Had it not been for the Decree of Judgment, the matter would have been decided between them (at once). But verily the Wrong-doers will have a grievous Penalty.

Surat AlBaqara Ayah 229Surat AlBaqara-0.287الطَّلَاقُ مَرَّتَانِ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ وَلَا يَحِلُّ لَكُمْ أَنْ تَأْخُذُوا مِمَّا آتَيْتُمُوهُنَّ شَيْئًا إِلَّا أَنْ يَخَافَا أَلَّا يُقِيمَا حُدُودَ اللَّهِ فَإِنْ خِفْتُمْ أَلَّا يُقِيمَا حُدُودَ اللَّهِ فَلَا جُنَاحَ عَلَيْهِمَا فِيمَا افْتَدَتْ بِهِ تِلْكَ حُدُودُ اللَّهِ فَلَا تَعْتَدُوهَا وَمَنْ يَتَعَدَّ حُدُودَ اللَّهِ فَأُولَئِكَ هُمُ الظَّالِمُونَA divorce is only permissible twice: after that, the parties should either hold Together on equitable terms, or separate with kindness. It is not lawful for you, (Men), to take back any of your gifts (from your wives), except when both parties fear that they would be unable to keep the limits ordained by Allah. If ye (judges) do indeed fear that they would be unable to keep the limits ordained by Allah, there is no blame on either of them if she give something for her freedom. These are the limits ordained by Allah; so do not transgress them if any do transgress the limits ordained by Allah, such persons wrong (Themselves as well as others).
Surat AlTaubah Ayah 83Surat AlTaubah-0.13113فَإِنْ رَجَعَكَ اللَّهُ إِلَى طَائِفَةٍ مِنْهُمْ فَاسْتَأْذَنُوكَ لِلْخُرُوجِ فَقُلْ لَنْ تَخْرُجُوا مَعِيَ أَبَدًا وَلَنْ تُقَاتِلُوا مَعِيَ عَدُوًّا إِنَّكُمْ رَضِيتُمْ بِالْقُعُودِ أَوَّلَ مَرَّةٍ فَاقْعُدُوا مَعَ الْخَالِفِينَIf, then, Allah bring thee back to any of them, and they ask thy permission to come out (with thee), say: "Never shall ye come out with me, nor fight an enemy with me: for ye preferred to sit inactive on the first occasion: Then sit ye (now) with those who lag behind."
Surat AlBaqara Ayah 102Surat AlBaqara-0.1387وَاتَّبَعُوا مَا تَتْلُو الشَّيَاطِينُ عَلَى مُلْكِ سُلَيْمَانَ وَمَا كَفَرَ سُلَيْمَانُ وَلَكِنَّ الشَّيَاطِينَ كَفَرُوا يُعَلِّمُونَ النَّاسَ السِّحْرَ وَمَا أُنْزِلَ عَلَى الْمَلَكَيْنِ بِبَابِلَ هَارُوتَ وَمَارُوتَ وَمَا يُعَلِّمَانِ مِنْ أَحَدٍ حَتَّى يَقُولَا إِنَّمَا نَحْنُ فِتْنَةٌ فَلَا تَكْفُرْ فَيَتَعَلَّمُونَ مِنْهُمَا مَا يُفَرِّقُونَ بِهِ بَيْنَ الْمَرْءِ وَزَوْجِهِ وَمَا هُمْ بِضَارِّينَ بِهِ مِنْ أَحَدٍ إِلَّا بِإِذْنِ اللَّهِ وَيَتَعَلَّمُونَ مَا يَضُرُّهُمْ وَلَا يَنْفَعُهُمْ وَلَقَدْ عَلِمُوا لَمَنِ اشْتَرَاهُ مَا لَهُ فِي الْآخِرَةِ مِنْ خَلَاقٍ وَلَبِئْسَ مَا شَرَوْا بِهِ أَنْفُسَهُمْ لَوْ كَانُوا يَعْلَمُونَThey followed what the evil ones gave out (falsely) against the power of Solomon: the blasphemers Were, not Solomon, but the evil ones, teaching men Magic, and such things as came down at babylon to the angels Harut and Marut. But neither of these taught anyone (Such things) without saying: "We are only for trial; so do not blaspheme." They learned from them the means to sow discord between man and wife. But they could not thus harm anyone except by Allah's permission. And they learned what harmed them, not what profited them. And they knew that the buyers of (magic) would have no share in the happiness of the Hereafter. And vile was the price for which they did sell their souls, if they but knew!

Surely this must be your leader, who has taught you magic! be sure I will cut off your hands and feet on opposite sides, and I will have you crucified on trunks of palm-trees: so shall ye know for certain, which of us can give the more severe and the more lasting punishment!"
Surat AlImran Ayah 152Surat AlImran0.001989وَلَقَدْ صَدَقَكُمُ اللَّهُ وَعْدَهُ إِذْ تَحُسُّونَهُمْ بِإِذْنِهِ حَتَّى إِذَا فَشِلْتُمْ وَتَنَازَعْتُمْ فِي الْأَمْرِ وَعَصَيْتُمْ مِنْ بَعْدِ مَا أَرَاكُمْ مَا تُحِبُّونَ مِنْكُمْ مَنْ يُرِيدُ الدُّنْيَا وَمِنْكُمْ مَنْ يُرِيدُ الْآخِرَةَ ثُمَّ صَرَفَكُمْ عَنْهُمْ لِيَبْتَلِيَكُمْ وَلَقَدْ عَفَا عَنْكُمْ وَاللَّهُ ذُو فَضْلٍ عَلَى الْمُؤْمِنِينَAllah did indeed fulfil His promise to you when ye with His permission Were about to annihilate your enemy, -until ye flinched and fell to disputing about the order, and disobeyed it after He brought you in sight (of the booty) which ye covet. Among you are some that hanker after this world and some that desire the Hereafter. Then did He divert you from your foes in order to test you but He forgave you: For Allah is full of grace to those who believe.

