SahihAlBukhari-017-001-1418Narrated Abu Huraira: When Allah Messenger ﷺ died and Abu Bakr was elected as a Caliph after him; some of the Arabs reverted to disbelief; Umar said to Abu Bakr; How dare you fight the people while Allah Messenger ﷺ said; I have been ordered to fight the people till they say None has the right to be worshipped but Allah And whoever says: None has the right to be worshipped but Allah. waves his wealth and his life from me unless he deserves a legal punishment lusty; and his account will be with Allah! Abu Bakr said; By Allah; I will fight him who discriminates between Zakat and prayers; for Zakat is the Compulsory right to be taken from the wealth By Allah; if they refuse to give me even a tying rope which they use to give to Allah Messenger ﷺ ; I would fight them for withholding it. Umar said; By Allah; It was nothing; except I saw that Allah had opened the chest of Abu Bakr to the fight; and I came to know for certain that was the truth. The Chapter on Fornication And Adultery And Theft in HodHood Indexing, Chapter on Following the Sunna of the Prophet in Sahih AlBukhari

Allah Messenger ﷺ performed ablution and poured the Remaining water of his ablution over me whereupon I became conscious and said; O Allah Messenger ﷺ ! How should I spend my wealth? The rich people have got the highest degrees of prestige and the permanent pleasures in this life and the life to come in the Hereafter. He said; How is that? They said; The rich pray as we pray; and strive in Allah Cause as we do; and spend from their surplus wealth in charity; while we have no wealth to spend likewise. He said; Shall I not tell you a thing; by doing which; you will catch up with those who are ahead of you and supersede those who will come after you; and nobody will be able to do such a good deed as you do except the one who does the same deed as you do. That deed is to recite Subhan Allah ten times; and AlHamduli Allah ten times; and AllahuAkbar ten times after every prayer. The Chapter on Wealth And Deeds in HodHood Indexing, Chapter on The invocation after the Salat in Sahih AlBukhari
SahihAlBukhari-017-001-2128Narrated Abu Saeed AlKhudri: Allah Messenger ﷺ said; The thing I am afraid of most for your sake; is the worldly blessings which Allah will bring forth to you. It was said; What are the blessings of this world? The Prophet ﷺ said; The pleasures of the world. A man said; Can the good bring forth evil? The Prophet ﷺ kept quiet for a while till we thought that he was being inspired divinely. Then he started removing the sweat from his forehead and said; Where is the questioner? That man said; I am present. Abu Saeed added: We thanked the man when the result of his question was such. The Prophet ﷺ said; Good never brings forth but good. This wealth of the world is like green and sweet fruit ; and all the vegetation which grows on the bank of a stream either kills or nearly kills the animal that eats too much of it; except the animal that eats the Khadira a kind of vegetation. Such an animal eats till its stomach is full and then it faces the sun and starts ruminating and then it passes out dung and urine and goes to eat again. This worldly wealth is like sweet fruit ; and if a person earns it the wealth in a legal way and spends it properly; then it is an excellent helper; and whoever earns it in an illegal way; he will be like the one who eats but is never satisfied. The Chapter on Wealth And Satisfaction in HodHood Indexing, Chapter on The warning regarding worldly pleasures amusements and competing against each other in Sahih AlBukhari

SahihAlBukhari-017-001-3484Narrated Urwa: that he asked Aisha regarding the Verse: If you fear that you shall not be able to deal justly with the orphans 4.3 She said; O my nephew! This Verse refers to the orphan girl who is under the guardianship of her guardian who likes her beauty and wealth and wishes to marry her and curtails her Mahr. Such guardians have been forbidden to marry them unless they do justice by giving them their full Mahr; and they have been ordered to marry other than them. The people asked for the verdict of Allah Messenger ﷺ after that; so Allah revealed: They ask your instruction concerning the women... whom you desire to marry. 4.127 So Allah revealed to them that if the orphan girl had beauty and wealth; they desired to marry her and for her family status. They can only marry them if they give them their full Mahr. And if they had no desire to marry them because of their lack of wealth and beauty; they would leave them and marry other women. So; as they used to leave them; when they had no interest; in them; they were forbidden to marry them when they had such interest; unless they treated them justly and gave them their full Mahr Apostle said; If at all there is evil omen; it is in the horse; the woman and the house. a lady is to be warded off. And the Statement of Allah: Truly; among your wives and your children; there are enemies for you i.e may stop you from the obedience of Allah 64.14The Chapter on Contracts And Disputes And Orphans in HodHood Indexing, Chapter on The marriage of a poor man with a wel Altodo lady in Sahih AlBukhari
