The eldest! meaning; Let the eldest of you speak. So Huwaiyisa spoke first and then Muhaiyisa. Allah Messenger ﷺ said; The Jews should either pay the blood money of your deceased companion or be ready for war. After that Allah Messenger ﷺ wrote a letter to the Jews in that respect; and they wrote that they had not killed him. Then Allah Messenger ﷺ said to Huwaiyisa; Muhaiyisa and Abdulrahman Can you take an oath by which you will be entitled to take the blood money? They said; No. He said to them ; Shall we ask the Jews to take an oath before you? They replied; But the Jews are not Muslims. So Allah Apostle gave them one-hundred camels as blood money from himself. Muhayisa came and informed that Abdutlah Bin Sahl had been killed; and his dead body had been thrown in a well or in a ditch. He came to the Jews and said: By Allah; it is you who have killed him. They said: By Allah; we have not killed him. He then came to his people; and made mention of that to them. Then came he and his brother Huwayisa; and he was older than he; and Abdulrahman Bin Sahl. Then Muhayisa went to speak; and it was he who had accompanied Abdullah to Khaibar; whereupon Allah Messenger ﷺ said to Muhayisa: Observe greatness of the great he meant the seniority of age. Then Huwayisa spoke and then Muhayisa also spoke. Thereupon Allah Messenger ﷺ said: They should either pay blood-wit for your companion; or be prepared for war. Allah Messenger ﷺ wrote about it to them to the Jews. They wrote: Verily; by Allah; we have not killed him. Thereupon Allah Messenger ﷺ said to Huwayisa and Muhayisa and Abdulrahman Are you prepared to take oath in order to entitle yourselves for the blood-wit of your companion? They said: No. He the Holy Prophet said: Then the Jews will take oath of their innocence. They said: They are not Muslims. This is what Muhammad; the Messenger of Allah; has settled with the Meccans ; The polytheists said to him: If we knew that thou art the Messenger of of Allah; we would follow you. But write: Muhammad Bin Abdullah. So he told Ali to strike out these words. Ali said: No; by Allah; I will not strike them out. The Messenger of Allah ﷺ said: Show me their place on the parchment. So he Ali showed him their place and he the Holy Prophet struck them out; and Ali wrote: Ibn Abdullah. According to the terms of the treaty; next year the Prophet ﷺ stayed there for three days When it was the third day; they said to Ali: This is the last day according to the terms of your companion. So tell him to leave. Ali informed the Prophet ﷺ accordingly. He said: Yes; and left the city. Najda wrote to him saying after praising the Almighty and invoking blessings on the Prophet : Tell me whether the Messenger of Allah ﷺ took women to participate with him in Jihad; if he did ; whether he allotted them a regular share from the booty; whether he killed the children of the enemy in the war ; how long an orphan would be entitled to consideration as such; and for whom the Khums fifth part of the booty was booty. Ibn Abbas wrote to him: You have written asking me whether the Messenger of Allah ﷺ took women with him to participate in Jihad. He did take them to the battle and sometimes he fought along with them. They would treat the wounded and were given a reward from the booty; but he did not assign any regular share for them. And the Messenger of Allah ﷺ did not kill the children of the enemy; so you should not kill the children. Also you have written to me asking me when the orphanhood of an orphan comes to an end. By my life; if a man has become bearded but is still incapable of getting his due from others or fulfilling his obligation towards them; he is yet an orphan to be treated as such ; but when he can look after his interests like grown-up people; he is no longer an orphan. And you have written to me inquiring about Khums as to whom it is meant for. SahihMuslim-017-001-18152It has been narrated on the anthority of Yazid Bin Hurmuz who said: Najda wrote to Ibn Abbas. I was sitting in the company of Ibn Abbas when he read his letter and wrote its reply. Ibn Abbas said: Were it not for preventing him from falling into wickedness. I would not have replied to his letter; may he never be joyful. He wrote in reply to him referring to the share of the close relatives of the Holy Prophet from the booty whom God has mentioned. I have to tell you that we thought we were the close relatives of the Messenger of Allah ﷺ ; but our people have refused to recognise us as such. You have asked about the orphan as to when his orphanhood comes to an end. I have to say that when he reaches the age of marriage; attains maturity of mind; and his property is returned to him; then he is no longer an orphan. You have inquired whether the Messenger of Allah may peace be upo him used to kill anyone from the children of the polytheists in the war. You should know that the Messenger of Allah ﷺ used not to kill any one of their children; and you too should not kill any one of them; except when you knew about them what Khadir had known about the boy whom