Ye are one from another: Wed them with the leave of their owners, and give them their dowers, according to what is reasonable: They should be chaste, not lustful, nor taking paramours: when they are taken in wedlock, if they fall into shame, their punishment is half that for free women. This (permission) is for those among you who fear sin; but it is better for you that ye practise self-restraint. And Allah is Oft-forgiving, Most Merciful.

SahihAlBukhari-017-001-1367Narrated Abu Mousa AlAshari: The Prophet ﷺ went out to one of the gardens of Medina for some business and I went out to follow him. When he entered the garden; I sat at its gate and said to myself; To day I will be the gatekeeper of the Prophet though he has not ordered me. The Prophet ﷺ went and finished his need and went to sit on the constructed edge of the well and uncovered his legs and hung them in the well. In the meantime Abu Bakr came and asked permission to enter. I said to him ; Wait till I get you permission. Abu Bakr waited outside and I went to the Prophet ﷺ and said; O Allah Prophet! Abu Bakr asks your permission to enter. He said; Admit him; and give him the glad tidings of entering Paradise. So Abu Bakr entered and sat on the right side of the Prophet ﷺ and uncovered his legs and hung them in the well. Then Umar came and I said to him ; Wait till I get you permission. The Prophet ﷺ said; Admit him and give him the glad tidings of entering Paradise. So Umar entered and sat on the left side of the Prophet and uncovered his legs and hung them in the well so that one side of the well became fully occupied and there remained no place for any-one to sit. Then Uthman came and I said to him ; Wait till I get permission for you. The Prophet ﷺ said; Admit him and give him the glad tidings of entering Paradise with a calamity which will befall him. When he entered; he could not find any place to sit with them so he went to the other edge of the well opposite them and uncovered his legs and hung them in the well. I wished that a brother of mine would come; so I invoked Allah for his coming. Ibn AlMusaiyab said; I interpreted that narration as indicating their graves. SahihAlBukhari-017-001-1419Narrated Abdullah Bin Abbas: Uyaina Bin Housn Bin Hudhaifa Bin Badr came and stayed at Medina with his nephew AlHurr Bin Qais Bin Housn who was one of those whom Umar used to keep near him; as the Qurra learned men knowing Quran by heart were the people of Umar meetings and his advisors whether they were old or young. Uyaina said to his nephew; O my nephew! Have you an approach to this chief so as to get for me the permission to see him? His nephew said; I will get the permission for you to see him. Ibn Abbas added: So he took the permission for Uyaina; and when the latter entered; he said; O the son of AlKhattab! By Allah; you neither give us sufficient provision nor judge among us with justice. On that Umar became so furious that he intended to harm him. AlHurr; said; O Chief of the Believers! Allah said to His Apostle Hold to forgiveness; command what is good right ; and leave the foolish i.e. do not punish them. 7.199 and this person is among the foolish. By Allah; Umar did not overlook that Verse when AlHurr recited it before him; and Umar said to observe the orders of Allah Book strictly. SahihAlBukhari-017-001-1438Narrated Malik Bin Aus AlNasri: I proceeded till I entered upon Umar and while I was sitting there ; his gate-keeper Yarfa came to him and said; Uthman; Abdulrahman AlZubair and Saad ask your permission to come in. Umar allowed them. So they entered; greeted; and sat down. After a while the gatekeeper came and said; Shall I admit Ali and Abbas? Umar allowed them to enter. AlAbbas said O Chief of the believers! Judge between me and the oppressor Ali. Then there was a dispute regarding the property of Bani Nadir between them Abbas and Ali. Uthman and his companions said; O Chief of the Believers! Judge between them and relieve one from the other. Umar said; Be patient! beseech you by Allah; with Whose permission the Heaven and the Earth Exist! Do you know that Allah Messenger ﷺ said; Our property is not to be inherited; and whatever we leave is to be given in charity; and by this Allah Messenger ﷺ meant himself? On that the group said; He verily said so. Umar then faced Ali and Abbas and said; I beseech you both by Allah; do you both know that Allah Messenger ﷺ said so? They both replied; Yes. Umar then said; Now I am talking to you about this matter in detail. Allah favored Allah Messenger ﷺ with some of this wealth which He did not give to anybody else; as Allah said: What Allah bestowed as Fai Booty on His Apostle for which you made no expedition... 59.6 So that property was totally meant for Allah Messenger ﷺ ; yet he did not collect it and ignore you; nor did he withhold it with your exclusion; but he gave it to you and distributed it among you till this much of it was left behind; and the Prophet; used to spend of this as the yearly expenditures of his family and then take what remained of it and spent it as he did with other Allah wealth. The Prophet ﷺ did so during all his lifetime; and I beseech you by Allah; do you know that? They replied; Yes. Umar then addressed Ali and Abbas; saying; I beseech you both by Allah; do you know that? Both of them replied; Yes. Umar added; Then Allah took His Apostle unto Him. Abu Bakr then said I am the successor of Allah Messenger ﷺ and took over all the Prophet property and disposed of it in the same way as Allah Messenger ﷺ used to do; and you were present then. Then he turned to Ali and Abbas and said; You both claim that Abu Bakr did so-and-so in managing the property; but Allah knows that Abu Bakr was honest; righteous; intelligent; and a follower of what is right in managing it. Then Allah took Abu Bakr unto Him; I said: I am the successor of Allah Messenger ﷺ and Abu Bakr. So I took over the property for two years and managed it in the same way as Allah Messenger ﷺ ; and Abu Bakr used to do. Then you both Ali and Abbas came to me and asked for the same thing! O Abbas! You came to me to ask me for your share from nephew property; and this Ali came to me asking for his wives share from her father property; and I said to you both; If you wish; I will place it in your custody on condition that you both will manage it in the same way as Allah Messenger ﷺ and Abu Bakr did and as I have been doing since I took charge of managing it; otherwise; do not speak to me anymore about it. Then you both said; Give it to us on that condition. So I gave it to you on that condition. Now I beseech you by Allah; did I not give it to them on that condition? The group whom he had been addressing replied; Yes. Umar then addressed Abbas and Ali saying; I beseech you both by Allah; didnt I give you all that property on that condition? They said; Yes. Umar then said; Are you now seeking a verdict from me other than that? By Him with Whose Permission the Heaven and the Earth exists I will not give any verdict other than that till the Hour is established; and if you both are unable to manage this property; then you can hand it back to me; and I will be sufficient for it on your behalf. And by that Allah Messenger ﷺ meant himself. The group said; No doubt ; he said so. Umar then faced Ali and Abbas and said; Do you both know that Allah Messenger ﷺ said that? They replied; No doubt ; he said so. Umar said; So let me talk to you about this matter. Allah favored His Apostle with something of this Fai i.e. booty won by the Muslims at war without fighting which He did not give to anybody else; Allah said:- And what Allah gave to His Apostle Fai Booty.........to do all things.... 