SahihAlBukhari-017-001-4018Narrated Khaula AlAnsariya: I heard Allah Messenger ﷺ saying; Some people spend Allah Wealth i.e. Muslim wealth in an unjust manner; such people will be put in the Hell Fire on the Day of Resurrection. The Chapter on Wealth And Zakat in HodHood Indexing, Chapter on The Statement of Allah Taala Verily onefifth of it is assigned to Allah and to the Messenger in Sahih AlBukhari
SahihAlBukhari-017-001-4080Narrated AlZuhri: Urwa Bin AlZubair said that he asked Aisha about the meaning of the Quranic Verse:- And if you fear that you will not deal fairly with the orphan girls then marry other women of your choice. 4.2-3 Aisha said; It is about a female orphan under the guardianship of her guardian who is inclined towards her because of her beauty and wealth; and likes to marry her with a Mahr less than what is given to women of her standard. So they i.e. guardians were forbidden to marry the orphans unless they paid them a full appropriate Mahr otherwise they were ordered to marry other women instead of them. Later on the people asked Allah Messenger ﷺ about it. So Allah revealed the following Verse:- They ask your instruction O Muhammad! regarding women. Say: Allah instructs you regarding them... 4.127 and in this Verse Allah indicated that if the orphan girl was beautiful and wealthy; her guardian would have the desire to marry her without giving her an appropriate Mahr equal to what her peers could get; but if she was undesirable for lack of beauty or wealth; then he would not marry her; but seek to marry some other woman instead of her. So; since he did not marry her when he had no inclination towards her; he had not the right to marry her when he had an interest in her; unless he treated her justly by giving her a full Mahr and securing all her rights. The Chapter on Contracts And Disputes And Orphans in HodHood Indexing, Chapter on The Statement of Allah Taala And if you fear that you shall not be able to deal justly with the orphangirls in Sahih AlBukhari
SahihAlBukhari-017-001-4086Narrated Anas Bin Malik: Abu Talha had the greatest wealth of date-palms amongst the Ansar in Medina; and he prized above all his wealth his garden Bairuha; which was situated opposite the Masjid of the Prophet ﷺ. The Prophet used to enter It and drink from its fresh water. When the following Divine Verse came:- By no means shall you attain piety until you spend of what you love; 3.92 Abu Talha got up saying. O Allah Messenger ﷺ ! Allah says; You will not attain piety until you spend of what you love; and I prize above AlI my wealth; Bairuha which I want to give in charity for Allah Sake; hoping for its reward from Allah. So you can use it as Allah directs you. On that the Prophet ﷺ said; Bravo! It is a profitable or perishable property. Ibn Maslama is not sure as to which word is right; i.e. profitable or perishable. I have heard what you have said; and I recommend that you distribute this amongst your relatives. On that Abu Talha said; O Allah Messenger ﷺ ! I will do as you have suggested. So; Abu Talha distributed that garden amongst his relatives and cousins. The Chapter on Wealth And Spending in HodHood Indexing, Chapter on If somebody gives a piece of land as an endowment and does not mark its boundaries in Sahih AlBukhari
SahihAlBukhari-017-001-4515Narrated Abu Saeed AlKhudri: Allah Messenger ﷺ ascended the pulpit and said; Nothing worries me as to what will happen to you after me; except the temptation of worldly blessings which will be conferred on you. Then he mentioned the worldly pleasures. He started with the one i.e. the blessings and took up the other i.e. the pleasures. A man got up saying; O Allah Messenger ﷺ ! Can the good bring about evil? The Prophet ﷺ remained silent and we thought that he was being inspired divinely; so all the people kept silent with awe. Then the Prophet ﷺ wiped the sweat off his face and asked; Where is the present questioner? Do you think wealth is good? he repeated thrice; adding; No doubt; good produces nothing but good. Indeed it is like what grows on the banks of a stream which either kills or nearly kills the grazing animals because of gluttony except the vegetation-eating animal which eats till both its flanks are full i.e. till it gets satisfied and then stands in the sun and defecates and urinates and again starts grazing. This worldly property is sweet vegetation. How excellent the wealth of the Muslim is; if it is collected through legal means and is spent in Allah Cause and on orphans; poor people and travelers. But he who does not take it legally is like an eater who is never satisfied and his wealth will be a witness against him on the Day of Resurrection. The Chapter on Wealth And Satisfaction in HodHood Indexing, Chapter on The Superiority of spending in Allah Cause in Sahih AlBukhari
