If the deceased belonged to a people at war with you, and he was a believer, the freeing of a believing slave (Is enough). If he belonged to a people with whom ye have treaty of Mutual alliance, compensation should be paid to his family, and a believing slave be freed. For those who find this beyond their means, (is prescribed) a fast for two months running: by way of repentance to Allah: for Allah hath all knowledge and all wisdom. | |

If that is beyond your means, fast for three days. That is the expiation for the oaths ye have sworn. But keep to your oaths. Thus doth Allah make clear to you His signs, that ye may be grateful. | |

SahihAlBukhari-017-001-1498 | Narrated Aisha: After the slanderers had given a forged statement against her; Allah Messenger ﷺ called Ali Bin Abi Talib and Usama Bin Zaid when the Divine Inspiration was delayed. He wanted to ask them and consult them about the question of divorcing me. Usama gave his evidence that was based on what he knew about my innocence; but Ali said; Allah has not put restrictions on you and there are many women other than her. Furthermore you may ask the slave girl who will tell you the truth. So the Prophet ﷺ asked Barira my salve girl ; Have you seen anything that may arouse your suspicion? She replied; I have not seen anything more than that she is a little girl who sleeps; leaving the dough of her family unguarded that the domestic goats come and eat it. Then the Prophet ﷺ stood on the pulpit and said; O Muslims! Who will help me against the man who has harmed me by slandering my wife? By Allah; I know nothing about my family except good. The narrator added: Then the Prophet ﷺ mentioned the innocence of Aisha. SahihAlBukhari-017-001-1535 | Narrated: Abu Abdulrahman and Hibban Bin Atiya had a dispute. Abu Abdulrahman said to Hibban; You know what made your companions i.e. Ali dare to shed blood. Hibban said; Come on! What is that? Abdulrahman said; Something I heard him saying. The other said; What was it? Abdulrahman said; Ali said; Allah Messenger ﷺ sent for me; AlZubair and Abu Marthad; and all of us were cavalry men; and said; Proceed to Raudat-Hajj Abu Salama said that Abu Awana called it like this; i.e.; Hajj where there is a woman carrying a letter from Hatib Bin Abi Baltaa to the pagans of Mecca. So bring that letter to me. So we proceeded riding on our horses till we overtook her at the same place of which Allah Messenger ﷺ had told us. She was traveling on her camel. In that letter Hatib had written to the Meccans about the proposed attached of Allah Messenger ﷺ against them. We asked her; Where is the letter which is with you? She replied; I havent got any letter. So we made her camel kneel down and searched her luggage; but we did not find anything. My two companions said; We do not think that she has got a letter. I said; We know that Allah Messenger ﷺ has not told a lie. Then Ali took an oath saying; By Him by Whom one should swear! You shall either bring out the letter or we shall strip off your clothes. She then stretched out her hand for her girdle round her waist and brought out the paper letter. They took the letter to Allah Messenger ﷺ. Umar said; O Allah Messenger ﷺ ! Hatib has betrayed Allah; His Apostle and the believers; let me chop off his neck! Allah Messenger ﷺ said; O Hatib! What obliged you to do what you have done? Hatib replied; O Allah Messenger ﷺ ! Why for what reason should I not believe in Allah and His Apostle? But I intended to do the Mecca people a favor by virtue of which my family and property may be protected as there is none of your companions but has some of his people relatives whom Allah urges to protect his family and property. Then I met him and he asked me; How do you fast? I replied; I fast daily; He asked; How long does it take you to finish the recitation of the whole Quran? I replied; I finish it every night. On that he said; Fast for three days every month and recite the Quran and finish it in one month. I said; But I have power to do more than that. He said; Then fast for three days per week. I said; i have the power to do more than that. SahihAlBukhari-017-001-3708 | Narrated Ibn Abbas: The first event of Qasama in the pre-lslamic period of ignorance was practiced by us i.e. Banu Hashim. A man from Banu Hashim was employed by a Quraishi man from another branch-family. The Hashimi laborer set out with the Quraishi driving his camels. There passed by him another man from Banu Hashim. The leather rope of the latter bag had broken so he said to the laborer; Will you help me by giving me a rope in order to tie the handle of my bag lest the camels should run away from me? The laborer gave him a rope and the latter tied his bag with it. When the caravan halted; all the camels legs were tied with their fetters except one camel. The employer asked the laborer; Why; from among all the camels has this camel not been fettered? He replied; There is no fetter