So I carried it and there went along with him with Abu Bakr my father in order to fetch its price and he Azib said to Abu Bakr: Abu Bakr; narrate to me what you both did on the night when you set out on a journey along with Allah Messenger ﷺ. He said: We set out during the night and went on walking until it was noon; and the path was vacant and so none passed by that until there appeared prominently before us a large rock. It had its shade and the rays of the sun did not reach that place. So we got down at that place. I then went to the rock and levelled the ground with my hands at the place where the Prophet ﷺ would take rest under its shade. I then set the bedding and said: Allah Messenger; go to sleep and I shall keep a watch around you. I went out and watched around him. There we saw a shepherd moving towards that rock with his flock and he intended what we intended i. e. taking rest. I met him and said to him: Young boy; to which place do you belong? He said: I am a person from Medina. I said; is there any milk in the udders of your sheep and goats? He said: Yes. He took hold of a goat; and I said to him: Clean the udder well so that it should be free from hair; dust and impurity. I saw AlBara striking his hand upon the other to give an indication how he did that. He milked the goat for me in a wooden cup which he had with him and I had with me a bucket in which I kept water for drinking and for performing ablution. I came to Allah Apostle ﷺ and did not like to awaken him from sleep but he was accidentally startled from the sleep. I poured water upon the milk till It was cold and I said: Allah Messenger; take this milk. He then took It and I was delighted and he the Holy Prophet said: Is now not the time to march on? I said: Of course. So he marched on after the sun had passed the meridian and Suraqa Bin Malik pursued us and we had been walking on soft; level ground. I said: Allah Messenger; we are about to be overtaken by them. Thereupon he said: Be not grieved. Verily; Allah is with us. Then Allah Messenger ﷺ cursed him and his horse sank into the earth. I think he also said: I know you have hurled curse upon me. So supplicate Allah for me and I take an oath that I shall turn everyone away who would come in search of you. Should he kill him and then be killed by you; or how should he act? Ask the Apostle of Allaah ﷺ Aasi m; for me about it. Aasi m then asked the Apostle of Allaah ﷺ about it. The Apostle of Allaah ﷺ disliked the question and denounced it. What Aasi m heard from the Apostle of Allaah ﷺ fell heavy on him. When Aasi m returned to his family Uwaimr came to him and asked Aasi m What did the Apostle of Allaah ﷺ say to you? Aasi m replied You did not do good to me. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon Uwaimir said I swear by Allaah; I shall not leave until I ask him about it. So; Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people. He said Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you; or how should he act? The Apostle of Allaah ﷺ said A revelation has been sent down about you and your wife so go away and bring her. Sahl said So we cursed one another while I was along with the people who were with the Apostle of Allaah ﷺ. On the next day he came to the Apostle of Allaah ﷺ and said If a man finds a man along with wife and declares about her adultery you will flog him. SunanAbuDawoud-017-001-25095 | Ibn Abbas said Hilal Bin Umayah was one of the three persons whose repentance was accepted by Allaah. One night he returned from his land and found a man along with his wife. He witnessed with his eyes and heard with his ears. He did not threaten him till the morning. Next day he went to the Apostle of Allaah ﷺ in the morning and said Apostle of Allaah ﷺ I came to my wife in the night and found a man along with her. I saw with my own eyes and heard with my own ears. The Apostle of Allaah ﷺ disliked what he described and he took it seriously. There upon the following Quranic verse came down And those who make charges against their spouses but have no witnesses except themselves; let the testimony of one of them.... When the Apostle of Allaah ﷺ came to himself after the revelation ended he said Glad tidings to you Hilal; Allaah the exalted has made ease and a way out for you. Hilal said I expected that from my Lord. The Apostle of Allaah ﷺ said Send for her. She then came. The Apostle of Allaah ﷺ recited the verses to them and he reminded them and told them that the punishment in the next world was more severe than that in n this world. Hilal said I swear by Allah I spoke the truth against her. She said He told a lie. The Apostle of Allaah ﷺ said Apply the method of invoking curses on one another. Hilal was told Bear witness. So he bore witness before Allaah four times that he spoke the truth. When he was about to utter the fifth time he was told Hilal fear Allah; for the punishment in this world is easier than that in the next world and this is the deciding one; that will surely cause punishment to you. He said I swear by Allaah. Allah will not punish me for this act ; as He did not cause me to be flogged for this act. So he bore witness a fifth time invoking the curse of Allah on him if he was of those who tell a lie. Then the people said to her; Testify. So she gave testimony before Allaah that he was a liar. When she was going to testify the fifth time she was told Fear Allah; for the punishment in this world is easier than that in the next world. This is the deciding one that will surely cause punishment to you. She hesitated for a moment. And then said By Allah; I will not disgrace my people. So she testified a fifth time invoking the curse of Allah on her if he spoke the truth. Apostle of Allaah ﷺ separated them from each other and decided that the child will not be attributed to its father. Neither she nor her child will be accused of adultery. He who accuses her or her child will be liable to punishment. He also decided that there will be no dwelling and maintenance for her from the husband as they were separated without divorce and death. He then said If she gives birth to a child with reddish hair; light buttocks; wide belly and light shins he will be the child of Hilal. If she bears a dusky child with curly hair; fat limbs; fat shins and fat buttocks he will be the child of the one who was accused of adultery. She gave birth to a child