SahihAlBukhari-017-001-4989Narrated Anas Bin Malik: Abu Talha was the richest man in Medina amongst the Ansar and Beeruha garden was the most beloved of his property; and it was situated opposite the Masjid of the Prophet.. Allah Messenger ﷺ used to enter it and drink from its sweet water. When the following Divine Verse were revealed: you will not attain righteousness till you spend in charity of the things you love 3.92 ; Abu Talha got up in front of Allah Messenger ﷺ and said; O Allah Messenger ﷺ ! Allah says in His Book; You will not attain righteousness unless you spend in charity that which you love; and verily; the most beloved to me of my property is Beeruha garden ; so I give it in charity and hope for its reward from Allah. O Allah Apostle! Spend it wherever you like. Allah Messenger ﷺ appreciated that and said; That is perishable wealth; that is perishable wealth. I have heard what you have said; I suggest you to distribute it among your relatives. Abu Talha said; I will do so; O Allah Messenger ﷺ. So; Abu Talha distributed it among his relatives and cousins. They said; No. So; he led his funeral prayer. Another dead man was brought and the people said; O Allah Messenger ﷺ ! Lead his funeral prayer. The Prophet ﷺ said; Is he in debt? They said; Yes. He said; Has he left any wealth? They said; Three Dinars. So; he led the prayer. Then a third dead man was brought and the people said to the Prophet ﷺ ; Please lead his funeral prayer. He said; Has he left any wealth? They said; No. He asked; Is he in debt? They said; Yes! He has to pay three Diners.; He refused to pray and said; Then pray for your dead companion. He said to me ; I will not pay you unless you disbelieve Muhammad. I said; I will not disbelieve till Allah kills you and then you get resurrected. He said; Leave me till I die and get resurrected; then I will be given wealth and children and I will pay you your debt. On that occasion it was revealed to the Prophet: Have you seen him who disbelieved in Our signs and says: Surely I will be given wealth and children? After saying that; the person retreated and sat by the side of the pillar; I followed him and sat beside him; and I did not know who he was. I said to him; I think the people disliked what you had said. He said; These people do not understand anything; although my friend told me. I asked; Who is your friend? He said; The Prophet ﷺ said to me ; O Abu Dhar! Do you see the mountain of Uhud? And on that I Abu Dhar started looking towards the sun to judge how much remained of the day as I thought that Allah Messenger ﷺ wanted to send me to do something for him and I said; Yes! He said; I do not love to have gold equal to the mountain of Uhud unless I spend it all in Allah cause except three Dinars pounds. These people do not understand and collect worldly wealth. SahihAlBukhari-017-001-5966Narrated Abu Saeed AlKhudri: Once the Prophet ﷺ sat on a pulpit and we sat around him. Then he said; The things I am afraid of most for your sake concerning what will befall you after me is the pleasures and splendors of the world and its beauties which will be disclosed to you. Somebody said; O Allah Messenger ﷺ ! Can the good bring forth evil? The Prophet ﷺ remained silent for a while. It was said to that person; What is wrong with you? You are talking to the Prophet ﷺ while he is not talking to you. Then we noticed that he was being inspired divinely. Then the Prophet ﷺ wiped off his sweat and said; Where is the questioner? It seemed as if the Prophet ﷺ liked his question. Then he said; Good never brings forth evil. Indeed it is like what grows on the banks of a water-stream which either kill or make the animals sick; except if an animal eats its fill the Khadira a kind of vegetable and then faces the sun; and then defecates and urinates and grazes again. No doubt this wealth is sweet and green. Blessed is the wealth of a Muslim from which he gives to the poor; the orphans and to needy travelers. SahihAlBukhari-017-001-6879Narrated Abu Huraira: Allah Messenger ﷺ said; Anyone whom Allah has given wealth but he does not pay its Zakat; then; on the Day of Resurrection; his wealth will be presented to him in the shape of a bald-headed poisonous male snake with two poisonous glands in its mouth and it will encircle itself round his neck and bite him over his cheeks and say; I am your wealth; I am your treasure. Then the Prophet ﷺ recited this Divine Verse:- And let not those who covetously withhold of that which Allah has bestowed upon them of His Bounty. 3.180The Chapter on Wealth And Zakat in HodHood Indexing, The Book of Prophetic Commentary on the Quran Tafseer of the Prophet in Sahih AlBukhari