59.6 And so that property was only for Allah Messenger ﷺ. Yet; by Allah; he neither gathered that property for himself nor withheld it from you; but he gave its income to you; and distributed it among you till there remained the present property out of which the Prophet ﷺ used to spend the yearly maintenance for his family; and whatever used to remain; he used to spend it where Allah property is spent i.e. in charity etc.. Allah Messenger ﷺ followed that throughout his life. Now I beseech you by Allah; do you know all that? They said; Yes. Umar then said to Ali and Abbas; I beseech you by Allah; do you know that? Both of them said; Yes. Umar added; And when the Prophet ﷺ died; Abu Bakr said; I am the successor of Allah Messenger ﷺ ; and took charge of that property and managed it in the same way as Allah Messenger ﷺ did. Then I took charge of this property for two years during which I managed it as Allah Messenger ﷺ and Abu Bakr did. Then you both Ali and Abbas came to talk to me; bearing the same claim and presenting the same case. O Abbas! You came to me asking for your share from the property of your nephew; and this man Ali came to me; asking for the share of h is wife from the property of her father. I said; If you both wish; I will give that to you on that condition i.e. that you would follow the way of the Prophet ﷺ and Abu Bakr and as I Umar have done in man aging it. Now both of you seek of me a verdict other than that? Lo! By Allah; by Whose permission both the heaven and the earth exist; I will not give any verdict other than that till the Hour is established. I beseech you by Allah; by Whose permission both the Heaven and the Earth stand fast ! Do you know that Allah Messenger ﷺ said. We Apostles do not bequeath anything to our heirs; but whatever we leave is to be given in charity. And by that Allah Messenger ﷺ s meant himself? The group said; He did say so. Umar then turned towards All and Abbas and said. I beseech you both by Allah; do you know that Allah Messenger ﷺ said that? They said; Yes Umar said; Now; let me talk to you about this matter. Allah favored His Apostle with something of this property war booty which He did not give to anybody else. And Allah said:- And what Allah has bestowed on His Apostle as Fai Booty from them for which you made no expedition with either cavalry or camelry... Allah is Able to do all things. 59.6 So this property was especially granted to Allah Messenger ﷺ. But by Allah he neither withheld it from you; nor did he keep it for himself and deprive you of it; but he gave it all to you and distributed it among you till only this remained out of it. And out of this property Allah Messenger ﷺ used to provide his family with their yearly needs; and whatever remained; he would spend where Allah Property the revenues of Zakat used to be spent. Allah Messenger ﷺ kept on acting like this throughout his lifetime. Now I beseech you by Allah; do you know that? They said; Yes. Then Umar said to Ali and Abbas; I beseech you by Allah; do you both know that? They said; Yes. Umar added; When Allah had taken His Apostle unto Him; Abu Bakr said; I am the successor of Allah Messenger ﷺ. So he took charge of that property and did with it the same what Allah Messenger ﷺ used to do; and both of you knew all about it then. Then Umar turned towards Ali and Abbas and said; You both claim that Abu Bakr was so-and-so! But Allah knows that he was honest; sincere; pious and right in that matter. Then Allah caused Abu Bakr to die; and I said; I am the successor of Allah Messenger ﷺ and Abu Bakr. So I kept this property in my possession for the first two years of my rule; and I used to do the same with it as Allah Messenger ﷺ and Abu Bakr used to do. Later both of you Ali and Abbas came to me with the same claim and the same problem. O Abbas! You came to me demanding your share from the inheritance of the son of your brother; and he Ali came to me demanding his wives share from the inheritance of her father. So I said to you; If you wish I will hand over this property to you; on condition that you both promise me before Allah that you will manage it in the same way as Allah Messenger ﷺ and Abu Bakr did; and as I have done since the beginning of my rule; otherwise you should not speak to me about it. So you both said; Hand over this property to us on this condition. And on this condition I handed it over to you. I beseech you by Allah; did I hand it over to them on that condition? The group said; Yes. Umar then faced Ali and Abbas and said; I beseech you both by Allah; did I hand it over to you both on that condition? They both said; Yes. Umar added; Do you want me now to give a decision other than that? By Him with Whose permission order both the Heaven and the Earth stand fast; I will never give any decision other than that till the Hour is established! SahihAlBukhari-017-001-327Narrated Amr Bin Maimun AlAudi: I saw Umar Bin AlKhattab when he was stabbed saying; O Abdullah Bin Umar! Go to the mother of the believers Aisha and say; Umar Bin AlKhattab sends his greetings to you; and request her to allow me to be buried with my companions. So; Ibn Umar conveyed the message to Aisha. She said; I had the idea of having this place for myself but today I prefer him Umar to myself and allow him to be buried there. When Abdullah Bin Umar returned; Umar asked him; What news do you have? He replied; O chief of the believers! She has allowed you to be buried there. On that Umar said; Nothing was more important to me than to be buried in that sacred place. So; when I expire; carry me there and pay my greetings to her Aisha and say; Umar Bin AlKhattab asks permission; and if she gives permission; then bury me there