Allah creates what He wills for verily Allah has power over all things.
Surat AlAnam Ayah 146Surat AlAnam-0.2767وَعَلَى الَّذِينَ هَادُوا حَرَّمْنَا كُلَّ ذِي ظُفُرٍ وَمِنَ الْبَقَرِ وَالْغَنَمِ حَرَّمْنَا عَلَيْهِمْ شُحُومَهُمَا إِلَّا مَا حَمَلَتْ ظُهُورُهُمَا أَوِ الْحَوَايَا أَوْ مَا اخْتَلَطَ بِعَظْمٍ ذَلِكَ جَزَيْنَاهُمْ بِبَغْيِهِمْ وَإِنَّا لَصَادِقُونَFor those who followed the Jewish Law, We forbade every (animal) with undivided hoof, and We forbade them that fat of the ox and the sheep, except what adheres to their backs or their entrails, or is mixed up with a bone: this in recompense for their wilful disobedience: for We are true (in Our ordinances).
Surat AlFath Ayah 25Surat AlFath-0.24111هُمُ الَّذِينَ كَفَرُوا وَصَدُّوكُمْ عَنِ الْمَسْجِدِ الْحَرَامِ وَالْهَدْيَ مَعْكُوفًا أَنْ يَبْلُغَ مَحِلَّهُ وَلَوْلَا رِجَالٌ مُؤْمِنُونَ وَنِسَاءٌ مُؤْمِنَاتٌ لَمْ تَعْلَمُوهُمْ أَنْ تَطَئُوهُمْ فَتُصِيبَكُمْ مِنْهُمْ مَعَرَّةٌ بِغَيْرِ عِلْمٍ لِيُدْخِلَ اللَّهُ فِي رَحْمَتِهِ مَنْ يَشَاءُ لَوْ تَزَيَّلُوا لَعَذَّبْنَا الَّذِينَ كَفَرُوا مِنْهُمْ عَذَابًا أَلِيمًاThey are the ones who denied Revelation and hindered you from the Sacred Mosque and the sacrificial animals, detained from reaching their place of sacrifice. Had there not been believing men and believing women whom ye did not know that ye were trampling down and on whose account a crime would have accrued to you without (your) knowledge, (Allah would have allowed you to force your way, but He held back your hands) that He may admit to His Mercy whom He will. If they had been apart, We should certainly have punished the Unbelievers among them with a grievous Punishment.
Surat AlMaidah Ayah 3Surat AlMaidah-0.2112حُرِّمَتْ عَلَيْكُمُ الْمَيْتَةُ وَالدَّمُ وَلَحْمُ الْخِنْزِيرِ وَمَا أُهِلَّ لِغَيْرِ اللَّهِ بِهِ وَالْمُنْخَنِقَةُ وَالْمَوْقُوذَةُ وَالْمُتَرَدِّيَةُ وَالنَّطِيحَةُ وَمَا أَكَلَ السَّبُعُ إِلَّا مَا ذَكَّيْتُمْ وَمَا ذُبِحَ عَلَى النُّصُبِ وَأَنْ تَسْتَقْسِمُوا بِالْأَزْلَامِ ذَلِكُمْ فِسْقٌ الْيَوْمَ يَئِسَ الَّذِينَ كَفَرُوا مِنْ دِينِكُمْ فَلَا تَخْشَوْهُمْ وَاخْشَوْنِ الْيَوْمَ أَكْمَلْتُ لَكُمْ دِينَكُمْ وَأَتْمَمْتُ عَلَيْكُمْ نِعْمَتِي وَرَضِيتُ لَكُمُ الْإِسْلَامَ دِينًا فَمَنِ اضْطُرَّ فِي مَخْمَصَةٍ غَيْرَ مُتَجَانِفٍ لِإِثْمٍ فَإِنَّ اللَّهَ غَفُورٌ رَحِيمٌForbidden to you (for food) are: dead meat, blood, the flesh of swine, and that on which hath been invoked the name of other than Allah; that which hath been killed by strangling, or by a violent blow, or by a headlong fall, or by being gored to death; that which hath been (partly) eaten by a wild animal; unless ye are able to slaughter it (in due form); that which is sacrificed on stone (altars); (forbidden) also is the division (of meat) by raffling with arrows: that is impiety. This day have those who reject faith given up all hope of your religion: yet fear them not but fear Me. This day have I perfected your religion for you, completed My favour upon you, and have chosen for you Islam as your religion. But if any is forced by hunger, with no inclination to transgression, Allah is indeed Oft-forgiving, Most Merciful.
Surat AlMaidah Ayah 95Surat AlMaidah-0.083112يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَقْتُلُوا الصَّيْدَ وَأَنْتُمْ حُرُمٌ وَمَنْ قَتَلَهُ مِنْكُمْ مُتَعَمِّدًا فَجَزَاءٌ مِثْلُ مَا قَتَلَ مِنَ النَّعَمِ يَحْكُمُ بِهِ ذَوَا عَدْلٍ مِنْكُمْ هَدْيًا بَالِغَ الْكَعْبَةِ أَوْ كَفَّارَةٌ طَعَامُ مَسَاكِينَ أَوْ عَدْلُ ذَلِكَ صِيَامًا لِيَذُوقَ وَبَالَ أَمْرِهِ عَفَا اللَّهُ عَمَّا سَلَفَ وَمَنْ عَادَ فَيَنْتَقِمُ اللَّهُ مِنْهُ وَاللَّهُ عَزِيزٌ ذُو انْتِقَامٍO ye who believe! Kill not game while in the sacred precincts or in pilgrim garb. If any of you doth so intentionally, the compensation is an offering, brought to the Ka'ba, of a domestic animal equivalent to the one he killed, as adjudged by two just men among you; or by way of atonement, the feeding of the indigent; or its equivalent in fasts: that he may taste of the penalty of his deed. Allah forgives what is past: for repetition Allah will exact from him the penalty. For Allah is Exalted, and Lord of Retribution.

