But if ye are prevented (From completing it), send an offering for sacrifice, such as ye may find, and do not shave your heads until the offering reaches the place of sacrifice. And if any of you is ill, or has an ailment in his scalp, (Necessitating shaving), (He should) in compensation either fast, or feed the poor, or offer sacrifice; and when ye are in peaceful conditions (again), if any one wishes to continue the 'umra on to the hajj, He must make an offering, such as he can afford, but if he cannot afford it, He should fast three days during the hajj and seven days on his return, Making ten days in all. This is for those whose household is not in (the precincts of) the Sacred Mosque. And fear Allah, and know that Allah Is strict in punishment. | |

If that is beyond your means, fast for three days. That is the expiation for the oaths ye have sworn. But keep to your oaths. Thus doth Allah make clear to you His signs, that ye may be grateful. | |

So every one of you who is present (at his home) during that month should spend it in fasting, but if any one is ill, or on a journey, the prescribed period (Should be made up) by days later. Allah intends every facility for you; He does not want to put to difficulties. (He wants you) to complete the prescribed period, and to glorify Him in that He has guided you; and perchance ye shall be grateful. | |

The Prophet ﷺ then asked us; Which month is this? We said; Allah and His Apostle know it better. He kept quiet so long that we thought he might call it by another name. Then he said; Isnt it Dhu AlHijja? We said; Yes. He asked What town is this? We said; Allah and His Apostle know it better. Then he kept quiet so long that we thought he might call it by another name. He then said; Isnt it the forbidden town Mecca ? We said; Yes. He asked; What is the day today? We said; Allah and His Apostle know it better. Then he kept quiet so long that we thought that he might call it by another name. Then he said; Isnt it the Day of AlNahr slaughtering of sacrifices ? We said; Yes. Then he said; Your blood lives ; your properties; the sub narrator Muhammad; said: I think he also said :..and your honor are as sacred to one another like the sanctity of this Day of yours; in this town of yours; in this month of yours. You shall meet your Lord and He will ask you about your deeds. Beware! Dont go astray after me by striking the necks of one another. Lo! It is incumbent upon those who are present to inform it to those who are absent for perhaps the informed one might comprehend it understand it better than some of the present audience. SahihAlBukhari-017-001-1086 | Narrated Abdullah Bin Masud: Allah Messenger ﷺ the true and truly inspired; narrated to us; The creation of everyone of you starts with the process of collecting the material for his body within forty days and forty nights in the womb of his mother. Then he becomes a clot of thick blood for a similar period 40 days and then he becomes like a piece of flesh for a similar period. Then an angel is sent to him by Allah and the angel is allowed ordered to write four things; his livelihood; his date of death; his deeds; and whether he will be a wretched one or a blessed one in the Hereafter and then the soul is breathed into him. So one of you may do good deeds characteristic of the people of Paradise so much that there is nothing except a cubit between him and Paradise but then what has been written for him decides his behavior and he starts doing evil deeds characteristic of the people of Hell Fire and ultimately enters Hell Fire ; and one of you may do evil deeds characteristic of the people of Hell Fire so much so that there is nothing except a cubit between him and Hell Fire ; then what has been written for him decides his behavior and he starts doing good deeds characteristic of the people of Paradise and ultimately enters Paradise. SahihAlBukhari-017-001-1618 | Narrated Aisha: The commencement of the Divine Inspiration to Allah Messenger ﷺ was in the form of good righteous true dreams in his sleep. He never had a dream but that it came true like bright day light. He used to go in seclusion the cave of Hira where he used to worship Allah Alone continuously for many days nights. He used to take with him the journey food for that stay and then come back to his wife Khadija to take his food like-wise again for another period to stay; till suddenly the Truth descended upon him while he was in the cave of Hira. The angel came to him in it and asked him to read. The Prophet ﷺ replied; I do not know how to read. The Prophet ﷺ added ; The angel caught me forcefully and pressed me so hard that I could not bear it anymore. He then released me and again asked me to read; and I replied; I do not know how to read; whereupon he caught me again and pressed me a second time till I could not bear it anymore. He then released me and asked me again to read; but again I replied; I do not know how to read or; what shall I read?. Thereupon he caught me for the third time and pressed me and then released me and said; Read: In the Name of your Lord; Who has created all that exists. Has created man from a clot. Read and Your Lord is Most Generous...up to.......that which he knew not. 96.15 Then Allah Messenger ﷺ returned with the Inspiration; his neck muscles twitching with terror till he entered upon Khadija and said; Cover me! Cover me! They covered him till his fear was over and then he said; O Khadija; what is wrong with