Settle his case according to Allah Book Laws. and allow me to speak; He said; My son was a laborer for this man and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death but I ransomed him with one-hundred sheep and a slave girl. Then I asked the religious learned people and they told me that his wife should be stoned to death and my son should receive one-hundred lashes and be sentenced to one year of exile. The Prophet ﷺ said; By Him in Whose Hands my life is; I will judge between you according to Allah Book Laws : As for the slave girl and the sheep; they are to be returned; and as for your son; he shall receive onehundred lashes and will be exiled for one year. You; O Unais! addressing a man from Bani Aslam; Go tomorrow morning to the wife of this man and if she confesses; then stone her to death. So in the year of Conquest of Mecca; Saad took him and said. This is my brother son whom my brother has asked me to take into my custody. Abd Bin Zama got up before him and said; He is my brother and the son of the slave girl of my father; and was born on my father bed. So they both submitted their case before Allah Apostle. Saad said; O Allah Messenger ﷺ ! This boy is the son of my brother and he entrusted him to me. Abd Bin Zama said; This boy is my brother and the son of the slave girl of my father; and was born on the bed of my father. Allah Messenger ﷺ said; The boy is for you; O Abd Bin Zama! Then Allah Apostle further said; The child is for the owner of the bed; and the stone is for the adulterer; He then said to Sauda bint Zama; Veil screen yourself before him; when he saw the child resemblance to Utba. Then I asked a learned man about this case and he informed me that my son should receive one hundred lashes and be exiled for one year; and the man wife should be stoned to death. SahihAlBukhari-017-001-1691 | Narrated Huzail Bin Shirahbil: Abu Mousa was asked regarding the inheritance of a daughter; a son daughter; and a sister. He said; The daughter will take one-half and the sister will take one-half. If you go to Ibn Masud; he will tell you the same. Ibn Masud was asked and was told of Abu Mousa verdict. Ibn Masud then said; If I give the same verdict; I would stray and would not be of the rightly-guided. The second claimant who was wiser than him said: Well; decide amongst us according to the Book of Allah; but permit me to say something. Thereupon Allah Messenger may peace be upon ham said: Say. He said: My son was a servant in the house of this person and he committed adultery with his wife. I was informed that my son deserved stoning to death as punishment for this offence. I gave one hundred goats and a slave girl as ransom for this. I asked the scholars if this could serve as an expiation for this offence. They informed me that my son deserved one hundred lathes and exile for one year. and this woman deserved stoning as she was married. Thereupon Allah Messenger may peace he upon him said: By Him in Whose Hand is my life. I will decide between you according to the Book of Allah. The slave-girl and the goats should be given back; and your son is to be punished with one hundred lashes and exile for one year. She Umm Sulaim said to the members of her family: Do not narrate to Abu Talha about his son until I narrate it to him. Abu Talha came home ; she presented to him the supper. He took it and drank water. She then embellished herself which she did not do before. He Abu Talha had a sexual intercourse with her and when she saw that he was satisfied after sexual intercourse with her; she said: Abu Talha ; if some people borrow something from another family and then the members of the family ask for its return; would they resist its return? He said: No. She said: I inform you about the death of your son. He was annoyed; and said: You did not inform me until I had a sexual intercourse with you and you later on gave me information about my son. He went to Allah Messenger ﷺ and informed him what had happened. Thereupon Allah Messenger ﷺ said: May Allah bless both of you in the night spent by you! He the narrator said: She became pregnant. Allah Messenger may peace he upon him was in the course of a journey and she was along with him and when Allah Messenger ﷺ came back to Medina from the journey he did not enter his house during the night. When the people came near Medina; she felt the pangs of delivery. He Abu Talha remained with her and Allah Messenger ﷺ proceeded on. Abu Talha said: O Lord; you know that I love to go along with Allah Messenger when he goes out and enter along with him when he enters and I have been detained as