he killed. And you have inquired whether there is a fixed share of the booty for women and slaves when they participate in a battle. And much time had not elapsed that she gave birth to a child after his death and when she was free from the effects of childbirth she embellished herself for those who had to give proposals of marriage. Abd AlSunabil Bin Bakak from Banu Abd AlDar came to her and said: What is this that I see you embellished; perhaps you are inclined to marry; By Allah; you cannot marry unless four months and ten days of Idda are passed. When he said that. I dressed myself; and as it was evening I came to Allah Messenger ﷺ and asked him about it; and he gave me a religious verdict that I was allowed to marry when I had given birth to a child and asked me to marry if I so liked. For if people were to be given what they claimed was theirs; then people would make claims against the wealth and blood of others. Then Marwan wrote saying that to me Usaid. I wrote to Marwan saying that the Prophet had ruled that if the one who bought it from the one who stole it is ot guilty of anything and did not realize that it was stolen goods ; then the owner has the choice: If he wishes; he may buy it from the one who bought it from the thief; or if he wishes he may go after the thief. She gave birth soon after he died; and when her Nifas ended she adorned herself to receive proposals of marriage. Perhaps you want to get married; but by Allah you will not get married until four months and ten days have passed. So; Umar Bin Abdullah wrote in reply to Abdullah Bin Utbah informing him what she told him. She told that she was under i.e.; the wife of Sad Bin Khawlah who belonged to Banu Amir Bin Luway. He was one of those who participated in the battle of Badr. He died at the Farwell Pilgrimage while she was pregnant. Soon after his death she gave birth to a child. When she was purified from her bleeding after child birth she adorned herself for seekers in marriage. Then Abu AlSanabil Bin Bakah a man from Banu Abd AlDar entered upon her and said to her What is the matter seeing you adorned; perhaps you are seeking marriage? I swear by Allah you cannot marry until four months and ten days pass away. Saubaiah said When she said this to me; I gathered my clothes on me when the evening came and I came to the Apostle of Allaah ﷺ and asked him about that. He told me that I became lawful when I had delivered a child. He suggested me to marry if I wished. When Umar Ibn AlKhattab succeeded; Sufyan Ibn Wahb wrote to Umar asking him about this wood. SunanAbuDawoud-017-001-25738Sahl Bin Abi Hathmah and some senior men of the tribe told that Abdullah Bin Abi Sahl and Muhayasah came to Khaibar on account of the calamity i.e. famine that befall them. Muhayasah came and told the Abdullah Bin Sahl had been killed and thrown in a well or stream. He hen came to the Jews and said: I swear by Allah; you have killed him. They said: We swear by Allah; we have not killed him. He then proceeded and came to his tribe and mentioned this to them. Then he; his brother Huwayasah; who was older to him; and Abdulrahman Bin Sahl came forward to the Prophet. Muhayasah began to speak. It was he who was at Khaibar. The Messenger of Allah ﷺ then said to him: Let the eldest speak ; let the eldest speak ; meaning age. So Huwayasah spoke; and after him Muhayasah spoke. The Messenger of Allah ﷺ then said: They should either pay the bloodwit for you friend or they should be prepared for war. So the Messenger of Allah ﷺ wrote to them about it. They wrote in reply : We swear by Allah; we have not killed him. The Messenger of Allah ﷺ then said to Huwayasah; Muhayasah and Abdulrahman Will you take an oath and thus have the claim to the blood of your friend ? They said: No. He the Prophet said: The Jews will then take an oath. They said: They are not Muslims. Then the Messenger of Allah ﷺ himself paid the bloodwit. The Messenger of Allah ﷺ then sent on one hundred camels and they were entered in their house. He wrote to him: To begin with; I enjoin upon you to fear Allah; to be moderate in obeying His Command; to follow the sunnah practice of His Prophet ﷺ and to abandon the novelties which the innovators introduced after his Sunnah has been established and they were saved from its trouble i.e. novelty or innovation ; so stick to Sunnah; for it is for you; if Allah chooses; a protection ; then you should know that any innovation which the people introduced was refuted long before it on the basis of some authority or there was some lesson in it; for the Sunnah was introduced by the people who were conscious of the error; slip; foolishness; and extremism in case of the sunnah was opposed. So accept for yourself what the people in the past had accepted for themselves; for they had complete knowledge of whatever they were informed; and by penetrating insight they forbade to do prohibited acts ; they had more strength than us to disclose the matters of religion ; and they were far better than us by virtue of their merits. If right guidance is