me? Then he told her everything that had happened and said; I fear that something may happen to me. Khadija said; Never! But have the glad tidings; for by Allah; Allah will never disgrace you as you keep good reactions with your Kith and kin; speak the truth; help the poor and the destitute; serve your guest generously and assist the deserving; calamityafflicted ones. Khadija then accompanied him to her cousin Waraqa Bin Nawfal Bin Asad Bin Abdul Uzza Bin Qusai. Waraqa was the son of her paternal uncle; i.e.; her father brother; who during the Pre-Islamic Period became a Christian and used to write the Arabic writing and used to write of the Gospels in Arabic as much as Allah wished him to write. He was an old man and had lost his eyesight. Khadija said to him; O my cousin! Listen to the story of your nephew. Waraqa asked; O my nephew! What have you seen? The Prophet ﷺ described whatever he had seen. Waraqa said; This is the same Namus i.e.; Gabriel; the Angel who keeps the secrets whom Allah had sent to Moses. I wish I were young and could live up to the time when your people would turn you out. Allah Messenger ﷺ asked; Will they turn me out? Waraqa replied in the affirmative and said: Never did a man come with something similar to what you have brought but was treated with hostility. If I should remain alive till the day when you will be turned out then I would support you strongly. But after a few days Waraqa died and the Divine Inspiration was also paused for a while and the Prophet ﷺ became so sad as we have heard that he intended several times to throw himself from the tops of high mountains and every time he went up the top of a mountain in order to throw himself down; Gabriel would appear before him and say; O Muhammad! You are indeed Allah Messenger ﷺ in truth whereupon his heart would become quiet and he would calm down and would return home. And whenever the period of the coming of the inspiration used to become long; he would do as before; but when he used to reach the top of a mountain; Gabriel would appear before him and say to him what he had said before. SahihAlBukhari-017-001-1979 | Narrated Abu Huraira: Allah Messenger ﷺ said; On the Day of Resurrection the Kanz Treasure or wealth of which; Zakat has not been paid of anyone of you will appear in the shape of a huge bald headed poisonous male snake and its owner will run away from it; but it will follow him and say; I am your Kanz. The Prophet ﷺ added; By Allah; that snake will keep on following him until he stretches out his hand and let the snake swallow it. Allah Messenger ﷺ added; If the owner of camels does not pay their Zakat; then; on the Day of Resurrection those camels will come to him and will strike his face with their hooves. SahihMuslim-017-001-17759 | It has been narrated on the authority of Abdulrahman Bin Abd Rabb AlKaba who said: I entered the Masjid when Abdullah Bin Amr Bin AlAs was sitting in the shade of the Kaba and the people had gathered around him. I betook myself to them and sat near him. Now Abdullah said: I accompanied the Messenger of Allah ﷺ on a journey. We halted at a place. Some of us began to set right their tents; others began to compete with one another in shooting; and others began to graze their beasts; when an announcer of the Messenger of Allah ﷺ announced that the people should gather together for prayer; so we gathered around the Messenger of Allah ﷺ. He said: It was the duty of every Prophet that has gone before me to guide his followers to what he knew was good for them and warn them against what he knew was bad for them; but this Umma of yours has its days of peace and security in the beginning of its career; and in the last phase of its existence it will be afflicted with trials and with things disagreeable to you. In this phase of the Umma ; there will be tremendous trials one after the other; each making the previous one dwindle into insignificance. When they would be afflicted with a trial; the believer would say: This is going to bring about my destruction. When at the trial is over; they would be afflicted with another trial; and the believer would say: This surely is going to be my end. Whoever wishes to be delivered from the fire and enter the garden should die with faith in Allah and the Last Day and should treat the people as he wishes to be treated by them. He who swears allegiance to a Caliph should give him the piedge of his hand and the sincerity of his heart i. e. submit to him both outwardly as well as inwardly. He should obey him to the best of his capacity. It another man comes forward as a claimant to Caliphate ; disputing his authority; they the Muslims should behead the latter. The narrator says: I came close to him Abdullah Bin Amr Bin AlAs and said to him: Can you say on oath that you heard it from the Messenger of Allah ﷺ ? SahihMuslim-017-001-18051 | It has been narrated on the authority of Umar Bin AlKhattab who said: When it was the day on which the Battle of Badr was fought; the Messenger of Allah ﷺ cast a glance at the infidels; and they were one thousand while his own Companions were three hundred and nineteen. The Prophet ﷺ turned his face towards the Qibla. Then he stretched his hands and began his supplication to his Lord: O Allah; accomplish for me what Thou hast promised to me. O Allah; bring about what Thou hast promised to me. O Allah; if this small band of Muslims is destroyed. Thou will not be worshipped on this earth. He continued his