Did you hear Allah Messenger ﷺ mentioning anything about him? Ubai said; Yes; I heard Allah Apostle saying; While Moses was sitting in the company of some Israelites a man came to him and asked; Do you know Someone who is more learned than you Moses ? Moses said; No. So Allah sent the Divine inspiration to Moses:- Yes; Our Slave Khadir is more learned than you Moses asked Allah how to meet him Khadir So Allah made the fish as a sign for him and it was said to him; When you lose the fish; go back to the place where you lose it and you will meet him. So Moses went on looking for the sign of the fish in the sea. The boy servant of Moses who was accompanying him said to him; Do you remember what happened when we betook ourselves to the rock? SahihAlBukhari-017-001-1678 | Narrated Samura Bin Jundub: Allah Messenger ﷺ very often used to ask his companions; Did anyone of you see a dream? So dreams would be narrated to him by those whom Allah wished to tell. One morning the Prophet ﷺ said; Last night two persons came to me in a dream and woke me up and said to me; Proceed! I set out with them and we came across a man lying down; and behold; another man was standing over his head; holding a big rock. Behold; he was throwing the rock at the man head; injuring it. The rock rolled away and the thrower followed it and took it back. By the time he reached the man; his head returned to the normal state. The thrower then did the same as he had done before. I said to my two companions; Subhan Allah! Who are these two persons? They said; Proceed! So we proceeded and came to a man lying flat on his back and another man standing over his head with an iron hook; and behold; he would put the hook in one side of the man mouth and tear off that side of his face to the back of the neck and similarly tear his nose from front to back and his eye from front to back. Then he turned to the other side of the man face and did just as he had done with the other side. He hardly completed this side when the other side returned to its normal state. Then he returned to it to repeat what he had done before. I said to my two companions; Subhan Allah! Who are these two persons? They said to me; Proceed! So we proceeded and came across something like a Tannur a kind of baking oven; a pit usually clay-lined for baking bread. I think the Prophet ﷺ said; In that oven there was much noise and voices. The Prophet ﷺ added; We looked into it and found naked men and women; and behold; a flame of fire was reaching to them from underneath; and when it reached them; they cried loudly. I asked them; Who are these? They said to me; Proceed! And so we proceeded and came across a river. I think he said;.... red like blood. The Prophet ﷺ added; And behold; in the river there was a man swimming; and on the bank there was a man who had collected many stones. Behold; while the other man was swimming; he went near him. The former opened his mouth and the latter on the bank threw a stone into his mouth whereupon he went swimming again. He returned and every time the performance was repeated. I asked my two companions; Who are these two persons? They replied; Proceed! Proceed! And we proceeded till we came to a man with a repulsive appearance; the most repulsive appearance; you ever saw a man having! Beside him there was a fire and he was kindling it and running around it. I asked my companions; Who is this man ? They said to me; Proceed! Proceed! So we proceeded till we reached a garden of deep green dense vegetation; having all sorts of spring colors. In the midst of the garden there was a very tall man and I could hardly see his head because of his great height; and around him there were children in such a large number as I have never seen. I said to my companions; Who is this? They replied; Proceed! Proceed! So we proceeded till we came to a majestic huge garden; greater and better than I have ever seen! My two companions said to me; Go up and I went up. The Prophet ﷺ added; So we ascended till we reached a city built of gold and silver bricks and we went to its gate and asked the gatekeeper to open the gate; and it was opened and we entered the city and found in it; men with one side of their bodies as handsome as the handsomest person you have ever seen; and the other side as ugly as the ugliest person you have ever seen. My two companions ordered those men to throw themselves into the river. Behold; there was a river flowing across the city ; and its water was like milk in whiteness. Those men went and threw themselves in it and then returned to us after the ugliness of their bodies had disappeared and they became in the best shape. The Prophet ﷺ further added; My two companions angels said to me; This place is the Eden Paradise; and that is your place. I raised up my sight; and behold; there I saw a palace like a white cloud! My two companions said to me; That palace is your place. I said to them; May Allah bless you both! Let me enter it. They replied; As for now; you will not enter it; but you shall enter it one day. I said to them; I have seen many wonders tonight. What does all that mean which I have seen? They replied; We will inform you: As for the first man you came upon whose head was being injured with the rock; he is the symbol of the one who studies the Quran and then neither recites it nor acts on its orders; and sleeps; neglecting the enjoined prayers. As for the man you came upon whose sides of mouth; nostrils and eyes were torn off from front to back; he is the symbol of the man who goes out of his house in the morning and tells so many lies that it spreads all over the world. And those naked men and women whom you saw in a construction resembling an oven; they are the adulterers and the adulteresses. And the man whom you saw swimming in the river and given a stone to swallow; is the eater of usury Riba. And the bad looking man whom you saw near the fire kindling it and going round it; is Malik; the gatekeeper of Hell. And the tall man whom you saw in the garden; is Abraham and the children around him are those children who die with AlFitra the Islamic Faith. The narrator added: Some Muslims asked the Prophet; O Allah Messenger ﷺ ! What about the children of pagans? The Prophet ﷺ replied; And also the children of pagans. The Prophet ﷺ added; My two companions added; The men you saw half handsome and half ugly were those persons who had mixed an act that was good with another that was bad; but Allah forgave them. | The Chapter on Almadinah And Companions in HodHood Indexing, Chapter on The interpretation of dreams after the Fajr prayer in Sahih AlBukhari

After that; the Prophet caller her Barira and gave her the choice to go back to her husband or not. She said; If he gave me so much and so much money I would not stay with him. So she selected her ownself i.e. refused to go back to her husband. | The Chapter on Slaves And Charity in HodHood Indexing, Chapter on If someone is converted to Islam through somebody else in Sahih AlBukhari

Abu Salama Bin Abdulrahman said; If anyone of you has such a thing forgetting the number of rakat he has prayed he should perform two prostrations of Sahu i.e. forgetfulness while sitting. Kindly teach me how to pray. The Prophet ﷺ said; When you stand for prayer; perform ablution properly and then face the Qibla and say Takbir Allahu-Akbar ; and then recite what you know from the Quran; and then bow with calmness till you feel at ease then rise from bowing; till you stand straight; and then prostrate calmly and remain in prostration till you feel at ease; and then raise your head and sit with calmness till you feel at ease and then prostrate with calmness and remain in prostration till you feel at ease; and then raise your head and sit with calmness till you feel at ease in the sitting position; and do likewise in whole of your prayer. Moreover when the shepherds of the black camels would exult themselves in buildings; this is one of the signs of Doom. Doom is one of the five happenings wrapped in the unseen which no one knows but Allah. Then he the Messenger of Allah recited the verse : Verily Allah! with Him alone is the knowledge of the hour and He it is Who sends down the rain and knows that which is in the wombs and no person knows whatsoever he shall earn tomorrow; and a person knows not in whatsoever land he shall die. Verily Allah is Knowing; Aware. He the narrator; Abu Huraira said: Then the person turned back and went away. The Messenger of Allah ﷺ said: Bring that man back to me. They the Companions of the Prophet present there went to bring him back; but they saw nothing there. Upon this the Messenger of Allah remarked: he was Gabriel; who came to teach the people their religion. | The Chapter on Hour And Divine Decree in HodHood Indexing, Chapter on 1 in Sahih Muslim
SahihMuslim-017-001-18436 | It is reported on the authority of Abu Huraira: We were sitting around the Messenger of Allah may peace and blessings be upon him. Abu Bakr and Umar were also there among the audience. In the meanwhile the Messenger of Allah got up and left us; He delayed in coming back to us; which caused anxiety that he might be attacked by some enemy when we were not with him; so being alarmed we got up. I was the first to be alarmed. I; therefore; went out to look for the Messenger of Allah may peace and blessings be upon him and came to a garden belonging to the Banu AlNajjar; a section of the Ansar went round it looking for a gate but failed to find one. Seeing a rabi i. e. streamlet flowing into the garden from a well outside; drew myself together; like a fox; and slinked into the place where God Messenger was. He the Holy Prophet said: Is it Abu Huraira? I Abu Huraira replied: Yes; Messenger of Allah. He the Holy Prophet said: What is the matter with you? replied: You were amongst us but got up and went away and delayed for a time; so fearing that you might be attacked by some enemy when we were not with you; we became alarmed. I was the first to be alarmed. So when I came to this garden; I drew myself together as a fox does; and these people are following me. He addressed me as Abu Huraira and gave me his sandals and said: Take away these sandals of mine; and when you meet anyone outside this garden who testifies that there is no god but Allah; being assured of it in his heart; gladden him by announcing that he shall go to Paradise. Now the first one I met was Umar. He asked: What are these sandals; Abu Huraira? I replied: These are the sandals of the Messenger of Allah with which he has sent me to gladden anyone I meet who testifies that there is no god but Allah; being assured of it in his heart; with the announcement that he would go to Paradise. Thereupon Umar struck me on the breast and I fell on my back. He then said: Go back; Abu Huraira; So I returned to the Messenger of Allah ﷺ ; and was about to break into tears. Umar followed me closely and there he was behind me. The Messenger of Allah may peace and blessings be on him said: What is the matter with you; Abu Huraira? I said: I happened to meet Umar and conveyed to him the message with which you sent me. He struck me on my breast which made me fall down upon my back and ordered me to go back. Upon this the Messenger of Allah ﷺ said: What prompted you to do this; Umar? He said: Messenger of Allah; my mother and father be sacrificed to thee; did you send Abu Huraira with your sandals to gladden anyone he met and who testified that there is no god but Allah; and being assured of it in his heart; with the tidings that he would go to Paradise? He said: Yes. Umar said: Please do it not; for I am afraid that people will trust in it alone; let them go on doing good deeds. The Messenger of Allah ﷺ said: Well; let them. | The Chapter on in HodHood Indexing, Chapter on 10 in Sahih Muslim
