When ye do divorce women, divorce them at their prescribed periods, and count (accurately), their prescribed periods: And fear Allah your Lord: and turn them not out of their houses, nor shall they (themselves) leave, except in case they are guilty of some open lewdness, those are limits set by Allah: and any who transgresses the limits of Allah, does verily wrong his (own) soul: thou knowest not if perchance Allah will bring about thereafter some new situation. | |

Enter not the Prophet's houses, - until leave is given you, - for a meal, (and then) not (so early as) to wait for its preparation: but when ye are invited, enter; and when ye have taken your meal, disperse, without seeking familiar talk. Such (behaviour) annoys the Prophet: he is ashamed to dismiss you, but Allah is not ashamed (to tell you) the truth. And when ye ask (his ladies) for anything ye want, ask them from before a screen: that makes for greater purity for your hearts and for theirs. Nor is it right for you that ye should annoy Allah's Messenger, or that ye should marry his widows after him at any time. Truly such a thing is in Allah's sight an enormity. | |

Violate not the sanctity of the symbols of Allah, nor of the sacred month, nor of the animals brought for sacrifice, nor the garlands that mark out such animals, nor the people resorting to the sacred house, seeking of the bounty and good pleasure of their Lord. But when ye are clear of the sacred precincts and of pilgrim garb, ye may hunt and let not the hatred of some people in (once) shutting you out of the Sacred Mosque lead you to transgression (and hostility on your part). Help ye one another in righteousness and piety, but help ye not one another in sin and rancour: fear Allah: for Allah is strict in punishment. | |

But if ye enter houses, salute each other - a greeting of blessing and purity as from Allah. Thus does Allah make clear the signs to you: that ye may understand. | |

SahihAlBukhari-017-001-089 | Narrated Mahmud Bin AlRabi AlAnsari: that he remembered Allah Messenger ﷺ and he also remembered a mouthful of water which he had thrown on his face; after taking it from a well that was in their house. Mahmud said that he had heard Itban Bin Malik; who was present with Allah Messenger ﷺ in the battle of Badr saying; I used to lead my people at Bani Salim in the prayer and there was a valley between me and those people. Whenever it rained it used to be difficult for me to cross it to go to their Masjid. So I went to Allah Messenger ﷺ and said; I have weak eyesight and the valley between me and my people flows during the rainy season and it becomes difficult for me to cross it; I wish you would come to my house and pray at a place so that I could take that place as a praying place. Allah Messenger ﷺ said; I will do so. So Allah Messenger ﷺ and Abu Bakr came to my house in the next morning after the sun had risen high. Allah Messenger ﷺ asked my permission to let him in and I admitted him. He did not sit before saying; Where do you want us to offer the prayer in your house? I pointed to the place where I wanted him to pray. So Allah Messenger ﷺ stood up for the prayer and started the prayer with Takbir and we aligned in rows behind him; and he offered two rakat; and finished them with Taslim; and we also performed Taslim with him. I detained him for a meal called KhaZirr which I had prepared for him.- KhaZirr is a special type of dish prepared from barley flour and meat soup - When the neighbors got the news that Allah Messenger ﷺ was in my house; they poured it till there were a great number of men in the house. One of them said; What is wrong with Malik; for I do not see him? One of them replied; He is a hypocrite and does not love Allah and His Apostle. On that Allah Apostle said; Dont say this. Havent you seen that he said; None has the right to be worshipped but Allah for Allah sake only. The man replied; Allah and His Apostle know better; but by Allah; we never saw him but helping and talking with the hypocrites. Allah Messenger ﷺ replied; No doubt; whoever says. None has the right to be worshipped but Allah; and by that he wants the pleasures of Allah; then Allah will save him from Hell. Mahmud added; I told the above narration to some people; one of whom was Abu Ayoub ; the companion of Allah Messenger ﷺ in the battle in which he Abu Ayoub died and Yazid Bin Muawiya was their leader in Roman Territory. Abu Ayoub denounced the narration and said; I doubt that Allah Messenger ﷺ ever said what you have said. I felt that too much; and I vowed to Allah that if I remained alive in that holy battle; I would go to Medina and ask Itban Bin Malik if he was still living in the Masjid of his people. So when he returned; I assumed Ihram for Hajj or Umra and then I proceeded on till I reached Medina. I went to Bani Salim and Itban Bin Malik; who was by then an old blind man; was leading his people in the prayer. When he finished the prayer; I greeted him and introduced myself to him and then asked him about that narration. SahihAlBukhari-017-001-1293 | Narrated Abu Humaid AlSaidi: The Prophet ﷺ employed Ibn AlUtbiya to collect Zakat from Bani Sulaim; and when he returned with the money to Allah Messenger ﷺ the Prophet ﷺ called him to account; and he said; This amount is for you; and this was given to me as a present. Allah Messenger ﷺ said; Why dont you stay at your father house or your mother house to see whether you will be given gifts or not; if you are telling the truth? Then Allah Messenger ﷺ stood up and addressed the people; and after glorifying and praising Allah; he said: Amma Badu then after I employ some men from among you for some job which Allah has placed in my charge; and then one of you comes to me and says; This amount is for you and this is a gift given