I had a wish of seeing a dream to narrate it to Allah Messenger ﷺ ﷺ I was a grown up boy and used to sleep in the Masjid in the lifetime of the Prophet. I saw in the dream that two angels caught hold of me and took me to the Fire which was built all round like a built well and had two poles in it and the people in it were known to me. I started saying; I seek refuge with Allah from the Fire. Then I met another angel who told me not to be afraid. I narrated the dream to Hafsa who told it to Allah Messenger ﷺ. The Prophet said; Abdullah is a good man. I wish he prayed Tahajjud. SahihAlBukhari-017-001-1070 | Narrated Ata Bin Yazid AlLaithi: On the authority of Abu Huraira: The people said; O Allah Messenger ﷺ ! Shall we see our Lord on the Day of Resurrection? The Prophet ﷺ said; Do you have any difficulty in seeing the moon on a full moon night? They said; No; O Allah Messenger ﷺ. He said; Do you have any difficulty in seeing the sun when there are no clouds? They said; No; O Allah Messenger ﷺ. He said; So you will see Him; like that. Allah will gather all the people on the Day of Resurrection; and say; Whoever worshipped something in the world should follow that thing ; so; whoever worshipped the sun will follow the sun; and whoever worshiped the moon will follow the moon; and whoever used to worship certain other false deities; he will follow those deities. And there will remain only this nation with its good people or its hypocrites. The sub-narrator; Ibrahim is in doubt. Allah will come to them and say; I am your Lord. They will deny Him and say; We will stay here till our Lord comes; for when our Lord comes; we will recognize Him. So Allah will come to them in His appearance which they know; and will say; I am your Lord. They will say; You are our Lord; so they will follow Him. Then a bridge will be laid across Hell Fire I and my followers will be the first ones to go across it and none will speak on that Day except the Apostles. And the invocation of the Apostles on that Day will be; O Allah; save! Save! In Hell or over The Bridge there will be hooks like the thorns of AlSadan thorny plant. Have you seen AlSadan? They replied; Yes; O Allah Messenger ﷺ ! He said; So those hooks look like the thorns of AlSadan; but none knows how big they are except Allah. Those hooks will snap the people away according to their deeds. Some of the people will stay in Hell be destroyed because of their evil deeds; and some will be cut or torn by the hooks and fall into Hell and some will be punished and then relieved. When Allah has finished His Judgments among the people; He will take whomever He will out of Hell through His Mercy. He will then order the angels to take out of the Fire all those who used to worship none but Allah from among those whom Allah wanted to be merciful to and those who testified in the world that none has the right to be worshipped but Allah. The angels will recognize them in the Fire by the marks of prostration on their foreheads ; for the Fire will eat up all the human body except the mark caused by prostration as Allah has forbidden the Fire to eat the mark of prostration. They will come out of the Hell Fire; completely burnt and then the water of life will be poured over them and they will grow under it as does a seed that comes in the mud of the torrent. Then Allah will finish the judgments among the people; and there will remain one man facing the Hell Fire and he will be the last person among the people of Hell to enter Paradise. He will say; O my Lord! Please turn my face away from the fire because its air has hurt me and its severe heat has burnt me. So he will invoke Allah in the way Allah will wish him to invoke; and then Allah will say to him; If I grant you that; will you then ask for anything else? He will reply; No; by Your Power; Honor I will not ask You for anything else. He will give his Lord whatever promises and covenants Allah will demand. So Allah will turn his face away from Hell Fire. When he will face Paradise and will see it; he will remain quiet for as long as Allah will wish him to remain quiet; then he will say; O my Lord! Bring me near to the gate of Paradise. Allah will say to him; Didnt you give your promises and covenants that you would never ask for anything more than what you had been given? Woe on you; O Adam son! How treacherous you are! He will say; O my lord; and will keep on invoking Allah till He says to him; If I give what you are asking; will you then ask for anything else? He will reply; No; by Your Honor Power; I will not ask for anything else. Then he will give covenants and promises to Allah and then Allah will bring him near to the gate of Paradise. When he stands at the gate of Paradise; Paradise will be opened and spread before him; and he will see its splendor and pleasures whereupon he will remain quiet as long as Allah will wish him to remain quiet; and then he will say; O my Lord! Admit me into Paradise. Allah will say; Didnt you give your covenants and promises that you