SahihMuslim-017-001-18743 | Abu Saeed AlKhudri reported: Some people during the lifetime of the Messenger of Allah ﷺ said: Messenger of Allah! shall we see our Lord on the Day of Resurrection? The Messenger of Allah ﷺ said: Yes; and added: Do you feel any trouble in seeing the sun at noon with no cloud over it; and do you feel trouble in seeing the moon open in the full moonlit night with no cloud over it? They said: No; Messenger of Allah! He the Holy Prophet said: You will not feel any trouble in seeing Allah on the Day of Resurrection any more than you do in seeing any one of them. When the Day of Resurrection comes a Muadhdhin a proclaimer would proclaim: Let every people follow what they used to worship. Then all who worshipped idols and stones besides Allah would fall into the Fire; till only the righteous and the vicious and some of the people of the Book who worshipped Allah are left. Then the Jews would be summoned; and it would be said to them: What did you worship? They will say: We worshipped Uzair; son of Allah. It would be said to them: You tell a lie; Allah had never had a spouse or a son. What do you want now? They would say: We feel thirsty; O our Lord! Quench our thirst. They would be directed to a certain direction and asked: Why dont you go there to drink water? Then they would be pushed towards the Fire and they would find to their great dismay that it was but a mirage and the raging flames of fire would be consuming one another; and they would fall into the Fire. Then the Christians would be summoned and it would be said to them: What did you worship? They would say: We worshipped Jesus; son of Allah. It would be said to them: You tell a lie; Allah did not take for Himself either a spouse or a son. Then it would be said to them: What do you want? They would say: Thirsty we are; O our Lord! Quench our thirst. They would be directed to a certain direction and asked: Why dont you go there to get water? But they would be pushed and gathered together towards the Hell; which was like a mirage to them; and the flames would consume one another. They would fall Into the Fire; till no one is left except he who worshipped Allah; be he pious or sinful. The Lord of the Universe; Glorified and Exalted; would come to them in a form recognisable to them and say; What are you looking for? Every people follow that which they worshipped. They would say: Our Lord; we kept ourselves separate from the people in the world; though we felt great need of them; we; however; did not associate ourselves with them. He would say: I am your Lord. They would say: We take refuge with Allah from thee and do not associate anything with Allah. They would repeat it twice or thrice; till some of them would be about to return. It would be said: Is there any sign between you and Him by which you will recognise Him? They would say: Yes. and the things would be laid bare. Those who used to prostrate themselves before God of their own accord would be permitted by God to prostrate themselves. But there would remain none who used to prostrate out of fear of people and ostentation but Allah would make his back as one piece; and whenever he would attempt to prostrate he would fall on his back. Then they would raise their heads and He would assume the Form in which they had seen Him the first time and would say: I am your Lord. They would say: Thou art our Lord. Then the bridge would be set up over the Hell and intercession would be allowed and they will say: O God; keep safe; keep safe. It was asked: Messenger of Allah; what is this bridge? He said: The void in which one Is likely to slip. There would be hooks; tongs; spits like the thorn that is found in Najd and is known as Sadan. The believers would then pass over within the twinkling of an eye; like lightning; like wind; like a bird; like the finest horses and camels. Some will escape and be safe; some will be lacerated and let go; and some will be pushed into the fire of Hell till the believers will find rescue from the Fire. By One in Whose hand is my life; there will be none among you more eager to claim a right than the believers on the Day of Resurrection for saying their brethren in the Fire who would say: O our Lord; they were fasting along with us; and praying and performing pilgrimage. It will be said to them: Take out those whom you recognise. Then their persons would be forbidden to the Fire; and they would take out a large number of people who had been overtaken by Fire up to the middle of the shank or up to the knees. They would then say: O our Lord I not one of those about whom Thou didst give us command remains in it. He will then say: Go back and bring out those in whose hearts you find good of the weight of a dinar Then they will take out a large number of people. Then they would say: O our Lord! we have not left anyone about whom You commanded us. He will then say: Go back and bring out those in whose hearts you find as much as half a dinar of good. Then they will take out a large number of people; and would say: O our Lord! not one of those about whom Thou commanded us we have left in it. Then He would say: Go back and in whose heart you find good to the weight of a particle bring him out. They would bring out a large number of people; and would then say: O our Lord; now we have not left anyone in it Hell having any good in him. Abu Saeed Khudri said: If you dont testify me in this hadith; then recite if you like: Surely Allah wrongs not the weight of an atom; and if it is a good deed. He multiplies it and gives from Himself a great reward AlQuran; iv. 40. Then Allah; Exalted and Great; would say: The angels have interceded; the apostles have interceded and the believers have interceded; and no one remains to grant pardon but the Most Merciful of the mercifuls. He will then take a handful from Fire and bring out from it people who never did any good and who had been turned into charcoal; and will cast them into a river called the river of life; on the outskirts of Paradise. They will come out as a seed comes cut from the silt carried by flood. You see it near the stone or near the tree. That which is exposed to the sun is yellowish or greenish and which is under the shade is white. They said: Messenger of Allah! it seems as if you had been tending a flock in the jungle. He the Holy Prophet said: They will come forth like pearls with seals on their necks. The inhabitants of Paradise would recognise them and say : Those are who have been set free by the Compassionate One. Who has admitted them into Paradise without any good deed that they did or any good that they sent in advance Then He would say: Enter the Paradise; whatever you see in it is yours. They would say: O Lord; Thou hast bestowed upon us favours which Thou didst not bestow upon anyone else in the world. He would say: There is with Me a favour for you better than this. They would say: O our Lord! which thing is better than this? He would say: It is My pleasure. SahihMuslim-017-001-18763 | Yazid AlFaqir said: This view of the Khawarij i.e. those who commit major sins and would be eternally doomed to Hell had obsessed me; and we set out in a large group intending to perform the Hajj and then going to the people for the propagation of the views of the Khawarij. He the narrator said: We happened to past by Medina and found there Jabir Bin Abdullah sitting near a column narrating to the people the ahadith of the Prophet ﷺ. When he mentioned the inhabitants of Hell; I said: O companion of the Messenger of Allah what is this that you narrate; whereas Allah says: Verily whomsoever Thou shall commit to the Fire; Thou indeed humiliateth him AlQuran; iii. 192 ; and All those who endeavored to get out of that would be thrown back into it AlQuran; xxxi i. 20 ? So what is it that you say? He said: Have you read the Quran? I said: Yes. He said: Have you heard about the exalted position of Muhammad ﷺ ; i.e. to which Allah would raise; him? I said: Yes. He said: Verily the position of Muhammad ﷺ is that of great glory and that is by which Allah would bring out whomsoever He would wish to bring out. He then described the Path the Bridge and the passing of the people over it; and said: I am afraid I may not have remembered other things but this much is still in my memory that people would come out of the Hell after having gone into it; and he said: They would come out of it as if they were the wood of the ebony tree. He the narrator said: They would enter a river; one or the rivers of Paradise; and would bathe in it; and then come out as if they were white like paper. We then turned back and said: Woe be upon you! How can this old man tell a lie against the Messenger of Allah ﷺ ? We turned back from the views of the Khawarij ; and by God every one of us abandoned this band of Khawarij except one man. A similar statement has been made by Abu Nuaim. | The Chapter on The Punishment Of Hell Fire in HodHood Indexing, Chapter on 84 in Sahih Muslim