supplication to his Lord; stretching his hands; facing the Qibla; until his mantle slipped down from his shoulders. So Abu Bakr came to him; picked up his mantle and put it on his shoulders. Then he embraced him from behind and said: Prophet of Allah; this prayer of yours to your Lord will suffice you; and He will fulfill for you what He has promised you. So Allah; the Glorious and Exalted; revealed the Quranic verse : When ye appealed to your Lord for help; He responded to your call saying : I will help you with one thousand angels coming in succession. So Allah helped him with angels. Abu Zumail said that the hadith was narrated to him by Ibn Abbas who said: While on that day a Muslim was chasing a disbeliever who was going ahead of him; he heard over him the swishing of the whip and the voice of the rider saying: Go ahead; Haizum! He glanced at the polytheist who had now fallen down on his back. When he looked at him carefully he found that there was a scar on his nose and his face was torn as if it had been lashed with a whip; and had turned green with its poison. An Ansari came to the Messenger of Allah ﷺ and related this event to him. He said: You have told the truth. This was the help from the third heaven. The Muslims that day i.e. the day of the Battle of Badr killed seventy persons and captured seventy. The Messenger of Allah ﷺ said to Abu Bakr and Umar Allah be pleased with them : What is your opinion about these captives? Abu Bakr said: They are our kith and kin. I think you should release them after getting from them a ransom. This will be a source of strength to us against the infidels. It is quite possible that Allah may guide them to Islam. Then the Messenger of Allah ﷺ said: What is your opinion; Ibn AlKhattab? He said: Messenger of Allah; I do not hold the same opinion as Abu Bakr. I am of the opinion that you should hand them over to us so that we may cut off their heads. Hand over Aqil to Ali that he may cut off his head; and hand over such and such relative to me that I may cut off his head. They are leaders of the disbelievers and veterans among them. The Messenger of Allah ﷺ approved the opinion of Abu Bakr and did not approve what I said. The next day when I came to the Messenger of Allah ﷺ ; I found that both he and Abu Bakr were sitting shedding tears. I said: Messenger of Allah; why are you and your Companion shedding tears? Tell me the reason. For I will weep; or I will at least pretend to weep in sympathy with you. The Messenger of Allah ﷺ said: I weep for what has happened to your companions for taking ransom from the prisoners. I was shown the torture to which they were subjected. It was brought to me as close as this tree. He pointed to a tree close to him. Then God revealed the verse: It is not befitting for a prophet that he should take prisoners until the force of the disbelievers has been crushed... to the end of the verse: so eat ye the spoils of war; it is lawful and pure. Each of us would prepare food for his companions turn by turn for a day. Accordingly when it was my turn I said: Abu Huraira; it is my turn today. So they came to my place. The food was not yet ready; so I said to Abu Huraira: I wish you could narrate to us a tradition from the Messenger of Allah ﷺ until the food was ready. Complying with my request Abu Huraira said: We were with the Messenger of Allah ﷺ on the day of the Conquest of Mecca. He appointed Khalid Bin Walid as commander of the right flank; AlZubair as commander of the left flank; and Abu Ubaida as commander of the foot-soldiers who were to advance to the interior of the valley. He then said: Abu Huraira; call the Ansar to me. So I called out to them and they came hurriedly. He said: O ye Assembly of the Ansaar; do you see the ruffians of the Quraish? They said: Yes. He said: See; when you meet them tomorrow; wipe them out. He hinted at this with his hand; placing his right hand on his left and said: You will meet us at AlSafa. Abu Huraira continued : Whoever was seen by them that day was put to death. The Messenger of Allah ﷺ ascended the mount of AlSafa. The Ansar also came there and surrounded the mount. Then came Abu Sufyan and said: Messenger ot Allah; the Quraish have perished. No member of the Quraish tribe will survive this day. The Messenger of Allah ﷺ said: Who enters the house of Abu Safyin will be safe; who lays down arms will be safe; who locks his door will be safe. some of the Ansar said: After all the man has been swayed by tenderness towards his family and love for his city. He said to Ali: Write down the terms settled between us. So Ali wrote : In the name of Allah; most Gracious and most Merciful. This is what Muhammad; the Messenger of Allah; has settled with the Meccans ; The polytheists said to him: If we knew that thou art the Messenger of of Allah; we would follow you. But write: Muhammad Bin Abdullah. So he told Ali to strike out these words. Ali said: No; by Allah; I will not strike them out. The Messenger of Allah ﷺ said: Show me their place on the parchment. So he Ali showed him their place and he the Holy Prophet struck them out; and Ali wrote: Ibn Abdullah. According to the terms of the treaty; next year the Prophet ﷺ stayed there for three days When it was the third day; they said to Ali: This is the last day according to the terms of your companion. So tell him to leave. Ali informed the Prophet ﷺ accordingly. He said: Yes; and left the city. SahihMuslim-017-001-18147 | It has been narrated