We are living in the land of the people of the Scripture and we take our meals in their utensils; and in the land there is game and I hunt with my bow and trained or untrained hounds; please tell me what is lawful for us of that. He said; As for your saying that you are living in the land of the people of the Scripture and that you eat in their utensils; if you can get utensils other than theirs; do not eat in their utensils; but if you do not find other than theirs ; then wash their utensils and eat in them. As for your saying that you are in the land of game; if you hung something with your bow; and have mentioned Allah Name while hunting; then you can eat the game. And if you hunt something with your trained hound; and have mentioned Allah Name on sending it for hunting then you can eat the game. SahihAlBukhari-017-001-3942 | Narrated Adi Bin Hatim: While I was in the city of the Prophet; a man came and complained to him the Prophet; of destitution and poverty. Then another man came and complained of robbery by highwaymen. The Prophet said; Adi! Have you been to AlHira? I said; I havent been to it; but I was informed about it. He said; If you should live for a long time; you will certainly see that a lady in a Howdah traveling from AlHira will safely reach Mecca and perform the Tawaf of the Kaba; fearing none but Allah. I said to myself; What will happen to the robbers of the tribe of Tai who have spread evil through out the country? The Prophet ﷺ further said. If you should live long; the treasures of Khosrau will be opened and taken as spoils. I asked; You mean Khosrau; son of Hurmuz? He said; Khosrau; son of Hurmuz; and if you should live long; you will see that one will carry a handful of gold or silver and go out looking for a person to accept it from him; but will find none to accept it from him. And any of you; when meeting Allah; will meet Him without needing an interpreter between him and Allah to interpret for him; and Allah will say to him: Didnt I send a messenger to teach you? He will say: Yes. Allah will say: Didnt I give you wealth and do you favors? He will say: Yes. Then he will look to his right and see nothing but Hell; and look to his left and see nothing but Hell. Adi further said: I heard the Prophet ﷺ saying; Save yourself from the Hell Fire even with half a date to be given in charity and if you do not find a half date; then with a good pleasant word. Adi added: later on I saw a lady in a Howdah traveling from AlHira till she performed the Tawaf of the Kaba; fearing none but Allah. And I was one of those who opened conquered the treasures of Khosrau; son of Hurmuz. SahihAlBukhari-017-001-3989 | Narrated Abu Huraira: The Prophet ﷺ said; A horse may be kept for one of three purposes: for a man it may be a source of reward; for another it may be a means of living; and for a third it may be a burden a source of committing sins. As for the one for whom it is a source of reward; he is the one who keeps his horse for the sake of Jihad in Allah Cause; he ties it with a long rope on a pasture or in a garden. So whatever its rope allows it to eat; will be regarded as good rewardable deeds for its owner. And if it breaks off its rope and jumps over one or two hillocks; even its dung will be considered amongst his good deeds. And if it passes by a river and drinks water from it; that will be considered as good deeds for his benefit even if he has had no intention of watering it. A horse is a shelter for the one who keeps it so that he may earn his living honestly and takes it as a refuge to keep him from following illegal ways of gaining money ; and does not forget the rights of Allah i.e. paying the Zakat and allowing others to use it for Allah Sake. But a horse is a burden and a source of committing sins for him who keeps it out of pride and pretense and with the intention of harming the Muslims. The Prophet ﷺ was asked about donkeys. SahihAlBukhari-017-001-4165 | Narrated Ibn Abbas: The first lady to use a girdle was the mother of Ishmael. She used a girdle so that she might hide her tracks from Sarah. Abraham brought her and her son Ishmael while she was suckling him; to a place near the Kaba under a tree on the spot of Zamzam; at the highest place in the Masjid. During those days there was nobody in Mecca; nor was there any water So he made them sit over there and placed near them a leather bag containing some dates; and a small water-skin containing some water; and set out homeward. Ishmael mother followed him saying; O Abraham! Where are you going; leaving us in this valley where there is no person whose company we may enjoy; nor is there anything to enjoy ? She repeated that to him many times; but he did not look back at her Then she asked him; Has Allah ordered you to do so? He said; Yes. She said; Then He will not neglect us; and returned while Abraham proceeded onwards; and on reaching the Thaniya where they could not see him; he faced the Kaba; and raising both hands; invoked Allah saying the following prayers: O our Lord! I have made some of my offspring dwell in a valley without cultivation; by Your Sacred House Kaba at Mecca in order; O our Lord; that they may offer prayer perfectly. So fill some hearts among men with love towards them; and O Allah provide them with fruits; so that they may give thanks. 