for it. The Quraishi asked; Where is its fetter? and hit the laborer with a stick that caused his death later on Just before his death a man from Yemen passed by him. The laborer asked him ; Will you go for the pilgrimage? He replied; I do not think I will attend it; but perhaps I will attend it. The Hashimi laborer said; Will you please convey a message for me once in your life? The other man said; yes. The laborer wrote: When you attend the pilgrimage; call the family of Quraish; and if they respond to you; call the family of Banu Hashim; and if they respond to you; ask about Abu Talib and tell him that so-and-so has killed me for a fetter. Then the laborer expired. When the employer reached Mecca ; Abu Talib visited him and asked; What has happened to our companion? He said; He became ill and I looked after him nicely but he died and I buried him. Then Abu Talib said; The deceased deserved this from you. After some time; the messenger whom the laborer has asked to convey the message; reached during the pilgrimage season. He called; O the family of Quraish! The people replied; This is Quraish. Then he called; O the family of Banu Hashim! Again the people replied; This is Banu Hashim. He asked; Who is Abu Talib? The people replied; This is Abu Talib. He said; So-and-so has asked me to convey a message to you that so-and-so has killed him for a fetter of a camel. Then Abu Talib went to the Quraishi killer and said to him; Choose one of three alternatives: i If you wish; give us one-hundred camels because you have murdered our companion; ii or if you wish; fifty of your men should take an oath that you have not murdered our companion; and if you do not accept this; iii we will kill you in Qisas. The killer went to his people and they said; We will take an oath. Then a woman from Banu Hashim who was married to one of them i.e.the Quraishis and had given birth to a child from him; came to Abu Talib and said; O Abu Talib! I wish that my son from among the fifty men; should be excused from this oath; and that he should not take the oath where the oathtaking is carried on. Abu Talib excused him. Then another man from them came to Abu Talib and said; O Abu Talib! You want fifty persons to take an oath instead of giving a hundred camels; and that means each man has to give two camels in case he does not take an oath. So there are two camels I would like you to accept from me and excuse me from taking an oath where the oaths are taken. Abu Talib accepted them from him. Then 48 men came and took the oath. SahihAlBukhari-017-001-3774 | Narrated Anas Bin Malik: Allah Messenger ﷺ arrived at Medina with Abu Bakr; riding behind him on the same camel. Abu Bakr was an elderly man known to the people; while Allah Messenger ﷺ was a youth that was unknown. Thus; if a man met Abu Bakr; he would say; O Abu Bakr! Who is this man in front of you? Abu Bakr would say; This man shows me the Way; One would think that Abu Bakr meant the road; while in fact; Abu Bakr meant the way of virtue and good. Then Abu Bakr looked behind and saw a horse-rider pursuing them. He said; O Allah Messenger ﷺ ! This is a horse-rider pursuing us. The Prophet ﷺ looked behind and said; O Allah! Cause him to fall down. So the horse threw him down and got up neighing. After that the rider; Suraqa said; O Allah Prophet! Order me whatever you want. The Prophet said; Stay where you are and do not allow anybody to reach us. So; in the first part of the day Suraqa was an enemy of Allah Prophet and in the last part of it; he was a protector. Then Allah Apostle alighted by the side of the AlHarra and sent a message to the Ansar; and they came to Allah Prophet and Abu Bakr; and having greeted them; they said; Ride your camels safe and obeyed. Allah Messenger ﷺ and Abu Bakr rode and the Ansar; carrying their arms; surrounded them. The news that Allah Prophet had come circulated in Medina. The people came out and were eagerly looking and saying Allah Prophet has come! Allah Prophet has come! So the Prophet ﷺ went on till he alighted near the house of Abu Ayoub. While the Prophet ﷺ was speaking with the family members of Abu Ayoub ; Abdullah Bin Salam heard the news of his arrival while he himself was picking the dates for his family from his family garden. He hurried to the Prophet ﷺ carrying the dates which he had collected for his family from the garden. He listened to Allah Prophet and then went home. Then Allah Prophet said; Which is the nearest of the houses of our kith and kin? Abu Ayoub replied; Mine; O Allah Prophet! This is my house and this is my gate. The Prophet ﷺ said; Go and prepare a place for our midday rest. Abu Ayoub said; Get up both of you with Allah Blessings. So when Allah Prophet went into the house; Abdullah Bin Salam came and said I testify that you i.e. Muhammad are Apostle of Allah and that you have come with the Truth. The Jews know well that I am their chief and the son of their chief and the