abdullah Ibn Sahl. The Messenger of Allah; may Allah bless him and grant him peace; said to them; Do you swear with fifty oaths and claim the blood-money of your companion or the life of the murderer? They said; Messenger of Allah; we did not see it and we were not present. The Messenger of Allah; may Allah bless him and grant him peace; said; Will you acquit the jews for fifty oaths? They said; Messenger of Allah; how can we accept the oaths of a people who are kafirun? Yahya Ibn Said said; Bushayr Ibn Yasar claimed that the Messenger of Allah; may Allah bless him and grant him peace; paid the blood-money from his own property. Malik said; The generally agreed on way of doing things in our community and that which I heard from whoever I am content with; concerning the oath of qasama; and upon which the past and present imams agree; is that those who claim revenge begin with the oaths and swear. The oath for revenge is only obligatory in two situations. Either the slain person says; My blood is against so-and-so; or the relatives entitled to the blood bring a partial proof of it that is not irrefutable against the one who is the object of the blood-claim. This obliges taking an oath on the part of those who claim the blood against those who are the object of the blood-claim. With us; swearing is only obliged in these two situations. Malik said; That is the sunna in which there is no dispute with us and which is still the behaviour of the people. The people who claim blood begin the swearings; whether it is an intentional killing or an accident. Malik said; The Messenger of Allah; may Allah bless him and grant him peace; began with Banu Harith in the case of the killing of their kinsman murdered at Khaybar. Malik said; If those who make the claim swear; they deserve the blood of their kinsman and whoever they swear against is slain. Only one man can be killed in the qasama. Two cannot be killed in it. Fifty men from the blood-relatives must swear fifty oaths. If their number is less or some of them draw back; they can repeat their oaths; unless one of the relatives of the murdered man who deserves blood and who is permitted to pardon it; draws back. If one of these draws back; there is no way to revenge. Yahya said that Malik said; The oaths can be made by those of them who remain if one of them draws back who is not permitted to pardon. If one of the blood-relatives draws back who is permitted to pardon; even if he is only one; more oaths can not be made after that by the blood- relatives. If that occurs; the oaths can be on behalf of the one against whom the claim is made. So fifty of the men of his people swear fifty oaths. If there are not fifty men; more oaths can be made by those of them who already swore. If there is only the defendant; he swears fifty oaths and is acquitted. Yahya said that Malik said; One distinguishes between swearing for blood and oaths for one rights. When a man has a money-claim against another man; he seeks to verify his due. When a man wants to kill another man; he does not kill him in the midst of people. He keeps to a place away from people. Had there only been swearing in cases where there is a clear proof and had one acted in it as one acts about one rights i.e. needing witnesses ; the right of blood retribution would have been lost and people would have been swift to take advantage of it when they learned of the decision on it. However; the relatives of the murdered man were allowed to initiate swearing so that people might restrain themselves from blood and the murderer might beware lest he was put into a situation like that i.e. qasama by the statement of the murdered man. Yahya said; Malik said about a people of whom a certain number are suspected of murder and the relatives of the murdered man ask them to take oaths and they are numerous; so they ask that each man swears fifty oaths on his own behalf. The oaths are not divided out between them according to their number and they are not acquitted unless each man among them swears fifty oaths on his own behalf. Malik said; This is the best I have heard about the matter. He said; Swearing goes to the paternal relatives of the slain. MuwataMalik-017-001-34743Yahya said that Malik said; The way of doing things in our community about which there is no dispute is that women do not swear in the swearing for the intentional act. If the murdered man only has female relatives; the women have no right to swear for blood and no pardon in murder. Yahya said that Malik said about a man who is murdered; If the paternal relatives of the murdered man or his mawali say; We swear and we demand our companion blood; that is their right. Malik said; If the women want to pardon him; they cannot do that. The paternal relatives and mawali are entitled to do that more than them because they are the ones who demand blood and swear for it. Malik said; If the paternal relatives or mawali pardon