SahihMuslim-017-001-19242 | Abu Saeed AlKhudri reported that Allah Messenger ﷺ one day gave a detailed account of the Dajjal and in that it was also included: He would come but would not be allowed to enter the mountain passes to Medina. So he will alight at some of the barren tracts near Medina; and a person who would be the best of men or one from amongst the best of men would say to him: I bear testimony to the fact that you are Dajjal about whom Allah Messenger ﷺ had informed us. The Dajjal would say: What is your opinion if I kill this person ; then I bring him back to life; even then will you harbour doubt in this matter? They would say: No. He would then kill the man and then bring him back to life. When he would bring that person to life; he would say: By Allah; I had no better proof of the fact that you are a Dajjal than at the present time that you are actually so. The Dajjal would then make an attempt to kill him again but he would not be able to do that. Abu Ishaq reported that it was said: That person would be Khadir Allah be pleased with him. | The Chapter on Life And Death And Wealth in HodHood Indexing, Chapter on 21 in Sahih Muslim

SunanAlTermithi-017-001-10024 | Narrated Zirr Bin Hubaish: I said to Hudhaifah Bin AlYaman: Did the Messenger of Allah ﷺ perform Prayer in Bait AlMaqdis? He said: No. I said: But he did. He said: You say that; O bald one! Based upon what do you say that? I said: Based upon the Quran; the Judge between you and I is the Quran. So Hudhaifah said: Whoever argues using the Quran; then he has indeed succeeded. One of the narrators Sufyan said: He means: He has indeed proven - and perhaps he Sufyan said: He triumphed. He Zirr said: Glorified is He Who took His slave for a journey by night from AlMasjid AlHaram to AlMasjid AlAqsa 17:1. He Hudhaifah said: Do you see this proves that he ﷺ performed Prayer in it? I said: No. He said: If he had performed Prayer in it; then it would have been required upon you that you perform Prayer in it; just as it is required that you perform Prayer in AlMasjid AlHaram. Hudhaifah said: The Messenger of Allah ﷺ was brought a beast with a long back - stretching out like this - one stride of it; is as far as his vision. So; the two of them remained upon the back of AlBuraq until they saw Paradise and the Fire; and all of what has been prepared for the Hereafter; then they returned back to where they began. SunanAlTermithi-017-001-10290 | Abu Saeed AlKhudri said: One day; the Messenger of Allah s.a.w led us in Prayer AlAsr while it was still daytime. Then he stood to give us a Khutbah. He did not leave anything that would happen until the Hour of Judgement except that he informed us about it. Whoever remembered it remembered it; and whoever forgot it forgot it. Among what he said was: Indeed the world is green and sweet; and indeed Allah has left you to remain to see how you behave. So beware of the world; and beware of the women. And among what he said was: The awe status of people should not prevent a man from saying the truth when he knows it.He one of the narrators said: Abu Saeed wept; then he said: By Allah! We have seen things and we feared. And among what he said in it; was : Indeed; for every treacherous person there shall be a banner erected on The Day Of Resurrection in proportion to his treachery. And there is no treachery greater than the treachery of a leader to the masses whose banner shall be positioned at his buttocks. And among what we remember from that day is: Behold! Indeed the children of Adam were created in various classes. Among them is he who was born a believer; lives as a believer; and dies a believer. Among them; is he who was born a disbeliever; lives as a disbeliever; and dies a disbeliever. Among them; is he who was born a believer; lives as a believer; and dies a disbeliever. Among them; is he who was born a disbeliever; lives as a disbeliever; and dies a believer. Behold! Among them is the slow to get angry; the quick to calm. Among them is the quick anger and the quick to calm; so this is with that. Behold! Among them is the quick get angry and the slow to calm; and indeed the best of them is the slow to get angry and the quick to calm; and the worst of them is the quick get angry and the slow to calm. Behold! Among them is he who pays back well and collects well. Among them is he who is bad with paying back and good when collecting. Among them is he who pays back well and is bad with collecting; so this is with that. Behold! Among them is he who is bad with paying back and bad with collecting. Indeed the best of them is the one who is good in paying back and good in collecting. And the worst of them is the one who is bad with paying back and bad with collecting. Behold! Anger is an ember in the heart of the son of Adam; as you see it in the redness of his eyes and the bulge of his jugular veins. So whoever senses something from that; then let him cling to the ground. He said: So we began turning towards the sun to see if anything of it remained meaning whether it has set or not. I will neither divorce you irrevocably; nor give you residence ever! She would say: And how is that? He would say: I will divorce you; and whenever your Iddah is just about to end I will take you back. So a woman went to Aisha to inform her about that; and Aisha was silent until the Prophet came. So He said: I created these for the Fire; and they will do the deeds of the people of the Fire. A man said: Then of what good is doing deeds O Messenger of Allah! He said: By Allah; I have not become a hypocrite; and I will go to the Prophet ﷺ and tell him about that ; So he went to the Prophet and said: 0 Messenger of Allah ﷺ ; Muadh prays with you; then he comes to lead us in prayer. You delayed the prayer; and he prayed with you then he came back to lead us in prayer; and he started to recite Shut AlBaqarah. She asked permission to enter when he was lying with me under my cover. He gave her permission to enter; and she said: O Messenger of Allah; your wives have sent me to you to ask you to be equitable with regard to the matter of the daughter of Abu Quhafah. I Aisha kept quiet and the Messenger of Allah said to her: O my daughter! Do you not love the one whom I love? She said: Yes. He said: Then love this one. Fatimah stood up when she heard this and left the Messenger of Allah; and went back to the wives of the Prophet. She told them what she had said; and what he had said to her. They said to her: We do not think that you have been of any avail to us. Go back to the Messenger of Allah and say to him: Your wives are urging you to be equitable with regard to the matter of the daughter of Abu Quhafah. Fatimah said: No; by Allah; I will never speak to him about her again. Aisha said: So the wives of the Prophet sent Zainab bint Jahsh to the Messenger of Allah; she was one who was somewhat equal to me in rank in the eyes of the Messenger of Allah. And I have never seen a woman who was better in religious commitment than Zainab; more fearing of Allah; more honest in speech; more dutiful in upholding the ties of kinship; more generous in giving charity; and devoted in giving of herself in acts of charity; by means of which she sought to draw closer to Allah. The Messenger of Allah gave her permission to enter and she said: O Messenger of Allah; your wives have sent me to ask you to be equitable with regard to the matter of the daughter of Abu Quhafah. Then she verbally abused me at length; and I was watching the Messenger of Allah to see if he would allow me to respond. SunanAbuDawoud-017-001-25003 | Narrated Abdullah Ibn Abbas: Ibn Umar misunderstood the Quranic verse; So come to your tilth however you will -may Allah forgive him. The fact is that this clan of the Ansar; who were idolaters; lived in the company of the Jews who were the people of the Book. They the Ansar accepted their superiority over themselves in respect of knowledge; and they followed most of their actions. The people of the Book i.e. the Jews used to have intercourse with their women on one side alone i.e. lying on their backs. This was the most concealing position for the vagina of the women. This clan of the Ansar adopted this practice from them. But this tribe of the Quraysh used to uncover their women completely; and seek pleasure with them from in front and behind and laying them on their backs. When the muhajirun the immigrants came to Medina; a man married a woman of the Ansar. He began to do the same kind of action with her; but she disliked it; and said to him: We were approached on one side i.e. lying on the back ; do it so; otherwise keep away from me. This matter of theirs spread widely; and it reached the Messenger of Allah ﷺ. So Allah; the Exalted; sent down the Quranic verse: Your wives are a tilth to you; so come to your tilth however you will; i.e. from in front; from behind or lying on the back. But this verse meant the place of the delivery of the child; i.e. the vagina. | The Chapter on Alansar And Forgiveness in HodHood Indexing, Chapter on Regarding Intercourse in Sunan Abu Dawoud

