Have we no intercessors now to intercede on our behalf? Or could we be sent back? then should we behave differently from our behaviour in the past." In fact they will have lost their souls, and the things they invented will leave them in the lurch. | |

SahihAlBukhari-017-001-1187 | Narrated Ibn Abbas: The delegates of Abdul Qais came to Allah Messenger ﷺ and said; The pagans of the tribe of Mudar intervene between you and us therefore we cannot come to you except in the Holy months. So please order us to do something good Religious deeds by which we may enter Paradise by acting on them and we may inform our people whom we have left behind to observe it. The Prophet ﷺ said; I order you to do four things and forbid you from four things: I order you to believe in Allah. Do you know what is meant by belief in Allah? It is to testify that none has the right to be worshipped except Allah; to offer prayers perfectly; to give Zakat; and to give AlKhumus one-fifth of the war booty in Allah Cause. And I forbid you four things; i.e.; Do not drink alcoholic drinks AlDubba; AlNaqir; pitched water skins ; AlZuruf; AlMuzaffat and AlHantam names of utensils used for the preparation of alcoholic drinks. SahihAlBukhari-017-001-1214 | Narrated Ibn Abbas: When the delegate of Abd AlQais came to Allah Messenger ﷺ ; he said; Who are the delegate? They said; The delegate are from the tribe of Rabia. The Prophet ﷺ said; Welcome; O the delegate; and welcome! O people! Neither you will have any disgrace nor will you regret. They said; O Allah Apostle! Between you and us there are the infidels of the tribe of Mudar; so please order us to do something good religious deeds that by acting on them we may enter Paradise; and that we may inform our people whom we have left behind; about it. They also asked the Prophet about drinks. He forbade them from four things and ordered them to do four things. He ordered them to believe in Allah; and asked them; Do you know what is meant by belief in Allah? They said; Allah and His Apostle know best. He said; To testify that none has the right to be worshipped except Allah; the One; Who has no partners with Him; and that Muhammad is Allah Messenger ﷺ ; and to offer prayers perfectly and to pay Zakat. the narrator thinks that fasting in Ramadan is included ; and to give one-fifth of the war booty to the state. SahihAlBukhari-017-001-1744 | Narrated Abu Huraira: In the year of the Conquest of Mecca; the tribe of Khuzaa killed a man from the tribe of Bam Laith in revenge for a killed person belonging to them in the Pre-lslamic Period of Ignorance. So Allah Apostle got up saying; Allah held back the army having elephants from Mecca; but He let His Apostle and the believers overpower the infidels of Mecca. Beware! Mecca is a sanctuary ! Verily! Fighting in Mecca was not permitted for anybody before me; nor will it be permitted for anybody after me; It was permitted for me only for a while an hour or so of that day. No doubt! It is at this moment a sanctuary; its thorny shrubs should not be uprooted; its trees should not be cut down; and its Luqata fallen things should not be picked up except by the one who would look for its owner. And if somebody is killed; his closest relative has the right to choose one of two things; i.e.; either the Blood money or retaliation by having the killer killed. Then a man from Yemen; called Abu Shah; stood up and said; Write that for me; O Allah Messenger ﷺ ! Allah Messenger ﷺ said to his companions ; Write that for Abu Shah. Then another man from Quraish got up; saying; O Allah Messenger ﷺ ! Except AlIdhkhir a special kind of grass as we use it in our houses and for graves. SahihAlBukhari-017-001-1806 | Narrated Ibn Abbas: One night I slept at the house of Maimuna. The Prophet ﷺ woke up; answered the call of nature; washed his face and hands; and then slept. He got up late at night ; went to a water skin; opened the mouth thereof and performed ablution not using much water; yet he washed all the parts properly and then offered the prayer. I got up and straightened my back in order that the Prophet ﷺ might not feel that I was watching him; and then I performed the ablution; and when he got up to offer the prayer; I stood on his left. He caught hold of my ear and brought me over to his right side. He offered thirteen rakat in all and then lay down and slept till he started blowing out his breath as he used to do when he slept. In the meantime Bilal informed the Prophet ﷺ of the approaching time for the Fajr prayer; and the Prophet offered the Fajr Morning prayer without performing new ablution. He used to say in his invocation; Allahumma ijal fi qalbi nuran wa fi basari nuran; wa fi sami nuran; waan yamini nuran; waan yasari nuran; wa fawqi nuran; wa tahti nuran; wa amami nuran; wa khalfi nuran; wajal li nuran. Kuraib a sub narrator