to me. SahihAlBukhari-017-001-1415 | Narrated Jabir Bin Abdullah: Some angels came to the Prophet ﷺ while he was sleeping. Some of them said; He is sleeping. Others said; His eyes are sleeping but his heart is awake. Then they said; There is an example for this companion of yours. One of them said; Then set forth an example for him. Some of them said; He is sleeping. The others said; His eyes are sleeping but his heart is awake. Then they said; His example is that of a man who has built a house and then offered therein a banquet and sent an inviter messenger to invite the people. So whoever accepted the invitation of the inviter; entered the house and ate of the banquet; and whoever did not accept the invitation of the inviter; did not enter the house; nor did he eat of the banquet. SahihAlBukhari-017-001-2001 | Narrated Abu Rafi: The Prophet ﷺ said; The neighbor has more right to be taken care of by his neighbor than anyone else. Some men said; If one wants to buy a house for 20;000 Dirhams then there is no harm to play a trick to deprive somebody of preemption by buying it just on paper with 20;000 Dirhams but paying to the seller only 9;999 Dirhams in cash and then agree with the seller to pay only one Dinar in cash for the rest of the price i.e. 10;001 Dirhams. If the preemptor offers 20;000 Dirhams for the house; he can buy it otherwise he has no right to buy it by this trick he got out of preemption. If the house proves to belong to somebody else other than the seller; the buyer should take back from the seller what he has paid; i.e.; 9;999 Dirhams and one Dinar; because if the house proves to belong to somebody else; so the whole bargain deal is unlawful. If the buyer finds a defect in the house and it does not belong to somebody other than the seller; the buyer may return it and receive 20;000 Dirhams instead of 9999 Dirham plus one Dinar which he actually paid. SahihAlBukhari-017-001-2043 | Narrated Abu Humaid AlSaidi: Allah Messenger ﷺ employed an employee to collect Zakat. The employee returned after completing his job and said; O Allah Messenger ﷺ ! This amount of Zakat is for you; and this other amount was given to me as a present. The Prophet ﷺ said to him; Why didnt you stay at your father or mother house and see if you would be given presents or not? Then Allah Messenger ﷺ got up in the evening after the prayer; and having testified that none has the right to be worshipped but Allah and praised and glorified Allah as He deserved; he said; Now then ! SahihAlBukhari-017-001-2656 | Narrated Abdulrahman Bin Abu Bakr: Abu Bakr invited a group of people and told me; Look after your guests. Abu Bakr added; I am going to visit the Prophet ﷺ and you should finish serving them before I return. Abdulrahman said; So I went at once and served them with what was available at that time in the house and requested them to eat. They said; Where is the owner of the house i.e.; Abu Bakr ? Abdulrahman said; Take your meal. They said; We will not eat till the owner of the house comes. Abdulrahman said; Accept your meal from us; for if my father comes and finds you not having taken your meal yet; we will be blamed severely by him; but they refused to take their meals. So I was sure that my father would be angry with me. When he came; I went away to hide myself from him. He asked; What have you done about the guests ? They informed him the whole story. Abu Bakr called; O Abdulrahman I kept quiet. He then called again. O Abdulrahman I kept quiet and he called again; O ignorant boy ! I beseech you by Allah; if you hear my voice; then come out! I came out and said; Please ask your guests and do not be angry with me. They said; He has told the truth; he brought the meal to us. He said; As you have been waiting for me; by Allah; I will not eat of it tonight. They said; By Allah; we will not eat of it till you eat of it. He said; I have never seen a night like this night in evil. What is wrong with you? Why dont you accept your meals of hospitality from us? He said to me ; Bring your meal. By God; any one of you will not take anything from the public funds without any justification; but will meet his Lord carrying it on himself on the Day of judgment. SahihMuslim-017-001-18086 | It has been narrated by Abdullah Bin Rabah from Abu Huraira; who said: Many deputations came to Muawiya. This was in the month of Ramadan. We would prepare food for one another. Abu Huraira was one of those who frequently invited us to his house. I said: Should I not prepare food and invite them to my place? So I ordered meals to be prepared Then I met Abu Huraira in the evening and said: You will have your meals with me tonight. He said: You have forestalled me. I said: Yes; and invited them. When they had finished with the meals Abu Huraira said: Should I not tell yon a tradition from your traditions; O ye assembly of the Ansar? He then gave an account of the Conquest of Mecca and said: The Messenger of Allah ﷺ advanced until he reached Mecca. He deputed AlZubair on his right flank and Khalid on the left; and he despatched Abu Ubaida with the force that had no armour. They advanced to the interior of the valley. The Messenger of Allah ﷺ was in the midst of a large contingent of fighters. He saw me and said: Abu Huraira. I said: I am here at your call; Messenger of Allah I He said: Let no one come to me except the Ansar; so call to me the Ansar only. Abu Huraira continued: So they gathered round him. The Quraish also gathered their ruffians and their lowly followers; and said: We send these forward. If they get anything; we shall be with them to share it ; and if misfortune befalls them; we shall pay as compensation whatever we are asked for. The Messenger of Allah ﷺ said to the Ansar : You see the ruffians and the lowly followers of the