Quran i.e. those who knew the Quran by heart on the day of the Battle of Yalmama; and I am afraid that more heavy casualties may take place among the Qurra on other battlefields; whereby a large part of the Quran may be lost. Therefore I suggest; you Abu Bakr order that the Quran be collected. I said to Umar; How can you do something which Allah Apostle did not do? Umar said; By Allah; that is a good project. So you should search for the fragmentary scripts of the Quran and collect it in one book. Then the shepherd cleaned his hands by striking his hands against one another. After doing so; he milked a small amount of milk. I used to keep for Allah Messenger ﷺ a leather water-container; the mouth of which was covered with a piece of cloth. I poured water on the milk container till its lower part was cold. Then I took the milk to the Prophet ﷺ whom I found awake. I said to him; Drink; O Allah Messenger ﷺ. So he drank till I became pleased. Then I said; It is time for us to move; O Allah Apostle! He said; Yes. So we set out while the people i.e. Quraish pagans were searching for us; but none found us except Suraqah Bin Malik Bin Jushum who was riding his horse. SahihAlBukhari-017-001-3354 | Narrated Aisha: We went out with Allah Messenger ﷺ on one of his journeys till we reached AlBaida or Dhat AlJaish where my necklace got broken and lost. Allah Messenger ﷺ stopped to search for it and the people too stopped with him. There was no water at that place and they had no water with them. So they went to Abu Bakr and said; Dont you see what Aisha has done? She has made Allah Messenger ﷺ and the people stop where there is no water and they have no water with them. Abu Bakr came while Allah Apostle was sleeping with his head on my thigh and said; You detained Allah Apostle and the people where there is no water and they have no water. He then admonished me and said what Allah wished and pinched me at my flanks with his hands; but I did not move because the head of Allah Messenger ﷺ was on my thigh. Allah Messenger ﷺ kept on sleeping till be got up in the morning and found no water. Then Allah revealed the Divine Verse of Tayammum; and the people performed Tayammum. Usaid Bin AlHudair said. SahihAlBukhari-017-001-4166 | Narrated Ibn Abbas: When Abraham had differences with his wife ; because of her jealousy of Hajar; Ishmael mother ; he took Ishmael and his mother and went away. They had a water-skin with them containing some water; Ishmael mother used to drink water from the water-skin so that her milk would increase for her child. When Abraham reached Mecca; he made her sit under a tree and afterwards returned home. Ishmael mother followed him; and when they reached Kada; she called him from behind; O Abraham! To whom are you leaving us? He replied; I am leaving you to Allah Care. She said; I am satisfied to be with Allah. She returned to her place and started drinking water from the water-skin; and her milk increased for her child. When the water had all been used up; she said to herself; Id better go and look so that I may see somebody. She ascended the Safa mountain and looked; hoping to see somebody; but in vain. When she came down to the valley; she ran till she reached the Marwa mountain. She ran to and fro between the two mountains many times. They she said to herself; id better go and see the state of the child; she went and found it in a state of one on the point of dying. She could not endure to watch it dying and said to herself ; If I go and look; I may find somebody. She went and ascended the Safa mountain and looked for a long while but could not find anybody. Thus she completed seven rounds of running between Safa and Marwa. Again she said to herself ; Id better go back and see the state of the child. But suddenly she heard a voice; and she said to that strange voice; Help us if you can offer any help. Lo! It was Gabriel who had made the voice. Gabriel hit the earth with his heel like this Ibn Abbas hit the earth with his heel to Illustrate it ; and so the water gushed out. Ishmael mother was astonished and started digging. Abu AlQasim i.e. the Prophet said; If she had left the water; flow naturally without her intervention ; it would have been flowing on the surface of the earth. Ishmael mother started drinking from the water and her milk increased for her child. Afterwards some people of the tribe of Jurhum; while passing through the bottom of the valley; saw some birds; and that astonished them; and they said; Birds can only be found at a place where there is water. They sent a messenger who searched the place and found the water; and returned to inform them about it. Then