Thou seest. Umm Sulaim said: Abu Talha ; I do not feel so much pain as I was feeling formerly; so better proceed on. So we proceeded on and she felt the pangs of delivery as they reached Medina and a child was born and my mother said to me: Anas; none should suckle him until you go to Allah Messenger ﷺ tomorrow morning. And when it was morning I carried him the child and went along with him to Allah Messenger may peace beupon him. He said: I saw that he had in his hand the instrument for the cauterisation of the camels. When he saw me. he said: This is; perhaps; what Umm Sulaim has given birth to. I said: Yes. He laid down that instrument on the ground. I brought that child to him and placed it in his lap and Allah Messenger ﷺ asked Ajwa dates of Medina to be brought and softened them in his month. When these had become palatable he placed them in the mouth of that child. The child began to taste them. Then Allah Messenger ﷺ said: See what love the Ansar have for dates. My father sent me to a group of them to bring their Sadaqah to him. I set out and came to an old man who was called Sar. I said: My father has sent me to collect the Sadaqah of your sheep. He said: O son of my brother; how will you decode what you want to take? I said We choose; and we even measure the sheep udders. He said: O son of my brother; I tell you that I was in one of these mountain passes at the time of the Messenger of Allah with some sheep of mine. SunanAbuDawoud-017-001-24900 | Aisha wife of the Prophet ﷺ and Umm Salamah said Abu Hudaifah Bin Utbah Bin Rabiah Bin Abd Shams adopted Salim as his son and married him to his niece Hind; daughter of AlWalid Bin Utbah Bin Rabiah. He Salim was the freed slave of a woman from the Ansar the Helpers as the Apostle of Allaah ﷺ adopted Zaid as his son. In pre Islamic days when anyone adopted a man as his son; the people called him by his name and he was given a share from his inheritance. Allaah; the Exalted; revealed about this matter Call them by the name of their fathers; that is juster in the sight of Allaah. And if ye know not their fathers; then they are your brethren in the faith and your clients. They were then called by their names of their fathers. A man; whose father was not known; remained under the protection of someone and considered brother in faith. Sahlah daughter of Suhail Bin Amr AlQuraishi then came and said Apostle of Allaah ﷺ ; we used to consider Salim our son. He dwelled with me and Abu Hudhaifah in the same house; and he saw me in the short clothes; but Allaah the Exalted; has revealed about them what you know; then what is your opinion about him? The Prophet ﷺ said give him your breast feed. She gave him five breast feeds. He then became like her foster son. Hence; Aisha may Allaah be pleased with her used to ask the daughters of her sisters and the daughters of her brethren to give him breast feed five times; whom Aisha wanted to see and who wanted to visit her. Though he might be of age; he then visited her. But Umm Salamah and all other wives of the Prophet ﷺ refused to allow anyone to visit them on the basis of such breast feeding unless one was given breast feed during infancy. SunanAbuDawoud-017-001-25111 | Aisha wife of the Prophet ﷺ said Marriage in pre Islamic times was of four kinds. One of them was the marriage contracted by the people today. A man asked another man to marry his relative sister or daughter to him. He fixed the dower and married her to him. Another kind of marriage was that a man asked his wife when she became pure from menstruation to send fro so and so and have sexual intercourse with him. Her husband kept himself aloof and did not have intercourse with her till It became apparent that she was pregnant from the man who had intercourse with her. When it was manifest that she was pregnant; her husband approached her if he liked. This marriage was called istibda to utilize man for intercourse for a noble birth. A third kind of marriage was that a group of people less than ten in number entered upon a woman and had intercourse with her. When she conceived gave birth to a child and a number of days passed after her delivery; she sent for them. No one of them could refuse to attend and they gathered before her. She said to them You have realized your affair. I have now given birth to a child. And this is your son. O so and so. She called the name of anyone of them she liked and the child was attributed to him. A fourth kind of marriage was that many people gathered together and entered upon a woman who did not prevent anyone who came to her. They were prostitutes. They hoisted