Quraish. And he indicated by striking one of his hands over the other that they should be killed and said: Meet me at AlSafa. Then we went on and if any one of us wanted that a certain person should be killed; he was killed; and none could offer any resistance. Abu Huraira continued: Then came Abu Sufyan and said: Messenger of Allah; the blood of the Quraish has become very cheap. There will be no Quraish from this day on. Then he the Holy Prophet said: Who enters the house of Abu Sufyan; he will be safe. Some of the Ansar whispered among themselves: After all ; love for his city and tenderness towards his relations have overpowered him. Abu Huraira said: At this moment revelation came to the Prophet ﷺ and when he was going to receive the Revelation; we understood it; and when he was actually receiving it; none of us would dare raise his eyes to the Messenger of Allah ﷺ until the revelation came to an end. When the revelation came to an end; the Messenger of Allah ﷺ said: O ye Assembly of the Ansar! They said: Here we are at your disposal; Messenger of Allah. He said: You were saying that love for his city and tenderness towards his people have overpowered this man. They said: So it was. He said: No; never. I am a bondman of God and His Messenger. I migrated towards God and towards you. I will live with you and will die with you. So; they the Ansar turned towards him in tears and they were saying: By Allah; we said what we said because of our tenacious attachment to Allah and His Messenger. The Messenger of Allah ﷺ said: Surely; Allah and His Messenger testify to your assertions and accept your apology. The narrator continued: People turned to the house of Abu Sufyan and people locked their doors. The Messenger of Allah ﷺ proceeded until he approached the Black Stone. He kissed it and circumambulated the Kaba. He reached near an idol by the side of the Kaba which was worshipped by the people. The Messenger of Allah ﷺ had a bow in his hand; and he was holding it from a corner. When he came near the idol; he began to pierce its eyes with the bow and while doing so was saying: Truth has been established and falsehood has perished. SahihMuslim-017-001-19253 | Amir Bin Sharahil Shabi Shab Hamdan reported that he asked Fatima; daughter of Qais and sister of AlDahhak Bin Qais and she was the first amongst the emigrant women: Narrate to me a hadith which you had heard directly from Allah Messenger ﷺ and there is no extra link in between them. She said: Very well; if you like; I am prepared to do that; and he said to her: Well; do It and narrate that to me. She said: I married the son of Mughira and he was a chosen young man of Quraish at that time; but he fell as a martyr in the first Jihad fighting on the side of Allah Messenger ﷺ. When I became a widow; Abdulrahman Bin Auf; one amongst the group of the Companions of Allah Messenger ﷺ ; sent me the proposal of marriage. Allah Messenger ﷺ also sent me such a message for his freed slave Usama Bin Zaid. And it had been conveyed to me that Allah Messenger ﷺ had said about Usama : He who loves me should also love Usama. When Allah Messenger ﷺ talked to me about this matter ; I said: My affairs are in your hand. You may marry me to anyone whom you like. He said: You better shift now to the house of Umm Sharik; and Umm Sharik was a rich lady from amongst the Ansar. She spent generously for the cause of Allah and entertained guests very hospitably. I said: Well; I will do as you like. He said: Do not do that for Umm Sharik is a woman who is very frequently visited by guests and I do not like that your head may be uncovered or the cloth may be removed from your shank and the strangers may catch sight of them which you abhor. You better shift to the house of your cousin Abdullah Bin Amr Bin Umm Maktum and he is a person of the Bani Fihr branch of the Quraish; and he belonged to that tribe to which Fatima belonged. So I shifted to that house; and when my period of waiting was over; I heard the voice of an announcer making an announcement that the prayer would be observed in the Masjid where congregational prayer is observed. So I set out towards that Masjid and observed prayer along with Allah Messenger ﷺ and I was in the row of the women which was near the row of men. When Allah Messenger ﷺ had finished his prayer; he sat on the pulpit smiling and said: Every worshipper should keep sitting at his place. He then said: Do you know why I had asked you to assemble? They said: Allah and His Messenger know best. He said: By Allah. I have not made you assemble for exhortation or for a warning; but I have detained you here; for Tamim Dari; a Christian; who came and accepted Islam; told me something; which agrees with what I was telling; you about the Dajjal. He narrated to me that he had sailed in a ship along with thirty men of Bani Lakhm and Bani Judham and had been tossed by waves in the ocean for a month. Then these waves took them near the land within the ocean island at the time of sunset. They sat in a small side-boat and entered that island. There was a beast with long thick hair and because of these they could not distinguish his face from his back. They said: Woe to you; who can you be? Thereupon it said: I am AlJassasa. They said: What is AlJassasa? And it said: O people; go to this person in the monastery as he is very much eager to know about you. He the narrator said: When it named a person for us we were afraid of it lest it should be a devil. Then we hurriedly went on till we came to that monastery and found a well-built person there with his hands tied to his neck and having iron shackles between his two legs up to the ankles. We said: Woe be upon thee; who are you? And he said: You would soon come to know about me. but tell me who are you. We said: We are people