SahihAlBukhari-017-001-2422 | Narrated Abu Said: A group of the companions of Allah Messenger ﷺ proceeded on a journey till they dismounted near one of the Arab tribes and requested them to entertain them as their guests; but they the tribe people refused to entertain them. Then the chief of that tribe was bitten by a snake or stung by a scorpion and he was given all sorts of treatment; but all in vain. Some of them said; Will you go to the group those travelers who have dismounted near you and see if one of them has something useful? They came to them and said; O the group! Our leader has been bitten by a snake or stung by a scorpion and we have treated him with everything but nothing benefited him Has anyone of you anything useful? One of them replied; Yes; by Allah; I know how to treat with a Ruqya. But. by Allah; we wanted you to receive us as your guests but you refused. I will not treat your patient with a Ruqya till you fix for us something as wages. Consequently they agreed to give those travellers a flock of sheep. The man went with them the people of the tribe and started spitting on the bite and reciting Surat AlFatiha till the patient was healed and started walking as if he had not been sick. When the tribe people paid them their wages they had agreed upon; some of them the Prophet companions said; Distribute the sheep. But the one who treated with the Ruqya said; Do not do that till we go to Allah Apostle and mention to him what has happened; and see what he will order us. So they came to Allah Messenger ﷺ and mentioned the story to him and he said; How do you know that Surat AlFatiha is a Ruqya? You have done the right thing. Behold! there would be turmoil in which the one who would be seated would be better than one who would stand and the one who would stand would be better than one who would run. Behold! when the turmoil comes or it appears; the one who has camel should stick to his camel and he who has sheep or goat should stick to his sheep and goat and he who has land should stick to the land. A person said: Allah Messenger; what is your opinion about one who has neither camel nor sheep nor land? Thereupon; he said: He should take hold of his sword and beat its edge with the help of stone and then try to find a way of escape. O Allah; I have conveyed Thy Message ; O Allah; I have conveyed Thy Message ; O Allah; I have conveyed Thy Message. He slaughtered a sheep for them and after they had eaten of it and of the bunch and drank; and when they had taken their fill and had been fully satisfied with the drink; Allah Messenger ﷺ said to Abu Bakr and Umar: By Him in Whose Hand is my life; you will certainly be questioned about this bounty on the Day of judgment. In the event that a person does not have a camel of the age specified according to the Hiaqah regulations; then if a person owes a Jadhah as Sadaqah but he does not have a Jadhah; then a Hiqqah should be accepted from him; and he should give two sheep along with it if they are available; or twenty Dirhams; If he owes a Hiqqah as Sadaqah and he does not have Hiqqah but he has a Jadhah; then if should be accepted from him; and the Zakah collector should give him twenty Dirhams; or two sheep if they are available. If a person owes a Hiqqah as Sadaqah and he does not have one; but he has a Bint Labun; it should be accepted from him; and he should give two sheep along with it if they are available; or twenty Dirhams. If a person owes a Bint Labun as Sadaqah but he only has a Hiqaah; then it should be accepted from him and the Zakah collector should give him twenty Dirhams; or two sheep. If a person owes a Bint Labun as Sadaqah but he only has a Bint Makhad; then it should be accepted from him; and he should be accepted from him; and he should give two sheep along with it if they are available; or twenty Dirhams. If a person owes a Bint Makhad as Sadaqah but he only has a Bint Labun; a male; it should be accepted from him; and he does not have to give anything else along with it. If a person has only four camels he does not have to give anything unless their owner wants to. With regard to the Sadaqah on grazing sheep; if there are forty; then one sheep is due upon them; up to one hundred and twenty. If there is one more; then two sheep are due; up to two hundred. If there is one more; then three sheep are due; up to three hundred. If there are more than that; then for every hundred; one sheep is due. No feeble; defective or male sheep should be taken as Sadaqah unless the Zakah collector wishes. Do not combine separate flocks or separate combined flocks for fear of Sadaqah. Each partner who has a share in a combined flock should pay the Sadaqah in proportion to his shares. If a man flock is one less than forty sheep; then nothing is due from them; unless their owner wishes. If