He said: Abdullah Ibn Umar divorced his wife while she was menstruating during the time of the Messenger of Allah ﷺ.So Umar asked the Messenger of Allah ﷺ saying: Abdullah Ibn Umar divorced his wife while she was menstruating. Abdullah said: He returned her to me and did not count it the pronouncement anything. He said: When she is purified; he may divorce her or keep her with him. Ibn Umar said: The Prophet ﷺ recited the Quranic verse: O Prophet; when you divorce women; divorce them in the beginning of their waiting period.Abu Dawud said: This tradition has been narrated by Yunus Bin Jubair; Anas Bin Seereen Bin Jubair; Zaid Bin Aslam; Abu AlZubair and Mansur from Abu Wail on the authority of Ibn Umar. They all agreed on the theme that the Prophet ﷺ commanded him to take her back and keep her till she was purified. Then if he desired; he might divorce her or keep her with him if he wanted to do so. The version narrated by AlZuhri from Salim from Nafi on the authority of Ibn Umar has: The Prophet ﷺ commanded him to take her back and keep her till she is purified; and then has menstrual discharge; and then she is purified. Then if he desires; he may divorce her and if he desires he may keep her.Abu Dawud said: A version like that of Nafi and AlZuhri has also been transmitted by Ata AlKhurasani from AlHasan on the authority of Ibn Umar. She went to the Prophet ﷺ and said: He is of no use to me except that he is as useful to me as a hair; and she took a hair from her head. So separate me from him. The Prophet ﷺ became furious. He called on Rukanah and his brothers. He then said to those who were sitting beside him. Do you see so-and-so who resembles Abdu Yazid in respect of so-and-so; and so-and-so who resembles him in respect of so-and-so? They replied: Yes. The Prophet ﷺ said to Abdu Yazid: Divorce her. Then he did so. He said: Take your wife; the mother of Rukanah and his brothers; back in marriage. He said: I have divorced her by three pronouncements; Messenger of Allah. He said: I know: take her back. He then recited the verse: O Prophet; when you divorce women; divorce them at their appointed periods.Abu Dawud said: The tradition narrated by Nafi Bin Ujair and Abdullah Bin Yazid Bin Rukanah from his father on the authority of his grandfather reads: Rukanah divorced his wife absolutely i.e. irrevocable divorce. The Prophet ﷺ restored her to him. This version is sounder than other versions ; for they i.e. these narrators are the children of his man; and the members of the family are more aware of his case. When the month of Ramadan came; I feared lest I should have intercourse with my wife; and this evil should remain with me till the morning. So I made my wife like my mother back to me till the end of Ramadan. But one night when she was waiting upon me; something of her was revealed. Suddenly I jumped upon her. When the morning came I went to my people and informed them about this matter. I said: Go along with me to the Messenger of Allah ﷺ. They said: No; by Allah. So I went to the Prophet ﷺ and informed him of the matter. He said: Have you really committed it; Salamah? I said: I committed it twice; Messenger of Allah. I am content with the Commandment of Allah; the Exalted; so take a decision about me according to what Allah has shown you. He said: Free a slave. I said: By Him Who sent you with truth; I do not possess a neck other than this: and I struck the surface of my neck. He said: Then fast two consecutive months. I said: Whatever I suffered is due to fasting. He said: Feed sixty poor people with a wasq of dates. I said: By Him Who sent you with truth; we passed the night hungry; there was no food in our house. He said: Then go to the collector of sadaqah of Banu Zurayq; he must give it to you. Then feed sixty poor people with a wasq of dates; and you and your family eat the remaining dates. Then I came back to my people; and said to them : I found with you poverty and bad opinion; and I found with the Prophet ﷺ prosperity and good opinion. He has commanded me to give alms to you. SunanAbuDawoud-017-001-25093 | Ibn Abbas said Hilal Bin Umayah accused his wife in the presence of Prophet ﷺ of having committed adultery with Sharik Bin Sahma. The Prophet ﷺ said Produce evidence or you must receive punishment on your back. He said Apostle of Allaah ﷺ when one of us sees a man having intercourse with his wife should he go and seek evidence? But the Prophet ﷺ merely said You must produce evidence or you must receive punishment on your back. Hilal then said By Him Who sent you with the Truth; I am speaking Truly. May Allaah send down something which will free my back from punishment. Then the following Quranic verses were revealed And those who make charges against their spouses but have no witnesses except themselves reciting till he reached one of those who speak the truth. The Prophet ﷺ then returned and sent for them and they came to him. Hilal Bin Umayah stood up and testified and the Prophet ﷺ was saying Allaah knows that one of you is lying. Will one of you repent? Then the woman got up and testified; but when she was about to do it a fifth time saying that Allaahs anger be upon her if he was one of those who spoke the truth; they said to her this is the deciding one. Ibn Abbas said She then hesitated and drew back so that we thought the she would withdraw what she said Look and see whether she gives birth to a child with eyes looking as if they have antimony in them; wide buttocks and fat legs; if she did. Sharik Bin Sahma will be its father. She then gave birth to a child of a similar description. It was then set up for him in the place of prayer. He fixed a day for the people on which they should come out. Aisha said: The Messenger of Allah ﷺ ; when the rim of the sun appeared; sat down on the pulpit; and having pronounced the greatness of Allah and expressed His praise; he said: You have complained of drought in your homes; and of the delay in receiving rain at the beginning of its season. Allah has ordered you to supplicate Him has and promised that He will answer your prayer. Then he said: Praise be to Allah; the Lord of the Universe; the Compassionate; the Merciful; the Master of the Day of Judgment. There is no god but Allah Who does what He wishes. O Allah; Thou art Allah; there is no deity but Thou; the Rich; while we are the poor. Send down the rain upon us and make what Thou sendest down a strength and satisfaction for a time. He then raised his hands; and kept raising them till the whiteness under his armpits was visible. He then turned his back to the people and inverted or turned round his cloak while keeping his hands aloft. He then faced the people; descended and prayed two rakahs. Allah then produced a cloud; and the storm of thunder and lightning came on. Then the rain fell by Allah permission; and before he reached his Masjid streams were flowing. When he saw the speed with which the people were seeking shelter; he ﷺ laughed till his back teeth were visible. SunanAbuDawoud-017-001-25435 | Narrated Abdullah Ibn Abbas: Saeed Ibn Jubayr said: I said to Abdullah Ibn Abbas: AbulAbbas; I am surprised to see the difference of opinion amongst the companions of the Apostle ﷺ about the wearing of ihram by the Messenger of Allah ﷺ when he made it obligatory. He replied: I am aware of it more than the people. The Messenger of Allah ﷺ performed only one hajj. Hence the people differed among themselves. The Messenger of Allah ﷺ came out from Medina with the intention of performing hajj. When he offered two rakahs of prayer in the Masjid at Dh AlHulayfah; he made it obligatory by wearing it. At the same meeting; he raised his voice in the talbiyah for hajj; when he finished his two rakahs. Some people heard it and I retained it from him. He then rode on the camel ; and when it the camel stood up; with him on its back; he raised his voice in the talbiyah and some people heard it at that moment. This is because the people were coming in groups; so they heard him raising his voice calling the talbiyah when his camel stood up with him on its back; and they thought that the Messenger of Allah ﷺ had raised his voice in the talbiyah when his camel stood up with him on its back. The Messenger of Allah ﷺ proceeded further; when he ascended the height of AlBayda he raised his voice in the talbiyah. Some people heard it at that moment. They thought that he had raised his voice in the talbiyah when he ascended the height of AlBayda. I swear by Allah; he raised his voice in the talbiyah at the place where he prayed; and he raised his voice in the talbiyah when his camel stood up with him on its back; and he raised his voice in the talbiyah when he ascended the height of AlBayda. SunanAbuDawoud-017-001-25920 | Narrated Umar Ibn AlKhattab: Muslim Ibn Yasar AlJuhani said: When Umar Ibn AlKhattab was asked about the verse When your Lord took their offspring from the backs of the children of Adam - AlQanabi recited the verse-he said: I heard the Messenger of Allah ﷺ say when he was questioned about it: Allah created Adam; then passed His right hand over his back; and brought forth from it his offspring; saying: I have these for Paradise and these will do the deeds of those who go to Paradise. He then passed His hand over his back and brought forth from it his offspring; saying: I have created these for Hell; and they will do the deeds of those who go to Hell. A man asked: What is the good of doing anything; Messenger of Allah? The Messenger of Allah ﷺ said: When Allah creates a servant for Paradise; He employs him in doing the deeds of those who will go to Paradise; so that his final action before death is one of the deeds of those who go to Paradise; for which He will bring him into Paradise. SunanAbuDawoud-017-001-26274 | Amr Bin Yahya AlMazini reports on the authority of his father who asked Abdullah Bin Zaid; the grandfather of Amr Bin Yahya AlMazini: Can you show me how the Messenger of Allah ﷺ performed ablution? Abdullah Bin Zaid replied: Yes. He called for ablution water; poured it over his hands; and washed them; then he rinsed his mouth and snuffed up water in the nose three times; then he washed his face three times and washed his forearms up to elbow twice; then he wiped his head with both hands; moving them front and back of the head; beginning from his forehead; and moved them to the nape; then he pulled them back to the place from where he had started wiping ; then he washed his feet. | The Chapter on Personal Hygiene Ablution in HodHood Indexing, Chapter on The Manner of The Prophet Wudu in Sunan Abu Dawoud