14.37 Ishmael mother went on suckling Ishmael and drinking from the water she had. When the water in the water-skin had all been used up; she became thirsty and her child also became thirsty. She started looking at him i.e. Ishmael tossing in agony; She left him; for she could not endure looking at him; and found that the mountain of Safa was the nearest mountain to her on that land. She stood on it and started looking at the valley keenly so that she might see somebody; but she could not see anybody. Then she descended from Safa and when she reached the valley; she tucked up her robe and ran in the valley like a person in distress and trouble; till she crossed the valley and reached the Marwa mountain where she stood and started looking; expecting to see somebody; but she could not see anybody. She repeated that running between Safa and Marwa seven times. The Prophet ﷺ said; This is the source of the tradition of the walking of people between them i.e. Safa and Marwa. When she reached the Marwa for the last time she heard a voice and she asked herself to be quiet and listened attentively. She heard the voice again and said; O; whoever you may be ! You have made me hear your voice; have you got something to help me? And behold! She saw an angel at the place of Zamzam; digging the earth with his heel or his wing ; till water flowed from that place. She started to make something like a basin around it; using her hand in this way; and started filling her water-skin with water with her hands; and the water was flowing out after she had scooped some of it. The Prophet ﷺ added; May Allah bestow Mercy on Ishmael mother! Had she let the Zamzam flow without trying to control it or had she not scooped from that water to fill her water-skin ; Zamzam would have been a stream flowing on the surface of the earth. The Prophet ﷺ further added; Then she drank water and suckled her child. The angel said to her; Dont be afraid of being neglected; for this is the House of Allah which will be built by this boy and his father; and Allah never neglects His people. The House i.e. Kaba at that time was on a high place resembling a hillock; and when torrents came; they flowed to its right and left. She lived in that way till some people from the tribe of Jurhum or a family from Jurhum passed by her and her child; as they i.e. the Jurhum people were coming through the way of Kada. They landed in the lower part of Mecca where they saw a bird that had the habit of flying around water and not leaving it. They said; This bird must be flying around water; though we know that there is no water in this valley. They sent one or two messengers who discovered the source of water; and returned to inform them of the water. So; they all came towards the water. The Prophet ﷺ added; Ishmael mother was sitting near the water. They asked her; Do you allow us to stay with you? She replied; Yes; but you will have no right to possess the water. They agreed to that. The Prophet ﷺ further said; Ishmael mother was pleased with the whole situation as she used to love to enjoy the company of the people. So; they settled there; and later on they sent for their families who came and settled with them so that some families became permanent residents there. The child i.e. Ishmael grew up and learnt Arabic from them and his virtues caused them to love and admire him as he grew up; and when he reached the age of puberty they made him marry a woman from amongst them. After Ishmael mother had died; Abraham came after Ishmael marriage in order to see his family that he had left before; but he did not find Ishmael there. When he asked Ishmael wife about him; she replied; He has gone in search of our livelihood. Then he asked her about their way of living and their condition; and she replied; We are living in misery; we are living in hardship and destitution; complaining to him. He said; When your husband returns; convey my salutation to him and tell him to change the threshold of the gate of his house. When Ishmael came; he seemed to have felt something unusual; so he asked his wife; Has anyone visited you? She replied; Yes; an old man of so-and-so description came and asked me about you and I informed him; and he asked about our state of living; and I told him that we were living in a hardship and poverty. On that Ishmael said; Did he advise you anything? She replied; Yes; he told me to convey his salutation to you and to tell you to change the threshold of your gate. Ishmael said; It was my father; and he has ordered me to divorce