When ye go abroad in the cause of Allah, investigate carefully, and say not to any one who offers you a salutation: "Thou art none of a believer!" Coveting the perishable goods of this life: with Allah are profits and spoils abundant. Even thus were ye yourselves before, till Allah conferred on you His favours: Therefore carefully investigate. For Allah is well aware of all that ye do.

When we faced the enemy; the Muslims retreated and I saw a pagan throwing himself over a Muslim. I turned around and came upon him from behind and hit him on the shoulder with the sword He i.e. the pagan came towards me and seized me so violently that I felt as if it were death itself; but death overtook him and he released me. I followed Umar Bin AlKhattab and asked him ; What is wrong with the people fleeing ? He replied; This is the Will of Allah; After the people returned; the Prophet ﷺ sat and said; Anyone who has killed an enemy and has a proof of that; will posses his spoils. I got up and said; Who will be a witness for me? and then sat down. The Prophet ﷺ again said; Anyone who has killed an enemy and has proof of that; will possess his spoils. I again got up and said; Who will be a witness for me? and sat down. Then the Prophet ﷺ said the same for the third time. I again got up; and Allah Messenger ﷺ said; O Abu Qatada! What is your story? Then I narrated the whole story to him. A man got up and said; O Allah Messenger ﷺ ! He is speaking the truth; and the spoils of the killed man are with me. So please compensate him on my behalf. On that Abu Bakr AlSiddiq said; No; by Allah; he i.e. Allah Messenger ﷺ will not agree to give you the spoils gained by one of Allah Lions who fights on the behalf of Allah and His Apostle. The Prophet ﷺ said; Abu Bakr has spoken the truth. So; Allah Messenger ﷺ gave the spoils to me. SahihAlBukhari-017-001-6655Narrated Abu Qatada: We set out along with the Prophet ﷺ during the year of the battle of Hunain; and when we faced the enemy; the Muslims with the exception of the Prophet ﷺ and some of his companions retreated before the enemy. I saw one of the pagans over-powering one of the Muslims; so I struck the pagan from behind his neck causing his armor to be cut off. The pagan headed towards me and pressed me so forcibly that I felt as if I was dying. Then death took him over and he released me. Afterwards I followed Umar and said to him; What is wrong with the people? He said; It is the Order of Allah. Then the Muslims returned to the battle after the flight and after overcoming the enemy the Prophet sat and said; Whoever had killed an Infidel and has an evidence to this issue; will have the Salb i.e. the belonging of the deceased e.g. clothes; arms; horse; etc. I stood up and said; Who will be my witness? and then sat down. Then the Prophet ﷺ repeated his question. Then the Prophet ﷺ said the same for the third time. I got up and said; Who will be my witness? and then sat down. The Prophet ﷺ asked his former question again. So I got up. The Prophet ﷺ said; What is the matter; O Abu Qatada? So I narrated the whole story; A man said; Abu Qatada has spoken the truth; and the Salb of the deceased is with me; so please compensate Abu Qatada on my behalf. Abu Bakr said; No! By Allah; it will never happen that the Prophet ﷺ will leave a Lion of Allah who fights for the Sake of Allah and His Apostle and give his spoils to you. The Prophet ﷺ said; Abu Bakr has spoken the truth. Give it the spoils back to him O man ! SahihAlBukhari-017-001-6656Narrated Abu Qatada: When it was the day of the battle of Hunain; I saw a Muslim man fighting with one of the pagans and another pagan was hiding himself behind the Muslim in order to kill him. So I hurried towards the pagan who was hiding behind the Muslim to kill him; and he raised his hand to hit me but I hit his hand and cut it off. That man got hold of me and pressed me so hard that I was afraid that I would die ; then he knelt down and his grip became loose and I pushed him and killed him. The Muslims excepting the Prophet ﷺ and some of his companions started fleeing and I too; fled with them. Suddenly I met Umar Bin AlKhattab amongst the people and I asked him; What is wrong with the people? He said; It is the order of Allah Then the people returned to Allah Messenger ﷺ after defeating the enemy. Allah Messenger ﷺ said; Whoever produces a proof that he has killed an infidel; will have the spoils of the killed man. So I got up to look for an evidence to prove that I had killed an infidel; but I could not find anyone to bear witness for me; so I sat down. Then it came to my mind that I should speak of it and I mentioned the case to Allah Messenger ﷺ. A man from the persons who were sitting with him i.e. the Prophet ; said; The arms of the deceased one whom he i.e. Abu Qatada has mentioned; are