they all went to her and said; O ishmael mother! Will you allow us to be with you or dwell with you ? And thus they stayed there. Later on her boy reached the age of puberty and married a lady from them. Then an idea occurred to Abraham which he disclosed to his wife Sarah ; I want to call on my dependents I left at Mecca. When he went there; he greeted Ishmael wife and said; Where is Ishmael? She replied; He has gone out hunting. Abraham said to her ; When he comes; tell him to change the threshold of his gate. When he came; she told him the same whereupon Ishmael said to her; You are the threshold; so go to your family i.e. you are divorced. Again Abraham thought of visiting his dependents whom he had left at Mecca ; and he told his wife Sarah of his intentions. Abraham came to Ishmael house and asked. Where is Ishmael? Ishmael wife replied; He has gone out hunting; and added; Will you stay for some time and have something to eat and drink? Abraham asked; What is your food and what is your drink? She replied; Our food is meat and our drink is water. He said; O Allah! Bless their meals and their drink. Abu AlQa-sim i.e. Prophet said; Because of Abraham invocation there are blessings in Mecca. Once more Abraham thought of visiting his family he had left at Mecca ; so he told his wife Sarah of his decision. He went and found Ishmael behind the Zamzam well; mending his arrows. He said; O Ishmael; Your Lord has ordered me to build a house for Him. Ishmael said; Obey the order of your Lord. Abraham said; Allah has also ordered me that you should help me therein. Ishmael said; Then I will do. So; both of them rose and Abraham started building the Kaba while Ishmael went on handing him the stones; and both of them were saying; O our Lord ! Accept this service from us; Verily; You are the All-Hearing; the All-Knowing. 2.127. When the building became high and the old man i.e. Abraham could no longer lift the stones to such a high position ; he stood over the stone of AlMaqam and Ishmael carried on handing him the stones; and both of them were saying; O our Lord! She came to him and said: What is this news that has reached me from you that you curse those women who tattooed and those women who have themselves tattooed; the women who pluck hair from their faces and who make spaces between their teeth for beautification changing what God has created? Thereupon Abdullah said: Should I not curse one upon whom Allah Messenger ﷺ has invoked curse and that is in the Book also. Thereupon that woman said: I read the Quran from cover to cover; but I did not find that in it. whereupon he said: If you had read thoroughly you would have definitely found this in that as Allah; the Exalted and Glorious; has said: What Allah Messenger brings for you accept that and what he has forbidden you; refrain from that. That woman said: I find this thing in your wife even now. Thereupon he said: Go and see her. She reported: I went to the wife of Abdullah but found nothing of this sort in her. She came back to him and said: I have not seen anything. whereupon he said: Had there been anything like it in her; I would have never slept with her in the bed. | The Chapter on Grooming The Pubic Hear And Plucking in HodHood Indexing, Chapter on 33 in Sahih Muslim

He who holds it fast would be on right guidance and he who abandons it would be in error; and in this hadith these words are also found: We said: Who are amongst the members of the household? Arent the wives of the Holy Prophet included amongst the members of his house hold? Thereupon he said: No; by Allah; a woman lives with a man as his wife for a certain period; he then divorces her and she goes back to her parents and to her people; the members of his household include his ownself and his kith and kin who are related to him by blood and for him the acceptance of Zakat is prohibited. | The Chapter on Enemies And Groups And Household in HodHood Indexing, Chapter on 4 in Sahih Muslim

SunanAlTermithi-017-001-10077 | Narrated Anas: My paternal uncle Anas Bin AlNadr - after whom I was named - did not participate in the battle of Badr with the Messenger of Allah ﷺ. This distressed him and he said: I was absent from the first battle which the Messenger of Allah ﷺ attended. By Allah! If Allah gives me the opportunity to participate in another battle along with the Messenger of Allah ﷺ ; then Allah will see what I will do! He said: He did not want to say more than that. A year later; he attended the battle of Uhud; where he saw Saad Bin Muadh and said: O Abu Amr where are you going? He said: I long for the fragrance of Paradise and I have found it near the mountains of Uhud. He fought them until he was killed. They found more than eighty wounds on his body; be they from blows of a sword; puncture wounds; or arrows. My paternal aunt AlRubai Bin AlNadr said: I could not recognize my brother except by his finger tips. And this Ayah was revealed: Among the believers are men who have been true to their covenant with Allah; of them some have fulfilled their vow; and some of them are still waiting; but they have never changed in the least 33:23. | The Chapter on Military Expedition Of Badr in HodHood Indexing, The Book of Chapters on Tafsir in Sunan AlTermithi

