SahihAlBukhari-017-001-1065 | Narrated Abu Saeed AlKhudri: When Ali was in Yemen; he sent some gold in its ore to the Prophet. The Prophet ﷺ distributed it among AlAqra Bin HAbis AlHanzali who belonged to Bani Mujashi; Uyaina Bin Badr AlFazari; Alqama Bin Ulatha AlAmiri; who belonged to the Bani Kilab tribe and Zaid AlKhail AlTai who belonged to Bani Nabhan. So the Quraish and the Ansar became angry and said; He gives to the chiefs of Najd and leaves us! The Prophet ﷺ said; I just wanted to attract and unite their hearts make them firm in Islam. Then there came a man with sunken eyes; bulging forehead; thick beard; fat raised cheeks; and clean-shaven head; and said; O Muhammad! Be afraid of Allah! The Prophet ﷺ said; Who would obey Allah if I disobeyed Him? Allah. He trusts me over the people of the earth; but you do not trust me? A man from the people present then ; who; I think; was Khalid Bin AlWalid; asked for permission to kill him; but the Prophet ﷺ prevented him. When the man went away; the Prophet said; Out of the offspring of this man; there will be people who will recite the Quran but it will not go beyond their throats; and they will go out of Islam as an arrow goes out through the game; and they will kill the Muslims and leave the idolators. Then he proceeded in the darkness of the night till he went out of sight; and then I heard a loud voice; and was afraid that something might have happened to the Prophet ﷺ.1 intended to go to him; but I remembered what he had said to me; i.e. Dont leave your place till I come back to you; so I remained at my place till he came back to me. He said; It was Gabriel who came to me and said; Whoever died without joining others in worship with Allah; will enter Paradise. SahihAlBukhari-017-001-234 | Narrated Amir Bin Saad Bin Abi Waqqas: That his father said; In the year of the last Hajj of the Prophet ﷺ I became seriously ill and the Prophet ﷺ used to visit me inquiring about my health. I told him; I am reduced to this state because of illness and I am wealthy and have no inheritors except a daughter; In this narration the name of Amir Bin Saad is mentioned and in fact it is a mistake; the narrator is Aisha bint Saad Bin Abi Waqqas. Should I give two-thirds of my property in charity? He said; No. I asked; Half? He said; No. then he added; Onethird; and even one-third is much. Youd better leave your inheritors wealthy rather than leaving them poor; begging others. You will get a reward for whatever you spend for Allah sake; even for what you put in your wife mouth. I said; O Allah Messenger ﷺ ! Will I be left alone after my companions have gone? He said; If you are left behind; whatever good deeds you will do will upgrade you and raise you high. And perhaps you will have a long life so that some people will be benefited by you while others will be harmed by you. O Allah! Complete the emigration of my companions and do not turn them renegades. SahihAlBukhari-017-001-2402 | Narrated Abdullah Bin Abbas: Umar Bin AlKhattab departed for Sham and when he reached Sargh; the commanders of the Muslim army; Abu Ubaida Bin AlJarrah and his companions met him and told him that an epidemic had broken out in Sham. Umar said; Call for me the early emigrants. So Umar called them; consulted them and informed them that an epidemic had broken out in Sham. Those people differed in their opinions. Some of them said; We have come out for a purpose and we do not think that it is proper to give it up; while others said to Umar ; You have along with you. other people and the companions of Allah Messenger ﷺ so do not advise that we take them to this epidemic. Umar said to them; Leave me now. Then he said; Call the Ansar for me. I called them and he consulted them and they followed the way of the emigrants and differed as they did. He then said to them; Leave me now; and added; Call for me the old people of Quraish who emigrated in the year of the Conquest of Mecca. I called them and they gave a unanimous opinion saying; We advise that you should return with the people and do not take them to that place of epidemic. So Umar made an announcement; I will ride back to Medina in the morning; so you should do the same. Abu Ubaida Bin AlJarrah said to Umar ; Are you running away from what Allah had ordained? Umar said; Would that someone else had said such a thing; O Abu Ubaida! Yes; we are running from what Allah had ordained to what Allah has ordained. Dont you agree that if you had camels that went down a valley having two places; one green and the other dry; you would graze them on the green one only if Allah had ordained that; and you would graze them on the dry one only if Allah had ordained that? At that time Abdulrahman Bin Auf; who had been absent because of some job; came and said; I have some knowledge about this. I have heard Allah Messenger ﷺ saying; If you hear about it an outbreak of plague in a land; do not go to it; but if plague breaks out in a country where you are staying; do not run away from it. He said; No. I said; Shall I bequeath half and leave half? He said; No. I said; Shall I bequeath one third and leave two thirds? He said; One third is alright; though even one third is too much. I do not leave anyone after me dearer to me than you; except Allah Messenger ﷺ soul and I owe some debt and you should repay it and treat your sisters favorably nicely and politely. So in the morning he was the first to be martyred and was buried along with another martyr. Abu Bakr said; Let my father and mother be sacrificed for you. Do you hope that emigration ? The Prophet said; Yes. So Abu Bakr waited to accompany the Prophet ﷺ and fed two camels he had on the leaves of AlSamur tree regularly for four months One day while we were sitting in our house at midday; someone said to Abu Bakr; Here is Allah Messenger ﷺ ; coming with his head and a part of his face covered with a cloth-covering at an hour he never used to come to us. Abu Bakr said; Let my father and mother be sacrificed for you; O Prophet ! An urgent matter must have brought you here at this hour. The Prophet ﷺ came and asked the permission to enter; and he was allowed. The Prophet ﷺ entered and said to Abu Bakr; Let those who are with you; go out. Abu Bakr replied; There is no stranger ; they are your family. Let my father be sacrificed for you; O Allah Apostle! The Prophet ﷺ said; I have been allowed to leave Mecca. Take one of these two shecamels of mine The Prophet ﷺ said. I will take it only after paying its price. So we prepared their baggage and put their journey food In a leather bag. And Asma bint Abu Bakr cut a piece of her girdle and tied the mouth of the leather bag with it. That is why she was called Dhatan- Nitaqaln. Then the Prophet ﷺ and Abu Bakr went to a cave in a mountain called Thour and remained there for three nights. Abdullah Bin Abu Bakr. who was a young intelligent man. used to stay with them at night and leave before dawn so that in the morning; he would he with the Quraish at Mecca as if he had spent the night among them. If he heard of any plot contrived by the Quraish against the Prophet and Abu Bakr; he would understand it and return to inform them of it when it became dark. Amir Bin Fuhaira; the freed slave of Abu Bakr used to graze a flock of milch sheep for them and he used to take those sheep to them when an hour had passed after the Isha prayer. Ubaidullah added; I asked Nafi again; and he said; As for leaving hair on the temples and the back part of the boy head; there is no harm; but AlQaza is to leave a tuft of hair on his forehead unshaved while there is no hair on the rest of his head; and also to leave hair on either side of his head. | The Chapter on Grooming The Hair And Perfumes in HodHood Indexing, Chapter on AlQaza in Sahih AlBukhari