would not ask for anything more than what you had been given? Allah will say; Woe on you; O Adam son! How treacherous you are! The man will say; O my Lord! Do not make me the most miserable of Your creation; and he will keep on invoking Allah till Allah will laugh because of his sayings; and when Allah will laugh because of him; He will say to him; Enter Paradise; and when he will enter it; Allah will say to him; Wish for anything. So he will ask his Lord; and he will wish for a great number of things; for Allah Himself will remind him to wish for certain things by saying; Wish for so-and-so. When there is nothing more to wish for; Allah will say; This is for you; and its equal is for you as well. Ata Bin Yazid added: Abu Saeed AlKhudri who was present with Abu Huraira; did not deny whatever the latter said; but when Abu Huraira said that Allah had said; That is for you and its equal as well; Abu Saeed AlKhudri said; And ten times as much; O Abu Huraira! Abu Huraira said; I do not remember; except his saying; That is for you and its equal as well. Abu Saeed AlKhudri then said; I testify that I remember the Prophet ﷺ saying; That is for you; and ten times as much. SahihAlBukhari-017-001-1308 | Narrated Ubada Bin AlSamit: Allah Messenger ﷺ said to us while we were in a gathering; Give me the oath Pledge of allegiance for: 1 Not to join anything in worship along with Allah; 2 Not to steal; 3 Not to commit illegal sexual intercourse; 4 Not to kill your children; 5 Not to accuse an innocent person to spread such an accusation among people ; 6 Not to be disobedient when ordered to do good deeds. The Prophet ﷺ added: Whoever amongst you fulfill his pledge; his reward will be with Allah; and whoever commits any of those sins and receives the legal punishment in this world for that sin; then that punishment will be an expiation for that sin; and whoever commits any of those sins and Allah does not expose him; then it is up to Allah if He wishes He will punish him or if He wishes; He will forgive him. By Allah; I think that you wish for my death; and if that should happen then you would be busy enjoying the company of one of your wives in the last part of that day. He said; Do you crowd and squeeze each other on looking at the sun when it is not hidden by clouds? They replied; No; Allah Messenger ﷺ. He added; So the hooks over that bridge will be like the thorns of AlSa-dan except that their greatness in size is only known to Allah. These hooks will snatch the people according to their deeds. Some people will be ruined because of their evil deeds; and some will be cut into pieces and fall down in Hell; but will be saved afterwards; when Allah has finished the judgments among His slaves; and intends to take out of the Fire whoever He wishes to take out from among those who used to testify that none had the right to be worshipped but Allah. We will order the angels to take them out and the angels will know them by the mark of the traces of prostration on their foreheads for Allah banned the f ire to consume the traces of prostration on the body of Adam son. So they will take them out; and by then they would have burnt as coal ; and then water; called Maul Hayat water of life will be poured on them; and they will spring out like a seed springs out on the bank of a rainwater stream; and there will remain one man who will be facing the Hell Fire and will say; O Lord! It Hells vapor has Poisoned and smoked me and its flame has burnt me; please turn my face away from the Fire. He will keep on invoking Allah till Allah says; Perhaps; if I give you what you want ; you will ask for another thing? The man will say; No; by Your Power; I will not ask You for anything else. Then Allah will turn his face away from the Fire. The man will say after that; O Lord; bring me near the gate of Paradise. Allah will say to him ; Didnt you promise not to ask for anything else? Woe to you; O son of Adam ! How treacherous you are! The man will keep on invoking Allah till Allah will say; But if I give you that; you may ask me for something else. The man will say; No; by Your Power. I will not ask for anything else. He will give Allah his covenant and promise not to ask for anything else after that. So Allah will bring him near to the gate of Paradise; and when he sees what is in it; he will remain silent as long as Allah will; and then he will say; O Lord! Let me enter Paradise. SahihMuslim-017-001-17759 | It has been narrated on the authority of Abdulrahman Bin Abd Rabb AlKaba who said: I entered the Masjid when Abdullah Bin Amr Bin AlAs was sitting in the shade of the Kaba and the people had gathered around him. I betook myself to them and sat near him. Now Abdullah said: I accompanied the Messenger of Allah ﷺ on a journey. We halted at a place. Some of us began to set right their tents; others began to compete with one another in shooting; and others began to graze their beasts; when an announcer of the Messenger of Allah ﷺ announced that the people should gather together