most learned amongst them and the son of the most learned amongst them. So send for them i.e. Jews and ask them about me before they know that I have embraced Islam; for if they know that they will say about me things which are not correct. So Allah Messenger ﷺ sent for them; and they came and entered. Allah Messenger ﷺ said to them; O the group of Jews! Woe to you: be afraid of Allah. By Allah except Whom none has the right to be worshipped; you people know for certain; that I am Apostle of Allah and that I have come to you with the Truth; so embrace Islam. The Jews replied; We do not know this. So they said this to the Prophet and he repeated it thrice. Then he said; What sort of a man is Abdullah Bin Salam amongst you? Each of us would prepare food for his companions turn by turn for a day. Accordingly when it was my turn I said: Abu Huraira; it is my turn today. So they came to my place. The food was not yet ready; so I said to Abu Huraira: I wish you could narrate to us a tradition from the Messenger of Allah ﷺ until the food was ready. Complying with my request Abu Huraira said: We were with the Messenger of Allah ﷺ on the day of the Conquest of Mecca. He appointed Khalid Bin Walid as commander of the right flank; AlZubair as commander of the left flank; and Abu Ubaida as commander of the foot-soldiers who were to advance to the interior of the valley. He then said: Abu Huraira; call the Ansar to me. So I called out to them and they came hurriedly. He said: O ye Assembly of the Ansaar; do you see the ruffians of the Quraish? They said: Yes. He said: See; when you meet them tomorrow; wipe them out. He hinted at this with his hand; placing his right hand on his left and said: You will meet us at AlSafa. Abu Huraira continued : Whoever was seen by them that day was put to death. The Messenger of Allah ﷺ ascended the mount of AlSafa. The Ansar also came there and surrounded the mount. Then came Abu Sufyan and said: Messenger ot Allah; the Quraish have perished. No member of the Quraish tribe will survive this day. The Messenger of Allah ﷺ said: Who enters the house of Abu Safyin will be safe; who lays down arms will be safe; who locks his door will be safe. some of the Ansar said: After all the man has been swayed by tenderness towards his family and love for his city. He Asas sent a messenger to them to the members of his family. When they had assembled; Jundab came there with a yellow hooded cloak on him; He said: Talk what you were busy in talking. The talk went on by turns; till there came his Jundabs turn. He took off the hooded cloak from his head and said: I have come to you with no other intention but to narrate to you a hadith of your Apostle: Verily the Messenger of Allah ﷺ sent a squad of the Muslims to a tribe of the polytheists. Both the armies confronted one another. There was a man among the army of polytheists who was so dashing that ; whenever he intended to kill a man from among the Muslims; he killed him. Amongst the Muslims too was a man looking forward to an opportunity of his the polytheists unmindfulness. He the narrator said: We talked that he was Usama b; Zaid. When he raised his sword; he the soldier of the polytheists uttered: There is no god but Allah; but he Usama Bin Zaid killed him. When the messenger of the glad tidings came to the Apostle ﷺ he asked him about the events of the battle and he informed him about the man Usama and what he had done He the Prophet of Allah called for him and asked him why he had killed him. SahihMuslim-017-001-18899 | Iyad Bin Him-ar reported that Allah Messenger ﷺ ; while delivering a sermon one day; said: Behold; my Lord commanded me that I should teach you which you do not know and which He has taught me today. He has instructed thus : The property which I have conferred upon them is lawful for them. I have created My servants as one having a natural inclination to the worship of Allah but it is Satan who turns them away from the right religion and he makes unlawful what has been declared lawful for them and he commands them to ascribe partnership with Re; although he has no justification for that. And verily; Allah looked towards the people of the world and He showed hatred for the Arabs and the non-Arabs; but with the exception of some remnants from the People of the Book. And He further said: I have sent thee the Holy Prophet in order to put you to test and put those to test through you. And I sent the Book to you which cannot be washed away by water; so that you may recite it while in the state of wakefulness or sleep. Verily; Allah commanded me to burn kill the Quraish. I said: My Lord; they would break my head like the tearing of bread; and Allah said: You turn them out as they turned you out; you fight against them and We shall help you in this; you should spend and you would be conferred upon. You send an army and I would send an army five times greater than that. Fight against those