Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs. If it is a man that dies, leaving a sister but no child, she shall have half the inheritance: If (such a deceased was) a woman, who left no child, Her brother takes her inheritance: If there are two sisters, they shall have two-thirds of the inheritance (between them): if there are brothers and sisters, (they share), the male having twice the share of the female. Thus doth Allah make clear to you (His law), lest ye err. And Allah hath knowledge of all things. | |

In what ye leave, their share is a fourth, if ye leave no child; but if ye leave a child, they get an eighth; after payment of legacies and debts. If the man or woman whose inheritance is in question, has left neither ascendants nor descendants, but has left a brother or a sister, each one of the two gets a sixth; but if more than two, they share in a third; after payment of legacies and debts; so that no loss is caused (to any one). Thus is it ordained by Allah; and Allah is All-knowing, Most Forbearing. | |

We have made lawful to thee thy wives to whom thou hast paid their dowers; and those whom thy right hand possesses out of the prisoners of war whom Allah has assigned to thee; and daughters of thy paternal uncles and aunts, and daughters of thy maternal uncles and aunts, who migrated (from Makka) with thee; and any believing woman who dedicates her soul to the Prophet if the Prophet wishes to wed her;- this only for thee, and not for the Believers (at large); We know what We have appointed for them as to their wives and the captives whom their right hands possess;- in order that there should be no difficulty for thee. And Allah is Oft-Forgiving, Most Merciful. | |

Nor marry (your girls) to unbelievers until they believe: A man slave who believes is better than an unbeliever, even though he allures you. Unbelievers do (but) beckon you to the Fire. But Allah beckons by His Grace to the Garden (of bliss) and forgiveness, and makes His Signs clear to mankind: That they may celebrate His praise. | |

He said; The Prophet ﷺ passed by her while she was weeping over a grave; and he said to her; Be afraid of Allah and be patient. The woman said to the Prophet. Go away from me; for you do not know my calamity. Anas added; The Prophet ﷺ left her and proceeded. A man passed by her and asked her; What has Allah Messenger ﷺ said to you? She replied; I did not recognize him. The man said; He was Allah Messenger ﷺ. Anas added; So that woman came to the gate of the Prophet ﷺ and she did not find a gate-keeper there; and she said; O Allah Messenger ﷺ ! By Allah. I did not recognize you! He said: Has he drunk wine? A person stood up and smelt his breath but noticed no smell of wine. Thereupon Allah Messenger ﷺ said: Have you committed adultery? He said: Yes. He made pronouncement about him and he was stoned to death. The people had been divided into two groups about him Maiz. One of them said: He has been undone for his sins had encompassed him; whereas another said: There is no repentance more excellent than the repentance of Maiz; for he came to Allah Apostle ﷺ and placing his hand in his in the Holy Prophets hand said: Kill me with stones. This controversy about Maiz remained for two or three days. Then came Allah Messenger ﷺ to them his Companions as they were sitting. He greeted them with salutation and then sat down and said: Ask forgiveness for Maiz Bin Malik. They said: May Allah forgive Maiz Bin Malik. Thereupon Allah Messenger ﷺ said: He Maiz has made such a repentance that if that were to be divided among a people; it would have been enough for all of them. He the narrator said: Then a woman of Ghamid; a branch of Azd; came to him and said: Messenger of of Allah; purify me; whereupon he said: Woe be upon you; go back and beg forgiveness from Allah and turn to Him in repentance. She said: I find that you intend to send me back as you sent back Maiz. Bin Malik. He the Holy; Prophet said: What has happened to you? She said that she had become pregnant as a result of fornication. He the Holy Prophet said: Is it you who has done that ? She said: Yes. He the Holy Prophet said to her: You will not be punished until you deliver what is there in your womb. One of the Ansar became responsible for her until she was delivered of the child. He that Ansari came to Allah Apostle ﷺ and said the woman of Ghamid has given birth to a child. He the Holy Prophet said: In that case we shall not stone her and so leave her infant with none to suckle him. One of the Ansar got up and said: Allah Apostle; let the responsibility of his suckling be upon me. The second claimant who was wiser than him said: Well; decide amongst us according to the Book of Allah; but permit me to say something. Thereupon Allah Messenger may peace be upon ham said: Say. He said: My son was a servant in the house of this person and he committed adultery with his wife. I was informed that my son deserved stoning to death as punishment for this offence. I gave one hundred goats and a slave