Then Allah revealed: And those of you who die and leave wives should bequeath for their wives a year maintenance and residence without turning them out; but if they leave; there is no blame on you for what they do of themselves; provided it is honorable i.e. lawful marriage 2.240 Mujahid said: Allah has ordered that a widow has the right to stay for seven months and twenty days with her husband relatives through her husband will and testament so that she will complete the period of one year of Iddah. But the widow has the right to stay that extra period or go out of her husband house as is indicated by the statement of Allah: But if they leave there is no blame on you;... 2.240 Ibn Abbas said: The above Verse has cancelled the order of spending the period of the Iddah at her late husband house; and so she could spend her period of the Iddah wherever she likes. And Allah says: Without turning them out. Ata said: If she would; she could spend her period of the Iddah at her husband house; and live there according to her husbands will and testament; and if she would; she could go out of her husband house as Allah says: There is no blame on you for what they do of themselves. 2.240 Ata added: Then the Verses of inheritance were revealed and the order of residence for the widow was cancelled; and she could spend her period of the Iddah wherever she would like; and she was no longer entitled to be accommodated by her husband family. | The Chapter on Marriage And Iddah in HodHood Indexing, Chapter on And those of you who die and leave behind wives in Sahih AlBukhari

SahihMuslim-017-001-17217 | Zaid Bin Khalid AlJuhani; the Companion ot Allah Messenger ﷺ ; said that Allah Messenger ﷺ was asked about the picking up of stray gold or silver; whereupon he said: Recognise well the strap and the bag containing that and then make an announcement regarding that for one year; but if none recognises it; then spend that and it would be a trust with you; and if someone comes one day to make demand of that; then pay that to him. He the inquirer asked about the lost camel; whereupon he said: You have nothing to do with that. SahihMuslim-017-001-17450 | Jabir Bin Abdullah reported: Allah Messenger may peace he upon him sent us on an expedition. We were three hundred riders and our chief leader was Ubaida Bin AlJarrah. We were on the look out for a caravan of the Quraish. So we stayed on the coast for half a month; and were so much afflicted by extreme hunger that we were obliged to eat leaves. That is why it was called the Detachment of the Leaves. The ocean cast out for us an animal which was called AlAnbar whale. We ate of that for half of the month and rubbed its fat on our bodies until our bodies became stout. Abu Ubaida caught hold of one of its ribs and fixed that up. He then cast a glance at the tallest man of the army and the highest of the camels. and then made him ride over that; and that-tnan passed beneath it the rib ; and many a man could sit in its eye-socket; and we extracted many pitchers of fat from the cavity of its eye. We had small bags containing dates with us before finding the whale. Ubaida gave every person amongst us a handful of dates and when the provision ran short ; he then gave each one of us one date. SahihMuslim-017-001-17957 | Amir Bin Saad reported on the authority of his father Saad Bin Abi Waqqas : Allah Messenger ﷺ visited me in my illness which brought me near death in the year of Hajjat AlWada Farewell Pilgrimage. I said: Allah Messenger; you can well see the pain with which I am afflicted and I am a man possessing wealth; and there is none to inherit me except only one daughter. Should I give two-thirds of my property as Sadaqa? He said: No. I said: Should I give half of my property as Sadaqa? He said: No. He further said: Give one-third in charity and that is quite enough. To leave your heirs rich is better than to leave them poor; begging from people; that you would never incur an expense seeking therewith the pleasure of Allah; but you would be rewarded therefor; even for a morsel of food that you put in the mouth of your wife. I said: Allah Messenger. would I survive my companions? He the Holy Prophet said: If you survive them; then do such a deed by means of which you seek the pleasure of Allah; but you would increase in your status in religion and prestige; you may survive so that people would benefit from you; and others would be harmed by you. He Sad said: Allah Messenger; I own a large property and I have only one daughter as my inheritor. Should I not will away the whole of my property? He the Holy Prophet said: No. He said: Should I not will away; two-thirds of the property? he the Holy Prophet said: No. He Sad again said: Should I not will away half of my property ? He said: No. He Sad said: Then one-third? Thereupon he the Holy Prophet said: Yes ; one-third; and one-third is quite substanial. And what you spend as charity from your property is Sadaqa and flour spending on your family is also Sadaqa; and what your wife eats from your property is also Sadaqa; and that you leave your heirs well off or he said: prospreous is better than to leave them poor and begging from people. SahihMuslim-017-001-18040 | It is reported by Zuhri that this tradition was narrated to him by Malik Bin Aus who said: Umar Bin AlKhattab sent for me and I came to him when the day had advanced. I found him in his house sitting on his bare bed-stead; reclining on a leather pillow. He said to me : Malik; some people of your tribe have hastened to me with a request for help. I have ordered a little money for them. Take it and distribute it among them. I said: I wish you had ordered somebody else to do this job. He said: Malik; take it and do what you have been told. At this moment his man-servant Yarfa came in and said: Commander of the Faithful; what do you say about Uthman; Abd AlRabman Bin Auf; AlZubair and Saad who have come to seek an audience with you ? He said: Yes; and permitted them. so they entered. Then he Yarfa came again and said: What do you say about Ali and Abbas who are present at the door ? He said: Yes; and permitted them to enter. Abbas said: Commander of the Faithful; decide the dispute between me and this sinful; treacherous; dishonest liar. The people who were present also said: Yes. Commander of the Faithful; do decide the dispute and have mercy on them. Malik Bin Aus said: I could well imagine that they had sent them in advance for this purpose by Ali and Abbas. Umar said: Wait and be patient. I adjure you by Allah by Whose order the heavens and the earth are sustained; dont you know that the Messenger of Allah ﷺ said: We prophets do not have any heirs; what we leave behind is to be given in charity? They said: Yes. Then he turned to Abbas and Ali and said: I adjure you both by Allah by Whose order the heavens and earth are sustained; dont you know that the Messenger of Allah ﷺ said: We do not have any heirs; what we leave behind is to be given in charity? They too said: Yes. Then Umar said: Allah; the Glorious and Exalted; had done to His Messenger ﷺ a special favour that He has not done to anyone else except him. He quoted the Quranic verse: What Allah has bestowed upon His Apostle from the properties of the people of township is for Allah and His Messenger. The narrator said: I do not know whether he also recited the previous verse or not. Umar continued: The Messenger of Allah ﷺ distrbuted among you the properties abandoned by Banu Nadir. By Allah; he never preferred himself over you and never appropriated anything to your exclusion. After a fair distribution in this way this property was left over. The Messenger of Allah ﷺ would meet from its income his annual expenditure; and what remained would be deposited in the Bait AlMal. Continuing further he said: I adjure you by Allah by Whose order the