who disobey you along with those who obey you. The inmates of Paradise are three: One who wields authority and is just and fair; one who Is truthful and has been endowed with power to do good deeds. And the person who is merciful and kind hearted towards his relatives and to every pious Muslim; and one who does not stretch his hand in spite of having a large family to support. And He said: The inmates of Hell are five: the weak who lack power to avoid evil ; the carefree who pursue everything irrespective of the fact that it is good or evil and who do not have any care for their family or for their wealth. And those dishonest whose greed cannot be concealed even in the case of minor things. And the third. who betray you. morning and evening; in regard to your family and your property. He also made a mention of the miser and the liar and those who are in the habit of abusing people and using obscene and foul language. SahihMuslim-017-001-19347 | Abu Huraira reported Allah Messenger ﷺ as saying that a person who had never done any good deed asked the members of his family to burn his dead body when he would die and to scatter half of its ashes over the land and half in the ocean. By Allah; if Allah finds him in His grip; He would torment him with a torment with which He did not afflict anyone amongst the people of the world; and when the person died; it was done to him as he had commanded his family to do. Allah commanded the land to collect the ashes scattered on it and He commanded the ocean and that collected ashes contained in it. SahihMuslim-017-001-19386 | AIsha reported: When I came under discussion what the people had to say about me; Allah Messenger ﷺ stood up for delivering an address and he recited tashahhud I bear witness to the fact that iheie is no god but Allah and praised Allah; lauded Him what He rightly deserves and then said: Coming to the point. Give me an advice about them who have brought false charge about my family. By Allah; I know no evil in the members of my family and the person in connection with whom the false charge is being levelled; I know no evil in him too. And he never entered my house but in my presence and when I was away on a journey; he remained with me even in that. The rest of the hadith is the same but with this change that Allah Messenger ﷺ came to my house and asked my maidservant and she said: By Allah; I know no fault in her but this that she sleeps; and goat comes and eats the kneaded flour. Some of the Companions of the Holy Prophet scolded her and said: State the fact before Allah Messenger ﷺ and they even made a pointed reference to this incident. She said: gallowed be Allah. By Allah; I know about her as does the jeweller know about the pure piece of gold. And when this news reached the person in connection with whom the allegation was made he said: Hallowed be Allah. By Allah; I have never unveiled any woman. Aisha said: He fell as a martyr in the cause of Allah; and there is this addition in this hadith that the people who had brought false allegation amongst them were Mistah and Hamna and Hassan. And so far as the hypocrite Abdullah Bin Ubay is concerned; he was one who tried his best to gather the false news and then gave them the wind. He said: I have grown old and have almost spent my age and I have forgotten some of the things which I remembered in connection with Allah Messenger ﷺ ; so accept whatever I narrate to you; and which I do not narrate do not compel me to do that. He then said: One day Allah Messenger ﷺ stood up to deliver sermon at a watering place known as Khumm situated between Mecca and Medina. He praised Allah; extolled Him and delivered the sermon and. exhorted us and said: Now to our purpose. O people; I am a human being. I am about to receive a messenger the angel of death from my Lord and I; in response to Allah call; would bid good-bye to you ; but I am leaving among you two weighty things: the one being the Book of Allah in which there is right guidance and light; so hold fast to the Book of Allah and adhere to it. He exhorted us to hold fast to the Book of Allah and then said: The second are the members of my household I remind you of your duties to the members of my family. He Husain said to Zaid: Who are the members of his household? Arent his wives the members of his family? Thereupon he said: His wives are the members of his family but here the members of his family are those for whom acceptance of Zakat is forbidden. And he said: Who are they? Thereupon he said: Ali and the offspring of Ali; Aqil and the offspring of Aqil and the offspring of Jafar and the offspring of Abbas. SahihMuslim-017-001-20731 | Anas reported that the son of Abu Talba who was born of Umm Sulaim died. She Umm Sulaim said to the members of her family: Do not narrate to Abu Talha about his son until I narrate it to him. Abu Talha came home ; she presented to him the supper. He took it and drank water. She