girl as ransom for this. I asked the scholars if this could serve as an expiation for this offence. They informed me that my son deserved one hundred lathes and exile for one year. and this woman deserved stoning as she was married. Thereupon Allah Messenger may peace he upon him said: By Him in Whose Hand is my life. I will decide between you according to the Book of Allah. The slave-girl and the goats should be given back; and your son is to be punished with one hundred lashes and exile for one year. SahihMuslim-017-001-17614 | Imran Bin Hosain reported that the tribe of Thaqif was the ally of Banu Uqail. Thaqif took two persons from amongst the Companions of Allah Messenger ﷺ as prisoners. The Companions of Allah Messenger ﷺ took one person at Banu Uqail as prisoner; and captured AlAdbi the camel of the Holy Prophet along with him. Allah Messenger ﷺ came to him and he was tied with ropes. He said: Muhammad. He came near him and said: What is the matter with you? Thereupon he the prisoner said: Why have you taken me as prisoner and why have you caught hold of one proceeding the pilgrims the camel as she carried the Prophet on her back and walked ahead of the multitude ? He the Holy Prophet said: Yours is a great fault. I my men have caught hold of you for the crime of your allies; Banu Thaqif. He the Holy Prophet then turned away. He again called him and said: Muhammad; Muhammad; and since Allah Messenger ﷺ was very compassionate; and tenderhearted; he returned to him; and said: What is the matter with you? He said: I am a Muslim; whereupon he the Holy Prophet said: Had you said this when you had been the master of yourself; you would have gained every success. He then turned away. He the prisoner called him again saying: Muhammad; Muhammad. He came to him and said: What is the matter with you? He said: I am hungry; feed me; and I am thirsty; so provide me with drink. He the Holy Prophet said: That is to satisfy your want. He was then ransomed for two persons who had been taken prisoner by Thaqif. He the narrator said: A woman of the Ansar had been taken prisoner and also AlAdbi was caught. The woman had been tied with ropes. The people were giving rest to their animals before their houses. She escaped one night from the bondage and came to the camels. As she drew near the camels; they fretted and fumed and so she left them until she came to Al; Adbi. It did not fret and fume; it was docile She rode upon its back and drove it away and she went off. When they the enemies of Islam were warned of this; they went in search of it; but it the camel exhausted them. She the woman took vow for Allah; that in case He would save her through it; she would offer that as a sacrifice. As she reached Medina; the people saw her and they said: Here is AlAdbi; the camel of Allah Messenger ﷺ. She the woman said that she had taken a vow that if Allah would save her on its back; she would sacrifice it. They the Prophet Companions came to Allah Messenger ﷺ and made a mention of that to him; whereupon he said: Hallowed be Allah; how ill she rewarded it that she took vow to Allah that if He saves her on its back; she would sacrifice it! There is no fulfillment of the vow in an act of disobedience; nor in an act over which a person has no control. By God; the Messenger of Allah ﷺ never took any vow from women except that which God had ordered him to take; and his palm never touched the palm of a woman. I did not know what to say. So I went to the house of Abdullah Bin Umar and I sought permission to enter. I was told he was taking a nap; but he heard me taking and he said: Is it Ibn Jubair? Enter. You would not have come except for a need. He said: So I entered and found him laying on a saddlecloth from his mount. I said: O Abu Abdulrahman Are those involved in Lian separated? He said: Glorious is Allah! Yes. The first who asked about hat was so-and-so the son of so-and-so. He came to the Prophet ﷺ and said O Messenger of Allah! If one of us saw his wife committing adultery; what should he do? If he were to say anything; his statement would be a horrible matter; and if he were to remain silent; his silence about the matter would be horrible. He said: So the Prophet ﷺ remained silent and did not answer him. Afterwards he came to the Prophet ﷺ and said: The one who asked you about it has been tried by it. So Allah revealed these Ayat from Surat AlNur: And those who accuse their wives and have no witnesses except themselves; let the testimony of one of them be four testimonies by Allah 24:6-10 - until the end of those Ayat. He said: So he called for the man and recited the Ayat to him and admonished him; reminded him; and he told him: Indeed the punishment of the world is less than the punishment of the Hereafter. So he said: Nay! By the One Who sent you with the Truth! I did not lie about her. Then he ﷺ did the same with the woman; admonishing her and reminding her and he told her: Indeed the punishment of the world is less than the punishment of the Hereafter. She said: Nay! By the One Who sent you with the Truth! He is not telling the truth. He said: So he started with the man: He testified four times; by Allah that he is one of the truthful; and the fifth time that the curse of Allah be upon him if he was one of the liars. Then the same with the woman: She testified four times by Allah; that he was one of the liars; and the fifth time that the wrath of Allah be upon her if he was one of the truthful. I did not find any one of the companions of the Prophet ﷺ more devoted to worship and more hospitable than Abu Huraira. One day I was with him when he was sitting on his bed. He had a purse which contained pebbles or kernels. A black slave-girl of his was sitting below. Counting them he was glorifying Allah. When the pebbles or the kernels in the purse were finished; she gathered them and put them again in the purse; and gave it to him. He said: Should I not tell you about me and about the Messenger of Allah ﷺ ? I said: Yes. He said: Once when I was laid up with fever in the Masjid; the Messenger of Allah ﷺ came and entered the Masjid; and said: Who saw the youth of AlDaws. He said this three times. A man said: Messenger of Allah; there he is; laid up with fever on one side of the Masjid. He moved; walking forward till he reached me. He placed his hand on me. He had a kind talk with me; and I rose. He then began to walk till he reached the place where he used to offer his prayer. He paid his attention to the people. There were two rows of men and one row of women; or two rows of women and one row of men the narrator is doubtful. He then said: If Satan makes me forget anything during the prayer; the men should glorify Allah; and the women should clap their hands. The Messenger of Allah ﷺ then prayed and he did not forget anything during the prayer. He said: Be seated in your places; be seated in your places. The narrator; Mousa; added the word here. He then praised Allah and exalted Him; and said: Now to our topic. The agreed version begins: He then said: Is there any man among you who approaches his wife; closes the door; covers himself with a curtain; and he is concealed with the curtain of Allah? They replied: Yes. He said: later he sits and says: I did so-and-so; I did so-and-so. The people kept silence. He then turned to the women and said to them : Is there any woman among you who narrates it? They kept silence. Then a girl fell on one of her knees. The narrator; Muammil; said in his version: a buxom girl. She raised her head before the Messenger of Allah ﷺ so that he could see her and listen to her. She said: Messenger of Allah; they the men describe the secrets of intercourse and they the women also describe the secrets of intercourse to the people. He said: Do you know what the similitude is? He said: The likeness of this act is the likeness of a female Satan who meets the male Satan on the roadside; he fulfils his desire with her while the people are looking at him. Beware! The perfume of men is that whose smell becomes visible and its colour does not appear. Beware! The perfume of women is that whose colour becomes visible and whose smell is not obvious. Abu Dawud said: From here I remembered this tradition from Muammil and Mousa: Beware! No man should lie with another man; no woman should lie with another woman except with one child or father. SunanAbuDawoud-017-001-25111 | Aisha wife of the Prophet ﷺ said Marriage in pre Islamic times was of four kinds. One of them was the marriage contracted by the people today. A man asked another man to marry his relative sister or daughter to him. He fixed the dower and married her to him. Another kind of marriage was that a man asked his wife when she became pure from menstruation to send fro so and so and have sexual intercourse with him. Her husband kept himself aloof and did not have intercourse with her till It became apparent that she was pregnant from the man who had intercourse with her. When it was manifest that she was pregnant; her husband approached her if he liked. This marriage was called istibda to utilize man for intercourse for a noble birth. A third kind of marriage was that a group of people less than ten in number entered upon a woman and had intercourse with her. When she conceived gave birth to a child and a number of days passed after her delivery; she sent for them. No one of them could refuse to attend and they gathered before her. She said to them You have realized your affair. I have now given birth to a child. And this is your son. O so and so. She called the name of anyone of them she liked and the child was attributed to him. A fourth kind of marriage was that many people gathered together and entered upon a woman who did not prevent anyone who came to her. They were prostitutes. They hoisted flags at their doors which served as a sign for the one who intended to enter upon them. When she became pregnant and delivered the child ; they got together before her and called for the experts of tracing relationship from physical features. They