SahihAlBukhari-017-001-6888Narrated Urwa Bin AlZubair: That he asked Aisha regarding the Statement of Allah: If you fear that you shall not be able to deal justly with the orphan girls... 4.3 She said; O son of my sister! An Orphan girl used to be under the care of a guardian with whom she shared property. Her guardian; being attracted by her wealth and beauty; would intend to marry her without giving her a just Mahr; i.e. the same Mahr as any other person might give her in case he married her. So such guardians were forbidden to do that unless they did justice to their female wards and gave them the highest Mahr their peers might get. They were ordered by Allah; to marry women of their choice other than those orphan girls. Aisha added; The people asked Allah Messenger ﷺ his instructions after the revelation of this Divine Verse whereupon Allah revealed: They ask your instruction regarding women 4.127 Aisha further said; And the Statement of Allah: And yet whom you desire to marry. 4.127 as anyone of you refrains from marrying an orphan girl under his guardianship when she is lacking in property and beauty. Aisha added; So they were forbidden to marry those orphan girls for whose wealth and beauty they had a desire unless with justice; and that was because they would refrain from marrying them if they were lacking in property and beauty. The Chapter on Contracts And Disputes And Orphans in HodHood Indexing, The Book of Prophetic Commentary on the Quran Tafseer of the Prophet in Sahih AlBukhari

SahihMuslim-017-001-17724It has been reported on the authority of Abu Humaid AlSaidi who said: The Messenger of Allah ﷺ appointed a man from the Azd tribe. called Ibn Al; Utbiya; in charge of Sadaqat to be received from Banu Sulaim. When he came back ; the Messenger of Allah ﷺ asked him to render his account. He said: This wealth is for you i. e. for the public treasury and this is a gift presented to me. The Messenger of Allah ﷺ said: You should have remained in the house of your father and your mother; until your gift came to you if you spoke the truth; then he addressed us. He praised God and extolled Him; and afterwards said: I appoint a man from you to a responsible post sharing with the authority that God has entrusted to me; and he comes to me saying: This wealth is for you i. e. for the public treasury and this is a gift presented to me. Why did he not remain in the house of his father and his mother and his gift came to him; if he was truthful? By God; any one of you will not take anything from the public funds without any justification; but will meet his Lord carrying it on himself on the Day of judgment. I will recognise any one of you meeting Allah and carrying a growling camel; or a cow bellowing or a goat bleating. Then he raised his hands so high that whiteness of his armpits could be seen. Then he said: O my Lord; I have conveyed Thy Commandments. The narrator says: My eyes saw the Prophet standing in that pose and my ears heard what he said. The Chapter on Truth And Hypocrisy And Martyrs in HodHood Indexing, Chapter on 7 in Sahih Muslim
SahihMuslim-017-001-17759It has been narrated on the authority of Abdulrahman Bin Abd Rabb AlKaba who said: I entered the Masjid when Abdullah Bin Amr Bin AlAs was sitting in the shade of the Kaba and the people had gathered around him. I betook myself to them and sat near him. Now Abdullah said: I accompanied the Messenger of Allah ﷺ on a journey. We halted at a place. Some of us began to set right their tents; others began to compete with one another in shooting; and others began to graze their beasts; when an announcer of the Messenger of Allah ﷺ announced that the people should gather together for prayer; so we gathered around the Messenger of Allah ﷺ. He said: It was the duty of every Prophet that has gone before me to guide his followers to what he knew was good for them and warn them against what he knew was bad for them; but this Umma of yours has its days of peace and security in the beginning of its career; and in the last phase of its existence it will be afflicted with trials and with things disagreeable to you. In this phase of the Umma ; there will be tremendous trials one after the other; each making the previous one dwindle into insignificance. When they would be afflicted with a trial; the believer would say: This is going to bring about my destruction. When at the trial is over; they would be afflicted with another trial; and the believer would say: This surely is going to be my end. Whoever wishes to be delivered from the fire and enter the garden should die with