for prayer; so we gathered around the Messenger of Allah ﷺ. He said: It was the duty of every Prophet that has gone before me to guide his followers to what he knew was good for them and warn them against what he knew was bad for them; but this Umma of yours has its days of peace and security in the beginning of its career; and in the last phase of its existence it will be afflicted with trials and with things disagreeable to you. In this phase of the Umma ; there will be tremendous trials one after the other; each making the previous one dwindle into insignificance. When they would be afflicted with a trial; the believer would say: This is going to bring about my destruction. When at the trial is over; they would be afflicted with another trial; and the believer would say: This surely is going to be my end. Whoever wishes to be delivered from the fire and enter the garden should die with faith in Allah and the Last Day and should treat the people as he wishes to be treated by them. He who swears allegiance to a Caliph should give him the piedge of his hand and the sincerity of his heart i. e. submit to him both outwardly as well as inwardly. He should obey him to the best of his capacity. It another man comes forward as a claimant to Caliphate ; disputing his authority; they the Muslims should behead the latter. The narrator says: I came close to him Abdullah Bin Amr Bin AlAs and said to him: Can you say on oath that you heard it from the Messenger of Allah ﷺ ? He pointed with his hands to his ears and his heart and said: My ears heard it and my mind retained it. I said to him: This cousin of yours; Muawiya; orders us to unjustly consume our wealth among ourselves and to kill one another; while Allah says: O ye who believe; do not consume your wealth among yourselves unjustly; unless it be trade based on mutual agreement; and do not kill yourselves. Verily; God is Merciful to you iv. 29. SahihMuslim-017-001-18565 | It is narrated on the authority of Usama Bin Zaid that the Messenger of Allah ﷺ sent us in a raiding party. We raided Huraqat of Juhaina in the morning. I caught hold of a man and he said: There is no god but Allah; I attacked him with a spear. It once occurred to me and I talked about it to the Apostle ﷺ. The Messenger of Allah ﷺ said: Did he profess There is no god but Allah; and even then you killed him? I said: Messenger of Allah; he made a profession of it out of the fear of the weapon. He the Holy Prophet observed: Did you tear his heart in order to find out whether it had professed or not? And he went on repeating it to me till I wished I had embraced Islam that day. Saad said: By Allah; I would never kill any Muslim so long as a person with a heavy belly; i. e.; Usama; would not kill. Upon this a person remarked: Did Allah not say this: And fight them until there is no more mischief and religion is wholly for Allah? SahihMuslim-017-001-18740 | Abu Haraira reported: The people said to the Messenger of Allah ﷺ : Messenger of Allah; shall we see our Lord on the Day of Resurrection? The Messenger of Allah ﷺ said: Do you feel any trouble in seeing the moon on the night when it is full? They said: Messenger of Allah; no. He the Messenger further said: Do you feel any trouble in seeing the sun; when there is no cloud over it? They said: Messenger of Allah. no. He the Holy Prophet said: Verily you would see Him like this as you see the sun and the moon. God will gather people on the Day of Resurrection and say: Let every people follow what they worshipped. Those who worshipped the sun would follow the sun; and those who worshipped the moon would follow the moon; and those who worshipped the devils would follow the devils. This Ummah of Islam alone would be left behind and there would be hypocrites too amongst it. Allah would then come to them in a form other than His own Form; recognisable to them; and would say: I am your Lord. They would say: We take refuge with Allah from thee. We will stay here till our Lord comes to us. and when our Lord would come we would recognise Him. Subsequently Allah would come to them in His own Form; recognisable to them; and say: I am your Lord. They would say: Thou art our Lord. And they would follow Him; and a bridge would be set over the Hell; and I the Holy Prophet and my Ummah would be the first to pass over it; and none but the messengers would speak on that day; and the prayer of the messengers on that day would be: O Allah! grant safety; grant safety. In Hell; there would be long spits like the thorns of Sadan He the Holy Prophet said: Have you seen Sadan? They replied: Yes; Messenger of Allah. He said: Verily those hooks would be like the thorns of Sadan; but no one knows their size except Allah. These would seize people for their misdeeds. Some of them would escape for their good deeds; and some would be rewarded for their deeds till they get salvation. When Allah would finish judging His bondsmen and because of His mercy decide to take out of Hell such people as He pleases. He