attributed the child to whom they considered and it was given to him. The child was called his son and he could not deny. She said: I have no need of perfume; but I heard the Messenger of Allah ﷺ say: It is not lawful for a woman who believes in Allah and the Last Day to observe mourning for one who has died; more than three nights; except for four months and ten days in the case of a husband. Zaynab said: I also visited Zaynab; daughter of Jahsh; when her brother died. She asked for some perfume and used it upon herself. She then said: I have no need of perfume; but I heard the Messenger of Allah ﷺ say when he was on the pulpit: It is not lawful for a woman who believes in Allah and the Last Day to observe mourning for one who has died; more than three nights; except for four months and ten days in the case of a husband. Malik said; The position with us is that there are eleven prescribed prostrations in the Quran; none of which are in the mufassal. Malik said; No-one should recite any of the pieces of Quran that require a prostration after the prayers of subh and asr. This is because the Messenger of Allah; may Allah bless him and grant him peace; forbade prayer after subh until after the sun had risen; and after asr until the sun had set; and prostration is part of the prayer. So no-one should recite any piece of Quran requiring a prostration during these two periods of time. Malik was asked whether a menstruating woman could prostrate if she heard some-one reciting a passage of Quran requiring a prostration; and he said; Neither a man nor a woman should prostrate unless they are ritually pure. Malik was asked whether a man in the company of a woman who was reciting a passage of Quran requiring a prostration should prostrate with her; and he said; He does not have to prostrate with her. The prostration is only obligatory for people who are with a man who is leading them. He recites the piece and they prostrate with him. The Messenger of Allah; may Allah bless him and grant him peace; asked them; What do you find in the Torah about stoning? They said; We make their wrong action known and flog them. Abdullah Ibn Salam said; You have lied! It has stoning for it; so bring the Torah. They spread it out and one of them placed his hand over the ayat of stoning. Then he read what was before it and what was after it. Abdullah Ibn Salam told him to lift his hand. He lifted his hand and there was the ayat of stoning. They said; He has spoken the truth; Muhammad. The ayat of stoning is in it. So the Messenger of Allah; may Allah bless him and grant him peace; gave the order and they were stoned. MuwataMalik-017-001-34776 | Malik related to me that Yahya Ibn Said heard Said Ibn AlMusayab say; When Umar Ibn AlKhattab came from Mina; he made his camel kneel at AlAbtah; and then he gathered a pile of small stones and cast his cloak over them and dropped to the ground. Then he raised his hands to the sky and said; O Allah! I have become old and my strength has weakened. My flock is scattered. Take me to You with nothing missed out and without having neglected anything. Then he went to Madina and addressed the people. He said; People! Sunan have been laid down for you. Obligations have been placed upon you. You have been left with a clear way unless you lead people astray right and left. He struck one of his hands on the other and then said; Take care lest you destroy the ayat of stoning so that one will say; We do not find two hadds in the Book of Allah. He said; If she does not produce any of those; the hadd is inflicted on her and what she claims of that is not accepted from her. Malik said; A raped woman cannot marry until she has restored herself by three menstrual periods. MuwataMalik-017-001-34835 | Malik related to me that he had heard that Said Ibn AlMusayab was asked who had the wala of the children whom a slave had by a free woman. Said said; If their father dies and he is a slave who was not set free; their wala belongs to the mawali of their mother. Malik said; That is like the child of a woman who is a mawla who has been divorced by lian; the child is attached to the mawali of his mother and they are his mawali. If he dies; they inherit from him. If he commits a crime; they pay the blood-money for him. If his father acknowledges him; he is given a kinship to him and his wala goes to the mawali of his father. They are his heirs; they pay his blood-money and his father is punished with the hadd-punishment. Malik said; It is like that with a free-born woman divorced by lian. If her husband who curses her by lian does not acknowledge her child; the child is dealt with in the same way except that the rest of his inheritance after the inheritance of his mother and his brothers from his mother goes to all the muslims as long as he was not given kinship to his father. The child of the lian is attached to the patronage of the mawali of his mother until his father acknowledges him because he does not have a lineage or paternal relations. If his lineage is confirmed; it