on the authority of Anas Bin Malik who said: On the Day of Uhud some of the people; being defeated; left the Prophet ﷺ ; but Abu Talha stood before him covering him with a shield. Abu Talha was a powerful archer who broke two or three bows that day. When a man would pass by carrying a quiver containing arrows; he would say: Spare them for Abu Talha. Whenever the Prophet ﷺ raised his head to look at the people; Abu Talha would say: Prophet of Allah; may my father and my mother be thy ransom; do not raise your head lest you be struck by an arrow shot by the enemy. My neck is before your neck. The narrator said: I saw Aisha bint Abu Bakr and Umm Sulaim. Both of them had tucked up their garments; so I could see the anklets on their feet. They were carrying water-skins on their backs and would pour water into the mouths of the people. They would then go back to the well ; would fill them again and would return to pour water into the mouths of the soldiers. He says: Nine-hundred and ninety-nine in the Fire; and one to Paradise. He said: So the Muslims started crying. Then the Messenger of Allah ﷺ said: Close your ranks and be straight forward; for there was never any Prophethood but there was a time of ignorance just before his advent; so the number will be taken from that time of ignorance; and if that is not enough; it will be made up of the hypocrites. The parable of you and the other nations is that you are like a mark on the foreleg of an animal; or a mole on the flank of a camel. Then he said: I hope that you will be a quarter of the people of Paradise. They said: Allahu Akbar. Then he said: I hope that you will be a third of the people of Paradise. They said: Allahu Akbar. Then he said: I hope that you will be half of the people of Paradise. They said: Allahu Akbar. SunanAlTermithi-017-001-10339 | It was narrated from AlNawas Bin Saman; who said: The Messenger of Allah s.a.w mentioned the Dajjal one morning; he belittled him and mentioned his importance until we thought that he might be amidst a cluster of date-palms. He said: We departed from the presence of the Messenger of Allah s.a.w ; then we returned to him; and he noticed that concern in us. So he said: What is wrong with you? We said: O Messenger of Allah! You mentioned the Dajjal this morning; belittling him; and mentioning his importance until we thought that he might be amidst a cluster of the date-palms. He said: It is not the Dajjal that I fear for you. If he were to appear while I am among you; then I will be his adversary on your behalf. And if he appears and I am not among you; then each man will have to fend for himself. And Allah will take care of every Muslim after me. He is young; with curly hair; his eyes protruding; resembling someone from Abd AlUzza Bin Qatan. Whoever among you sees him; then let him recite the beginning of Surah Ashab AlKahf.He said: He will appear from what is between AlSham and AlIraq; causing devastation toward the right and toward the left. O worshippers of Allah! Hold fast! We said: O Messenger of Allah! How long will he linger on the earth? He said: Forty days; a day like a year; a day like a month; a day like a week; and the remainder of his days are like your days. We said: O Messenger of Allah! Do you think that during the day that is like a year; the Prayer of one day will be sufficient for us? He said: No. You will have to estimate it. We said: O Messenger of Allah! How fast will he move through the earth. He said: Like a rain storm driven by the wind. He will come upon a people and call them; and they will deny him; and reject his claims. Then he will leave them; and their wealth will follow him. They will awaken in the morning with nothing left. Then he will come upon a people and call them; and they will respond to him; believing in him. So he will order the Heavens to bring rain; and it shall rain; and he will order the land to sprout; and it will sprout. Their cattle will return to them with their coats the longest; their udders the fullest and their stomachs the fattest. He said: Then he will come upon some ruins; saying to it: Bring me your treasures! He will turn to leave it; and it will follow him; like drone bees. Then he will call a young man; full of youth; and he will strike him with the sword cutting him into two pieces. Then he will call him; and he will come forward with his face beaming and laughing. So while he is doing that; Eisa Bin Mariam; ﷺ ; will descend in eastern Damascus at the white minaret; between two Mahrud; with his hands on the wings of two angels. When he lowers his head; drops fall; and when raises it; gems like pearls drop from him. He said: His the Dajjals breath does not reach anyone but he dies; and his breath reaches as far as his sight. He said: So he pursues him the Dajjal and he catches up with him at the gate of Ludd where he kills him. He said: So he remains there as long as Allah wills. He said: Then Allah reveals to him: Take my slaves to AlTur; for I have sent down some creatures of Mine which no one shall be able to kill. He said: Allah dispatches Yajuj and Majuj; and they are as Allah said: They swoop down from every mount.He said: The first of them pass by the lake of Tiberias; drinking what is in it. Then the last of them pass by it saying: There was water here at one time. They travel until they reach a mountain at Bait AlMaqdis. They will say: We have killed whoever was in the earth. Come! Let us kill whoever is in the skies. They will