heavens and the earth are sustained. Do you know this? They said: Yes. Then he adjured Abbas and All as he had adjured the other persons and asked: Do you both know this? They said: Yes. He said: When the Messenger of Allah ﷺ passed away; Abu Bakr said: I am the successor of the Messenger of Allah ﷺ. Both of you came to demand your shares from the property left behind by the Messenger of Allah. Referring to Hadrat Abbas ; he said: You demanded your share from the property of your nephew; and he referring to Ali demanded a share on behalf of his wife from the property of her father. Abu Bakr Allah be pleased with him said: The Messenger of Allah ﷺ had said: We do not have any heirs; what we leave behind is to be given in charity. So both of you thought him to be a liar; sinful; treacherous and dishonest. And Allah knows that he was true; virtuous; well-guided and a follower of truth. When Abu Bakr passed away and I have become the successor of the Messenger of Allah ﷺ and Abu Bakr Allah be pleased with him ; you thought me to be a liar; sinful; treacherous and dishonest. And Allah knows that I am true; virtuous; well-guided and a follower of truth. I became the guardian of this property. Then you as well as he came to me. Both of you have come and your purpose is identical. You said: Entrust the property to us. I said: If you wish that I should entrust it to you; it will be on the condition that both of you will undertake to abide by a pledge made with Allah that you will use it in the same way as the Messenger of Allah ﷺ used it. So both of you got it. He said: Wasnt it like this? They said: Yes. He said: Then you have again come to me with the request that I should adjudge between you. No; by Allah. I will not give any other judgment except this until the arrival of the Doomsday. If you are unable to hold the property on this condition; return it to me. | The Chapter on Contracts And Disputes Management in HodHood Indexing, Chapter on 15 in Sahih Muslim
SahihMuslim-017-001-18656 | Hudhaifa reported: The Messenger of Allah ﷺ narrated to us two ahadith. I have seen one crystallized into reality ; and I am waiting for the other. He told us: Trustworthiness descended in the innermost root of the hearts of people. Then the Quran was revealed and they learnt from the Quran and they learnt from the Sunnah. Then he the Holy Prophet told us about the removal of trustworthiness. He said: The man would have a wink of sleep and trustworthiness would be taken away from his heart leaving the impression of a faint mark. He would again sleep and trustworthiness would be taken away from his heart leaving an impression of a blister; as if you rolled down an ember on your foot and it was vesicled. He would see a swelling having nothing in it. He the Holy Prophet then took up a pebble and rolled it down over his foot and said : The people would enter into transactions amongst one another and hardly a person would be left who would return things entrusted to him. And there would be so much paucity of honest persons till it would be said: There in such a such tribe is a trustworthy man. And they would also say about a person: How prudent he is; how broad-minded he is and how intelligent he is; whereas in his heart there would not be faith even to the weight of a mustard seed. I have passed through a time in which I did not care with whom amongst you I entered into a transaction; for if he were a Muslim his faith would compel him to discharge his obligations to me and it he were a Christian or a Jew; the ruler would compel him to discharge his obligations to me. But today I would not enter into a transaction with you except so and so. | The Chapter on Family And Judgments in HodHood Indexing, Chapter on 64 in Sahih Muslim
SahihMuslim-017-001-18765 | Anas b Malik reported: The Messenger of Allah ﷺ said: Allah would gather people on the Day of Resurrection and they would be concerned about it; and Ibn Ubaid said. They would get a Divine inspiration about it; and would say: If we could seek intercession with our Lord; we may be relieved from this predicament of ours. He the Holy Prophet said: They would come to Adam andsay; Thou art Adam; the father of mankind. Allah created thee with His own hand and breathed unto thee of His Spirit and commanded the angels and they prostrated before thee. So intercede for us with thy Lords; that He may relieve us from this position of ours. He would say: I am not in a position to do this; and would recall his error; and would fight shy of his Lord on account of that; go to Noah the first messenger after me sent by Allah. He the Holy Prophet said: So they would come to Noah ﷺ. He would say: I am not in a position to do that for you; and recall his fault which he had committed; and would fight shy of his Lord on account of that; and would say : You better go to Ibrahim ﷺ whom Allah took for a friend. They would come to Ibrahim ﷺ and he would say: I am not in a position to do that for you; and would recall his fault that he had committed and would; therefore; fight shy of his Lord on that account and would say : You better go to Moses ﷺ with whom Allah conversed and con- ferred Torah upon him. He the Holy Prophet said: So they would come to Moses ﷺ He would say: I am not in a position to do that for you; and would recall his fault that he had committed and would fight shy of his Lord on account of that and would say : You better go to Jesus; the Spirit of Allah and His word He would say: I am not in a position to do that for you; you better go to Muhammad ﷺ ; a servant whose former and later sins have been forgiven. He the narrator said: The Messenger or Allah ﷺ observed: So they would come to me and I would ask the permission of my Lord and it would be granted to me; and when I would see Him; I would fall down in prostration; and He Allah would leave me thus as long as He would wish; and then it would be said: O Muhammad; raise your head; say and you would be heard; ask and it would be granted; intercede and intercession would be accepted. Then I would raise my head and extrol my Lord with the praise which my Lord would teach me. I shall then inter- cede; but a limit would be set for me I would bring them out from the Fire and make them enter Paradise according to the limit. I shall return then ard fall down in pros- tration and Allah would leave me in that position as long as He would wish to leave me it would be said: Rise; O Muhammad; say and you would be heard; ask and it would be conferred; intercede and intercession would be granted. I would raise my head and extrol my Lord with praise that He would teach me. I would theft intercede and a limit would be set for me. I would bring them out of the Fire of Hell and make them enter Paradise. He the narrator said: I do not remember whether he the Holy Prophet said at tLe third time or at the fourth time: O my Lord; none has been left in the Fire; but thise restrained by the Holy Quran; i e. those who were eternally doomed. SunanAlTermithi-017-001-10192 | Sufyan narrated from Amr Bin Dinar that he heard Jabir Bin Abdullah saying: We were in a battle Sufyan said: They say it was the battle of Banu Mustaliq A man from the Muhajirin kicked a man from the Ansar. The man from the Muhajirin said: O Muhajirin! the man from the Ansar said: O Ansar! The Prophet heard that and said: What is this evil call of Jahliyah? They said: A man from the Muhajirin kicked a man from the Ansar. So the Prophet said: Leave that; for it is offensive. Abdullah Bin Ubay Bin Salul heard that and said: Did they really do that? By Allah! If we return to AlMadinah indeed the more honorable will expel therefrom the meaner. Umar said: Allow me to chop off the head of this hypocrite; O Messenger of Allah! The Prophet said: Leave him; I do not want the people to say that