then embellished herself which she did not do before. He Abu Talha had a sexual intercourse with her and when she saw that he was satisfied after sexual intercourse with her; she said: Abu Talha ; if some people borrow something from another family and then the members of the family ask for its return; would they resist its return? He said: No. She said: I inform you about the death of your son. He was annoyed; and said: You did not inform me until I had a sexual intercourse with you and you later on gave me information about my son. He went to Allah Messenger ﷺ and informed him what had happened. Thereupon Allah Messenger ﷺ said: May Allah bless both of you in the night spent by you! He the narrator said: She became pregnant. Allah Messenger may peace he upon him was in the course of a journey and she was along with him and when Allah Messenger ﷺ came back to Medina from the journey he did not enter his house during the night. When the people came near Medina; she felt the pangs of delivery. He Abu Talha remained with her and Allah Messenger ﷺ proceeded on. Abu Talha said: O Lord; you know that I love to go along with Allah Messenger when he goes out and enter along with him when he enters and I have been detained as Thou seest. Umm Sulaim said: Abu Talha ; I do not feel so much pain as I was feeling formerly; so better proceed on. So we proceeded on and she felt the pangs of delivery as they reached Medina and a child was born and my mother said to me: Anas; none should suckle him until you go to Allah Messenger ﷺ tomorrow morning. And when it was morning I carried him the child and went along with him to Allah Messenger may peace beupon him. He said: I saw that he had in his hand the instrument for the cauterisation of the camels. When he saw me. he said: This is; perhaps; what Umm Sulaim has given birth to. I said: Yes. He laid down that instrument on the ground. I brought that child to him and placed it in his lap and Allah Messenger ﷺ asked Ajwa dates of Medina to be brought and softened them in his month. When these had become palatable he placed them in the mouth of that child. The child began to taste them. Then Allah Messenger ﷺ said: See what love the Ansar have for dates. SahihMuslim-017-001-21174 | Aisha Allah be pleased with her reported: Barira came to me and said: My family owners have made contract with me for granting freedom for nine uqiyas of silver payable in nine years; one uqiya every year. Help me in making this payment. I said to her: If your family so desires; I am prepared to make them the full payment in one instalment; and thus secure freedom for you; but the right of inheritance will vest in me; if I do so. She Barira made a mention of that to her family; but they refused except on the condition that the right of inheritance would vest in them. She came to me and made mention of if She Aisha said: I scolded her. She Barira said: By Allah; it is not possible they will never agree to it. And as she was saying it; Allah messenger ﷺ heard; and he asked me; I informed him and he said: Buy her and emancipate her; and let the right of inherit- ance vest in them; for they cannot claim it rightfully since the right of inherritance vests with one who emancipates the slave; therefore; these people have no right to lay such false claims. And I did so. She Aisha said: Then Allah Messenger ﷺ delivered a sermon in the evening. He extolled Allah and praised Him with what He deserves; and then said afterwards;: What has happened to the people that they lay down conditions which are not found in the Book of Allah? And the condition which is not found in the Book of Allah is invalid; even if its number is one hundred. The Book of Allah is more true than any other deed and the condition laid down by Allah is more binding than any other condition. What has happened to the people among you that someone among you says: Emancipate so and so; but the right of inheritance vests in me? SahihMuslim-017-001-21757 | Abdullah Bin Abu Mulaika reported: I was sitting by the side of Ibn Umar; and we were waiting for the bier of Umm Aban; daughter of Uthman; and there was also Amr Bin Uthman. In the meanwhile there came Ibn Abbas led by a guide. I conceive that he was informed of the place of Ibn Umar. So he came till he sat by my side. While I was between them Ibn Abbas and Ibn Umar there came the noise of wailing from the house. Upon this Ibn Umar said that is; he pointed out to Amr that he should stand and forbid them; for : I heard the Messenger of Allah ﷺ as saying: The dead is punished because of the lamentation of his family. Abdullah made it general what was said for a particular occasion. Ibn Abbas said: When we were with the Commander of the believers; Umar Bin AlKhattab; we reached Baida; and there was a man under the shadow of the tree. He said to me: Go and inform me who is that person. So I went and found that he was Suhaib. I returned to him and