and if she does not; then take me to the graveyard of the Muslims. I do not think any person has more right for the caliphate than those with whom Allah Messenger ﷺ ﷺ was always pleased till his death. And whoever is chosen by the people after me will be the caliph; and you people must listen to him and obey him; and then he mentioned the name of Uthman; Ali; Talha ; AlZubair; Abdulrahman Bin Auf and Saad Bin Abi Waqqas. By this time a young man from Ansar came and said; O chief of the believers! Be happy with Allah glad tidings. The grade which you have in Islam is known to you; then you became the caliph and you ruled with justice and then you have been awarded martyrdom after all this. Umar replied; O son of my brother! Would that all that privileges will counterbalance my short comings ; so that I neither lose nor gain anything. I recommend my successor to be good to the early emigrants and realize their rights and to protect their honor and sacred things. And I also recommend him to be good to the Ansar who before them; had homes in Medina and had adopted the Faith. He should accept the good of the righteous among them and should excuse their wrongdoers. SahihAlBukhari-017-001-3383Narrated Amr Bin Maimun: I saw Umar Bin AlKhattab a few days before he was stabbed in Medina. He was standing with Hudhaifa Bin AlYaman and Uthman Bin Hunaif to whom he said; What have you done? Do you think that you have imposed more taxation on the land of AlSwad i.e. Iraq than it can bear? They replied; We have imposed on it what it can bear because of its great yield. Umar again said; Check whether you have imposed on the land what it can not bear. They said; No; we havent. Umar added; If Allah should keep me alive I will let the widows of Iraq need no men to support them after me. But only four days had elapsed when he was stabbed to death. The day he was stabbed; I was standing and there was nobody between me and him i.e. Umar except Abdullah Bin Abbas. Whenever Umar passed between the two rows; he would say; Stand in straight lines. When he saw no defect in the rows ; he would go forward and start the prayer with Takbir. He would recite Surat Yousif or AlNahl or the like in the first raka so that the people may have the time to Join the prayer. As soon as he said Takbir; I heard him saying; The dog has killed or eaten me; at the time he i.e. the murderer stabbed him. A non-Arab infidel proceeded on carrying a double-edged knife and stabbing all the persons he passed by on the right and left till he stabbed thirteen persons out of whom seven died. When one of the Muslims saw that; he threw a cloak on him. Realizing that he had been captured; the non-Arab infidel killed himself; Umar held the hand of Abdulrahman Bin Auf and let him lead the prayer. Those who were standing by the side of Umar saw what I saw; but the people who were in the other parts of the Masjid did not see anything; but they lost the voice of Umar and they were saying; Subhan Allah! Subhan Allah! i.e. Glorified be Allah. Abdulrahman Bin Auf led the people a short prayer. When they finished the prayer; Umar said; O Ibn Abbas! Find out who attacked me. Ibn Abbas kept on looking here and there for a short time and came to say. The slave of AlMughira. On that Umar said; The craftsman? Ibn Abbas said; Yes. Umar said; May Allah curse him. I did not treat him unjustly. All the Praises are for Allah Who has not caused me to die at the hand of a man who claims himself to be a Muslim. No doubt; you and your father Abbas used to love to have more non-Arab infidels in Medina. AlAbbas had the greatest number of slaves. Ibn Abbas said to Umar. If you wish; we will do. He meant; If you wish we will kill them. Umar said; You are mistaken for you cant kill them after they have spoken your language; prayed towards your Qibla; and performed Hajj like yours. Then Umar was carried to his house; and we went along with him; and the people were as if they had never suffered a calamity before. Some said; Do not worry he will be Alright soon. Some said; We are afraid that he will die. Then an infusion of dates was brought to him and he drank it but it came out of the wound of his belly. Then milk was brought to him and he drank it; and it also came out of his belly. The people realized that he would die. We went to him; and the people came; praising him. A young man came saying; O chief of the believers! Receive the glad tidings from Allah to you due to your company with Allah Messenger ﷺ and your superiority in Islam which you know. Then you became the ruler i.e. Caliph and you ruled with justice and finally you have been martyred. Umar said; I wish that all these privileges will counterbalance my shortcomings so that I will neither lose nor gain anything. When the young man turned back to leave; his clothes seemed to be touching the ground. Umar said; Call the young man back to me. When he came back Umar said; O son of my brother! Lift your clothes; for this will keep your clothes clean and save you from the Punishment of your Lord. Umar further said; O Abdullah Bin Umar! See how much I am in debt to others. When the debt was checked; it amounted to approximately eighty-six thousand. Umar said; If the property of Umar family covers the debt; then pay the debt thereof; otherwise request it from Bani Adi Bin Kaab and if that too is not sufficient; ask for it from Quraish tribe; and do not ask for it from any one else; and pay this debt on my behalf. Umar then said to Abdullah ; Go to Aisha the mother of the believers and say: Umar is paying his salutation to you. But dont say: The chief of the believers; because today I am not the chief of the believers. And say: Umar Bin AlKhattab asks the permission to be buried with his two companions i.e. the Prophet; and Abu Bakr. Abdullah greeted Aisha and asked for the permission for entering; and then entered to her and found her sitting and weeping. He said to her; Umar Bin AlKhattab is paying his salutations to you; and asks the permission to be buried with his two companions. She said; I had the idea of having this place for myself; but today I prefer Umar to myself. When he returned it was said to Umar ; Abdullah Bin Umar has come. Umar said; Make me sit up. Somebody supported him against his body and Umar asked Abdullah ; What news do you have? He said; O chief of the believers! It is as you wish. She has given the permission. Umar said; Praise be to Allah; there was nothing more important to me than this. So when I die; take me; and greet Aisha and say: Umar Bin AlKhattab asks the permission to be buried with the Prophet ﷺ ; and if she gives the permission; bury me there; and if she refuses; then take me to the grave-yard