what you are following; then you outstriped them to it. And if you say whatever the novelty occurred after them was introduced by those who followed the way other then theirs and disliked them. It is they who actually outstripped; and talked about it sufficiently; and gave a satisfactory explanation for it. Below them there is no place for exhaustiveness; and above them there is no place for elaborating things. Some people shortened the matter more than they had done; and thus they turned away from them ; and some people raised the matter more than they had done; and thus they exaggerated. They were on right guidance between that. You have written to me asking about confession of Divine decree; you have indeed approached a person who is well informed of it; with the will of Allah. I know what whatever novelty people have brought in; and whatever innovation people have introduced are not more manifest and more established than confession of Divine decree. The ignorant people i.e. the Arabs before Islam in pre-Islamic times have mentioned it ; they talked about it in their speeches and in their poetry. They would console themselves for what they lost; and Islam then strengthened it i.e. belief in Divine decree. The Messenger of Allah ﷺ did not mention it in one or two traditions; but the Muslims heard it from him; and they talked of it from him; and they talked of it during his lifetime and after his death. They did so out of belief and submission to their Lord and thinking themselves weak. There is nothing which is not surrounded by His knowledge; and not counted by His register and not destined by His decree. Despite that; it has been strongly mentioned in His Book: from it they have derived it; and from it they have and so ? they also read in it what you read; and they knew its interpretation of which you are ignorant. After that they said: All this is by writing and decreeing. Distress has been written down; and what has been destined will occur ; what Allah wills will surely happen; and what He does not will will not happen. We have no power to harm or benefit ourselves. SunanAbuDawoud-017-001-29261Narrated Mujjaah Ibn Mirarah AlYamani: Mujjaah went to the Prophet ﷺ asking him for the blood-money of his brother whom Banu Sadus from Banu Dhuhl had killed. The Prophet ﷺ said: Had I appointed blood-money for a polytheist; I should have appointed it for your brother. But I shall give you compensation for him. So the Prophet ﷺ wrote a document for him that he should be given a hundred camels which were to be acquired from the fifth taken from the polytheists of Banu Dhuhl. So he took a part of them; for Banu Dhuhl embraced Islam. He then asked Abu Bakr for them later on; and brought to him the document of the Prophet ﷺ. So Abu Bakr wrote for him that he should be given one thousand two hundred sa from the sadaqah of AlYamamah; four thousand sas of wheat; four thousand sas of barley; and four thousand sas of dates. The text of the document written by the Prophet ﷺ for Mujjaah was as follows: In the name of Allah; the Beneficent; the Merciful. This document is from Muhammad; the Prophet; to Mujjaah Ibn Mirarah of Banu Sulma. SunanAbuDawoud-017-001-29275Narrated A man from the companions of the Prophet: Abdulrahman Ibn Kaab Ibn Malik reported on the authority of a man from among the companions of the Prophet ﷺ : The infidels of the Quraysh wrote a letter to Ibn Ubay and to those who worshipped idols from alaous and AlKhazraj; while the Messenger of Allah ﷺ was at that time at Medina before the battle of Badr. They wrote : You gave protection to our companion. We swear by Allah; you should fight him or expel him; or we shall come to you in full force; until we kill your fighters and appropriate your women. When this news reached Abdullah Ibn Ubay and those who were worshippers of idols; with him they gathered together to fight the Messenger of Allah ﷺ. When this news reached the Messenger of Allah ﷺ ; he visited them and said: The threat of the Quraysh to you has reached its end. They cannot contrive a plot against you; greater than what you yourselves intended to harm you. Are you willing to fight your sons and brethren? When they heard this from the Prophet ﷺ ; they scattered. This reached the infidels of the Quraysh. The infidels of the Quraysh again wrote a letter to the Jews after the battle of Badr: You are men of weapons and fortresses. You should fight our companion or we shall deal with you in a certain way. And nothing will come between us and the anklets of your women. When their letter reached the Prophet ﷺ ; they gathered Banu AlNadir to violate the treaty. They sent a message to the Prophet ﷺ : Come out to us with thirty men from your companions; and thirty rabbis will come out from us till we meet at a central place where they will hear you. If they testify to you and believe in you; we shall believe in you. The narrator then narrated the whole story. When the next day came; the Messenger of Allah ﷺ went out in the morning with an army; and surrounded them. He told them: I swear