goes to his paternal relations. Malik said; The generally agreed-on way of doing things among us about a child of a slave by a free woman; while the father of the slave is free; is that the grandfather the father of the slave ; attracts the wala of his son free children by a free woman. They leave their inheritance to him as long as their father is a slave. If the father becomes free; the wala returns to his mawali. If he dies and he is still a slave; the inheritance and the wala go to the grandfather. If the slave has two free sons; and one of them dies while the father is still a slave; the grandfather; the father of the father; attracts the wala and the inheritance. Malik spoke about a slave-girl who was set free while she was pregnant and her husband was a slave and then her husband became free before she gave birth; or after she gave birth. He said; The wala of what is in her womb goes to the person who set the mother free because slavery touched the child before the mother was set free. It is not treated in the same way as a child conceived by its mother after she has been set free because the wala of such a child; is attracted by the father when he is set free. MuwataMalik-017-001-34849 | Yahya related to me from Malik that he heard Ibn Shihab say; The precedent of the sunna when a man injures a woman is that he must pay the blood- money for that injury and there is no retaliation against him. Malik said; That is an accidental injury; when a man strikes a woman and hits with a blow what he did not intend; for instance; if he struck her with a whip and cut her eye open and the like of that. Malik said about a woman who has a husband and children who are not from her paternal relatives or her people; that since he is from another tribe; there is no blood-money against her husband for her criminal action; nor any against her children if they are not from her people; nor any against her maternal brothers when they are not from her paternal relations or her people. These are entitled to her inheritance but only the paternal relations have paid blood-money from since the time of the Messenger of Allah; may Allah bless him and grant him peace. MuwataMalik-017-001-34852 | Yahya related to me from Malik that Rabia Ibn Abi Abdulrahman said; The slave of fair complexion and excellence is estimated at fifty dinars or six hundred dirhams. The blood-money of a free muslim woman is five hundred dinars or six thousand dirhams. Malik said; The blood-money of the foetus of a free woman is a tenth of her blood-money. The tenth is fifty dinars or six hundred dirhams. Malik said; I have not heard anyone dispute that there is no slave in compensation for the foetus until it leaves its mother womb and falls still-born from her womb. Malik said; I heard that if the foetus comes out of its mother womb alive and then dies; the full blood-money is due for it. Malik said; The foetus is not alive unless it cries at birth. If it comes out of its mother womb and cries out and then dies; the complete blood-money is due for it. We think that the slave- girl foetus has a tenth of the price of the slave-girl. Malik said; When a woman murders a man or woman; and the murderess is pregnant; retaliation is not taken against her until she has given birth. If a woman who is pregnant is killed intentionally or unintentionally; the one who killed her is not obliged to pay anything for her foetus. If she is murdered; then the one who killed her is killed and there is no blood-money for her foetus. If she is killed accidentally; the tribe obliged to pay on behalf of her killer pays her blood-money; and there is no blood-money for the foetus. Yahya related to me; Malik was asked about the foetus of the christian or jewish woman which was aborted. MuwataMalik-017-001-34881 | Yahya related to me from Malik that he had heard that Marwan Ibn AlHakam wrote to Muawiya Ibn Abi Sufyan to mention to him that a drunkard was brought to him who had killed a man. Muawiya wrote to him to kill him in retaliation for the dead man. Yahya said that Malik said; The best of what I have heard on the interpretation of this ayat; the word of Allah; the Blessed; the Exalted; The free man for the free man and the slave for the slave - these are men and the woman for the woman; Surat 2 ayat 178 is that retaliation is between women as it is between men. The free woman is killed for the free woman as the free man is killed for the free man. The slave-girl is slain for the slave-girl as the slave is slain for the slave. Retaliation is between women as it is between men. That is because Allah; the Blessed; the Exalted; said in His Book; We have written for them in it that it is a life for a life and an eye for an eye; a nose for a nose; and an ear for an ear; and a tooth for a tooth; and for wounds there is retaliation. Surat 5 ayat 48 Allah; the Blessed; the Exalted; mentioned that it is a life for a life. It is the life of a free woman for the life of a free man; and her injury for his injury. Malik said about