you. Go back to your family. So; Ishmael divorced her and married another woman from amongst them i.e. Jurhum. Then Abraham stayed away from them for a period as long as Allah wished and called on them again but did not find Ishmael. So he came to Ishmael wife and asked her about Ishmael. She said; He has gone in search of our livelihood. Abraham asked her; How are you getting on? asking her about their sustenance and living. She replied; We are prosperous and well-off i.e. we have everything in abundance. Then she thanked Allah Abraham said; What kind of food do you eat? She said. Meat. He said; What do you drink? She said; Water. He said; O Allah! Bless their meat and water. The Prophet added; At that time they did not have grain; and if they had grain; he would have also invoked Allah to bless it. The Prophet ﷺ added; If somebody has only these two things as his sustenance; his health and disposition will be badly affected; unless he lives in Mecca. The Prophet ﷺ added; Then Abraham said Ishmael wife; When your husband comes; give my regards to him and tell him that he should keep firm the threshold of his gate. When Ishmael came back; he asked his wife; Did anyone call on you? She replied; Yes; a good-looking old man came to me; so she praised him and added. He asked about you; and I informed him; and he asked about our livelihood and I told him that we were in a good condition. Ishmael asked her; Did he give you any piece of advice? She said; Yes; he told me to give his regards to you and ordered that you should keep firm the threshold of your gate. On that Ishmael said; It was my father; and you are the threshold of the gate. He has ordered me to keep you with me. Then Abraham stayed away from them for a period as long as Allah wished; and called on them afterwards. He saw Ishmael under a tree near Zamzam; sharpening his arrows. When he saw Abraham; he rose up to welcome him and they greeted each other as a father does with his son or a son does with his father. Abraham said; O Ishmael! Allah has given me an order. Ishmael said; Do what your Lord has ordered you to do. Abraham asked; Will you help me? Ishmael said; I will help you. Abraham said; Allah has ordered me to build a house here; pointing to a hillock higher than the land surrounding it. The Prophet ﷺ added; Then they raised the foundations of the House i.e. the Kaba. Ishmael brought the stones and Abraham was building; and when the walls became high; Ishmael brought this stone and put it for Abraham who stood over it and carried on building; while Ishmael was handing him the stones; and both of them were saying; O our Lord! SahihAlBukhari-017-001-5046 | Narrated Abu Huraira: Allah Messenger ﷺ said; Keeping horses may be a source of reward to some man ; a shelter to another i.e. means of earning one living ; or a burden to a third. He to whom the horse will be a source of reward is the one who keeps it in Allah Cause prepare it for holy battles and ties it by a long rope in a pasture or a garden. He will get a reward equal to what its long rope allows it to eat in the pasture or the garden; and if that horse breaks its rope and crosses one or two hills; then all its footsteps and its dung will be counted as good deeds for its owner; and if it passes by a river and drinks from it; then that will also be regarded as a good deed for its owner even if he has had no intention of watering it then. Horses are a shelter from poverty to the second person who keeps horses for earning his living so as not to ask others; and at the same time he gives Allah right i.e. rakat from the wealth he earns through using them in trading etc.; and does not overburden them. He who keeps horses just out of pride and for showing off and as a means of harming the Muslims; his horses will be a source of sins to him. SahihMuslim-017-001-18043 | It is narrated on the authority of Urwa Bin AlZubair who narrated from Aisha that she informed him that Fatima; daughter of the Messenger of Allah ﷺ ; sent someone to Abu Bakr to demand from him her share of the legacy left by the Messenger of Allah ﷺ from what Allah had bestowed upon him at Medina and Fadak and what was left from one-filth of the income annually received from Khaibar. Abu Bakr said: The Messenger of Allah ﷺ said: We prophets do not have any heirs; what we leave behind is to be given in charity. The household of the Messenger of Allah ﷺ will live on the income from these properties; but; by Allah; I will not change the charity of the Messenger of Allah ﷺ from the condition in which it was in his own time. I will do the same with it as the Messenger of Allah may peace be upun him himself used to do. So Abu Bakr refused to hand over anything from it to Fatima who got angry with Abu Bakr for this reason. She forsook him and did not talk to him until the end of her life. She lived for six months after the death of the Messenger of Allah ﷺ. When she died; her