Violate not the sanctity of the symbols of Allah, nor of the sacred month, nor of the animals brought for sacrifice, nor the garlands that mark out such animals, nor the people resorting to the sacred house, seeking of the bounty and good pleasure of their Lord. But when ye are clear of the sacred precincts and of pilgrim garb, ye may hunt and let not the hatred of some people in (once) shutting you out of the Sacred Mosque lead you to transgression (and hostility on your part). Help ye one another in righteousness and piety, but help ye not one another in sin and rancour: fear Allah: for Allah is strict in punishment.

Surat Yunus Ayah 24Surat Yunus0.2349إِنَّمَا مَثَلُ الْحَيَاةِ الدُّنْيَا كَمَاءٍ أَنْزَلْنَاهُ مِنَ السَّمَاءِ فَاخْتَلَطَ بِهِ نَبَاتُ الْأَرْضِ مِمَّا يَأْكُلُ النَّاسُ وَالْأَنْعَامُ حَتَّى إِذَا أَخَذَتِ الْأَرْضُ زُخْرُفَهَا وَازَّيَّنَتْ وَظَنَّ أَهْلُهَا أَنَّهُمْ قَادِرُونَ عَلَيْهَا أَتَاهَا أَمْرُنَا لَيْلًا أَوْ نَهَارًا فَجَعَلْنَاهَا حَصِيدًا كَأَنْ لَمْ تَغْنَ بِالْأَمْسِ كَذَلِكَ نُفَصِّلُ الْآيَاتِ لِقَوْمٍ يَتَفَكَّرُونَThe likeness of the life of the present is as the rain which We send down from the skies: by its mingling arises the produce of the earth- which provides food for men and animals: (It grows) till the earth is clad with its golden ornaments and is decked out (in beauty): the people to whom it belongs think they have all powers of disposal over it: There reaches it Our command by night or by day, and We make it like a harvest clean-mown, as if it had not flourished only the day before! thus do We explain the Signs in detail for those who reflect.

Say: lawful unto you are (all) things good and pure: and what ye have taught your trained hunting animals (to catch) in the manner directed to you by Allah: eat what they catch for you, but pronounce the name of Allah over it: and fear Allah; for Allah is swift in taking account.
Surat AlHajj Ayah 36Surat AlHajj0.3103وَالْبُدْنَ جَعَلْنَاهَا لَكُمْ مِنْ شَعَائِرِ اللَّهِ لَكُمْ فِيهَا خَيْرٌ فَاذْكُرُوا اسْمَ اللَّهِ عَلَيْهَا صَوَافَّ فَإِذَا وَجَبَتْ جُنُوبُهَا فَكُلُوا مِنْهَا وَأَطْعِمُوا الْقَانِعَ وَالْمُعْتَرَّ كَذَلِكَ سَخَّرْنَاهَا لَكُمْ لَعَلَّكُمْ تَشْكُرُونَThe sacrificial camels we have made for you as among the symbols from Allah: in them is (much) good for you: then pronounce the name of Allah over them as they line up (for sacrifice): when they are down on their sides (after slaughter), eat ye thereof, and feed such as (beg not but) live in contentment, and such as beg with due humility: thus have We made animals subject to you, that ye may be grateful.

While I was at the bank of a river a man was praying and the reins of his animal were in his hands and the animal was struggling and he was following the animal. Shuba; a sub-narrator; said that man was Abu Barza AlAslami. A man from the Khawarij said; O Allah! Be harsh to this sheik. And when the sheik Abu Barza finished his prayer; he said; I heard your remark. SahihAlBukhari-017-001-1927Narrated Urwa-bin AlZubair: Usama Bin Zaid said; The Prophet ﷺ rode over a donkey with a saddle underneath which there was a thick soft Fadakiya velvet sheet. Usama Bin Zaid was his companion rider; and he was going to pay a visit to Saad Bin Ubada who was sick at the dwelling place of Bani AlHarith Bin AlKhazraj; and this incident happened before the battle of Badr. The Prophet ﷺ passed by a gathering in which there were Muslims and pagan idolators and Jews; and among them there was Abdullah Bin Ubai Bin Salul; and there was Abdullah Bin Rawaha too. When a cloud of dust raised by the animal covered that gathering; Abdullah Bin Ubai covered his nose with his Rida sheet and said to the Prophet ; Dont cover us with dust. The Prophet ﷺ greeted them and then stopped; dismounted and invited them to Allah i.e.; to embrace Islam and also recited to them the Holy Quran. Abdullah Bin Ubai Bin Salul said; O man! There is nothing better than what you say; if what you say is the truth. So do not trouble us in our gatherings. Go back to your mount or house; and if anyone of us comes to you; tell your tales to him. On that Abdullah Bin Rawaha said; O Allah Messenger ﷺ ! Come to us and bring it what you want to say in our gatherings; for we love that. So the Muslims; the pagans and the Jews started quarreling till they were about to fight and clash with one another. The Prophet ﷺ kept on quietening them till they all became quiet. He then rode his animal; and proceeded till he entered upon Saad Bin Ubada; he said; O Sad; didnt you hear what Abu Habbab said? He meant Abdullah Bin Ubai. He said so-and-so. Saad Bin Ubada said; O Allah Messenger ﷺ ! Excuse and forgive him; for by Allah; Allah has given you what He has given you. The people of this town decided to crown him as their chief and make him their king. But when Allah prevented that with the Truth which He had given you; it choked him; and that was what made him behave in the way you saw him behaving. SahihAlBukhari-017-001-2079Narrated AlBara Bin Azib that once he had a guest; so he told his family on the Day of Eid AlAdha that they should slaughter the animal for sacrifice before he returned from the Id prayer in order that their guest could take his meal. So his family slaughtered the animal before the prayer. Then they mentioned that event to the Prophet who ordered AlBara to slaughter another sacrifice. AlBara said to the Prophet ﷺ ; I have a young milch goat which is better than two sheep for slaughtering. The sub-narrator; Ibn aown used to say; I dont know whether the permission to slaughter a goat as a sacrifice was especially given to AlBara or if it was in general for all the Muslims. SahihAlBukhari-017-001-2128Narrated Abu Saeed AlKhudri: Allah Messenger ﷺ said; The thing I am afraid of most for your sake; is the worldly blessings which Allah will bring forth to you. It was said; What are the blessings of this world? The Prophet ﷺ said; The pleasures of the world. A man said; Can the good bring forth evil? The Prophet ﷺ kept quiet for a while till we thought that he was being inspired divinely. Then he started removing the sweat from his forehead and said; Where is the questioner? That man said; I am present. Abu Saeed added: We thanked the man when the result of his question was such. The Prophet ﷺ said; Good never brings forth but good. This wealth of the world is like green and sweet fruit ; and all the vegetation which grows on the bank of a stream either kills or nearly kills the animal that eats too much of it; except the animal that eats the Khadira a kind of vegetation. Such an animal eats till its stomach is full and then it faces the sun and starts ruminating and then it passes out dung and urine and goes to eat again. SahihAlBukhari-017-001-2450Narrated Abu Thalaba AlKhushani: The Prophet ﷺ forbade the eating of wild animals having fangs. AlZuhri said: I did not hear this narration except when I went to Sham. AlLaith said: Narrated Yunus: I asked Ibn Shihab; May we perform the ablution with the milk of asses or drink it; or drink the bile of wild animals or urine of camels? He replied; The Muslims used to treat themselves with that and did not