a Bint Makhad a one-year-old male camel. If the number reaches thirty-six; then a Bint Labun a two-year-old camel is due; up to forty five. If the number reaches forty-six; then a Hiqqah a three year old camel that was bred by a stallion camel is due; up to sixty. If the number reaches sixty-one; then a Jadhah a four-year-old camel is due; up to seventy-five. If the number reaches seventy-six; then two Bint Labun are due; up to ninety. If the number reaches ninety-one; then two Hiqqahs that have been bred by stallion camels are due; up to one hundred and twenty. If there are more than one hundred and twenty; then for every forty a Bint Labun and for every fifty a Hiqqah. In the event that a person does not have a camel of the age specified according to the Sadaqah regulation; then if a person owes a Jadhah but he has a Hiqqah; then the Hiqqah should be accepted from him and he should give two sheep along with it if they are available; or twenty Dirhams. If a person owes a Hiqqah as Sadaqah but he only has a Jadhah; then it shold be accepted from him; and the Zakah collector should give him twenty Dirhams or two sheep. If a person owes a Hiqqah and does not have one but he has a Bint Labun; it should be accepted from him; and he should give two sheep along with it; if they are available; or twenty Dirhams. If a person owes a Bint Labun as Sadaqah but he only has a Hiqqah; it should be accepted from him; and the Zakah collector should give him twenty Dirhams or two sheep. If a person owes a Bint Labun as Sadaqah and he does not have a Bint Labun; but he has a Bint Makhad. It should be accepted from him; and he should give two sheep along with it; if they are available; or twenty Dirhams. If a person owes a Bint Makhad as Sadaqah but he only has a Bint Labun; a male; it shold be accepted from him and nothing else need be given with it. If a person has only four camels; then nothing is due on them; unless their owner wishes to give something. With regard to the Sadaqah of grazing sheep; if there are forty then one sheep is due; up to one hundred and twenty. If there is one more than that; then two sheep are due; up to two hundred. If there is one more than that; then three sheep are due; up to three hundred. If there is one more than that; then for every hundred one sheep is due; and no decrepit or defecting sheep or male sheep should be taken as Sadaqah unless the Zakah collector wishes. Do not combine separate flocks or separate combined flocks for fear of Sadaqah; Each partner who has a share in a combined flock shold pay Sadaqah in proportion to his shares. If a man flock is one less than forty sheep; then nothing is due from them unless their owner wishes. SunanAlNasai-017-001-14732 | It was narrated that Muslim Bin Thafihan said: Ibn Alqamah appointed my father to be in charge of his people; and he commanded him to collect their Sadaqah. My father sent me to a group of them to bring their Sadaqah to him. I set out and came to an old man who was called Sar. I said: My father has sent me to collect the Sadaqah of your sheep. He said: O son of my brother; how will you decode what you want to take? I said We choose; and we even measure the sheep udders. He said: O son of my brother; I tell you that I was in one of these mountain passes at the time of the Messenger of Allah with some sheep of mine. Two men came on a camel and said: We are the messengers of the Messengers of Allah; we come to take the Sadaqah of your sheep. I said: What do I have to give? They said: A sheep. So I went to a sheep that I knew was filled with milk and was fat; and brought it out to them. He said: This is a Shafi - a sheep that has a child or is pregnant - and the Messenger of Allah forbade us to take a Shafi. SunanAbuDawoud-017-001-25168 | AlHarith AlAwar reported from Ali. Zuhayr said: I think; the Prophet ﷺ said: Pay a fortieth. A dirham is payable on every forty; but you are not liable for payment until you have accumulated two hundred dirhams. When you have two hundred dirhams; five dirhams are payable; and that proportion is applicable to larger amounts. Regarding sheep; for every forty sheep up to one hundred and twenty; one sheep is due. But if you possess only thirty-nine; nothing is payable on them. He further narrated the tradition about the sadaqah zakat on sheep like that of AlZuhri. Regarding cattle; a yearling bull calf is payable for every thirty; and a cow in her third year for forty; and nothing is payable on working animals. Regarding the zakat on camels; he mentioned the rates that AlZuhri mentioned in his tradition. He said: For twenty-five camels; five sheep are to be paid. If they exceed by one; a camel in her second year is to be given. If there is no camel in her second year; a male camel in its third year is to be given; up to