SunanAbuDawoud-017-001-26280 | AbulAzhar AlMughirah Ibn Farwah and Yazid Ibn Abu Malik reported: Muawiyah performed ablution before the people; as he saw the Messenger of Allah ﷺ performed ablution. When he reached the stage of wiping his head; he took a handful of water and poured it with his left hand over the middle of his head so much so that drops of water came down or almost came down. SunanAbuDawoud-017-001-26305 | AlMughirah Bin Shubah reported: I was in the company of the Messenger of Allah ﷺ in the expedition of Tabuk. He abandoned the main road before the dawn prayer; and I also did the same along with him. The Prophet ﷺ made his camel kneel down and went to relieve himself. He then came back and I poured water upon his hands from the skin-vessel. He then washed his hands and face. He tried to get his forearms out of the gown ; but the sleeves of the gown were too narrow; so he entered back both his hands; and brought them out from beneath the gown. He washed his forearms up to the elbows and wiped his head and wiped over his socks.80 He then mounted his camel and we began to proceed until we found people offering the prayer. They brought forward Abdulrahman Bin Awuf who was leading them in prayer. The Prophet ﷺ stood in the row side by side with other Muslims. He performed the second rakah of the prayer behind Abdulrahman Bin Awuf. Then Abdulrahman uttered salutation. The Prophet ﷺ stood to perform the remaining rakah of the prayer. The Muslims were alarmed. They began to utter tasbih Subhan Allah presuming that they had offered prayer before the Prophet ﷺ had done. SunanAbuDawoud-017-001-26469 | Narrated Woman of Banu Ghifar: Umayah; daughter of AbusSalt; quoted a certain woman of Banu Ghifar; whose name was mentioned to me; as saying: The Messenger of Allah ﷺ made me ride behind him on the rear of the camel saddle. By Allah; the Messenger of Allah ﷺ got down in the morning. He made his camel kneel down and I came down from the back of his saddle. There was a mark of blood on it saddle and that was the first menstruation that I had. I stuck to the camel and felt ashamed. When the Messenger of Allah ﷺ saw what had happened to me and saw the blood; he said: Perhaps you are menstruating. I said: Yes. He then said: Set yourself right i.e. tie some cloth to prevent bleeding ; then take a vessel of water and put some salt in it; and then wash the blood from the back of the saddle; and then return to your mount. When the Messenger of Allah ﷺ conquered Khaybar; he gave us a portion of the booty. Whenever the woman became purified from her menses; she would put salt in water. Once Hassan or Husayn may Allah be pleased with them was brought to him and he passed water on his chest. I came to wash it. He said: It is only the urine of a female which should be washed; the urine of a male should be sprinkled over.Abbas a narrator said: Yahya Bin AlWalid narrated the tradition to us. They came to AlNuman Ibn Bashir; the companion of the Prophet ﷺ. He confined them for some days and then set them free. They came to AlNuman and said: You have set them free without beating and investigation. AlNuman said: What do you want? You want me to beat them. If your goods are found with them; then it is all right; otherwise; I shall take retaliation from your back as I have taken from their backs. They asked: Is this your decision? SunanAbuDawoud-017-001-26615 | Narrated Nuaym Ibn Huzzal: Yazid Ibn Nuaym Ibn Huzzal; on his father authority said: Maiz Ibn Malik was an orphan under the protection of my father. He had illegal sexual intercourse with a slave-girl belonging to a clan. My father said to him: Go to the Messenger of Allah ﷺ and inform him of what you have done; for he may perhaps ask Allah for your forgiveness. His purpose in that was simply a hope that it might be a way of escape for him. So he went to him and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. He the Prophet turned away from him; so he came back and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. He again turned away from him; so he came back and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. When he uttered it four times; the Messenger of Allah ﷺ said: You have said it four times. With whom did you commit it? He replied: With so and so. He asked: Did you lie down with her? He replied: Yes. He asked: Had your skin been in contact with hers? He replied. Yes. He asked: Did you have intercourse with her? He said: Yes. So he the Prophet gave orders that he should be stoned to death. He was then taken out to the Harrah; and while he was being stoned he felt the effect of the stones and could not bear it and fled. But Abdullah Ibn Unays encountered him when those who had been stoning him could not catch up with him. He threw the bone of a camel foreleg at him; which hit him and killed him. MuwataMalik-017-001-34490 | Yahya related to me from Malik from Abu Hazim Salama Ibn Dinar from Sahl Ibn Said AlSaidi that the Messenger of Allah; may Allah bless him and grant him peace; went to the tribe of Bani Amr Ibn Awuf to settle their disputes. The time for the prayer came and the muadhdhin came to Abu Bakr AlSiddiq and said; Could you lead the people in prayer and I will say the iqama? He said; Yes; and Abu Bakr prayed. The Messenger of Allah; may Allah bless him and grant him peace; came back while the people were praying; and approached and joined the row. People clapped; but Abu Bakr did not turn round. The people increased their clapping; and Abu Bakr turned round and saw the Messenger of Allah; may Allah bless him and grant him peace; and the Messenger of Allah; may Allah bless him and grant him peace; indicated to him to stay in his place. Abu Bakr raised his hands and praised Allah that the Messenger of Allah; may Allah bless him and grant him peace; had told him to do that. Then he drew back until he was in the row; and the Messenger of Allah; may Allah bless him and grant him peace; stepped forward and led the prayer. When he had finished he said; Abu Bakr; what stopped you from staying put like I told you? Abu Bakr said; It is not for Ibn Abi Quhafa to pray in front of the Messenger of Allah; may Allah bless him and grant him peace. The Messenger of Allah; may Allah bless him and grant him peace; said; Why did I see you all clapping so much? If something happens to you in the prayer you should say Subhana-llah Glory be to Allah ; and when you say Subhana-llah you will be heard. MuwataMalik-017-001-34665 | Yahya related to me from Malik from Zayd Ibn Abi Unaysa that Abd AlHamid Ibn Abdulrahman Ibn Zayd Ibn AlKhattab informed him from Muslim Ibn Yasar AlJuhani that Umar Ibn AlKhattab was asked about this ayat - When your Lord took their progeny from the Banu Adam from their backs and made them testify against themselves. Am I not your Lord? They said; Yes; we bear witness Lest you should say on the Day of Rising; We were heedless of that. Surat 7 ayat 172 Umar Ibn AlKhattab said; I heard the Messenger of Allah; may Allah bless him and grant him peace; being asked about it. The Messenger of Allah; may Allah bless him and grant him peace; said; Allah; the Blessed; the Exalted; created Adam. Then He stroked his back with His right hand; and progeny issued from it. He said; I created these for the Garden and they will act with the behaviour of the people of the Garden. Then He stroked his back again and brought forth progeny from him. He said; I created these for the Fire and they will act with the behaviour of the people of the Fire. A man said; Messenger of Allah! Then of what value are deeds? The Messenger of Allah; may Allah bless him and grant him peace; answered; When Allah creates a slave for the Garden; he makes him use the behaviour of the people of the Garden; so that he dies on one of the actions of the people of the Garden and by it He brings him into the Garden. When He creates a slave for the Fire; He makes him use the behaviour of the people of the Fire; so that he dies on one of the actions of the people of the Fire; and by it; He brings him into the Fire. | The Chapter on Good Deeds To Save Oneself From Hell Fire in HodHood Indexing, The Book of Purity in Muwata Malik
MuwataMalik-017-001-34742 | Yahya said from Malik from Yahya Ibn Said that Bushayr Ibn Yasar informed him that Abdullah Ibn Sahl AlAnsari and Muhayisa Ibn Masud went out to Khaybar; and they separated on their various businesses and Abdullah Ibn Sahl was killed. Muhayisa; and his brother Huwayisa and Abdulrahman Ibn Sahl went to the Prophet; may Allah bless him and grant him peace; and Abdulrahman began to speak before his brother. The Messenger of Allah; may Allah bless him and grant him peace; said; The older first; the older first. Therefore Huwayisa and then Muhayisa spoke and mentioned the affair of Abdullah Ibn Sahl. The Messenger of Allah; may Allah bless him and grant him peace; said to them; Do you swear with fifty oaths and claim the blood-money of your companion or the life of the murderer? They said; Messenger of Allah; we did not see it and we were not present. The Messenger of Allah; may Allah bless him and grant him peace; said; Will you acquit the jews for fifty oaths? They said; Messenger of Allah; how can we accept the oaths of a people who are kafirun? Yahya Ibn Said said; Bushayr Ibn Yasar claimed that the Messenger of Allah; may Allah bless him and grant him peace; paid the blood-money from his own property. Malik said; The generally agreed on way of doing things in our community and that which I heard from whoever I am content with; concerning the oath of qasama; and upon which the past and present imams agree; is that those who claim revenge begin with the oaths and swear. The oath for revenge is only obligatory in two situations. Either the slain person says; My blood is against so-and-so; or the relatives entitled to the blood bring a partial proof of it that is not irrefutable against the one who is the object of the blood-claim. This obliges taking an oath on the part of those who claim the blood against those who are the object of the blood-claim. With us; swearing is only obliged in these two situations. Malik said; That is the sunna in which there is no dispute with us and which is still the behaviour of the people. The people who claim blood begin the swearings; whether it is an intentional killing or an accident. Malik said; The Messenger of Allah; may Allah bless him and grant him peace; began with Banu Harith in the case of the killing of their kinsman murdered at Khaybar. Malik said; If those who make the claim swear; they deserve the blood of their kinsman and whoever they swear against is slain. Only one man can be killed in the qasama. Two cannot be killed in it. Fifty men from the blood-relatives must swear fifty oaths. If their number is less or some of them draw back; they can repeat their oaths; unless one of the relatives of the murdered man who deserves blood and who is permitted to pardon it; draws back. If one of these draws back; there is no way to revenge. Yahya said that Malik said; The oaths can be made by those of them who remain if one of them draws back who is not permitted to pardon. If one of the blood-relatives draws back who is permitted to pardon; even if he is only one; more oaths can not be made after that by the blood- relatives. If that occurs; the