SahihAlBukhari-017-001-227 | Narrated Abdullah Bin Ubaidullah Bin Abi Mulaika: One of the daughters of Uthman died at Mecca. We went to attend her funeral procession. Ibn Umar and Ibn Abbas were also present. I sat in between them or said; I sat beside one of them. Then a man came and sat beside me. Abdullah Bin Umar said to Amr Bin Uthman; Will you not prohibit crying as Allah Messenger ﷺ has said; The dead person is tortured by the crying of his relatives.? Ibn Abbas said; Umar used to say so. Then he added narrating; I accompanied Umar on a journey from Mecca till we reached AlBaida. There he saw some travelers in the shade of a Samura A kind of forest tree. He said to me ; Go and see who those travelers are. So I went and saw that one of them was Suhaib. I told this to Umar who then asked me to call him. So I went back to Suhaib and said to him; Depart and follow the chief of the faithful believers. Later; when Umar was stabbed; Suhaib came in weeping and saying; O my brother; O my friend! on this Umar said to him; O Suhaib! Are you weeping for me while the Prophet ﷺ said; The dead person is punished by some of the weeping of his relatives? Ibn Abbas added; When Umar died I told all this to Aisha and she said; May Allah be merciful to Umar. By Allah; Allah Messenger ﷺ did not say that a believer is punished by the weeping of his relatives. But he said; Allah increases the punishment of a non-believer because of the weeping of his relatives. Aisha further added; The Quran is sufficient for you to clear up this point as Allah has stated: No burdened soul will bear another burden. 35.18. Ibn Abbas then said; Only Allah makes one laugh or cry. SahihAlBukhari-017-001-3351 | Narrated Aisha: the wife of the Prophet Allah Messenger ﷺ died while Abu Bakr was at a place called AlSunah AlAliya Umar stood up and said; By Allah! Allah Messenger ﷺ is not dead! Umar later on said; By Allah! Nothing occurred to my mind except that. He said; Verily! Allah will resurrect him and he will cut the hands and legs of some men. Then Abu Bakr came and uncovered the face of Allah Messenger ﷺ ; kissed him and said; Let my mother and father be sacrificed for you; O Allah Messenger ﷺ ; you are good in life and in death. By Allah in Whose Hands my life is; Allah will never make you taste death twice. Then he went out and said; O oath-taker! Dont be hasty. When Abu Bakr spoke; Umar sat down. Abu Bakr praised and glorified Allah and said; No doubt! Whoever worshipped Muhammad; then Muhammad is dead; but whoever worshipped Allah; then Allah is Alive and shall never die. Then he recited Allah Statement.:- O Muhammad Verily you will die; and they also will die. 39.30 He also recited:- Muhammad is no more than an Apostle; and indeed many Apostles have passed away; before him; If he dies Or is killed; will you then Turn back on your heels? And he who turns back On his heels; not the least Harm will he do to Allah And Allah will give reward to those Who are grateful. 3.144 The people wept loudly; and the Ansar were assembled with Sad Bin Ubada in the shed of Bani Saida. They said to the emigrants. There should be one Amir from us and one from you. Then Abu Bakr; Umar Bin AlKhattab and Abu baida Bin AlJarrah went to them. Umar wanted to speak but Abu Bakr stopped him. Umar later on used to say; By Allah; I intended only to say something that appealed to me and I was afraid that Abu Bakr would not speak so well. Then Abu Bakr spoke and his speech was very eloquent. He said in his statement; We are the rulers and you Ansars are the ministers i.e. advisers ; Hubab Bin AlMundhir said; No; by Allah we wont accept this. But there must be a ruler from us and a ruler from you. Abu Bakr said; No; we will be the rulers and you will be the ministers; for they i.e. Quarish are the best family amongst the Arabs and of best origin. So you should elect either Umar or Abu Ubaida Bin AlJarrah as your ruler. Umar said to Abu Bakr ; No but we elect you; for you are our chief and the best amongst us and the most beloved of all of us to Allah Messenger ﷺ. So Umar took Abu Bakr hand and gave the pledge of allegiance and the people too gave the pledge of allegiance to Abu Bakr. Someone said; You have killed Sad Bin Ubada. SahihAlBukhari-017-001-6846 | Narrated Mujahi: regarding the Verse :- Those of you who die and leave wives behind. They - their wives - shall wait as regards their marriage for four months and ten days. 2.234 The widow; according to this Verse; was to spend this period of waiting with her husband family; so Allah revealed: Those of you who die and leave wives i.e. widows should bequeath for their wives; a year maintenance and residences without turning them out; but if they leave their residence ; there is no blame on you for what they do with themselves provided it is honorable. i.e. lawful marriage 2.240. So Allah entitled the widow to be bequeathed extra maintenance for seven months and twenty nights; and that is the completion of one year. If she wished she could stay in her husband home according to the will; and she could leave it if she wished; as Allah says:..without turning them out; but if they leave the residence ; there is no blame on you. So the Idda i.e. four months and ten days as it is obligatory for her. Ata said: Ibn Abbas said; This Verse; i.e. the Statement of Allah:..without turning them out.. cancelled the obligation of staying for the