of the Muslims. Then Hafsa the mother of the believers came with many other women walking with her. When we saw her; we went away. She went in to Umar and wept there for sometime. When the men asked for permission to enter; she went into another place; and we heard her weeping inside. The people said to Umar ; O chief of the believers! Appoint a successor. Umar said; I do not find anyone more suitable for the job than the following persons or group whom Allah Messenger ﷺ had been pleased with before he died. Then Umar mentioned Ali; Uthman; AlZubair; Talha ; Saad and Abdulrahman bin Auf and said; Abdullah Bin Umar will be a witness to you; but he will have no share in the rule. His being a witness will compensate him for not sharing the right of ruling. If Saad becomes the ruler; it will be alright: otherwise; whoever becomes the ruler should seek his help; as I have not dismissed him because of disability or dishonesty. Umar added; I recommend that my successor takes care of the early emigrants; to know their rights and protect their honor and sacred things. I also recommend that he be kind to the Ansar who had lived in Medina before the emigrants and Belief had entered their hearts before them. I recommend that the ruler should accept the good of the righteous among them and excuse their wrong-doers; and I recommend that he should do good to all the people of the towns AlAnsar ; as they are the protectors of Islam and the source of wealth and the source of annoyance to the enemy. I also recommend that nothing be taken from them except from their surplus with their consent. I also recommend that he do good to the Arab bedouin; as they are the origin of the Arabs and the material of Islam. He should take from what is inferior; amongst their properties and distribute that to the poor amongst them. I also recommend him concerning Allah and His Apostle protectees i.e. Dhimmis to fulfill their contracts and to fight for them and not to overburden them with what is beyond their ability. So when Umar expired; we carried him out and set out walking. Abdullah Bin Umar greeted Aisha and said; Umar Bin AlKhattab asks for the permission. Aisha said; Bring him in. He was brought in and buried beside his two companions. When he was buried; the group recommended by Umar held a meeting. Then Abdulrahman said; Reduce the candidates for rulership to three of you. AlZubair said; I give up my right to Ali. Talha said; I give up my right to Uthman; Sad; I give up my right to Abdulrahman Bin Auf. Abdulrahman then said to Uthman and Ali ; Now which of you is willing to give up his right of candidacy to that he may choose the better of the remaining two; bearing in mind that Allah and Islam will be his witnesses. So both the sheiks i.e. Uthman and Ali kept silent. Abdulrahman said; Will you both leave this matter to me; and I take Allah as my Witness that I will not choose but the better of you? They said; Yes. So Abdulrahman took the hand of one of them i.e. Ali and said; You are related to Allah Messenger ﷺ and one of the earliest Muslims as you know well. So I ask you by Allah to promise that if I select you as a ruler you will do justice; and if I select Uthman as a ruler you will listen to him and obey him. Then he took the other i.e. Uthman Aasi de and said the same to him. When Abdulrahman secured their agreement to this covenant; he said; O Uthman! Raise your hand. I felt shy to say him; No as we had no other camel for carrying water; but later on I said: Yes; and to I sold it to him on the condition that I would be permitted to ride it until I reached Madina. I said to him: Allah Messenger; I am newly married; so I asked his permission to go ahead of the caravan. He permitted me; and I reached Medina well in advance of other people; until I reached my destination. There my maternal uncle met me and asked me about the camel; and I told him what I had done with regard to it. He reproved me in this connection. He Jabir said: When I asked his permission to go ahead of the caravan Allah Messenger ﷺ inquired of me whether I had married a virgin or a non-virgin. I said to him: I have married a non-virgin. He said: Why did you not marry a virgin who would have played with you and you would have played with her? I said to him: Allah Messenger; my father died or he fell as a martyr ; and I have small sisters to look after ; so I did not like the idea that I should marry a woman who is like them and thus be not able to teach them manners and look after them properly. So I have married a non-virgin so that she should be able to look after them and teach them manners; When Allah Messenger ﷺ came to Medina; I went to him in the morning with the camel. SahihMuslim-017-001-20364Abu AlSaib; the freed slaved of Hisham Bin Zuhra; said that he visited Abu Saeed Khudri in his house; and he further said: I found him saying his prayer; so I sat down waiting for him to finish his prayer when I heard a stir in the bundles of wood lying in a comer of the house. I looked towards it and found a snake. I jumped up in order to kill it; but he Abu Saeed Khudri made a gesture that I should sit down. So I sat down and as he finished the prayer he pointed to a room in the house and said: Do you see this room? I said: Yes. He said: There was a young man amongst us who had been newly wedded. We went with Allah Messenger ﷺ to participate in the Battle of Trench when a young man in the midday used to seek permission from Allah Messenger ﷺ to return to his family. One day he sought permission from him and Allah Messenger ﷺ after granting him the permission said to him: Carry your weapons with you for I fear the tribe of Quraidha may harm you. The man carried the weapons and then came back and found his wife standing between the two doors. He bent towards her smitten by jealousy and made a dash towards her with a spear in order to stab her. She said: Keep your spear away and enter the house until you see that which has made me come out. He entered and found a big snake coiled on the bedding. He darted with the spear and pierced it and then went out having fixed it in the house; but the snake quivered and attacked him and no one knew which of them died first; the snake or the young man. We came to Allah Apostle ﷺ and made a mention to him and said: Supplicate to Allah that that man may be brought back to life. Aisha further reported: The wives of Allah Apostle ﷺ then sent Zainab Bin Jahsh; the wife of Allah Apostle ﷺ ; and she was one who was somewhat equal in rank with me in the eyes of Allah Messenger ﷺ and I have never seen a woman more advanced in religious piety than Zainab; more God-conscious; more truthful; more alive to the ties of