oaths can be on behalf of the one against whom the claim is made. So fifty of the men of his people swear fifty oaths. If there are not fifty men; more oaths can be made by those of them who already swore. If there is only the defendant; he swears fifty oaths and is acquitted. Yahya said that Malik said; One distinguishes between swearing for blood and oaths for one rights. When a man has a money-claim against another man; he seeks to verify his due. When a man wants to kill another man; he does not kill him in the midst of people. He keeps to a place away from people. Had there only been swearing in cases where there is a clear proof and had one acted in it as one acts about one rights i.e. needing witnesses ; the right of blood retribution would have been lost and people would have been swift to take advantage of it when they learned of the decision on it. However; the relatives of the murdered man were allowed to initiate swearing so that people might restrain themselves from blood and the murderer might beware lest he was put into a situation like that i.e. qasama by the statement of the murdered man. Yahya said; Malik said about a people of whom a certain number are suspected of murder and the relatives of the murdered man ask them to take oaths and they are numerous; so they ask that each man swears fifty oaths on his own behalf. The oaths are not divided out between them according to their number and they are not acquitted unless each man among them swears fifty oaths on his own behalf. Malik said; This is the best I have heard about the matter. He said; Swearing goes to the paternal relatives of the slain. They are the blood-relatives who swear against the killer and by whose swearing he is killed. | The Chapter on Oath And Jews In Crimes And Felonies in HodHood Indexing, The Book of Purity in Muwata Malik
MuwataMalik-017-001-34894 | Malik related to me from Yahya Ibn Said that Abud-Darda wrote to Salman AlFarsi; Come immediately to the holy land. Salman wrote back to him; Land does not make anyone holy. Man deeds make him holy. I have heard that you were put up as a doctor to treat and cure people. If you are innocent; then may you have delight! If you are a quack; then beware lest you kill a man and enter the Fire! When Abud-Darda judged between two men; and they turned from him to go; he would look at them and say; Come back to me; and tell me your story again. A quack! By Allah! Yahya said that he heard Malik say; If someone makes use of a slave; without permission of its master; in anything important to him; whose like has a fee; he is liable for what befalls the slave if anything befalls him. If the slave is safe and his master asks for his wage for what he has done; that is the master right. This is what is done in our community. Yahya said that he heard Malik say about a slave who is part free and part enslaved; His property is suspended in his hand and he cannot begin anything with it. He eats from it and clothes himself in an approved fashion. If he dies; his property belongs to the one to whom he is in slavery. Yahya said that he heard Malik say; The way of doing things in our community is that a parent can take his child to account for what he spends on him from the day the child has property; cash or goods; if the parent wants that. | The Chapter on Slave As A Property in HodHood Indexing, The Book of Hair in Muwata Malik
MuwataMalik-017-001-34956 | Yahya said that he heard Malik say; The way of doing things in our community about which there is no dispute; is that if a man gives sadaqa to his son - sadaqa which the son takes possession of or which is in the father keeping and the father has had his sadaqa witnessed; he cannot take back any of it because he cannot reclaim any sadaqa. Yahya said that he heard Malik say; The generally agreed-on way of doing things in our community in the case of someone who gives his son a gift or grants him a gift which is not sadaqa is that he can take it back as long as the child does not start a debt; which people claim from him; and which they trust him for on the strength of the gift his father has given him. The father cannot take back anything from the gift after debts are started against it. If a man gives his son or daughter something and a woman marries the man; and she only marries him for the wealth and the property which his father has given him and so the father wants to take that back; or; if a man marries a woman whose father has given her a gift and he marries her with an increased bride-price because of the wealth and property that her father has given; then the father says; I will take that back; then the father cannot take back any of that from the son or daughter if it is as I have described to you. | The Chapter on Charity To Brothers And Mother in HodHood Indexing, The Book of The Description of the Prophet may Allah Bless Him and Grant Him Peace in Muwata Malik
MuwataMalik-017-001-35058 | Malik said; There is no harm in buying dates from specified trees or a specified orchard or buying milk from specified sheep when the buyer starts to take them as soon as he has payed the price. That is like buying oil from a container. A man buys some of it for a dinar or two and gives his gold and stipulates that it be measured out for him. There is no harm in that. If the container breaks and the oil is wasted; the buyer has his gold back and there is no transaction between them. Malik said; There is no harm in everything which is taken right away as it is; like fresh milk and fresh picked dates which the buyer can take on a day-to-day basis. If the supply runs out before the buyer has what he has paid for in full; the seller gives him back the portion of the gold that is owed to him; or else the buyer takes other goods from him to the value of what he is owed and which they mutually agree about. The buyer should stay with the seller until he has taken it. It is disapproved of for the seller to leave because the transaction would then come into the forbidden category of a debt for a debt. If a stated time period for payment or delivery enters into the transaction; it is also disapproved. Delay and deferment are not permitted in it; and are only acceptable when it is standard practice on definite terms by which the seller guarantees it to the buyer; but this is not to be from one specific orchard or from any specific ewes. Malik was asked about a man who bought an orchard from another man in which there were various types of palm-trees - excellent ajwa palms; good kabis palms; adhq palms and othertypes. The seller kept Aasi de from the sale the produce of a certain palm of his choice. Malik said; That is not good because if he does that; and keeps Aasi de; for instance; dates of the ajwa variety whose yield would be 15 sa; and he picks the dates of the kabis in their place; and the yield of their dates is 10 sa or he picks the ajwa which yield 15 sa and leaves the kabis which yield 10 sa; it is as if he bought the ajwa for the kabis making allowances for their difference of quality. This is the same as if a man dealing with a man who has heaps of dates before him - a heap of 15 sa of ajwa; a heap of 10 sa of kabis; and a heap of 12 sa of cadhq; gives the owner of the dates a dinar to let him choose and take whichever of the heaps he likes. Malik said; That is not good. Malik was asked what a man who bought fresh dates from the owner of an orchard and advanced him a dinar was entitled to if the crop was spoilt. Malik said; The buyer makes a reckoning with the owner of the orchard and takes what is due to him of the dinar. If the buyer has taken two-thirds of a dinar worth of dates; he gets back the third of a dinar which is owed him. If the buyer has taken three-quarters of a dinar worth of dates; then he gets back the quarter which is owed to him; or they come to a mutual agreement; and the buyer takes what is owed him from his dinar from the owner of the orchard in something else of his choosing. If; for instance; he prefers to take dry dates or some other goods; he takes them according to what is due. If he takes dry dates or some other goods; he should stay with him until he has been paid in full. Malik said; This is the same situation as hiring out a specified riding-camel or hiring out a slave tailor; carpenter or some other kind of worker or letting a house and taking payment in advance for the hire of the slave or the rent of the house or camel. Then an accident happens to what has been hired resulting in death or something else. The owner of the camel; slave or house returns what remains of the rent of the camel; the hire of the slave or the rent of the house to the one who advanced him the money; and the owner reckons what will settle that up in full. If; for instance; he has provided half of what the man paid for; he returns the remaining half of what he advanced; or according to whatever amount is due. Malik said; Paying in advance for something which is on hand is only good when the buyer takes possession of what he has paid for as soon as he hands over the gold; whether it be slave; camel; or house; or in the case of dates; he starts to pick them as soon as he has paid the money. It is not good that there be any deferment or credit in such a transaction. Malik said; An example illustrating what is disapproved of in this situation is that; for instance; a man may say that he will pay someone in advance for the use of his camel to ride in the hajj; and the hajj is still some time off; or he may say something similar to that about a slave or a house. When he does that; he only pays the money in advance on the understanding that if he finds the camel to be sound at the time the hire is due to begin; he will take it by virtue of what he has already paid. If an accident; or death; or something happens to the camel; then he will get his money back and the money he paid in advance will be considered as a loan. Malik said; This is distinct from someone who takes immediate possession of what he rents or hires; so that it does not fall into the category of uncertainty; or disapproved payment in advance. That is following a common practice. An example of that is that a man buys a slave; or slave-girl; and takes possession of them and pays their price. If something happens to them within the period of the year indemnification contract; he takes his gold back from the one from whom he bought it. There is no harm in that. This is the precedent of the sunna in the matter of selling slaves. Malik said; Someone who rents a specified slave; or hires a specified camel; for a future date; at which time he will take possession of the camel or slave; has not acted properly because he did not take possession of what he rented or hired; nor is he advancing a loan which the person is responsible to pay back. | The Chapter on Financial Transactions And Gold in HodHood Indexing, The Book of Madina in Muwata Malik