with me; so please compensate him for it i.e. the spoils ; Abu Bakr said; No; Allah Messenger ﷺ will not give it i.e. the spoils to a weak humble person from Quraish and leave one of Allah Lions who fights on behalf of Allah and His Apostle. SahihMuslim-017-001-17985It has been reported from Sulaiman Bin Buraida through his father that when the Messenger of Allah ﷺ appointed anyone as leader of an army or detachment he would especially exhort him to fear Allah and to be good to the Muslims who were with him. He would say: Fight in the name of Allah and in the way of Allah. Fight against those who disbelieve in Allah. Make a holy war; do not embezzle the spoils; do not break your pledge; and do not mutilate the dead bodies; do not kill the children. When you meet your enemies who are polytheists; invite them to three courses of action. If they respond to any one of these; you also accept it and withhold yourself from doing them any harm. Invite them to accept Islam; if they respond to you; accept it from them and desist from fighting against them. Then invite them to migrate from their lands to the land of the Muhajireen and inform them that; if they do so; they shall have all the privileges and obligations of the Muhajireen. If they refuse to migrate; tell them that they will have the status of Bedouin Muslims and will be subjected to the Commands of Allah like other Muslims; but they will not get any share from the spoils of war or Fai except when they actually fight with the Muslims against the disbelievers. If they refuse to accept Islam; demand from them the Jizya. If they agree to pay; accept it from them and hold off your hands. If they refuse to pay the tax; seek Allah help and fight them. When you lay siege to a fort and the besieged appeal to you for protection in the name of Allah and His Prophet; do not accord to them the guarantee of Allah and His Prophet; but accord to them your own guarantee and the guarantee of your companions for it is a lesser sin that the security given by you or your companions be disregarded than that the security granted in the name of Allah and His Prophet be violated. SahihMuslim-017-001-18018It has been narrated by Abu Huraira that the Messenger of Allah ﷺ said: One of the Prophets made a holy war. He said to his followers: One who has married a woman and wants to consummate to his marriage but has not yet done so; another who has built a house but has not yet erected its roof; and another who has bought goats and pregnantshe-camels and is waiting for their offspring-will not accommpany me. So he marched on and approached a village at or about the time of the Asr prayers. He said to the sun: Thou art subserviant to Allah and so am I. O Allah; stop it for me a little. It was stopped for him until Allah granted him victory. The people gathered the spoils of war at one place. A fire approached the spoils to devour them; but it did not devour them. He the Holy Prophet said: Some of you have been guilty of misappropriation. So one man from each tribe should swear fealty to me. The did so putting their hands into his. The hand of one man stuck to his hand and the Prophet ﷺ said: Your tribe is guilty of misappropriation. Let all the members of your tribe swear fealty to me one by one. They did so; when the hands of two or three persons got stuck with his hand. He said: You have misappropriated. So they took out gold equal in volume to the head of a cow. They-placed it among the spoils on the earth. Then the fire approached the spoils and devoured them. SahihMuslim-017-001-18304Abi Qilabah reported: I was in Syria having a circle of friends. in which was Muslim Bin Yasir. There came Ab AlAshath. He the narrator said that they the friends called him: Ab AlAshath; Ab AlAshath; and he sat down. I said to him: Narrate to our brother the hadith of Ubada Bin Samit. He said: Yes. We went out on an expedition; Muawiya being the leader of the people; and we gained a lot of spoils of war. And there was one silver utensil in what we took as spoils. Muawiya ordered a person to sell it for payment to the people soldiers. The people made haste in getting that. The news of this state of affairs reached Ubada Bin Samit; and he stood up and said: I heard Allah Messenger ﷺ forbidding the sale of gold by gold; and silver by silver; and wheat by wheat; and barley by barley; and dates by dates; and salt by salt; except like for like and equal for equal. So he who made an addition or who accepted an addition committed the sin of taking interest. So the people returned what they had got. This reached Muawiya. and he stood up to deliver an address. He said: What is the matter with people that they narrate from the Messenger ﷺ such tradition which we did not hear though we saw him the Holy Prophet and lived in his company? Thereupon; Ubida