One night while she was serving me; something of her became exposed for me; so I rushed myself upon her. When the morning came I went to my people to inform them about what happened to me. I said: Accompany me to the Messenger of Allah to inform him about my case. They said: No by Allah! We shall not do that; we feat that something will be revealed about us in the Quran; or the Messenger of Allah might say something about us; the disgrace of which will remain upon us. But you do and do whatever you want. He said: So I left and I went to the Messenger of Allah; and informed him of my case. He said: You are the one who did that? I said: I am the one. He said: You are the one who did that? I said: I am the one. He said: You are the one who did that? I said: I am the one; it is before you; so give me Allahs judgment; for I shall be patient with that. He said: Free a slave. He said: Then fast for two months I said: O Messenger of Allah! Did this occur to me other than when I was fasting? He said: Then feed sixty poor people. I said: By the One Who sent you with the Truth! We have spent these nights of ours hungry without an evening meal. He said: Go to the one with the charity from Banu Ruzaiq; tell him to give it to you; then feed a Wasq of it; on your behalf; to sixty poor people. The Prophet ﷺ became angry and said: Ibn Awuf ; ride your horse; and call loudly: Beware; Paradise is lawful only for a believer; and that they the people should gather for prayer. They gathered and the Prophet ﷺ led them in prayer; stood up and said: Does any of you; while reclining on his couch; imagine that Allah has prohibited only that which is to be found in this Quran? By Allah; I have preached; commanded and prohibited various matters as numerous as that which is found in the Quran; or more numerous. Allah has not permitted you to enter the houses of the people of the Book without permission; or beat their women; or eat their fruits when they give you that which is imposed on them. | The Chapter on Worship And Alquran In Homes in HodHood Indexing, Chapter on Levying The Ushur On Ahl AlDhimmah If They Deal In Trade in Sunan Abu Dawoud
SunanAbuDawoud-017-001-29326 | Narrated Abdullah AlHawzani: I met Bilal; the Muadhdhin of the Messenger of Allah ﷺ at Aleppo; and said: Bilal; tell me; what was the financial position of the Messenger of Allah ﷺ ? He said: He had nothing. It was I who managed it on his behalf since the day Allah made him Prophet of Allah ﷺ until he died. When a Muslim man came to him and he found him naked; he ordered me to clothe him. I would go; borrow some money ; and purchase a cloak for him. I would then clothe him and feed him. A man from the polytheists met me and said: I am well off; Bilal. Do not borrow money from anyone except me. So I did accordingly. One day when I performed ablution and stood up to make call to prayer; the same polytheist came along with a body of merchants. When he saw me; he said: O Abyssinian. I said: I am at your service. He met me with unpleasant looks and said harsh words to me. He asked me: Do you know how many days remain in the completion of this month? I replied: The time is near. He said: Only four days remain in the completion of this month. I shall then take that which is due from you i.e. loan ; and then shall return you to tend the sheep as you did before. I began to think in my mind what people think in their minds on such occasions. When I offered the night prayer; the Messenger of Allah ﷺ returned to his family. I sought permission from him and he gave me permission. I said: Messenger of Allah; may my parents be sacrificed for you; the polytheist from whom I used to borrow money said to me such-and-such. Neither you nor I have anything to pay him for me; and he will disgrace me. So give me permission to run away to some of those tribes who have recently embraced Islam until Allah gives His Apostle ﷺ something with which he can pay the debt for me. So I came out and reached my house. I placed my sword; waterskin or sheath ; shoes and shield near my