a man who held a man fast for another man to hit; and he died on the spot; If he held him and he thought that he meant to kill him; the two of them are both killed for him. If he held him and he thought that he meant to beat him as people sometimes do; and he did not think that he meant to kill him; the murderer is slain and the one who held him is punished with a very severe punishment and jailed for a year. There is no killing against him. Malik said about a man who murdered a man intentionally or gouged out his eye intentionally; and then was slain or had his eye gouged out himself before retaliation was inflicted on him; There is no blood-money nor retaliation against him. The right of the one who was killed or had his eye gouged out goes when the thing which he is claiming as retaliation goes. It is the same with a man who murders another man intentionally and then the murderer dies. When the murderer dies; the one seeking blood-revenge has nothing of blood- money or anything else. That is by the word of Allah; the Blessed the Exalted; Retaliation is written for you in killing. The free man for the free man and the slave for the slave. Malik said; He only has retaliation against the one who killed him. If the man who murdered him dies; he has no retaliation or blood-money. Malik said; There is no retaliation held against a free man by a slave for any injury. The slave is killed for the free man when he intentionally murders him. The free man is not slain for the slave; even if he murders him intentionally. MuwataMalik-017-001-34889 | Yahya said that he heard Malik say; The best of what I have heard about the testament of a pregnant woman and about what settlements she is permitted in her property is that the pregnant woman is like the sick person. When the illness is light; and one does not fear for the sick person; he does with his property what he likes. If the illness is such that his life is feared for; he can only dispose of a third of his estate. He said; It is the same with a woman who is pregnant. The beginning of pregnancy is good news and joy. It is not illness and no fear because Allah the Blessed; the Exalted; said in His Book; We gave her good news of Ishaq and after Ishaq; Yaqub. Surat ll ayat 71. And He said; She bore a light burden and passed by with it; but when she became heavy; they called upon Allah; their Lord; If you give us a good-doing son; we will be among the thankful. Surat 7 ayat 189. When a pregnant woman becomes heavy; she is only permitted to dispose of a third of her estate. The beginning of this restriction is after six months. Allah; the Blessed; the Exalted; said in His Book; Mothers suckle their children for two complete years. And He said; his bearing and weaning are thirty months. Surat 2 ayat 233. When six months have passed for the pregnant woman from the day she conceived; she is only permitted to dispose of a third of her property. Yahya said that he heard Malik say; A man who is advancing in the row for battle; can only dispose of a third of his property. He took him by the arm and placed him before him on his mount. The grandmother of the child saw him and argued with Umar about the child so they went to Abu Bakr AlSiddiq. Umar said; My son. The woman said; My son. Abu Bakr said; Do not interfere between a child and its mother. Umar did not repeat his words. MuwataMalik-017-001-34928 | Malik related to me from Yazid Ibn Abdullah Ibn AlHadi from Muhammad Ibn Ibrahim Ibn AlHarith AlTaymi from Sulayman Ibn Yasar from Abdullah Ibn Abi Umaya that a woman husband died; and she did the idda of four months and ten days. Then she married when she was free to marry. She stayed with her husband for four and a half months; then gave birth to a fully developed child. Her husband went to Umar Ibn AlKhattab and mentioned that to him; so Umar called some of the old women of the Aljahiliya and asked them about that. One of the women said; I will tell you what happened with this woman. When her husband died; she was pregnant by him; but then the blood flowed from her because of his death and the child became dry in her womb. When her new husband had intercourse with her and the water reached the child; the child moved in the womb and grew. Umar Ibn AlKhattab believed her and separated them until she had completed her idda. MuwataMalik-017-001-34929 | Malik related to me from Yahya Ibn Said from Sulayman Ibn Yasar that Umar Ibn AlKhattab used to attach the children of the Aljahiliya to whoever claimed them in Islam. Two men came and each of them claimed a woman child. Umar Ibn AlKhattab summoned a person who scrutinized features and he looked at them. The scrutinizer said; They both share in him. Umar Ibn AlKhattab hit him with a whip. Then he summoned the woman; and said; Tell me your tale. She said; It was this one indicating one of the two men who used to come to me while I was with my people camels. He did not leave me until he thought and I thought that I was pregnant. Then he left me; and blood flowed from me; and