Muhammad kills his Companions. Someone other than Amr said: So his son; Abdullah Bin Abdullah; said: By Allah! You shall not return until you say that you are the mean and that the Messenger of Allah is the honorable. SunanAlTermithi-017-001-10339 | It was narrated from AlNawas Bin Saman; who said: The Messenger of Allah s.a.w mentioned the Dajjal one morning; he belittled him and mentioned his importance until we thought that he might be amidst a cluster of date-palms. He said: We departed from the presence of the Messenger of Allah s.a.w ; then we returned to him; and he noticed that concern in us. So he said: What is wrong with you? We said: O Messenger of Allah! You mentioned the Dajjal this morning; belittling him; and mentioning his importance until we thought that he might be amidst a cluster of the date-palms. He said: It is not the Dajjal that I fear for you. If he were to appear while I am among you; then I will be his adversary on your behalf. And if he appears and I am not among you; then each man will have to fend for himself. And Allah will take care of every Muslim after me. He is young; with curly hair; his eyes protruding; resembling someone from Abd AlUzza Bin Qatan. Whoever among you sees him; then let him recite the beginning of Surah Ashab AlKahf. He said: He will appear from what is between AlSham and AlIraq; causing devastation toward the right and toward the left. O worshippers of Allah! Hold fast! We said: O Messenger of Allah! How long will he linger on the earth? He said: Forty days; a day like a year; a day like a month; a day like a week; and the remainder of his days are like your days. We said: O Messenger of Allah! Do you think that during the day that is like a year; the Prayer of one day will be sufficient for us? He said: No. You will have to estimate it. We said: O Messenger of Allah! How fast will he move through the earth. He said: Like a rain storm driven by the wind. He will come upon a people and call them; and they will deny him; and reject his claims. Then he will leave them; and their wealth will follow him. They will awaken in the morning with nothing left. Then he will come upon a people and call them; and they will respond to him; believing in him. So he will order the Heavens to bring rain; and it shall rain; and he will order the land to sprout; and it will sprout. Their cattle will return to them with their coats the longest; their udders the fullest and their stomachs the fattest. He said: Then he will come upon some ruins; saying to it: Bring me your treasures! He will turn to leave it; and it will follow him; like drone bees. Then he will call a young man; full of youth; and he will strike him with the sword cutting him into two pieces. Then he will call him; and he will come forward with his face beaming and laughing. So while he is doing that; Eisa Bin Mariam; ﷺ ; will descend in eastern Damascus at the white minaret; between two Mahrud; with his hands on the wings of two angels. When he lowers his head; drops fall; and when raises it; gems like pearls drop from him. He said: His the Dajjals breath does not reach anyone but he dies; and his breath reaches as far as his sight. He said: So he pursues him the Dajjal and he catches up with him at the gate of Ludd where he kills him. He said: So he remains there as long as Allah wills. He said: Then Allah reveals to him: Take my slaves to AlTur; for I have sent down some creatures of Mine which no one shall be able to kill. He said: Allah dispatches Yajuj and Majuj; and they are as Allah said: They swoop down from every mount. He said: The first of them pass by the lake of Tiberias; drinking what is in it. Then the last of them pass by it saying: There was water here at one time. They travel until they reach a mountain at Bait AlMaqdis. They will say: We have killed whoever was in the earth. Come! Let us kill whoever is in the skies. They will shoot their arrows into the Heavens; so Allah will return their arrows to them red with blood. Eisa Bin Mariam and his Companions be surrounded; until the head of a bull on that day would be better to them than a hundred Dinar to one of you today. He s.a.w said: Eisa will beseech Allah; as will his companions. He said: So Allah will send AlNaghaf down upon their necks. In the morning they will find that they have all died like the death of a single soul. He said: Eisa and his companions will come down; and no spot nor hand-span can be found; except that it is filled with their stench; decay and blood. So Eisa will beseech Allah; as will his companions. So Allah will send upon them birds like the necks of Bukht milch camels. They will carry them off and cast them into an abyss. The Muslims will burn their bows; arrows and quivers for seventy years. He s.a.w said: Allah will send upon them a rain which no house of hide nor mud will bear. The earth will be washed; leaving it like a mirror. Then it will be said to the earth: bring forth your fruits and return your blessings. So on that day; a whole troop would eat a pomegranate and seek shade under its skin. Milk will be so blessed that a large group of people will be sufficed by one milking of a camel. And that a tribe will be sufficed by one milking of a cow; and that a group will be sufficed by the milking of sheep. While it is like that; Allah will send a wind which grabs the soul of every believer; leaving the remainder of the people copulating publicly like the copulation of donkeys. So Salman went to them and said: I am only a man from among you; a Persian; and you see that the Arabs obey me. If you become Muslims then you will have the likes of what we have; and from you will be required that which is required from us. If you refuse; and keep your religion; then we will leave you to it; and you will give us the Jizyah from your hands while you are submissive. He said to them in Persian: And you are other than praiseworthy and if you refuse then we will equally resist you. They said: We will not give you the Jizyah; we will fight you instead. He said: I shall not leave it; if you would like me to lead you with it then I shall do so; and if you do not like it then I shall leave you. SunanAbuDawoud-017-001-24713 | Narrated Aisha: The Prophet ﷺ called Uthman Bin Madhoun. When he came to him; he said: Uthman; did you dislike my practice ? He said: No; by Allah; but I seek your practice. He said: I sleep; I pray; I keep fast; I sometimes leave fast; and I marry women. SunanAbuDawoud-017-001-25274 | Narrated Umar Ibn AlKhattab: The Messenger of Allah ﷺ commanded us one day to give sadaqah. At that time I had some property. I said: Today I shall surpass Abu Bakr if I surpass him any day. I; therefore; brought half my property. The Messenger of Allah ﷺ asked: What did you leave for your family? I replied: The same amount. Abu Bakr brought all that he had with him. The Messenger of Allah ﷺ asked him: What did you leave for your family? He replied: I left Allah and His Apostle for them. SunanAbuDawoud-017-001-25981 | Abu said Alkhudri said : Ali sent some gold-mixed dust to the prophet ﷺ. He divided it among the four : AlAqra Bin Habis AlHanzall and then AlMujashi; uyainah Bin Badr Alfazari; zaid Alkhail AlTal; next to one of Banu nabhan; and Alqamah Bin Ulathat AlAmiri in general ; next to one of Banu kulaib. The Quraish and the ansar became angry and said : He is giving to the chiefs of the people of Najd and leaving us. He said : I am giving them for reconciliation of their hearts. Then a man with deep-seated eyes; high cheek-bones; a projecting brow; a thick beard and a shaven head came forward and said: For Allah; Muhammad! He said : Who will obey Allah if I disobey Him? Allah entrusts me with power over the inhabitants of the earth; but you do not. A man asked to be allowed to kill him and I think he was Khalid Bin AlWalid but he prevented him. Then when the man turned away; he said: From this ones stock there will be people who recite the Quran; but it will not pass down their throats. They will sever from Islam and leave the worshippers of Idols alone; but if I live up to their time I shall certainly kill them as Ad were killed. | The Chapter on Killing And Disbelivers in HodHood Indexing, Chapter on Fighting Against The Khawarij in Sunan Abu Dawoud
