He said: "Will ye exchange the better for the worse? Go ye down to any town, and ye shall find what ye want!" They were covered with humiliation and misery; they drew on themselves the wrath of Allah. This because they went on rejecting the Signs of Allah and slaying His Messengers without just cause. If anyone of us saw another man over his wife; would he go to search for a proof. SahihAlBukhari-017-001-6456 | Narrated Ikrima Bin Khalid: Ibn Umar said; I went to Hafsa while water was dribbling from her twined braids. I said; The condition of the people is as you see; and no authority has been given to me. Hafsa said; to me ; Go to them; and as they i.e. the people are waiting for you; and I am afraid your absence from them will produce division amongst them. So Hafsa did not leave Ibn Umar till we went to them. When the people differed. Muawiya addressed the people saying; If anybody wants to say anything in this matter of the Caliphate; he should show up and not conceal himself; for we are more rightful to be a Caliph than he and his father. On that; Habib Bin Masalama said to Ibn Umar ; Why dont you reply to him i.e. Muawiya ? Abdullah Bin Umar said; I untied my garment that was going round my back and legs while I was sitting and was about to say; He who fought against you and against your father for the sake of Islam; is more rightful to be a Caliph; but I was afraid that my statement might produce differences amongst the people and cause bloodshed; and my statement might be interpreted not as I intended. So I kept quiet remembering what Allah has prepared in the Gardens of Paradise for those who are patient and prefer the Hereafter to this worldly life. One day a person from among my uncles came to us and said: Allah Messenger ﷺ forbade us this act which was a source of benefit to us; but the obedience to Allah and to His Messenger ﷺ is more beneficial to us. A person said: Messenger of Allah; does good produce evil? The Messenger of Allah ﷺ remained silent. And it was said to him the man who had asked the question from the Holy Prophet : What Is the matter with you; that you speak with the Messenger of Allah ﷺ but he does not speak with you? We thought as if revelation was descending upon him. He regained himself and wiped the sweat from him and said: He was the inquirer and his style of expression showed as if he praised him and then added : Verily good does not produce evil. Whatever the spring rainfall causes to grow kills or is about to kill; but that animal which feeds on vegetation. It eats till its flanks are filled; it faces the sun and dungs and urinates. and then returns to eat. SunanAlNasai-017-001-14969 | It was narrated that Anas Bin Malik said: The first Lian in Islam was when Hilal Bin Umayah accused Sharik Bin AlSahma of committing adultery with his wife. He came to the Prophet and told him about that. The Prophet said: Bring four witnesses; otherwise you will feel the Hadd punishment on your back. And he repeated that several times. Hilal said to him: By Allah; O Messenger of Allah! Allah; the Mighty and Sublime; knows that I am telling the truth; and Allah; the Mighty and Sublime; will certainly reveal to you that which will spare my back from the whip. While they were like that; the Verse of Lian was revealed to him: As to those who accuse their wives. He called Hilal and he bore witness four times by Allah that he was telling the truth; and the fifth time he invoked the curse of Allah upon him if he were lying. Then he called the woman and she bore witness four times by Allah that he was lying. When it came to the fourth or fifth time; the Messenger of Allah said: Stop her; for it will inevitably bring the punishment of Allah upon the liar. She hesitated until we thought that she was going to confess; then she said: I will not dishonor my people today. Then she went ahead with the oath. The Messenger of Allah said: Wait and see. If she produces a child who is white; with straight hair and Qadiya eyes; then he belongs to Hilal Bin Umayah; but if she produces a child who is dark with curly hair; of average size and with narrow calves; then he belongs to Sharik Bin AlSahma. She produced a child who was dark with curly hair; of average size and with narrow calves. SunanAbuDawoud-017-001-25093 | Ibn Abbas said Hilal Bin Umayah accused his wife in the presence of Prophet ﷺ of having committed adultery with Sharik Bin Sahma. The Prophet ﷺ said Produce evidence or you must receive punishment on your back. He said Apostle of Allaah ﷺ when one of us sees a man having intercourse with his wife should he go and seek evidence? But the Prophet ﷺ merely said You must produce evidence or you must receive punishment on your back. Hilal then said By Him Who sent you with the Truth; I am speaking Truly. May Allaah send down something which will free my back from punishment. Then the following Quranic verses were revealed And those who make charges against their spouses but have no