shoot their arrows into the Heavens; so Allah will return their arrows to them red with blood. Eisa Bin Mariam and his Companions be surrounded; until the head of a bull on that day would be better to them than a hundred Dinar to one of you today. He s.a.w said: Eisa will beseech Allah; as will his companions. He said: So Allah will send AlNaghaf down upon their necks. In the morning they will find that they have all died like the death of a single soul. He said: Eisa and his companions will come down; and no spot nor hand-span can be found; except that it is filled with their stench; decay and blood. So Eisa will beseech Allah; as will his companions. So Allah will send upon them birds like the necks of Bukht milch camels. They will carry them off and cast them into an abyss. The Muslims will burn their bows; arrows and quivers for seventy years. He s.a.w said: Allah will send upon them a rain which no house of hide nor mud will bear. The earth will be washed; leaving it like a mirror. Then it will be said to the earth: bring forth your fruits and return your blessings. So on that day; a whole troop would eat a pomegranate and seek shade under its skin. Milk will be so blessed that a large group of people will be sufficed by one milking of a camel. And that a tribe will be sufficed by one milking of a cow; and that a group will be sufficed by the milking of sheep. While it is like that; Allah will send a wind which grabs the soul of every believer; leaving the remainder of the people copulating publicly like the copulation of donkeys. I thought that he would give me some present. He said to me when I came to him : When the day declines; stand up and pray four rakahs. He then narrated something similar. This version adds: Do not stand until you glorify Allah ten times; and praise Him ten times; and exalt Him ten times; and say; There is no god but Allah ten times. Then you should do that in four rakahs. If you are the greatest sinner on earth; you will be forgiven by Allah on account of this prayer. SunanAbuDawoud-017-001-25138 | Humaid Ibn Nafi reported the following three traditions on the authority of Zaynab; daughter of Abu Salamah: Zainab said: I visited Umm Habibah when her father Abu Sufyan; died. She asked for some yellow perfume containing saffron khaluq or something else. Then she applied it to a girl and touched her cheeks. She said: I have no need of perfume; but I heard the Messenger of Allah ﷺ say: It is not lawful for a woman who believes in Allah and the Last Day to observe mourning for one who has died; more than three nights; except for four months and ten days in the case of a husband. Zaynab said: I also visited Zaynab; daughter of Jahsh; when her brother died. She asked for some perfume and used it upon herself. She then said: I have no need of perfume; but I heard the Messenger of Allah ﷺ say when he was on the pulpit: It is not lawful for a woman who believes in Allah and the Last Day to observe mourning for one who has died; more than three nights; except for four months and ten days in the case of a husband. Zaynab said: I heard my mother; Umm Salamah; say: A woman came to the Messenger of Allah ﷺ and said: Messenger of Allah; the husband of my daughter has died; and she is suffering from sore eyes; may we put antimony in her eyes? The Messenger of Allah ﷺ said: No. He said this twice or thrice. Each time he said: No. The Messenger of Allah ﷺ said: The waiting period is now four months and ten days. In pre-Islamic days one of you used to throw away a piece of dung at the end of a year. Humayd said: I asked Zaynab: What do you mean by throwing away a piece of dung at the end of a year. Zaynab replied: When the husband of a woman died; she entered a small cell and put on shabby clothes; not touching perfume or any other thing until a year passed. Then an animal such as donkey or sheep or bird was provided for her. She rubbed herself with it. The animal with which she rubbed herself rarely survived. She then came out and was given a piece of dung which she threw away. SunanAbuDawoud-017-001-25225 | Narrated Sahl Ibn Hanzaliyah: Uyaynah Ibn Housn and Aqra Ibn Habis came to the Messenger of Allah ﷺ. They begged from him. He commanded to give them what they begged. He ordered Muawiyah to write a document to give what they begged. Aqra took his document; wrapped it in his turban; and went away. As for Uyaynah; he took his document and came to the Prophet ﷺ at his home; and said to him: Muhammad; do you see me? I am taking a document to my people; but I do not know what it contains; just like the document of AlMutalammis. Muawiyah informed the Messenger of Allah ﷺ of his statement. Thereupon the Messenger of Allah ﷺ said: He who begs from people when he has sufficient is simply asking for a large amount of Hell-fire. AlNufayl a transmitter said elsewhere: embers of Hell. They asked: Messenger of Allah; what is a sufficiency? Elsewhere AlNufayl said: What is a sufficiency which makes begging unfitting? MuwataMalik-017-001-34893 | Yahya said that he heard Malik speak about a man who bought goods - animals or clothes or wares; and the sale was found not to be permitted so it was revoked and the one who had taken the goods was ordered to return the owner his goods. Malik said; The owner of the goods only has their value on the day they were taken from him; and not on the day they are returned to him. That is because the man is liable for them from the day he took them and