SunanAbuDawoud-017-001-25985 | Salamah Bin Kuhail said: Zaid Bin Wahb AlJuhani told us that he was in the army which proceeded to fight with the Khawarij in the company of Ali. Ali then said: O people! I heard the Messenger of Allah ﷺ say: there will appear from among my community people who recite the Quran; and your recitation has no comparison with their recitation; and your prayer has no comparison with their prayer; and your fasts have no comparison with their fasts. They will recite the Quran thinking that it is beneficial for them; while it is harmful for them. Their prayer will not pass their collar-bones. They will swerve from Islam as an arrow goes through the animal shot at. If the army that is approaching them knows what reward has been decided for them at the tongue of their Prophet ﷺ ; they would leave other good activities. The sign of that is that among them there will be a man who has an upper arm; but not hand; on his upper arm there will be something like the nipple of a female breast; having white hair thereon. Will you go to Muawiyah and the people of Syria; and leave them behind among your children and property? I swear by Allah; I hope these are the same people; for they shed the blood unlawfully; and attacked the cattle of the people so go on in the name of Allah. Salamah Bin Kuhail said: Zaid Bin Wahb then informed me of all the halting places one by one; saying : Until we passed a bridge. When we fought with each other; Abdullah Bin Wahb AlRasibi; who was the leader of the Khawarij; said to them: Throw away the lances and pull out the swords from their sheaths; for I am afraid they will adjure you as they had adjured on the day of Harura. So they threw away their lances and pulled out their swords; and the people pierced them with their lances. They were killed lying one on the other. On that day only two persons of the partisans of Ali were afflicted. Ali said: Search for the man with the crippled hand. But they could not find him. Then Ali got up himself and went to the people who had been killed and were lying on one another. He said: Take them out. They found him just near the ground. So he shouted: Allah is Most Great! He said: Allah spoke the truth; and His Apostle has conveyed. Ubaidat AlSalmani stood up to him; saying: Commander of the Faithful! Have you heard it from the Messenger of Allah ﷺ ? SunanAbuDawoud-017-001-26616 | Narrated Jabir Ibn Abdullah: Muhammad Ibn Ishaq said: I mentioned the story of Maiz Ibn Malik to Aasi m Ibn Umar Ibn Qatadah. He said to me:Hassan Ibn Muhammad Ibn Ali Ibn Abu Talib said to me: Some men of the tribe of Aslam whom I do not blame and whom you like have transmitted to me the saying of the Messenger of Allah ﷺ : Why did you not leave him alone? He said: But I did not understand this tradition. So I went to Jabir Ibn Abdullah and said to him : Some men of the tribe of Aslam narrate that the Messenger of Allah ﷺ said when they mentioned to him the anxiety of Maiz when the stones hurt him: Why did you not leave him alone? But I do not know this tradition. He said: My cousin; I know this tradition more than the people. I was one of those who had stoned the man. When we came out with him; stoned him and he felt the effect of the stones; he cried: O people! return me to the Messenger of Allah ﷺ. My people killed me and deceived me; they told me that the Messenger of Allah ﷺ would not kill me. We did not keep away from him till we killed him. When we returned to the Messenger of Allah ﷺ we informed him of it. He said: Why did you not leave him alone and bring him to me? and he said this so that the Messenger of Allah ﷺ might ascertain it from him. SunanAbuDawoud-017-001-26835 | Narrated Uqbah Ibn Amir: AbulHaytham quoted Dukhayn; the scribe of Uqbah Ibn Amir; saying: We had some neighbours who used to drink wine. I forbade them; but they did not stop. I then said to Uqbah Ibn Amir: These neighbours of ours drink wine; and I tried to prevent them but they did not stop; and I am going to call the police about them. He said: Leave them. I again came to Uqbah Ibn Amir and said: Our neighbours have refused to refrain from drinking wine; and I am going to call the police for them. He said: Woe to thee! Leave them alone. I heard the Messenger of Allah ﷺ say: he then mentioned the tradition to the same effect as recorded above on the authority of the narrator Muslim. I have come for no other purpose. He said: I heard the Messenger of Allah ﷺ say: If anyone travels on a road in search of knowledge; Allah will cause him to travel on one of the roads of Paradise. The angels will lower their wings in their great pleasure with one who seeks knowledge; the inhabitants of the heavens and the Earth and the fish in the deep waters will ask forgiveness for the learned man. The superiority of the learned man over the devout is like that of the moon; on the night when it is full; over the rest of the stars. A dead Muslim was brought to him and he asked: Is there any debt due from him? They the people said: Yes; two dirhams. He said: Pray yourselves over your companion. Then Abu Qatadah AlAnsari said: I shall pay them; Messenger of Allah. The Messenger of Allah ﷺ then prayed over him. He replied: No. He asked: Then one-third ? He replied: You may will away a third and third is a lot. To leave your heirs rich is better than to leave them poor begging from people. You will not spend anything; seeking thereby to please Allah; without being rewarded for it; even the mouthful you give your wife. I said: Messenger of Allah; shall I be left behind form immigration to Medina ? He said: If you remain behind after me and do good works seeking the pleasure of Allah; your rank will be raised and degree increased. Perhaps you will not remain behind; and some people will benefit from you and others will be harmed by you. He then said: O Allah; complete the immigration of my Companions and do not turn them back. MuwataMalik-017-001-34694 | Yahya related to me from Malik from Ibn Shihab from Abd AlHamid Ibn Abdulrahman Ibn Zayd Ibn AlKhattab from Abdullah Ibn Abdullah Ibn AlHarith Ibn Nawfal from Abdullah Ibn Abbas that Umar Ibn AlKhattab set out for AlSham and when he was at Sargh; near Tabuk; the commanders of the army; Abu Ubayda Ibn AlJarrah and his companions; met him and told him that the plague had broken out in AlSham. Ibn Abbas said; Umar Ibn AlKhattab said; all the first Muhajir unto me. He assembled them and asked them for advice; informing them that the plague had broken out in AlSham. They disagreed. Some said; You have set out for something; and we do not think that you should leave it. Others said; You have the companions of the Prophet; may Allah bless him and grant him peace; and the rest of the people with you; and we do not think that you should send them towards this plague. Umar said; Leave me. Then he said; Summon the Ansar to me. They were summoned and he asked them for advice. They acted as the Muhajirun had and disagreed as they had disagreed. He said; Leave me. Then he said; Summon to me whoever is here of the aged men of Quraysh from the Muhajirun of the conquest. He summoned them and not one of them differed. They said; We think that you should withdraw the people and not send them towards the plague. Umar called out to the people; I am leaving by camel in the morning; so they set out. Abu Ubayda