with curly hair; fat limbs; fat shins and fat buttocks. The people who heard from Hudhaifah would go to Salman and tell him what Hudhaifah said. Salman would say: Hudhaifah knows best what he says. Then they would come to Hudhaifah and tell him: We mentioned Salman what you said; but he neither testified you nor falsified you. So Hudhaifah came to salman who was in his vegetable farm; and said : Salman; what prevents you from testifying me of what I heard from the Messenger of Allah ﷺ ? Salman said: The Messenger of Allah ﷺ sometimes would be angry; and said in anger something to some of his Companions; he would be sometimes pleased and said in pleasure something to some of his Companions. Would you not stop until you create love of some people in the hearts of some people; and hatred of some people in the hearts of some people; and until you generate disagreement and dissension? MuwataMalik-017-001-35222 | Yahya related to me from Malik from Ibn Shihab that Sahl Ibn Sad AlSaidi told him that Uwaymir AlAjlani came to Aasi m Ibn Adi AlAnsari and said to him; Aasi m! What do you think a man who finds another man with his wife should do? Should he kill him and then be killed himself; or what should.he do? Aasi m! ask the Messenger of Allah; may Allah bless him and grant him peace; about that for me. Aasi m asked the Messenger of Allah; may Allah bless him and grant him peace; about it. The Messenger of Allah; may Allah bless him and grant him peace; was revolted by the questions and reproved them until what he heard from the Messenger of Allah; may Allah bless him and grant him peace. was intolerable for Aasi m. When Aasi m returned to his people; Uwaymir came to him and said; Aasi m! what did the Messenger of Allah; may Allah bless him and grant him peace; say to you? Aasi m said to Uwaymir; You didnt bring me any good. The Messenger of Allah; may Allah bless him and grant him peace; was revolted by the question which I asked him. Uwaymir said; By Allah! I will not stop until I ask him about it! Uwaymir stood up and went to the Messenger of Allah; may Allah bless him and grant him peace; in the middle of the people and said; Messenger of Allah! What do you think a man who finds another man with his wife should do? Should he kill him and then be killed himself; or what should he do? The Messenger of Allah; may Allah bless him and grant him peace; said; Something has been sent down about you and your wife; so go and bring her. Sahl continued; They mutually cursed one another in the presence of the Messenger; may Allah bless him and grant him peace; and I was present with the people. When they finished cursing each other; Uwaymir said; I shall have lied about her; Messenger of Allah; if I keep her; and pronounced the divorce three times before the Messenger of Allah; may Allah bless him and grant him peace; ordered him to do it. MuwataMalik-017-001-35223 | Yahya related to me from Malik from Nafic from Abdullah Ibn Umar that a man cursed his wife in the time of the Messenger of Allah; may Allah bless him and grant him peace; and disowned her child. The Messenger of Allah; may Allah bless him and grant him peace; separated them and gave the child to the woman. Malik said; Allah the Blessed; the Exalted; said; The testimony of men who accuse their wives but do not have any witnesses except themselves is to testify by Allah four times that he is being truthful; and a fifth time; that the curse of Allah will be upon him; if he should be a liar. She will avoid punishment if she testifies by Allah four times that he is a liar; and a fifth time; that the wrath of Allah shall be upon her; if he should be telling the truth. Surat 24 ayat 6. Malik said; The sunna with us is that those who curse each other are never to be remarried. If the man calls himself a liar; i.e. takes back his accusation ; he is flogged with the hadd-punishment; and the child is given to him; and his wife can never return to him. There is no doubt or dispute about this sunna among us. Malik said; If a man separates from his wife by an irrevocable divorce by which he cannot return to her; and then he denies the paternity of the child she is carrying; whilst she claims that he is the father; and it is possible by the timing; that he be so; he must curse her; and the child is not recognised as his. Malik said; That is what is done among us; and it is what I have heard from the people of knowledge. Malik said that a man who accused his wife after he had divorced her trebly while she was pregnant; and he had at first accepted being the father but then claimed that he had seen her committing adultery before he separated from her; was flogged with the hadd-punishment; and did not curse her. If he denied the paternity of her child after he had divorced her trebly; and he had not previously accepted it; then he cursed her. Malik said; This is what I have heard. Malik said; The slave is in the same position as the free man as regards making accusations and invoking mutual curses lian. He acts in the lian as the free man acts although there is no hadd applied for slandering a female-slave. Malik said; The muslim slave-girl and the christian and jewish free woman also do lian when a free muslim marries one of them and has intercourse with her. That is because Allah - may He be blessed and Exalted; said in His Book; As for those who accuse their wives; and they are their wives. This is what is done among us. Malik said that a man who did the lian with his wife; and then stopped and called himself a liar after one or two oaths and he had not cursed himself in the fifth one; had to be flogged with the hadd-punishment; but they did not have to be separated. Malik said that if a man divorced his wife and then after three months the woman said; I am pregnant; and he denied paternity; then he had to do lian. Malik said that the husband of a female slave who pronounced the lian on her and then bought her; was not to have intercourse with her; even if he owned her. The sunna which had been handed down about a couple who mutually cursed each other in the lian was that they were never to return to each other. Malik said that when a man pronounced the lian against his wife before he had consummated the marriage; she only had half of the bride price. | The Chapter on Wives And Relationship Lian in HodHood Indexing, The Book of Marriage in Muwata Malik |