whatever loss is in them after that is against him. For that reason; their increase and growth are also his. A man may take the goods at a time when they are selling well and are in demand; and then have to return them at a time when they have fallen in price and no one wants them. For instance; the man may take the goods from the other man; and sell them for ten dinars or keep them while their price is that. Then he may have to return them while their price is only a dinar. He should not go off with nine dinars from the man property. Or perhaps they are taken by the man; and he sells them for a dinar or keeps them; while their price is only a dinar; then he has to return them; and their value on the day he returns them is ten dinars. The one who took them does not have to pay nine dinars from his property to the owner. He is only obliged to pay the value of what he took possession of on the day it was taken. He said; Part of what clarifies this is that when a thief steals goods; only their price on the day he stole them is looked at. If cutting off the hand is necessary because of it; that is done. If the cutting off is delayed; either because the thief is imprisoned until his situation is examined or he flees and then is caught; the delay of the cutting off of the hand does not make the hadd; which was obliged for him on the day he stole; fall from him even if those goods become cheap after that. MuwataMalik-017-001-34921 | Yahya said that he heard Malik say; What is done in our community about someone who consumed an animal without the permission of its owner; is that he must pay its price on the day he consumed it. He is not obliged to replace it with a similar animal nor does he compensate the owner with any kind of animal. He must pay its price on the day it was consumed; and giving the value is more equitable in compensation for animals and goods. Yahya said that he heard Malik say about someone who consumes some food without the permission of its owner; He returns to the owner a like weight of the same kind of food. Food is in the position of gold and silver. Gold and silver are returned with gold and silver. The animal is not in the position of gold in that. What distinguishes between them is the sunna and the behaviour which is in force. MuwataMalik-017-001-35034 | Yahya related to me from Malik from Abdullah Ibn Abi Bakr Ibn Muhammad Ibn Amr Ibn Hazm that Aban Ibn Uthman and Hisham Ibn Ismail used to mention in their khutbas built-in liability agreements in the sale of slaves; to cover both a three day period and a similar clause covering a year. Malik explained; The defects a lave or slave-girl are found to have from the time they are bought until the end of the three days are the responsibility of the seller. The year agreement is to cover insanity; leprosy; and loss of limbs due to disease. After a year; the seller is free from any liability. Malik said;An inheritor or someone else who sells a slave or slave-girl without any such built-in guarantee is not responsible for any fault in the slave and there is no liability agreement held against him unless he was aware of a fault and concealed it. If he was aware of a fault; the lack of guarantee does not protect him. The purchase is returned. MuwataMalik-017-001-35035 | Yahya related to me from Malik from Yahya Ibn Said from Salim Ibn Abdullah that Abdullah Ibn Umar sold one of his slaves for eight hundred dirhams with the stipulation that he was not responsible for defects. The person who bought the slave complained to Abdullah Ibn Umar that the slave had a disease which he had not told him about. They argued and went to Uthman Ibn Affan for a decision. The man said; He sold me a slave with a disease which he did not tell me about. Abdullah said; I sold to him with the stipulation that I was not responsible. Uthman Ibn Affan decided that Abdullah Ibn Umar should take an oath that he had sold the slave without knowing that he had any disease. Abdullah Ibn Umar refused to take the oath; so the slave was returned to him and recovered his health in his possession. Abdullah sold him afterwards for 1500 dirhams. Malik said; The generally agreed upon way of doing things among us about a man who buys a female slave and she becomes pregnant; or who buys a slave and then frees him; or if there is any other such matter which has already happened so that he cannot return his purchase; and a clear proof is established that there was a fault in that purchase when it was in the hands of the seller or the fault is admitted by the seller or someone else; is that the slave or slave-girl is assessed for its value with the fault it is found to have had on the day of purchase and the buyer is refunded;from what he paid;the difference between the price of a slave who is sound and a slave with such a defect. Malik said; The generally agreed upon way of doing things among us regarding a man who buys a slave and then finds out that the slave has a defect for which he can be returned and meanwhile another defect has happened to the slave whilst in his possession; is that if the defect which occurred to the slave in his possession has harmed him; like loss of a limb; loss of an eye; or something similar; then he has a choice. If he wants; he can have the price of the slave reduced commensurate with the defect he bought him with according to the prices on the day he bought him; or if he likes; he can pay compensation for the defect which the slave has suffered