7. Abu Huraira Allah be pleased with him reported: The people of the Khuzaah tribe killed a man of the tribe of Laith in the Year of Victory as a retaliation for one whom they had killed whom the people of the tribe of Laith had killed. It was reported to Allah Messenger ﷺ. He mounted his camel and delivered this address: Verily Allah; the Exalted and Majestic; held back the Ele- phants from Mecca; and gave its domination to His Messenger and believers. Behold; it was not violable for anyone before me and it will not be violable for anyone after me. Behold; it was made violable for me for an hour of a day; and at this very hour it has again been made inviolable for me as well as for others. So its thorns are not to be cut; its trees are not to be lopped; and no one is allowed to pick up a thing dropped; but the one who makes an announcement of it. And one whose fellow is killed is allowed to opt between two alternatives: either he should receive blood-money or get the life of the murderer in return. He the narrator said : A person from the Yemen; who was called Abu Shah; came to him and said: Messenger of Allah; write it down for me; whereupon he Allah Messenger said: Write it down for Abu Shah. 8. Narrated Ibn Abbas: The law of Qisas i.e. equality in punishment was prescribed for the children of Israel; but the Diya i.e. blood money was not ordained for them. So Allah said to this Nation i.e. Muslims : O you who believe! The law of AlQisas i.e. equality in punishment is prescribed for you in cases of murder: The free for the free; the slave for the slave; and the female for the female. But if the relatives or one of them of the killed person forgive their brother i.e. the killers something of Qisas i.e. not to kill the killer by accepting blood money in the case of intentional murder --then the relatives of the killed person should demand blood-money in a reasonable manner and the killer must pay with handsome gratitude. Abu Laila Abdullah Bin Abdulrahman Bin Sahl reported that the elderly persons of the tribe had informed Sahl Bin Abu Hathma that Abdullah Bin Sahl and Muhayisa went out to Khaibar under some distress which had afflicted them. Muhayisa came and informed that Abdutlah Bin Sahl had been killed; and his dead body had been thrown in a well or in a ditch. He came to the Jews and said: By Allah; it is you who have killed him. 4. It has been narrated on the authority of Abd AlAziz Bin Abu Hazim; who learnt from his father Abu Hazim. The latter heard it from Sahl Bin Saad who was asked about the injury which the Messenger of Allah ﷺ got on the day of the Battle of Uhud. He said: The face of the Messenger of Allah ﷺ was injured; his front teeth were damaged and his helmet was crushed. Fatima; the daughter of the Messenger of Allah ﷺ ; was washing the blood from his head ; and Ali Bin Abu Talib was pouring water on it from a shield. When Fatima saw that the bleeding had increased on account of pouring water on the wound ; she took a piece of mat and burnt it until it was reduced to ashes. Narrated Ziyad Ibn Saad Ibn Dumayrah AlSulami: On the authority of his father Sad and his grandfather Dumayrah according to Mousa version who were present in the battle of Hunayn with the Messenger of Allah ﷺ : After the advent of Islam; Muhallam Ibn Jaththamah AlLaythi killed a man of Ashja. That was the first blood-money decided by the Messenger of Allah ﷺ for payment. Uyaynah spoke about the killing of AlAshjai; for he belonged to Ghatafan; and AlAqra Ibn Habis spoke on behalf of Muhallam; for he belonged to Khunduf. The voices rose high; and the dispute and noise grew. So the Messenger of Allah ﷺ said: Do you not accept blood-money; Uyaynah? Uyaynah then said: No; I swear by Allah; until I cause his women to suffer the same fighting and grief as he caused my women to suffer. Again the voices rose high; and the dispute and noise grew. The Messenger of Allah ﷺ said: Do you not accept the blood-money Uyaynah? Uyaynah gave the same reply as before; and a man of Banu Layth called Mukaytil stood up. He had a weapon and a skin shield in his hand. He said: I do not find in the beginning of Islam any illustration for what he has done except the one that some sheep came on; and those in the front were shot; hence those in the rear ran away. Abu Salamah added: He Muhallam then got up while he was wiping his tears with the end of his garment. 6. Sahl Bin Abi Hathmah and some senior men of the tribe told that Abdullah Bin Abi Sahl and Muhayasah came to Khaibar on account of the calamity i.e. famine that befall them. Muhayasah came and told the Abdullah Bin Sahl had been killed and thrown in a well or stream. He hen came to the Jews and said: I swear by Allah; you have killed him. They said: We swear by Allah; we have not killed him. He then proceeded and came to his tribe and mentioned this to them. The Messenger of Allah ﷺ then said to him: Let the eldest speak ; let the eldest speak ; meaning age. So Huwayasah spoke; and after him Muhayasah spoke. The Messenger of Allah ﷺ then said: They should either pay the bloodwit for you friend or they should be prepared for war. So the Messenger of Allah ﷺ wrote to them about it. They wrote in reply : We swear by Allah; we have not killed him. The Messenger of Allah ﷺ then said to Huwayasah; Muhayasah and Abdulrahman Will you take an oath and thus have the claim to the blood of your friend ? They said: No. He the Prophet said: The Jews will then take an oath. They said: They are not Muslims. Then the Messenger of Allah ﷺ himself paid the bloodwit.