see any harm in it. As for the milk of asses; we have learnt that Allah Messenger ﷺ forbade the eating of their meat; but we have not received any information whether drinking of their milk is allowed or forbidden. SahihAlBukhari-017-001-2529Narrated Abu Huraira: Allah Messenger ﷺ said; While a man was walking on a road. he became very thirsty. Then he came across a well; got down into it; drank of its water and then came out. Meanwhile he saw a dog panting and licking mud because of excessive thirst. The man said to himself This dog is suffering from the same state of thirst as I did. So he went down the well again and filled his shoe with water and held it in his mouth and watered the dog. The people hurried and fixed the cooking pots for cooking but the Prophet ﷺ came there and ordered that the cooking pots be turned upside down. Then he distributed the animals; regarding ten sheep as equal to one camel. One of the camels ran away and there were a few horses with the people. They chased the camel but they got tired; whereupon a man shot it with an arrow whereby Allah stopped it. We hope; or we are afraid that tomorrow we will meet the enemy and we have no knives; shall we slaughter our animals with canes? Abu Mousa said: I went along with them to my friends and said: Verily Allah messenger ﷺ has provided you with these animals for riding; but by Allah; I shall not leave you until some of you go along with me to him who had heard the talk of Allah Messenger ﷺ then I asked him for you; and his refusal for the first time; and then his granting them to me subsequently; so you should not think that I narrated to you something which he did not say. They said to me: By Allah; in our opinion you are certainly truthful; and we would do as you like. We stayed for some time there as Allah willed; and there was brought to Allah Messenger ﷺ booty of camels. He called us and commanded that we should be given five white humped camels. As we were about to go back; some of us said to the other: As we made Allah Messenger ﷺ forget oath; there would be no blessing for us in his gift. We went back to him and said: Allah Messenger; we came to you to provide us with riding animals and you took an oath that you would never equip us with mounts and then you have provided us with the riding beasts Allah Messenger; have you forgotten? Thereupon he said: I swear by Allah that if Allah so wills; I shall not swear an oath; and then consider something else to be better than it without making atonement for my oath and doing the thing that is better. SahihMuslim-017-001-17895It has been reported on the authority of Anas Bin Malik who said: The Messenger of Allah ﷺ sent Busaisah as a scout to see what the caravan of Abu Sufyan was doing. He came back and met the Prophet in his house where there was nobody except myself and the Messenger of Allah. I do not remember whether he Hadrat Anas made an exception of some wives of the Prophet ﷺ or not and told him the news of the caravan. Having heard the news ; the Messenger of Allah ﷺ came out hurriedly ; spoke to the people and said: We are in need of men ; whoever has an animal to ride upon ready with him should ride with us. People began to ask him permission for bringing their riding animals which were grazing on the hillocks near Medina. He said: No. I want only those who have their riding animals ready. So the Messenger of Allah ﷺ and his Companions proceeded towards Badr and reached there forestalling the polytheists of Mecca. When the polytheists also reached there; the Messenger of Allah ﷺ said: None of you should step forward to do anything unless I am ahead of him. The polytheists now advanced towards us ; and the Messenger of Allah ﷺ said. Get up to enter Paradise which is equal in width to the heavens and the earth. Umair Bin AlHumam AlAnsari said: Messenger of Allah; is Paradise equal in extent to the heavens and the earth? He said: Yes. Umair said: My goodness! The Messenger of Allah ﷺ asked him: What prompted you to utter these words i. e. my goodness! ? He said: Messenger of Allah; nothing but the desire that I be among its residents. He said: Thou art surely amona its residents. He took out dates from his bag and began to eat them. Then he said: If I were to live until I have eaten all these dates of mine; it would be a long life. The narrator said : He threw away all the dates he had with him. SahihMuslim-017-001-18123It has been narrated on the authority of Usama Bin Zaid that the Prophet ﷺ rode a donkey. It had on it a saddle under which was a mattress made at Fadak a place near Medina. Behind him he seated Usama. He was going to the street of Banu Harith AlKhazraj to inquire after the health of Saad Bin Ubada This happened before the Battle of Badr. He proceeded until he passed by a mixed company of people in which were Muslims; polytheists; idol worshippers and the Jews and among them were Abdullah Bin Ubay and Abdullah Bin Rawaha. When the dust raised by the hoofs of the animal spread over the company; Abdullah Bin Ubay covered his nose with his mantle and said: Do not scatter the dust over us Not minding this remark ; the Prophet ﷺ greeted them; stopped; got down from his animal; invited them to Allah; and recited to them the Quran. Abdullah Bin Ubay said: O man; if what you say is the truth; the best thing for you would be not to bother us with it in our assemblies. Get back to your place. Whoso comes to you from us; tell him all this. Abdullah Bin Rawaha said: Come to us in our gatherings; for we love to hear it. The narrator says: At this ; the Muslims; the polytheists and the Jews began to rebuke one another until they were determined to come to blows. The Prophet ﷺ continued to pacify them. When they were pacified ; he rode his animal and came to Saad Bin Ubida. He said: Sad; havent you heard what Abu Hubab meaning Abdullah Bin Ubay has said? He has said so and so. Saad said: Messenger of Allah; forgive and pardon. God has granted you a sublime position; but so far as he is concerned the people of this settlement had-decided to make him their king by making him wear a crown and a turban in token thereof ; but God has circumvented this by the truth He has granted you. This has made him jealous and his jealousy must have prompted the behaviour that you have witnessed. Then one day during Hajj season a man came to me and said: You do not know what the commander of the Believers has introduced concerning the rites. I said: O people; whoever heard our heard our Fatwa; let him not rush to follow it; for the commander of the Believers! Is coming to you; and you should follow him. When he came; I said: O Commander of the Believers! What is this that you have introduced concerning the rites? He said: If we follow the Book of Allah; then Allah; the Mighty and Sublime; says: And complete the Hajj and Umrah for Allah. When he had collected his property of camels; I found that a camel in her second year was due from him. I said to him: Pay a camel in her second year; for she is to be paid as sadaqah zakat by you. He said: That one is not worthy of milking and riding. Here is another camel which is young; grand and