blood; more generous and having more sense of self-sacrifice in practical life and having more charitable disposition and thus more close to God; the Exalted; than her. She; however; lost temper very soon but was soon calm. Allah Messenger ﷺ permitted her to enter as she Aisha was along with Allah Messenger ﷺ in her mantle; in the same very state when Fatima had entered. She said: Allah Messenger; your wives have sent me to you seeking equity in case of the daughter of Abu Quhafa. She then came to me and showed harshness to me and I was seeing the eyes of Allah Messenger ﷺ whether he would permit me. Zainab went on until I came to know that Allah Messenger ﷺ would not disapprove if I retorted. Then I exchanged hot words until I made her quiet. SahihMuslim-017-001-20792Kharasha Bin Hurr reported: I was sitting in a circle in the Masjid of Medina and there was an old man; quite handsome. He was Abdullah Bin Salim. He was telling good things to them to the people sitting in that company. As he stood up to depart the people said: He who is desirous of looking at a person from amongst the people of Paradise should see him. I said: By Allah; I will follow him; and would try to know his residence. So I followed him and he walked on until he reached the outskirts of Medina. He then entered his house. I sought permission from him to get in; and he granted me the permission; saying: My nephew; what is the need that has brought you here ? I said to him: As you stood up; I heard people say about you: He who is desirous of seeing a person from among the people of Paradise should look at him. So I became desirous of accompanying you. The story is that while I was asleep one night there came to me a person in the dream who asked me to stand up. So I stood up and he caught hold of my hand and I walked along with him; and; lo; I found some paths on my left and I was about to set out upon them. Thereupon he said to me Do not set yourself on them for these are the paths of the leftists denizens of Hell-fire. Then there were paths leading to the right side; whereupon he said: Set yourself on these paths. We came across a hill and he said to me: Climb up; and I attempted to climb up that I fell upon my buttocks. I made several attempts but failed to succeed. He led until he came to a pillar so high that its upper end touched the sky and its base was in the earth. And there was a handhold at its upper end. He said to me Climb over it. I said: How can I climb upon it; as its upper end touches the sky? He cought hold of my hand and pushed me up and I found myself suspended with the handhold. He then struck the pillar and it fell down; but I remained attached to that handhold until it was morning and the dream was thus over. I came to Allah Apostle ﷺ and narrated it to him. He said: So far as the paths which you saw on your left are concerned; these are paths of the leftists denizens of Hell and the paths which you saw on your right; these are the paths of the rightists the dwellers of Paradise and the mountain represents the destination of the martyrs which you would not be able to attain. SunanAlNasai-017-001-13178It was narrated that Jabir said: I went on a campaign with the Messenger of Allah riding a camel of ours; then he quoted the whole Hadih. Then he said words to the effect that: The camel got tried and the Prophet hit it; so it became energetic and came to the front of the army. The Prophet said: O Jabir; I see that your camel has become energetic. I said: It is because of your blessing; O Messenger of Allah; He said: Sell it to me; and you can ride it till we arrive in AlMadinah. So I sold it to him. I was in great need of it myself but I felt too shy to refuse. When we finished our campaign; and we were close to AlMadinah; I asked his permission to go on ahead. I said: O Messenger of Allah; I am newly married. He said; Have you married a virgin or a previously married woman? I said: A previously married woman; O Messenger of Allah. Abdullah Bin Arm died and left behind young druthers; and I did not like to bring to them someone who was like them; so I married a previously married woman who could teach the; and rise them with good manners. So he gave me permission; and said to me; Go to When I arrived; I told my maternal uncle that I had sold the camel and he scolded me. SunanAlNasai-017-001-13888Aisha said: The wives of the Prophet sent Fatimah; the daughter of the Messenger of Allah; to the Messenger of Allah. She asked permission to enter when he was lying with me under my cover. He gave her permission to enter; and she said: O Messenger of Allah; your wives have sent me to you to ask you to be equitable with regard to the matter of the daughter of Abu Quhafah. I Aisha kept quiet and the Messenger of Allah said to her: O my daughter! Do you not love the one whom I love? She said: Yes. He said: Then love this one. Fatimah stood up when she heard this and left the Messenger of Allah; and went back to the wives of the Prophet. She told them what she had said; and what he had said to her. Fatimah said: No; by Allah; I will never speak to him about her again. Aisha said: So the wives of the Prophet sent Zainab bint Jahsh to the Messenger of Allah; she was one who was somewhat equal to me in rank in the eyes of the Messenger of Allah. And I have never seen a woman who was better in religious commitment than Zainab; more fearing of Allah; more honest in speech; more dutiful in upholding the ties of kinship; more generous in giving charity; and devoted in giving of herself in acts of charity; by means of which she sought to draw closer to Allah. But she was quick-tempered; however; she was also quick to calm down. She asked permission to enter upon the Messenger of Allah when he was with Aisha under her cover; in the same situation as when Fatimah had entered. The Messenger of Allah gave her permission to enter and she said: O Messenger of Allah; your wives have sent me to ask you to be equitable with regard to the matter of the daughter of Abu Quhafah. Then she verbally abused me at length; and I was watching the Messenger of Allah to see if he would allow me to respond. Zainab went on until I realized that the Messenger of Allah would not disapprove if I responded. Then I spoke back to her in such a way; until I silenced her. SunanAbuDawoud-017-001-25129Ubaid Allah said Marwan sent someone Qabisah to Fatimah and asked her about the case. She said that she was the wife of Abu Hafs. The Prophet ﷺ appointed Ali as governor in a certain part of Yemen. Her husband also proceeded with him. From there he sent a message to her pronouncing one divorce that had yet remained. He commanded Ayash Bin Abi Rabiah and AlHarith