in his possession and return him. The choice is up to him. If the slave dies in his possession; the slave is valued with the defect which he had on the day of his purchase. It is seen what his price would really have been. If the price of the slave on the day of purchase without fault was 100 dinars; and his price on the day of purchase with fault would have been 80 dinars; the price is reduced by the difference. These prices are assessed according to the market value on the day the slave was purchased. Malik said; The generally agreed upon way of doing things among us is that if a man returns a slave girl in whom he has found a defect and he has already had intercourse with her; he must pay what he has reduced of her price if she was a virgin. If she was not a virgin; there is nothing against his having had intercourse with her because he had charge of her. Malik said; The generally agreed upon way of doing things among us regarding a person; whether he is an inheritor or not; who sells a slave; slave-girl; or animal without a liability agreement is that he is not responsible for any defect in what he sold unless he knew about the fault and concealed it. If he knew that there was a fault and concealed it; his declaration that he was free of responsibility does not absolve him; and what he sold is returned to him. Malik spoke about a situation where a slave-girl was bartered for two other slave-girls and then one of the slave-girls was found to have a defect for which she could be returned. He said; The slave-girl worth two other slave- girls is valued for her price. Then the other two slave-girls are valued; ignoring the defect which the one of them has. Then the price of the slave-girl sold for two slave-girls is divided between them according to their prices so that the proportion of each of them in her price is arrived at - to the higher priced one according to her higher price; and to the other according to her value. Then one looks at the one with the defect; and the buyer is refunded according to the amount her share is affected by the defect; be it little or great. The price of the two slave-girls is based on their market value on the day that they were bought. Malik spoke about a man who bought a slave and hired him out on a long-term or short-term basis and then found out that the slave had a defect which necessitated his return. He said that if the man returned the slave because of the defect; he kept the hire and revenue. This is the way in which things are done in our city. That is because; had the man bought a slave who then built a house for him; and the value of the house was many times the price of the slave; and he then found that the slave had a defect for which he could be returned; and he was returned; he would not have to make payment for the work the slave had done for him. Similarly; he would keep any revenue from hiring him out; because he had charge of him. This is the way of doing things among us. Malik said; The way of doing things among us when someone buys several slaves in one lot and then finds that one of them has been stolen; or has a defect; is that he looks at the one he finds has been stolen or the one in which he finds a defect. If he is the pick of those slaves; or the most expensive; or it was for his sake that he bought them; or he is the one in whom people see the most excellence; then the whole sale is returned. MuwataMalik-017-001-35110 | Yahya related to me; that Malik said; The generally agreed on way of doing things among us about a man buying cloth in one city; and then taking it to another city to sell as a murabaha; is that he is not reckoned to have the wage of an agent; or any allowance for ironing; folding; straightening; expenses; or the rent of a house. As for the cost of transporting the drapery; it is included in the basic price; and no share of the profit is allocated to it unless the agent tells all of that to the investor. If they agree to share the profits accordingly after knowledge of it; there is no harm in that. Malik said; As for bleaching; tailoring; dyeing; and such things; they are treated in the same way as drapery. The profit is reckoned in them as it is reckoned in drapery goods. So if he sells the drapery goods without clarifying the things we named as not getting profit; and if the drapery has already gone; the transport is to be reckoned; but no profit is given. If the drapery goods have not gone the transaction between them is null and void unless they make a new mutual agreement on what is to be permitted between them. Malik spoke about an agent who bought goods for gold or silver; and the exchange rate on the day of purchase was ten dirhams to the dinar. He took them to a city to sell murabaha; or sold them where he purchased them according to the exchange rate of the day on which he sold them. If he bought them for dirhams and he sold them for dinars; or he bought them for dinars and he sold them for dirhams; and the goods had not gone then he had a choice. If he wished; he accepted to sell the goods and if he wished; he left them. If the goods had been sold; he had the price for which the salesman bought them; and the salesman was reckoned to have the profit on what they were bought for; over what the investor gained as profit. Malik said; If a man sells goods worth one hundred dinars for one hundred and ten; and he hears after that they are worth ninety dinars; and the goods have gone; the seller has a