said; I have forgotten seven other words; which the Prophet ﷺ mentioned in this invocation. SahihAlBukhari-017-001-2001 | Narrated Abu Rafi: The Prophet ﷺ said; The neighbor has more right to be taken care of by his neighbor than anyone else. Some men said; If one wants to buy a house for 20;000 Dirhams then there is no harm to play a trick to deprive somebody of preemption by buying it just on paper with 20;000 Dirhams but paying to the seller only 9;999 Dirhams in cash and then agree with the seller to pay only one Dinar in cash for the rest of the price i.e. 10;001 Dirhams. If the preemptor offers 20;000 Dirhams for the house; he can buy it otherwise he has no right to buy it by this trick he got out of preemption. If the house proves to belong to somebody else other than the seller; the buyer should take back from the seller what he has paid; i.e.; 9;999 Dirhams and one Dinar; because if the house proves to belong to somebody else; so the whole bargain deal is unlawful. If the buyer finds a defect in the house and it does not belong to somebody other than the seller; the buyer may return it and receive 20;000 Dirhams instead of 9999 Dirham plus one Dinar which he actually paid. SahihAlBukhari-017-001-3801 | Narrated Anas: When the news of the arrival of the Prophet ﷺ at Medina reached Abdullah Bin Salam; he went to him to ask him about certain things; He said; I am going to ask you about three things which only a Prophet can answer: What is the first sign of The Hour? What is the first food which the people of Paradise will eat? Why does a child attract the similarity to his father or to his mother? The Prophet ﷺ replied; Gabriel has just now informed me of that. Ibn Salam said; He i.e. Gabriel is the enemy of the Jews amongst the angels. The Prophet ﷺ said; As for the first sign of The Hour; it will be a fire that will collect the people from the East to the West. As for the first meal which the people of Paradise will eat; it will be the caudate extra lobe of the fish-liver. As for the child; if the man discharge proceeds the woman discharge; the child attracts the similarity to the man; and if the woman discharge proceeds the mans; then the child attracts the similarity to the woman. On this; Abdullah Bin Salam said; I testify that None has the right to be worshipped except Allah; and that you are the Messenger of Allah. and added; O Allah Messenger ﷺ ! Jews invent such lies as make one astonished; so please ask them about me before they know about my conversion to I slam. The Jews came; and the Prophet ﷺ said; What kind of man is Abdullah Bin Salam among you? They replied; The best of us and the son of the best of us and the most superior among us; and the son of the most superior among us. The Prophet ﷺ said; What would you think if Abdullah Bin Salam should embrace Islam? They said; May Allah protect him from that. The Prophet ﷺ repeated his question and they gave the same answer. Then Abdullah came out to them and said; I testify that None has the right to be worshipped except Allah and that Muhammad is the Messenger of Allah! On this; the Jews said; He is the most wicked among us and the son of the most wicked among us. So they degraded him. Allah Messenger ﷺ had waited for them for over ten days when he returned from Taif. Yunis said: Ruzaiq Bin Hukaim wrote to Ibn Shihab while I was with him at Wadi AlQura saying; Shall I lead the Jumua prayer? Ruzaiq was working on the land i.e. farming and there was a group of Sudanese people and some others with him; Ruzaiq was then the Governor of Aila. He the inquirer said: When there would be the hour of Doom ? Upon this he the HolyProphet said: The one who is being asked about it is no better informed than the inquirer himself. I; however; narrate some of its signs and these are : when you see a slave woman giving birth to her master - that is one of the signs of Doom ; when you see barefooted; naked; deaf and dumb ignorant and foolish persons as the rulers of the earth - that is one of the signs of the Doom. And when you see the shepherds of black camels exult in buildings - that is one of the signs of Doom. The Doom is one of the five things wrapped in the unseen. No one knows them except Allah. Then the Holy Prophet recited the folowing verse : Verily Allah! with Him alone is the knowledge of the hour and He it is Who sends down the rain and knows that which is in the wombs and no person knows whatsoever he shall earn on morrow and a person knows not in whatsoever land he shall die. SahihMuslim-017-001-18408 | It is reported on the authority of Qatada that one among the delegates of the Abd AlQais tribe narrated this tradition to him. Saeed said that Qatada had mentioned the name of Abu Nadra on the authority of Abu Saeed Khudri who narrated this tradition: That people from the- tribe of Abd AlQais came to the