would command the angels to bring out those who had not associated anything with Allah; to whom Allah decided to show mercy. those who would say: There is no god but Allah. They the angels would recognise them in the Fire by the marks of prostration; for Hell-fire will devour everything limb of the sons of Adam except the marks of prostration. Allah has forbidden the fire to consume the marks of prostration. They will be taken out of the Fire having been burnt; and the water of life would be poured over them; and they will sprout as seed does In the silt carried by flood. Then Allah would finish judging amongst His bondsmen; but a man who will be the last to enter Paradise will remain facing Hell and will say: O my Lord I turn my face away from Hell; for its air has poisoned me ard its blaze has burnt me. He will then call to Allah as long as Allah would wish that he should call to Him. Then Allah; Blessed and Exalted; would say: If I did that; perhaps you would ask for more than that. He would say: I would not ask You more than this; and he would give his Lord covenants and agreements as Allah wished; and so He would turn his face away from the Fire When he turns towards the Paradise and sees it; he will remain silent as long as Allah wishes him to remain so. He will then say: O my Lord I bring me forward to the gate of the Paradise. Allah would say to him: Did you not give covenants and agreements that you would not ask for anything besides what I had given you. Woe to thee! O son of Adam; how treacherous you are! He would say: O my Lord! and would continue calling to Allah till He would say to him: If I grant you that; perhaps you will ask for more. He will reply: No; by Thy greatness; and he will give His Lord promises and covenants as Allah had wished. He would then bring him to the gate of the Paradise; and when he would stand at the gate of the Paradise; it would lay open before him. and he would see the bounty and the joy that there is in it. He would remain quiet as long as Allah would desire him to remain silent. He would then say: O my Lord; admit me to Paradise. Allah. Blessed and Exalted; would say: Did you not give covenants and agreements that you would not ask for anything more than what I had granted you? Woe to you! son of Adam; how treacherous you are! And he would say: O my Lord; I do not wish to be the most miserable of Thy creatures. He would continue calling upon Allah till Allah; Blessed and Exalted; would laugh. When Allah would laugh at him; He would say: Enter the Paradise. When he would enter; Allah would say: State your wish. He would express his wishes till Allah would remind him the desire of such and such things. When his desires would be exhausted Allah would say: That is for thee and; besides it; the like of it also. Ata Bin Yazid said: Abu Saeed AlKhudri was with Abu Huraira and be did not reject anything from the hadith narrated by him; but when Abu Huraira narrated: Allah said to that man; ind its like along with it; Abu Saeed said: Ten like it along with it; O Abu Huraira. Abu Huraira said: I do not remember except the words: That is for you and a similar one along with it. Abu Saeed said: I bear witness to the fact that I remembered from the Messenger of Allah ﷺ his words: That is for thee and ten like it. SahihMuslim-017-001-20169 | Saeed Bin jubair reported: I said to Ibn Abbas that Nauf AlBikali was of the opinion that Moses ﷺ ; the Apostle of Bani Israil; was not the same who accompanied Khadir; whereupon he said: The enemy of Allah tells a lie. I heard Ubay Bin Kaab say: Moses ﷺ stood up to give sermon to the people of Israil. He was asked as to who amongst the people has the best knowledge; whereupon he said: I have the best knowledge. Thereupon Allah was annoyed with him that he did not attribute the best knowledge to Him. He revealed to him: A servant amongst My servants is at the junction of two rivers who has more knowledge than yours. Moses said: How can I meet him? It was said to him: Carry a fish in the large basket and the place where you find it missing there you will find him. Thereupon Moses proceeded forth along with a young man Yusha. Joshua Bin Nan and Moses ﷺ put the fish in the basket and there went along with him the young man Yusha until they came to a certain rock and Moses and his companion went to sleep and the fish stirred in that basket and fell into the ocean and Allah stopped the current of water like a vault until the way was made for the fish. Moses and his youn. companion were astonished and they walked for the rest of the day and the night and the friend of Moses forgot to inform him of this incident. When it was morning; Moses ﷺ said to the young man: Bring for us the breakfast for we are dead tired because of this journey; and they did not feel exhausted until they had passed that place where they had been commanded to stay. He said: Dont you know that when we reached the Sakhra rock I forgot the fisii and noth ng made me forget it but the satan that I. could