flags at their doors which served as a sign for the one who intended to enter upon them. When she became pregnant and delivered the child ; they got together before her and called for the experts of tracing relationship from physical features. They attributed the child to whom they considered and it was given to him. The child was called his son and he could not deny. Abu Huraira said: O Allah; I do not say this; except that I heard a woman who came to the Messenger of Allah ﷺ while I was sitting with him; and she said: My husband wishes to take away my son; Messenger of Allah; and he draws water for me from the well of Abu Inabah; and he has been good to me. Their mother then died. They inherited her houses and had the right of inheritance of her freed slaves. Amr Ibn AlAs was the agnate of her sons. He sent them to Syria where they died. Amr Ibn AlAs then came. A freed slave of hers died and left some property. Her brothers disputed with him and brought the case to Umar Ibn AlKhattab. Umar reported the Messenger of Allah ﷺ as saying: Whatever property a son or a father receives as an heir will go to his agnates; whoever they may be. This happened before the prescription of veil for them. Sawdah said: I swear by Allah; I was with them when I came from there to the people and I was told: These are captives recently brought here. I returned to my house; and the Messenger of Allah ﷺ was there; and Abu Zayd Suhayl Ibn Amr was in the corner of the apartment and his hands were tied up on his neck with a rope. SunanAbuDawoud-017-001-29728 | Anas said The Apostle of Allaah ﷺ called on his Companions and they proceeded towards Badr. Suddenly they found the watering Camels of the Quraish; there was among them a black slave of Banu AlHajjaj. The Companions of the Apostle of Allaah ﷺ seized him and began to ask Where is Abu Sufyan? He said I swear by Allaah; I do not know anything about him; but this is the Quraish who have come here; among them are Abu Jahl; Utbah; Shaibah the two sons of Rabiah and Umayah Bin Khalaf. When he aid this to them; they beat him and he began to say Leave me; leave me. I shall tell you. When they left him he said I know nothing about Abu Sufyan; but this is the Quraish who have come here ; among them are Abu Jahl; Utbah; Shaibah the two sons of Rabiah and Umayah Bin Khalaf who have come here. The Prophet ﷺ was praying and hearing all that dialogue. When he finished; he said By Him in Whose hand my soul is; you beat him when he speaks the truth to you and you leave him when he tells a lie. This is the Quraish who have come here to defend Abu Sufyan. Anas said; The Apostle of Allaah ﷺ said This will be the place of falling of so and so tomorrow and he placed his hand on the ground. MuwataMalik-017-001-34772 | Malik related to me from Ibn Shihab from Ubaydullah Ibn Abdullah Ibn Utba Ibn Masud that Abu Huraira and Zayd Ibn Khalid AlJuhani informed him that two men brought a dispute to the Messenger of Allah; may Allah bless him and grant him peace. One of them said; Messenger of Allah! Judge between us by the Book of Allah! The other said; and he was the wiser of the two; Yes; Messenger of Allah. Judge between us by the Book of Allah and give me permission to speak. He said; Speak. He said; My son was hired by this person and he committed fornication with his wife. He told me that my son deserved stoning; and I ransomed him for one hundred sheep and a slave-girl. Then I asked the people of knowledge and they told me that my son deserved to be flogged with one hundred lashes and exiled for a year; and they informed me that the woman deserved to be stoned. The Messenger of Allah; may Allah bless him and grant him peace; said; By him in whose Hand myself is; I will judge between you by the Book of Allah. As for your sheep and slave girl; they should be returned to you. Your son should have one hundred lashes and be exiled for a year. When the son came; his father said to him; O fornicator. Zurayq said; So the son asked me to help him against the father. When I wanted to flog him; his son said; By Allah; if you flog him; I will acknowledge that I have committed fornication. When he said that; the situation was confused for me; so I wrote about it to Umar Ibn Abd AlAziz who was the governor at that time; and I mentioned it to him. Umar wrote me to permit his pardon. Zurayq said; I wrote to Umar Ibn Abd AlAziz also; What do you think about a man who is slandered or his parents are slandered and both or only one of them are dead? He said; Umar wrote to me; If he forgives; his pardon is permitted for himself. If his parents are