from Arabia and we embarked upon a boat but the sea-waves had been driving us for one month and they brought as near this island. We got Into the side-boats and entered this island and here a beast met us with profusely thick hair and because of the thickness of his hair his face could not be distinguished from his back. We said: Woe be to thee; who are you? It said: I am AlJassasa. We said: What is AlJassasa? And it said: You go to this very person in the monastery for he is eagerly waiting for you to know about you. So we came to you in hot haste fearing that that might be the Devil. He that chained person said: Tell me about the date-palm trees of Baisan. We said: About what aspect of theirs do you seek information? He said: I ask you whether these trees bear fruit or not. We said: yes. Thereupon he said: I think these would not bear fruits. He said: Inform me about the lake of Tabariya? We said: Which aspect of it do you want to know? He said: Is there water in it? They said: There is abundance of water in it. Thereupon he said: I think it would soon become dry. He again said: Inform me about the spring of Zughar. They said: Which aspect of it you want to know? He the chained person said: Is there water in it and does it irrigate the land ? We said to him: Yes; there is abundance of water in it and the inhabitants of Medina irrigate land with the help of it; He said: Inform me about the unlettered Prophet; what has he done? We said: He has come out from Mecca and has settled In Yathrib Medina. He said: Do the Arabs fight against him? We said: Yes. He said: How did he deal with them? We informed him that he had overcome those in his neighbourhood and they had submitted themselves before him. Thereupon he said to us: Has it actually happened? We said: Yes. Thereupon he said: If it is so that is better for them that they should show obedience to him. I am going to tell you about myself and I am Dajjal and would be soon permitted to get out and so I shall get out and travel in the land; and will not spare any town where I would not stay for forty nights except Mecca and Medina as these two places are prohibited areas for me and I would not make an attempt to enter any one of these two. An angel with a sword in his hand would confront me and would bar my way and there would be angels to guard every passage leading to it; then Allah Messenger ﷺ striking the pulpit with the help of the end of his staff said: This implies Taiba meaning Medina. Have I not; told you an account of the Dajjal like this? The people said: Yes; and this account narrated by Tamim Dari was liked by me for it corroborates the account which I gave to you in regard to him Dajjal at Medina and Mecca. Behold he Dajjal is in the Syrian sea Mediterranean or the Yemen sea Arabian sea. Nay; on the contrary; he is in the east; he is in the east; he is in the east; and he pointed with his hand towards the east. SahihMuslim-017-001-19386 | AIsha reported: When I came under discussion what the people had to say about me; Allah Messenger ﷺ stood up for delivering an address and he recited tashahhud I bear witness to the fact that iheie is no god but Allah and praised Allah; lauded Him what He rightly deserves and then said: Coming to the point. Give me an advice about them who have brought false charge about my family. By Allah; I know no evil in the members of my family and the person in connection with whom the false charge is being levelled; I know no evil in him too. And he never entered my house but in my presence and when I was away on a journey; he remained with me even in that. The rest of the hadith is the same but with this change that Allah Messenger ﷺ came to my house and asked my maidservant and she said: By Allah; I know no fault in her but this that she sleeps; and goat comes and eats the kneaded flour. Some of the Companions of the Holy Prophet scolded her and said: State the fact before Allah Messenger ﷺ and they even made a pointed reference to this incident. She said: gallowed be Allah. By Allah; I know about her as does the jeweller know about the pure piece of gold. And when this news reached the person in connection with whom the allegation was made he said: Hallowed be Allah. By Allah; I have never unveiled any woman. Aisha said: He fell as a martyr in the cause of Allah; and there is this addition in this hadith that the people who had brought false allegation amongst them were Mistah and Hamna and Hassan. And so far as the hypocrite Abdullah Bin Ubay is concerned; he was one who tried his best to gather the false news and then gave them the wind. I said to him: My mother sent this to you; and she conveys her Salam; and says: This is a little something from us for you. He said: Put it down. Then he said: Go and invite so-and-so; so-and-so; and so-and-so for me; and whomever you meet. He named some people; and said: I invited those he named; and whomever I met. - He AlJad said: I said to Anas: How many of you were there? He said: Roughly about three-hundred. - He Anas said: The Messenger of Allah ﷺ said to me: O Anas! Bring me the Tawr. He said: They entered until the Suffah a shaded part of the Masjid in AlMadinah and the apartment were full. The Messenger of Allah ﷺ said: Let groups of ten in; and let each person eat what is near him. He said: They ate until they were full. He said: A group exited; and another group entered; until all of them ate. He said: He said to me: O Anas! Remove it. He said: So I took it. I could not tell if there was more when I first put it down; or when I picked it up. He said: Groups of them sat talking in the house of the Messenger of Allah ﷺ ; while the Messenger of Allah ﷺ and his wife sat facing the wall. They began to be burdensome on the Messenger of Allah ﷺ ; so the Messenger of Allah ﷺ went