after they demand blood and the women refuse and say; We will not abandon our right against the murderer of our companion; the women are more entitled to that because whoever takes retaliation is more entitled than the one who leaves it among the women and paternal relatives when the murder is established and killing obliged. Malik said; At least two claimants must swear in murder. The oaths are repeated by them until they swear fifty oaths; then they have the right to blood. That is how things are done in our community. Malik said; When people beat a man and he dies in their hands; they are all slain for him. If he dies after their beating; there is swearing. If there is swearing; it is only against one man and only he is slain. We have never known the swearing to be against more than one man. Malik spoke about a slave who had his hand or foot broken and then the break mended. He said; The one who injured him is not obliged to pay anything. If that break causes him loss or scar; the one who injured him must pay according to what he diminished of the value of the slave. Malik said; What is done in our community about retaliation between slaves is that it is like retaliation between freemen. The life of the slave-girl for the life of the slave; and her injury for his injury. When a slave intentionally kills a slave; the master of the murdered slave has a choice. If he wishes; he kills him; and if he wishes; he takes the blood-money. If he takes the blood-money; he takes the value of his slave. If the owner of the slave who killed wishes to give the value of the murdered slave; he does it. If he wishes; he surrenders his slave. If he surrenders him; he is not obliged to do anything other than that. When the owner of the murdered slave takes the slave who murdered and is satisifed with him; he must not kill him. All retaliations between slaves for cutting off of the hand and foot and such things are dealt with in the same way as in the murder. Malik said about a muslim slave who injures a jew or christian; If the master of the slave wishes to pay blood-money for him according to the injury; he does it. Or else he surrenders him and he is sold; and the jew or christian is given the blood-money of the injury or all the price of the slave if the blood-money is greater than his price. If it is not possible to divide up the oaths which they swear between them evenly; one looks to the one who has most of those oaths against him; and that oath is obliged against him. Malik said; If the slain man only has female heirs; they swear and take the blood-money. If he only has one male heir; he swears fifty oaths and takes the blood-money. MuwataMalik-017-001-34745Yahya said that Malik said; When the relatives of the deceased accept the blood-money then it is inherited according to the Book of Allah. Daughters of the dead man inherit and so do sisters; and whichever women would inherit from him ordinarily. If the women do not take all his inheritance; then what remains goes to the agnatic relations who most deserve to inherit from him in conjunction with the women. Malik said; When one of the heirs of a man killed by mistake attempts to take his due from the blood-money while his companions are absent; he may not do that; and he has no right to any of the blood-money; however large or small; unless the qasama has been completed by him. If he swears fifty oaths then he has the right to his portion of the blood-money. That is because the blood-money is not established as due without there being fifty oaths; and the blood- money is not established as due unless the responsibility for the blood is established. If any one of the heirs comes after that he swears a number of the oaths commensurate with his fraction of the inheritance and takes his right until all the heirs exact their complete right. If a maternal uncle comes he has one sixth and must swear one sixth of the fifty oaths. So whoever swears may take his due from the blood-money and whoever abstains annuls his right. If one of the heirs is absent or is a child who has not reached puberty; those who are present swear fifty oaths and if the one who was absent comes after that or the child reaches puberty; they swear. and they swear according to their due of the blood-money and according to their shares of inheritance from it. MuwataMalik-017-001-34746Yahya said that Malik said; What is done in our community about slaves is that when a slave is struck intentionally or accidentally and the master brings a witness; he swears with his witness one oath and then he has the value of the slave. There is no swearing for revenge in slaves; accidentally or intentionally; and I have not heard any of the people of knowledge say that there was. Malik said; If a slave is killed intentionally or accidentally; the master of the slave who is slain has no swearing or oath. The master cannot demand his right except with a fair proof or a