fat. So take it. I said to him: I shall not take an animal for which I have not been commanded. The Messenger of Allah ﷺ is here near to you. If you like; go to him; and present to him what you presented to me. Do that; if he accepts it from you; I shall accept it; if he rejects it; I shall reject it. He said: I shall do it. He accompanied me and took with him the camel which he had presented to me. We came to the Messenger of Allah ﷺ. He said to him: Prophet of Allah; your messenger came to me to collect zakat on my property. By Allah; neither the Messenger of Allah nor his messenger has ever seen my property before. I gathered my property camels ; and he estimated that a camel in her second year would be payable by me. But that has neither milk nor is it worth riding. So I presented to him a grand young camel for acceptance as zakat. But he has refused to take her. Look; she is here; I have brought her to you; Messenger of Allah. Take her. The Messenger of Allah ﷺ said: That is what is due from you. If you give voluntarily a better animal Allah will give a reward to you for it. We accept her from you. She is here; Messenger of Allah; I have brought her to you. So take her. But according to the version of Hammad Bin Salamah; he said as for myself; I shall raise my voice in talbiyah for Hajj because I have sacrificial animal with me. The agreed version goes I Aisha was one of those persons who wore Ihram for an Umrah. But on my way to Makkah I menstruated. The Messenger of Allah SWAS entered upon me while I was weeping. He asked why are you weeping? I wished I would not come out for Hajj this year. He said give up your Umrah; untie your hair and comb. The version of Mousa said and raise your voice in talbiyah for Hajj after wearing Ihram. Sulaimans version goes and do as all the Muslims do during their Hajj. When the night for performing the obligatory circumambulation tawaf AlZiyarah came; the Messenger of Allah SWAS commanded Abdulrahman He took her to AlTanim instead of the words her Umrah. She went round the Kabah. Allah thus completed both her Umrah and Hajj.Hisham said : No sacrificial animal was offered during all this time. They remarked should we go to Mina with our penises dripping with prostatic fluid? These remarks reached the Apostle of Allaah ﷺ. Thereupon he said had I known before hand about my affair what I have come to know later; I would not have brought sacrificial animals. O brother; I am eager to wage war in the cause of Allah i.e. jihad ; and I find that both hajj and umrah are due from me. How can I combine them? He said: Combine them and sacrifice the animal made easily available for you. I; therefore; raised my voice in talbiyah for both of them i.e. umrah and hajj. When I reached AlUdhayb; Salman Ibn Rabiah and Zayd Ibn Suhan met me while I was raising my voice in talbiyah for both of them. One of them said to the other: This man does not have any more understanding than his camel. Thereupon it was as if a mountain fell on me. I came to Umar Ibn AlKhattab may Allah be pleased with him and said to him: Commander of the Faithful; I was a Christian Bedouin; and I have embraced Islam. SunanAbuDawoud-017-001-25470Abdullah Bin Umar said At the Farewell Pilgrimage the Apostle of Allaah ﷺ put on ihram first for Umrah and afterwards for Hajj and drove the sacrificial animals along with him from Dhu AlHulaifa. The Apostle of Allaah ﷺ first raised his voice in talbiyah for Umrah and afterwards he did so for Hajj; and the people along with the Apostle of Allaah ﷺ did it first for Umrah and afterwards for Hajj. Some of the people had brought sacrificial animals and others had not; so when the Apostle of Allaah ﷺ came to Makkah ; he said to the people. Those of you who have brought sacrificial animals must not treat as lawful anything which has become unlawful for you till you complete your Hajj; but those of you who have not brought sacrificial animals should go round the House Kabah and run between AlSafa and AlMarwah; clip their hair; put off ihram; and afterwards raise their voice in talbiyah for Hajj and bring sacrificial animals. Those who cannot get sacrificial animals should fast three days during Hajj and seven days when they return to their families. The Apostle of Allaah ﷺ then performed circumambulation when he came to Makkah first touching the corner then running during three circuits out of seven and walking during four and when he had finished his circumambulation of the House Kabah he prayed two rakahs at Maqam Ibrahim; then giving the salutation and departing he went to AlSafa and ran seven times between AlSafa and AlMarwah. After that he did not treat anything as lawful which had become unlawful for him till he had completed his Hajj; sacrificed his animals on the day of sacrifice; went quickly and performed the circumambulation of the House the Kabah ; after which all that had been unlawful became lawful for him. I; therefore; sacrificed the animals at the same spot. I then took off ihram and returned. Next year I came out to make an atonement for my umrah. I came to Ibn Abbas and asked him about it. SunanAbuDawoud-017-001-25570Jafar Bin Muhammad reported on the authority of his father We entered upon Jabir Bin Abd Allaah. When we reached him; he asked about the people who had come to visit him. When my turn came I said I am Muhammad Bin Ali Bin Hussain. He patted my head with his hand and undid my upper then lower buttons. He then placed his hand between my nipples and in those days I was a young boy. He then said welcome to you my nephew; ask what you like. I questioned him he was blind. The time of prayer came and he stood wrapped in a mantle. Whenever he placed it on his shoulders its ends fell due to its shortness. He led us in prayer while his mantle was placed on a rack by his side. I said tell me about the Hajj of the Apostle of Allaah ﷺ.He signed with his hand and folded his fingers indicating nine. He then said Apostle of Allaah ﷺ remained nine years at Madeenah during which he did not perform Hajj; then made a public announcement in the tenth year to the effect that the Apostle of Allaah ﷺ was about to go to perform Hajj. A large number of people came to Madeenah everyone desiring to follow him and act like him. The Apostle of Allaah ﷺ went out and we too went out with him till we reached Dhu AlHulaifa. Asma daughter of Umais gave birth to Muhammad Bin Abi Bakr. She sent message to Apostle of Allaah ﷺ asking him What should I do?He replied take a bath; bandage your private parts with a cloth and put on ihram. The Apostle of Allaah ﷺ then prayed in the masjid and mounted AlQaswa and his she Camel stood erect with him on its back. Jabir said I saw a large number of people on mounts and on foot in front of him and a similar number on his right side and a similar number on his left side and a similar number behind him. The Apostle of Allaah ﷺ was among us; the Quran was being revealed to him and he knew its interpretation. Whatever he did; we did it. The Apostle of Allaah ﷺ then raised his voice declaring Allaahs unity and saying Labbaik I am at thy service ; O Allaah; labbaik; labbaik; Thou hast no partner praise