slandered and one or both of them are dead; take the judgement of the Book of Allah for it unless he wants to veil it. Yahya said; I heard Malik say; That is because the slandered man might fear that if that is unveiled about him; a clear proof might be established. One of the two with the same mother died and left property and mawali. His full brother inherited his property and the wala of his mawali. Then he also died; and left as heirs his son and his paternal half brother. His son said; I obtain what my father inherited of property and the wala of the mawali. His brother said; It is not like that. You obtain the property. As for the wala of the mawali; it is not so. Do you think that had it been my first brother who died today; I would not have inherited from him? They argued and went to Uthman Ibn Affan. MuwataMalik-017-001-34837 | Malik related to me from Abdullah Ibn Abi Bakr Ibn Hazm that his father told him that he was sitting with Aban Ibn Uthman; and an argument was brought to him between some people from the Juhayna tribe and some people from the Banu AlHarith Ibn AlKhazraj. A woman of the Juhayna tribe was married to a man from the Banu AlHarith Ibn AlKhazraj; called Ibrahim Ibn Kulayb. She died and left property and mawali; and her son and husband inherited them from her. Then her son died and his heirs said; We have the wala of the mawali. Her son obtained them. Those of the Juhayna said; It is not like that. They are the mawali of our female associate. When her child died; we have their wala and we inherit them. He is more entitled to the man blood than any of his relatives after him. Malik said about a man who pardoned murder; after he had claimed his right and it was obliged for him; There is no blood-money against the murderer unless the one who pardons him stipulates that when he pardons him. Malik said about the murderer when he was pardoned; He is flogged one hundred lashes and jailed for a year. The ex-slave then killed a man from the Banu Aidh tribe. An Aidhi; the father of the slain man came to Umar Ibn AlKhattab seeking the blood-money of his son. Umar said; He has no blood-money. The Aidhi said; What would you think if it had been my son who killed him? Umar said; Then you would pay his blood-money. He said; He is then like the black and white Arqam snake. He took him by the arm and placed him before him on his mount. The grandmother of the child saw him and argued with Umar about the child so they went to Abu Bakr AlSiddiq. Umar said; My son. The woman said; My son. Abu Bakr said; Do not interfere between a child and its mother. Umar did not repeat his words. In the year of the conquest; Sad took him and said; He is the son of my brother. He covenanted with me about him. Abd Ibn Zama stood up and said; He is my brother and the son of my father slave-girl. He was born on his bed. They went to the Messenger of Allah; may Allah bless him and grant him peace. Sad said; Messenger of Allah! He is the son of my brother; he made a covenant with me about him. MuwataMalik-017-001-34931 | Yahya said that he heard Malik say; The way of doing things generally agreed upon in our community in the case of a man who dies and has sons and one of them claims; My father confirmed that so-and- so was his son; is that the relationship is not established by the testimony of one man; and the confirmation of the one who confirmed it is only permitted as regards his own share in the division of his father property. The one testified for is only given his due from the share of the testifier. Malik said; An example of this is that a man dies leaving two sons; and 600 dinars. Each of them takes 300 dinars. Then one of them testifies that his deceased father confirmed that so-and-so was his son. The one who testifies is obliged to give 100 dinars to the one thus connected. This is half of the inheritance of the one thought to be related; had he been related. If the other confirms him; he takes the other 100 and so he completes his right and his relationship is established. His position is similar to that of a woman who confirms a debt against her father or her husband and the other heirs deny it. She must pay to the person whose debt she confirms; the amount according to her share of the full debt; had it been confirmed against all the heirs. If the woman inherits an eighth; she pays the creditor an eighth of his debt. If a daughter inherits a half; she pays the creditor half of his debt. Whichever women confirm him; pay him according to this. Malik said; If a man testimony is in agreement with what the woman testified to; that so- and-so had