out to greet his women folk; then he returned; they realized that they had overburdened him; so they hastened for the gate and all of them exited. The Messenger of Allah ﷺ came until he lowered the curtain; and entered while I was sitting in the apartment. He did not remain there long before he left me; and these Ayat were revealed. So the Messenger of Allah ﷺ went out to recite them to the people: O you who believe! Do not enter the Prophet house unless permission is given to you for a meal; not to wait for its preparation. But when you are invited; enter; and when you have taken your meals; dispense without sitting for a talk. SunanAlNasai-017-001-12420 | It was narrated that Ibn Abbas said: There were kings after Isa Bin Mariam who altered the Tawrah and the Injil; but there were among them believers who read the Tawrah. It was said to their kings: We have never heard of any slander worse than that of those believers who slander us and recite: And whosoever does not judge by what Allah has revealed; such are the disbelievers. In these Verses; they are criticizing us for our deeds when they recite them. So he called them together and gave them the choice between being put to death; or giving up reading the Tawrah and Injil; except for what had been altered. They said: Why do you want us to change? Leave us alone. Some of them said: Build us a tower and let us go up there; and give us something to lift up our food and drink so we do not have to mix with you. Others said: Let us go and wander throughout the land; and we will drink as the wild animals drink; and if you capture us in your land; you may kill us. Others said: Build houses for us in the wilderness; and we will dig wells and grow vegetables; and we will not mix with you or pass by you; for there is no one of the tribes among whom we do not have close relatives. So they did that; and Allah revealed the words: But the monasticism which they invented for themselves; We did not prescribe for them; but they sought it only to please Allah therewith; but that they did not observe it with the right observance. Then others said: We will worship as so-and-so worshipped; and we will wander as so-and-so wandered; and we will adopt houses in the wilderness as so-and-so did. But they were still following their Shirk with no knowledge of the faith of those whom they claimed to be following. Marwan heard of that and he sent word to the daughter of Saeed; telling her to go back to her home; and asking her why she had moved from her home before her Iddah was over? She sent word to him telling him that her maternal aunt had told her to do that. Fatimah bint Qais said that she had been married to Abu Amr Bin Hafs; and when the Messenger of Allah appointed Ali Bin Abi Talib as governor of Yemen; he went out with him and sent word to her that she was divorced with the third Talaq. He told AlHarith Bin Hisham and Ayash Bin Abi Raiah to spend on her. She sent word to AlHarith and Ayash asking them what her husband had told them to spend on her; and they said: By Allah; she has no right to any maintenance from us; unless she is pregnant; and she cannot come into our home without our permission. She said that she came to the Messenger of Allah and told him about that; and he stated that they were correct. Fatimah said: Where should I move to; O Messenger of Allah? He said: Move to the home of Ibn Umm Maktum; the blind man whom Allah; the Mighty and Sublime; named in His Book. Fatimah said: So I observed my Iddah there. SunanAbuDawoud-017-001-24690 | Narrated Aisha; Ummul Muminin: Zurarah Ibn Awuf a said that Aisha was asked about the midnight prayer of the Messenger of Allah ﷺ. She said: He used to offer his night prayer in congregation and then return to his family in his house and pray four rakahs. Then he would go to his bed and sleep; but the water for his ablution was placed covered near his head and his tooth-stick was also kept there until Allah awakened him at night. He then used the tooth-stick; performed ablution perfectly then came to the place of prayer and would pray eight rakahs; in which he would recite Surah AlFatihah; and a surah from the Quran as Allah willed. He would not sit during any of them but sit after the eighth rakah; and would not utter the salutation; but recite the Quran during the ninth rakah. Then he would sit and supplicate as long as Allah willed; and beg Him and devote his attention to Him; He would utter the salutation once in such a loud voice that the inmates of the house were almost awakened by his loud salutation. He would then recite Surah AlFatihah while sitting; bow while sitting; and then recite the Quran during the second rakah; and would bow and prostrate while sitting. He would supplicate Allah as long as He willed; then utter the salutation and turn away. This amount of prayer of the Messenger of Allah ﷺ continued till he put a weight. Some of the people had brought sacrificial animals and others had not; so when the Apostle of Allaah ﷺ came to Makkah ; he said to the people. Those of you who have brought sacrificial animals must not treat as lawful anything which has become unlawful for you till you complete your Hajj; but those of you who have not brought sacrificial animals should go round the House Kabah and run between AlSafa and AlMarwah; clip their hair; put off ihram; and afterwards raise their voice in talbiyah for Hajj and bring sacrificial animals. Those who cannot get sacrificial animals should fast three days during Hajj and seven days when they return to their families. I sat to wait for him until he finished the prayer. I heard a movement under a bed in his room; and it was a snake. I stood up to kill it; and Abu Said gestured to me to sit. When he was finished he pointed to a room in the house and said; Do