Messenger of Allah ﷺ and said: Messenger of Allah; we belong to the tribe of Rabia and there live between you and us the unbelievers of the Mudar tribe and we find it impossible to come to you except in the sacred months; direct us to a deed which we must communicate to those who have been left behind us and by doing which we may enter heaven. Upon this the Messenger of Allah ﷺ said: I enjoin upon you four things and forbid you to do four things : worship Allah and associate none with Him; establish prayer; pay Zakat; and observe the fast of Ramadan; and pay the fifth part out of the booty. And I prohibit you from four things : dry gourds; green-coloured jars; hollowed stumps of palm-trees; and receptacles. They the members of the delegation said: Do you know what Alnaqir is? He replied: Yes; it is a stump which you hollow out and in which you throw small dates. Saeed said: He the Holy Prophet used the word tamar dates. The Prophet then added : Then you sprinkle water over it and when its ebullition subsides; you drink it and you are so intoxicated that one amongst you; or one amongst them the other members of your tribe; who were not present there strikes his cousin with the sword. He the narrator said: There was a man amongst us who had sustained injury on this very account due to intoxication ; and he told that he tried to conceal it out of shame from the Messenger of Allah ﷺ. I; however; inquired from the Messenger of Allah it we discard those utensils which you have forbidden us to use ; then what type of vessels should be used for drink? He the Holy Prophet replied: In the waterskin the mouths of which are tied with a string. They again said: Prophet of Allah; our land abounds in rats and water-skins cannot remain preserved. SahihMuslim-017-001-20629 | Amir Bin Saad Bin Abi Waqqas reported on the authority of his father that Muawiya Bin Abi Sufyan appointed Saad as the Governor and said: What prevents you from abusing Abu Turab Hadrat Ali ; whereupon be said: It is because of three things which I remember Allah Messenger ﷺ having said about him that I would not abuse him and even if I find one of those three things for me; it would be more dear to me than the red camels. I heard Allah Messenger ﷺ say about Ali as he left him behind in one of his campaigns that was Tabuk. Ali said to him: Allah Messenger; you leave me behind along with women and children. Thereupon Allah Messenger ﷺ said to him: Arent you satisfied with being unto me what Aaron was unto Moses but with this exception that there is no prophethood after me. And I also heard him say on the Day of Khaibar: I would certainly give this standard to a person who loves Allah and his Messenger; and Allah and his Messenger love him too. He the narrator said: We had been anxiously waiting for it; when he the Holy Prophet said: Call Ali. He was called and his eyes were inflamed. He applied saliva to his eyes and handed over the standard to him; and Allah gave him victory. I am about to receive a messenger the angel of death from my Lord and I; in response to Allah call; would bid good-bye to you ; but I am leaving among you two weighty things: the one being the Book of Allah in which there is right guidance and light; so hold fast to the Book of Allah and adhere to it. He exhorted us to hold fast to the Book of Allah and then said: The second are the members of my household I remind you of your duties to the members of my family. Then he has uttered one the worst lies against Allah; Allah says: No vision can grasp Him; but His grasp is over all vision; and He is the Most Subtle; Well-Acquainted with all things 6:103. It is not for any human being that Allah should speak to him unless it be by revelation or from behind a veil 42:91. I was reclining so I sat up an said: O Mother of the Believers! On Friday there is an hour in which; if a believer prays and asks Allah SWT for something; He will give it to him. Kaab said: Is than one day in every year? I said: No; it is every Friday. Then Kaab read in the Tawrah and said: The Messenger of Allah ﷺ spoke the truth; it is every Friday. Then I went out and met Basrah Bin Abi Basrah AlGhifari. He said: From where have you come? I said: From AlTur. He said: If I had met you before you went there; you would not have gone. I said to him: Why? He said: I heard the Messenger of Allah ﷺ say: Do not travel especially to visit a masjid except three: AlMasjid AlHaram in Makkah ; my masjid in AlMadinah and the Masjid of Bait AlMaqdis in Jerusalem. Then I met Abdullah Bin Salam and said: If you had only seen me; I went to AlTur and met Kaab and he and I spent the day together; when I narrated things to him from the Messenger of Allah ﷺ and he narrated things to me from the Tawrah. I said to him: The Messenger of Allah ﷺ said: The best day on which the sun rises is Friday. On