MuwataMalik-017-001-35071 | Yahya related to me from Malik from Ibn Shihab from Malik Ibn Aus Ibn AlHadathan AlNasri that one time he asked to exchange 100 dinars. He said; Talha Ibn Ubaydullah called me over and we made a mutual agreement that he would make an exchange for me. He took the gold and turned it about in his hand; and then said; I cant do it until my treasurer brings the money to me from AlGhaba. Umar Ibn AlKhattab was listening and Umar said; By Allah! Do not leave him until you have taken it from him! Then he said; The Messenger of Allah; may Allah bless him and grant him peace; said; Gold for silver is usury except hand to hand. Wheat for wheat is usury except hand to hand. Dates for dates is usury except hand to hand. Barley for barley is usury except hand to hand. Malik said; When a man buys dirhams with dinars and then finds a bad dirham among them and wants to return it; the exchange of the dinars breaks down; and he returns the silver and takes back his dinars. The explanation of what is disapproved of in that is that the Messenger of Allah; may Allah bless him and grant him peace; said; Gold for silver is usury except hand to hand. and Umar Ibn AlKhattab said; If someone asks you to wait to be paid until he has gone back to his house; do not leave him. When he returns a dirham to him from the exchange after he has left him; it is like a debt or something deferred. For that reason; it is disapproved of; and the exchange collapses. Umar Ibn AlKhattab wanted that all gold; silver and food should not be sold for goods to be paid later. He did not want there to be any delay or deferment in any such sale; whether it involved one commodity or different sorts of commodities. | The Chapter on Financial Transaction And Food in HodHood Indexing, The Book of Drinks in Muwata Malik
MuwataMalik-017-001-35087 | Yahya related to me from Malik that he had heard that Muhammad Seereen used to say; Do not sell grain on the ears until it is white. Malik said; If someone buys food for a known price to be delivered at a stated date; and when the date comes; the one who owes the food says; I do not have any food; sell me the food which I owe you with delayed terms. The owner of the food says; This is not good; because the Messenger of Allah; may Allah bless him and grant him peace; forbade selling food until the deal was completed. The one who owes the food says to his creditor; Sell me any kind of food on delayed terms until I discharge the debt to you. This is not good because he gives him food and then he returns it to him. The gold which he gave him becomes the price of that which is his right against him and the food which he gave him becomes what clears what is between them. If they do that; it becomes the sale of food before the deal is complete. Malik spoke about a man who was owed food which he had purchased from a man and this man was owed the like of that food by another man. The one who owed the food said to his creditor; I will refer you to my debtor who owes me the same amount of food as I owe you; so that you may obtain the food which I owe you. Malik said; If the man who had to deliver the food; had gone out; and bought the food to pay off his creditor; that is not good. That is selling food before taking possession of it. If the food is an advance which falls due at that particular time; there is no harm in paying off his creditor with it because that is nota sale. It is not halal to sell food before receiving it in full since the Messenger of Allah; may Allah bless him and grant him peace; forbade that. However; the people of knowledge agree that there is no harm in partnership; transfer of responsibility and revocation in sales of food and other goods. Malik said; That is because the people of knowledge consider it as a favour rendered. They do not consider it as a sale. It is like a man lending light dirhams. He is then paid back in dirhams of full weight; and so gets back more than he lent. That is halal for him and permitted. Had a man bought defective dirhams from him as being the full weight; that would not be halal. Had it been stipulated to him that he lend full weight in dirhams; and then he gave faulty ones; that would not be halal for him. | The Chapter on Financial Transaction And Food in HodHood Indexing, The Book of Drinks in Muwata Malik
MuwataMalik-017-001-35242 | Yahya related to me from Malik from Yahya Ibn Said from Said Ibn AlMusayab that Umar Ibn AlKhattab said; The woman who loses her husband and does not know where he is; waits for four years; then she does idda for four months; and then she is free to marry. Malik said; If she marries after her idda is over; regardless of whether the new husband has consummated the marriage or not; her first husband has no means of access to her. Malik said; That is what is done among us and if her husband reaches her before she has remarried; he is more entitled to her. Malik said that he had seen people disapproving of someone who said that one of the people of knowledge attributed to Umar Ibn AlKhattab that he said; Her first husband chooses when he comes either her bride-price or his wife. Malik said; I have heard that Umar Ibn AlKhattab; speaking about a woman whose husband divorced her while he was absent from her; and then he took her back and the news of his taking her back had not reached her; while the news of his divorcing her had; and so she had married again; said; Her first husband who divorced her has no means of access to her whether or not the new husband has consummated the marriage. Malik said; This is what I like the best of what I heard about the missing man. | The Chapter on Marriage And Entitlements in HodHood Indexing, The Book of The Mudabbar in Muwata Malik
MuwataMalik-017-001-35425 | Malik said; I do not see that there is any harm in the Muslims eating whatever food they come across in enemy territory before the spoils are divided. Malik said; I think that any camels; cattle and sheep taken as booty are considered as food which the Muslims can eat in enemy territory. If they could not be eaten until the people had gathered for the division and the spoils had been distributed among them; that would be harmful for the army. I do not see any objection to eating such things within acceptable limits. I do not think; however; that anyone should store up any of it to take back to his family. Malik was asked whether it was proper for a man who obtained food in enemy territory and ate some of it and made provision so that there was some of it left over to keep and eat with his family; or to sell before he had come to his country and make use of its price. He said; If he sells it while he is on a military expedition; I think that he should put its price into the booty of the Muslims. If he takes it back to his country; I see no objection to his eating it and using it if it is a small insignificant thing. | The Chapter on Almaghazi And Killing The Enemies And Pagans in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35426 | Yahya related to me from Malik that it reached him that a slave of Abdullah Ibn Umar escaped and one of his horses wandered off; and the idol worshippers seized them. Then the Muslims recaptured them; and they were returned to Abdullah Ibn Umar; before the division of the spoils took place. I heard Malik say about muslim property that had been seized by the enemy; If it is noticed before the distribution; then it is returned to itsowner. Whatever has already been distributed is not returned to anyone. Malik; when asked about a man whose young male slave was taken by the idol worshippers and then the Muslims re-captured him; said; The owner is more entitled to him without having to pay his price or value or having to incur any loss before the distribution takes place. If the distribution has already taken place then I think that the slave belongs to his master for his price if the master wants him back. Regarding an umm walad of a Muslim man who has been taken by the idol worshippers and then recaptured by the Muslims and allotted in the distribution of spoils and then recognised by her master after the distribution; Malik said; She is not to be enslaved. I think that the Imam should pay a ransom for her for her master. If he does not do it; then her master must pay a ransom for her and not leave her. I do not think that she should be made a slave by whoever takes her and intercourse with her is not halal. She is in the position of a free woman because her master would be required to pay compensation if she injured somebody and so she is in the same position as a wife. He must not leave the mother of his son to be enslaved nor may intercourse with her be made halal. Malik was asked about a man who went to enemy territory to pay ransom or to trade; and he bought a free man or a slave; or they were given to him. He said; As for the free man; the price he buys him for is a debt against the man and he is not made a slave. If the captive is given to him freely; he is free and owes nothing unless the man gave something in recompense for him. That is a debt against the free man; the same as if a ransom had been paid for him. As for a slave; his former master can choose to take him back and pay his price to the man who bought him or he can choose to leave him; as he wishes. If he was given to the man; the former master is more entitled to him; and he owes nothing for him unless the man gave something for him in recompense. Whatever he gave for him is a loss against the master if he wants him back. | The Chapter on Slaves And Praise And Worship in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35431 | Yahya related to me from Malik from Abdulrahman Ibn Said from Amr Ibn Shuayb that when the Messenger of Allah; may