faith in Allah and the Last Day and should treat the people as he wishes to be treated by them. He who swears allegiance to a Caliph should give him the piedge of his hand and the sincerity of his heart i. e. submit to him both outwardly as well as inwardly. He should obey him to the best of his capacity. It another man comes forward as a claimant to Caliphate ; disputing his authority; they the Muslims should behead the latter. The narrator says: I came close to him Abdullah Bin Amr Bin AlAs and said to him: Can you say on oath that you heard it from the Messenger of Allah ﷺ ? He pointed with his hands to his ears and his heart and said: My ears heard it and my mind retained it. I said to him: This cousin of yours; Muawiya; orders us to unjustly consume our wealth among ourselves and to kill one another; while Allah says: O ye who believe; do not consume your wealth among yourselves unjustly; unless it be trade based on mutual agreement; and do not kill yourselves. Verily; God is Merciful to you iv. 29. The narrator says that hearing this Abdullah Bin Amr Bin AlAs kept quiet for a while and then said: Obey him in so far as he is obedient to God; and diqobey him in matters involving disobedience to God.The Chapter on Obligations Of Wealth in HodHood Indexing, Chapter on 10 in Sahih Muslim
SahihMuslim-017-001-18052It has been narrated on the authority of Abu Huraira who said: The Messenger of Allah ﷺ sent some horsemen to Najd. They captured a man. He was from the tribe of Banu Hanifa and was called Thumama Bin Uthal. He was the chief of the people of Yamama. People bound him with one of the pillars of the Masjid. The Messenger of Allah ﷺ came out to see him. He said: O Thumama; what do you think? He replied: Muhammad; I have good opinion of you. If you kill me; you will kill a person who has spilt blood. If you do me a favour; you will do a favour to a grateful person. If you want wealth; ask and you will get what you will demand. The Messenger of Allah may peace be pon him lefthim in this condition for two days; and came to him again and said: What do you think; O Thumama? He replied: What I have already told you. If you do a favour; you will do a favour to a grateful person. If you kill me; you will kill a person who has spilt blood. If you want wealth; ask and you will get what you will demand. The Messenger of Allah ﷺ left him until the next day when he came to him again and said: What do you think; O Thumama? He replied: What I have already told you. If you do me a favour; you will do a favour to a grateful person. If you kill me; you will kill a person who has spilt blood. If you want wealth ask and you will get what you will demand. The Messenger of Allah ﷺ said: Set Thumama free. He went to a palm-grove near the Masjid and took a bath. Then he entered the Masjid and said: I bear testimony to the truth that there is no god but Allah and I testify that Muhammad is His bondman and His messenger. O Muhammad; by Allah; there was no face on the earth more hateful to me than your face; but now your face has become to me the dearest of all faces. By Allah; there was no religion more hateful to me than your religion; but now your religion has become the dearest of all religions to me. By Allah; there was no city more hateful to me than your city; but now your city has become the dearest of all cities to me. Your horsemen captured me when I intended going for Umra. Now what is your opinion in the matter ? The Messenger of Allah ﷺ announced good tidings to him and told him to go on Umra. When he reached Mecca; somebody said to him: Have you changed your religion? He said: No! I have rather embraced Islam with the Messenger of Allah ﷺ. By Allah; you will not get a single grain of wheat from Yamama until it is permitted by the Messenger of Allah ﷺ.The Chapter on Love And Emotions And Makkah in HodHood Indexing, Chapter on 19 in Sahih Muslim

He the Holy Prophet said: The poor of my Umma would be he who would come on the Day of Resurrection with prayers and fasts and Zakat but he would find himself bankrupt on that day as he would have exhausted his funds of virtues since he hurled abuses upon others; brought calumny against others and unlawfully consumed the wealth of others and shed the blood of others and beat others; and his virtues would be credited to the account of one who suffered at his hand. He commanded the announcer to make announcement to the effect that he to whom Allah Apostle ﷺ had held out promise or owed any debt should come to him. I came and said: Allah Apostle ﷺ had said to me: In case there comes to us the wealth of Bahrain I shall give you so much; and so much. He said: They are those having a huge amount of wealth except so and so and those who spend their wealth generously on them whom they find in front of them; behind them