I told him; I am reduced to this state because of illness and I am wealthy and have no inheritors except a daughter; In this narration the name of Amir Bin Saad is mentioned and in fact it is a mistake; the narrator is Aisha bint Saad Bin Abi Waqqas. Should I give two-thirds of my property in charity? He said; No. I asked; Half? He said; No. then he added; Onethird; and even one-third is much. Youd better leave your inheritors wealthy rather than leaving them poor; begging others. You will get a reward for whatever you spend for Allah sake; even for what you put in your wife mouth. I said; O Allah Messenger ﷺ ! Will I be left alone after my companions have gone? He said; If you are left behind; whatever good deeds you will do will upgrade you and raise you high. And perhaps you will have a long life so that some people will be benefited by you while others will be harmed by you. O Allah! Complete the emigration of my companions and do not turn them renegades. She replied; In three Suhuliya pieces of white cloth of cotton; and there was neither a shirt nor a turban among them. Abu Bakr further asked her; On which day did the Prophet die? She replied; He died on Monday. He asked; What is today? She replied; Today is Monday. He added; I hope I shall die sometime between this morning and tonight. Then he looked at a garment that he was wearing during his illness and it had some stains of saffron. Then he said; Wash this garment of mine and add two more garments and shroud me in them. I said; This is worn out. He said; A living person has more right to wear new clothes than a dead one; the shroud is only for the body pus. He said; No. I said; Shall I then give one half of it in charity? He said; O Sad! Give 1/3 in charity and even 1/3 is too much. No doubt; it is better to leave your children rich than to leave them poor; reduced to begging from others. And Allah will reward you for whatever you spend with the intention of gaining Allah Pleasure even if it were a mouthful of food you put into your wives mouth. I said; O Allah Apostle! Am I to be left behind in Mecca after my companions have gone? He said; If you should be left behind; you will be upgraded and elevated for every deed you will do with a desire to achieve Allah Pleasure. I hope that you will live long so that some people will benefit by you while others will be harmed. O Allah! SunanAlNasai-017-001-11333 | Abd AlAziz Bin Abd AlMalik Bin Abu Mahdhurah narrated that Abdullah Bin Muhairiz - who was an orphan under the care of Abu Mahdhurah until he prepared him to go to AlSham - informed him: he said: I said to Abu Mahdhurah: I am going to AlSham and I am afraid that I will be asked about how you say the Adhan. He told me that Abu Mahdhurah said to him; I went out with a group of people and we were somewhere on the road to Hunain when the Messenger of Allah ﷺ was coming back from Hunain. The Messenger of Allah met us somewhere on the road and the Muadhdhin of the Messenger of Allah called the Adhan for prayer in the presence of the Messenger of Allah. We heard the voice of the Muadhdhin and we were careless about it the Adhan ; so we started yelling; immitating and mocking it. The Messenger of Allah ﷺ heard us; so he sent some people who brought us to stand infront of him. He said; Who is the one whose voice I heard so loud? The people all pointed to me; and they were telling the truth. He sent them all away; but kept me there and said to me: Stand up and call the Adhan for the Prayer. SunanAbuDawoud-017-001-25730 | Narrated Ibn Kaab Bin Malik: On the authority of his father: Umm Mubashshir said to the Prophet ﷺ during the sickness of which he died: What do you think about your illness; Messenger of Allah ﷺ ? I do not think about the illness of my son except the poisoned sheep of which he had eaten with you at Khaybar. The Prophet ﷺ said: And I do not think about my illness except that. This is the time when it cut off my aorta.Abu Dawud said: Sometime Abd AlRazzaq transmitted this tradition; omitting the link of the Companion; from Mamar; from AlZuhri; from the Prophet ﷺ ; and sometimes he transmitted it from AlZuhri from Abdulrahman Bin Kaab Bin Malik; Abdulrahman mentioned that Mamar sometimes transmitted the tradition in a mursal form omitting the link of the Companion ; and they recorded it. A slave-girl of someone visited him; and he was cheered by her and had unlawful intercourse with her. When his people came to visit the patient; he told them about it. He said: Ask the Messenger of Allah ﷺ about the legal verdict for me; for I have had unlawful intercourse with a slave-girl who visited me. So they mentioned it to the Messenger of Allah ﷺ saying: We have never seen anyone so weak from illness as he is. If we bring him to you; his bones will disintegrate. He is only skin and bone. We visited him to inquire about his illness. We found him praying sitting in the apartment of Aisha. We; therefore; stood; praying behind him. He kept silent. We