Bin Hisham to provide maintenance to her. They said By Allah there is no sustenance for her except in case she is pregnant. She came to the Prophet ﷺ who said There is no sustenance for you except in case you are pregnant. She then asked permission to shift from her house and he gave her permission. She asked Where should I shift. Apostle of Allaah ﷺ ? The Apostle of Allaah ﷺ said to Ibn Umm Maktum. He was blind. She would undress herself and he could not see her. She lived there till her waiting period passed. The Prophet ﷺ married her to Usamah. Qabisah then returned to Marwan and narrated that to him. Marwan said We did not hear this tradition except from a woman; so we shall follow the reliable practice on which we found the people. When this reached Fatimah she said between me and you is the Book of Allah. Allaah the exalted said Divorce them for their waiting period... Thou knowest not it may be that Allaah will afterward bring some new thing to pass. She said What a new thing will emerge after triple divorce.Abu Dawud said A similar tradition has been narrated by Yunus on the authority of AlZuhri. The word of Allah; Most High; reads: O ye who believe! Let those whom your right hands possess; and the children among you; who have not come of age; ask your permission before they enter your presence on three occasions: before morning prayer; while you are undressing for the noonday heat; and after late-night prayer. Sometimes a servant; a child or a female orphan of a man entered while the man was having sexual intercourse with his wife. So Allah commanded them to ask permission in those times of undress. Then Allah brought them curtains and all good things. He then pointed to a room in his house in front of his room and said : My cousin son of my uncle was in this room. He asked his permission to go to his wife on the occasion of the battle of Troops Ahzab ; as he was recently married. The Messenger of Allah ﷺ gave him permission and ordered him to take his weapon with him. He came to his house and found his wife standing at the door of the house. When he pointed to her with the lance; she said; do not make haste till you see what has brought me out. He entered the house and found an ugly snake there. He pierced in the lance while it was quivering. He said : I do not know which of them died first; the man or the snake. His people then came to the Messenger of Allah ﷺ and said: supplicate Allah to restore our companion to life for us. He said : Ask forgiveness for your Companion. When he was finished he pointed to a room in the house and said; Do you see this room? I said; Yes. He said; There was a young boy in it who had just got married. He went out with the Messenger of Allah; may Allah bless him and grant him peace; to AlKhandaq; the ditch which the muslims dug in the 5th year of the Hijra to defend Madina against the Quraysh and their allies. When he was there; the youth came and asked his permission; saying; Messenger of Allah. Give me permission to return to my family. The Messenger of Allah; may Allah bless him and grant him peace; gave him permission and said; Take your weapons with you; for I fear the Banu Quraydha tribe. They may harm you. The youth went to his family and found his wife standing between the two doors. He lifted his spear to stab her as jealousy had been aroused in him. She said; Dont be hasty until you go in and see what is in your house. He entered and found a snake coiled up on his bed. He transfixed it with his spear and then went out with it and pitched it into the house. The snake stirred on the end of the spear and the youth fell dead. No one knew which of them died first; the snake or the youth. That was mentioned to the Messenger of Allah; may Allah bless him and grant him peace; and he said; There are jinn in Madina who have become muslim. When you see one of them; call out to it for three days. I recognised hunger in it; so; do you have anything? She replied; Yes; and brought out some barley loaves. She took her long head scarf and wrapped up the bread with part of it and put it into my Anass hand and gave me part of it to wear. Then she sent me to the Messenger of Allah; may Allah bless him and grant him peace. Anas continued; I took it; and I found the Messenger of Allah; may Allah bless him and grant him peace; sitting in the Masjid with some people. I watched them. The Messenger of Allah; may Allah bless him and grant him peace; said; Did Abu Talha send you? I replied; Yes. He said; For food? I said; Yes. The Messenger of Allah; may Allah bless him and grant him peace; said to those with him; Let us go. He set off and I went among them until I came to Abu Talha and told him. MuwataMalik-017-001-34813Malik said; The generally agreed-on way of doing things among us in the case of slave whose master makes a bequest to free part of him - a third; a fourth; a half; or any share after his death; is that only the portion of him is freed that his master has named. This is because the freeing of that portion is only obliged to take place after the death of the master because the master has the option to withdraw the bequest as long as he lives. When the slave is freed from his master; the master is a testator and the testator only has access to free what he can take from his property; being the third of the property he is allowed to bequeath; and the rest of the slave is not free because the man property has gone out of his hands. How can the rest of the slave which belongs to other people be free when they did not initiate the setting free and did not confirm it and they do not have the wala established for them? Only the deceased could do that. He was the one who freed him and the one for whom the wala was confirmed. That is not to be borne by another property unless he bequeaths within the third of his property what remains of a lave to be freed. That is a request against his partners and inheritors and the partners must not refuse the slave that when it is within the third of the dead man property because there is no harm in that to the inheritors. Malik said; If a man frees a third of his slave while he is critically ill; he must complete the emancipation so all of him is free from him; if it is within the third of his property that he has access to; because he is not treated in the same way as a man who frees a third of a slave after his death; because had the one who freed a third of his slave after his death lived; he could have cancelled it and the slave being set free would be of no effect. The master who made the freeing of the third of the slave irrevocable in his illness; would still have to free all of him if he lived. If he died; the slave would