thirty-five. If they exceed by one a camel in her third year is to be given; up to forty-five. If they exceed by one; a camel in her fourth year which is ready to be covered by a bull-camel is to be given. He then transmitted the rest of the tradition like that of AlZuhri. He continued: If they exceed by one; i.e. they are ninety-one to hundred and twenty; two camels in their fourth year; which are ready to be covered by a bull-camel; are to be given. If there are more camels than that; a camel in her fourth year is to be given for every fifty. Those which are in one flock are not to be separated; and those which are separate are not to be brought together. An old sheep; one with a defect in the eye; or a billy goat is not to be accepted as a sadaqah unless the collector is willing. As regards agricultural produce; a tenth is payable on that which is watered by rivers or rain; and a twentieth on that which is watered by draught camels. The version of Aasi m and AlHarith says: Sadaqah zakat is payable every year. Zuhayr said: I think he said Once a year. My father sent me to a group of them; so I came to an aged man called Sar Ibn Disam I said: My father has sent me to you to collect zakat from you. He asked: What kind of animals will you take; my nephew? I replied: We shall select the sheep and examine their udders. He said: My nephew; I shall narrate a tradition to you. I lived on one of these steppes during the time of the Messenger of Allah ﷺ along with my sheep. Two people riding a camel came to me. They said to me: We are messengers of the Messenger of Allah ﷺ ; sent to you so that you may pay the sadaqah zakat on your sheep. I asked: What is due from me for them? They said: One goat. I went to a goat which I knew was full of milk and fat; and I brought it to them. They said: This is a pregnant goat. The Messenger of Allah ﷺ prohibited us to accept a pregnant goat. SunanAbuDawoud-017-001-25727 | Narrated Ibn Shihab: Jabir Ibn Abdullah used to say that a Jewess from the inhabitants of Khaybar poisoned a roasted sheep and presented it to the Messenger of Allah ﷺ who took its foreleg and ate from it. A group of his companions also ate with him. The Messenger of Allah ﷺ then said: Take your hands away from the food. The Messenger of Allah ﷺ then sent someone to the Jewess and he called her. He said to her: Have you poisoned this sheep? The Jewess replied: Who has informed you? He said: This foreleg which I have in my hand has informed me. She said: Yes. SunanAbuDawoud-017-001-25781 | Narrated Abu Dawud: I found in my notebook from Shaiban and I did not hear from him ; Abu Bakr; a reliable friend of ours; said: Shaiban - Muhammad Bin Rashid - Sulaiman Bin Mousad - Amr Bin Suhaib; On his father authority; said that his grandfather said: The Messenger of Allah ﷺ would fix the blood-money for accidental killing at the rate of four hundred dinars or their equivalent in silver for townsmen; and he would fix it according to the price of camels. So when they were dear; he increased the amount to be paid; and when cheap prices prevailed he reduced the amount to be paid. In the time of the Messenger of Allah ﷺ they reached between four hundred and eight hundred dinars; their equivalent in silver being eight thousand dirhams. He said: The Messenger of Allah ﷺ gave judgment that those who possessed cattle should pay two hundred cows; and those who possessed sheep two thousand sheep. He said: The Messenger of Allah ﷺ said: The blood-money is to be treated as something to be inherited by the heirs of the one who has been killed; and the remainder should be divided among the agnates. He said: The Messenger of Allah ﷺ gave judgment that for cutting off a nose completely there was full blood-money; one hundred camels were to be paid. If the tip of the nose was cut off; half of the blood-money;i.e. fifty camels were to be paid; or their equivalent in gold or in silver; or a hundred cows; or one thousand sheep. For the hand; when it was cut of;f half of the blood-money was to be paid; for one foot of half; the blood-money was to be paid. For a wound in the head; a third of the blood-money was due; i.e. thirty-three camels and a third of the blood-money; or their equivalent in gold; silver; cows or sheep. For a head thrust which reaches the body; the same blood-money was to be paid. Ten camels were to be paid for every finger; and five camels for every tooth. When we reached the Prophet; we did not find him in his house. We found there Aisha; the Mother of the Believers. She ordered that a dish called Khazirah should be prepared for us. It was then prepared. A tray containing dates was then presented to us. The narrator Qutaybah did not mention the word qina; tray. Then the Messenger of Allah ﷺ came. He asked: Has anything been served to you or ordered for you? We