you see this room? I said; Yes. He said; There was a young boy in it who had just got married. He went out with the Messenger of Allah; may Allah bless him and grant him peace; to AlKhandaq; the ditch which the muslims dug in the 5th year of the Hijra to defend Madina against the Quraysh and their allies. When he was there; the youth came and asked his permission; saying; Messenger of Allah. Give me permission to return to my family. The Messenger of Allah; may Allah bless him and grant him peace; gave him permission and said; Take your weapons with you; for I fear the Banu Quraydha tribe. They may harm you. The youth went to his family and found his wife standing between the two doors. He lifted his spear to stab her as jealousy had been aroused in him. She said; Dont be hasty until you go in and see what is in your house. He entered and found a snake coiled up on his bed. He transfixed it with his spear and then went out with it and pitched it into the house. The snake stirred on the end of the spear and the youth fell dead. No one knew which of them died first; the snake or the youth. That was mentioned to the Messenger of Allah; may Allah bless him and grant him peace; and he said; There are jinn in Madina who have become muslim. When you see one of them; call out to it for three days. He saw that he had some nabidh with him and he was at that moment on the way to Makka. Aslam said to him; Umar Ibn AlKhattab loves this drink. Abdullah Ibn Ayash therefore carried a great drinking bowl and brought it to Umar Ibn AlKhattab and placed it before him. Umar brought it near to him and then raised his head. Umar said; This drink is good; so he drank some of it and then passed it to a man on his right. Yahya said that he heard Malik say; What is done among us about a person who steals the goods of people which are placed under guard in the markets; and their owners put them in their containers and store them together is that if anyone steals any of that from where it is kept; and its value reaches that for which cutting off the hand is obliged; his hand must be cut off; whether or not the owner of the goods is with his goods and whether it is night or day. Malik said about some one who stole something for which cutting off the hand was obliged and then what he stole was found with him and he returned it to its owner; His hand is cut off. Malik said; If someon says; How can his hand be cut off when the goods have been taken from him and returned to their owner?; it is because he is in the same position as the wine drinker when the smell of the wine is found on his breath and he is not drunk. He is flogged with the hadd. The hadd is imposed for drinking wine even if it does not make the man intoxicated. That is because he drank it to become intoxicated. It is the same as that with cutting off the hand of the thief for theft when it is taken from him; even if he has not profited from it and it was returned to its owner. When he stole it; he stole it to take it away. Malik said that if some people came to a house and robbed it together; and then they left with a sack or box or a board or basket or the like of that which they carried together; and when they took it out of its guarded place; they carried it together; and the price of what they took reached that for which cutting off the hand was obliged; and that was three dirhams and upwards; each of them had his hand cut off. If each of them takes out something by himself; whoever of them takes out something whose value reaches three dirhams and upwards must have his hand cut off. If any of them takes out something whose value does not reach three dirhams; he does not have his hand cut off. Yahya said that Malik said; What is done among us is that when a man house is locked and he is the only one living in it; cutting off the hand is not obliged against the one who steals something from it until he takes it out of the house completely. That is because all of the house is a place of custody. If someone other than him lives in the house and each of them locks his door; and it is a place of custody for each of them; whoever steals anything from the apartments of that house must have his hand cut off when he leaves the apartment and goes into the main house. He has removed it from its place of custody to another place and he must have his hand cut off. Malik said; What is done in our community about a slave who steals from the property of his master is that if he is not in service and among those trusted in the house and he enters secretly and steals from his master something that for which cutting off the hand is obliged; his hand is not cut off. It is like that with a slave-girl when she steals from her master property. Her hand is not cut off. Malik then spoke about a slave who was not in service and not one of those trusted in the house; and he entered secretly and stole from the property of his master wife that for which cutting off the hand was obliged. He said; His hand is cut off. It is like that with the wife slave-girl when she does not serve her or her husband nor is she trusted in the house and she enters secretly and steals from her mistress property that for which cutting off the hand is obliged. Her hand is not cut off. It is like that with the wife slave-girl who is not in her service and is not trusted in the house and she enters secretly and steals from the property of her mistress husband something for which cutting off the hand is obliged. Her hand is cut off. It is like that with the man who steals from his wife goods or the wife who steals from her husband goods something for which cutting off the hand is obliged. If the thing which one of them steals from his spouse property is in a room other than the room which they both lock for themselves; or