and grace are Thine and the Dominion. Thou hast no partner. The people too raised their voices in talbiyah which they used to utter. But the Apostle of Allaah ﷺ did not forbid them anything. The Apostle of Allaah ﷺ continued his talbiyah. Jabir said We did not express our intention of performing anything but Hajj; being unaware of Umrah at that season ; but when we came with him to the House the Kabah ; he touched the corner and made seven circuits walking quickly with pride in three of them and walking ordinarily in four. Then going forward to the station of Abraham he recited And take the station of Abraham as a place of prayer. While praying two rakahs he kept the station between him and the House. The narrator said My father said that Ibn Nufail and Uthman said I do not know that he Jabir narrated it from anyone except the Prophet ﷺ. The narrator Sulaiman said I do not know but he Jabir said The Apostle of Allaah ﷺ used to recite in the two rakahs Say; He is Allaah; one and Say O infidels. He then returned to the House the kabah and touched the corner after which he went out by the gate to AlSafa. When he reached near AlSafa he recited AlSafa and AlMarwah are among the indications of Allaah and he added We begin with what Allaah began with. He then began with AlSafa and mounting it till he could see the House the Kabah he declared the greatness of Allaah and proclaimed his Unity. He then said there is no god but Allaah alone; Who alone has fulfilled His promise; helped His servant and routed the confederates. He then made supplication in the course of that saying such words three times. He then descended and walked towards AlMarwah and when his feet came down into the bottom of the valley; he ran; and when he began to ascend he walked till he reached AlMarwah. He did at AlMarwah as he had done at AlSafa and when he came to AlMarwah for the last time; he said If I had known before what I have come to know afterwards regarding this matter of mine; I would not have brought sacrificial animals but made it an Umrah; so if any of you has no sacrificial animals; he may take off ihram and treat it as an Umrah. All the people then took off ihram and clipped their hair except the Prophet ﷺ and those who had brought sacrificial animals. Suraqah bin Malik Bin Jusham then got up and asked Apostle of Allaah ﷺ does this apply to the present year or does it apply for ever? The Apostle of Allaah ﷺ interwined his fingers and said The Umarh has been incorporated in Hajj. Adding No; but forever and ever. Ali came from Yemen with the sacrificial animals of the Apostle of Allaah ﷺ and found Fathima among one of those who had taken off their ihram. She said put on colored clothes and stained her eyes with collyrium. Ali disliked this action of her and asked Who commanded you for this? She said My father. Jabir said Ali said at Iraq I went to Apostle of Allaah ﷺ to complain against Fathima for what she had done and to ask the opinion of Apostle of Allaah ﷺ about which she mentioned to me. I informed him that I disliked her action and that thereupon she said to me My father commanded me to do this. He said She spoke the truth; she spoke the truth. What did you say when you put on ihram for Hajj? I said O Allaah; I put on ihram for the same purpose for which Apostle of Allaah ﷺ has put it on. He said I have sacrificial animals with me; so do not take off ihram. He Jabir said The total of those sacrificial animals brought by Ali from Yemen and of those brought by the Prophet ﷺ from Madeenah was one hundred. Then all the people except the Prophet ﷺ and those who had with them the sacrificial animals took off ihram and clipped their hair. When the 8th of Dhu AlHijja Yaum AlTarwiyah came; they went towards Mina having pit on ihram for Hajj and the Apostle of Allaah ﷺ rode and prayed at Mina the noon; afternoon; sunset; night and dawn prayers. After that he waited a little till the sun rose and gave orders for a tent of hair to be set up at Namrah. The Apostle of Allaah ﷺ then sent out and the Quraish did not doubt that he would halt at AlMash ar AlHaram at AlMuzdalifah; as the Quraish used to do in the pre Islamic period but he passed on till he came to Arafat and found that the tent had been setup at Namrah. There he dismounted and when the sun had passed the meridian he ordered AlQaswa to be brought and when it was saddled for him; he went down to the bottom of the valley and addressed the people saying Your lives and your property must be respected by one another like the sacredness of this day of yours in the month of yours in this town of yours. Lo! Everything pertaining to the pre Islamic period has been put under my feet and claims for blood vengeance belonging to the pre Islamic period have been abolished. The first of those murdered among us whose blood vengeance I permit is the blood vengeance of ours according to the version of the narrator Uthman; the blood vengeance of the son of Rabiah and according to the version of the narrator Sulaiman the blood vengeance of the son of Rabiah Bin AlHarith Bin Abd AlMuttalib. Some scholars said he was suckled among Banu Sad i.e.; he was brought up among Bani Sad and then killed by Hudhail. The usury of the pre Islamic period is abolished and the first of usury I abolish is our usury; the usury of Abbas Bin Abd AlMuttalib for it is all abolished. Fear Allaah regarding women for you have got them under Allahs security and have the right to intercourse with them by Allaahs word. It is a duty from you on them not to allow anyone whom you dislike to lie on your beds but if they do beat them; but not severely. You are responsible for providing them with food and clothing in a fitting manner. I have left among you something by which if you hold to it you will never again go astray; that is Allaahs Book. You will be asked about me; so what will you say? They replied We testify that you have conveyed and fulfilled the message and given counsel. Then raising his forefinger towards the sky and pointing it at the people; he said O Allaah! Be witness; O Allaah! Be witness; O Allaah! Be witness! Bilal then uttered the call to prayer and the iqamah and he prayed the noon prayer; he then uttered the iqamah and he prayed the afternoon prayer; engaging in no prayer between the two. He then mounted his she Camel AlQaswa and came to the place of standing ; making his she Camel AlQaswa turn its back to the rocks and having the path taken by those who went on foot in front of him and he faced the qiblah. He remained standing till sunset when the yellow light had somewhat gone and the disc of the sun had disappeared. He took Usamah up behind him and picked the reins of AlQaswa severely so much so that its head was touching the front part of the saddle. Pointing with is right hand he was saying Calmness; O People! Calmness; O people. Whenever he came over a mound of sand he let loose its reins a little so that it could ascend. He then came to AlMuzdalifah where he combined the sunset and night prayers; with one adhan and two iqamahs. The narrator Uthamn said He did not offer supererogatory prayers between them. The narrators are then agreed upon