waiting period in her dead husband house; and she can complete this period wherever she likes. Ata aid: If she wished; she could complete her Idda by staying in her dead husband residence according to the will or leave it according to Allah Statement:- There is no blame on you for what they do with themselves. Ata added: Later the regulations of inheritance came and abrogated the order of the dwelling of the widow in her dead husband house ; so she could complete the Idda wherever she likes. And it was no longer necessary to provide her with a residence. SahihMuslim-017-001-21757 | Abdullah Bin Abu Mulaika reported: I was sitting by the side of Ibn Umar; and we were waiting for the bier of Umm Aban; daughter of Uthman; and there was also Amr Bin Uthman. In the meanwhile there came Ibn Abbas led by a guide. I conceive that he was informed of the place of Ibn Umar. So he came till he sat by my side. While I was between them Ibn Abbas and Ibn Umar there came the noise of wailing from the house. Upon this Ibn Umar said that is; he pointed out to Amr that he should stand and forbid them; for : I heard the Messenger of Allah ﷺ as saying: The dead is punished because of the lamentation of his family. Abdullah made it general what was said for a particular occasion. Ibn Abbas said: When we were with the Commander of the believers; Umar Bin AlKhattab; we reached Baida; and there was a man under the shadow of the tree. He said to me: Go and inform me who is that person. So I went and found that he was Suhaib. I returned to him and said: You commanded me to find out for you who that was; and he is Suhaib. He Hadrat Umar said: Command him to see us. I said: He has family along with him. He said: That is of no account even if he has family along with him. So he the narrator told him to see the Commander of the believers and his party. When we came to Medina ; it was before long that the Commander of the believers was wounded; and Suhaib came weeping and crying: Alas for the brother; alas for the companion. Upon this Umar said: Didnt you know; or didnt you hear; that the Messenger of Allah ﷺ said: The dead is punished because of the lamentation of his family? Then Abdullah made it general and Umar told it of certain occasions. So I Abdullah Bin Abu Mulaika stood up and went to Aisha and told her what Ibn Umar had said. Upon this she said: I swear by Allah that Allah Messenger ﷺ never said that dead would be punished because of his family lamenting for him. What he said was that Allah would increase the punishment of the unbeliever because of his family lamenting for him. Verily it is Allah Who has caused laughter and weeping. No bearer of a burden will bear another burden. Abdullah Bin Umar said to Amr Bin Uthman who was sitting opposite to him: Will you not prevent the people from lamenting; for the Messenger of Allah ﷺ had said: The dead is punished because of the lamenting of his family for him? Ibn Abbas then said that Umar used to say someting of that nature; and then narrated saying: I proceeded from Mecca along with Umar till we reached AlBaida and there was a party of riders under the shade of a tree. He said to me : Go and find out who this party is. I cast a glance and there was Suhaib in that party. So I informed him Umar about it. He said: Call him to me. So I went back to Suhaib and said: Go and meet the Commander of the believers. When Umar was wounded; Suhaib came walling: Alas; for the brother! alas for the companion! Umar said: O Suhaib; do you wail for me; whereas the Messenger of Allah ﷺ said: The dead would be punished on account of the lamentation of the members of his family ? Ibn Abbas said: When Umar died I made a mention of it to Aisha. She said: May Allah have mercy upon Umar! I swear by Allah that Allah Messenger ﷺ never said that Allah would punish the believer because of the weeping of any one of the members of his family ; but he said that Allah would increase the punishment of the unbeliever because of the weeping of his family over him. Aisha said: The Quran is enough for you when it states : No bearer of burden will bear another burden vi. 164. Thereupon Ibn Abbas said: Allah is He Who has caused laughter and weeping. SahihMuslim-017-001-21762 | Hisham narrated on the authority of his father that it was mentioned to Aisha that Ibn Umar had narrated as marfu hadith from the Messenger of Allah ﷺ that the dead would be punished in the grave because of the lamentation of his family for him. Upon this she said: He Ibn Umar missed the point. The Messenger of Allah ﷺ had in fact said: He the dead is punished for his faults or for his sins; and the members of his family are wailing for him now. This misunderstanding of Ibn Umar is similar to his saying: The Messenger of Allah ﷺ stood by the well in which were lying the dead bodies of those polytheists who had been killed on the Day of Badr; and he said to them what he had to say; i. e.: They hear what I say. SahihMuslim-017-001-22103 | Zaid Bin Wahb Juhani reported and he was among the squadron which was under the command of Ali Allah be pleased with him and which set out to curb the activities of the Khawarij. Ali Allah be pleased with him said: O people; I heard the Messenger of Allah ﷺ say: There would arise from my Ummah a people who would recite the Quran; and your recital would seem insignificant as compared with their recital; your prayer as compared