choice. If he likes; he has the price of the goods on the day they were taken from him unless the price is more than the price for which he was obliged to sell them in the first place; and he does not have more than that - and it is one hundred and ten dinars. If he likes; it is counted as profit against ninety unless the price his goods reached was less than the value. He is given the choice between what his goods fetch and the capital plus the profit; which is ninety-nine dinars. Malik said; If someone sells goods in murabaha and he says; It was valued at one hundred dinars to me. Then he hears later on; that it was worth one hundred and twenty dinars; the customer is given the choice. If he wishes; he gives the salesman the value of the goods on the day he took them; and if he wishes; he gives the price for which he bought them according to the reckoning of what profit he gives him; as far as it goes; unless that is less than the price for which he bought them; for he should not give the owner of the goods a loss from the price for which he bought them because he was satisfied with that. MuwataMalik-017-001-35157 | Yahya related to me from Malik from Rabia Ibn Abi Abdulrahman from more than one of the people of knowledge of that time; that those who were killed on the Day of the Camel; the Day of Siffin; the Day of AlHarra; and the Day of Qudayd did not inherit from each other. None of them inherited anything from his companion unless it was known that he had been killed before his companion. Malik said; That is the way of doing things about which there is no dispute; and which none of the people of knowledge in our city doubt. The procedure with two mutual heirs who are drowned; or killed in another way; when it is not known which of them died first is the same - neither of them inherits anything from his companion. Their inheritance goes to whoever remains of their heirs. They are inherited from by the living. Malik said; No one should inherit from anyone else when there is doubt; and one should only inherit from the other when there is certainty of knowledge and witnesses. That is because a man and his mawla whom his father has freed might die at the same time. The sons of the free man could say; Our father inherited from the mawla. They should not inherit from the mawla without knowledge or testimony that he died first. The living people most entitled to his wala inherit from him. Malik said; Another example is two full brothers who die. One of them has children and the other does not. They have a half-brother by their father. It is not known which of them died first; so the inheritance of the childless one goes to his half-brother by the father. The children of the full-brother get nothing. Malik said; Another example is when a paternal aunt and the son of her brother die; or else the daughter of the brother and her paternal uncle. It is not known which of them died first. Their grave was part of what was left after the flood. They were in the same grave; and they were among those martyred at Uhud. They were dug up so that they might be moved. They were found unchanged. It was as if they had died only the day before. One of them had been wounded; and he had put his hand over his wound and had been buried like that. His hand was pulled away from his wound and released; and it returned to where it had been. It was forty-six years between Uhud and the day they were dug up. Malik said; There is no harm in burying two or three men in the same grave due to necessity. MuwataMalik-017-001-35469 | Malik was asked whether someone who went into a Masjid to do itikaf for the last ten days of Ramadan and stayed there for a day or two but then became ill and left the Masjid; had to do itikaf for the number of days that were left from the ten; or not; and if he did have to do so; then what month should he do it in; and he replied; He should make up whatever he has to do of the itikaf when he recovers; whether in Ramadan or otherwise. I have heard that the Messenger of Allah; may Allah bless him and grant him peace; once wanted to do itikaf in Ramadan; but then came back without having done so; and then when Ramadan had gone; he did itikaf for ten days in Shawal. Some one who does itikaf voluntarily in Ramadan and some one who has to do itikaf are in the same position regarding what is halal for them and what is haram. I have not heard that the Messenger of Allah; may Allah bless him and grant him peace; ever did itikaf other than voluntarily. Malik said; that if a woman did itikaf and then menstruated during her itikaf; she went back to her house; and; when she was pure again she returned to the Masjid; at whatever time it was that she became pure. She then continued her itikaf from where she left off. This was the same situation as with a woman who had to fast two consecutive months; and who menstruated and then became pure. One year he was doing itikaf and then; when it came to the night of the twenty-first; which was the night before the morning when he would normally have finished his itikaf; he said; Whoever has done itikaf with me should continue doing itikaf for the last ten days. I saw a certain night and then I was made to forget it. I saw myself prostrating the following morning in water and clay. Look for it in the last ten days; and look for it on the odd days. Abu Said continued; The sky poured with rain that night and the Masjid had a roof made of palm fronds and the Masjid was soaked.