and on their right side and on their left side and they are a few. And no owner of camels; or cattle or goat and sheep; who does not pay Zakat would be spared punishment but these camels; cattle; goats and sheep would come on the Day of Resurrection wearing more flesh and would gore him with their horns and trample them with their hooves. The Bedouin said: No; by Allah; I will not let you retaliate.; The Messenger of Allah said that three times; and each time the man said: No; by Allah; I will not let you retaliate.; When we heard what the Bedouin said; we turned toward him quickly. The Messenger of Allah turned to us and said; I urge anyone who hears me not to leave his place until give him permission. Then the Messenger of Allah said: O so and so; load one of his camels with barley and the other with dates. The wealthy people have all the rewards; they pray as we pray; they fast as we fast; and they have surplus wealth which they give in charity; but we have no wealth which we may give in charity. The Messenger of Allah ﷺ said: Abu Dharr; should I not teach you phrases by which you acquire the rank of those who excel you? No one can acquire your rank except one who acts like you. MuwataMalik-017-001-34567Malik related to me that Yahya Ibn Said said; A woman came to the Messenger of Allah; may Allah bless him and grant him peace; and said; Messenger of Allah; we moved into a house when our number was great and our wealth was abundant. MuwataMalik-017-001-34956Yahya said that he heard Malik say; The way of doing things in our community about which there is no dispute; is that if a man gives sadaqa to his son - sadaqa which the son takes possession of or which is in the father keeping and the father has had his sadaqa witnessed; he cannot take back any of it because he cannot reclaim any sadaqa. Yahya said that he heard Malik say; The generally agreed-on way of doing things in our community in the case of someone who gives his son a gift or grants him a gift which is not sadaqa is that he can take it back as long as the child does not start a debt; which people claim from him; and which they trust him for on the strength of the gift his father has given him. The father cannot take back anything from the gift after debts are started against it. If a man gives his son or daughter something and a woman marries the man; and she only marries him for the wealth and the property which his father has given him and so the father wants to take that back; or; if a man marries a woman whose father has given her a gift and he marries her with an increased bride-price because of the wealth and property that her father has given; then the father says; I will take that back; then the father cannot take back any of that from the son or daughter if it is as I have described to you.The Chapter on Charity To Brothers And Mother in HodHood Indexing, The Book of The Description of the Prophet may Allah Bless Him and Grant Him Peace in Muwata Malik
MuwataMalik-017-001-35033Yahya related to me from Malik from Nafi from Abdullah Ibn Umar that Umar Ibn AlKhattab said; If a slave who has wealth is sold; that wealth belongs to the seller unless the buyer stipulates its inclusion. Malik said; The generally agreed upon way of doing things among us is that if the buyer stipulates the inclusion of the slave property whether it be cash; debts; or goods of known or unknown value; then they belong to the buyer; even if the slave possesses more than that for which he was purchased; whether he was bought for cash; as payment for a debt; or in exchange for goods. This is possible because a master is not asked to pay zakat on his slave property. If a slave has a slave-girl; it is halal for him to have intercourse with her by his right of possession. If a slave is freed or put under contract kitaba to purchase his freedom; then his property goes with him. If he becomes bankrupt; his creditors take his property and his master is not liable for any of his debts. The Chapter on Slave As A Property in HodHood Indexing, The Book of Setting Free and Wala in Muwata Malik
MuwataMalik-017-001-35563Yahya related to me that Malik said; I consider that if a man dies and he has not paid zakat on his property; then zakat is taken from the third of his property from which he can make bequests ; and the third is not exceeded and the zakat is given priority over bequests. In my opinion it is the same as if he had a debt; which is why I think it should be given priority over bequests. Malik continued; This applies if the deceased has asked for the zakat to be deducted. If the deceased has not asked for it to be deducted but his family do so then that is good; but it is not binding upon them if they do not do it. Malik continued; The sunna which we are all agreed upon is that zakat is not due from someone who inherits a debt i.e. wealth that was owed to the deceased ; or goods; or a house; or a male or female slave; until a year has elapsed over the price realised from whatever he sells i.e. slaves or a house; which are not zakatable or over the wealth he inherits; from the day he sold the things; or took possession of them. Malik said; The sunna with us is that zakat does not have to be paid on wealth that is inherited until a year has elapsed over it.The Chapter on Inheritance And Charity in HodHood Indexing, The Book of Faraid in Muwata Malik