it is in a place of custody in a room other than the room which they are in; whichever of them steals something for which cutting off the hand is obliged; their hand should be cut off. Malik spoke about a small child and a foreigner who does not speak clearly. He said; If they are robbed of something from its place of custody or from under a lock; the one who stole it has his hand cut off. If the property is outside of its place of custody or locked room when it is stolen ; the one who robbed them does not have his hand cut off. It is then in the position of sheep stolen from the mountain and uncut fruit hanging on the trees Malik said; What is done among us about a person who robs graves is that if what he takes from the grave reaches what cutting off the hand is obliged for; his hand is cut off. That is because the grave is a place of custody for what is in it just as houses are a place of custody for what is in them. MuwataMalik-017-001-34988 | Malik related to me that he heard the like of that from Sulayman Ibn Yasar. Malik spoke about a man who bought out one of the partners in a shared property; by paying the man with an animal; a slave; a slave-girl; or the equivalent of that in goods. Then another partner decided to exercise his right of pre-emption after that; and he found that the slave or slave-girl had died; and no one knew what her value had been. The buyer claimed; The value of the slave or slave-girl was 100 dinars. The partner with the right of pre-emption claimed; The value was 50 dinars. Malik said; The buyer takes an oath that the value of what he payed was 100 dinars. Then if the one with the right of pre-emption wishes; he can compensate him; or else he can leave it; unless he can bring a clear proof that the slave or slave-girl value is less than what the buyer said. If someone gives away his portion of a shared house or land and the recipient repays him for it by cash or goods; the partners can take it by pre-emption if they wish and pay off the recipient the value of what he gave in dinars or dirhams. If someone makes a gift of his portion of a shared house or land; and does not take any remuneration and does not seek to; and a partner wants to take it for its value; he cannot do so as long as the original partner has not been given recompense for it. If there is any recompense; the one with the right of pre-emption can have it for the price of the recompense. Malik spoke about a man who bought into a piece of shared land for a price on credit; and one of the partners wanted to possess it by right of pre-emption. Malik said; If it seems likely that the partner can meet the terms; he has right of pre-emption for the same credit terms. If it is feared that he will not be able to meet the terms; but he can bring a wealthy and reliable guarantor of equal standing to the one who bought into the land; he can also take possession. Malik said; A person absence does not sever his right of pre-emption. Even if he is a way for a long time; there is no time limit after which the right of preemption is cut off. Malik said that if a man left land to a number of his children; then one of them who had a child died and the child of the deceased sold his right in that land; the brother of the seller was more entitled to pre-empt him than his paternal uncles; the partners of his father. Malik said; This is what is done in our community. Malik said; Pre- emption is shared between partners according to their existing shares. Each of them takes according to his portion. If it is small; he has little. If it is great; it is according to that. That is if they are tenacious and contend with each other about it. Malik said; As for a man who buys out the share of one of his partners; and one of the other partners says; I will take a portion according to my share; and the first partner says; If you wish to take all the preemption; I will give it up to you. If you wish to leave it; then leave it. If the first partner gives him the choice and hands it over to him; the second partner can only take all the pre-emption or give it back. If he takes it; he is entitled to it. If not; he has nothing. Malik spoke about a man who bought land; and developed it by planting trees or digging a well etc.; and then someone came; and seeing that he had a right in the land; wanted to take possession of it by pre-emption. Malik said He has no right of preemption unless he compensates the other for his expenditure. If he gives him the price of what he has developed; he is entitled to pre- emption. If not; he has no right in it. Malik said that someone who sold off his portion of a shared house or land and then; on learning that some one with a right of pre-emption was to take possession by that right; asked the buyer to revoke the sale; and he did so; did not have the right to do that. The pre-emptor has more right to the property for the price for which he sold it. In the case of some one who bought along with a section of a shared house or land; an animal and goods that were not shared ; so that when any one demanded his right of pre-emption in the house or land he said; Take what I have bought altogether; for I bought it altogether; Malik said; The pre-emptor need only take possession of the house or land. Each thing the man bought is assessed according to its share of the lump sum the man paid. Then the pre-emptor takes possession of his right for a price which is appropriate on that basis. He does not take any animals or goods unless he wants to do that. Malik said; If someone sells a section of shared land; and one of those who have the right of preemption surrenders it to the buyer and another refuses to do other than take his pre-emption; the one who refuses to surrender has to take all the preemption; and he cannot