SahihAlBukhari-017-001-1269 | Narrated Abu Qatada: Allah Messenger ﷺ said on the Day of the battle of Hunain; Whoever has killed an infidel and has a proof or a witness for it; then the salb arms and belongings of that deceased will be for him. I stood up to seek a witness to testify that I had killed an infidel but I could not find any witness and then sat down. Then I thought that I should mention the case to Allah Messenger ﷺ I and when I did so a man from those who were sitting with him said; The arms of the killed person he has mentioned; are with me; so please satisfy him on my behalf. Abu Bakr said; No; he will not give the arms to a bird of Quraish and deprive one of Allah lions of it who fights for the cause of Allah and His Apostle. Allah Messenger ﷺ I stood up and gave it to me; and I bought a garden with its price; and that was my first property which I owned through the war booty. The people of Hijaz said; A judge should not pass a judgment according to his knowledge; whether he was a witness at the time he was the judge or before that And if a litigant gives a confession in favor of his opponent in the court; in the opinion of some scholars; the judge should not pass a judgment against him till the latter calls two witnesses to witness his confession. And some people of Iraq said; A judge can pass a judgement according to what he hears or witnesses the litigant confession in the court itself; but if the confession takes place outside the court; he should not pass the judgment unless two witnesses witness the confession. Some of them said; A judge can pass a judgement depending on his knowledge of the case as he is trust-worthy; and that a witness is Required just to reveal the truth. The judge knowledge is more than the witness. Some said; A judge can judge according to his knowledge only in cases involving property; but in other cases he cannot. SahihAlBukhari-017-001-6470 | Narrated Aisha: Saad was wounded on the day of Khandaq i.e. Trench when a man from Quraish; called Hibban Bin AlAraqa hit him with an arrow. The man was Hibban Bin Qais from the tribe of Bani Mais Bin Amir Bin Louai who shot an arrow at Saad medial arm vein or main artery of the arm. The Prophet ﷺ pitched a tent for Sad in the Masjid so that he might be near to the Prophet ﷺ to visit. When the Prophet returned from the battle of AlKhandaq i.e. Trench and laid down his arms and took a bath Gabriel came to him while he i.e. Gabriel was shaking the dust off his head; and said; You have laid down the arms? By Allah; I have not laid them down. Go out to them to attack them. The Prophet ﷺ said; Where? Gabriel pointed towards Bani Quraidha. So Allah Messenger ﷺ went to them i.e. Banu Quraidha i.e. besieged them. They then surrendered to the Prophet judgment but he directed them to Saad to give his verdict concerning them. Saad said; I give my judgment that their warriors should be killed; their women and children should be taken as captives; and their properties distributed. Narrated Hisham: My father informed me that Aisha said; Saad said; O Allah! You know that there is nothing more beloved to me than to fight in Your Cause against those who disbelieved Your Apostle and turned him out of Mecca. O Allah! I think you have put to an end the fight between us and them i.e. Quraish infidels. And if there still remains any fight with the Quraish infidels ; then keep me alive till I fight against them for Your Sake. But if you have brought the war to an end; then let this wound burst and cause my death thereby. So blood gushed from the wound. There was a tent in the Masjid belonging to Banu Ghifar who were surprised by the blood flowing towards them. They said; O people of the tent! What is this thing which is coming to us from your side? Behold! Blood was flowing profusely out of Saad wound. SahihMuslim-017-001-21927 | Abu Huraira reported Allah Messenger way ﷺ as saying: If any owner of gold or silver does not pay what is due on him; when the Day of Resurrection would come; plates of fire would be beaten out for him; these would then be heated in the fire of Hell and his sides; his forehead and his back would be cauterized with them. Whenever these cool down; the process is repeated during a day the extent of which would be fifty thousand years; until judgment is pronounced among servants; and he sees whether his path is to take him to Paradise or to Hell. It was said: Messenger of Allah; what about the camel? He the Holy Prophet said: If any owner of the camel does not pay what is due on him; and of his due in that camel is also to milk it on the day when it comes down to water. When the Day of Resurrection comes a soft sandy plain would be set for him; as extensive as possible; he will find that not a single young one is missing; and they will trample him with their hoofs and bite him with their mouths. As often as the first of them passes him; the last of them would be made to return during a day the extent of which would be fifty thousand years; until judgment is pronounced among servants and he sees whether his path is to take him to Paradise or to Hell. It was again said: Messenger of Allah; what about cows cattle and sheep? He said: It any owner of the cattle and sheep does not pay what is due on them; when the Day of Resurrection comes a soft sandy plain would be spread for them; he will find none of them missing; with twisted horns; without horns or with a broken horn; and they will gore him with their horns and trample him with their hoofs. As often as the first of them passes him the last of them would be made to return to him during a day the extent of which would be fifty thousand years; until