replied: Yes; Messenger of Allah. While we were sitting in the company of the Messenger of Allah ﷺ we suddenly saw that a shepherd was driving a herd of sheep to their fold. He had with him a newly-born lamb that was crying. Let the one with a small herd of camels and the one with a small herd of sheep enter; but be wary of the livestock of Ibn Awuf and the livestock of Ibn Affan. If their livestock are destroyed; they will return to palm-trees and agriculture. Some people rode out from Madina to call upon Abu Huraira. He told me to go to his mother; sending his greetings and asking her to prepare some food. Humayd continued; She set down three loaves on a plate and some oil and salt. Then she put it on my head and I carried it to them. When I set it before them; Abu Huraira said; Allah is greater and added; Praise be to Allah who has filled us with bread after our food had previously been only water and dates; as the people did not touch any of the food. When they left; he said; O son of my brother; be good to your sheep and wipe the mucus from them and clean their pen. Pray in their quarter for they are among the animals of the Garden. One of them said; Messenger of Allah! Judge between us by the Book of Allah! The other said; and he was the wiser of the two; Yes; Messenger of Allah. Judge between us by the Book of Allah and give me permission to speak. He said; Speak. He said; My son was hired by this person and he committed fornication with his wife. He told me that my son deserved stoning; and I ransomed him for one hundred sheep and a slave-girl. Then I asked the people of knowledge and they told me that my son deserved to be flogged with one hundred lashes and exiled for a year; and they informed me that the woman deserved to be stoned. Malik said; What we do about the aqiqa is that if someone makes an aqiqa for his children; he gives a sheep for both male and female. The aqiqa is not obligatory but it is desirable to do it; and people continue to come to us about it. If someone makes an aqiqa for his children; the same rules apply as with all sacrificial animals - one-eyed; emaciated; injured; or sick animals must not be used; and neither the meat or the skin is to be sold. The bones are broken and the family eat the meat and give some of it away as sadaqa. If he found something which would enable him to dispense with it; he threw it away. Malik when asked whether or not a man who had been forced by necessity to eat carrion; should eat it when he also found the fruit; crops or sheep of a people in that place; answered; If he thinks that the owners of the fruit; crops; or sheep will believe his necessity so that he will not be deemed a thief and have his hand cut off; then I think that he should eat from whatever he finds that which will remove his hunger but he should not carry any of it away. I prefer that he does that than that he eat carrion. If he fears that he will not be believed; and will be deemed a thief for what he has taken; then I think that it is better for him to eat the carrion; and he has leeway to eat carrion in this respect. Even so; I fear that someone who is not forced by necessity to eat carrion might exceed the limits out of a desire to consume other peoples property; crops or fruit. It is disapproved for a group of people to buy a camel; cow or sheep; to share for the ritual and sacrifices; each man giving a share of its price; and taking a share of its meat. The Book of Zakat. On twenty-four camels or less zakat is paid with sheep; one ewe for every five camels. On anything above that; up to thirty-five camels; a camel in its second year; and; if there is no she camel in its second year; a male camel in its third year. On anything above that; up to forty-five camels; a camel in its third year. On anything above that; up to sixty camels; a she camel in its fourth year that is ready to be sired. On anything above that; up to seventy-five camels; a camel in its fifth year. On anything above that; up to ninety camels; two camels in their third year. On anything above that; up to one hundred and twenty camels; two camels in their fourth year that are ready to be sired. On any number of camels above that; for every forty camels; a camel in its third year; and for every fifty; a camel in its fourth year. On grazing sheep and goats; if they come to forty or more; up to one hundred and twenty head; one ewe. On anything above that; up to two hundred head; two ewes. MuwataMalik-017-001-35571 | Yahya related to me from Malik from Humayd Ibn Qays AlMakki from Tawus AlYamani that from thirty cows; Muadh Ibn Jabal took one cow in its second year; and from forty cows; one cow in its third or fourth year; and when less than that i.e. thirty cows was brought to him he refused to take anything from it. He said; I have not