this day; Adam was created; on this day he was sent down; on it repentance was accepted; on this day he died; and on this day the Hour will begin. There is no living creature on Earth that does not listen out from Friday morning until the sun rises; fearing the onset of the Hour; except the son of Adam. One day Muadh Bin jabal said: In the times after you there would be trails in which riches would be abundant. During these trails the Quran would be easy so much so that every believer; hypocrite; man; woman; young; grown up; slave and free man will learn it. Then a man might say: What happened with the people that they do not follow me while I read the Quran? They are not going to follow me until I introduce a novelty for them other than it. So avoid that which is innovated in religion ; for whichever is innovated is an error. I warn you of the deviation of a scholar from right guidance; for sometimes Satan utters a word of error through the tongue of a scholar; and sometimes a hypocrites may speak a word of truth. I said to Muadh Bin jabal: I am at a loss to understand may Allah have mercy on you that a learned man sometimes may speak a word of error and a hypocrite may speak a word of truth. MuwataMalik-017-001-34846 | Malik related to me that the generally agreed on way of doing things amongst the community about an accident is that there is no blood-money until the victim is better. If a man bone; either a hand; or a foot; or another part of his body; is broken accidentally and it heals and becomes sound and returns to its form; there is no blood-money for it. If the limb is impaired or there is a scar on it; there is blood-money for it according to the extent that it is impaired. Malik said; If that part of the body has a specific blood-money mentioned by the Prophet; may Allah bless him and grant him peace; it is according to what the Prophet; may Allah bless him and grant him peace; specified. If it is part of what does not have a specific blood-money for it mentioned by the Prophet; may Allah bless him and grant him peace; and if there is no previous sunna about it or specific blood-money; one uses ijtihad about it. Malik said; There is no blood-money for an accidental bodily injury when the wound heals and returns to its form. If there is any scar or mark in that; ijtihad is used about it except for the belly-wound. There is a third of the blood-money of a life for it. Malik said; There is no blood-money for the wound which splinters a bone in the body; and it is like the wound to the body which lays bare the bone. Malik said; What is done in our community about the wound to the brain and the wound which splinters the bone; and the wound that bares the bone is that they apply only to the head and face. Malik said; The generally agreed-on way of doing things in our community is that when the testator writes something in health or illness as a bequest; and it has freeing slaves or things other than that in it; he can alter it in any way he chooses; until he is on his deathbed. If he prefers to abandon a bequest or change it; he can do so unless he has made a slave mudabbar to be freed after his death. If he has made him mudabbar; there is no way to change what he has made mudabbar. He is allowed to change his testament because the Messenger of Allah; may Allah bless him and grant him peace; said; It is the duty of a muslim man who has something to be given as a bequest not to spend two nights without writing a will about it. Malik explained; Had the testator not been able to change his will nor what was mentioned in it about freeing slaves; each testator might withhold making bequests from his property; whether in freeing slaves or other than it. MuwataMalik-017-001-34956 | Yahya said that he heard Malik say; The way of doing things in our community about which there is no dispute; is that if a man gives sadaqa to his son - sadaqa which the son takes possession of or which is in the father keeping and the father has had his sadaqa witnessed; he cannot take back any of it because he cannot reclaim any sadaqa. Yahya said that he heard Malik say; The generally agreed-on way of doing things in our community in the case of someone who gives his son a gift or grants him a gift which is not sadaqa is that he can take it back as long as the child does not start a debt; which people claim from him; and which they trust him for on the strength of the gift his father has given him. The father cannot take back anything from the gift after debts are started against it. MuwataMalik-017-001-35035 | Yahya related to me from Malik from Yahya Ibn Said from Salim Ibn Abdullah that Abdullah Ibn Umar sold one of his slaves for eight hundred dirhams with the stipulation that he was not responsible for defects. The person who bought the slave complained to Abdullah Ibn Umar that the