by Allah; you will have no peace from me until you conclude a treaty with me. But they refused to conclude a treaty with him. He therefore fought them the same day. Next he attacked Banu Quraysh with an army in the morning; and left Banu AlNadir. He asked them to sign a treaty and they signed it. He turned away from them and attacked Banu AlNadir with an army. He fought with them until they agreed to expulsion. Banu AlNadir were deported; and they took with them whatever their camels could carry; that is; their property; the doors of their houses; and their wood. Palm-trees were exclusively reserved for the Messenger of Allah ﷺ. Allah bestowed them upon him and gave them him as a special portion. He Allah ; the Exalted; said: What Allah has bestowed on His Apostle and taken away from them; for this ye made no expedition with either camel corps or cavalry. He said: Without fighting. So the Prophet ﷺ gave most of it to the emigrants and divided it among them; and he divided some of it between two men from the helpers; who were needy; and he did not divide it among any of the helpers except those two. MuwataMalik-017-001-34741Yahya related to me from Malik from Abu Layla Ibn Abdullah Ibn Abdulrahman Ibn Sahl from Sahl Ibn Abi Hathma that some of the great men of his people informed him that Abdullah Ibn Sahl and Muhayisa went out to Khaybar because extreme poverty had overtaken them. Muhayisa returned and said that Abdullah Ibn Sahl had been killed and thrown in a shallow well or spring. The jews came and he said; By Allah! You have killed him. They said; By Allah! We have not killed him! Then he made for his people and mentioned that to them. Then he; his brother Huwayisa; who was older than him; and Abdulrahman set out. Muhayisa began to speak; as he had been at Khaybar. The Messenger of Allah; may Allah bless him and grant him peace; said to him; The greater first; the greater first; meaning in age. So Huwayisa spoke and then Muhayisa spoke. The Messenger of Allah; may Allah bless him and grant him peace; said; Either they pay your companion blood-money or we will declare war against them. The Messenger of Allah; may Allah bless him and grant him peace; wrote that to them and they wrote; By Allah; we did not kill him! The Messenger of Allah; may Allah bless him and grant him peace; said to Huwayisa; Muhayisa; and Abdulrahman Do you swear and claim the blood of your companion? They said; No. He said; Shall the jews swear to you? They said; But they are not muslims. MuwataMalik-017-001-34785Malik related to me from Zurayq Ibn Hakim AlAyli that a man called Misbah asked his son for help and he thought him unnecessarily slow. When the son came; his father said to him; O fornicator. Zurayq said; So the son asked me to help him against the father. When I wanted to flog him; his son said; By Allah; if you flog him; I will acknowledge that I have committed fornication. When he said that; the situation was confused for me; so I wrote about it to Umar Ibn Abd AlAziz who was the governor at that time; and I mentioned it to him. Umar wrote me to permit his pardon. Zurayq said; I wrote to Umar Ibn Abd AlAziz also; What do you think about a man who is slandered or his parents are slandered and both or only one of them are dead? He said; Umar wrote to me; If he forgives; his pardon is permitted for himself. If his parents are slandered and one or both of them are dead; take the judgement of the Book of Allah for it unless he wants to veil it. Yahya said; I heard Malik say; That is because the slandered man might fear that if that is unveiled about him; a clear proof might be established. MuwataMalik-017-001-34795Yahya related to me from Malik that Zurayq Ibn Hakim informed him that he had a runaway slave who had stolen. He said; The situation was obscure for me; so I wrote to Umar Ibn Abd AlAziz to ask him about it. He was the governor at that time. I informed him that I had heard that if a runaway slave stole while he was a fugitive; his hand was not cut off. Umar Ibn Abd AlAziz wrote to contradict my letter; You wrote to me that you have heard that when the runaway slave steals; his hand is not cut off. Allah; the Blessed; the Exalted; says in His Book; The thief; male and female; cut off the hands of both; as a recompense for what they have earned; and an exemplary punishment from Allah. Allah is Mighty; Wise. Surat 5 ayat 41 When his theft reaches a quarter of a dinar; and upwards; his hand is cut off. Yahya related to me from Malik that he had heard that AlQasim Ibn Muhammad and Salim Ibn Abdullah and Urwa Ibn AlZubair said; When a runaway slave steals something for which cutting off the hand is obliged; his hand is cut off. Muawiya wrote to him; Tie him up and do not inflict any retaliation on him. There is no retaliation against a madman. Malik said about an adult and a child when they murder a man together; The adult is killed and the child pays half the full blood-money. Malik said; It is like that with a freeman and a slave when they murder a slave. Man deeds make him holy. I have heard that