husband. Ali Bin Abu Talib; buried her at night. He did not inform Abu Bakr about her death and offered the funeral prayer over her himself. During the lifetime of Fatima; All received special regard from the people. After she had died; he felt estrangement in the faces of the people towards him. So he sought to make peace with Abu Bakr and offer his allegiance to him. He had not yet owed allegiance to him as Caliph during these months. He sent a person to Abu Bakr requesting him to visit him unaccompanied by anyone disapproving the presence of Umar. Umar said to Abu Bakr: BY Allah; you will not visit them alone. Abu Bakr said: What will they do to me? By Allah; I will visit them. And he did pay them a visit alone. All recited Tashahhud as it is done in the beginning of a religious sermon ; then said: We recognise your moral excellence and what Allah has bestowed upon you. We do not envy the favour i. e. the Catiphate which Allah nas conferred upon you; but you have done it assumed the position of Caliph alone without consulting us ; and we thought we had a right to be consulted on account of our kinship with the Messenger of Allah ﷺ. He continued to talk to Abu Bakr in this vein until the latter eyes welled up with tears. Then Abd Bakr spoke and said: By Allah; in Whose Hand is my life; the kinship of the Messenger of Allah ﷺ is dearer to me than the kinship of my own people. As regards the dispute that has arisen between you and me about these properties; I have not deviated from the right course and I have not given up doing about them what the Messenger of Allah ﷺ used to do. So Ali said to Abu Bakr: This aftetnoon is fixed for swearing allegiance to you. So when Abu Bakr had finished his Zuhr prayer; he ascended the pulpit and recited Tashahhud; and described the status of Ali; his delay in swearing allegiance and the excuse which lie had offered to him for this delay. After this he asked for God forgiveness. Then Ali Bin Abu Talib recited the Tashahhud. extolled the merits of Abu Bakr and said that his action was nott prompted by any jealousy of Abu Bakr on his part or his refusal to accept the high position which Allah had conferred upon him; adding: But we were of the opinion that we should have a share in the government; but the matter had been decided without taking us into confidence; and this displeased us. Hence the delay in offering allegiance. The Muslims were pleased with this explanation and they said: You have done the right thing. SahihMuslim-017-001-19248 | Abdullah Bin Amr reported that a person came to him and said: What is this hadith that you narrate that the Last Hour would come at such and such time? Thereupon he said: Hallowed be Allah; there is no god but Allah or the words to the same effect. I have decided that I would not narrate anything to anyone now. I had only said that you would see after some time an important event that the sacred House Kaba would be burnt and it would happen and definitely happen. He then reported that Allah Messenger ﷺ said: The Dajjal would appear in my Ummah and he would stay in the world for forty - I cannot say whether he meant forty days; forty months or forty years. And Allah would then send Jesus son of Mary who would resemble Urwa b Masud. He Jesus Christ would chase him and kill him. Then people would live for seven years that there would be no rancour between two persons. Then Allah would send cold wind from the side of Syria that none would survive upon the earth having a speck of good in him or faith in him but he would die; so much so that even if some amongst you were to enter the innermost part of the mountain; this wind would reach that place also and that would cause his death. I heard Allah Messenger ﷺ as saying: Only the wicked people would survive and they would be as careless as birds with the characteristics of beasts. They would never appreciate the good nor condemn evil. Then Satan would come to them in human form and would say: Dont you respond? And they would say: What do you order us? And he would command them to worship the idols but; in spite of this; they would have abundance of sustenance and lead comfortable lives. Then the trumpet would be blown and no one would hear that but he would bend his neck to one side and raise it from the other side and the first one to hear that trumpet would be the person who would be busy in setting right the tank meant for providing water to the camels. He would swoon and the other people would also swoon; then Allah would send or He would cause to send rain which would be like dew and there would grow out of it the bodies of the people. Then the second trumpet would be blown and they would stand up and begin to look around. Then it would be said: O people; go to your Lord; and make them stand there. And they would be questioned. Then it would be said: Bring out a group out of them for the Hell-Fire. And then it would be asked: How much? One