slave had a disease which he had not told him about. They argued and went to Uthman Ibn Affan for a decision. The man said; He sold me a slave with a disease which he did not tell me about. Abdullah said; I sold to him with the stipulation that I was not responsible. Uthman Ibn Affan decided that Abdullah Ibn Umar should take an oath that he had sold the slave without knowing that he had any disease. Abdullah Ibn Umar refused to take the oath; so the slave was returned to him and recovered his health in his possession. Abdullah sold him afterwards for 1500 dirhams. Malik said; The generally agreed upon way of doing things among us about a man who buys a female slave and she becomes pregnant; or who buys a slave and then frees him; or if there is any other such matter which has already happened so that he cannot return his purchase; and a clear proof is established that there was a fault in that purchase when it was in the hands of the seller or the fault is admitted by the seller or someone else; is that the slave or slave-girl is assessed for its value with the fault it is found to have had on the day of purchase and the buyer is refunded;from what he paid;the difference between the price of a slave who is sound and a slave with such a defect. Malik said; The generally agreed upon way of doing things among us regarding a man who buys a slave and then finds out that the slave has a defect for which he can be returned and meanwhile another defect has happened to the slave whilst in his possession; is that if the defect which occurred to the slave in his possession has harmed him; like loss of a limb; loss of an eye; or something similar; then he has a choice. If he wants; he can have the price of the slave reduced commensurate with the defect he bought him with according to the prices on the day he bought him; or if he likes; he can pay compensation for the defect which the slave has suffered in his possession and return him. The choice is up to him. If the slave dies in his possession; the slave is valued with the defect which he had on the day of his purchase. It is seen what his price would really have been. If the price of the slave on the day of purchase without fault was 100 dinars; and his price on the day of purchase with fault would have been 80 dinars; the price is reduced by the difference. These prices are assessed according to the market value on the day the slave was purchased. Malik said; The generally agreed upon way of doing things among us is that if a man returns a slave girl in whom he has found a defect and he has already had intercourse with her; he must pay what he has reduced of her price if she was a virgin. If she was not a virgin; there is nothing against his having had intercourse with her because he had charge of her. Malik said; The generally agreed upon way of doing things among us regarding a person; whether he is an inheritor or not; who sells a slave; slave-girl; or animal without a liability agreement is that he is not responsible for any defect in what he sold unless he knew about the fault and concealed it. If he knew that there was a fault and concealed it; his declaration that he was free of responsibility does not absolve him; and what he sold is returned to him. Malik spoke about a situation where a slave-girl was bartered for two other slave-girls and then one of the slave-girls was found to have a defect for which she could be returned. He said; The slave-girl worth two other slave- girls is valued for her price. Then the other two slave-girls are valued; ignoring the defect which the one of them has. Then the price of the slave-girl sold for two slave-girls is divided between them according to their prices so that the proportion of each of them in her price is arrived at - to the higher priced one according to her higher price; and to the other according to her value. Then one looks at the one with the defect; and the buyer is refunded according to the amount her share is affected by the defect; be it little or great. The price of the two slave-girls is based on their market value on the day that they were bought. Malik spoke about a man who bought a slave and hired him out on a long-term or short-term basis and then found out that the slave had a defect which necessitated his return. He said that if the man returned the slave because of the defect; he kept the hire and revenue. This is the way in which things are done in our city. That is because; had the man bought a slave who then built a house for him; and the value of the house was many times the price of the slave; and he then found that the slave had a defect for which he could be returned; and he was returned; he would not have to make payment for the work the slave had done for him. Similarly; he would keep any revenue from hiring him out; because he had charge of