judgment would be pronounced among the servants. And he would be shown his path-path leading him to Paradise or to Hell. It was said: Messenger of Allah; what about the horse? Upon this he said: The horses are of three types. To one than these are a burden; and to another man these are a covering; and still to another man these are a source of reward. The one for whom these are a burden is the person who rears them in order to show off; for vainglory and for opposing the Muslims; so they are a burden for him. The one for whom these are a covering is the person who rears them for the sake of Allah but does not forget the right of Allah concerning their backs and their necks; and so they are a covering for him. As for those which bring reward these refer to the person who rears them for the sake of Allah to be used for Muslims and he puts them in meadow and field. And whatever thing do these eat from that meadow and field would be recorded on his behalf as good deeds; as would also the amount of their dung and urine. And these would not break their halter and prance a course or two without having got recorded the amount of their hoof marks and their dung as a good deed on his behalf on behalf of their owner. And their master does not bring them past a river from which they drink; though he did not intend to quench their thirst; but Allah would record for him the amount of what they drink on his behalf as deeds. SahihMuslim-017-001-21929 | Abu Huraira reported Allah Messenger ﷺ as saying: No owner of the treasure who does not pay Zakat would be spared but his hoards would be heated in the Fire of Hell and these would be made into plates and with these his sides; his forehead would be cauterised till Allah would pronounce judgment among His servants during a day; the extent of which would be fifty thousand years. He would then see his path; leading either to Paradise or to Hell. And no owner of the camels who does not pay Zakat would be spared but a soft sandy plain would be set for him and they the camels would be made to pass over him till the last of them would be made to return till Allah would pronounce judgment among His servants during a day the extent of which would be fifty thousand years. He would then see his path leading him to Paradise or leading him to Hell. And no owner of the cattle and goats who does not pay Zakat would be spared but a soft sandy plain would be set for him; he would find none of them missing; with twisted horns; without horns; or with broken horns; and they will gore him with their horns and trample him with their hoofs and they would be made to pass over him till the last of them would be made to return till Allah would pronounce judgment among His servants; during a day the extent of which would be fifty thousand years; and he would see the paths leading to Paradise or to Hell. Suhail said: I do not know whether he made mention of the cows. They said: Messenger of Allah ﷺ ; what about the horses? He said: The horses have goodness in their foreheads or he said or goodness is ingrained in the foreheads of the horses Suhail said: I am in doubt as to what was actually said up till the Day Of Judgment. The horses are of three kinds. They are a source of reward to a person; they are a covering to a person; and they are a burden to a person. As for those which bring reward is that a person would get reward who rears them for the sake of Allah and trains them for Him; and nothing disappears in their stomachs but Allah would record for him a good deed. And if they were to graze in the meadow; they would eat nothing but Allah would record for him a reward. And if they were to drink water from the canal; with every drop that; would disappear in their stomachs there would be reward for the owner. He went on describing till a reward was mentioned for their urine and dung. And if they pranced a course or two; there would be recorded a reward for every pace that they covered. As for one for whom they are a covering; he is the man who rears them for honour and dignity but does not forget the right of their backs and their stomachs; in plenty and adversity; As regards one for whom they are a burden; he is that who rears them for vainglory and showing off to the people; for him they are; the burden. They said: Messenger of Allah; what about asses? SunanAlNasai-017-001-12430 | It was narrated from Abu Huraira and Zaid Bin Khalid AlJuhani that: Two men referred a dispute to the Messenger of Allah SAWSYMOBOL. One of them said: O Messenger of Allah; pass judgment between us according to the Book of Allah. The other; who was wiser; said: Yes; O Messenger of Allah; and allow me to speak. He said: My son was a laborer serving this man; and he committed Zina with his wife. SunanAlNasai-017-001-13819 | It was narrated that Malik Bin Aws Bin AlHadathan said: AlAbbas and Ali came to Umar with a dispute. AlAbbas said: Pass judgment between him and I. the people said: Pass judgment between them. Umar said: I will not pass judgment between them. They know that the Messenger of Allah said: We are not inherited from; what we leave behind is charity. He said: And in this narration of it AlZuhri said: It the Khumus was under the control of the Messenger of Allah ; and he took provision for himself and for his family from it; and disposed to the rest of it as he disposed of other wealth belonging to the Muslims. Then Abu Bakr took control of it; then I took control of it after Abu Bakr; and I did with it what he sued to do. Then these two came to me and asked me to give it to them so that they could dispose of it as the Messenger of Allah disposed of it; and as Abu Bakr disposed of it; and