nit remember it? How strange is it that the fish found a way in the river? Moses said: That was what we had been aiming at. Then both of them retraced their steps until they reached Sakhra; there they saw a man covered with a cloth. Moses greeted him. Khadir said to him: Where is AlSalam in our country.? He said: I am Moses; whereupon he Khadir said: You mean the Moses of Bani Israil? He said: Yes. He Khadir said: You have a knowledge out of the knowledge of Allah which in fact Allah imparted to you and about that I know nothing and I have knowledge out of Allah knowledge which He imparted to me and about that you do not know. Moses ﷺ said to him: May I follow you so that you may teach me that with which you have been taught righteousness. He said: You will not be able to bear with me; how you will be able to bear that about which you do not know? Moses said: Thou wilt find me patient; nor shalt I disobey you in aught. Khadir said to him: If you were to follow me; then do not ask me about anything until I myself speak to you about it. He said: Yes. So Khadir and Moses set forth on the bank of the river that there came before them a boat. Both of theni talked to them the owners of the boat so that they might carry both of them. They had recognised Khadir and they carried them free. Khadir thereupon took hold of a plank in the boat and broke it away. Moses said: These people have carried us without any charge and you attempt to break their boat so that the people sailing in the boat may drown. This is something grievous that you have done. He said: Did I not say that you would not bear with me? He said: Blame me not for what I forgot and be not hard upon what I did. Then both of them got down from the boat and began to walk along the coastline that they saw a boy who had been playing with other boys. Khadir pulled up his head and killed him. Moses said: Have you killed an innocent person who is in no way guilty of slaying another? You have done something horrible. Thereupon he said: Did I not say to you that you will not be able to bear with me? He Moses said: This act is more grievous than the first one. He Moses further said. If I ask you about anything after this; keep not company with me; then you would no doubt find a plausible excuse for this. Then they both walked on until they reached the inhabitants of a village. They asked its inhabitants for food but they refused to entertain them as their guests. They found in it a wall which had been bent on one side and was about to fall. Khadir set it right with his own hand. Moses; said to him: It is the people to whom we came but they showed us no hospitality and they did not serve us food. If you wish you can get wages for it. He Khadir said: This is the parting of ways between mt and you. Now I wish to reveal to you the significance of that for which you could not bear with me. Allah Messenger ﷺ said. May Allah have mercy upon Moses! I wish if Moses could show patience and a fuller story of both of them could have been told. Allah Messenger ﷺ said that the first thing which Moses said was out of forgetfulness. Then there came a sparrow until it perched on the wall of the boat and took water from the ocean. Then came Umar and he sought permission and it was granted to him; and he found Allah Apostle ﷺ sitting sad and silent with his wives around him. Then this verse was revealed to him: Prophet: Say to thy wives... for a mighty reward xxxiii. 28. He then went first to Aisha Allah be pleased with her and said: I want to propound something to you; Aisha; but wish no hasty reply before you consult your parents. She said: Messenger of Allah; what is that? He the Holy Prophet recited to her the verse; whereupon she said: Is it about you that I should consult my parents; Messenger of Allah? Nay; I choose Allah; His Messenger; and the Last Abode; but I ask you not to tell any of your wives what I have said He replied: Not one of them will ask me without my informing her. SunanAlNasai-017-001-12024 | It was narrated that Ibn Abbas said: The first instance of Qasamah during the Aljahiliyah involved a man from Banu Hashim who was employed by a man from Quraish; from another branch of the tribe. He went out with him; driving his camels and another man from Banu Hashim passed by them. The leather rope of that man bag broke; so he said to the hired worker : Help me by giving me a rope with which to tie the handle of my bag; lest the camels run away from me. So he gave him a rope and he tied his gab with it. When they halted; all the camels legs were hobbled except one camel. The one who had hired him said: Why is his camel; out of all of them; not hobbled? He said: There is no rope for it. He said: Where is its rope? He said: A man from Banu Hashim passed by and the leather rope of his bag had broken; and he asked me to help him; he said: Help me by giving me a rope with which to tie the handle of my bag lest the camels run away from me; so I gave him a rope. He struck him with a stick; which led