day he prepared food which contained garlic; and when it was returned to him he asked to locate the part which the fingers of Allah Apostle ﷺ had touched. It was said to him that he had not eaten the food. He Abd Ayoub Ansari was distressed and went up to him to the Holy Prophet and said: Is it forbidden? Among what he said was: Indeed the world is green and sweet; and indeed Allah has left you to remain to see how you behave. So beware of the world; and beware of the women. And among what he said was: The awe status of people should not prevent a man from saying the truth when he knows it.He one of the narrators said: Abu Saeed wept; then he said: By Allah! He asked his people to give them one hundred camels if they embraced Islam; and they embraced Islam. He divided the camels among them. But it occurred to him then that he should withdraw his camels from them. Is he more entitled to them or we? If he says: Yes or no; then tell him: My father is an old man; and he is the chief of the people living at the water. He has requested you to make me chief after him. He came to him and said: My father has extended his greetings to you. He replied: On you and you father be peace. He said: My father asked his people to give them one hundred camels if they embraced Islam. So they embraced Islam; and their belief in Islam is good. MuwataMalik-017-001-34813 | Malik said; The generally agreed-on way of doing things among us in the case of slave whose master makes a bequest to free part of him - a third; a fourth; a half; or any share after his death; is that only the portion of him is freed that his master has named. This is because the freeing of that portion is only obliged to take place after the death of the master because the master has the option to withdraw the bequest as long as he lives. When the slave is freed from his master; the master is a testator and the testator only has access to free what he can take from his property; being the third of the property he is allowed to bequeath; and the rest of the slave is not free because the man property has gone out of his hands. How can the rest of the slave which belongs to other people be free when they did not initiate the setting free and did not confirm it and they do not have the wala established for them? Only the deceased could do that. He was the one who freed him and the one for whom the wala was confirmed. That is not to be borne by another property unless he bequeaths within the third of his property what remains of a lave to be freed. That is a request against his partners and inheritors and the partners must not refuse the slave that when it is within the third of the dead man property because there is no harm in that to the inheritors. Malik said; If a man frees a third of his slave while he is critically ill; he must complete the emancipation so all of him is free from him; if it is within the third of his property that he has access to; because he is not treated in the same way as a man who frees a third of a slave after his death; because had the one who freed a third of his slave after his death lived; he could have cancelled it and the slave being set free would be of no effect. The master who made the freeing of the third of the slave irrevocable in his illness; would still have to free all of him if he lived. If he died; the slave would be set free within the third of the bequest. MuwataMalik-017-001-35157 | Yahya related to me from Malik from Rabia Ibn Abi Abdulrahman from more than one of the people of knowledge of that time; that those who were killed on the Day of the Camel; the Day of Siffin; the Day of AlHarra; and the Day of Qudayd did not inherit from each other. None of them inherited anything from his companion unless it was known that he had been killed before his companion. Malik said; That is the way of doing things about which there is no dispute; and which none of the people of knowledge in our city doubt. The procedure with two mutual heirs who are drowned; or killed in another way; when it is not known which of them died first is the same - neither of them inherits anything from his companion. Their inheritance goes to whoever remains of their heirs. They are inherited from by the living. Malik said; No one should inherit from anyone else when there is doubt; and one should only inherit from the other when there is certainty of knowledge and witnesses. That is because a man and his mawla whom his father has freed might die at the same time. The sons of the free man could say; Our father inherited from the mawla. They should not inherit from the mawla without knowledge or testimony that he died first. The living people most entitled to his wala inherit from him. Malik said; Another example is two full brothers who die. One of them has children and the other does not. They have a half-brother by their father. It is not known which of them died first; so the inheritance of