as I disposed of it. So I gave it to them and I took promises from them that they would take proper care of it. Then they came to me and this one said. Give me my share from my brothers son: and this one said: Give me my share from my wife. If they want me to give it to them on the condition that they would dispose of it in the same manner as the Messenger of Allah did; and as Abu Bakr did; and as I did; I would give it to them; but if they refuse; then they do not have to worry about it. Then he said: And know that whatever of spoils of war that you may gain; verily; one-fifth of it is assigned to Allah; and to the Messenger; and to the near relatives of the Messenger Muhammad ; and also the orphans; AlMasakin the poor and the wayfarer AlAnfal 8:41 this if for them. AlSadaqat here it means Zakah are only for the Fuqara poor ; and AlMasakin the poor and those employed to collect the funds ; and to attract the hearts of those who have been inclined toward Islam ; and to free the captives; and for those in debt; and for Allah cause I.e. for Mujahidun - those fighting in a holy battle - this is for them. And what Allah gave as booty Fay to His Messenger Muhammad from them - for this you made no expeditin with either cavalry or camels. AlZuhri said: This applies exclusively to the Messenger of Allah and refers to an Arab village called Fadak; and so on. SunanAbuDawoud-017-001-25781 | Narrated Abu Dawud: I found in my notebook from Shaiban and I did not hear from him ; Abu Bakr; a reliable friend of ours; said: Shaiban - Muhammad Bin Rashid - Sulaiman Bin Mousad - Amr Bin Suhaib; On his father authority; said that his grandfather said: The Messenger of Allah ﷺ would fix the blood-money for accidental killing at the rate of four hundred dinars or their equivalent in silver for townsmen; and he would fix it according to the price of camels. So when they were dear; he increased the amount to be paid; and when cheap prices prevailed he reduced the amount to be paid. In the time of the Messenger of Allah ﷺ they reached between four hundred and eight hundred dinars; their equivalent in silver being eight thousand dirhams. He said: The Messenger of Allah ﷺ gave judgment that those who possessed cattle should pay two hundred cows; and those who possessed sheep two thousand sheep. He said: The Messenger of Allah ﷺ said: The blood-money is to be treated as something to be inherited by the heirs of the one who has been killed; and the remainder should be divided among the agnates. He said: The Messenger of Allah ﷺ gave judgment that for cutting off a nose completely there was full blood-money; one hundred camels were to be paid. If the tip of the nose was cut off; half of the blood-money;i.e. fifty camels were to be paid; or their equivalent in gold or in silver; or a hundred cows; or one thousand sheep. For the hand; when it was cut of;f half of the blood-money was to be paid; for one foot of half; the blood-money was to be paid. For a wound in the head; a third of the blood-money was due; i.e. thirty-three camels and a third of the blood-money; or their equivalent in gold; silver; cows or sheep. For a head thrust which reaches the body; the same blood-money was to be paid. Ten camels were to be paid for every finger; and five camels for every tooth. The Messenger of Allah ﷺ gave judgment that the blood-money for a woman should be divided among her relatives on her father side; who did not inherit anything from her except the residence of her heirs. If she was killed; her blood-money should be distributed among her heirs; and they would have the right of taking revenge on the murderer. The Messenger of Allah ﷺ said: There is nothing for the murderer; and if he the victim has no heir; his heir will be the one who is nearest to him among the people; but the murderer should not inherit anything. SunanAbuDawoud-017-001-26646 | Narrated Abu Huraira: This is Mamar version which is more accurate. A man and a woman of the Jews committed fornication. Some of them said to the others: Let us go to this Prophet; for he has been sent with an easy law. If he gives a judgment lighter than stoning; we shall accept it; and argue about it with Allah; saying: It is a judgment of one of your prophets. So they came to the Prophet ﷺ who was sitting in the Masjid among his companions. They said: AbulQasim; what do you think about a man and a woman who committed fornication? He did not speak to them a word till he went to their school. He stood at the gate and said: I adjure you by Allah Who revealed the Torah to Moses; what punishment do you find in the Torah for a person who commits fornication; if he is married? They said: He shall be blackened with charcoal; taken round a donkey among the people; and flogged. A young man among them kept silent. When the Prophet ﷺ emphatically adjured him; he said: By Allah; since you have adjured us we inform you that we find stoning in the Torah is the punishment for fornication. The Prophet ﷺ said: So when did you lessen the severity of Allah command? He said: A relative of one of our kings had committed fornication; but his stoning was suspended. Then a man of a family of common people committed fornication. He was to have been stoned; but his people intervened and said: Our man shall not be stoned until you bring your man and stone him. So they made a compromise on this punishment between them. The Prophet ﷺ said: So I decide in accordance with what the Torah says. He then commanded regarding them and they were stoned to death. AlZuhri said: We have been informed that this verse was revealed about them: It was We Who revealed the Law to Moses : therein was guidance and light.