to his death.Then a man from Yemen passed by him the man from Banu Hashim; the man from Banu Hashim; just before he died and he the Hashimi man said: Are you going to attend the Pilgrimage? He said: I do not think I will attend it; but perhaps I will attend it. He said: Will you convey a message from me once in your lifetime? He said: Yes. He said: If you attend the pilgrimage; then call out; O family of Quraish! If they respond; then call out; O family of Hashim! If they respond; then ask for Abu Talib; and tell him that so and so killed me for a rope. Then the hired worker died. When the one who had hired him cam; Abu Talib went to him and said: What happened to our companion? He said: He fell sick and I took good care of him; but he died; so I stopped and buried him. He said: He deserved that from you. Some time passed; then the Yemeni man who had been asked to convey the message arrived at the time of the pilgrimage. He said: O family of Quraish! And they said: Here is Quraish. He said: O family of Banu Hashim! They said: Here is Banu Hashim. He said Where is Abu Talib? He said: Here is Abu Talib. He said: so and so asked me to convey a message to you; that so and so killed him for a camel rope. Abu Talib went to him and said Choose one of three alternatives that we are offering you. If you wish; you may give us one hundred camels; because you killed our companion by mistake: or if you wish; fifty of your men may swear an oath that you did not kill him; or if you wish; we will kill you in retaliation. He went to his people and told them about that; and they said: We will swear the oath. Then a woman from Banu Hashim; who was married to one of their men and had born him a child; came to Abu Talib and said: O Abu Talib; I wish that my son; who is one of these fifty men; should be excused from having to take the oath.; So the excused him. Then one of the men came to him and said: O Abu Talib; you want fifty men to take the oath in lieu of one hundred camels; which means that each man may give two camels instead; so here are two camels; take them from me; and do not make me take the oath. So he accepted them; and did not make him take the oath. Then forty-eight men came and took the oath. Then Marwan wrote saying that to me Usaid. I wrote to Marwan saying that the Prophet had ruled that if the one who bought it from the one who stole it is ot guilty of anything and did not realize that it was stolen goods ; then the owner has the choice: If he wishes; he may buy it from the one who bought it from the thief; or if he wishes he may go after the thief. SunanAbuDawoud-017-001-29279 | Abdullah Bin Umar reported that Umar said When Khaibar was conquered; the Jews asked the Apostle of Allaah ﷺ to confirm that they would do all the cultivation and have half the produce. The Apostle of Allaah ﷺ said I shall confirm you on that condition as long as we wish. So they were confirmed on that condition. The dates from half the produce of Khaibar were divided into a number of portions. The Apostle of Allaah ﷺ would take the fifth. MuwataMalik-017-001-34743 | Yahya said that Malik said; The way of doing things in our community about which there is no dispute is that women do not swear in the swearing for the intentional act. If the murdered man only has female relatives; the women have no right to swear for blood and no pardon in murder. Yahya said that Malik said about a man who is murdered; If the paternal relatives of the murdered man or his mawali say; We swear and we demand our companion blood; that is their right. Malik said; If the women want to pardon him; they cannot do that. The paternal relatives and mawali are entitled to do that more than them because they are the ones who demand blood and swear for it. Malik said; If the paternal relatives or mawali pardon after they demand blood and the women refuse and say; We will not abandon our right against the murderer of our companion; the women are more entitled to that because whoever takes retaliation is more entitled than the one who leaves it among the women and paternal relatives when the murder is established and killing obliged. Malik said; At least two claimants must swear in murder. The oaths are repeated by them until they swear fifty oaths; then they have the right to blood. That is how things are done in our community. Malik said; When people beat a man and he dies in their hands; they are all slain for him. If he dies after their beating; there is swearing. If there is swearing; it is only against one man and only he is slain. We have never known the swearing to be against more than one man. Malik spoke about a slave who had his hand or foot broken and then the break mended. He said; The one who injured him is not obliged to pay anything. If that break causes him loss or scar; the one who injured him must pay according to what he diminished of the value of the slave. Malik said; What is done in our community about retaliation between slaves is that it is like retaliation between