the childless one goes to his half-brother by the father. The children of the full-brother get nothing. Malik said; Another example is when a paternal aunt and the son of her brother die; or else the daughter of the brother and her paternal uncle. It is not known which of them died first. MuwataMalik-017-001-35601 | Yahya related to me from Malik from Nafi that Abdullah Ibn Umar used to pay the zakat Alfitr for those slaves of his that were at Wadil-Qura and Khaybar. Yahya related to me that Malik said; The best that I have heard about the zakat Alfitr is that a man has to pay for every person that he is responsible for supporting and whom he must support. He has to pay forall his mukatabs; his mudabbars; and his ordinary slaves; whether they are present or absent; as long as they are muslim; and whether or not they are fortrade. However; he does not have to pay zakat on any of them that are not muslim. Malik said; concerning a runaway slave; I think that his master should pay the zakat fo rhim whether or not he knows where he is; if it has not been long since the slave ran away and his master hopes that he is still alive and will return. If it has been a long time since he ran away and his master has despaired of him returning then I do not think that he should pay zakat for him. MuwataMalik-017-001-35795 | Yahya related to me from Malik; from Abdullah Ibn Dinar; that Abdullah Ibn Umar used to say; Anyone that does umra in the months of hajj; that is; in Shawal; Dh AlQada; or in Dhu AlHijja before the hajj; and then stays in Makka until the time for hajj; is doing tamattu if he then does hajj. He must sacrifice whatever animal it is easy for him to obtain; and if he cannot find one then he must fast three days during hajj and seven days when he returns. Malik said; This is only the case if he stays until the hajj and does hajj in that same year. Malik said that if someone who was from Makka but had stopped living there and gone to live elsewhere; came back to do umra in the months of the hajj and then stayed in Makka to begin hajj there; he was doing tamattu; and had to offer up a sacrificial animal; or fast if he could not find one. He was not the same as the people of Makka. Malik was asked whether someone who was not from Makka and entered Makka to do umra in the months of hajj with the intention of staying on to begin his hajj there was doing tamattu or not; and he said; Yes; he is doing tamattu; and he is not the same as the people of Makka; even if he has the intention of staying there. This is because he has entered Makka; and is not one of its people; and making a sacrifice or fasting is incumbent on anyone who is not from Makka; and; although he intends to stay; he does not know what possibilities might arise later. MuwataMalik-017-001-35797 | Malik said; Someone who does umra in Shawal; Dh AlQada or Dhu AlHijja and then goes back to his people; and then returns and does hajj in that same year does not have to sacrifice an animal. Sacrificing an animal is only incumbent on some one who does umra in the months of hajj; and then stays in Makka and then does hajj. A person not from Makka who moves to Makka and establishes his home there and does umra in the months of the hajj and then begins his hajj there is not doing tamattu. He does not have to sacrifice an animal nor does he have to fast. He is in the same position as the people of Makka if he is one of those who are living there. Malik was asked whether a man from Makka who had gone to live in another town or had been on a journey and then returned to Makka with the intention of staying there; regardless of whether he had a family there or not; and entered it to do umra in the months of the hajj; and then began his hajj there; beginning his umra at the miqat of the Prophet; may Allah bless him and grant him peace; or at a place nearer than that; was doing tamattu or not? Malik answered; He does not have to sacrifice an animal or fast as someone who is doing tamattu has to do. MuwataMalik-017-001-35946 | Yahya related to me from Malik from Zayd Ibn Aslam from his father that Umar Ibn AlKhattab prayed two rakas with the people of Makka; and then; when he had finished; he said; People of Makka; complete your prayer; becausewe are a group of travellers. Later; Umar prayed two rakas with them at Mina; but we have not heard that he said anything to them on that occasion. Malik was asked whether the people of Makka should pray two rakas at Arafa or four; and whether the amir of the hajj; if he was a Makkan; should pray dhuhr and asr with four rakas or two; and also how the people of Makka who were living at Mina should pray; and he said; The people of Makka should pray only two rakas at Arafa and Mina for as long as they stay there; and should shorten the prayer until they return to Makka. The amir of the hajj; if he is a Makkan; should also shorten the prayer at Arafa and during the days of Mina.