Allah bless him and grant him peace; came back from Hunayn heading for AlJiirrana; the people crowded around so much to question him that his camel backed into a tree; which became entangled in his cloak and pulled it off his back. The Messenger of Allah; may Allah bless him and grant him peace; said; Return my cloak to me. Are you afraid that I will not distribute among you what Allah has given you as spoils. By He in whose hand my self is! Had Allah given you spoils equal to the number of acacia trees on the plain of Tihama; I would have distributed it among you. You will not find me to be miserly; cowardly; or a liar. Then the Messenger of Allah; may Allah bless him and grant him peace; got down and stood among the people; and said; Hand over even the needle and thread; for stealing from the spoils is disgrace; fire; ignominy on the Day of Rising for people who do it. Then he took a bit of camel fluff or something from the ground and said; By He in whose hand my self is! What Allah has made spoils for you is not mine - even the like of this! - except for the tax of one fifth; and the tax of one fifth is returned to you. | The Chapter on Almaghazi And Camels in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35469 | Malik was asked whether someone who went into a Masjid to do itikaf for the last ten days of Ramadan and stayed there for a day or two but then became ill and left the Masjid; had to do itikaf for the number of days that were left from the ten; or not; and if he did have to do so; then what month should he do it in; and he replied; He should make up whatever he has to do of the itikaf when he recovers; whether in Ramadan or otherwise. I have heard that the Messenger of Allah; may Allah bless him and grant him peace; once wanted to do itikaf in Ramadan; but then came back without having done so; and then when Ramadan had gone; he did itikaf for ten days in Shawal. Some one who does itikaf voluntarily in Ramadan and some one who has to do itikaf are in the same position regarding what is halal for them and what is haram. I have not heard that the Messenger of Allah; may Allah bless him and grant him peace; ever did itikaf other than voluntarily. Malik said; that if a woman did itikaf and then menstruated during her itikaf; she went back to her house; and; when she was pure again she returned to the Masjid; at whatever time it was that she became pure. She then continued her itikaf from where she left off. This was the same situation as with a woman who had to fast two consecutive months; and who menstruated and then became pure. She then continued the fast from where she had left off and did not delay doing so. | The Chapter on Ramadan And Fasting And Deeds in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35493 | Yahya related to me from Malik from Zayd Ibn Aslam from Ata Ibn Yasar that a certain man kissed his wife while he was fasting in Ramadan. This made him very anxious; and so he sent his wife to the Prophet; may Allah bless him and grant him peace; to ask him about that for him. She went in and saw Umm Salamah; the wife of the Prophet; may Allah bless him and grant him peace; and mentioned the matter to her; and Umm Salamah told her that the Messenger of Allah; may Allah bless him and grant him peace; used to kiss while he was fasting. So she went back and told her husband that; but it only made him find fault all the more and he said; We are not like the Messenger of Allah; may Allah bless him and grant him peace. Allah makes permissible for the Messenger of Allah; may Allah bless him and grant him peace; whatever He wishes. His wife then went back to Umm Salamah and found the Messenger of Allah; may Allah bless him and grant him peace; with her. The Messenger of Allah; may Allah bless him and grant him peace; said; What the matter with this woman?; and Umm Salamah told him. The Messenger of Allah; may Allah bless him and grant him peace; said; Didnt you tell her that I do that myself? and she said; I told her; and she went to her husband and told him; but it only made him find fault all the more and say; We are not like the Messenger of Allah; may Allah bless him and grant him peace. Allah makes permissible for His Messenger; may Allah bless him and grant him peace; whatever He wishes. The Messenger of Allah; may Allah bless him and grant him peace; got angry and said; By Allah; I am the one with the most taqwa of Allah of you all; and of you all the one who best knows His limits. | The Chapter on Peace And Makkah in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35566 | Yahya related to me from Malik from Yazid Ibn Khusayfa that he had asked Sulayman Ibn Yasar whether zakat was due from a man who had wealth in hand but also owed a debt for the same amount; and he replied; No. Malik said; The position that we are agreed upon concerning a debt is that the lender of it does not pay zakat on it until he gets it back. Even if it stays with the borrower for a number of years before the lender collects it; the lender only has to pay zakat on it once. If he collects an amount of the debt which is not zakatable; and has other wealth which is zakatable; then what he has collected of the debt is added to the rest of his wealth and he pays zakat on the total sum. Malik continued; If he has no ready money other than that which he has collected from his debt; and that does not reach a zakatable amount; then he does not have to pay any zakat. He must; however; keep a record of the amount that he has collected and if; later; he collects another amount which; when added to what he has already collected; brings zakat into effect; then he has to pay zakat on it. Malik continued; Zakat is due on this first amount; together with what he has further collected of the debt owed to him; regardless of whether or not he has used up what he first collected. If what he takes back reaches twenty dinars of gold; or two hundred dirhams of silver he pays zakat on it. He pays zakat on anything else he takes back afte rthat; whether it be a large or small amount; according to the amount. Malik said; What shows that zakat is only taken once from a debt which is out of hand for some years before it is recovered is that if goods remain with a man for trading purposes for some years before he sells them; he only has to pay zakat on their prices once. This is because the one who is owed the debt; or owns the goods; should not have to take the zakat on the debt; or the goods; from anything else; since the zakat on anything is only taken from the thing itself; and not from anything else. Malik said; Our position regarding some onewho owes a debt; and has goods which are worth enough to pay off the debt; and also has an amount of ready money which is zakatable; is that he pays the zakat on the ready money which he has to hand. If; however; he only has enough goods and ready money to pay off the debt; then he does not have to pay any zakat. But if the ready money that he has reaches a zakatable amount over and above the amount of the debt that he owes; then he must pay zakat on it. | The Chapter on Debt And Creditors And Paying Zakat in HodHood Indexing, The Book of Itikaf in Ramadan in Muwata Malik
MuwataMalik-017-001-35587 | Yahya related to me from Malik from Ibn Shihab from Sulayman Ibn Yasar that the people of Syria said to Abu Ubayda Ibn AlJarrah; Take zakat from our horses and slaves; and he refused. Then he wrote to Umar Ibn AlKhattab and he also refused. Again they talked to him and again he wrote to Umar; and Umar wrote back to him saying; If they want; take it from them and then give it back to them and give their slaves provision. MuwataMalik-017-001-35598 | Yahya related to me from Zayd Ibn Aslam that his father said that he had heard Umar Ibn AlKhattab say; I once gave a noble horse to carry somebody in the way of Allah; and the man neglected it. I wished to buy it back from him and I thought that he would sell it cheaply. I asked the Messenger of Allah; may Allah bless him and grant him peace; about it and he said; Do not buy it; even if he gives it to you for one dirham; for someone who takes back his sadaqa is like a dog swallowing its own vomit. | The Chapter on The Choice Of Gifts in HodHood Indexing, The Book of Hajj in Muwata Malik

Malik said that someone who prayed a raka with the imam on the day of jumua; then had a nosebleed and left and came back and the imam had prayed both rakas; should complete the prayer with another raka as long as he had not spoken. MuwataMalik-017-001-35783 | Yahya related to me from Malik; from Hisham Ibn Urwa; that Abdullah Ibn AlZubair stayed in Makka for nine years. He would go into ihram for hajj at the beginning of Dhu AlHijja; and Urwa Ibn AlZubayr; who was with him; would do likewise. Yahya said that Malik said; The people of Makka and whoever else is living there besides them should go into ihram for hajj if they are in Makka; and anyone that is living in the centre of Makka and is not one of the people of Makka should not leave the Haram. Yahya said that Malik said; Someone who goes into ihram for hajj in Makka should delay tawaf of the House and the say between Safa and Marwa until he has come back from Mina; which is what Abdullah Ibn Umar used to do. Malik was asked what the people of Madina; or anybody else; should do about tawaf if they went into ihram in Makka at the beginning of Dhu AlHijja; and he said; They should delay the obligatory tawaf; which is the one they combine with the say between Safa and Marwa; but they can do whatever other tawaf they want to; and they should pray two rakas every time they complete seven tawafs; which is what the companions of the Messenger of Allah; may Allah bless him and grant him peace; did when they had gone into ihram to do hajj. They delayed the tawaf of the House and the say between Safa and Marwa until they had come back from Mina. Abdullah Ibn Umar also did this; going into ihram for hajj in Makka at the beginning of Dhu AlHijja; and then delaying tawaf of theHouse and the say between Safa and Marwa until he had come back from Mina. Malik was asked whether one of the people of Makka could go into ihram to do umra in the centre of Makka; and he said; No. He should go outside the Haram and go into ihram there. | The Chapter on Makkah And Alhajj in HodHood Indexing, The Book of Hajj in Muwata Malik