witnesses except themselves reciting till he reached one of those who speak the truth. The Prophet ﷺ then returned and sent for them and they came to him. Hilal Bin Umayah stood up and testified and the Prophet ﷺ was saying Allaah knows that one of you is lying. Will one of you repent? Then the woman got up and testified; but when she was about to do it a fifth time saying that Allaahs anger be upon her if he was one of those who spoke the truth; they said to her this is the deciding one. Ibn Abbas said She then hesitated and drew back so that we thought the she would withdraw what she said Look and see whether she gives birth to a child with eyes looking as if they have antimony in them; wide buttocks and fat legs; if she did. Sharik Bin Sahma will be its father. She then gave birth to a child of a similar description. The Prophet ﷺ thereupon said If it were not for what has already been stated in Allaahs book I would have dealt severely with her.Abu Dawud said This tradition has been transmitted by the people of Medina alone. SunanAbuDawoud-017-001-29279 | Abdullah Bin Umar reported that Umar said When Khaibar was conquered; the Jews asked the Apostle of Allaah ﷺ to confirm that they would do all the cultivation and have half the produce. The Apostle of Allaah ﷺ said I shall confirm you on that condition as long as we wish. So they were confirmed on that condition. The dates from half the produce of Khaibar were divided into a number of portions. The Apostle of Allaah ﷺ would take the fifth. The Apostle of Allaah ﷺ used to contribute from the fifth one hundred wasqs of dates and twenty wasqs of wheat to each of his wives. When he was dying; he said; By Allah; little daughter; there is no one I would prefer to be wealthy after I die than you. There is no one it is more difficult for me to see poor after I die than you. I gave you palm-trees whose produce is twenty awsuq. Had you cut them and taken possession of them; they would have been yours; but today they are the property of the heirs; and they are your two brothers and your two sisters; so divide it according to the Book of Allah. Aisha continued; I said; My father! By Allah; even if it had been more; I would have left it. There is only Asma. Who is my other sister? Abu Bakr replied; What is in the womb of Kharija? Kharija was the wife of Abu Bakr brother from the Ansar. The crop is examined and estimated while still on the palm. This is allowed because it comes into the category of delegation of responsibility; handing over rights; and involving a partner. MuwataMalik-017-001-35582 | Yahya related to me from Malik from Ziyad Ibn Sad that Ibn Shihab said; Neither jurur; nor musran Alfara; nor adhq Ibn hubayq should be taken as zakat from dates. They should be included in the assessment but not taken as zakat. Malik said; This is the same as with sheep and goats; whose young are included in the assessment but are not actually taken as zakat. There are also certain kinds of fruit which are not taken as zakat; such as burdi dates one of the finest kinds of dates ; and similar varieties. Neither the lowest quality of any property nor the highest should be taken. Rather; zakat should be taken from average quality property. Malik said; The position that we are agreed upon concerning fruit is that only dates and grapes are estimated while on the tree. They are estimated when their usability is clear and they are halal to sell. This is because the fruit of date-palms and vines is eaten straightaway in the form of fresh dates and grapes; and so the assessment is done by estimation to make things easier for people and to avoid causing them trouble. Their produce is estimated and then they are given a free hand in using their produce as they wish; and later they pay the zakat on it according to the estimation that was made. Malik said; crops which are not eaten fresh; such as grains and seeds; which are only eaten after they have been harvested; are not estimated. The owner; after he has harvested; threshed and sifted the crop; so that it is then in the form of grain or seed; has to fulfil his trust himself and deduct the zakat he owes if the amount is large enough for him to have to pay zakat. This is the position that we are all agreed upon here in Madina. Malik said; The position that we are all agreed upon here in Madina is that the produce of date palms is estimated while it is still on the tree; after it has ripened and become halal to sell; and the zakat on it is deducted in the form of dried dates at the time of harvest. If the fruit is damaged after it has been estimated and the damage affects all the fruit then no zakat has to be paid. If some of the fruit remains unaffected; and this fruit amounts to five awsuq or more using the sa of the Prophet; may Allah bless him and grant him peace; then zakat is deducted from it. Zakat does not have to be paid; however; on the fruit that was damaged. Grapevines are dealt with in the same way.