said; Is it flight from the decree of Allah? Umar said; Better that someone other than you had said it; Abu Ubayda. Yes. We flee from the decree of Allah to the decree of Allah. What would you think if these camels had gone down into a valley which had two slopes; one of them fertile; and the other barren. If you pastured in the fertile part; wouldnt you pasture them by the decree of Allah? If you pastured them in the barren part; wouldnt you pasture them by the decree of Allah? Abdulrahman Ibn Awuf arrived and he had been off doing something and he said; I have some knowledge of this. I heard the Messenger of Allah; may Allah bless him and grant him peace; say; If you hear about it in a land; do not go forward to it. MuwataMalik-017-001-34899 | Malik related to me from Yahya Ibn Said from Said Ibn AlMusayab that Umar Ibn AlKhattab had a dispute brought to him between a muslim and a jew. Umar saw that the right belonged to the jew and decided in his favour. The jew said to him; By Allah! You have judged correctly. So Umar Ibn AlKhattab struck him with a whip and said; How can you be sure. The jew said to him; We find that there is no judge who judges correctly but that there is an angel on his right side and an angel on his left side who guide him and give him success in the truth as long as he is with the truth. When Sad Ibn Ubada returned; that was mentioned to him. Sad said; Messenger of Allah! Will it help her if I give sadaqa for her? MuwataMalik-017-001-34988 | Malik related to me that he heard the like of that from Sulayman Ibn Yasar. Malik spoke about a man who bought out one of the partners in a shared property; by paying the man with an animal; a slave; a slave-girl; or the equivalent of that in goods. Then another partner decided to exercise his right of pre-emption after that; and he found that the slave or slave-girl had died; and no one knew what her value had been. The buyer claimed; The value of the slave or slave-girl was 100 dinars. The partner with the right of pre-emption claimed; The value was 50 dinars. Malik said; The buyer takes an oath that the value of what he payed was 100 dinars. Then if the one with the right of pre-emption wishes; he can compensate him; or else he can leave it; unless he can bring a clear proof that the slave or slave-girl value is less than what the buyer said. If someone gives away his portion of a shared house or land and the recipient repays him for it by cash or goods; the partners can take it by pre-emption if they wish and pay off the recipient the value of what he gave in dinars or dirhams. If someone makes a gift of his portion of a shared house or land; and does not take any remuneration and does not seek to; and a partner wants to take it for its value; he cannot do so as long as the original partner has not been given recompense for it. If there is any recompense; the one with the right of pre-emption can have it for the price of the recompense. Malik spoke about a man who bought into a piece of shared land for a price on credit; and one of the partners wanted to possess it by right of pre-emption. Malik said; If it seems likely that the partner can meet the terms; he has right of pre-emption for the same credit terms. If it is feared that he will not be able to meet the terms; but he can bring a wealthy and reliable guarantor of equal standing to the one who bought into the land; he can also take possession. Malik said; A person absence does not sever his right of pre-emption. Even if he is a way for a long time; there is no time limit after which the right of preemption is cut off. Malik said that if a man left land to a number of his children; then one of them who had a child died and the child of the deceased sold his right in that land; the brother of the seller was more entitled to pre-empt him than his paternal uncles; the partners of his father. Malik said; This is what is done in our community. Malik said; Pre- emption is shared between partners according to their existing shares. Each of them takes according to his portion. If it is small; he has little. If it is great; it is according to that. That is if they are tenacious and contend with each other about it. Malik said; As for a man who buys out the share of one of his partners; and one of the other partners says; I will take a portion according to my share; and the first partner says; If you wish to take all the preemption; I will give it up to you. If you wish to leave it; then leave it. If the first partner gives him the choice and hands it over to him; the second partner can only take all the pre-emption or give it back. If he takes it; he is entitled to it. If not; he has nothing. Malik spoke about a man who bought land; and developed it by planting trees or digging a well etc.; and then someone came; and seeing that he had a right in the land; wanted to take possession of it by pre-emption. Malik said He has no right of preemption unless he compensates the other for his expenditure. If he gives him the price of what he has developed; he is entitled to pre- emption. If not; he has no right in it. Malik said that someone who sold off his portion of a shared house or land and then; on learning that some one with a right of pre-emption was to take possession by that right; asked the buyer to revoke the sale; and he did so; did not have the right to do that. The pre-emptor has more right to the property for the price for which he sold it. In the case of some one who bought along with a section of a shared house or land; an animal and goods that were not shared ; so that when any one demanded his right of pre-emption in the house or land he said; Take what I have bought altogether; for I bought it altogether; Malik said; The pre-emptor need only take possession of the house or land. Each thing the man bought is assessed according to its share of the lump sum the man paid. Then the pre-emptor takes possession of his right for a price which is appropriate on that basis. He does not take any animals or goods unless he wants to do that. Malik said; If someone sells a section of shared land; and one of those who have the right of preemption surrenders it to the buyer and another refuses to do other than take his pre-emption; the one who refuses to surrender has to take all the preemption; and he cannot take according to his right and leave what remains. In the case where one of a number of partners in one house sold his share when all his partners were away except for one man; the one present was given the choice of either taking the pre-emption or leaving it; and he said; I will take my portion and leave the portions of my partners until they are present. If they take it; that is that. If they leave it; I will take all the pre-emption; Malik said; He can only take it all or leave it. If his partners come; they can take from him or leave it as they wish. If this is offered to him and he does not accept; I think that he has no pre-emption. | The Chapter on Throwing And Land And Property in HodHood Indexing, The Book of Dress in Muwata Malik