heard anything about it from the Messenger of Allah; may Allah bless him and grant him peace. When I meet him; I will ask him. But the Messenger of Allah; may Allah bless him and grant him peace; died before Muadh Ibn Jabal returned. Yahya said that Malik said; The best that I have heard about some one who has sheep or goats with two or more shepherds in different places is that they are added together and the owner then pays the zakat on them. This is the same situation as a man who has gold and silver scattered in the hands of various people. He must add it all u p and pay whatever zakat there is to pay on the sum total. Yahya said that Malik said; about a man who had both sheep and goats; that they were added up together for the zakat to be assessed; and if between them they came to a number on which zakat was due; he paid zakat on them. Malik added; They are all considered as sheep; and in Umar Ibn AlKhattab book it says; On grazing sheep and goats; if they come to forty or more; one ewe. Malik said; If there are more sheep than goats and their owner only has to pay one ewe; the zakat collector takes the ewe from the sheep. If there are more goats than sheep; he takes it from the goats. If there is an equal number of sheep and goats; he takes the ewe from whichever kind he wishes. Yahya said that Malik said; Similarly; Arabian camels and Bactrian camels are added up together in order to assess the zakat that the owner has to pay. They are all considered as camels. If there are more Arabian camels than Bactrians and the owner only has to pay one camel; the zakat collector takes it from the Arabian ones. If; however; there are more Bactrian camels he takes it from those. If there is an equal number of both; he takes the camel from whichever kind he wishes. Malik said; Similarly; cows and water buffaloes are added up together and are all considered as cattle. If there are more cows than water buffalo and the owner only has to pay one cow; the zakat collector takes it from the cows. If there are more water buffalo; he takes it from them. If there is an equal number of both; he takes the cow from whichever kind he wishes. So if zakat is necessary; it is assessed taking both kinds as one group. Yahya said that Malik said; No zakat is due from anyone who comes into possession of livestock; whether camels or cattle or sheep and goats; until a year has elapsed over them from the day he acquired them; unless he already had in his possession a nisab of livestock. The nisab is the minimum amount on which zakat has to be paid; either five head of camels; or thirty cattle; or forty sheep and goats. If he already had five head of camels; or thirty cattle; or forty sheep and goats; and he then acquired additional camels; or cattle; or sheep and goats; either by trade; or gift; or inheritance; he must pay zakat on them when he pays the zakat on the livestock he already has; even if a year has not elapsed over the acquisition. And even if the additional livestock that he acquired has had zakat taken from it the day before he bought it; or the day before he inherited it; he must still pay the zakat on it when he pays the zakat on the livestock he already has Yahya said that Malik said; This is the same situation as some one who has some silver on which he pays the zakat and then uses to buy some goods with from somebody else. He then has to pay zakat on those goods when he sells them. It could be that one man will have to pay zakat on them one day; and by the following day the other man will also have to pay. Malik said; in the case of a man who had sheep and goats which did not reach the zakatable amount; and who then bought or inherited an additional number of sheep and goats well above the zakatable amount; that he did not have to pay zakat on all his sheep and goats until a year had elapsed over them from the day he acquired the new animals; whether he bought them or inherited them.This was because none of the livestock that a man had; whether it be camels; or cattle; or sheep and goats; was counted as a nisab until there was enough of any one kind for him to have to pay zakat on it. This was the nisab which is used for assessing the zakat on what the owner had additionally acquired; whether it were a large or small amount of livestock. Malik said; If a man has enough camels; or cattle; or sheep and goats; for him to have to pay zakat on each kind; and then he acquires another camel; or cow; or sheep; or goat; it must be included with the rest of his animals when he pays zakat on them Yahya said that Malik said; This is what I like most out of what I heard about the matter. Malik said; in the case of a man who does not have the animal required of him for the zakat; If it is a two-year-old camel that he does not have; a three-year-old male camel is taken