you were put up as a doctor to treat and cure people. If you are innocent; then may you have delight! If you are a quack; then beware lest you kill a man and enter the Fire! When Abud-Darda judged between two men; and they turned from him to go; he would look at them and say; Come back to me; and tell me your story again. A quack! By Allah! Yahya said that he heard Malik say; If someone makes use of a slave; without permission of its master; in anything important to him; whose like has a fee; he is liable for what befalls the slave if anything befalls him. If the slave is safe and his master asks for his wage for what he has done; that is the master right. This is what is done in our community. Yahya said that he heard Malik say about a slave who is part free and part enslaved; His property is suspended in his hand and he cannot begin anything with it. He eats from it and clothes himself in an approved fashion. If he dies; his property belongs to the one to whom he is in slavery. MuwataMalik-017-001-34976Malik said; The best of what is said about a man who buys the mukatab of a man is that if the man wrote the slave kitaba for dinars or dirhams; he does not sell him unless it is for merchandise which is paid immediately and not deferred; because if it is deferred; it would be a debt for a debt. A debt for a debt is forbidden. He said; If the master gives a mukatab his kitaba for certain merchandise of camels; cattle; sheep; or slaves; it is more correct that the buyer buy him for gold; silver; or different goods than the ones his master wrote the kitaba for; and that must be paid immediately; not deferred. Malik said; The best of what I have heard about a mukatab when he is sold is that he is more entitled to buy his kitaba than the one who buys him if he can pay his master the price for which he was sold in cash. That is because his buying himself is his freedom; and freedom has priority over what bequests accompany it. If one of those who have written the kitaba for the mukatab sells his portion of him; so that a half; a third; a fourth; or whatever share of the mukatab is sold; the mukatab does not have the right of pre-emption in what is sold of him. That is because it is like the severance of a partner; and a partner can only make a settlement for a partner of the one who is mukatab with the permission of his partners because what is sold of him does not give him complete rights as a free man and his property is barred from him; and by buying part of himself; it is feared that he will become incapable of completing payment because of what he had to spend. That is not like the mukatab buying himself completely unless whoever has some of the kitaba remaining due to him gives him permission. If they give him permission; he is more entitled to what is sold of him. Malik said; Selling one of the instalments of a mukatab is not halal. That is because it Is an uncertain transaction. If the mukatab cannot pay it; what he owes is nullified. If he dies or goes bankrupt and he owes debts to people; then the person who bought his instalment does not take any of his portion with the creditors. The person who buys one of the instalments of the mukatab is in the position of the master of the mukatab. The master of the mukatab does not have a share with the creditors of the mukatab for what he is owed of the kitaba of his slave. It is also like that with the kharaj; a set amount deducted daily from the slave against his earnings ; which accumulates for a master from the earnings of his slave. The creditors of his slave do not allow him a share for what has accumulated for him from those deductions. Malik said; There is no harm in a mukatab paying off his kitaba with coin or merchandise other than the merchandise for which he wrote his kitaba if it is identical with it; on time for the instalment or delayed. Malik said that if a mukatab died and left an umm walad and small children by her or by someone else and they could not work and it was feared that they would be unable to fulfil their kitaba; the umm walad of the father was sold if her price would pay all the kitaba for them; whether or not she was their mother. They were paid for and set free because their father did not forbid her sale if he feared that he would be unable to complete his kitaba. If her price would not pay for them and neither she nor they could work; they all reverted to being slaves of the master. Malik said; What is done among us in the case of a person who buys the kitaba of a mukatab; and then the mukatab dies before he has paid his kitaba; is that the person who bought the kitaba inherits from him. If; rather than dying; the mukatab cannot pay; the buyer has his person. I was present with two khalifs before you who gave the grandfather a half with one sibling; and a third with two. Then he wrote to Umar Ibn AlKhattab and he also refused. Again they talked to him and again he wrote to Umar; and Umar wrote back to him saying; If they want; take it from them and then give it back to them and give their slaves provision.