freemen. The life of the slave-girl for the life of the slave; and her injury for his injury. When a slave intentionally kills a slave; the master of the murdered slave has a choice. If he wishes; he kills him; and if he wishes; he takes the blood-money. If he takes the blood-money; he takes the value of his slave. If the owner of the slave who killed wishes to give the value of the murdered slave; he does it. If he wishes; he surrenders his slave. If he surrenders him; he is not obliged to do anything other than that. When the owner of the murdered slave takes the slave who murdered and is satisifed with him; he must not kill him. All retaliations between slaves for cutting off of the hand and foot and such things are dealt with in the same way as in the murder. Malik said about a muslim slave who injures a jew or christian; If the master of the slave wishes to pay blood-money for him according to the injury; he does it. Or else he surrenders him and he is sold; and the jew or christian is given the blood-money of the injury or all the price of the slave if the blood-money is greater than his price. MuwataMalik-017-001-34890 | Yahya said that he heard Malik say; This ayat is abrogated. It is the word of Allah; the Blessed; the Exalted; If he leaves goods; the testament is for parents and kinsmen. What came down about the division of the fixed shares of inheritance in the Book of Allah; the Mighty; the Exalted; abrogated it. Yahya said that he heard Malik say; The established sunna with us; in which there is no dispute; is that it is not permitted for a testator to make a bequest in addition to the fixed share in favour of an heir; unless the other heirs permit him. If some of them permit him and others refuse; he is allowed to diminish the share of those who have given their permission. Those who refuse take their full share from the inheritance. Yahya said that he heard Malik speak about an invalid who made a bequest and asked his heirs to give him permission to make a bequest when he was so ill that he only had command of a third of his property; and they gave him permission to leave some of his heirs more than his third. Malik said; They cannot revoke that. Had they been permitted to do so; every heir would have done that; and then; when the testator died; they would take that for themselves and prevent him from bequeathing his third and what was permitted to him with respect to his property. Malik said; If he asks permission of his heirs to grant a bequest to an heir while he is well and they give him permission; that is not binding on them. The heirs can rescind that if they wish. That is because when a man is well; he is entitled to all his property and can do what he wishes with it. If he wishes; he can spend all of it. He can spend it and give sadaqa with it or give it to whomever he likes. His asking permission of his heirs is permitted for the heirs; when they give him permission when authority over all his property is closed off from him and nothing outside of the third is permitted to him; and when they are more entitled to the two-thirds of his property than he is himself. That is when their permission becomes relevant. If he asks one of the heirs to give his inheritance to him when he is dying; and the heir agrees and then the dying man does not dispose of it at all; it is returned to the one who gave it unless the deceased said to him; So-and-so - one of his heirs - is weak; and I would like you to give him your inheritance. So he gives it to him. That is permitted when the deceased specified it for him. Malik said; When a man gives the dying man free use of his share of the inheritance; and the dying man distributes some of it and some remains; it is returned to the giver; after the man has died. Yahya said that he heard Malik speak about someone who made a bequest and mentioned that he had given one of his heirs something which he had not taken possession of; so the heirs refused to permit that. That is against the slave person and does not exceed the price of the slave whether it is little or much. If his master wishes to give the value of what the slave took or ruined; or pay the blood-price for the injury; he pays it and keeps his slave. MuwataMalik-017-001-34950 | Yahya said that he heard Malik say; If a man buys a garment which has a defect; a burn or something else; which the seller knows about and that is testified against him or he confirms it; and the man who has bought it causes a new tear which decreases the price of the garment; and then he learns about the original defect; he can return it to the seller and he is not liable for his tearing it. If a man buys a garment which has a defect of a burn or flaw; and the one who sold it to him claims that he did not know about it; and the buyer has cut the garment or dyed it; then the buyer has an option. If he wishes; he can have a reduction according to what the burn or flaw detracts from the price of the garment and he can keep the garment; or if he wishes to pay