head. When dawn broke; I intended to be on my way. All of a sudden I saw a man running towards me and calling: Bilal; return to the Messenger of Allah ﷺ. So I went till I reached him. I found four mounts kneeling on the ground with loads on them. I sought permission. The Messenger of Allah ﷺ said to me: Be glad; Allah has made arrangements for the payment of your debt. He then asked: Have you not seen the four mounts kneeling on the ground? I replied: Yes. He said: You may have these mounts and what they have on them. There are clothes and food on them; presented to me by the ruler of Fadak. Take them away and pay off your debt. I did so. He then mentioned the rest of the tradition. I then went to the Masjid and found that the Messenger of Allah ﷺ was sitting there. I greeted him. He asked: What benefit did you have from your property? I replied: Allah Most High paid everything which was due from the Messenger of Allah ﷺ. Nothing remains now. He asked: Did anything remain from that property ? I said: Yes. He said: Look; if you can give me some comfort from it; for I shall not visit any member of my family until you give me some comfort from it. When the Messenger of Allah ﷺ offered the night prayer; he called me and said: What is the position of that which you had with you i.e. property ? I said: I still have it; no one came to me. The Messenger of Allah ﷺ passed the night in the Masjid. He then narrated the rest of the tradition. Next day when he offered the night prayer; he called me and asked: What is the position of that which you had i.e. the rest of the property ? I replied: Allah has given you comfort from it; Messenger of Allah. He said: Allah is Most Great; and praised Allah; fearing lest he should die while it was with him. I then followed him until he came to his wives and greeted each one of them and finally he came to his place where he had to pass the night. This is all for which you asked me. | The Chapter on Horses And Property in HodHood Indexing, Chapter on Regarding The Imam Accepting Gifts From Idolaters in Sunan Abu Dawoud
SunanAbuDawoud-017-001-29554 | Zaid Bin Thabit said I was beside the Apostle of Allaah ﷺ when the divinely-inspired calmness overtook him and the thigh of the Apostle of Allaah ﷺ fell on my thigh. I did not find any weightier than the thigh of the Apostle of Allaah ﷺ. He then regained his composure and said Write down. I wrote on a shoulder. Not equal are thise believers who sit at home ; other than those who have a disabling hurt; and those who strive in the way of Allaah. When Ibn Umm Makhtum who was blind heard the excellence of the warriors. He stood up and said Apostle of Allaah ﷺ how is it for those believers who are unable to fight in the path of Allaah ? When he finished his question his divinely-inspired calmness overtook him; and his thigh fell on my thigh and I found its weight the second time as I found the first time. When the Apostle of Allaah ﷺ regained his composure; he said Apostle of Allaah ﷺ said Other than those who have a disabling hurt. Zaid said Allaah; the exalted; revealed it alone and I appended it. MuwataMalik-017-001-34577 | Malik related to me from Safiy; the mawla of Ibn Aflah that Abus-Saib; the mawla of Hisham Ibn Zuhra said; I went to Abu Said AlKhudri and found him praying. I sat to wait for him until he finished the prayer. I heard a movement under a bed in his room; and it was a snake. I stood up to kill it; and Abu Said gestured to me to sit. When he was finished he pointed to a room in the house and said; Do you see this room? I said; Yes. He said; There was a young boy in it who had just got married. He went out with the Messenger of Allah; may Allah bless him and grant him peace; to AlKhandaq; the ditch which the muslims dug in the 5th year of the Hijra to defend Madina against the Quraysh and their allies. When he was there; the youth came and asked his permission; saying; Messenger of Allah. Give me permission to return to my family. The Messenger of Allah; may Allah bless him and grant him peace; gave him permission and said; Take your weapons with you; for I fear the Banu Quraydha tribe. They may harm you. The youth went to his family and found his wife standing between the two doors. He lifted his spear to stab her as jealousy had been aroused in him. She said; Dont be hasty until you go in and see what is in your house. He entered and found a snake coiled up on his bed. He transfixed it with his spear and then went out with it and pitched it into the house. The snake stirred on the end of the spear and the youth fell dead. No one knew which of them died first; the snake or the youth. That was mentioned to the Messenger of Allah; may Allah bless him and grant him peace; and he said; There are jinn in Madina who have become muslim. When you see one of them; call out to it for three days. If it appears after that; then kill it; for it is a shaytan. | The Chapter on Premises in HodHood Indexing, The Book of Pre emption in Property in Muwata Malik