again visited him to inquire about his illness. He offered the obligatory prayer sitting. We; therefore; stood praying behind him; he made a sign to us and we sat down. SunanAbuDawoud-017-001-28990 | Narrated Amir AlRam: We were in our country when flags and banners were raised. I said: What is this? The the people said: This is the banner of the Messenger of Allah ﷺ. So I came to him. He was sitting under a tree. A sheet of cloth was spread for him and he was sitting on it. His Companions were gathered around him. I sat with them. The Messenger of Allah ﷺ mentioned illness and said: When a believer is afflicted by illness and Allah cures him of it; it serves as an atonement for his previous sins and a warning to him for the future. But when a hypocrite becomes ill and is then cured; he is like a camel which has been tethered and then let loose by its owners; but does not know why they tethered it and why they let it loose. A man from among those around him asked: Messenger of Allah; what are illnesses? I swear by Allah; I never fell ill. The Messenger of Allah ﷺ said: Get up and leave us. You do not belong to our number. When we were with him; a man came to him. He had a sheet of cloth and something in his hand. He turned his attention to him and said: Messenger of Allah; when I saw you; I turned towards you. I saw a group of trees and heard the sound of fledglings. I took them and put them in my garment. Their mother then came and began to hover round my head. I showed them to her; and she fell on them. I wrapped them with my garment. They are now with me. He said: Put them away from you. So I put them away; but their mother stayed with them. The Messenger of Allah ﷺ said to his companions: Are you surprised at the affection of the mother for her young? They said: Yes; Messenger of Allah. He said: I swear by Him Who has sent me with the Truth; Allah is more affectionate to His servants than a mother to her young ones. MuwataMalik-017-001-34607 | Yahya related to me from Malik that Muhammad Ibn Abi Umama Ibn Sahl Ibn Hunayf heard his father say; My father; Sahl Ibn Hunayf did a ghusl at AlKharrar. He removed the jubbah he had on while Amir Ibn Rabia was watching; and Sahl was a man with beautiful white skin. Amir said to him; I have never seen anything like what I have seen today; not even the skin of a virgin. Sahl fell ill on the spot; and his condition grew worse. Somebody went to the Messenger of Allah; may Allah bless him and grant him peace; and told him that Sahl was ill; and could not go with him. The Messenger of Allah; may Allah bless him and grant him peace; came to him; and Sahl told him what had happened with Amir. The Messenger of Allah; may Allah bless him and grant him peace; said; Why does one of you kill his brother? Why did you not say; May Allah bless you? ta baraka-llah The evil eye is true. MuwataMalik-017-001-34614 | Yahya related to me from Malik from Yahya Ibn Said that death came to a man in the time of the Messenger of Allah; may Allah bless him and grant him peace. MuwataMalik-017-001-34806 | Malik said; The generally agreed-on way of doing things in our community is that any setting-free which a man makes in a bequest that he wills in health or illness can be rescinded by him when he likes and changed when he likes as long as it is not a tadbir. There is no way to rescind a tadbir once he has made it. As for every child born to him by a slave-girl who he wills to be set free but he does not make mudabbara; her children are not freed with her when she is freed. That is because her master can change his will when he likes and rescind it when he likes; and being set free is not confirmed for her. She is in the position of a slave-girl whose master says; If so- and-so remains with me until I die; she is free. i.e. he does not make a definite contract. Malik said; If she fulfils that; that is hers. If he wishes; before that; he can sell her and her child because he has not entered her child into any condition he has made for her. The bequest in setting free is different from the tadbir. The precedent of the sunna makes a distinction between them. Had a bequest been in the position of a tadbir; no testator would be able to change his will and what he mentioned in it of setting free. His property would be tied up and he would not be able to use it. Malik said about a man who made all his slaves mudabbar while he was well and they were his only property; If he made some of them mudabbar before the others; one begins with the first until the third of his property is reached. i.e. their value is matched against the third; and those whose value is covered are free. If he makes the mall mudabbar in his illness; and says in one statement; So-and-so is free. So-and-so is free. So-and-so is free if my death occurs in this illness; or he makes them all mudabbar in one statement; they are matched against the third and one does not begin with any of them before the others. It is a