the version He then lay down till dawn and prayed the dawn prayer when the morning light was clear. The narrator Sulaiman said with one adhan and one iqamah. The narrators are then agreed upon the version He then mounted AlQaswa and came to AlMashar AlHaram and ascended it. The narrators Uthaman and Sulaiman said He faced the qiblah praised Allaah; declared His greatness; His uniqueness. Uthamn added in his version and His Unity and kept standing till the day was very clear. The Apostle of Allaah ﷺ then went quickly before the sun rose ; taking AlFadl Bin Abbas behind him. He was a man having beautiful hair; white and handsome color. When the Apostle of Allaah ﷺ went quickly; the women in the howdas also began to pass him quickly. AlFadl began to look at them. The Apostle of Allaah ﷺ placed his hand on the face of AlFadl ; but Alfadl turned his face towards the other side. The Apostle of Allaah ﷺ also turned away his hand to the other side. AlFadl also turned his face to the other side looking at them till he came to the Valley of Muhassir. He urged the Camel a little and following a middle road which comes out at the greatest jamrah; he came to the jamrah which is beside the tree and he threw seven small pebbles at this jamrah saying Allah is most great each time he threw a pebble like bean seeds. He threw them from the bottom of the valley. The Apostle of Allaah ﷺ then went to the place of the sacrifice and sacrificed sixty three Camels with his own hand. He then commanded Ali who sacrificed the remainder and he shared him and his sacrificial animals. After that he ordered that a piece of flesh from each Camel should be put in a pot and when it was cooked the two of them ate some of it and drank some of its broth. The narrator Sulaiman said the he mounted afterwards the Apostle of Allaah ﷺ went quickly to the House the Kabah and prayed the noon prayer at Makkah. He came to Banu Abd AlMuttalib who were supplying water at Zamzam and said draw water Banu Abd AlMuttalib were it not that people would take from you the right to draw water; I would draw it along with you. MuwataMalik-017-001-34877Yahya related to me from Malik from Ibn Shihab from Said Ibn AlMusayab and Abu Salama Ibn Abdulrahman from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; The wound of an animal is of no account and no compensation is due for it. The well is of no account and no compensation is due for it. The mine is of no account and no compensation is due for it and a fifth is due for buried treasures. Alkanz: see Book 17. Malik said; Everyone leading an animal by the halter; driving it; and riding it is responsible for what the animal strikes unless the animal kicks out without anything being done to it to make it kick out. Umar Ibn AlKhattab imposed the blood-money on a person who was exercising his horse. Malik said; It is more fitting that a person leading an animal by the halter; driving it; or riding it incur a loss than a person who is exercising his horse. See hadith 4 of this book. Malik said; What is done in our community about a person who digs a well on a road or ties up an animal or does the like of that on a road used by muslims; is that since what he has done is included in that which he is not permitted to do in such a place; he is liable for whatever injury or other thing arises from that action. The blood-money of that which is less than a third of the full blood- money is owed from his own personal property. Whatever reaches a third or more; is owed by his tribe. Any such things that he does which he is permitted to do on the muslims road are something for which he has no liability or loss. Part of that is a hole which a man digs to collect rain; and the beast from which the man alights for some need and leaves standing on the road. There is no penalty against anyone for this. Malik spoke about a man who went down a well; and another man followed behind him; and the lower one pulled the higher one and they fell into the well and both died He said; The tribe of the one who pulled him in is responsible for the blood-money. Malik spoke about a child whom a man ordered to go down into a well or to climb a palm tree and he died as a result. He said; The one who ordered him is liable for whatever befalls him; be it death or something else. Malik said; The way of doing things in our community about which there is no dispute is that women and children are not obliged to pay blood-money together with the tribe in the blood-moneys which the tribe must pay. The blood-money is only obligatory for a man who has reached puberty. Malik said that the tribe could bind themselves to the blood-money of mawali if they wished. If they refused; they were people of the diwan or were cut off from their people. In the time of the Messenger of Allah; may Allah bless him and grant him peace; people paid the blood-money to each other as well as in the time of Abu Bakr AlSiddiq before there was a diwan. The diwan was in the time of Umar Ibn AlKhattab. No one other than one people and the ones holding the wala paid blood- money for one because the wala was not transferable and because the Prophet; may Allah bless him and grant him peace; said; The wala belongs to the one who sets free. Malik said; The wala is an established relationship. Malik said; What is done in our community about animals that are injured is that the person who causes the injury pays whatever of their value has been diminished. Malik said about a man condemned to death and one of the other hudud befell him; He is not punished for it. That is because the killing overrides all of that; except for slander. The slander remains hanging over the one to whom it was said because it will be said to him; Why do you not flog the one who slandered you? I think that the condemned man is flogged with the hadd before he is killed; and then he is killed. I do not think that any retaliation is inflicted on him for any injury except killing because killing overrides all of that. Malik said; What is done in our community is that when a murdered person is found among the main body of a people in a village or other place; the house or place of the nearest people to him is not responsible. That is because the murdered person can be slain and then cast at the door of some people to shame them by it. No one is responsible for the like of that. Malik said about a group of people who fight with each other and when the fight is broken up; a man is found dead or wounded; and it is not known who did it; The best of what is heard about that is that there is blood-money for him; and the blood-money is against the people who argued with him. MuwataMalik-017-001-34915Yahya said; I heard Malik say that if a man pledges his garden for a stated period and the fruits of that garden are ready before the end of that period; the fruits are not included in the pledge with the real estate; unless it is stipulated by the pledger in his pledge. However; if a man receives a slave-girl as a pledge and she is pregnant or she becomes pregnant after his taking her as a pledge; her child is included with her. A distinction is made between the fruit and the