MuwataMalik-017-001-34605 | Yahya related to me from Malik from Abu Hazim Ibn Dinar that Abu Idris AlKhawlani said; I entered the Damascus Masjid and there was a young man with a beautiful mouth and white teeth sitting with some people. When they disagreed about something; they referred it to him and proceeded from his statement. I inquired about him; and it was said; This is Muadh Ibn Jabal. The next day I went to the noon prayer; and I found that he had preceded me to the noon prayer and I found him praying. Abu Idris continued; I waited for him until he had finished the prayer. Then I came to him from in front of him and greeted him and said; By Allah! I love you for Allah! He said; By Allah? I said; By Allah. He said; By Allah? I said; By Allah. He said; By Allah? I said; By Allah. He continued; He took me by the upper part of my cloak and pulled me to him and said; Rejoice! I heard the Messenger of Allah; may Allah bless him and grant him peace; say; Allah; the Blessed and Exalted; said; My love is obliged for those who love each other in Me; and those who sit with each other in Me; and those who visit each other in Me; and those who give to each other generously in Me. | The Chapter on Love And Emotions Son And Brothers in HodHood Indexing, The Book of Judgements in Muwata Malik
MuwataMalik-017-001-34925 | Malik related to me from Yahya Ibn Said from Said Ibn AlMusayab that a Syrian man called Ibn Khaybari found a man with his wife and killed him; or killed them both. Muawiya Ibn Abi Sufyan found it difficult to make a decision and he wrote to Abu Mousa AlAshari to ask Ali Ibn Abi Talib for him about that. So Abu Mousa asked Ali Ibn Abi Talib and AIi said to him; Is this thing in my land? I adjure you; you must tell me. MuwataMalik-017-001-34926 | Yahya said that Malik related from Ibn Shihab that Sunayn Abi Jamila; a man from the Banu Sulaym; found an abandoned child in the time of Umar Ibn AlKhattab. Sunayn took him to Umar Ibn AlKhattab. He asked; What has induced you to take this person? He answered; I found him lost; so I took him. Umar advisor said to him; Amir AlMuminin! He is a man who does good. Umar inquired of him; Is it so? He replied; Yes. Umar Ibn AlKhattab said; Go; he is free; and you have his wala inheritance; and we will provide for him. MuwataMalik-017-001-35035 | Yahya related to me from Malik from Yahya Ibn Said from Salim Ibn Abdullah that Abdullah Ibn Umar sold one of his slaves for eight hundred dirhams with the stipulation that he was not responsible for defects. The person who bought the slave complained to Abdullah Ibn Umar that the slave had a disease which he had not told him about. They argued and went to Uthman Ibn Affan for a decision. The man said; He sold me a slave with a disease which he did not tell me about. Abdullah said; I sold to him with the stipulation that I was not responsible. Uthman Ibn Affan decided that Abdullah Ibn Umar should take an oath that he had sold the slave without knowing that he had any disease. Abdullah Ibn Umar refused to take the oath; so the slave was returned to him and recovered his health in his possession. Abdullah sold him afterwards for 1500 dirhams. Malik said; The generally agreed upon way of doing things among us about a man who buys a female slave and she becomes pregnant; or who buys a slave and then frees him; or if there is any other such matter which has already happened so that he cannot return his purchase; and a clear proof is established that there was a fault in that purchase when it was in the hands of the seller or the fault is admitted by the seller or someone else; is that the slave or slave-girl is assessed for its value with the fault it is found to have had on the day of purchase and the buyer is refunded;from what he paid;the difference between the price of a slave who is sound and a slave with such a defect. Malik said; The generally agreed upon way of doing things among us regarding a man who buys a slave and then finds out that the slave has a defect for which he can be returned and meanwhile another defect has happened to the slave whilst in his possession; is that if the defect which occurred to the slave in his possession has harmed him; like loss of a limb; loss of an eye; or something similar; then he has a choice. If he wants; he