MuwataMalik-017-001-35057 | Yahya related to me from Malik from Ibn Shihab from Said Ibn AlMusayab that the Messenger of Allah; may Allah bless him and grant him peace; forbade muzabana and muhaqala. Muzabana was selling fresh dates for dried dates. Muhaqala was buying unharvested wheat in exchange for threshed wheat and renting land in exchange for wheat. Ibn Shihab added that he had asked Said Ibn AlMusayab about renting land for gold and silver. He said; There is no harm in it. Malik said; The Messenger of Allah; may Allah bless him and grant him peace; forbade muzabana. The explanation of muzabana is that it is buying something whose number; weight and measure is not known with something whose number; weight or measure is known; for instance; if a man has a stack of food whose measure is not known; either of wheat; dates; or whatever food; or the man has goods of wheat; date kernels; herbs; safflower; cotton; flax; silk; and does not know its measure or weight or number and then a buyer approaches him and proposes that he weigh or measure or count the goods; but; before he does; he specifies a certain weight; or measure; or number and guarantees to pay the price for that amount; agreeing that whatever falls short of that amount is a loss against him and whatever is in excess of that amount is a gain for him. That is not a sale. It is taking risks and it is an uncertain transaction. It falls into the category of gambling because he is not buying something from him for something definite which he pays. Everything which resembles this is also forbidden. Malik said that another example of that was; for instance; a man proposing to another man; You have cloth. I will guarantee you from this cloth of yours so many hooded cloaks; the measureof each cloak to be such-and-such; naming a measurement. Whatever loss there is; is against me and I will fulfill you the specified amount and whatever excess there is; is mine. Or perhaps the man proposed; I will guarantee you from this cloth of yours so many shirts; the measurement of each shirt to be such-and-such; and whatever loss there is; is against me and I will fulfill the specified amount and whatever excess there is; is mine. Or perhaps a man proposed to a man who had cattle or camel hides; I will cut up these hides of yours into sandals on a pattern I will show you. Whatever falls short of a hundred pairs; I will make up its loss and whatever is over is mine because I guaranteed you. Another example was that a man say to a man who had ben-nuts; I will press these nuts of yours. Whatever falls short of such-and-such a weight by the pound; I will make it up; and whatever is more than that is mine. Malik said that all this and whatever else was like it or resembled it was in the category of muzabana; which was neither good nor permitted. It was also the same case for a man to say to a man; who had fodder leaves; date kernels; cotton; flax; herbs or safflower; I will buy these leaves from you in exchange for such-and-such a sa; indicating leaves which are pounded like his leaves.. or these date kernels for such-and-such a sa of kernels like them; and the like of that in the case of safflower; cotton; flax and herbs. Malik said; All this is what we have described of muzabana. | The Chapter on Muzabana In Agriculture Products in HodHood Indexing, The Book of Madina in Muwata Malik
MuwataMalik-017-001-35071 | Yahya related to me from Malik from Ibn Shihab from Malik Ibn Aus Ibn AlHadathan AlNasri that one time he asked to exchange 100 dinars. He said; Talha Ibn Ubaydullah called me over and we made a mutual agreement that he would make an exchange for me. He took the gold and turned it about in his hand; and then said; I cant do it until my treasurer brings the money to me from AlGhaba. Umar Ibn AlKhattab was listening and Umar said; By Allah! Do not leave him until you have taken it from him! Then he said; The Messenger of Allah; may Allah bless him and grant him peace; said; Gold for silver is usury except hand to hand. Wheat for wheat is usury except hand to hand. Dates for dates is usury except hand to hand. Barley for barley is usury except hand to hand. Malik said; When a man buys dirhams with dinars and then finds a bad dirham among them and wants to return it; the exchange of the dinars breaks down; and he returns the silver and takes back his dinars. The explanation of what is disapproved of in that is that the Messenger of Allah; may Allah bless him and grant him peace; said; Gold for silver is usury except hand to hand. and Umar Ibn AlKhattab said; If someone asks you to wait to be paid until he has gone back to his house; do not leave him. When he returns a dirham to him from the exchange after he has left him; it is like a debt or something deferred. For that reason; it is disapproved of; and the exchange collapses. Umar Ibn AlKhattab wanted that all gold; silver and food should not be sold for goods to be paid later. He did not want there to be any delay or deferment in any such sale; whether it involved one commodity or different sorts of commodities. | The Chapter on Financial Transaction And Food in HodHood Indexing, The Book of Drinks in Muwata Malik
MuwataMalik-017-001-35136 | Malik said; The inheritance of a husband from a wife when she leaves no children or grandchildren through sons is a half. If she leaves children or grandchildren through sons; male or female; by her present or previous husbands; the husband has a quarter after bequests or debts. The inheritance of a wife from a husband who does not leave children or grandchildren through sons is a quarter. If he leaves children or grandchildren through sons; male or female; the wife has an eighth after bequests and debts. That is because Allah; the Blessed; the Exalted! said in His Book; You have a half of what your wives leave if they have no children. If they have children; you have a fourth of what they leave after bequests and debts. They have a fourth of what you leave if you have no children. If you have children; they have an eighth after bequests or debts. MuwataMalik-017-001-35137 | Malik said; The generally agreed on way of doing things among us about which there is no dispute and what I have seen the people of knowledge in our city doing is that when a father inherits from a son or a daughter and the deceased leaves children; or grandchildren through a son; the father has a fixed share of one sixth. If the deceased does leave any children or male grandchildren through a son; the apportioning begins with those with whom the father shares in the fixed shares. They are given their fixed shares. If a sixth or more is left over; the sixth and what is above it is given to the father; and if there is less than a sixth left; the father is given his sixth as a fixed share; i.e. the other shares are adjusted. The inheritance of a mother from her child; if her son or daughter dies and leaves children or male or female grandchildren through a son; or leaves two or more full or half siblings is a sixth. If the deceased does not leave any children or grandchildren through a son; or two or more siblings; the mother has a whole third except in two cases. One of them is if a man dies and leaves a wife and both parents. The wife has a fourth; the mother a third of what remains; which is a fourth of the capital. The other is if a wife dies and leaves a husband and both parents. The husband gets half; and the mother a third of what remains; which is a sixth of the capital. That is because Allah; the Blessed; the Exalted; says in His Book; His two parents each have a sixth of what he leaves if he has children. If he does not have children; and his parents inherit from him; his mother has a third. If he has siblings; the mother has a sixth. Surat 4 ayat 11. The sunna is that the siblings be two or more. | The Chapter on Inheritance And Shares in HodHood Indexing, The Book of Blood Money in Muwata Malik