bequest and they have a third of his property divided between them in shares. Then the third of his property frees each of them according to the extent of his share. No single one of them is given preference when that all occurs in his illness. Malik spoke about a master who made his slave a mudabbar and then he died and the only property he had was the mudabbar slave and the slave had property. He said; A third of the mudabbar is freed and his property remains in his possession. Malik said about a mudabbar whose master gave him a kitaba and then the master died and did not leave any property other than him; A third of him is freed and a third of his kitaba is reduced; and he owes two-thirds. Malik spoke about a man who freed half of his slave while he was ill and made irrevocable his freeing half of him or all of him; and he had made another slave of his mudabbar before that. He said; One begins with the slave he made mudabbar before the one he freed while he was ill. That is because the man cannot revoke what he has made mudabbar and cannot follow it with a matter which will rescind it. When this mudabbar is freed; then what remains of the third goes to the one who had half of him freed so as to complete his setting-free entirely in the third of the property of the deceased. If what is left of the third does not cover that; whatever is covered by what is left of the third is freed after the first mudabbar is freed. | The Chapter on Selling Of Slaves in HodHood Indexing, The Book of Speech in Muwata Malik
MuwataMalik-017-001-34813 | Malik said; The generally agreed-on way of doing things among us in the case of slave whose master makes a bequest to free part of him - a third; a fourth; a half; or any share after his death; is that only the portion of him is freed that his master has named. This is because the freeing of that portion is only obliged to take place after the death of the master because the master has the option to withdraw the bequest as long as he lives. When the slave is freed from his master; the master is a testator and the testator only has access to free what he can take from his property; being the third of the property he is allowed to bequeath; and the rest of the slave is not free because the man property has gone out of his hands. How can the rest of the slave which belongs to other people be free when they did not initiate the setting free and did not confirm it and they do not have the wala established for them? Only the deceased could do that. He was the one who freed him and the one for whom the wala was confirmed. That is not to be borne by another property unless he bequeaths within the third of his property what remains of a lave to be freed. That is a request against his partners and inheritors and the partners must not refuse the slave that when it is within the third of the dead man property because there is no harm in that to the inheritors. Malik said; If a man frees a third of his slave while he is critically ill; he must complete the emancipation so all of him is free from him; if it is within the third of his property that he has access to; because he is not treated in the same way as a man who frees a third of a slave after his death; because had the one who freed a third of his slave after his death lived; he could have cancelled it and the slave being set free would be of no effect. The master who made the freeing of the third of the slave irrevocable in his illness; would still have to free all of him if he lived. If he died; the slave would be set free within the third of the bequest. That is because the command of the deceased is permissible in his third as the command of the healthy is permissible in all his property. | The Chapter on Slave As A Property in HodHood Indexing, The Book of Speech in Muwata Malik
MuwataMalik-017-001-34889 | Yahya said that he heard Malik say; The best of what I have heard about the testament of a pregnant woman and about what settlements she is permitted in her property is that the pregnant woman is like the sick person. When the illness is light; and one does not fear for the sick person; he does with his property what he likes. If the illness is such that his life is feared for; he can only dispose of a third of his estate. He said; It is the same with a woman who is pregnant. The beginning of pregnancy is good news and joy. It is not illness and no fear because Allah the Blessed; the Exalted; said in His Book; We gave her good news of Ishaq and after Ishaq; Yaqub. Surat ll ayat 71. And He said; She bore a light burden and passed by with it; but when she became heavy; they called upon Allah; their Lord; If you give us a good-doing son; we will be among the thankful. Surat 7 ayat 189. When a pregnant woman becomes heavy; she is only permitted to dispose of a third of her estate. The beginning of this restriction is after six months. Allah; the Blessed; the Exalted; said in His Book; Mothers suckle their children for two complete years. And He said; his bearing and weaning are thirty months. Surat 2 ayat 233. When six months have passed for the pregnant woman from the day she conceived; she is only permitted to dispose of a third of her property. Yahya said that he heard Malik say; A man who is advancing in the row for battle; can only dispose of a third of his property. He is in the same position as a pregnant woman or an ill person who is feared for; as long as he is in that situation. | The Chapter on Recitation Of Ayat in HodHood Indexing, The Book of Hair in Muwata Malik