this other one took his place. I do not know from which of them the child is. The scrutinizer said; Allah is greater. MuwataMalik-017-001-34931 | Yahya said that he heard Malik say; The way of doing things generally agreed upon in our community in the case of a man who dies and has sons and one of them claims; My father confirmed that so-and- so was his son; is that the relationship is not established by the testimony of one man; and the confirmation of the one who confirmed it is only permitted as regards his own share in the division of his father property. The one testified for is only given his due from the share of the testifier. Malik said; An example of this is that a man dies leaving two sons; and 600 dinars. Each of them takes 300 dinars. Then one of them testifies that his deceased father confirmed that so-and-so was his son. The one who testifies is obliged to give 100 dinars to the one thus connected. This is half of the inheritance of the one thought to be related; had he been related. If the other confirms him; he takes the other 100 and so he completes his right and his relationship is established. His position is similar to that of a woman who confirms a debt against her father or her husband and the other heirs deny it. She must pay to the person whose debt she confirms; the amount according to her share of the full debt; had it been confirmed against all the heirs. If the woman inherits an eighth; she pays the creditor an eighth of his debt. If a daughter inherits a half; she pays the creditor half of his debt. Whichever women confirm him; pay him according to this. Malik said; If a man testimony is in agreement with what the woman testified to; that so- and-so had a debt against his father; the creditor is made to take an oath with one witness and he is given all his due. This is not the position with women because a man testimony is allowed and the creditor must take an oath with the testimony of his witness; and take all his due. If he does not take an oath; he only takes from the inheritance of the one who confirmed him according to his share of the debt; because he confirmed his right and the other heirs denied it. MuwataMalik-017-001-34956 | Yahya said that he heard Malik say; The way of doing things in our community about which there is no dispute; is that if a man gives sadaqa to his son - sadaqa which the son takes possession of or which is in the father keeping and the father has had his sadaqa witnessed; he cannot take back any of it because he cannot reclaim any sadaqa. Yahya said that he heard Malik say; The generally agreed-on way of doing things in our community in the case of someone who gives his son a gift or grants him a gift which is not sadaqa is that he can take it back as long as the child does not start a debt; which people claim from him; and which they trust him for on the strength of the gift his father has given him. The father cannot take back anything from the gift after debts are started against it. MuwataMalik-017-001-35151 | Malik said; The generally agreed on way of doing things among us in which there is no dispute and which I saw the people of knowledge in our citydoing; is that the child of the half-sibling by the mother; the paternal grandfather; the paternal uncle who is the maternal half- brother of the father; the maternal uncle; the great-grandmother who is the mother of the mother father; the daughter of the full- brother; the paternal aunt; and the maternal aunt do not inherit anything by their kinship. Malik said; The woman who is the furthest relation of the deceased of those who were named in this book; does not inherit anything by her kinship; and women do not inherit anything apart from those that are named in the Quran. Allah; the Blessed; the Exalted; mentioned in His Book the inheritance ofthe mother from her children; the inheritance of the daughters from their father; the inheritance of the wife from her husband; the inheritance of the full sisters; the inheritance of the half-sisters by the father and the inheritance of the half-sisters by the mother. MuwataMalik-017-001-35191 | Yahya related to me from Malik from Nafi that Abdullah Ibn Umar said that statements like I cut myself off from you;orYou are abandoned; were considered as three pronouncements of divorce. Malik said that any strong statements such as these or others were considered as three pronouncements of divorce for a woman whose marriage had been consummated. In the case of a woman whose marriage had not been consummated; the man was asked to make an oath on his deen; as to whether he had intended one or three pronouncements of divorce. If he had intended one pronouncement; he was asked to make an oath by Allah to confirm it; and he became a suitor among other suitors; because a woman whose marriage had been consummated; required three pronouncements of divorce to make her inaccessible for the husband; whilst only one pronouncement was needed to make a woman whose marriage had not been consummated inaccessible.