child of the slave-girl. The Messenger of Allah; may Allah bless him and grant him peace; said; If someone sells a palm which has been pollinated; the fruit belongs to the seller unless the buyer stipulates its inclusion. The undisputed way of doing things in our community is that if a man sells a slave-girl or an animal with a foetus in its womb; the foetus belongs to the buyer; whether or not the buyer stipulates it. The palm is not like the animal. Fruit is not like the foetus in its mother womb. Part of what clarifies that is also that it is the usage of people to have a man pawn the fruit of the palm apart from the palm. MuwataMalik-017-001-34919Yahya said that he heard Malik say; What is done in our community about a man who rents an animal for a journey to a specified place and then he goes beyond that place and further; is that the owner of the animal has a choice. If he wants to take extra rent for his animal to cover the distance overstepped; he is given that on top of the first rent and the animal is returned. If the owner of the animal likes to sell the animal from the place where he over-steps; he has the price of the animal on top of the rent. If; however; the hirer rented the animal to go and return and then he overstepped when he reached the city to which he rented him; the owner of the animal only has half the first rent. That is because half of the rent is going; and half of it is returning. If he oversteps with the animal; only half of the first rent is obliged for him. Had the animal died when he reached the city to which it was rented; the hirer would not be liable and the renter would only have half the rent. Malik said; That is what is done with people who overstep and dispute about what they took the animal for. Malik said; It is also like that with some one who takes qirad-money from his companion. The owner of the property says to him; Do not buy such-and-such animals or such- and-such goods. He names them and forbids them and disapproves of his money being invested in them. The one who takes the money then buys what he was forbidden. By that; he intends to be liable for the money and take the profit of his companion. When he does that; the owner of the money has an option. If he wants to enter with him in the goods according to the original stipulations between them about the profit; he does so. If he likes; he has his capital guaranteed against the one who took the capital and over stepped the mark. Malik said; It is also like that with a man with whom another man invests some goods. The owner of the property orders him to buy certain goods for him which he names. He differs; and buys with the goods something other than what he was ordered to buy. He exceeded his orders. The owner of the goods has an option. If he wants to take what was bought with his property; he takes it. He must pay its price on the day it was consumed; and giving the value is more equitable in compensation for animals and goods. Yahya said that he heard Malik say about someone who consumes some food without the permission of its owner; He returns to the owner a like weight of the same kind of food. Food is in the position of gold and silver. Gold and silver are returned with gold and silver. The animal is not in the position of gold in that. What distinguishes between them is the sunna and the behaviour which is in force. MuwataMalik-017-001-35032Yahya related to me from Malik from a reliable source from Amr Ibn Shuayb from his father from his father father that the Messenger of Allah; may Allah bless him and grant him peace; forbade transactions in which nonrefundable deposits were paid. Malik said; That is; in our opinion; but Allah knows best; that for instance; a man buys a slave or slave-girl or rents an animal and then says to the person from whom he bought the slave or leased the animal; I will give you a dinar or a dirham or whatever on the condition that if I actually take the goods or ride what I have rented from you; then what I have given you already goes towards payment of the goods or hire of the animal. If I do not purchase the goods or hire the animal; then what I have given you is yours without liability on your part. Malik said; According to the way of doing things with us there is nothing wrong in bartering an arabic speaking merchant slave for abyssinian slaves or any other type that are not his equal in eloquence; trading; shrewdness; and know-how. There is nothing wrong in bartering one slave like this for two or more other slaves with a stated delay in the terms if he is clearly different. If there is no appreciable difference between the slaves; two should not be bartered for one with a stated delay in the terms even if their racial type is different. Malik said; There is nothing wrong in selling what has been bought in such a transaction before taking possession of all of it as long as you receive the price for it from some one other than the original owner. Malik said; An addition to the price must not be made for a foetus in the womb of its mother when she is sold because that is gharar an uncertain transaction. It is not known whether the child will be male or female; good-looking or ugly; normal or handicapped; alive or dead. All these things will affect the price. Malik said that in a transaction where a slave or slave-girl was bought for one hundred dinars with a stated credit period that if the seller regretted the sale there was nothing wrong in him asking the buyer to revoke it for ten dinars which he would pay him immediately or after a period and he would forgo his right to the hundred dinars which he was owed. Malik said; However; if the buyer regrets and asks the seller to revoke the sale of a slave or slave-girl in consideration of which he will pay an extra ten dinars immediately or on credit terms; extended beyond the original term; that should not be done. It is disapproved of because it is as if; for instance; the seller is buying the one hundred dinars which is not yet due on a year credit term before the year expires for a slave-girl and ten dinars to be paid immediately or on credit term longer than the year. This falls into the category of selling gold for gold when delayed terms enter into it. Malik said that it was not proper for a man to sell a slave-girl to another man for one hundred dinars on credit and then to buy her back for more than the original price or on a credit term longer than the original term for which he sold her. To understand why that was disapproved of in that case; the example of a man who sold a slave-girl on credit and then bought her back on a credit term longer than the original term was looked at. He might have sold her for thirty dinars with a month to pay and then buy her back for sixty dinars with a year or half a year to pay. The outcome would only be that his goods would have returned to him just like they were and the other party would have given him thirty dinars on a month credit against sixty dinars on a year or half a year credit. There are three things forbidden in animals: Almadamin; Almalaqih and habal Alhabala. Almadamin is the sale of what is in the wombs of