MuwataMalik-017-001-35230 | Yahya related to me from Malik that he heard Rabia Ibn Abi Abdulrahman say; I heard that the wife of Abdulrahman Ibn Awuf asked him to divorce her. He said; When you have menstruated and are pure; then come to me. She did not menstruate until Abdulrahman Ibn Awuf was ill. When she was purified; she told him and he divorced her irrevocably or made a pronouncement of divorce which was all that he had left over her Abd arRahman Ibn Awuf was terminally ill at the time; so Uthman Ibn Affan made her one of the heirs after the end of her idda. | The Chapter on Menstruation And Sexual Intercourse in HodHood Indexing, The Book of Marriage in Muwata Malik
MuwataMalik-017-001-35232 | Yahya related to me from Malik that he had heard Ibn Shihab say; When a man who is terminally ill divorces his wife three times; she inherits from him. Malik said; If he divorces her while he is terminally ill before he has consummated the marriage; she has half of the bride-price and inherits; and she does not have to do an idda. If he consummated the marriage; she has all the dowry and inherits. The virgin and the previously married woman are the same in this situation according to us. | The Chapter on Marriage And Consummating The Marriage in HodHood Indexing, The Book of Marriage in Muwata Malik
MuwataMalik-017-001-35522 | Yahya related to me; and I myself heard Malik say; The best that I have heard about some one who has to fast for two consecutive months because of having killed someone by mistake or having pronounced the dhihar form of divorce; becoming very ill and having to break his fast; is that if he recovers from his illness and is strong enough to fast; he must not delay doing so. He continues his fast from where he left off. Similarly; a woman who has to fast because of having killed some one by mistake should not delay resuming her fast when she has become pure after her period. She continues her fast from where she left off. No one who; by the Book of Allah; has to fast for two consecutive months may break his fast except for a reason - illness or menstruation. He must not travel and break his fast. Malik said; This is the best that I have heard about the matter. | The Chapter on Menstruation And Fasting in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35523 | Yahya said that he heard Malik say; What I have heard from the people of knowledge is that if a man succumbs to an illness which makes fasting very difficult for him and exhausts him and wears him out; he can break his fast. This is the same as with a sick man in the prayer; who finds standing to be too difficult and exhausting; and Allah knows better than the slave that it is an excuse for him and that it really cannot be described. If the man is in such a condition he prays sitting; and the deen of Allah is ease. Allah has permitted a traveller to break the fast when travelling; and he has more strength for fasting than a sick man. Allah; the Exalted; says in His book; Whoever among you is ill or on a journey must fast a number of other days; and Allah has thus permitted a traveller to break his fast when on a journey; and he is more capable of fasting than a sick man. | The Chapter on Journeys And Travel And Waiving Of Fasting in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35624 | Yahya related to me from Malik from Ibn Shihab that Abu Umama Ibn Sahl Ibn Hunayf told him that once a poor woman fell ill and the Messenger of Allah; may Allah bless him and grant him peace; was told of her illness; and the Messenger of Allah; may Allah bless him and grant him peace; used to visit poor people frequently and ask after them. The Messenger of Allah; may Allah bless him and grant him peace; said; Let me know if she dies. Her bier was brought out at night- time and they did not want to wake up the Messenger of Allah; may Allah bless him and grant him peace. In the morning the Messenger of Allah; may Allah bless him and grant him peace; was told what had happened to her and he said; Didnt I tell you to let me know if she died? They replied; Messenger of Allah; we did not want to wake you up and make you come out in the night. Then the Messenger of Allah; may Allah bless him and grant him peace; went out and formed everyone into rows by her grave and said Allah is greater four times. | The Chapter on Granting Peace in HodHood Indexing, The Book of Hajj in Muwata Malik |