Bin Samit stood up and repeated that narration; and then said: We will definitely narrate what we heard from Allah Messenger ﷺ though it may be unpleasant to Muawiya or he said: Even if it is against his will. I do not mind if I do not remain in his troop in the dark night. SahihMuslim-017-001-19151Yusair Bin Jabir reported: Once there blew a red storm in Kufah that there came a person who had nothing to say but these words : Abdullah Bin Masud; the Last Hour has come. He Abdullah Bin Masud was sitting reclining against something; and he said: The Last Hour would not come until shares of inheritance are not distributed and there is no rejoicing over spoils of war. Then he said pointing towards Syria; with the gesture of his hand like this: The enemy shall muster strength against Muslims and the Muslims will muster strength against them Syrians. I said: You mean Rome? And he said: Yes; and there would be a terrible fight and the Muslims would prepare a detachment for fighting unto death which would not return but victorious. They will fight until night will intervene them; both the sides will return without being victorious and both will be wiped out. The Muslims will again prepare a detachment for fighting unto death so that they may not return but victorious. When it would be the fourth day; a new detachment out of the remnant of the Muslims would be prepared and Allah will decree that the enemy should be routed. And they would fight such a fight the like of which would not be seen; so much so that even if a bird were to pass their flanks; it would fall down dead before reaching the end of them. There would be such a large scale massacre that when counting would be done; only one out of a hundred men related to one another would be found alive. So what can be the joy at the spoils of such war and what inheritance would be divided! They would be in this very state that they would hear of a calamity more horrible than this. And a cry would reach them: The Dajjal has taken your place among your offspring. They will; therefore; throw away what would be in their hands and go forward sending ten horsemen; as a scouting party. Allah Messenger ﷺ said: I know their names and the names of their forefathers and the color of their horses. SahihMuslim-017-001-20647mousab Bin Saad reported on the authority of his father that many verses of the Quran had been revealed in connection with him. His mother Umm Saad had taken oath that she would never talk with him until he abandoned his faith and she neither ate nor drank and said: Allah has commanded you to treat well your parents and I am your mother and I command you to do this. She passed three days in this state until she fainted because of extreme hunger and at that time her son whose name was Umara stood up and served her drink and she began to curse Saad that Allah; the Exalted and Glorions; revealed these verses of the Holy Quran: And We have enjoined upon a person goodness to his parents but if they contend with thee to associate others with Me of which you have no knowledge; then obey them not xxix. 8 ; Treat thein with customary good in this world xxxi. 15. He also reported that there fell to the lot of Allah Messenger ﷺ huge spoils of war and there was one sword in them. I picked that up and came to Allah Messenger ﷺ and said: Bestow this sword upon me as my share in the spoils of war and you know my state. Thereupon he said: Return it to the place from where you picked it up. I went back until I decided to throw it in a store but my soul repulsed me so I came back and asked him to give that sword to me. He said in a loud voice to return it to the place from where I had picked it up. It was on this occasion that this verse was revealed: They asked about the spoils of war viii. 1. He further said: I once fell ill and sent a message to Allah Apostle ﷺ. He visited me and I said to him: Permit me to distribute in charity my property as much as I like. He did not agree. I said: Permit me to distribute half of it. He did not agree. I said: Permit me to distribute the third part; whereupon he kept quiet and it was after this that the distribution of one property in charity to the extent of one-third was held valid. He further said: I came to a group of persons of the Ansir and Muhajirin and they said: Come; so that we may serve you wine; and it was before the use of wine had been prohibited. I went to them in a garden and there had been with them the roasted head of a camel and a small water-skin containing wine. I ate and drank along with them and there came under discussion the Ansr Helpers and Muhajirin immigrants. I said: The immigrants are better than the Ansar; that a person picked up a portion of the head of the camel and struck me with it that my nose was injured. SahihMuslim-017-001-22076Anas