be set free within the third of the bequest. MuwataMalik-017-001-34890Yahya said that he heard Malik say; This ayat is abrogated. It is the word of Allah; the Blessed; the Exalted; If he leaves goods; the testament is for parents and kinsmen. What came down about the division of the fixed shares of inheritance in the Book of Allah; the Mighty; the Exalted; abrogated it. Yahya said that he heard Malik say; The established sunna with us; in which there is no dispute; is that it is not permitted for a testator to make a bequest in addition to the fixed share in favour of an heir; unless the other heirs permit him. If some of them permit him and others refuse; he is allowed to diminish the share of those who have given their permission. Those who refuse take their full share from the inheritance. Yahya said that he heard Malik speak about an invalid who made a bequest and asked his heirs to give him permission to make a bequest when he was so ill that he only had command of a third of his property; and they gave him permission to leave some of his heirs more than his third. Malik said; They cannot revoke that. Had they been permitted to do so; every heir would have done that; and then; when the testator died; they would take that for themselves and prevent him from bequeathing his third and what was permitted to him with respect to his property. Malik said; If he asks permission of his heirs to grant a bequest to an heir while he is well and they give him permission; that is not binding on them. The heirs can rescind that if they wish. That is because when a man is well; he is entitled to all his property and can do what he wishes with it. If he wishes; he can spend all of it. He can spend it and give sadaqa with it or give it to whomever he likes. His asking permission of his heirs is permitted for the heirs; when they give him permission when authority over all his property is closed off from him and nothing outside of the third is permitted to him; and when they are more entitled to the two-thirds of his property than he is himself. That is when their permission becomes relevant. If he asks one of the heirs to give his inheritance to him when he is dying; and the heir agrees and then the dying man does not dispose of it at all; it is returned to the one who gave it unless the deceased said to him; So-and-so - one of his heirs - is weak; and I would like you to give him your inheritance. So he gives it to him. That is permitted when the deceased specified it for him. Malik said; When a man gives the dying man free use of his share of the inheritance; and the dying man distributes some of it and some remains; it is returned to the giver; after the man has died. Yahya said that he heard Malik speak about someone who made a bequest and mentioned that he had given one of his heirs something which he had not taken possession of; so the heirs refused to permit that. He must pay its price on the day it was consumed; and giving the value is more equitable in compensation for animals and goods. Yahya said that he heard Malik say about someone who consumes some food without the permission of its owner; He returns to the owner a like weight of the same kind of food. Food is in the position of gold and silver. Gold and silver are returned with gold and silver. The animal is not in the position of gold in that. What distinguishes between them is the sunna and the behaviour which is in force. MuwataMalik-017-001-34980Malik spoke to me about a man who wrote a kitaba for his slave for gold or silver and stipulated against him in his kitaba a journey; service; sacrifice or similar; which he specified by its name; and then the mukatab was able to pay all his instalments before the end of the term. He said; If he pays all his instalments and he is set free and his inviolability as a free man is complete; but he still has this condition to fulfil; the condition is examined; and whatever involves his person in it; like service or a journey etc.; is removed from him and his master has nothing in it. Whatever there is of sacrifice; clothing; or anything that he must pay; that is in the position of dinars and dirhams; and is valued and he pays it along with his instalments; and he is not free until he has paid that along with his instalments. Malik said; The generally agreed-on way of doing things among us about which there is no dispute; is that a mukatab is in the same position as a slave whom his master will free after a service of ten years. If the master who will free him dies before ten years; what remains of his service goes to his heirs and his wala goes to the one who contracted to free him and to his male children or paternal relations. Malik spoke about a man who stipulated against his mukatab that he could not travel; marry; or leave his land without his permission; and that if he did so without his permission it was in his power to cancel the kitaba. He said; If the mukatab does any of these things it is not in the man power to cancel the kitaba. Let the master put that before the Sultan. The mukatab; however; should not marry; travel; or leave the land of his master without his permission; whether or not he stipulates that. That is because the man may write a kitaba for his slave for 100 dinars and the slave may have 1000 dinars or more than that. He goes off and marries a woman and pays her bride-price which sweeps away his money and then he cannot pay. He reverts to his master as a slave who has no property. Or else he may travel and his instalments fall due while he is away. He cannot do that and kitaba is not to be based on that. That is in the hand of his master. If his master does not give him permission; he separates them. The muhallil is separated in any case if he intends to make the woman halal by marriage. Malik said; When a slave is owned by his wife or a husband owns his wife; the possession of each of them is rendered void without divorce. If a man; for instance; is married to a slave-girl; and then he buys her; he must divorce her as a matter of course. They can then re- marry. If they re-marry afterwards; that separation was not divorce. Then the man said; What are the spoils which He; the Blessed; the Exalted; mentioned in His Book? He kept on asking until Ibn Abbas was on the verge of being annoyed; then Ibn Abbas said; Do you know who this man is like? Ibn Sabigh; who was beaten by Umar Ibn AlKhattab because he was notorious for asking foolish questions. Yahya said that Malik was asked whether someone who killed one of the enemy could keep the man effects without the permission of the Imam. He said; No one can do that without the permission of the Imam. Only the Imam can make ijtihad.