with their prayer; and your fast; as compared with their fast. They would recite the Quran thinking that it supports them; whereas it is an evidence against them. Their prayer does not get beyond their collar bone; they would swerve through Islam just as the arrow passes through the prey. If the squadron which is to encounter them were to know what great boon has been assured to them by their Messenger ﷺ they would completely rely upon this deed alone and cease to do other good deeds ; and their that of the Khawarij distinctive mark is that there would be among them a person whose wrist would be without the arm; and the end of his wrist would be fleshy like the nipple of the breast on which there would be white hair. You would be marching towards Muawiya and the people of Syria and you would leave them behind among your children and your property to do harm. By Allah; I believe that these are the people against whom you have been commanded to fight and get reward for they have shed forbidden blood; and raided the animals of the people. So go forth in the name of Allah to fight against them. Salama Bin Kuhail mentioned that Zaid Bin Wahb made me alight at every stage; till we crossed a bridge. Abdullah Bin Wahb AlRasibi was at the head of the Khawarij when we encountered them. He Abdullah said to his army: Throw the spears and draw out your swords from their sheaths; for I fear that they would attack you as they attacked you on the day of Harura. They went back and threw their spears and drew out their swords; and people fought against them with spears and they were killed one after another. Only two persons were killed among the people among the army led by Ali on that day. Ali Allah be pleased with him said: Find out from among them the dead bodies of the Khawarij the maimed. They searched but did not find him. Ali Allah be pleased with him then himself stood up and walked till he came to the people who had been killed one after another. He Ali said: Search them to the last; and then Ali companions found him the dead body of the maimed near the earth. He Ali then pronounced Allahu Akbar Allah is the Greatest and then said; Allah told the Truth and His Messenger ﷺ conveyed it. He then said: Shroud him in his two garments; was him with water and lotus leaves; but do not cover his head; for he will be raised on the Day of Resurrection saying the talbiyah.Abu Dawud said: I heard Ahmad Bin Hanbal say: There are five rules of the law sunan in this tradition: Shroud him in his two garment; that is; the dead should be shrouded in his two garments. Wash him with water and lotus leaves; that is; washing all times should be with lotus leaves. Do not bring any perfume near him. MuwataMalik-017-001-34785 | Malik related to me from Zurayq Ibn Hakim AlAyli that a man called Misbah asked his son for help and he thought him unnecessarily slow. When the son came; his father said to him; O fornicator. Zurayq said; So the son asked me to help him against the father. When I wanted to flog him; his son said; By Allah; if you flog him; I will acknowledge that I have committed fornication. When he said that; the situation was confused for me; so I wrote about it to Umar Ibn Abd AlAziz who was the governor at that time; and I mentioned it to him. Umar wrote me to permit his pardon. Zurayq said; I wrote to Umar Ibn Abd AlAziz also; What do you think about a man who is slandered or his parents are slandered and both or only one of them are dead? He said; Umar wrote to me; If he forgives; his pardon is permitted for himself. If his parents are slandered and one or both of them are dead; take the judgement of the Book of Allah for it unless he wants to veil it. Yahya said; I heard Malik say; That is because the slandered man might fear that if that is unveiled about him; a clear proof might be established. MuwataMalik-017-001-34876 | 11 Malik related to me from Yahya Ibn Said from Urwa Ibn AlZubair that a man of the Ansar called Uhayha Ibn AlJulah had a young paternal uncle who was younger than him and who was living with his maternal uncles. Uhayha took him and killed him. His maternal uncles said; We brought him up from a baby to a youth till he stood firm on his feet; and we have had the right of a man taken from us by his paternal uncle. Urwa said; For that reason a killer does not inherit from the one he killed. Malik said; The way of doing things about which there is no dispute is that the intentional murderer does not inherit anything of the blood-money of the person he has murdered or any of his property. He does not stop anyone who has a share of inheritance from inheriting. The one who kills accidentally does not inherit anything of the blood-money and there is dispute as to whether or not he inherits from the dead person property because there is no suspicion that he killed him for his inheritance and in order to take his property. MuwataMalik-017-001-35118 | 86 Malik related to me from Mousa Ibn Maysara that he heard a man ask Said Ibn AlMusayab; I am a man who sells for a debt. Said said; Do not sell except for what you take to your camel. Malik spoke about a person who bought goods from a man provided that he provide him with those goods by a specific date; either in time for a market in which he hoped for their saleability; or to fulfil a need at the time he stipulated. Then the seller failed him about the date; and the buyer