take according to his right and leave what remains. In the case where one of a number of partners in one house sold his share when all his partners were away except for one man; the one present was given the choice of either taking the pre-emption or leaving it; and he said; I will take my portion and leave the portions of my partners until they are present. If they take it; that is that. If they leave it; I will take all the pre-emption; Malik said; He can only take it all or leave it. If his partners come; they can take from him or leave it as they wish. His agent sent her some barley and she was displeased with it; saying; By Allah; I dont expect anything from you. She went to the Messenger of Allah; may Allah bless him and grant him peace; and mentioned it to him. He said; You have no maintenance. He then ordered her to spend her idda in the house of Umm Sharik. Then he said; This is a woman whom my companions visit. Spend the idda in the house of Ibn Umm Maktum. He is a blind man and you can undress at his home. When you are free to remarry; tell me. She continued; When I was free to remarry; I mentioned to him that Muawiya Ibn Abi Sufyan and Abu Jahm Ibn Hisham had asked for me in marriage. She said; I asked the Messenger of Allah; may Allah bless him and grant him peace; if I could return to my people in the Banu Khudra; as my husband had not left me in a dwelling which belonged to him; and had left me no maintenance. MuwataMalik-017-001-35393 | Yahya related to me from Malik that Yahya Ibn Said said; I vowed to walk; but I was struck by a pain in the kidney; so I rode until I came to Makka. I questioned Ata Ibn Abi Rabah and others; and they said; You must sacrifice an animal. When I came to Madina I questioned the ulama there; and they ordered me to walk again from the place from which I was unable to go on. So I walked. Yahya said that he had heard Malik say; What is done among us regarding someone who makes a vow to walk to the House of Allah; and then cannot do it and so rides; is that he must return and walk from the place from which he was unable to go on. If he cannot walk; he should walk what he can and then ride; and he must sacrifice a camel; a cow; or a sheep if that is all that he can find. Malik; when asked about a man who said to another; I will carry you to the House of Allah; answered; If he intended to carry him on his shoulder; by that he meant hardship and exhaustion to himself; and he does not have to do that. Let him walk by foot and make sacrifice. If he did not intend anything; let him do hajj and ride; and take the man on hajj with him. That is because he said; I will carry you to the house of Allah. If the man refuses to do hajj with him; then there is nothing against him; and what is demanded of him is cancelled. Yahya said that Malik was asked whether it was enough for a man who had made a vow that he would walk to the House of Allah a certain large number of times; or who had forbidden himself from talking to his father and brother; if he did not fulfil a certain vow; and he had taken upon himself; by the oath; something which he was incapable of fulfilling in his lifetime; even though he were to try every year; to fulfil only one or a smaller number of vows by Allah? Malik said; The only satisfaction for that that I know is fulfilling what he has obliged himself to do. MuwataMalik-017-001-35563 | Yahya related to me that Malik said; I consider that if a man dies and he has not paid zakat on his property; then zakat is taken from the third of his property from which he can make bequests ; and the third is not exceeded and the zakat is given priority over bequests. In my opinion it is the same as if he had a debt; which is why I think it should be given priority over bequests. Malik continued; This applies if the deceased has asked for the zakat to be deducted. If the deceased has not asked for it to be deducted but his family do so then that is good; but it is not binding upon them if they do not do it. Malik continued; The sunna which we are all agreed upon is that zakat is not due from someone who inherits a debt i.e. wealth that was owed to the deceased ; or goods; or a house; or a male or female slave; until a year has elapsed over the price realised from whatever he sells i.e. slaves or a house; which are not zakatable or over the wealth he inherits; from the day he sold the things; or took possession of them. MuwataMalik-017-001-35801 | Yahya related to me from Malik that he had heard that Uthman Ibn Affan would sometimes never get down from the animal he was riding on when he was doing umra; until he had returned. Malik said; Umra is a sunna; and we do not know of any muslim who has ever said that it is permissible not to do it. Malik said; I do not think that anyone can do more than one umra in any one year. Malik said that someone doing umra who had sexual intercourse with his wife had to sacrifice an animal and do a second umra; which he had to begin when he had finished the one that he had spoiled. He should go into ihram at the same place where he went into ihram for the umra which he had spoiled; except if he had entered into ihram at a place further away than his miqat. This was because he only had to go into ihram from his miqat. Malik said; Someone who entered Makka to do umra; and does tawaf of the House and say between Safa and Marwa while he is junub; or not in Ablution; and afterwards has intercourse with his wife; and then remembers; should do ghusl; or Ablution; and then go back and do tawaf around the House and say between Safa and Marwa and do another umra and sacrifice an animal. A woman should do the same if her husband has intercourse with her while she is in ihram. Malik said; As for beginning umra at AlTanim; it is not the only alternative.