damages for what the cutting or dyeing has decreased of the price of the garment and return it; he can do so. If the buyer has dyed the garment with a dye which increases the value; the buyer has an option. If he wishes; he has a reduction from the price of the garment according to what the defect diminishes or if he wishes to become a partner with the one who sold the garment he does so. The price of the garment with a burn or flaw is looked at. If the price is ten dirhams; and the amount by which the dyeing increased the value is five dirhams; then they are partners in the garment; each according to his share. Malik spoke about an investor who paid a man qirad money and the man told him that it was collected with him and asked him to write it for him as a loan. He said; I do not like that unless he takes his money from him and then lends it to him or keeps it as he wishes. That is only out of fear that he has lost some of it; and wants to defer it so that he can make up what has been lost of it. MuwataMalik-017-001-35037 | Yahya related to me from Malik from Nafi that Abdullah Ibn Umar would say; A man should not have intercourse with a slave girl except one whom; if he wished; he could sell; if he wished; he could give away; if he wished; he could keep; if he wished; he could do with her what he wanted. Malik said that a man who bought a slave- girl on condition that he did not sell her; give her away; or do something of that nature; was not to have intercourse with her. That was because he was not permitted to sell her or to give her away; so if he did not own that from her; he did not have complete ownership of her because an exception had been made concerning her by the hand of someone else. MuwataMalik-017-001-35110 | Yahya related to me; that Malik said; The generally agreed on way of doing things among us about a man buying cloth in one city; and then taking it to another city to sell as a murabaha; is that he is not reckoned to have the wage of an agent; or any allowance for ironing; folding; straightening; expenses; or the rent of a house. As for the cost of transporting the drapery; it is included in the basic price; and no share of the profit is allocated to it unless the agent tells all of that to the investor. If they agree to share the profits accordingly after knowledge of it; there is no harm in that. Malik said; As for bleaching; tailoring; dyeing; and such things; they are treated in the same way as drapery. The profit is reckoned in them as it is reckoned in drapery goods. So if he sells the drapery goods without clarifying the things we named as not getting profit; and if the drapery has already gone; the transport is to be reckoned; but no profit is given. If the drapery goods have not gone the transaction between them is null and void unless they make a new mutual agreement on what is to be permitted between them. Malik spoke about an agent who bought goods for gold or silver; and the exchange rate on the day of purchase was ten dirhams to the dinar. He took them to a city to sell murabaha; or sold them where he purchased them according to the exchange rate of the day on which he sold them. If he bought them for dirhams and he sold them for dinars; or he bought them for dinars and he sold them for dirhams; and the goods had not gone then he had a choice. If he wished; he accepted to sell the goods and if he wished; he left them. If the goods had been sold; he had the price for which the salesman bought them; and the salesman was reckoned to have the profit on what they were bought for; over what the investor gained as profit. Malik said; If a man sells goods worth one hundred dinars for one hundred and ten; and he hears after that they are worth ninety dinars; and the goods have gone; the seller has a choice. If he likes; he has the price of the goods on the day they were taken from him unless the price is more than the price for which he was obliged to sell them in the first place; and he does not have more than that - and it is one hundred and ten dinars. If he likes; it is counted as profit against ninety unless the price his goods reached was less than the value. He is given the choice between what his goods fetch and the capital plus the profit; which is ninety-nine dinars. Malik said; If someone sells goods in murabaha and he says; It was valued at one hundred dinars to me. Then he hears later on; that it was worth one hundred and twenty dinars; the customer is given the choice. If he wishes; he gives the salesman the value of the goods on the day he took them; and if he wishes; he gives the price for which he bought them according to the reckoning of what profit he gives him; as far as it goes; unless that is less than the price for which he bought them; for he should not give the owner of the goods a loss from the price for which he bought them because he was satisfied with that. His wife then went back to Umm Salamah and found the Messenger of Allah; may Allah bless him and grant him peace; with her.