said: You commanded me to find out for you who that was; and he is Suhaib. He Hadrat Umar said: Command him to see us. I said: He has family along with him. He said: That is of no account even if he has family along with him. So he the narrator told him to see the Commander of the believers and his party. When we came to Medina ; it was before long that the Commander of the believers was wounded; and Suhaib came weeping and crying: Alas for the brother; alas for the companion. Upon this Umar said: Didnt you know; or didnt you hear; that the Messenger of Allah ﷺ said: The dead is punished because of the lamentation of his family? Then Abdullah made it general and Umar told it of certain occasions. So I Abdullah Bin Abu Mulaika stood up and went to Aisha and told her what Ibn Umar had said. Upon this she said: I swear by Allah that Allah Messenger ﷺ never said that dead would be punished because of his family lamenting for him. What he said was that Allah would increase the punishment of the unbeliever because of his family lamenting for him. Verily it is Allah Who has caused laughter and weeping. No bearer of a burden will bear another burden. SahihMuslim-017-001-21758 | Abdullah Bin Abu Mulaika said: The daughter of Uthman Bin Affan died in Mecca. We came to attend her funeral. Ibn Umar and Ibn Abbas were also present there; and I was sitting between them. He added: I first sat by the side of one of them; then the other one came and he sat by my side. Abdullah Bin Umar said to Amr Bin Uthman who was sitting opposite to him: Will you not prevent the people from lamenting; for the Messenger of Allah ﷺ had said: The dead is punished because of the lamenting of his family for him? Ibn Abbas then said that Umar used to say someting of that nature; and then narrated saying: I proceeded from Mecca along with Umar till we reached AlBaida and there was a party of riders under the shade of a tree. He said to me : Go and find out who this party is. I cast a glance and there was Suhaib in that party. So I informed him Umar about it. He said: Call him to me. So I went back to Suhaib and said: Go and meet the Commander of the believers. When Umar was wounded; Suhaib came walling: Alas; for the brother! alas for the companion! Umar said: O Suhaib; do you wail for me; whereas the Messenger of Allah ﷺ said: The dead would be punished on account of the lamentation of the members of his family ? Ibn Abbas said: When Umar died I made a mention of it to Aisha. She said: May Allah have mercy upon Umar! I swear by Allah that Allah Messenger ﷺ never said that Allah would punish the believer because of the weeping of any one of the members of his family ; but he said that Allah would increase the punishment of the unbeliever because of the weeping of his family over him. Aisha said: The Quran is enough for you when it states : No bearer of burden will bear another burden vi. 164. Thereupon Ibn Abbas said: Allah is He Who has caused laughter and weeping. Her husband had gone out searching for his runaway slaves; and when he was in Turaf AlQadum he caught up with them and they killed him. She said: So I asked the Messenger of Allah if I could return to my family since my husband had not left me a home that he owned nor any maintenance. She said: So the Messenger of Allah said: Yes. Then I left. When I was in the courtyard; or; in the Masjid; the Messenger of Allah called me or; summoned for me to come back t him and he said: What did you say? SunanAlTermithi-017-001-9936 | Narrated Ibn Abbas: from Tamim AlDari; regarding this Ayah: O you who believe! When death approaches any of you then take the testimony 5:106. He said: The people are innocent of it; other than myself and Adi Bin Badda. We were Christians who used to frequent AlSham before Islam. They went to AlSham for their business; and they were approached by a freed slave of Banu Sahm; who was called Budail Bin Abi Maryam; with some trade. He had a bowl they wanted made of silver; but he wanted a great deal for it. Then he became ill; and willed it to them; and he commissioned them to deliver what was left to his family. Tamim said: When he died; we took that bowl and we sold it for one-thousand Dirham. Then Adi Bin Badda and I divided it. When we went to his family to give them what was with us; they searched for the bowl and asked about it. We said: He did not leave behind other than this; nor did he give us other than this. Tamim said: When I accepted Islam; after the Messenger of Allah ﷺ had arrived in AlMadinah; I felt guilty about that; so I went to his family; and informed them about what had happened. I gave them fifty-thousand Dirham and told them my companion had the same. They took him to the Messenger of Allah ﷺ but he asked them for their proof; which they did not have; so he ordered them; to have him to take an oath in accordance with whatever the people of his religion revered; so he took the oath. Then Allah