him. This is the way of doing things among us. Malik said; The way of doing things among us when someone buys several slaves in one lot and then finds that one of them has been stolen; or has a defect; is that he looks at the one he finds has been stolen or the one in which he finds a defect. If he is the pick of those slaves; or the most expensive; or it was for his sake that he bought them; or he is the one in whom people see the most excellence; then the whole sale is returned. MuwataMalik-017-001-35059 | Malik said; The generally agreed on way of doing things among us is that some one who buys some fruit; fresh or dry; should not resell it until he gets full possession of it. He should not barter things of the same type; except hand to hand. Whatever can be made into dry fruit to be stored and eaten; should not be bartered for its own kind; except hand to hand; like for like; when it is the same kind of fruit. In the case of two different kinds of fruit; there is no harm in bartering two of one kind for one of another; hand to hand on the spot. It is not good to set delayed terms. As for produce which is not dried and stored but is eaten fresh like water melon; cucumber; melon; carrots; citron; medlars; pomegranates; and soon; which when dried no longer counts as fruit; and is not a thing which is stored up as is fruit; I think that it is quite proper to barter such things two for one of the same variety hand to hand. MuwataMalik-017-001-35070 | Yahya related to me from Malik that Yahya Ibn Said heard Said Ibn AlMusayab say; Keeping gold and silver out of circulation is part of working corruption in the land. Malik said; There is no harm in buying gold with silver or silver with gold without measuring if it is unminted or a piece of jewellery which has been made. Counted dirhams and counted dinars should not be bought without reckoning until they are known and counted. To abandon number and buy them at random would only be to speculate. That is not part of the business transactions of Muslims. As for what is weighed of unminted objects and jewellery; there is no harm in buying such things without measuring. To buy them without measuring is like buying wheat; dried dates; and such food-stuffs; which are sold without measuring; even though things like them are measured Malik spoke about buying a Quran; a sword or a signet ring which had some gold or silver work on it with dinars or dirhams. He said; The value of the object bought with dinars; which has gold in it is looked at. If the value of the gold is up to one-third of the price; it is permitted and there is no harm in it if the sale is hand to hand and there is no deferment in it. When something is bought with silver which has silver in it; the value is looked at. If the value of the silver is one- third; it is permitted and there is no harm in it if the sale is hand to hand. I want to take payment for goods that I guarantee to deliver at a future date. Said said to him; Do you intend to settle these things with receipts for provisions you have bought? He said; Yes. So he forbade that. There is no harm in taking a ritl of iron for two ritls of iron; and a ritl of brass for two ritls of brass. Malik said; There is no good in two for one of one sort with delayed terms. There is no harm in taking two of one sort for one of another on delayed terms; if the two sorts are clearly different. If both sorts resemble each other but their names are different; like lead and black lead; brass and yellow brass; I disapprove of taking two of one sort for one of the other on delayed terms. Malik said; When buying something of this nature; there is no harm in selling It beforetaking possession of it to some one other than the person from whom it was purchased; if the price is taken immediately and if it was bought originally by measure or weight. If it was bought without measuring; it should be sold to someone other than the person from whom it was bought; for cash or with delayed terms. That is because goods have to be guaranteed when they are bought without measuring; and they cannot be guaranteed when bought by weight until they are weighed and the deal is completed. This is the best of what I have heard about all these things. It is what people continue to do among us. Malik said; The way of doing things among us with what is measured or weighed of things which are not eaten or drunk; like safflower; date-stones; fodder leaves; indigo dye and the like of that is that there is no harm in bartering all those sort of things two for one; hand to hand. Do not take two for one from the same variety with delayed terms. If the types are clearly different; there is no harm in taking two of one for one of the other with delayed terms. There is no harm in selling whatever is purchased of all these sorts; before taking delivery of them