MuwataMalik-017-001-35565Yahya related to me from Malik from Ayoub Ibn Abi Tamima AlSakhtayani that Umar Ibn Abd AlAziz; when writing about wealth that one of his governors had collected unjustly; ordered it to be returned to its owner and zakat to be taken from it for the years that had passed. Then shortly afterwards he revised his order with a message that zakat should only be taken from it once; since it was not wealth in hand. The Chapter on Wealth And Deeds in HodHood Indexing, The Book of Faraid in Muwata Malik
MuwataMalik-017-001-35566Yahya related to me from Malik from Yazid Ibn Khusayfa that he had asked Sulayman Ibn Yasar whether zakat was due from a man who had wealth in hand but also owed a debt for the same amount; and he replied; No. Malik said; The position that we are agreed upon concerning a debt is that the lender of it does not pay zakat on it until he gets it back. Even if it stays with the borrower for a number of years before the lender collects it; the lender only has to pay zakat on it once. If he collects an amount of the debt which is not zakatable; and has other wealth which is zakatable; then what he has collected of the debt is added to the rest of his wealth and he pays zakat on the total sum. Malik continued; If he has no ready money other than that which he has collected from his debt; and that does not reach a zakatable amount; then he does not have to pay any zakat. He must; however; keep a record of the amount that he has collected and if; later; he collects another amount which; when added to what he has already collected; brings zakat into effect; then he has to pay zakat on it. Malik continued; Zakat is due on this first amount; together with what he has further collected of the debt owed to him; regardless of whether or not he has used up what he first collected. If what he takes back reaches twenty dinars of gold; or two hundred dirhams of silver he pays zakat on it. He pays zakat on anything else he takes back afte rthat; whether it be a large or small amount; according to the amount. Malik said; What shows that zakat is only taken once from a debt which is out of hand for some years before it is recovered is that if goods remain with a man for trading purposes for some years before he sells them; he only has to pay zakat on their prices once. This is because the one who is owed the debt; or owns the goods; should not have to take the zakat on the debt; or the goods; from anything else; since the zakat on anything is only taken from the thing itself; and not from anything else. Malik said; Our position regarding some onewho owes a debt; and has goods which are worth enough to pay off the debt; and also has an amount of ready money which is zakatable; is that he pays the zakat on the ready money which he has to hand. If; however; he only has enough goods and ready money to pay off the debt; then he does not have to pay any zakat. But if the ready money that he has reaches a zakatable amount over and above the amount of the debt that he owes; then he must pay zakat on it.The Chapter on Debt And Creditors And Paying Zakat in HodHood Indexing, The Book of Itikaf in Ramadan in Muwata Malik
MuwataMalik-017-001-35567Yahya related to me from Malik from Yahya Ibn Said that Zurayq Ibn Hayan; who was in charge of Egypt in the time of AlWalid; Sulayman; and Umar Ibn Abd AlAziz; mentioned that Umar Ibn Abd AlAziz had written to him saying; Assess the muslims that you come across and take from what is apparent of their wealth and whatever merchandise is in their charge; one dinar for every forty dinars; and the same proportion from what is less than that down to twenty dinars; and if the amount falls short of that by one third of a dinar then leave it and do not take anything from it. As for the people of the Book that you come across; take from the merchandise in their charge one dinar for every twenty dinars; and the same proportion from what is less than that down to ten dinars; and if the amount falls short by one third of a dinar leave it and do not take anything from it. Give them a receipt for what you have taken f rom them until the same time next year. Malik said; The position among us in Madina concerning goods which are being managed for trading purposes is