female camels. Almalaqih is the sale of the breeding qualities of camels i.e. for stud. Malik said; No one should buy a specified animal when it is concealed from him or in another place; even if he has already seen it; very recently or not so recently; and was pleased enough with it to pay its price in cash. Malik said; That is disapproved of because the seller makes use of the price and it is not known whether or not those goods are found to be as the buyer saw them or not. For that reason; it is disapproved of. MuwataMalik-017-001-35593Yahya related to me from Malik from Zayd Ibn Aslam from his father that he said to Umar Ibn AlKhattab; There is a blind camel behind the house; soUmar said; Hand it over to a household so that they can make some use of it. He said; But she is blind. Umar replied; Then put it in a line with other camels. He said; How will it be able to eat from the ground? Umar asked; Is it from the livestock of the jizya or the zakat? and Aslam replied; From the livestock of the jizya. Umar said; By AIIah; you wish to eat it. Aslam said; It has the brand of the jizya on it. So Umar ordered it to be slaughtered. He had nine platters; and on each of the platters he put some of every fruit and delicacy that there was and then sent them to the wives of the Prophet; may Allah bless him and grant him peace; and the one he sent to his daughter Hafsa was the last of them all; and if there was any deficiency in any of them it was in Hafsa portion. He put meat from the slaughtered animal on the platters and sent them to the wives of the Prophet; may Allah bless him and grant him peace; and he ordered what was left of the meat of the slaughtered animal to be prepared. Then he invited the Muhajirun and the Ansar to eat it. I have sent one; so write and tell me what you say about this; or tell the man in charge of the animal what to do. Amra said that Aisha said; It is notas Ibn Abbas has said. I once plaited the garlands for the sacrificial animal of the Messenger of Allah; may Allah bless him and grant him peace; with my own two hands. Then after that the Messenger of Allah; may Allah bless him and grant him peace; himself put the garlands on the animal and then sent it with my father. So he asked people about him and they said; He has given directions for his sacrificial animal to be garlanded; and it is for that reason that he has put on ihram. Rabia said; I then met Abdullah Ibn AlZubair and so I mentioned this to him and he said; By the Lord of the Kaba; an innovation. Malik was asked about some one who set out with his own sacrificial animal and marked it and garlanded it at Dh AlHulayfa; but did not go into ihram until he had reached AlJuhfa;and hesaid; I do not like that; and whoever does so has not acted properly. He should only garland his sacrificial animal; or mark it; when he goes into ihram; unless it is someone who does not intend to do hajj; in which case he sends it off and stays with his family. Malik was asked if somone who was not in ihram could set out with a sacrificial animal; and he said; Yes. There is no harm in that. MuwataMalik-017-001-35795Yahya related to me from Malik; from Abdullah Ibn Dinar; that Abdullah Ibn Umar used to say; Anyone that does umra in the months of hajj; that is; in Shawal; Dh AlQada; or in Dhu AlHijja before the hajj; and then stays in Makka until the time for hajj; is doing tamattu if he then does hajj. He must sacrifice whatever animal it is easy for him to obtain; and if he cannot find one then he must fast three days during hajj and seven days when he returns. Malik said; This is only the case if he stays until the hajj and does hajj in that same year. Malik said that if someone who was from Makka but had stopped living there and gone to live elsewhere; came back to do umra in the months of the hajj and then stayed in Makka to begin hajj there; he was doing tamattu; and had to offer up a sacrificial animal; or fast if he could not find one. He was not the same as the people of Makka. Malik was asked whether someone who was not from Makka and entered Makka to do umra in the months of hajj with the intention of staying on to begin his hajj there was doing tamattu or not; and he said; Yes; he is doing tamattu; and he is not the same as the people of Makka; even if he has the intention of staying there. This is because he has entered Makka; and is not one of its people; and making a sacrifice or fasting is incumbent on anyone who is not from Makka; and; although he intends to stay; he does not know what possibilities might arise later. MuwataMalik-017-001-35797Malik said; Someone who does umra in Shawal; Dh AlQada or Dhu AlHijja and then goes back to his people; and then returns and does hajj in that same year does not have to sacrifice an animal. Sacrificing an animal is only incumbent on some one who does umra in the months of hajj; and then stays in Makka and then does hajj. A person not from Makka who moves to Makka and establishes his home there and does umra in the months of the hajj and then begins his hajj there is not doing tamattu. He does not have to sacrifice an animal nor does he have to fast. He is in the same position as the people of Makka if he is one of those who are living there. Malik was asked whether a man from Makka who had gone to live in another town or had been on a journey and then returned to Makka with the intention of staying there; regardless of whether he had a family there or not; and entered it to do umra in the months of the hajj; and then began his hajj there; beginning his umra at the miqat of the Prophet; may Allah bless him and grant him peace; or at a place nearer than that; was doing tamattu or not? Malik answered; He does not have to sacrifice an animal or fast as someone who is doing tamattu has to do. MuwataMalik-017-001-35801Yahya related to me from Malik that he had heard that Uthman Ibn Affan would sometimes never get down from the animal he was riding on when he was doing umra; until he had returned. Malik said; Umra is a sunna; and we do not know of any muslim who has ever said that it is permissible not to do it. Malik said; I do not think that anyone can do more than one umra in any one year. Malik said that someone doing umra who had sexual intercourse with his wife had to sacrifice an animal and do a second umra; which he had to begin when he had finished the one that he had spoiled. He should go into ihram at the same place where he went into ihram for the umra which he had spoiled; except if he had entered into ihram at a place further away than his miqat. This was because he only had to go into ihram from his miqat. Malik said; Someone who entered Makka to do umra; and does tawaf of the House and say between Safa and Marwa while he is junub; or not in Ablution; and afterwards has intercourse with his wife; and then remembers; should do ghusl; or Ablution; and then go back and do tawaf around the House and say between Safa and Marwa and do another umra and sacrifice an animal. A woman should do the same if her husband has intercourse with her while she is in ihram. Malik said; As for beginning umra at AlTanim; it is not the only alternative.