if the price is taken from someone other than the person from whom they were purchased. MuwataMalik-017-001-35129 | Malik related to me from Abuz-Zinad from AlAraj from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; Do not go out to meet the caravans for trade; do not bid against each other; outbidding in order to raise the price; and a townsman must not buy on behalf of a man of the desert; and do not tie up the udders of camels and sheep so that they appear to have a lot of milk; for a person who buys them after that has two recourses open to him after he milks them. If he is pleased with them; he keeps them and if he is displeased with them; he can return them along with a sa of dates. Malik said; The explanation of the words of the Messenger of Allah; may Allah bless him and grant him peace; according to what we think - and Allah knows best - do not bid against each other; is that it is forbidden for a man to offer a price over the price of his brother when the seller has inclined to the bargainer and made conditions about the weight of the gold and he has declared himself not liable for faults and such things by which it is recognised that the seller wants to make a transaction with the bargainer. This is what he forbade; and Allah knows best. Malik said; There is no harm; however; in more than one person bidding against each other over goods put up for sale. He said; Were people to leave off haggling when the first person started haggling; an unreal price might be taken and the disapproved would enter into the sale of the goods. MuwataMalik-017-001-35524 | Yahya related to me from Malik that he had heard that Said Ibn AlMusayab was asked whether a man who had vowed to fast a month could fast voluntarily; and Said said; He should fulfil his vow before he does any voluntary fasting. Malik said; I have heard the same thing from Sulayman Ibn Yasar. Malik said; If someone dies with an unfulfilled vow to free a slave or to fast or to give sadaqa or to give away a camel; and makes a bequest that his vow should be fulfilled from his estate; then the sadaqa or the gift of the camel are taken from one third of his estate. Preference is given to it over other bequests; except things of a similar nature; because by his vow it has become incumbent on him; and this is not the case with something he donates voluntarily. They vows and voluntary donations are settled from a limited one-third of his estate; and not from the whole of it; since if the dying man were free to dispose of all of his estate; he might delay settling what had become incumbent on him i.e. his vows ; so that when death came and the estate passed into the hands of his heirs; he would have bequeathed such things i.e. his vows that were not claimed by anyone like debts. If that i.e. to dispose freely of his property were allowed him; he would delay these things i.e. his vows until when he was near death; he would designate them and they might take up all of his estate. He said; What are they; Ibn Jurayj? and he replied; I have seen you touching only the twoYamani corners; I have seen you wearing hairless sandals; I have seen you using yellow dye; and; when you were at Makka and everybody had started doing talbiya after seeing the new moon; I saw that you did not do so until the eighth of Dhu AlHijja. Abdullah Ibn Umar replied; As for the corners; I only ever saw the Messenger of Allah; may Allah bless him and grant him peace; touching the two Yamani corners. As for the sandals; I saw the Messenger of Allah; may Allah bless him and grant him peace; wearing hairless sandals and doing Ablution in them; and I like wearing them. As for using yellow dye; I saw the Messenger of Allah; may Allah bless him and grant him peace; using it; and I also like to use it for dyeing things with. MuwataMalik-017-001-35928 | Yahya related to me from Malik from Abdulrahman Ibn AlQasim that his father used to go into Makka by night when he was doing umra and do tawaf of the House and say between Safa and Marwa and delay the shaving until the morning; but he would not go back to the House and do tawaf again until he had shaved his head. Abdulrahman added; Sometimes he would enter the Masjid and do the witr prayer there without actually going near the House. Malik said; AlTafath is shaving the head; putting on normal clothes and things of that nature. Yahya said that Malik was asked whether a man who forgot to shave his head at Mina during the hajj could shave in Makka; and he said; That is permissible; but I prefer the shaving to be done at Mina. Malik said; What we are all agreed upon here in Madina is that no-one should shave his head or cut his hair until he has killed his sacrificial animal; if he has one; and things that are haram for him do not become halal for him until he leaves ihram at Mina on the day of sacrifice.