instead. If it is a three- or four- or five-year-old camel that he does not have; then he must buy the required animal so that he gives the collector what is due. I do not like it if the owner gives the collector the equivalent value. MuwataMalik-017-001-35572 | Yahya said that Malik said; concerning two associates; If they share one herdsman; one male animal; one pasture and one watering place then the two men are associates; as long as each one of them knows his own property from that of his companion If someone cannot tell his property apart from that of his fellow; he is not an associate; but rather; a co-owner Malik said; It is not obligatory for both associates to pay zakat unless both of them have a zakatable amount of livestock. If; for instance; one of the associates has forty or more sheep and goats and the other has less than forty sheep and goats; then the one who has forty has to pay zakat and the one who has less does not. If both of them have a zakatable amount of livestock then both of them are assessed together i.e the flock is assessed as one and both of them have to pay zakat. If one of them has a thousand sheep; or less; that he has to pay zakat on; and the other has forty; or more; then they are associates; and each one pays his contribution according to the number of animals he has - so much from the one with a thousand; and so much from the one with forty. Malik said; Two associates in camels are the same as two associates in sheep and goats; and; for the purposes of zakat; are assessed together if each one of them has a zakatable amount of camels. MuwataMalik-017-001-35573 | Yahya related to me from Malik from Thawr Ibn Zayd AlDili from a son of Abdullah Ibn Sufyan AlThaqafi from his grandfather Sufyan Ibn Abdullah that Umar Ibn AlKhattab once sent him to collect zakat. He used to include sakhlas when assessing zakat ; and they said; Do you include sakhlas even though you do not take them as payment ? He returned to Umar Ibn AlKhattab and mentioned that to him and Umar said; Yes; you include a sakhla which the shepherd is carrying; but you do not take it. Neither do you take an akula; or a rubba; or a makhid; or male sheep and goats in their second and third years; and this is a just compromise between the young of sheep and goats and the best of them. Malik said; A sakhla is a newborn lamb or kid. A rubba is a mother that is looking after her offspring; a makhid is a pregnant ewe or goat; and an akula is a sheep or goat that is being fattened for meat. Malik said; about a man who had sheep and goats on which he did not have to pay any zakat; but which increased by birth to a zakatable amount on the day before the zakat collector came to them; If the number of sheep and goats along with their newborn offspring reaches a zakatable amount then the man has to pay zakat on them. That is because the offspring of the sheep are part of the flock itself. It is not the same situation as when some one acquires sheep by buying them; or is given them; or inherits them. Rather; it is like when merchandise whose value does not come to a zakatable amount is sold; and with the profit that accrues it then comes to a zakatable amount. The owner must then pay zakat on both his profit and his original capital; taken together. If his profit had been a chance acquisition or an inheritance he would not have had to pay zakat on it until one year had elapsed over it from the day he had acquired it or inherited it. Malik said; The young of sheep and goats are part of the flock; in the same way that profit from wealth is part of that wealth. There is; however; one difference; in that when a man has a zakatable amount of gold and silver; and then acquires an additional amount of wealth; he leaves Aasi de the wealth he has acquired and does not pay zakat on it when he pays the zakat on his original wealth but waits until a year has elapsed over what he has acquired from the day he acquired it. Whereas a man who has a zakatable amount of sheep and goats; or cattle; or camels; and then acquires another camel; cow; sheep or goat; pays zakat on it at the same time that he pays the zakat on the others of its kind; if he already has a zakatable amount of livestock of that particular kind. Malik said; That is what I like most out of what I have heard about the matter; because Allah; the Blessed and Exalted; says in His Book; O you who trust; do not kill game while you are in ihram. Whoever of you kills it intentionally; there shall be repayment the like of what he has slain; from livestock; as shall be judged by two men of justice among you; a sacrificial animal which will reach the Kaba; or food for poor people; or the equivalent of that in fasting; Surat 5 ayat 95 and a sheep is one of the animals which is judged to be acceptable as a sacrifice.