that if a man pays zakat on his wealth; and then buys goods with it; whether cloth; slaves or something similar; and then sells them before a year has elapsed over them; he does not pay zakat on that wealth until a year elapses over it from the day he paid zakat on it. He does not have to pay zakat on any of the goods if he does not sell them for some years; and even if he keeps them for a very long time he still only has to pay zakat on them once when he sells them. Malik said; The position among us concerning a man who uses gold or silver to buy wheat; dates; or whatever; for trading purposes and keeps it until a year has elapsed over it and then sells it; is that he only has to pay zakat on it if and when he sells it; if the price reaches a zakatable amount. This is therefore not the same as the harvest crops that a man reaps from his land; or the dates that he harvests from his palms. Malik said; A man who has wealth which he invests in trade; but which does not realise a zakatable profit for him; fixes a month in the year when he takes stock of what goods he has for trading; and counts the gold and silver that he has in ready money; and if all of it comes to a zakatable amount he pays zakat on it. Malik said; The position is the same for muslims who trade and muslims who do not. They only have to pay zakat once in any one year; whether they trade in that year or not.The Chapter on Precious Metals And Zakat in HodHood Indexing, The Book of Itikaf in Ramadan in Muwata Malik
MuwataMalik-017-001-35569Yahya related to me from Malik from Abdullah Ibn Dinar from Abus-Salih AlSamman that Abu Huraira used to say; Anyone who has wealth on which he has not paid zakat will; on the day of rising; find his wealth made to resemble a whiteheaded serpent with a sac of venom in each cheek which will seek him out until it has him in its power; saying; I am the wealth that you had hidden away. The Chapter on Wealth And Zakat in HodHood Indexing, The Book of Itikaf in Ramadan in Muwata Malik
MuwataMalik-017-001-35573Yahya related to me from Malik from Thawr Ibn Zayd AlDili from a son of Abdullah Ibn Sufyan AlThaqafi from his grandfather Sufyan Ibn Abdullah that Umar Ibn AlKhattab once sent him to collect zakat. He used to include sakhlas when assessing zakat ; and they said; Do you include sakhlas even though you do not take them as payment ? He returned to Umar Ibn AlKhattab and mentioned that to him and Umar said; Yes; you include a sakhla which the shepherd is carrying; but you do not take it. Neither do you take an akula; or a rubba; or a makhid; or male sheep and goats in their second and third years; and this is a just compromise between the young of sheep and goats and the best of them. Malik said; A sakhla is a newborn lamb or kid. A rubba is a mother that is looking after her offspring; a makhid is a pregnant ewe or goat; and an akula is a sheep or goat that is being fattened for meat. Malik said; about a man who had sheep and goats on which he did not have to pay any zakat; but which increased by birth to a zakatable amount on the day before the zakat collector came to them; If the number of sheep and goats along with their newborn offspring reaches a zakatable amount then the man has to pay zakat on them. That is because the offspring of the sheep are part of the flock itself. It is not the same situation as when some one acquires sheep by buying them; or is given them; or inherits them. Rather; it is like when merchandise whose value does not come to a zakatable amount is sold; and with the profit that accrues it then comes to a zakatable amount. The owner must then pay zakat on both his profit and his original capital; taken together. If his profit had been a chance acquisition or an inheritance he would not have had to pay zakat on it until one year had elapsed over it from the day he had acquired it or inherited it. Malik said; The young of sheep and goats are part of the flock; in the same way that profit from wealth is part of that wealth. There is; however; one difference; in that when a man has a zakatable amount of gold and silver; and then acquires an additional amount of wealth; he leaves Aasi de the wealth he has acquired and does not pay zakat on it when he pays the zakat on his original wealth but waits until a year has elapsed over what he has acquired from the day he acquired it. Whereas a man who has a zakatable amount of sheep and goats; or cattle; or camels; and then acquires another camel; cow; sheep or goat; pays zakat on it at the same time that he pays the zakat on the others of its kind; if he already has a zakatable amount of livestock of that particular kind. Malik said; This is the best of what I have heard about this. The Chapter on Zakat Of Live Stock in HodHood Indexing, The Book of Itikaf in Ramadan in Muwata Malik