revealed: O you who believe! When death approaches any of you then take the testimony... up to His saying: Or else they would fear that oaths will be admitted after their oaths 5:106. SunanAlNasai-017-001-12024 | It was narrated that Ibn Abbas said: The first instance of Qasamah during the Aljahiliyah involved a man from Banu Hashim who was employed by a man from Quraish; from another branch of the tribe. He went out with him; driving his camels and another man from Banu Hashim passed by them. The leather rope of that man bag broke; so he said to the hired worker : Help me by giving me a rope with which to tie the handle of my bag; lest the camels run away from me. So he gave him a rope and he tied his gab with it. When they halted; all the camels legs were hobbled except one camel. The one who had hired him said: Why is his camel; out of all of them; not hobbled? He said: There is no rope for it. He said: Where is its rope? He said: A man from Banu Hashim passed by and the leather rope of his bag had broken; and he asked me to help him; he said: Help me by giving me a rope with which to tie the handle of my bag lest the camels run away from me; so I gave him a rope. He struck him with a stick; which led to his death.Then a man from Yemen passed by him the man from Banu Hashim; the man from Banu Hashim; just before he died and he the Hashimi man said: Are you going to attend the Pilgrimage? He said: I do not think I will attend it; but perhaps I will attend it. He said: Will you convey a message from me once in your lifetime? He said: Yes. He said: If you attend the pilgrimage; then call out; O family of Quraish! If they respond; then call out; O family of Hashim! If they respond; then ask for Abu Talib; and tell him that so and so killed me for a rope. Then the hired worker died. When the one who had hired him cam; Abu Talib went to him and said: What happened to our companion? He said: He fell sick and I took good care of him; but he died; so I stopped and buried him. He said: He deserved that from you. Some time passed; then the Yemeni man who had been asked to convey the message arrived at the time of the pilgrimage. He said: O family of Quraish! And they said: Here is Quraish. He said: O family of Banu Hashim! They said: Here is Banu Hashim. He said Where is Abu Talib? He said: Here is Abu Talib. He said: so and so asked me to convey a message to you; that so and so killed him for a camel rope. Abu Talib went to him and said Choose one of three alternatives that we are offering you. If you wish; you may give us one hundred camels; because you killed our companion by mistake: or if you wish; fifty of your men may swear an oath that you did not kill him; or if you wish; we will kill you in retaliation. He went to his people and told them about that; and they said: We will swear the oath. Then a woman from Banu Hashim; who was married to one of their men and had born him a child; came to Abu Talib and said: O Abu Talib; I wish that my son; who is one of these fifty men; should be excused from having to take the oath.; So the excused him. Then one of the men came to him and said: O Abu Talib; you want fifty men to take the oath in lieu of one hundred camels; which means that each man may give two camels instead; so here are two camels; take them from me; and do not make me take the oath. The narrator Hammad said : I doubt whether he the Prophet said: their urine. Abu Dharr said: I was away from the watering place and I had my family with me. I would have sexual defilement and pray without purification. I came to the Messenger of Allah ﷺ at noon. He was resting in the shade of the Masjid along with a group of Companions. We heard that some slaves had been brought to the prophet ﷺ. I said: if you go to your father and ask him for a servant; that will be sufficient for you. She came to him and found some people talking to him. She felt shy and returned. Next morning he visited us when we were in our quilt. He said She pulled the grinding stone with her hand so much that it affected her hand; she carried water in a water bag so much so that it affected the upper portion of her chest; she swept the house so much so that her clothes became dirty. The Prophet ﷺ acquired some slaves. So I said Would that you go to your father and ask him for a slave. She then came to him and found some people with him talking to him. She therefore returned. Next day she came again. He asked her ; what was your need? But she kept silence. So I said; I inform you; Apostle of Allaah ﷺ. She pulled grinding stone so much that it affected her hand; she carried water bag so much so that it affected the upper portion of her chest. When the slaves were brought to you I asked her to come to you and to ask you for a slave to save her from the exertion she is suffering. He said Fear Allaah; Fathimah and perform the duty of your Lord and do the work of your family. When you go to bed say Glory be to