wanted to return those goods to the seller. Malik said; The buyer cannot do that; and the sale is binding on him. If the seller does bring the goods before the completion of the term; the buyer cannot be forced to take them. Malik spoke about a person who bought food and measured it. Then some one came to him to buy it and he told him that he had measured it for himself and taken it in full. The new buyer wanted to trust him and accept his measure. Malik said; Whatever is sold in this way for cash has no harm in it but whatever is sold in this way on delayed terms is disapproved of until the new buyer measures it out for himself. The sale with delayed terms is disapproved of because it leads to usury and it is feared that it will be circulated in this way without weight or measure. If the terms are delayed it is disapproved of and there is no disagreement about that with us. Malik said; One should not buy a debt owed by a man whether present or absent; without the confirmation of the one who owes the debt; nor should one buy a debt owed to a man by a dead person even if one knows what the deceased man has left. That is because to buy that is an uncertain transaction and one does not know whether the transaction will be completed or not completed. He said; The explanation of what is disapproved of in buying a debt owed by someone absent or dead; is that it is not known what unknown debtor may be connected to the dead person. If the dead person is liable for another debt; the price which the buyer gave on strength of the debt may become worthless. Malik said; There is another fault in that as well. He is buying something which is not guaranteed for him; and so if the deal is not completed; what he paid becomes worthless. This is an uncertain transaction and it is not good. Malik said; One distinguishes between a man who is only selling what he actually has and a man who is being paid in advance for something which is not yet in his possession. The man advancing the money brings his gold which he intends to buy with. The seller says; This is 10 dinars. What do you want me to buy for you with it? It is as if he sold 10 dinars cash for 15 dinars to be paid later. Because of this; it is disapproved of. MuwataMalik-017-001-35177 | Yahya related to me from Malik from Abuz-Zinad from Abu Salama Ibn Abdulrahman that some people from AlJar came to Marwan Ibn AlHakam and asked him about eating what was cast up by the sea. He said; There is no harm in eating it. Marwan said; Go to Zayd Ibn Thabit and Abu Huraira and ask them about it; then come to me and tell me what they say. They went to them and asked them; and they both said; There is no harm in eating it They returned to Marwan and told him. Marwan said; I told you. Malik said that there was no harm in eating fish caught by magians; because the Messenger of Allah; may Allah bless him and grant him peace; said; In the sea water is purity; and that which is dead in it is halal. MuwataMalik-017-001-35427 | Yahya related to me from Malik from Yahya Ibn Said from Amr Ibn Kathir Ibn Aflah from Abu Muhammad; the mawla of Abu Qatada that Abu Qatada Ibn Ribi said; We went out with the Messenger of Allah; may Allah bless him and grant him peace; in the year of Hunayn. When the armies met; the Muslims were put in disarray. I saw a man from the idol worshippers who had got the better of one of the Muslims; so I circled round and came up behind him; and struck him with a sword on his shoulder-blade. He turned to me and grabbed me so hard that I felt the smell of death in it. Then death overcame him; and he let go of me. He continued; I met Umar Ibn AlKhattab and said to him; What going on with the people? He replied; The Command of Allah. Then the people took hold of the battle and the Messenger of Allah; may Allah bless him and grant him peace; said; Whoever has killed one of the dead and can prove it; can strip him of his personal effects. I stood up and said; Who will testify for me? and then I sat down. The Messenger of Allah repeated; Whoever has killed one of the dead and can prove it; can strip him of his personal effects. I stood up and said; Who will testify for me? then I sat down. Then he repeated his statement a third time; so I stood up; and the Messenger of Allah; may Allah bless him and grant him peace; said; What the matter with you; Abu Qatada? So I related my story to him. A man said; He has spoken the truth; Messenger of Allah. I have the effects of that slain person with me; so give him compensation for it; Messenger of Allah. Abu Bakr said; No; by Allah! He did not intend that one of the lions of Allah should fight for Allah and His Messenger and then give you his spoils. He gave it to me; and I sold the breast-plate and I bought a garden in the area of the Banu Salima with the money. MuwataMalik-017-001-35463 | Yahya related to me from Malik from Ibn Shihab from Amra bint Abdulrahman that when Aisha was doing itikaf she would only ask after sick people if she was walking and not if she was standing still. Malik said; A person doing itikaf should not carry out obligations of his; nor leave the Masjid for them; nor should he help anyone. He should only leave the Masjid to relieve himself. If he were able to go out to do things for people; visiting the sick; praying over the dead and following funeral processions would be the things with the most claim on his coming out.