can have the price of the slave reduced commensurate with the defect he bought him with according to the prices on the day he bought him; or if he likes; he can pay compensation for the defect which the slave has suffered in his possession and return him. The choice is up to him. If the slave dies in his possession; the slave is valued with the defect which he had on the day of his purchase. It is seen what his price would really have been. If the price of the slave on the day of purchase without fault was 100 dinars; and his price on the day of purchase with fault would have been 80 dinars; the price is reduced by the difference. These prices are assessed according to the market value on the day the slave was purchased. Malik said; The generally agreed upon way of doing things among us is that if a man returns a slave girl in whom he has found a defect and he has already had intercourse with her; he must pay what he has reduced of her price if she was a virgin. If she was not a virgin; there is nothing against his having had intercourse with her because he had charge of her. Malik said; The generally agreed upon way of doing things among us regarding a person; whether he is an inheritor or not; who sells a slave; slave-girl; or animal without a liability agreement is that he is not responsible for any defect in what he sold unless he knew about the fault and concealed it. If he knew that there was a fault and concealed it; his declaration that he was free of responsibility does not absolve him; and what he sold is returned to him. Malik spoke about a situation where a slave-girl was bartered for two other slave-girls and then one of the slave-girls was found to have a defect for which she could be returned. He said; The slave-girl worth two other slave- girls is valued for her price. Then the other two slave-girls are valued; ignoring the defect which the one of them has. Then the price of the slave-girl sold for two slave-girls is divided between them according to their prices so that the proportion of each of them in her price is arrived at - to the higher priced one according to her higher price; and to the other according to her value. Then one looks at the one with the defect; and the buyer is refunded according to the amount her share is affected by the defect; be it little or great. The price of the two slave-girls is based on their market value on the day that they were bought. Malik spoke about a man who bought a slave and hired him out on a long-term or short-term basis and then found out that the slave had a defect which necessitated his return. He said that if the man returned the slave because of the defect; he kept the hire and revenue. This is the way in which things are done in our city. That is because; had the man bought a slave who then built a house for him; and the value of the house was many times the price of the slave; and he then found that the slave had a defect for which he could be returned; and he was returned; he would not have to make payment for the work the slave had done for him. Similarly; he would keep any revenue from hiring him out; because he had charge of him. This is the way of doing things among us. Malik said; The way of doing things among us when someone buys several slaves in one lot and then finds that one of them has been stolen; or has a defect; is that he looks at the one he finds has been stolen or the one in which he finds a defect. If he is the pick of those slaves; or the most expensive; or it was for his sake that he bought them; or he is the one in whom people see the most excellence; then the whole sale is returned. If the one who is found to be stolen or to have a defect is not the pick of the slaves; and he did not buy them for his sake; and there is no special virtue which people see in him; the one who is found to have a defect or to have been stolen is returned as he is; and the buyer is refunded his portion of the total price. | The Chapter on Financial Transaction And Return in HodHood Indexing, The Book of Setting Free and Wala in Muwata Malik