Bin Malik reported: When Mecca was conquered; he the Holy Prophet distributed the spoils among the Quraish. Upon this the Ansar said: It is strange that our swords are dripping with their blood; whereas our spoils have been given to them to the Quraish. This remark reached the Messenger of Allah ﷺ ; and so he gathered them and said: What is this that has been conveyed to me about you? SahihMuslim-017-001-22077Anas Bin Malik reported that when it was the Day of Hunain there came the tribes of Hawazin; Ghatafan and others along with their children and animals; and there were with the Messenger of Allah ﷺ that day ten thousand soldiers ; and newly freed men of Mecca after its conquest. All these men once turned their backs; till he the Holy Prophet was left alone. He the Messenger of Allah on that day called twice and he did not interpose anything between these two announcements. He turned towards his right and said: O people of Ansar! They said: At thy beck and call are we ; Messenger of Allah. Be glad we are with thee. He then turned towards his left and said: O people of Ansar. They said: At thy beck and call are we. Be glad we are with thee. He the Holy Prophet was riding a white mule. He dismounted and said: I am the servant of Allah and His Apostle. The polytheists suffered defeat and the Messenger of Allah may peace he upon him acquired a large quantity of spoils; and he distributed them among the refugees and the people recently delivered of Mecca but did not give anything to the Ansar. The Ansar said: In the hour of distress it is we who are called for help. but the spoils are given to other people besides us. This remark reached him the Holy Prophet. and he gathered them In a tent. and said: What is this news that has reached me on your behalf? They kept silence. Upon this he said: O people of Ansar; dont you like that people should go away with worldly riches ; and you go away with Muhammad taking him to your houses? They said: Yes; happy we are. Messenger of Allah. He the Holy Prophet said: If the people were to tread a valley; and the Ansar were to tread a narrow path; I would take the narrow path of the Ansar. SahihMuslim-017-001-22083Abdullah reported: On the day of Hunain; the Messenger of Allah ﷺ showed preference to some people in the distribution of the spoils. He bestowed on Aqra Bin Habis one hundred camels; and bestowed an equal number upon Uyaina; and bestowed on people among the elites of Arabia; and preferred them to others on that day; in the distribution of spoils. Upon this a person said: By Allah; neither justice has been done in this distribution of spoils ; nor has the pleasure of Allah been sought in it. I the narrator said: By Allah; I will certainly inform the Messenger of Allah ﷺ about it. I came to him and informed him about what he had said. The colour of his the Prophets face changed red like blood and he then said: Who would do justice; if Allah and His Messenger do not do justice? He further said: May Allah have mercy upon Moses; he was tormented more than this; but he showed patience. SunanAlTermithi-017-001-7852Narrated Yazid Bin Hurmuz: That Najdah AlHaruri wrote to Ibn Abbas asking if the Messenger of Allah ﷺ would fight along with women; and if he would fix a share of the spoils of war for them. Ibn Abbas wrote to him: You wrote to me asking me if the Messenger of Allah ﷺ would fight along with women. He did fight along with them; as they would treat the wounded. They received something from the spoils of war; but as for their share; then he did not fix a share for them.There is something on this topic from Anas and Umm Atiyah.This Hadith isHassan Sahih. This is acted upon according to most of the people of knowledge. It is the view of Sufyan AlThawri and AlShafii. A man among those who did not go out said: We have not seen an expedition quicker in return or greater in spoils than this expedition. So the Messenger of Allah ﷺ said: Should I not direct you to a group greater in spoils and quicker in return? Then a man from Banu AlDubaib; who was called Rifaah Bin Zaid; gave the Messenger of Allah a black slave who was called Midam. The Messenger of Allah set out for Wadi AlQura. When we were in Wadi AlQura; while Midam was unloading the luggage of the Messenger of Allah; an arrow came and killed him. The people said: Congratulations! You will go to Paradise; but the Messenger of Allah said: No; by the One in Whose hand is my soul! The cloak that he took from the spoils of war on the Day of Khaibar is burning him with fire. SunanAlNasai-017-001-14272It was narrated from Amr Bin Shuaib; from his father; that his grandfather said: We were with the Messenger of Allah when the delegation of Hawazin came to him and said: O Muhammad! We are one of the Arab tribes and a calamity has befallen us of which you are well