witness if he swears with one witness. MuwataMalik-017-001-35113Malik related to me that he had heard that Abdullah Ibn Masud used to relate that the Messenger of Allah; may Allah bless him and grant him peace; said; When two parties dispute about a business transaction; the seller word is taken; or they make an agreement among themselves. Malik spoke about someone who sold goods to a man; and said at the contracting of the sale; I will sell to you provided I consult so-and-so. If he is satisfied; the sale is permitted. If he dislikes it; there is no sale between us. They made the transaction on that basis. Then the buyer regretted before the seller consulted the person. Malik said; That sale is binding on them according to what they described. The buyer has no right of withdrawal; and it is binding on him; if the person whom the seller stipulated to him; permits it. Malik said; The way of doing things among us about a man who buys goods from another and they differ about the price; and the seller says; I sold them to you for ten dinars; and the buyer says; I bought them from you for five dinars; is that it is said to the seller; If you like; give them to the buyer for what he said. If you like; swear by Allah that you only sold your goods for what you said. If he swears it is said to the buyer; Either you take the goods for what the seller said; or you swear by Allah that you bought them only for what you said. If he swears; he is free to return the goods. MuwataMalik-017-001-35398Yahya related to me from Malik from Hisham Ibn Urwa from his father that Aisha; umm Almuminin said; Rashness in oaths is that a man says; By Allah; No! by Allah! i.e. out of habit. Malik said; The best of what I have heard on the matter is that rashness in oaths is that a man take an oath on something to show that he is certain that it is like he said; only to find that it is other than what he said. This is rashness. Malik said; The binding oath is for example; that a man says that he will not sell his garment for ten dinars; and then he sells it for that; or that he will beat his young slave and then does not beat him; and so on. One does kaffara for making such an oath; and there is no kaffara in rashness. MuwataMalik-017-001-35400Yahya related to me from Malik from Suhayl Ibn Abi Salih from his father from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; Whoever makes an oath and then sees that something else would be better than it; should do kaffara for his oath and do what is better. Yahya said that he heard Malik say; Anyone who says that he has a vow but does not mention the name of Allah; is still obliged to make the kaffara for an oath if he breaks it. Malik said; Emphasis is when a man swears one thing several times; repeating the oath in his speech time after time. For instance; the statement; By Allah; I will not decrease it from such-and-such; sworn three times or more. The kaffara of that is like the kaffara of one oath. If a man swears; I will not eat this food or wear these clothes or enter this house; that is all in one oath; and he is only obliged to do one kaffara. It is the same for a man who says to his wife; You are divorced if I clothe you in this garment or let you go to the Masjid; and it is one entire statement in the normal pattern of speech. If he breaks any of that oath; divorce is necessary; and there is no breaking of oath after that in whatever he does. There is only one oath to be broken in that. Malik said; What we do about a woman who makes a vow without her husband permission is that she is allowed to do so and she must fulfill it; if it only concerns her own person and will not harm her husband. Marwan said; I swear to you; Abdar-Rahman; you must go to the two umm Almuminin; Aisha and Umm Salamah; and ask them about it. Abdulrahman went to visit Aisha and I accompanied him. He greeted her and then said; Umm Almuminin; we were with Marwan Ibn AlHakam and someone mentioned to him that Abu Huraira used to say that if some one had begun the morning junub; he had broken the fast for that day. Aisha said; It is not as Abu Huraira says Abdulrahman Do you dislike what the Messenger of Allah; may Allah bless him and grant him peace; used to do?; and Abdulrahman said; No; by Allah. Aisha said; I bear witness that the Messenger of Allah; may Allah bless him and grant him peace; used to get up in the morning junub from intercourse; not a dream; and would then fast for that day. He continued; Then we went and visited Umm Salamah; and Abdulrahman asked her about the same matter and she said the same as Aisha had said. Then we went off until we came to Marwan Ibn AlHakam Abdulrahman told him what they had both said and Marwan said; I swear to you; Abu Muhammad; you must use the mount which is at the door; and go to Abu Huraira; who is on his land at AlAqiq; and tell him this. So Abdulrahman rode off; and I went with him; until we came to Abu Huraira.