Allaah thirty three times; Praise be to Allaah thirty three times; Allaah is Most Great thirty four times. This is hundred times. That will be better for you than a servant. I went to the Messenger of Allah; may Allah bless him and grant him peace; and found that a man was asking for something; and the Messenger of Allah; may Allah bless him and grant him peace; was saying; I do not have anything to give you. The man turned away from him in anger; saying; By my life! You give to whomever you wish. The Messenger of Allah; may Allah bless him and grant him peace; said; He is angry with me because I do not have anything to give him. Whoever asks of you while he has an uqiya or its like; has asked with importunity. The man continued; I said to myself about a camel that we had; It is better than an uqiya. Malik explained that an uqiya was forty dirhams. Ibn Abbas said; At the end of two periods. Abu Huraira said; When she gives birth; she is free to marry. Abu Salama Ibn Abdulrahman visited Umm Salamah; the wife of the Prophet; may Allah bless him and grant him peace; and asked her about it Umm Salamah said; Subaya AlAslamiya gave birth half a month after the death of her husband; and two men asked to marry her. One was young and the other was old. She preferred the young man and so the older man said; You are not free to marry yet. Her family were away and he hoped that when her family came; they would give her to him. Then later on people began to compete with each other and it became boasting. Malik said; The best that I have heard about a single camel; cow or sheep; is that a man should sacrifice a camel for himself and his family. He sacrifices a cow or sheep which he owns for his family; and shares with them in it. It is disapproved for a group of people to buy a camel; cow or sheep; to share for the ritual and sacrifices; each man giving a share of its price; and taking a share of its meat. We have heard the tradition that people do not share in the ritual. MuwataMalik-017-001-35425 | Malik said; I do not see that there is any harm in the Muslims eating whatever food they come across in enemy territory before the spoils are divided. Malik said; I think that any camels; cattle and sheep taken as booty are considered as food which the Muslims can eat in enemy territory. If they could not be eaten until the people had gathered for the division and the spoils had been distributed among them; that would be harmful for the army. I do not see any objection to eating such things within acceptable limits. I do not think; however; that anyone should store up any of it to take back to his family. Malik was asked whether it was proper for a man who obtained food in enemy territory and ate some of it and made provision so that there was some of it left over to keep and eat with his family; or to sell before he had come to his country and make use of its price. He said; If he sells it while he is on a military expedition; I think that he should put its price into the booty of the Muslims. MuwataMalik-017-001-35797 | Malik said; Someone who does umra in Shawal; Dh AlQada or Dhu AlHijja and then goes back to his people; and then returns and does hajj in that same year does not have to sacrifice an animal. Sacrificing an animal is only incumbent on some one who does umra in the months of hajj; and then stays in Makka and then does hajj. A person not from Makka who moves to Makka and establishes his home there and does umra in the months of the hajj and then begins his hajj there is not doing tamattu. He does not have to sacrifice an animal nor does he have to fast. He is in the same position as the people of Makka if he is one of those who are living there. Malik was asked whether a man from Makka who had gone to live in another town or had been on a journey and then returned to Makka with the intention of staying there; regardless of whether he had a family there or not; and entered it to do umra in the months of the hajj; and then began his hajj there; beginning his umra at the miqat of the Prophet; may Allah bless him and grant him peace; or at a place nearer than that; was doing tamattu or not? Malik answered; He does not have to sacrifice an animal or fast as someone who is doing tamattu has to do. MuwataMalik-017-001-36214 | Yahya related to me from Malik thatYahya Ibn Said used to say; Even if someone manages to pray before the time of the prayer has passed; the time that has passed him by is more important; or better; than his family and wealth. Yahya said that Malik said; If the time for a prayer comes and a traveller delays a prayer through neglect or forgetfulness until he reaches his family; he should do that prayer in full if he arrives within the time. But if he arrives when the time has past; he should do the travelling prayer. That way he only repays what he owes. Malik said; This is what I have found the people and men of knowledge doing in our community.