aware. Do us a favor; may Allah bless you. He said: Choose between your wealth or your women and children. They said: You have given us a choice between our families and our wealth; we choose our women and children. The Messenger of Allah said: As for that which was allocated to myself and to Banu Abd AlMuttalib; it is yours. When I have prayed Zuhr; stand up and say: We seek the help of the Messenger of Allah in dealing with the believers; or the Muslims; with regard to our women and children. So when they prayed Zuhr; they stood up and said that. The Messenger of Allah said: As for that which was allocated to myself and to Banu Abd AlMuttalib; it is yours. The Muhajirun said: That which was allocated to us is for the Messenger of Allah. The Ansar said: That which was allocated to us is for the Messenger of Allah. AlAqra Bin Habis said: As for myself and Banu Tamim; then no we will not give it up. Uyaynah Bin Housn said: As for myself and Banu Fazarah; then no we will not give it up. AlAbbas Bin Mirdas said: As for myself and Banu Sulaim; then no we will not give it up. Banu Sulaim stood up and said: You lied; whatever was allocated to us; it is for the Messenger of Allah. The Messenger of Allah said: O people; give their women and children back to them. Whoever gives back anything of these spoils of war; he will have six camels from the spoils of war that Allah grants us next. Then he mounted his riding-animal and the people surrounded him; saying: Distribute our spoils of war among us. They made him go back toward a tree on which his Rida upper-wrap got caught. He said: O people! Give me back my Rida. By Allah! If there were cattle as many in number as the trees of Tihamah I would distribute them among you; then you would not find me a miser; a coward or a liar. Then he went to a camel and took a hair from its hump between two of his fingers and said: Look! I do not have any of the spoils of war. All I have is the Khums; and the Khums will be given back to you. A man stood up holding a ball of yarn made from goat hair and said: O Messenger of Allah; I took this to fix my camel-saddle. He said: What was allocated to myself and to Banu Abd AlMuttalib is for you. He said: Is this so important? I dont need it! And he threw it down. He said: O people! Then the people returned and the Apostle of Allaah ﷺ sat down and said If anyone kills a man and can prove it; he will get his spoil. I stood up and said Who will testify for me? I then sat down. He said again If anyone kills a man and can prove it; he will get his spoil. I stood up and said Who will testify for me? I then sat down. He then said the same for the third time. I then stood up. The man for the reinforcement asked him for a part of its skin which he gave him. He made it like the shape of a shield. We went on and met the Byzantine armies. There was a man among them on a reddish horse with a golden saddle and golden weapons. This Byzantinian soldiers began to attack the Muslims desperately. The man for reinforcement sat behind a rock for attacking him. He hamstrung his horse and overpowered him and then killed him. He took his horse and weapons. When Allah; Most High; bestowed victory on the Muslims. Khalid Bin AlWalid sent for him and took his spoils. Awuf said I came to him and said Khalid; do you know that the Apostle of Allaah ﷺ had decided to give spoils to the killer? He said Yes; I thought it abundant. I said You should return it to him; or I shall tell you about it before the Apostle of Allaah ﷺ. But he refused to return it. Awuf said We then assembled with the Apostle of Allaah ﷺ. He said This sword is neither mine nor yours. I then went away saying today this will be given to a man who has not been put to trial like me. MuwataMalik-017-001-35425Malik said; I do not see that there is any harm in the Muslims eating whatever food they come across in enemy territory before the spoils are divided. Malik said; I think that any camels; cattle and sheep taken as booty are considered as food which the Muslims can eat in enemy territory. If they could not be eaten until the people had gathered for the division and the spoils had been distributed among them; that would be harmful for the army. I do not see any objection to eating such things within acceptable limits. I do not think; however; that anyone should store up any of it to take back to his family. Malik was asked whether it was proper for a man who obtained food in enemy territory and ate some of it and made provision so that there was some of it left over to keep and eat with his family; or to sell before he had come to his country and make use of its price. He said; If he sells it while he is on a military expedition; I think that he should put its price into the booty of the Muslims. Malik said; That is the best of what I have