a debt against his father; the creditor is made to take an oath with one witness and he is given all his due. This is not the position with women because a man testimony is allowed and the creditor must take an oath with the testimony of his witness; and take all his due. If he does not take an oath; he only takes from the inheritance of the one who confirmed him according to his share of the debt; because he confirmed his right and the other heirs denied it. Yahya said that he heard Malik say; The generally agreed-on way of doing things in our community in the case of someone who gives his son a gift or grants him a gift which is not sadaqa is that he can take it back as long as the child does not start a debt; which people claim from him; and which they trust him for on the strength of the gift his father has given him. The father cannot take back anything from the gift after debts are started against it. MuwataMalik-017-001-34998 | Malik related to me from Zayd Ibn Aslam that his father said; Abdullah and Ubaydullah; the sons of Umar Ibn AlKhattab went out with the army to Iraq. On the way home; they passed by Abu Mousa AlAshari who was the amir of Basra. He greeted them and made them welcome; and told them that if there was anything he could do to help them; he would do it. Then he said; There is some of the property of Allah which I want to send to the amir Almuminin; so I will lend it to you; and you can buy wares from Iraq and sell them in Madina. Then give the principal to the amir Almuminin; and you keep the profit. They said that they would like to do it; and so he gave them the money and wrote to Umar Ibn AlKhattab to take the money from them. When they came to sell they made a profit; and when they paid the principal to Umar he asked; Did he lend everyone in the army the like of what he lent you? They said; No. Umar Ibn AlKhattab said; He made you the loan; because you are the sons of the amir Almuminin; so pay the principal and the profit. Abdullah was silent. Ubaydullah said; You do not need to do this; amir Almuminin. Had the principal decreased or been destroyed; we would have guaranteed it. Umar said; Pay it. Abdullah was silent; and Ubaydullah repeated it. A man who was sitting with Umar said; Amir Almuminin; better that you make it a qirad. Umar said; I have made it qirad. MuwataMalik-017-001-35026 | Yahya related to me from Malik from Ibn Shihab that he was asked about the suckling of an older person. He said; Urwa Ibn AlZubair informed me that Abu Hudhayfa Ibn Utba Ibn Rabia; one of the companions of the Messenger of Allah; may Allah bless him and grant him peace; who was present at Badr; adopted Salim who is called Salim; the mawla of Abu Hudhayfa as the Messenger of Allah; may Allah bless him and grant him peace; adopted Zayd Ibn Haritha. He thought of him as his son; and Abu Hudhayfa married him to his brother sister; Fatima bint AlWalid Ibn Utba Ibn Rabia; who was at that time among the first emigrants. She was one of the best unmarried women of the Quraysh. When Allah the Exalted sent down in His Book what He sent down about Zayd Ibn Haritha; Call them after their true fathers. That is more equitable in the sight of Allah. If you do not know who their fathers were then they are your brothers in the deen and your mawali; Surat 33 ayat 5 people in this position were traced back to their fathers. When the father was not known; they were traced to their mawla. Sahla bint Suhayl who was the wife of Abu Hudhayfa; and one of the tribe of Amr Ibn Luay; came to the Messenger of Allah; may Allah bless him and grant him peace; and said; Messenger of Allah! We think of Salim as a son and he comes in to see me while I am uncovered. We only have one room; so what do you think about the situation? The Messenger of Allah; may Allah bless him and grant him peace; said; Give him five drinks of your milk and he will be mahram by it. She then saw him as a foster son. Aisha umm Almuminin took that as a precedent for whatever men she wanted to be able to come to see her. She ordered her sister; Umm Kulthum bint Abi Bakr AlSiddiq and the daughters of her brother to give milk to whichever men she wanted to be able to come in to see her. The rest of the wives of the Prophet; may Allah bless him and grant him peace; refused to let anyone come in to them by such nursing. They said; No! By Allah! We think that what the Messenger of Allah; may Allah bless him and grant him peace; ordered Sahla bint Suhayl to do was only an indulgence concerning the nursing of Salim alone. No! By Allah! No one will come in upon us by such nursing! MuwataMalik-017-001-35135 | Yahya related to me from Malik; The generally agreed upon way of doing things among us and what I have seen the people of knowledge doing in our city about the fixed shares of inheritance of children from the mother or father when one or other of them dies is that if they leave male and female children; the male takes the portion of two females. If there are only females; and there are more than two; they get two thirds of what is left between them. If there is only one; she gets a half. If someone shares with the children; who has a fixed share and there are males among them; the reckoner begins with the ones with fixed shares. What remains after that is divided among the children according to their inheritance. When there are no children; grandchildren through sons have the same position as children; so that grandsons are like sons and grand-daughters are like daughters. They inherit as they inherit and they overshadow as they overshadow. If there are both children and grandchildren through sons; and there is a male among the children; then the grandchildren through sons do not share in the inheritance with him. If there is no surviving male among the children; and there are two or more daughters; the granddaughters through a son do not share in the inheritance with them unless there is a male who is in the same position as them in relation to the deceased; or further than them. His presence gives access to whatever is left over; if any; to whoever is in his position and whoever is above him of the granddaughters through sons. If something is left over; they divide it among them; and the male takes the portion of two females. If nothing is left over; they have nothing. If the only descendant is a daughter; she takes half; and if there are one or more grand-daughters through a son who are in the same position to the deceased; they share a sixth. If there is a male in the same position as the granddaughters through a son in relation to the deceased; they have no share and no sixth. If there is a surplus after the allotting of shares to the people with fixed shares; the surplus goes to the male and whoever is in his position and whoever is above him of the female descendants through sons. The male has the share of two females. The one who is more distant in relationship than grandchildren through sons has nothing. If there is no surplus; they have nothing. That is because Allah; the Blessed; the Exalted; said in His Book; Allah charges you about your children that the male has the like of the portion of two females. If there are more than two women they have two thirds of what is left. If there is one; she has a half. The inheritance of a wife from a husband who does not leave children or grandchildren through sons is a quarter. If he leaves children or grandchildren through sons; male or female; the wife has an eighth after bequests and debts. That is because Allah; the Blessed; the Exalted! said in His Book; You have a half of what your wives leave if they have no children. If they have children; you have a fourth of what they leave after bequests and debts. They have a fourth of what you leave if you have no children. If you have children; they have an eighth after bequests or debts. If the deceased does leave any children or male grandchildren through a son; the apportioning begins with those with whom the father shares in the fixed shares. They are given their fixed shares. If a sixth or more is left over; the sixth and what is above it is given to the father; and if there is less than a sixth left; the father is given his sixth as a fixed share; i.e. the other shares are adjusted. The inheritance of a mother from her child; if her son or daughter dies and leaves children or male or female grandchildren through a son; or leaves two or more full or half siblings is a sixth. If the deceased does not leave any children or grandchildren through a son; or two or more siblings; the mother has a whole third except in two cases. One of them is if a man dies and leaves a wife and both parents. The wife has a fourth; the mother a third of what remains; which is a fourth of the capital. The other is if a wife dies and leaves a husband and both parents. The husband gets half; and the mother a third of what remains; which is a sixth of the capital. That is because Allah; the Blessed; the Exalted; says in His Book; His two parents each have a sixth of what he leaves if he has children. If he does not have children; and his parents inherit from him; his mother has a third. If he has siblings; the mother has a sixth. Surat 4 ayat 11.