MuwataMalik-017-001-35111 | Malik spoke about what was done among them in the case of a group of people who bought goods; drapery or slaves; and a man heard about it and said to one of the group; I have heard the description and situation of the drapery goods you bought from so-and-so. Shall I give you such-and-such profit to take over your portion? This person agreed; and the man gave him the profit and became a partner in his place. When he looked at the purchase; he saw that it was ugly and found it too expensive. Malik said; It is obliged on him and there is no choice in it for him if he bought it according to a list of contents and the description was well-known. Malik spoke about a man who had drapery goods sent to him; and salesmen came to him and he read to them his list of contents and said; In each bag is such-and-such a wrap from Basra and such-and-such a light wrap from Sabir. Their size is such-and-such; and he named to them types of drapery goods by their sort; and he said; Buy them from me according to this description. They bought the bags according to what he described to them; and then they bought them and found them too expensive and regretted it. Malik said; The sale is binding on them; if the goods agree with the list of contents on which he sold them. Malik said; This is the way of doing things which people still use today. They permit the sale among them when the goods agree with the list of contents and are not different from it. | The Chapter on Financial Transactions And Sales in HodHood Indexing, The Book of Blood Money in Muwata Malik
MuwataMalik-017-001-35184 | Yahya related to me from Malik that the best of what he had heard about a man who is forced by necessity to eat carrion is that he ate it until he was full and then he took provision from it. If he found something which would enable him to dispense with it; he threw it away. Malik when asked whether or not a man who had been forced by necessity to eat carrion; should eat it when he also found the fruit; crops or sheep of a people in that place; answered; If he thinks that the owners of the fruit; crops; or sheep will believe his necessity so that he will not be deemed a thief and have his hand cut off; then I think that he should eat from whatever he finds that which will remove his hunger but he should not carry any of it away. I prefer that he does that than that he eat carrion. If he fears that he will not be believed; and will be deemed a thief for what he has taken; then I think that it is better for him to eat the carrion; and he has leeway to eat carrion in this respect. Even so; I fear that someone who is not forced by necessity to eat carrion might exceed the limits out of a desire to consume other peoples property; crops or fruit. Malik said; That is the best of what I have heard. | The Chapter on Live Stock Milk And Graze in HodHood Indexing, The Book of Marriage in Muwata Malik
MuwataMalik-017-001-35813 | Yahya related to me from Malik; from Yahya Ibn Said; that he heard Said Ibn AlMusayab relating from Abu Huraira that he was once coming back from Bahrayn; and; when he reached AlRabadha; he found a caravan of people from Iraq in ihram; who asked him whether they could eat the meat of some game which they had found with the people of AlRabadha; and he told them they could eat it. He said; Afterwards I had doubts about what I had told them to do; so when I got back to Madina I mentioned the matter to Umar Ibn AlKhattab and he said; What did you tell them to do? I said; I told them to eat it. MuwataMalik-017-001-35815 | Yahya related to me from Malik; from Zayd Ibn Aslam; from Ata Ibn Yasar; that Kaab AlAhbar was once coming back from Syria with a group of riders; and at a certain point along the road they found some game- meat and Kaab said they could eat it. When they got back to Madina they went to Umar Ibn AlKhattab and told him about that; and he said; Who told you you could do that?; and they said; Kaab He said; He was indeed the one I made amir over you until you should return. Later; when they were on the road to Makka; a swarm of locusts passed them by and Kaab told them to catch them and eat them. When they got back to Umar Ibn AlKhattab they told him about this; and he said to Kaab ; What made you tell them they could do that? Kaab said; It is game of the sea. He said; How do you know?; and Kaab said; Amir Almuminin; by the One in whose hand my self is; it is only the sneeze of a fish which it sneezes twice every year. Malik was asked whether a muhrim could buy game that he had found on the way. He replied; Game that is only hunted to be offered to people performing Hajj I disapprove of and forbid; but there is no harm in game that a man has which he does not intend for those in ihram; but which a muhrim finds and buys. Malik said; about someone who had some game with him that he had hunted or bought at the time when he had entered into ihram; that he did not have to get rid of it; and that there was no harm in him giving it to his family. Malik said that it was halal for some one in ihram to fish in the sea or in rivers and lakes; etc. | The Chapter on Games And Hunting And The State Of Ihram in HodHood Indexing, The Book of Hajj in Muwata Malik |