heard on the matter. Malik was asked about bonuses and whether they were taken from the first of the spoils; and he said; That is only decided according to the ijtihad of the Imam. We do not have a known reliable command about that other than it is up to the ijtihad of the Sultan. I have not heard that the Messenger of Allah; may Allah bless him and grant him peace; gave bonuses in all his raids. I have only heard that he gave bonuses in one of them; namely the day of Hunayn. MuwataMalik-017-001-35431Yahya related to me from Malik from Abdulrahman Ibn Said from Amr Ibn Shuayb that when the Messenger of Allah; may Allah bless him and grant him peace; came back from Hunayn heading for AlJiirrana; the people crowded around so much to question him that his camel backed into a tree; which became entangled in his cloak and pulled it off his back. The Messenger of Allah; may Allah bless him and grant him peace; said; Return my cloak to me. Are you afraid that I will not distribute among you what Allah has given you as spoils. By He in whose hand my self is! Had Allah given you spoils equal to the number of acacia trees on the plain of Tihama; I would have distributed it among you. You will not find me to be miserly; cowardly; or a liar. Then the Messenger of Allah; may Allah bless him and grant him peace; got down and stood among the people; and said; Hand over even the needle and thread; for stealing from the spoils is disgrace; fire; ignominy on the Day of Rising for people who do it. MuwataMalik-017-001-35801Yahya related to me from Malik that he had heard that Uthman Ibn Affan would sometimes never get down from the animal he was riding on when he was doing umra; until he had returned. Malik said; Umra is a sunna; and we do not know of any muslim who has ever said that it is permissible not to do it. Malik said; I do not think that anyone can do more than one umra in any one year. Malik said that someone doing umra who had sexual intercourse with his wife had to sacrifice an animal and do a second umra; which he had to begin when he had finished the one that he had spoiled. He should go into ihram at the same place where he went into ihram for the umra which he had spoiled; except if he had entered into ihram at a place further away than his miqat. This was because he only had to go into ihram from his miqat. Malik said; Someone who entered Makka to do umra; and does tawaf of the House and say between Safa and Marwa while he is junub; or not in Ablution; and afterwards has intercourse with his wife; and then remembers; should do ghusl; or Ablution; and then go back and do tawaf around the House and say between Safa and Marwa and do another umra and sacrifice an animal. A woman should do the same if her husband has intercourse with her while she is in ihram. Malik said; As for beginning umra at AlTanim; it is not the only alternative. MuwataMalik-017-001-35895Yahya related to me from Malik from Yahya Ibn Said that he heard Said Ibn AlMusayab asking a group of people; What do you think about someone who has intercourse with his wife while he is in ihram? and none of them answered him. Said said; There is a man who has had intercourse with his wife while in ihram who has sent a message to Madina asking about it. Some of them said; They should be kept apart until a future year; and Said Ibn AlMusayab said; They should carry on and complete the hajj which they have spoiled; and then return home when they have finished. If another hajj comes upon them; they must do hajj and sacrifice an animal. They should go into ihram at the same place where they went into ihram for the hajj that they spoiled; and they should keep apart until they have finished their hajj. Malik said; They should both sacrifice an animal. Malik said; about a man who had intercourse with his wife during hajj after he had come down from Arafa but before he had stoned the Jamra; He must sacrifice an animal and do hajj again in another year. If; however; he had intercourse with his wife after he stoned the Jamra; he only has to do an umra and sacrifice an animal and he does not have to do another hajj. Malik said; What spoils a hajj or an umra and makes sacrificing an animal and repeating the hajj necessary is the meeting of the two circumcised parts; even if there is no emission. It is also made necessary by an emission if it is the result of bodily contact. I do not think that a man who remembers something and has an emission owes anything; and if a man were to kiss his wife and no emission were to occur from that; he would only have to sacrifice an animal. A woman in ihram who has intercourse with her husband several times during hajj or umra out of obedience to him only has to do another hajj and sacrifice an animal. That is if her husband has intercourse with her while she is doing hajj.