MuwataMalik-017-001-35426 | Yahya related to me from Malik that it reached him that a slave of Abdullah Ibn Umar escaped and one of his horses wandered off; and the idol worshippers seized them. Then the Muslims recaptured them; and they were returned to Abdullah Ibn Umar; before the division of the spoils took place. I heard Malik say about muslim property that had been seized by the enemy; If it is noticed before the distribution; then it is returned to itsowner. Whatever has already been distributed is not returned to anyone. Malik; when asked about a man whose young male slave was taken by the idol worshippers and then the Muslims re-captured him; said; The owner is more entitled to him without having to pay his price or value or having to incur any loss before the distribution takes place. If the distribution has already taken place then I think that the slave belongs to his master for his price if the master wants him back. Regarding an umm walad of a Muslim man who has been taken by the idol worshippers and then recaptured by the Muslims and allotted in the distribution of spoils and then recognised by her master after the distribution; Malik said; She is not to be enslaved. I think that the Imam should pay a ransom for her for her master. If he does not do it; then her master must pay a ransom for her and not leave her. I do not think that she should be made a slave by whoever takes her and intercourse with her is not halal. She is in the position of a free woman because her master would be required to pay compensation if she injured somebody and so she is in the same position as a wife. He must not leave the mother of his son to be enslaved nor may intercourse with her be made halal. Malik was asked about a man who went to enemy territory to pay ransom or to trade; and he bought a free man or a slave; or they were given to him. He said; As for the free man; the price he buys him for is a debt against the man and he is not made a slave. If the captive is given to him freely; he is free and owes nothing unless the man gave something in recompense for him. That is a debt against the free man; the same as if a ransom had been paid for him. As for a slave; his former master can choose to take him back and pay his price to the man who bought him or he can choose to leave him; as he wishes. If he was given to the man; the former master is more entitled to him; and he owes nothing for him unless the man gave something for him in recompense. Whatever he gave for him is a loss against the master if he wants him back. | The Chapter on Slaves And Praise And Worship in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35463 | Yahya related to me from Malik from Ibn Shihab from Amra bint Abdulrahman that when Aisha was doing itikaf she would only ask after sick people if she was walking and not if she was standing still. Malik said; A person doing itikaf should not carry out obligations of his; nor leave the Masjid for them; nor should he help anyone. He should only leave the Masjid to relieve himself. If he were able to go out to do things for people; visiting the sick; praying over the dead and following funeral processions would be the things with the most claim on his coming out. Malik said; A person doing itikaf is not doing itikaf until he avoids what some one doing itikaf should avoid; namely; visiting the sick; praying over the dead; and entering houses; except to relieve himself. | The Chapter on Ramadan And Fasting And Kabah in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35721 | Malik said; Someone who has a nosebleed on the day of jumua while the imam is giving the khutba and he leaves and does not come back until the imam has finished the prayer; should pray four rakas. Malik said that someone who prayed a raka with the imam on the day of jumua; then had a nosebleed and left and came back and the imam had prayed both rakas; should complete the prayer with another raka as long as he had not spoken. Malik said; If some one has a nosebleed; or something happens to him and he has no alternative but to leave; he does not have to ask permission of the imam if he wants to leave on the day of jumua. | The Chapter on Bowing In Prayers And Mina And Alqiblah in HodHood Indexing, The Book of Hajj in Muwata Malik
MuwataMalik-017-001-35772 | Yahya related to me from Malik; from Jafar Ibn Muhammad; from his father; that AlMiqdad Ibn AlAswad once went to see AIi Ibn Abi Talibat AlSuqya; where he was feeding some young camels of his with a mash of meal and leaves; and he said to him; This man Uthman Ibn Affan is telling people that they cannot do hajj and umra together. AlMiqdad said; Ali Ibn Abi Talib went off with bits of meal and leaves on his forearms - and I shall never forget the sight of the meal and the leaves on his arms - and went to see Uthman Ibn Affan and asked him; Are you saying then that people cannot do hajj and umra together? Uthman replied; That is my opinion. Whereupon AIi got angry and went out saying; I am at your service; O Allah; I am at your service for a hajj and an umra together. Malik said; Our position here in Madina is that someone who does hajj and umra together should not remove any of his hair; nor should he come out of ihram in any way until he has sacrificed an animal; if he has one. He should come out of ihram at Mina; on the day of the sacrifice. | The Chapter on Mina In Alhajj in HodHood Indexing, The Book of Hajj in Muwata Malik
MuwataMalik-017-001-35856 | Yahya related to me from Malik from Yahya Ibn Said that Umar Ibn AlKhattab refused to let one man who had not taken leave of the House pass AlDhahran; a valley eighteen miles from Makka until he had taken leave of it. | The Chapter on Leave in HodHood Indexing, The Book of Business Transactions in Muwata Malik
MuwataMalik-017-001-35962 | Yahya related to me from Malik that Yahya Ibn Said heard Ata Ibn Abi Rabah mentioning that the camel-herders were allowed to throw the stones at night; and saying that this was in the early period of Islam. Malik said; The explanation of the hadith where the Messenger of Allah; may Allah bless him and grant him peace; allowed the camel-herders to delay the stoning of the jamras is; in our view; and Allah knows best; that they threw stones on the day of sacrifice; and then threw again two days later; which was the first possible day for leaving; and this throwing was for the day which had passed. They then threw again for the day itself; because it is only possible for someone to make up for something which is obligatory for him; and when something obligatory passes someone by without him doing it he must necessarily make it up afterwards and not beforehand. So in the case of the camel-herders ; if it seemed appropriate for them to leave that day; they would have done all that they were supposed to do; and if they were to stay until the following day; they would throw stones with everybody else on the second and last day for leaving; and then leave. | The Chapter on Special Days And Forbidden Deeds in HodHood Indexing, The Book of Fasting in Muwata Malik
MuwataMalik-017-001-35966 | Yahya related to me from Abdulrahman Ibn AlQasim; from his father that Aisha; umm Almuminin; said; We set out with the Messenger of Allah; may Allah bless him and grant him peace; in the year of the farewell hajj and we went into ihram for umra. Afterwards; the Messenger of Allah; may Allah bless him and grant him peace; said; Whoever has a sacrificial animal with him should go into ihram for hajj and umra together; and he should not leave ihram without leaving ihram for both of them at the same time. She continued I was menstruating when I got to Makka; so I did not do tawaf of the House or say between Safa and Marwa. I complained to the Messenger of Allah; may Allah bless him and grant him peace; and he said; Undo your hair and comb it and leave the umra and go back into ihram for the hajj. She said; I did so; and when we had completed the hajj; the Messenger of Allah; may Allah bless him and grant him peace; sent me with Abdulrahman Ibn Abi Bakr AlSiddiq to AlTanim and I performed an umra and he said; This is in place of your umra. Those who had entered ihram for the umra did tawaf of the House and say between Safa and Marwa; then left ihram. Then they did another tawaf after returning from Mina for their hajj; whereas those who entered ihram for the hajj or combined the hajj and the umra; only did one tawaf.
